I-Team: FAA Waives Rule For Life Saving Equipment As CBS4 I-Team Investigator Stephen Stock discovered, every day more than one hundred commercial airplane flights to the Caribbean may not carry the type of survival gear passengers have come to expect. That’s because the FAA routinely waives the rules requiring life rafts and allows commercial aircraft to fly over the ocean without them. It’s a policy that goes back decades. Even if you fly a lot you likely don’t know about it.

Reporting Stephen Stock SStock@cbs.com MIAMI (CBS4) – Few will forget the watershed moment in US aviation history when a US Airways jet glided to a safe landing in the middle of the Hudson River in January of 2009. Bill Elkins certainly won’t. He was a passenger aboard Flight 1549, a flight that will forever be known as the Miracle on the Hudson. “I wasn’t thinking about hitting the water. I was thinking about my wife and kids,” said Elkins. “Once I came to and realized I was still on the plane and it was filling up with water, to me that was more terrifying than the thought of the plane crash. Because at that point I thought I had a pretty good shot of drowning inside the airplane.” What few people know is that the Miracle on the Hudson might have been a disaster. Those who were there say many might have died or been seriously injured but for one detail most of us probably didn’t know about… there were life rafts on board the airplane, allowing everyone to get out safely in the freezing waters of the Hudson River. Chesley “Sully” Sullenberger piloted that miracle flight. “I absolutely believe it made a big difference on the flight. Had we not had life rafts and only seat cushions for flotation I think it’s likely we would not have had a good outcome.” What’s more the Miracle on the Hudson was a flight scheduled to travel over land from New York to Charlotte. “I think flight 1549 two-and-a-half years ago proves that water landings can result in survival of everyone on the airplane, if there are slide rafts or life rafts in addition to life vests,” Sullenberger said.

Of the hundreds that may be flying without life rafts, the CBS4 I-Team knows that several commercial flights have actually flown over water to islands in the Caribbean without them on board. William “Bill” McGee is an Aviation Consumer Advocate. “It does raise a concern. Absolutely.” McGee is the travel consultant for the Consumers Union based in New Haven, Connecticut. “The idea that we would compromise the margin of safety by removing life rafts from commercial aircraft, it’s quite dangerous,” McGee warned. But that is exactly what’s happening. The CBS4 I-Team discovered that the Federal Aviation Administration routinely waives the rule requiring life rafts on airplanes flying over the ocean. With the waivers, 18 different commercial airlines are allowed to fly all over the Caribbean with no life rafts on board. Although they do use seat cushions and individual life vests. “Most domestic flights now are operated by airplanes that do not have life rafts or life vests… only seat cushions for flotation… and that’s just not as good in a water landing as life rafts are, even if the temperatures are moderate. Because hypothermia in water can be an issue so quickly even water that’s relatively warm,” said Captain “Sully.” Experts tell us airlines don’t always carry life rafts because they are costly to maintain, inspect and add extra weight to planes causing them to use more fuel. “I think its part of a larger pattern with the FAA at times being more concerned about the economic health of the airline industry than being concerned with passengers that pay for the ticket,” explained McGee.

The I-Team then compiled a database of more than 100 daily flights from Miami, New York, Dallas and Chicago that have actual daily commercial routes listed by major US airlines on their web sites to places all over the Caribbean as far away as Aruba and Curacao. All but two of those routes use airplanes listed on the FAA’s waiver list. That means they don’t need to carry life rafts on board the aircraft to comply with the FAA rules. “We do find it disturbing because the fact is that this equipment can save lives,” said Veda Shook, President of the Association of Flight Attendants. The organization represents nearly 60 thousand employees at 23 airlines. “It’s a strange loophole that the equipment is required but that a request for a deviation can be made. So the Association of Flight Attendants believes that in every case where it’s mandated that that equipment needs to remain onboard,” Shook said. “The blame rests with the FAA itself,” Gabe Bruno told Stock. Bruno served as an operations inspector and regional manager for the FAA for 28 years,

before retiring in 2006. “Just because the aircraft is going to ditch in the water doesn’t mean that it’s a fatal accident,” Bruno explained. Bruno now serves as an aviation safety consultant and heads the FAA whistleblowers alliance. “Wouldn’t it be a horrendous thing to survive the crash and then die because of the elements?” asked Bruno. The CBS4 I-Team contacted the major US airlines to get their take on this issue. All of them insist they fly safe and obey the FAA’s rules and waivers as currently written. They wouldn’t tell us specifically which flights over the Caribbean carry life rafts and which ones do not. The FAA insists these waivers don’t risk the public’s safety. Meantime, retired airline pilot Captain Sully Sullenberger is pushing Congress and the FAA to require life rafts on all flights, whether they are scheduled to fly over the ocean or not.

Program Giving People With Criminal Records A Second Chance Garcia explains “I was really just defending myself but that’s the way it came out,” Garcia explained to CBS4’s David Sutta. Police arrested him. It landed on his record and it’s haunts him every time he interviews for a job. “After they have checked your record they say oh we’ll get back with you,” Garcia said. At this one stop shop put on by the State Attorney Office, people with minor charges can get them expunged or sealed. Reporting David Sutta dsutta@cbs.com MIAMI (CBS4) – A program by the MiamiDade State Attorney’s Office is offering people who have criminal records a leg up in an already tough job market. “They are providing people the opportunity for a second chance, for those of us who have made a mistake in life.” Garcia says. His mistake was a fight he had a long time ago.

“You can expunge anyone of the three.” a case worker explained to Garcia. In other words he’s getting a fresh start. “Somewhere between 50 and 70 percent of the folks qualify for the process,” Leo Mendoza with the State Attorney’s Office explained. Miami-Dade is the only county in Florida that does this. Typically you would need a lawyer and a decent amount of money. Here, it’s free. “I’m happy. I’m grateful,” Gerald Baker told

Small Cars Equal Big Gas Savings “It’s definitely very important because I commute 20 minutes each way so I’m looking for something that’s going to save on gas as well,” Larrame told the car salesman. The base-model of this new small Chevy gets up to 40 miles per gallon with a 6 speed manual transmission. She also wants something that’s roomy, drives well and gets the best fuel economy possible.

Melissa said that saving money at the gas pump is a major goal of new car shoppers. “I definitely think they are going to go small being the way the economy is and people are trying to cut back in certain areas and fuel is one area they can cut. It is something they are definitely going to cut those costs in,” said Larrame. Ford’s also working on its electric car and just announced a 3 cylinder small car, capable of approaching 50 miles per gallon. Melissa Larrame’s paying a lot of attention to the new U.S. made small cars that are competing with foreign carmakers. But she’s still not sure what’s right for her. “American cars are definitely on the up and up,” said Larrame. “At this point would you rather buy American? I haven’t decided yet.” Most of the new, smaller models include the latest safety technology and have done pretty well in their crash tests. Florida Part Of Lean Cuisine Package Mislabeling Recall The company said fewer than 200 packages of Lean Cuisine Dinnertime Selects Lemon Garlic Shrimp were inadvertently placed into packaging for Lean Cuisine Dinnertime Selects Chicken Fettuccini and possibly shipped to grocers in Florida, Alaska, Idaho, Oregon and Washington State.

Reporting Lisa Cilli MIAMI (CBSMiami) – The parent company of Lean Cuisine has issued a voluntary recall of one of its boxed frozen meals, and Florida is one of the states affected by the recall. Nestlé Prepared Foods Co. is recalling selected packages of its Lean Cuisine Dinnertime Selects Chicken Fettuccini after a small number of the boxes were mislabeled.

Nestle is voluntarily recalling the product out of an abundance of caution, noting that consumption of shrimp by consumers with an allergy to shellfish could lead to a serious or life-threatening reaction. So far no illnesses or allergic reactions have been reported. The specific product affected by the recall is Lean Cuisine Dinnertime Selects Chicken Fettuccini, with UPC code 13800-14880. The affected product also has a production code of 1253595911G and a “best before” date of October 2012. Nestlé says consumers can get a full refund by calling Nestlé Consumer Services from 8 a.m. to 8 p.m. Monday through Friday at 1800-542-6935.

Dogs Abandoned In S. Florida Find New Hope With Rescue Groups You can’t blame Duke for begging. He weighs 47 pounds, and is slightly underweight. But that is a miracle, considering six weeks ago he weighed half that, and looked horrible. His ribs and hip bones stuck out through his skin, and his face was gaunt and weary. “It’s the single most emaciated dog I’ve ever seen that survived,” Dr. Hack told CBS4’s Natalia Zea. Dr. Hack and her staff nursed Duke back to health after a rescue group took him out of the Miami-Dade Animal Shelter a month and a half ago. “He was extremely sick,” said Dr. Hack. “He had an upper respiratory disease and was full of parasites.”

Reporting Jorge Estevez jestevez@cbs.com BOCA RATON (CBS4) – Boca Veterinary Clinic veterinarian Dr. Lesley Hack chuckles as she feeds dog treats to an eager 10-month-old brown terrier mix named Duke. “Don’t worry we won’t run out of food,” she laughs.

And Dr. Hack believes a human owner caused this suffering because Duke’s stomach was empty- no trash, no scraps, nothing a normal stray would have eaten. “This dog didn’t pass any abnormal material which made me think he had been in a home and simply had not been fed,” predicted Dr. Hack. “It’s despicable.” Duke was found on the street with his brother Bo who was also starving. A Lighthouse Point rescue group took Bo in, and is still looking for a loving home for him.

For Duke, the recovery has been long and tough. Soon he will fly to the “From Stetson With Love” dog rescue group in Washington State that has been paying his bills. They will make sure he will finally belong to a family that deserves him. Despite the vet giving a big discount for Duke’s care, the costs add up. While they are convenient, the little pods go into a box and later you throw the box away. So where do all those pods go after you’re done with them? That’s what has environmentalists concerned. “Our concern is that they are not recyclable and that means they end up in landfills and incinerators and impact our health.” said Cindy Loopee with Clean Water Action. “The emissions end up in the air we breath and in the water we breath. It is hard to recycle because of the multiple materials.” Those materials include the plastic cup, the aluminum foil to keep the coffee fresh and then a separate filter. Loopee pointed out, “It is also typically too small to be recycled. The trend is that larger materials are accepted in recycling programs.” The Keurig Coffee company, which makes the popular single serving K-Cups, knows

they have an issue. The company issued this statement. “Finding a more environmentally friendly approach to this packaging challenge is a big priority for us. We are working on a few different fronts to improve the environmental characteristics of the K-cup system.” – Keurig Coffee Co. A system that works for some in South Florida is because of the convenience of it all… for now trumping any environmental concerns. “It doesn’t think. The caffeine is what I am looking for right? What used to seem impossible many years ago could soon be installed in your own household. Experts are introducing these products as “Smart Appliances”. In fact, some appliances might even be

Molly Wood from CNET.com introduced some of the new appliances. “Most likely, they’ll be able to save you both time and money.” A new type of refrigerator made by Samsung has an 8-inch, LCD, touch screen that allows you to use a variety of applications.

“It can actually give you your calendar, your weather report, the latest news. It can play music, and you can even leave little notes, or send a tweet,” Wood explained. How about a vacuum cleaner that remembers the blueprint of your home? LGs “Hom-Bot” (Home-Bot) cleans up the crumbs and remembers the floor plan in your house for the future. “If you connect to it over Wi-Fi with your smart phone, you could actually see a live stream from the cameras,” bragged Wood. Whirlpool designed a washer and dryer featuring a USB port that allows you to view the stains disappear from your pots and pans, all from the screen on your home computer. “That actually lets you connect a USB stick to it if you want to add program information.” Molly Wood explained how that would work. “So, for example, you could program the washer/dryer to deal with certain kinds of stains, or certain

kinds of fabrics.” “I easily do 20 loads of laundry a week, so I think that that technology is brilliant,” exclaimed Gold. There are even products that can save you a little money. The “GE Nucleus” allows you to track your energy consumption on a minute-by-minute basis by plugging it directly into the wall. It then communicates with a special smart meter to give you the readings. “You have a little application that runs either on your computer or your smart phone, and it really helps you kind of do a little bit of an audit in terms of what you use, when you use it, things you might be able to turn off,” Wood said. But these products are not sold at a cheap price. They range in price from $150 for the GE Nucleus energy tracker, to more than $3,000 for the Samsung Refrigerator.

3-D Breast Imaging Comes To South Florida current digital mammography machine but the digital machines are more like highdefinition television without the glasses, or as one doctor said, “it’s like putting on a mask and going under water.” Tanya Terry opted for the 3-D mammography, “Because it’s better. Better technology means better testing.”

What’s different is that traditional digital mammogram x-rays the breast. 3-D imaging allows you to look through each slice of the breast, making the reading much more accurate.

MIAMI (CBS4) – The wave of the future in mammograms is here. The traditional digital mammograms are being replaced with 3D technology.

“It has been a huge, huge advance,” said Dr. German Fraynd. “The new machine will catch problems about 20 to 22 percent of the time more than the digital mammograms.”

It’s called tomosynthesis, a word that will become common place throughout the next few years.

The machine can also rule out something that may be questionable.

According to CBS4 Health Reporter Cynthia Demos, it looks similar to the

Radiologist Dr. Eric Godreau found something in Tanya’s mammogram that typically would have concerned him and

worried Tanya. But the tomosynthesis was able to show that there was nothing to fear. “You look here and it looks like it’s cancer,” Dr. Godreau explained. “But the tomo showed that it is all blend in. So it’s nothing.” Tanya was immediately relieved. ”It gives you a clearer image of your breast. I don’t think I’d ever have a regular 2-D mammo again.”

If you don’t have insurance this new diagnostic machine will typically run you about $300. If you have insurance it’s an extra $99. That’s a price Tanya says is worth paying. At the moment, the only 3-D mammograms offered in South Florida is available at the Comprehensive Breast Care Center in Aventura and Memorial Regional Hospital’s Women’s Imaging Center in South Broward.

MIAMI (CBSMiami.com) – The lobby of the Stephen P. Clark Center in Downtown Miami resembled a fresh market on Tuesday in honor of National Food Day.

Fraga’s mother said the activities are a good idea.

The county’s Cooperative Extension put together the day’s activities in an effort to get people more fresh fruits and veggies along with supporting local farms. Participant Briana Fraga,9, said it’s best to consume fruits and vegetables everyday. “I guess it helps you live longer,” she said. “I have a great grandmother that’s 101.” Those stopping by the lobby were treated to food demonstrations and tastings by Johnson & Wales Culinary School chefs. Bee Heaven Farm was selling local honey and tomato transplants while members of

The National Food Day effort was organized by the Center for Science in the Public Interest; a non-profit watchdog group that since 1971 has led successful fights for food labeling, better nutrition and safer food.

Demos spoke with several lawyers in Florida who are filing lawsuits on behalf of their patients suffering dislocation, revisions, additional surgery, loss of jobs and some permanently disabled. The attorneys told Demos the lawsuits are in their infancy.

“The problem is most of these devices have never undergone human testing prior to getting on the market. Hip replacements and knee replacements are unique in that, to really prove that you’re good, you need big numbers of patients to walk around on these things for 30 to 40 years,” one doctor explained to Demos.

“They don’t really know, they being the medical community, what those elevated levels can do to your system,” said Ayers.

The device was recalled by the company last year. Katie has since gotten a new hip replacement.

Katie Ayers has her own opinion. “I think there’s got to be a better way than what’s already out there.”

Reports show Katie’s hip, the Depuy A-SR, failed in nearly one-third of patients in Britain within six years.

“I thought I was gonna have 15, 20 years before I had to do it again,” she said.

Katie’s blood levels are back to normal. But like thousands of others, she worries that damage has already been done.

Report: Rich Keep Getting Richer In U.S. The percentage grew from 35.6 percent in 2010. The overall global wealth was pegged at $231 trillion, according to Credit Suisse. As the middle class and lower class struggle to put food on the table, Credit Suisse found that the millionaires in the world saw their wealth grow by $20 trillion dollars in the last year.

The study also found that in June 2011, there were 84,700 ultra high net worth individuals, which was defined as having net assets exceeding $50 million.

MIAMI (CBSMiami.com) – If you’ve driven past the mansions on Miami Beach or in Coral Gables, the phrase the rich keep getting richer may not be a surprise.

The overall numbers have rapidly increased in recent years and the U.S. claimed the title for the greatest number of richest citizens, with 35,400.

According to a new report from the Credit Suisse Research Institute, the millionaires in the world now control 38.5 percent of global household wealth.

Credit Suisse found that in terms of average wealth per adult, the U.S. isn’t in the top 3. According to the study, Switzerland, Australia, and Norway are the three richest nations in the world.

Postal Service: Stamp Prices Are Going Up Reporting Shaneeva Yassin MIAMI (CBS4)- The cost of mailing a letter is once again going up across South Florida. That’s because the US Postal Service announced Tuesday it will be increasing postage rates. The increase is expected to take course in January 22, 2012 by one cent — to 45cents. It’s the first price change for FirstClass Mail stamps in more than two and a half years, the USPS said. The new 45-cent price for Forever stamps is among price changes filed with the Postal Regulatory Commission Tuesday. The move comes at a time the postal service is dealing with major financial issues. Highlights of the new single-piece FirstClass Mail pricing include: • Letters (1 oz.) – 1-cent increase to 45 cents

• Letters additional ounces – unchanged at 20 cents • Postcards – 3-cent increase to 32 cents • Letters to Canada or Mexico (1 oz.) – 5cent increase to 85 cents • Letters to other international destinations – 7-cent increase to $1.05 Prices also will change for other mailing services, including Standard Mail, Periodicals, Package Services and Extra Services, according to the USPS. Tuesday’s announcement does not affect Express Mail and Priority Mail prices. Suck For Luck A Dangerous Game

Reporting Tim Kephart MIAMI (CBSMiami.com) – The muchballyhooed “Suck for Luck” sweepstakes is the hot issue on the tongues of many Miami Dolphins fans after an 0-5 start to the season. The campaign is for a team to finish with the worst record in professional football and secure the number one pick in the draft and select Stanford quarterback Andrew Luck. Luck is considered a can’t-miss, once in a generation quarterback in the veins of Peyton Manning or John Elway. Both of those quarterbacks were franchise defining players that many Dolphins fans hope Luck can become if they lose enough games to get him. But, getting the number one pick and selecting a quarterback is ripe with troubles. Since the much-ballyhooed quarterback class of 1983, a total of 14 quarterbacks have been selected with the number one overall pick. Out of those 14 quarterbacks, only Troy Aikman, Peyton Manning, and Eli Manning have won a Super Bowl. The rest have become either journeymen quarterbacks or are still in the league and trying to solidify their lofty draft status. The list is littered with bad quarterbacks including Tim Couch, David Carr, and the all-time biggest draft bust, JaMarcus Russell. It also has five quarterbacks still starting including: Michael Vick, Carson Palmer, Alex Smith, Matthew Stafford, and Sam Bradford. Obviously, selecting a quarterback first overall is not exactly a science and you have to rely on your scouting department. But scouts can often be so off on a pick that it’s beyond description how bad the players turned out.

passes and has thrown eight touchdowns to just two interceptions. His 2011 quarterback rating of 95.2 is nearly 20 points higher than his career average of 74.3.

“The workout Russell had was Star Wars. It was unbelievable,” said Jon Gruden. “I can’t remember being in such awe of a quarterback in my decade of attending combines and pro days,” said ESPN’s Todd McShay. “JaMarcus Russell, my man,” Fox’s Terry Bradshaw said. “The Raiders finally get their big arm; and he’s a good kid, strong kid, smart kid. He’ll be a big-time player.”

It yields the question of is it coaching, or is it ability? It’s reminiscent of the chicken and egg dispute that’s never been settled.

For the record, Russell played three years in the NFL and completed just 52 percent of his passes and threw for 18 touchdowns versus 23 interceptions. He’s since been in trouble with the law and disappeared from the sports world. The other prime example of just how bad scouting players can be is Ryan Leaf. He didn’t end up being the number one overall pick in 1998, but he was being mentioned in the same breath as Peyton Manning. Here’s what SI.com wrote about Ryan Leaf before the draft: “There are no physical or athletic limitations to hold Leaf back from becoming a great NFL QB…Nobody will question his physical abilities, and it is not outlandish to think that he could be the first pick of the draft, instead of Peyton Manning. There is a huge upside with Leaf, and it is conceivable that he could be one of the best young QB’s in the game in 2-3 years.” SI did mention an indescribable quality that Leaf had that could hurt him in the NFL. He imploded and is considered the second biggest draft bust in NFL history. The San Diego Chargers set their franchise back nearly 7 years with the Leaf mistake. Back to Andrew Luck, there’s another issue about his abilities as well. Luck spent two years under then-Stanford head coach Jim Harbaugh. Under Harbaugh’s tutelage, Luck exploded onto the scene and became the best quarterback in college football. Harbaugh left before Luck’s junior season to coach the San Francisco 49ers. In San Francisco, Harbaugh has turned quarterback Alex Smith, who was a candidate to be released, into one of the hottest quarterbacks in the league in 2011. Smith is completing 63.3 percent of his

Under Harbaugh in 2010, Luck threw for 3,338 yards, completed 70 percent of his passes, and threw for 32 touchdowns to just 8 interceptions. In 2011, Luck is on a similar torrid pace and halfway through the season has thrown 18 touchdowns to just 3 interceptions. But remember, Luck is playing in the defensively-challenged Pac-12 Conference. Outside of his own Stanford team, the next highest-rated defense in the Pac-12 is the Cal Golden Bears ranked 48th in the country, according to cfbstats.com. There’s also another wrinkle into the supposed “Suck for Luck” sweepstakes that could throw a wrench into the plans of any team intentionally tanking the season to

acquire Luck. According to Albert Breer of NFL.com, there are rumblings among front office personnel that Luck and his father could force a team to trade him or Luck won’t play for them, a la Eli Manning in 2004. In other words, Luck hasn’t played a down in the NFL, but will be holding all the cards when it comes to a team wanting to select him in the 2012 NFL Draft. It’s hard to believe that any NFL team would intentionally lose to try to acquire Luck. It’s even harder to believe that true fans of a team would hope their team would “Suck for Luck.” But in a quarterback driven league, nothing is outside the realm of possibility. At the end of the day, if the Miami Dolphins do end up with the number one overall pick; they had better get their house in order or the 2012 draft could be 1983 all over again, and not in a good way.
