With summer on our doorstep, this is the time of year when our not so little coastal community comes alive. As we move into the Christmas and New Year period, the real estate market continues to thrive with several indicators that our local property markets are not slowing down anytime soon as we move into 2020. This spring/summer period is showing advantageous conditions for investors with confidence returning due to regulatory certainty and record low interest rates. Like LJ Hooker’s Coolangatta office,

we deal with clients that are buying or selling in both QLD and NSW. It is important to remember that there are some key differences when it comes to property transactions depending on what side of the border you are buying or selling on.


NSW

In NSW, the Contract for Sale of Land is prepared by the vendor’s solicitor or conveyancer. Once it is completed, the contract is then sent to the real estate agent for marketing purposes. A Contract of Sale must contain certain ‘prescribed documents’. These documents are to help any prospective purchaser decide whether to proceed. They may include zoning documents, sewerage, easements and other relevant searches for your property. Additional searches may be undertaken by the purchaser’s solicitor or conveyancer that are not included in the prescribed searches, ie roads and transport searches to see if the property may be impacted by future infrastructure development. When it comes to your contract becoming unconditional, there is a 5 day cooling off period. There may also be conditions based on the contract becoming unconditional, like a satisfactory pest and building report. Once the conditions have been met and the cooling off period has expired then the contract becomes unconditional and is legally binding on both sides. If a purchaser decides not to proceed during a cooling off period then they may be required to forfeit a 0.25% deposit paid on the property. It is therefore important that you obtain advice prior to entering into a contract for purchase.

QLD

In QLD a solicitor can prepare your Contract of Sale but it is more common for the agent to do so. There is far less information contained in a QLD Contract of Sale than in NSW. As a result, purchasers in QLD will normally be required to undertake more searches of their own to ensure the property suits their needs. These need to be conducted early in the piece, often before exchange of contracts or in the cooling off period. In QLD the cooling off period is needed so that the purchaser can undertake searches that were not provided previously as they are in NSW. QLD contracts are also normally subject to a standard pest and building clause and finance clauses. This is not as common practice in NSW, particularly finance. While most solicitors that deal with transactions on both sides of the border will be used to finance clauses, if you are coming from NSW and your solicitor is not familiar with QLD conditions this may cause you issues. Once loan and pest and building approvals are OK then generally a QLD contract will become unconditional. There are a range of other issues that may affect your property transaction depending on whether it is in NSW or QLD. If in doubt, feel free to give our office a call.

This greater regulatory certainty for investors supports better planning and could lead to increased investor confidence and interest.

The benefits for mortgage holders are significant: some households could save as much as $1,400 on their annual repayments. The increase in mortgage affordability will support households seeking to borrow more to upsize or renovate, and will be advantageous for first home buyers as well as investors entering the market. This will likely result in stronger buyer demand.

3. New First Home Buyer deposit scheme The newly elected Morrison government has committed to introducing a new First Home Buyer (FHB) deposit scheme. This could see more people buying their first homes with deposits as small as 5% and saving around $10,000 on lenders mortgage insurance (LMI). Slated to be introduced in 1 January 2020, the FHB deposit scheme will help 10,000 eligible first home buyers by topping up their 5% deposit with a government guarantee for 15% of the loan. This allows them to bypass the LMI usually required for deposits smaller than 20% and lets them enter the market sooner, without having to save up for the full 20%. 17

On Thursday, 24th October our Palm Beach & Coolangatta offices came together to help raise a total of $500 for Pink Ribbon Day. More than 12,500 Australian women are diagnosed with breast cancer each year and tragically over 2,500 lose their lives to this terrible disease. Pink Ribbon Day brings light to this issue and helps raise funds for Cancer Council to provide support services, new treatments to those affected by cancer. We received a total of $250 in donations from the staff who attended our Pink Ribbon afternoon tea that was held at our Coolangatta office. But more funding is needed to make the museum sustainable into the future and raise its profile befitting a global hub of surf culture like the Gold Coast. “Without Gold Coast Council and Currumbin Wildlife Sanctuary we’d be struggling to keep the doors open,” says Andrew. 57
