Vendors Protest City Ban on Street Sales President Obama Endorses Kasim Reed By Dion Rabouin

Mobile billboards made their way around Atlanta for the fourth day in a row this week with the goal of putting pressure on Atlanta Mayor Kasim Reed to remove the vending ban and other obstructions the Atlanta Vendors Association (AVA) says has kept its members from earning a living for more than seven months. The billboards are the latest blow in a fight that AVA President Larry Miller and his members say they are prepared to take all the way to the Supreme Court. Miller says they have been unable to legally sell food and merchandise at popular public areas around Atlanta like Turner Field and the Five Points MARTA station all year. The mobile billboard features an AVA member and his grandchildren with the caption “Mayor Reed won’t let our grandpa work” on one side and “Mayor Reed: The right to earn a living is a civil right” on the other. The billboard sits on top of a truck that has been running throughout Atlanta’s Midtown and Buckhead neighborhoods and around City Hall from 8 a.m. to 4 p.m. since Monday. “I don’t know where his moral consciousness is,” Miller said of Reed in an interview with the Daily World. “When [the stoppage] started, I tried five times to sit down with the mayor. He refused to even acknowledge me. I’ve been in the city for 30 years and I’ve met every mayor but him.” Neither Reed nor City Councilmembers Kwanza Hall, Michael Julian Bond or Cleta Winslow immediately returned calls from the Atlanta Daily World seeking comment. Reed has, however, responded to two separate editorials from the AJC in as many days about the subject. On Monday, the mayor rebutted claims that he was “wrongly keeping street vendors from working” in a Letter to the Editor that the paper chose not to print. Reed also pointed to the Five Points MARTA station as evidence that the program is working and suggested that many of the city’s vendors operate businesses “which are more reminiscent of ‘swap meets’ than places for small business to thrive.” “My administration is committed to developing a best-in-

class public vending program in the city of Atlanta that is fair to kiosk vendors, non-kiosk vendors and traditional brick and mortar small businesses in their vicinity,” the mayor added. Miller and fellow AVA vendor Stanley Hambrick have filed and won three separate court battles with the city of Atlanta – a December 2012 decision to strike down the vending agreement the city signed with Chicago-based General Growth Properties that gave the company exclusive vending rights in the city, a July clarification of that court order and an Oct. 8 writ of mandamus from Fulton County Superior Court. A writ of mandamus is an order from a Superior Court to a government official ordering the official to properly fulfill their duties or correct an abuse of discretion. Despite the judicial victories, Miller and Hambrick say court appeals from Reed and the City of Atlanta and the use of the Atlanta Police Department have continued to keep the vendors off of public streets and out of business. Hambrick said the association attempted to file a restraining order against the police and against Reed, but that was denied. No court date has yet been set for the city’s appeal of the Oct. 8 writ of mandamus, but Reed appears poised to meet the association’s challenge to take the case to the Supreme Court. “The bottom line is I’m not going to allow Atlanta to be turned into a swap meet,” Reed said in response to the writ of mandamus. “If you go to Five Points right now and look at it, it is a night-and-day difference than the way that it had looked for the last 20 years. We’re not going back there.” The city council this summer also shelved a proposal that would have allowed the vendors to temporarily return to work throughout the city, except in the area surrounding Five Points MARTA Station, which would have remained off limits. “You don’t shut down the whole industry because a few people are operating out of the ordinary,” Miller said. “What we tend to see [under Reed] is that big businesses get everything and we get nothing.” For now, Miller, Hambrick and other AVA members say they are selling merchandise at flea markets, private businesses and “doing whatever is necessary to stay alive.”

President Barack Obama Tuesday made an official endorsement of Kasim Reed for a second term as Mayor of Atlanta. In a statement, Reed’s campaign detailed the president’s praise for Reed’s fiscal stewardship of the city, investment in young people, commitment to public safety, and efforts to improve infrastructure and create well-paying jobs and business opportunities in the city and state for all Georgians. “For nearly four years, Mayor Reed has worked tirelessly to ensure that Atlanta remains one of our nation’s leading cities and a competitive center of commerce and culture in the Southeast,” President Obama said in the release. “He has restored the city’s fiscal condition, reduced crime and implemented after-school programming that serves hundreds of children per week in some of the city’s most challenged neighborhoods. He has earned a second term. I look forward to partnering with him on issues of importance not only to the city of Atlanta, but also our great country.” Reed and President Obama have worked together several times since Reed became mayor of Atlanta in 2009 and Reed has voiced support for Obama’s programs, including most recently the Patient Protection and Affordable Care Act, also known as Obamacare. This fall, Reed and Georgia Gov. Nathan Deal toured the Port of Savannah with Vice President Joseph Biden, who called for expediting port improvement projects on the U.S. East Coast. “I am deeply honored by President Obama’s endorsement,” said Reed. “I wake up every day humbled to serve as mayor of the City of Atlanta. This is my dream job, and if I am fortunate enough to earn the trust of the people for a second term on Nov. 5, I will work hard every day to make our city better. I share President Obama’s vision for a city and nation in which we can improve the lives of working-class families. I will focus on fixing the city’s infrastructure needs, creating more jobs, addressing the challenges faced by our youth and keeping residents and visitors safe. If elected, I am eager to continue working with the president and his Administration on a progressive urban agenda.” In August, Mayor Reed and Atlanta Police Chief George Turner met with Obama and Attorney General Eric Holder at the White House to discuss strategies to reduce youth violence. During the summer of 2012, Mayor Reed met with the president to discuss voting rights.

Report Finds Poor Blacks in Georgia Remain Uninsured Even if healthcare.gov, the web portal for federal health insurance exchange, worked perfectly, more than 5 million poor, uninsured adults, many of them Black, will continue to go without coverage, because they live in states that didn’t expand Medicaid, according to a recent brief by the Kaiser Family Foundation. Through the Affordable Care Act, the federal government agreed to pay 100 percent of the cost of the Medicaid expansion through 2016 and at least 90 percent through 2020. The Obama administration planned for nationwide expansion of Medicaid, the health insurance program that covers the poor and disabled, setting the Medicaid income eligibility at 138 percent of the federal poverty level, or roughly $27,000 for a family of three. In June 2012, the Supreme Court ruled that states could decide whether they want to expand Medicaid. According to the Kaiser Commission, more than half of states, a majority in the southeast, decided not to expand Medicaid. That decision created a coverage gap affecting 27 percent of uninsured adults. “A fifth of people in the coverage gap reside in Texas, which has both a large uninsured population and very limited Medicaid eligibility. Fifteen percent live in Florida, eight percent in Georgia, six percent live in North Carolina, and another six percent live in Ohio,” the Kaiser Commission brief said. More than half of all Blacks live in eight states: Texas, Florida, Georgia, New York, California, North Carolina, Illinois, and Maryland. According to the Kaiser Commission on Medicaid and the Uninsured, “The largest uninsured nonelderly Black populations reside in Florida (718,800), Texas (613,100), and Georgia (594,600). In addition, Blacks comprise a large share of the uninsured population in the District of Columbia (52%), Mississippi (48%), and Louisiana (42%).” Florida, Texas, Georgia, Mississippi and Louisiana chose not to expand Medicaid, leaving billions of dollars unspent, forcing many of their citizens to either go without health insurance or to sign up for health insurance on the federal-facilitated marketplace. Because 40 percent of all Blacks are under the age 26, compared to 30 per-

cent of Whites, the very people needed to make the health care formula work, may be less inclined to participate. According to the Kaiser Commission brief, “… With many states opting not to implement the Medicaid expansion, millions of adults will remain outside the reach of the ACA and continue to have limited, if any, option for health coverage: most do not have access to employer-based coverage through a job, few can afford coverage on their own, and most are currently ineligible for public coverage in their state.” During a Webinar for journalists, Rachel Garfield, senior researcher for the Kaiser Commission on Medicaid and the Uninsured, said that in all states, there are people who will continue to be uninsured, because of their T:9.75” immigration status, people who opt to pay the penalty, or people who are exempt from the penalty. The Rainbow PUSH Coalition and the Citizenship Education Fund will host their 14th Annual Creating Opportunity Conference in Atlanta, Nov.1-2 at the Hyatt Regency. This year’s conference focuses on financial literacy, business growth and development, job creation, civil rights enforcement and the Affordable Care Act. The purpose of the conference is to promote fairness in contracting, hiring, retention and promotion, as well as fair terms and conditions in purchasing, lending and investment. The conference will also inspire youth and their parents to take advantage of every opportunity to achieve their highest potential. “Rainbow PUSH has worked with hundreds of families across the nation to avoid foreclosure and retain their homes,” said regional Rainbow PUSH vice president Janice Mathis. “It also pushed progressive ideas, such as the infrastructure bank, student debt forgiveness and principal reduction to spread the recovery throughout the economy beyond Washington and Wall Street.” The Keep Hope Alive Gala will honor Dr. Joseph Leonard, assistant secretary of the USDA for Civil Rights, and Tommy Dortch, founder of 100 Black Men, for their civic contributions and commitment to improve the quality of life for Black Americans. The conference also presents Financial Literacy, featuring Wells Fargo’s Hands-On Banking internet-based curriculum, to promote neighborhood stabilization and home retention. “We aim to improve public policy at the state and federal levels, promote urban and rural economic development and job creation and help families and congregations escape or avoid poverty by making sure they have as much knowledge as possible. Wynton Marsalis has taken his Jazz at Lincoln Center Orchestra all the way to China and Russia, but the trumpeter says its current “Abyssinian: A Gospel Celebration Tour’’ is the most challenging in the band’s 25-year history. The tour of U.S. performing arts centers and churches involves a convoy of four buses and an equipment truck. The 15-piece orchestra and the 70-voice Chorale Le Chateau conducted by Damien Sneed are performing Marsalis’ “Abyssinian 200: A Celebration,’’ an extended work blending gospel and jazz traditions he wrote in 2008 to celebrate the 200th anniversary of Harlem’s Abyssinian Baptist Church. “There’s never been a tour where a jazz band and a big choir like this went on the road and played a piece like this,’’ Marsalis said in a telephone interview. “It’s definitely a spiritual experience when you get the choir and the band and the congregation in there together.’’ The piece, based on the liturgy used in many African-American Baptist churches, draws on diverse influences. These include the lessons Marsalis learned from his music professor father about traditional spirituals, hymns and gospel music, his own experiences as a classical trumpeter performing the religious works of Bach, Handel and Palestrina, and his vast knowledge of jazz styles going back to the music’s roots in his native New Orleans. The 52-year-old Marsalis is complementing the tour that concludes this weekend with concerts at Jazz at Lincoln Center’s Rose Theater in New York and Boston’s Symphony Hall with the release this week of

“The Spiritual Side of Wynton Marsalis.’’ The album is a 15-track collection of spiritually inspired works that he recorded from 1988 to 2002. It includes selections from “In This House, On This Morning,’’ Marsalis’ first commissioned work for Jazz at Lincoln Center in 1992, capturing the feeling of a Sunday morning church service in the South. The tour’s main sponsor is a foundation set up by a leading Black businessman, David Steward, founder of World Wide Technology Inc. Steward described the concert series as “an excellent opportunity to celebrate and share the joy, cultural heritage and power of gospel and jazz with longtime fans and new listeners.’’ Earlier this year, the orchestra made a U.S. tour playing a repertoire that covered its entire history. It performed everything from early New Orleans jazz to Ornette Coleman’s modern jazz, as well as classic tunes by Duke Ellington, Thelonious Monk and Dave Brubeck, and compositions by contemporary jazz musicians, including several JLCO members. “This is probably the most flexible ensemble ever in the history of jazz because we have to play so many different styles of music,’’ said Marsalis, JLCO’s music director. Marsalis also hand-picked the 17-piece Jazz at Lincoln Center All-Stars to perform in the new Broadway show “After Midnight,’’ starring Fantasia and Dule Hill, which celebrates Duke Ellington’s

years at the Cotton Club during the 1920s. Trombonist Art Baron says the band is using some of the same transcriptions of Ellington’s arrangements that he played as a founding member of the Lincoln Center Jazz Orchestra, as it was known when Marsalis formed it in 1988. Baron, who played with Ellington before his death in 1974, said the Lincoln Center orchestra had “a very similar vibe ... in which people were not judged by the color of your skin or by your age, just by the music you made.’’

What Is Bullying?

October: Bullying Prevention Awareness Month By Katie Gorscak U.S. Department of Health and Human Services

1 of every 7 students from kindergarten to Grade 12 has been a bully or has been bullied.

Bullying Prevention Awareness Month

More than 56% of students had already witnessed bullying that happened while they were in school.

A statement by HHS Secretary Kathleen Sebelius

71% of students reported that bullying is an on-going problem.

October is Bullying Prevention Awareness Month -- when individuals, families, schools, and communities across the nation help to raise awareness about bullying prevention. Bullying remains a widespread problem with nearly 30 percent of adolescents in the U.S. reporting some experience with bullying, whether as the victim, the bully or both. An infographic developed by the Health Resources and Services Administration (HRSA) highlights important facts and information about bullying prevention. We know that there are a number of emotional effects that can result from bullying such as depression and anxiety. There are also physical effects as well, like headaches, stomachaches and sleep problems. •Media Guidelines for Bullying Prevention. Media coverage of social issues can have a widespread impact on how communities understand and address problems. SAMHSA has developed media guidelines conveniently located in the newsroom of stopbullying.gov. This guidance offers help to journalists, bloggers, and others to engage in responsible reporting on this important topic. •Conversation Starters Mobile App. Later this month, SAMHSA will release a mobile app for parents to help start conversations with their children about bullying. This app will be available for both Android and Apple platforms. •Bullying Prevention Training Center. This revamped section of stopbullying.gov provides a one-stop-shop for training materials for educators and community leaders. These new materials, developed by HRSA, will be available in late October in our training section on stopbullying.gov.

Groups across the country committed to stop bullying released new resources, campaigns, and efforts aimed at bringing awareness to this important issue facing youth. This month serves as a reminder that bullying prevention must be addressed, and one way to accomplish this is through educating ourselves, communities and the youth in our lives. In the spirit of lifelong learning on this issue, the Federal Partners in Bullying Prevention have launched several initiatives and resources this month through StopBullying.gov. These efforts are highly important for reaching out not only to parents, teachers, and the youth themselves, but also to the media who play an important role in telling the stories we hear about bullying. Keep up to date on the latest bullying prevention resources and tools and sign up for e-mail updates from StopBullying.gov. With all of these new resources and attention, it’s a great time to consider how you can help raise awareness about bullying and take action to stop it. In a special supplement of the Journal of Adolescent Health supported by the Centers for Disease Control and Prevention (CDC) in collaboration with the Substance Abuse and Mental Health Services Administration (SAMHSA) we see how researchers continue to investigate the complex relationship between bullying and suicide. But help is available. I am very pleased to highlight a number of exciting activities and initiatives that HHS will be launching during Bullying Prevention Awareness Month.

Oct. 31 - Nov. 6, 2013

We are all well aware of verbal and physical bullying, but did you know there are other kinds as well? Successful bullying prevention can’t happen alone! We work closely with the Departments of Education, Justice, and Agriculture, and others, through the Federal Partners in Bullying Prevention, including supporting stopbullying. gov, which continues to be an excellent resource for bullying prevention information. •We are collaborating with these offices to support youth engagement. Across the country, youth are encouraged to talk about bullying by organizing bullying prevention social and educational events through youth organizations in their communities. Youth can report back on these activities through our Tumblr page. •The Department of Education has issued guidance in the form of a Dear Colleague letter that provides an overview of school districts’ responsibilities under the Individuals with Disabilities Education Act to address bullying of students with disabilities. With all of these resources available, it’s a great time to consider how you can help raise awareness about bullying and take action to stop it. 1. Physical bullying: Physical bullying involves any kind of physical contact that would hurt or injure a person. Common ways to bully someone this way would involve hitting, kicking, punching, shoving, tripping, pushing, etc.. Physical bullying is not only limited to any sort of abuse, but it can also involve taking away things belonging to someone else and destroying them. According to Safe School Facts, 30.5% of bullying occurring in elementary and middle schools is physical. 2. Verbal bullying: This type of bullying includes offensive remarks, joking about a person’s religion, gender, ethnicity, socioeconomic status, or the way they look. An example could be a group of children making fun of another because he/ she can’t run as fast as everyone else. Verbal bullying is very common in both, schools and work places. It can also include making threats of violence or aggression against someone. 3. Indirect bullying: Spreading rumors or stories about someone, telling others about something that was told to you in private, and excluding others from groups are common forms of indirect bullying. 4. Social alienation: Common forms of social alienation can be excluding someone from a social group or activity on purpose. It also includes the spreading of rumors and pointing out someone’s differences.

5. Intimidation: This is a method some bullies use to make his/her victim do whatever they want. Victims of this type of bullying are chosen according to their weak appearance. Ways that victims are intimidated are by threats. 6. Cyberbullying: This is bullying that includes sending messages, pictures, or information by using electronic/social media (email & instant messages, text messaging, voicemail, etc.). Personal information, rumors, and other things are put out via the internet to have others know about something quickly. This is done to put down the victim or damage a person’s image. According to a survey done by many experts, the rate of cyberbullying is growing each day.

Top years for bullying are from 4th-8th Grades. 54% of students who witness violence and physical abuse at home can become bullies in schools. Each month, a shocking number of around 282,000 students are being victimized by bullying in the U.S. 90% of victims admitted that they suffered negative side effects. Among them are: • Significant drop in grades • Increase in anxiety • Loss of friends • Loss of social life 9

The ultimate goal is to stop bullying before it starts. Research on preventing and addressing bullying is still developing. School-based bullying prevention programs are widely implemented, but infrequently evaluated. Based on a review of the limited research on school-based bullying prevention, the following program elemments are promising: • Improving supervision of students • Using school rules and behavior management techniques in the classroom and throughout the school to detect and address bullying, providing consequences for bullying • Having a whole school anti-bullying policy, and enforcing that policy consistently • Promoting cooperation among different professionals and between school staff and parents

‘A Time to Kill’ is not worth killing time

Berry Gordy: Motown Records founder and Michigan Chronicle news carrier

Cissy Houston Remembers Whitney in Poignant New Book

By Mark Kennedy AP Drama Writer

By Steve Holsey

By Steve Holsey

A paperback copy of John Grisham’s novel A Time to Kill will set you back less than $10. The DVD of the film will cost a few bucks more. The new adaptation on Broadway? Tickets at the box office start at $70. Save your money. A puzzling version of Grisham’s story, which mashes up elements from both the book and the Matthew McConaughey-led movie, opened Sunday at the John Golden Theatre with an inability to sustain any sense of drama. That’s pretty unforgivable, since the story deals with the rape of a child, a double murder and a death row court case -- all against the sounds of the KKK and NAACP protesting outside the Southern town’s courthouse. But director Ethan McSweeny and a talented cast that includes standouts Patrick Page, Tom Skerritt and Fred Dalton Thompson can’t seem to get any traction with a story about the case of a Black father who kills the White men who raped his daughter. Perhaps we’ve all watched too many “Law & Orders’’ and are exhausted by listening to lawyers stipulate to this or object to that. Or perhaps we’ve seen this trial before, and there are no mysteries. Or perhaps the incessantly rotating set by James Noone takes all the air out of it. Eighteen scenes whip by, each triggering a twist of the massive central turntable and a long pause with some ominous music as various props are arranged. It gets tiresome and clunky. That also applies to the book, an adaptation by Rupert Holmes that simplifies the complex motives and emotions of the men and women in the book and film to the part of cartoons.

Stepping into the role of the seemingly overmatched defense attorney Jake Brigance is Sebastian Arcelus, who struggles to give the character nuance, since he’s often the passive center of the script. Page, playing his adversary, is at his glorious best, a smooth-talking and cocky politician with a gloriously Shakespearian bass voice. Skerritt nicely pulls off a charming disgraced and drunken lawyer and Thompson is a sure-footed judge, perfectly cast. Ashley Williams, making her Broadway debut as Brigance’s smarty-pants aide, shows confidence and great potential for comedy, but the role is tissue-thin. John Douglas Thompson as the jailed father balances uneasily between being wily and a simpleton. Holmes has his choice of material from both book and film and so some choices are odd. Scenes between Thompson and his wife (a great Tonya Pinkins) seem true and honest, but having the newly freed man rush back to court to celebrate with Brigance is a little corny. Holmes includes a movie scene that features a KKK member with a suitcase bomb, but in this version the KKK don’t kill Brigance’s dog or attack Brigance’s aide. A huge burning cross with real flames is as unsubtle as, well, a huge burning cross. There is no jury in this version -- it’s us. Act 2 is the trial itself and the spinning set goes into high gear. The lawyers and witnesses address us in the audience seats, but the final outcome is then taken out of our hands. Nonetheless, here’s the verdict: If you have time to kill, pick up the novel or catch the movie.

Motown Records founder and former president Berry Gordy comes from a hard-working family with a strong business sense. At any given time, there was at least one family-owned business in operation — a grocery store, a print shop, a bricklaying operation, etc. This spirit of entrepreneurship was no doubt a factor in Berry Gordy’s decision to start a record company -- one that was destined to become iconic. Berry Gordy Prior to that, he had owned a record store but made the mistake of attempting to sell jazz to people who wanted blues and R&B. At one point in his youth, Gordy was a newsboy, right after operating a shoeshine stand. “From the shoe industry, I turned to journalism, selling the Michigan Chronicle, Detroit’s top colored weekly newspaper,” said Gordy in his memoir.

“One weekend I packed up some papers and went to sell them in the White neighborhood. I figured White people there would probably love to buy them if they got the chance. After all, you could always find them hanging out at the Black nightclubs, like the Flame Show Bar or those down in Paradise Valley.” He continued, “Well, I was a big hit and sold more papers in less time than ever before. I decided I could afford to share the wealth and brought my brother Bobby down with me the next week. “We did not do well. We both got a hard, fast lesson in race relations. It seemed one precocious little Black kid was cute, but two were a threat to the neighborhood.” Berry Gordy will receive a Lifetime Achievement Award at the Michigan Chronicle 2013 Legacy In Motion black tie event.

Rev. Run and Wife Set to Host New Show

Without question, Remembering Whitney by Cissy Houston is one of the most captivating, incisive, honest and informative books ever written. In addition to learning so much about her superstar daughter Whitney, who was on her way to becoming an icon, the book provides plenty of information on Cissy Houston, a star in her own right, and provides an insider’s look at the music industry and show business in general. But, of course, it is the topic of Whitney Houston that is the main focus and the main attraction. Avoiding truth and mincing words is not Cissy Houston’s style. She writes, “Though her voice came through just fine in the studio, Nippy (Whitney) was having more trouble than ever with her throat in live performances, and again she had to cancel a few dates. People said all kinds of things when she canceled those shows.

Rev. Joseph “Run” Simmons and wife Justine Simmons will soon be hosting their own daytime talk show, according to Always A-List. The couple filmed a pilot for the show before an ABC studio audience in August on the “Live with Kelly and Michael” set. The show’s name has yet to be disclosed, along with other details. This won’t be the first time they’ve appeared on their own show. MTV also aired “Run’s House,” a reality series documenting Simmons’ life with his family in New Jersey. It ran from 2005 to 2009. Run, who sold millions of records as one-third of superstar rap group Run DMC, has branched out into multiple ventures since “Run’s House” ended. This year, he released a book titled, Manology: Secrets of Your Man’s Mind Revealed, along with singer Tyrese Gibson. The book offers relationship advice for women and how they can improve their romantic bonds. In related news, Run is also preparing to become a grandfather for the first time. Daughter Vanessa Simmons is expecting her first child with Mike Wayans of the Wayans clan.

“Everybody in the world thought they knew what was going on with her, even if no one really did. “But the truth was, the very real struggles she was having with her voice as she got older were made even worse by the partying she was doing, which, as I found out later, included smoking cigarettes and smoking other things.” Houston continued, “Nippy was better than anybody I know at keeping her stuff private — or at least keeping it private from me … Obviously, the people who worked closely with Nippy could see if she was having problems — with drugs or Bobby or anything else. “But Nippy was their boss, and if she didn’t want me to find something out, they were not going to tell me about it. They knew she would feel betrayed, and they didn’t want to lose their jobs. “I never read the tabloids. For years, avoiding those rags had kept me safe from a whole lot of baseless rumors and the nastiness of the gossip business. “But when Nippy actually started to have a problem with drugs, it also meant that I was sheltered from the speculation about how bad things really were,” laments Cissy Houston.

Chris Brown Digs Deeper Hole Chris Brown, 24, was charged with felony assault in Washington, D.C. on Sunday, Oct. 27 for allegedly punching a man in the face who was trying to enter Brown’s tour bus. Not only is the R&B star facing charges in D.C., but this incident could mean incarceration for violating his probation in Los Angeles for the 2009 attack on Rihanna. “The arrest alone is still a probation violation, and his probation could be violated or revoked, which means jail time, up to four years,” explained attorney Lauren Lake, of “Paternity Court,” while talking to news analyst Roland Martin on the “Tom Joyner Morning Show.” “This young man is troubled, arrogant, stupid, or poorly advised or all of the above, because it just doesn’t make any sense that he keeps involving himself in these same situations,” she continued. Retired judge Kevin A. Ross, of “America’s Court,” elaborated on “NewsOne Now” with Roland Martin. “If [Brown] explodes one more time … If he commits any other felony, it doesn’t even have to be serious or violent, he’s looking at a minimum of 25 years to life, if prosecutors choose to pursue that,” Ross said, referencing California’s three-strike law.

Quincy Jones sues Michael Jackson’s estate By Anthony Mccartney AP Entertainment Writer

Quincy Jones sued Michael Jackson’s estate claiming he is owed millions in royalties and production fees on some of the superstar’s greatest hits. Jones’ lawsuit seeks at least $10 million from the singer’s estate and Sony Music Entertainment, claiming the entities improperly re-edited songs to deprive him of royalties and production fees. The music has been used in the film “This Is It’’ and a pair of Cirque du Soleil shows based on the King of Pop’s songs, the lawsuit states. Jones also claims that he should have received a producer’s credit on the music in “This Is It.’’ His lawsuit seeks an accounting of the estate’s profits from the works so that Jones can determine how much he is owed. The producer worked with Jackson on three of his most popular solo albums, “Off the Wall,’’ “Thriller’’ and “Bad.’’ Jackson’s estate wrote in a statement that it was saddened by Jones’ lawsuit. “To the best of its knowledge, Mr. Jones

has been appropriately compensated over approximately 35 years for his work with Michael,’’ the statement said. An after-hours message left at Sony Music’s New York offices was not immediately returned. Jackson’s hits “Billie Jean,’’ “Thriller’’ and “Don’t Stop `Til You Get Enough’’ are among the songs Jones claims were re-edited to deprive him of royalties and his producer’s fee. Jones’ lawsuit states the producer’s contracts called for him to have the first opportunity to re-edit or alter the songs, in part to protect his reputation.

Today, of course, when we talk about what we watch, that doesn’t necessarily mean just television or the big screen. We have the choice of watching content (e.g. movies, TV, shows and videos) on a number of our cool devices whenever and wherever we feel like it. We have our computers (African-Americans are 10% more likely to spend time on the internet searching for information on electronics than the total population); smartphones (71% of us own smartphones compared to 62% of the total population); and television of course (Blacks watch 37% more television that the total population, which is the most of any other group). Although how we watch continues to evolve, what we watch remains consistent, as Nielsen’s latest report on Black consumers, Resilient, Receptive and Relevant: The African-American Consumer 2013 Report, details. We prefer shows and movies that star or feature people who look like us – even though they might not always act like the average Black person (When was the last time you threw a drink in someone’s face or tried to pull someone’s wig off?). Marketers who want to reach African-American audiences and a piece of our $1 trillion buying power should be paying close attention. We’re loyal television fans. Our watch activity breaks down to seven hours and 17 minutes of viewing a day, compared to five hours and 18 minutes of viewing time a day for the total population. And, ladies, we watch more than the guys, especially those of us in the 18-49 age range. It’s no surprise that Blacks prefer cable. Since many cable shows and casts offer more diversity than network programs, eight of our Top 10 TV shows air on cable networks. The two exceptions are ABC’s Scandal, starring, Kerry Washington, and FOX’s long-running singing competition variety show, American Idol. If you are a true Gladiator, then I know you tuned in to watch watch Scandal’s third season premiere earlier this month. Not only did Olivia Pope and company rack up 10.5 million viewers; the show helped us introduce a new measurement – Nielsen’s Twitter TV Ratings. Scandal’s premiere was that week’s top-tweeted show with almost 713,000 tweets, reaching a Twitter audience of 3.7 million. It tied with VH1’s Love & Hip-Hop Atlanta 2 as our top rated show earlier this summer on June 30. Blacks love Twitter, with those of us between 18-34 spending 11% more time on the social chat site than 35-44 and 45-64 year olds combined. Twitter TV conversations have grown since last year. From the same period a year ago, there has

been 38% more tweets related to live TV – 190 million tweets in 2012 grew to 263 million tweets in 2013. There’s also been an increase in Tweeters as well – from 15 million in 2012 to 19 million in 2013. By offering these metrics, Nielsen gives marketers yet another outlet to reach you in their campaigns. We also like to watch movies. We go to the movies with the same frequency as every other consumer group, about 6.3 times a year. As with TV, we favor films with characters that look like us. Action/adventure movies, however, are the exception. We tend to gravitate to that genre more than other groups, regardless of the cast’s ethnicity. These were the top five grossing movies among African Americans, featuring Black casts from September 2012 to June 2013: Django Unchained (Jamie Foxx, Kerry Washington, Samuel L. Jackson) $163 million 42 (Chadwick Boseman)

$94 million

Flight (Denzel Washington)

Tyler Perry’s Temptation (Jurnee Smollett-Bell, Vanessa Williams, Brandy) $52 million The Call (Halle Berry, Morris Chestnut)

Nielsen research shows that 51% of us are receptive to product ads that run in movie theaters and 87% of us are receptive to movie trailers and previews. We’re almost finished breaking down this year’s report, but if you just can’t wait until the next column, look for a four-page copy of the report in this newspaper. I join President Barack Obama in endorsing Mayor Kasim Reed for a second term as Mayor of Atlanta. He has definitely earned a second term in the same manner as his predecessors. He has made good on his campaign promises and I join the President in praising Reed’s “fiscal stewardship of the city, investment in young people, commitment to public safety, and efforts to improve infrastructure and create well-paying jobs and business opportunities.” Reed certainly earned the President’s support as one of his key surrogates during the 2012 presidential election, which won Obama his own second term as the nation’s first African-American president. Reed’s second term will begin as Atlanta marks four decades of consecutive African-American mayors, including one woman. President Obama characterizes Reed’s accomplishments, this way: “He has restored the city’s fiscal condition, reduced crime and implemented after-school programming that serves hundreds of children per week in some of the city’s most challenged neighborhoods. He has earned a second term. I look forward to partnering with him on issues of importance not only to the city of Atlanta, but also our great country.” I will attest to the many good things that Mayor Reed has accomplished. He has re-opened the city’s rec centers and received private support to augment them with computers and other enhancements, transforming them into what he calls “Centers of Hope.” And perhaps the biggest accomplishment has been helping to close the deal between the Atlanta Falcons and two historic African-American churches to make way for a new football stadium that he says will provide more jobs and rejuvenate Vine City and surrounding neighborhoods. And finally, Mayor Reed has the vision, energy and commitment to continue to move Atlanta forward. “This is my dream job, and if I am fortunate enough to earn the trust of the people for a second term on Nov. 5, I will work hard every day to make our city better,” he said in a statement in response to the President’s endorsement. “I will focus on fixing the city’s infrastructure needs, creating more jobs, addressing the challenges faced by our youth and keeping residents and visitors safe.” Here are my thoughts about other races in the city. For Atlanta City Council, current President Ceasar Mitchell deserves another term. He has served as City Council President since 2010 and been on the council since 2001.Unchallenged in his citywide post is Michael Julian Bond, and he deserves another term. There are two other citywide posts on the 15-member council who have challengers. I’m going with former Mayor Shirley Franklin’s recommendation and pick newcomer Andre Dickens against incumbent H. Lamar Willis. The other citywide post pits incumbent Aaron Watson against former City Councilwoman and mayoral candidate Mary Norwood. Watson, an

attorney who has also served on the Atlanta school board, deserves re-election. Council members Kwanza Hall, Yolanda Adrean, C.T. Martin and Joyce M. Shepard are unopposed and deserve another term. My Councilman, Ivory Young, works hard for his constituents and should win re-election. Here are my recommendations in other district races: incumbent Carla Smith; incumbent Cleta Winslow; incumbent Natalyn Archibong; incumbent Alex Wan; incumbent Howard Shook; incumbent Felicia Moore; and incumbent Keisha Lance Bottoms. For more information on the candidates, visit the Committee for Better Atlanta website for candidate responses to questions about issues facing the city: http:// committeeforabetteratlanta.org. The school board races are equally important. Two of the nine seats are open and two seats are unopposed. The board will have the responsibility of selecting the city’s next superintendent as one of its most important jobs. For two of the three citywide posts: Incumbent Courtney D. English or his challenger Nisha Simama; incumbent Reuben McDaniel or Mark B. Riley, a former board member. I’m not sure whom to recommend for the other citywide seat being vacated by Emmett D. Johnson. Study and you decide. For the district seats, newcomer Matt Westmoreland, a teacher and classmate of my son’s from Grady High school will be a great addition. Also my school board representative Byron D. Amos, vice chair of the board, is running unopposed. Other recommendations include: incumbent Brenda J. Muhammad and incumbent Nancy M. Meister. For the seat being vacated by Yolanda Johnson, I recommend Eshe Collins. Whomever you decide to vote for, please vote if you haven’t already. Too many people have shed blood and died for our right to vote for us not to use it. Perhaps I’ll see you at the polls. I like to vote on Election Day. M.
