"I see a lot of similarities between today and the 1970s," said Jason Henderson, an economist and head of the Omaha branch of the Federal Reserve Bank of Kansas City, Mo. It's in strong hands," said Troy Louwagie, chairman of the Farmland Value Survey, which is published by the Realtors Land Institute. That lessens the potential impact of any future correction, from lower commodity prices, for example, he said. Strong prices for grain are the primary driver of farmland sales, along with uncertainty about stocks, bonds and other investments. Low returns for governmentinsured products such as certificates of deposit also are a factor, said Marc Hock, regional manager for Pinnacle Bank, the largest ag lender in Nebraska. "Whenever corn is pushed into the $4.25to-$4.75 range, it doesn't take long to get a return on your investment," he said. Also, the amount of farmable land is declining, while the world's population is expected to go from 6.9 billion today to more than 9 billion by 2050. An economist for equipment maker Deere & Co. said in Omaha last summer that the world produced 7 billion tons of food in 2005 but will need to produce 10 billion to 11 billion tons by 2030. Examples of some recent per-acre cropland sales: $8,100 near Shelby, Neb. $8,525 in York County, Neb. $7,875 in Harden County, Iowa. According to the Iowa Farmland Values Survey, cropland prices increased an average of 8.5 percent from September 2009 to September 2010, from $5,314 an acre for high-quality ground to $5,765 an acre. The comparative figure for Nebraska ($1,503 per acre as of June 2010, up 5 percent from the previous year) is misleading because of the state's diversity -- from rangeland in the west, valued at a few hundred dollars an acre; to irrigated cropland, approaching $5,000 in some areas; to dryland cropland, about $4,000. Irrigated farmland in eastern Nebraska, perhaps the most comparable to Iowa, had an average value of $4,890, according to the latest survey. "We're much more heterogeneous," said Bruce Johnson, an agricultural economics professor at the University of NebraskaLincoln and author of the Farm Real Estate Market survey. "We're in such a transitional area of the country," he said, from less than 900 feet above sea level in Richardson County in the southeast to more than 5,400 feet in Kimball County in the southwest. Another reason for the increased value in farmland is the economic principle of supply and demand. Johnson said the annual land turnover rate in Nebraska, historically low anyway, is down to an average of about 1.55 per-

cent over the last few years. "In the last 10 years or so, land was in good hands and stayed in good hands, apart from estate settlements and divorce situations." Some real estate experts expected more land to arrive on the market this year, as owners tried to take advantage of low capital gains tax rates. But that didn't happen. "It was a case where people said, OK, we can sell now and avoid some taxes, but then what do we do with it (the money)?'" Johnson said.

Individual investors or investment groups from outside Nebraska and Iowa make up a small percentage of buyers, but most are local, and many are farmers seeking to expand, said Lee Vermeer, a vice president at Farmers National Co., a national farm management, appraisal and real estate firm based in Omaha. "I'm guessing 85 percent to 90 percent" of buyers are farmers, he said. Previously, farmers made up 70 percent to 80 percent of the buyers, Vermeer said. Hock at Pinnacle Bank said many of the "outside investors" could be adult children of farmers who work and live elsewhere but remain interested in farming and want land in their portfolios. Mark Hesser, president of Pinnacle Bank, said there are more cash buyers today than in the last 10 or 15 years. "Grain producers have made money for three to five years, and that's given them good cash positions." And buyers who seek financing are likely to get it, unlike some small-business owners who have bemoaned the scarcity of credit since the subprime mortgage debacle, big bank failures and the recession.

Why do farm borrowers fare better? "No. 1, there's a tangible asset," Hock said. "Land is always worth something." Farms also produce a product for which there is a solid market, he said, which isn't necessarily the case for small businesses. Half of all small businesses do not survive past five years, according to 2008 data from SCORE, the nonprofit counseling association affiliated with the Small Business Administration. Still, despite the apparently solid business decisions and rosy environment for agriculture, Henderson, as an economist, sees a more balanced picture. "One of the things we've been looking at ... is values outpacing cash rents," he said. The value of land and the amount someone pays to rent and farm it -- a figure that varies depending on location, land quality and other factors -- should move ahead in a similar pattern, Henderson said. The equivalent in the housing sector is that personal or household incomes should be in line with the value of a person's home, something that became unbalanced and contributed to the housing collapse. "I don't see corn prices returning to $2 a bushel, but the concern I have is that this run-up was due to a supply shock -- the drought in Russia -- and a supply shock doesn't last long. Next year you get a new crop," Henderson said. Too many variables exist to predict the price of corn in the long term: weather; federal ethanol policies; global population growth and demand; water supplies. But that's why landowners' equity vs. debt is so important. If the value of the land declines, the impact on the lender is less if the landowner has plenty of equity and a smaller loan. Again, that's a major difference between 2010 and the early 1980s, Henderson said. "By 1982, farmers basically were struggling to service their debt. When farmers' incomes weren't enough to pay their debt, it was the beginning of the farmland bust." Hesser said he sees the potential for an "adjustment" in land values if commodity prices decline. But Pinnacle Bank has accounted for that possibility, he said. "One conscious decision we made is to put a cap on the amount we'll loan. Typically, we'd require 20 percent to 30 percent equity," he said. Johnson, the UNL professor, said farmland values are vulnerable to commodity prices and other factors, but the bottom line is that it's a good asset. "In inflationary times, it holds its value. In deflationary times, a lot of stuff will sell at a bigger discount than good, productive land."

Consumptive use must be detailed. Only the consumptive use amount can be applied to the permit. "It's important that the owner understands that he has to forego that amount of consumptive use," Tyrrell said. An equivalent amount of land must be taken out of irrigation. Water coming from controlled and uncontrolled areas must be accounted for. The State Engineer has a list of 12 items in the policy document issued Sept. 23, that must be adhered to. Tyrrell and Tullis said their offices are available to answer questions. To determine which category of permit and its conditions your proposed water use would be under, contact either office. The State Engineer's Office Ground Water -- 307777-6163; Surface Water -- 307-777-6475; Water Division I, Torrington -- 307-5322248. Seven items pertaining to temporary permit compliance and administration that will be monitored by the Division I Water Office staff. 1. Permits dealing with Glendo contracts require approval from the Bureau of Reclamation. 2. Carefully read approved permits for conditions, limitations, and metering/reporting requirements. 3. Water Division I staff, in cooperation with SEO Cheyenne staff, will field inspect for permit compliance. Remember: 1. Notification to H/C prior to diverting 2. Acceptable meter required for point of diversion or POW 3. Copy of proper temporary permit in on-board truck. 4. Weekly reporting of water use, recorded daily, if hauling out of Wyoming. Quantity breakdown required. 5. Be prepared for random field checks staff will have appropriate ID. 6. Compliance checks on "non-watered" acreage is per temporary permit. 7. Request amended temporary permit if changing/adding point of diversion or point of use in writing to John Barnes at State Engineer's Office in Cheyenne.

Oil companies planning to explore southeastern Wyoming, western Nebraska and northeastern Colorado for new production are looking around for water sources as well. The water is needed for drilling, well completion, and fracturing the geological features of the Niobrara play, where they hope to find a new source of oil and gas. Local landowners and water users, concerned about the impact the water demands will have on their operations, have been meeting with Wyoming officials during the past two weeks to learn the options available to them and to the companies. On Wednesday, about 40 people listened to Wyoming State Engineer Pat Tyrrell, his staff, and Randy Tullis, superintendent at the Division I Water Office in Torrington, explain the potential impacts on their livelihoods. The main focus is to minimize the development impacts on the resource that is so important to agricultural, industrial, municipal and domestic users in the region. While it is important to maintain the resource, it is also important to local residents that they are able to take advantage of economic opportunities that are sure to accompany the exploration and potential development. According to Tyrrell, the oil industry has said it will need about 20,000 acre-feet of water over the next 20 years for drilling, completion and fracturing purposes. "That's not a lot," Tyrrell said. "At 500 acre-feet a year, there is plenty of water available for the oil play." He did note that other than this forecast from the companies, there is no guarantee on the amount of water that will or could be used. However, through temporary permits, current water supplies should be sufficient. Sources include redirected irrigation water, natural flow in the North Platte River, or Glendo Reservoir contracts. Tyrrell said it is up to the companies to decide where they want to get the water, and the market will determine which locations they choose.

Also involved in the situation is the North Platte River agreement between Nebraska and Wyoming. Tyrrell said it should have little impact on the potential to create temporary water transfer permits because the decree is based on the irrigation year. This means water transfers between October and April are not subject to the two-state agreement. It also means that hydrologically and non-hydrologically connected water in the Triangle area of eastern Wyoming along the North Platte River, could be used. It is possible to locate non-hydrologically connected water in some areas, especially in Platte County. A permit can be obtained for hyrdrologically connected water, but it is a lot tougher to accomplish. Temporary use permits are the key to most of the water transfers. They will allow irrigation water to be re-directed to the oil exploration projects. However, there are restrictions and conditions attached to moving water in controlled and un-controlled areas. Appropriated and un-appropriated water use changes also have special requirements. As an example, a two-year temporary change in use of appropriated water is possible, while retaining the water right. The temporary use can be extended, but there is no guarantee that the water right would be retained after the two years. That issue has not been challenged. Currently, there is one permit that allows water to be hauled from the North Platte River near Douglas, Wyo., to northern Colorado. Some of the issues connected to obtaining permits include: Permit applications are available at the State Engineer's Office Bureau of Reclamation/federal water cannot be used in a temporary change of use. Ground water must be taken from active wells. Points of diversion and points of use are required. The rate of flow, and volumetric measurements are required, as is the explanation of the beneficial use of the transferred water.

Estate planning is a very important topic for farm families. In 2001, President Bush signed legislation that reduced the Federal Estate Taxes until 2010, when it was reduced to zero. However, in 2011 the Federal Estate Tax will be reinstated, as indicated in the table on the next page. President Obama has proposed a permanent Federal Estate Tax exemption at the 2009 level, but that has not been acted upon by Congress. Other proposals range from a $2 million exemption with a 55 per-

A married couple can effectively double the amount their heirs inherit tax free through estate planning by having both parents split the estate between them, and each leave their half of the estate to the kids rather than to each other. A simplified approach would be for Mom and Dad to put the farm into a limited liability company (LLC), and give each parent half of the LLC. When the first parent dies, their half of the LLC would be put in a trust for the children, with the trust

income going to the surviving parent. This first half of the LLC would be eligible for the full Federal Estate Tax exemption for the year in which the first parent died. When the second parent died, their share of the LLC would go to the kids, the trust would be dissolved, and the kids would own the LLC. The second half of the LLC would also be entitled to the full Federal Estate Tax exemption for the year in which the second parent died. Many variations of this model are possible, but this is the general idea. Splitting the estate like this can effectively double the amount of the farm that the kids inherit tax free.

Eustis-Farnam senior Waylan Bellamy recently operated his own 20head cattle operation at his familys former feedlot near Johnson Lake. Bellamy started from scratch, financed the operation with a local bank and turned a profit at the end.

Waylan Bellamy can remember the feedlot his grandfather, Willard Bellamy, then his dad, Mark, operated on the Bellamy farm west of Johnson Lake. It had been years since cattle were in the Bellamy feedlot, but Waylan, now a senior at Eustis-Farnam High School, said the more he thought of the empty feedlot, overgrown with a heavy cover of weeds, the more he dreamed of filling it with cattle. So he put it to use in his initial foray into cattle feeding. "I started from scratch," he said. "I made about $250 a head." Bellamy sold his 20 head of cattle late this summer after about six months of caring for them. Bellamy, 17, plans to attend the University of Nebraska-Lincoln to major in animal production

management. He said he started his recent venture modestly. "When we didn't have school on Fridays, I went to the livestock market in Lexington." He talked with cattlemen, observed how cattle were auctioned, and noted the ages and kinds of stock farmers were buying and selling and the prices they were going for. First, he had to arrange financing, which meant a trip to see a banker. Bellamy went well armed with facts and figures. He had talked with a grain dealer about feed and its cost and had talked with a hay supplier. He visited a veterinarian to learn what vaccinations the cattle would need and their costs and what the cost of fencing would be. "I went by myself to see the banker. I had built a spreadsheet that I put on a USB drive. It had all the details of what I wanted to do with all the details on costs and how I wanted to go about it.

It took me about a month to put it all together," he said. He said pulled the USB drive from his pocket and handed it to the banker, saying, "It's all right there," and the banker put it in her computer to study. After looking it over, she said, "I think we can help you." Bellamy went to a cattle buyer and explained he was looking for heifers of about 500 pounds. The cattle buyer supplied him with 20 Angus and Charolais heifers. He had an early adventure in cattle management when one morning a neighbor called the Bellamy home to say, "Waylan, your cattle are out." He put coveralls on over his school clothes and using a four-wheeler, headed out to round them up. The cattle had been in his pasture long enough to know where they'd come from. "They weren't hard to herd back. They knew where they belonged," he said laughing. After that, he put up electric fence. "Once they hit it they learn not to hit it again," he said. Bellamy kept his cattle on pasture grass about six months, then brought them to the feedlot where he finished them off. They occupied only a small percentage of the space available at the lot. "My dad tells me the feedlot is big enough to handle about 1,000 head," Bellamy said. "My grandmother tells me my grandfather would really like it that I'm using his old feedlot," he said. Willard Bellamy died in 1989, before Waylan was born. Waylan said he understands the pitfalls of the cattle business, but he thinks he made an excellent start as a cattle feeder. "I'd like to get it going again," he said. In addition to raising cattle, Bellamy is active in FFA and plays football. He placed 11th in a food science competition at the National FFA Convention in Indianapolis in October 2009. Bellamy also competed on Eustis-Farnam's Food Science Team at the state FFA Convention in 2009. The team won first place, and he won third place as an individual.

Creating Compost Piles Healthy for Environment Sheryl Fellers, Dawson County Extension Service Leaves will soon be falling and homeowners will be cleaning their yards by raking leaves and getting rid of other organic materials. One way to clean up the yard and help the environment is to turn those materials into compost by making a compost pile. Compost piles have several benefits. Adding compost to a garden with heavy clay soil can help improve water movement and drainage in that soil. Compost also will add nutrients and nitrogen that can assist in plant growth. For a garden with sandy soil, compost helps improve the water holding capacity of that soil, which also makes it beneficial for plant growth. Good items for composting include grass clippings, tree leaves, kitchen waste, sawdust, chipped up woody branches and shredded news-

papers. Items that aren't great for composting include plants that have had disease or insect problems, pet waste and certain kitchen items, such as leftover meat or fish, bones, butter, cheese, mayonnaise, milk and oil. Those kitchen items can create wildlife problems if opossums or raccoons decide to dig through the compost piles. Creating a compost pile is simple. First, place four to six inches of coarse, chopped brush or branches on the soil. This allows air to circulate under the pile. Then add three to four inches of green, low carbon materials, like grass clippings, on top. Next add another layer of four to six inches of brown, high carbon organic material, like tree leaves. Add an inch of soil on top, which adds bacteria that will start the decomposition process, above the organic materials. Also make sure the layers are damp by getting out a hose and wetting the layers when constructing the pile. Mix the pile

and follow with additional layers of green and brown materials until the pile reaches three to five feet in height. The pile will heat up quickly within a couple of days and should reach the goal temperature of 140 to 150 degrees. In the fall, steam should come off the top of a very actively decomposing compost pile. The time it takes for a pile to compost depends on how actively the pile is managed. Piles typically heat up and then begin to cool down. Mix the pile up again when it starts to cool in order to help the bacteria get going and heat the pile up again. Actively turning the pile about once every two weeks should mean the pile composts in as little as three or four months. However, just adding new materials on top of the pile and not mixing it could mean composting takes up to a year.

As I mowed my yard this weekend, I couldn’t help but think about the jobs I needed to take care of in my lawn. There are several items that need to be taken care of now if they haven’t been already. Here are some simple reminders and steps to help finish up some projects around the lawn before it gets any cooler. Draining Water Lines and Garden Hoses Now is the time to clear out sprinkler lines and garden hoses before they freeze and burst. Empty garden hoses by stretching them out in a straight line before coiling them up. The water will run out when the hose is coiled over the arm or on hose stand. Store the coiled hose in a place where UV rays will not break down the hose material. A dark corner of a garage or shed is a good place to place these for the winter. Sprinkler systems are set fairly shallow in the surface of the soil. While there is some protection from the weather, sprinkler lines can be damaged or burst the lines when the ground freezes for the winter. First, if there is a shut-off valve, close

it off. Next, run the sprinkler system’s zone to bleed off the lines. If the homeowner does not feel comfortable draining out the sprinkler system, contact a local professional to drain the system and blow out the lines. Mulching Fall Leaves Leaves are falling in earnest now, and it has been fun to watch children play in area yards. Outside of the fun, what do we do with all the leaves on the lawn? Collecting, bagging and removing leaves can be a very time consuming process that is ongoing throughout the late fall. The wind also has an uncanny ability to blow the neighbor’s leaves into your yard too! Instead of spending all that time and energy removing leaves, why not compost them with the help of the mower? First, check the mower blades to make sure they are sharp to help shred the leaves as fine as possible. Second, mow over the leaves when they are dry to help increase the ability to shred. Third, mow the lawn at its regular height three or four passes slowly to shred the leaves as fine as possible so they fall into the lawn, and not cover the turf. Turfgrass will still need to have access to sunlight to continue photosynthesis, and store carbohydrates to build a strong root system. The mulching process will probably need to be repeated

to keep the lawn from being covered with leaves for the duration of the fall. Final Lawn Fertilization Cool season lawn turf such as bluegrass and fescue can be fertilized one last time before spring. This last fertilization will help boost the photosynthesis rate of the turf, and build carbohydrate reserves in the plant to help lawns green up in the spring. Late fertilization can also help increase the lawn’s winter hardiness, root growth and desirable, moderate shoot growth in the spring. Apply 1 to 1 ½ pounds of actual nitrogen per 1000 square feet of area to the lawn. Remember to look on the fertilizer label to ensure than at least a full pound of nitrogen is applied, not a pound of total fertilizer. Soluble fertilizers that contain urea or ammonium sulfate are desired in this application to help ensure that turf is receiving the nitrogen it needs as soon as possible. Avoid using slow-release, or water insoluble fertilizer.
