GST in Agriculture The issue of GST as it relates to agriculture can be confusing. If one looks into all of the nuances of GST one can see that it can be quite complicated for agricultural producers, especially for those attempting to diversify.

“For a conventional producer growing grain or raising cattle, the GST is straight forward,” says Ted Nibourg, B.Sc.Ag, MDE, farm business management specialist with Alberta Agriculture and Rural Development. “Generally, their only concern is applying for their Investment Tax Credits (ITCs) on a quarterly basis. They are not faced with having to collect GST and then remitting it to the Canadian Revenue Agency (CRA). This is because their production is zero-rated. This does not mean exempt, rather they are still subject to GST, but the GST rate is zero. This allows CRA to easily change the rate in the future. However, not all agricultural production falls in the zero-rated category.

Fur bearing animals are not and neither are horses, donkeys, mules, pigeons and peacocks. Rabbits sold for meat are zerorated, but as soon as they are sold for pets GST needs to be collected.”

On the plant side, products such as cut flowers, bedding plants and sod are all subject to GST. Even within conven-

tional crops, GST may apply. Zero-rated status for conventional crops is dependent on quantity. For example, grain sold in quantities smaller than would ordinarily go into production agriculture would be considered subject to GST. “CRA has established guidelines for grain and seed quantities,” says Nibourg.

“Small seeds have to be sold in packages exceeding 125 grams and large seeds have to be sold in quantities greater than 5.0 kilograms in order to be zero-rated.

Large seeds refers to peas, corn and beans, all others are small seeds. This provision has special concern for the bird seed market. Small packages of garden seeds are taxable. Lawn seed and flower seed are also subject to GST. Forage seed labelled and sold as a forage mix according to the Seeds Act is zero-rated even though it may contain non-zerorated seeds such as Kentucky bluegrass.”

One surprising fact found in the CRA’s GST Memorandum on Agriculture and Fishing relates to hay sales. For hay to be zero-rated, it has to be sold in quantities greater than one round bale or equivalent. CRA regulations define a single round bale as one weighing at least 1650 pounds. If selling 50-pound hay bales, a

producers would have to load at least 33 on a pickup or sell a combination of loads equalling 33 bales in order for that hay to not be subject to GST. This may be of special concern to people marketing hay to the horse market where hay is often purchased in smaller lots.

“Land rental is another area where GST may apply,” says Nibourg. “Generally, land rented on a crop share basis is zero-rated as long as the crop is also zero-rated. For crops such as Kentucky bluegrass or creeping red fescue, GST would apply to the landlord’s share of the crop. For cash rent GST needs to be tacked on.”

Custom services such as custom combining, swathing, discing, etc., are subject to GST. Leasing or rental of equipment is zero-rated provided the equipment itself is zero-rated. For example a tractor has to be at least 60 P.T.O. HP to be zero-rated. CRA’s GST Memorandum on Agriculture and Fishing lists the equipment that is zero-rated.

“The subject of GST can be daunting especially for those with non-conventional production,” concludes Nibourg.
