Hey Cora: I recently put an offer on a home and was unable to close because of a title problem. I don’t understand why that affects me? I just want to buy the house. Signed frustrated Dear Frustrated: I understand, it seems like you should be able to buy the house if you are willing to pay for it. Most of the time, the title companies can work through the problem. But sometimes, it’s just better to let it go and look for something else. Old Deeds: One time, I had a house that some clients wanted to purchase, it was old, and had an old loan on it through a large bank. The sellers had died, and no one could find the documentation that showed where that loan had been paid off. The Bank said that they couldn’t find any record of it. It was a mess. The buyers did not buy the property because if money was owed, they then would be liable for paying it off. There is usually a release that is filed with the recorders office when a property is paid off, if there is no release, then the seller must provide documentation to prove it was paid off. It’s called a deed of reconveyance, or a “recon”. In this case, no one could find the deed of recon and therefore, the title company could not issue clear title. Who owns the house: There are many issues that can come up with title. One issue is, does your “seller” really own the property or house? Don’t think this hasn’t happened before, it has. Sometimes it’s because the seller has passed, and the heirs don’t know who has the right to sell the property. Best way to resolve this one is to start with a death certificate. Probate can be resolved using a copy of a community property agreement, or a copy of last will and testament, or a probate, affidavit or in some cases, deeds from potential heirs. Other times, it could just be a scam. This is why I don’t recommend purchasing without a realtor. Short Sale: What if the seller owes more on the property than they can sell it for? This is called a short sale and it doesn’t mean that it’s a “short” process – because it’s anything but short! It takes a long time. I have done several, but if they are a local bank, it can take as little as 6 months. Out of state, and it can be a year! Sometimes, we can negotiate lower payoffs with debtors and get it taken care of that way. Federal Tax liens: This one can be a deal breaker. The lien must be paid off and the a release from the IRS issued. Remember that this is a government agency and they don’t do anything quickly. I have had people go to the office and pay it off right there in Anchorage, only to have them say; “we will issue a release in 4 to 6 weeks!” It’s good to know all this before you get too far in the transaction. That’s why we read title reports.

Judgements: This can be against the buyer or the seller! But they do have to be paid. Sometimes, you can negotiate a deal, but if the judgement is on the seller, the judgment must be paid out of closing. If it’s against the buyer, the lender and buyer work that out together. Pending Lawsuits: The lawsuit may need to be resolved before the transaction can close. This could be something like the seller has a beef with the homeowners association because they cut down a bunch of trees in the greenbelt by accident (or on purpose) and the HOA has brought a law suit against them. If the HOA says “we want $10,000 to replace those trees!” the seller may be able to put one and a half times the amount of the law suit, in this case $10,000 so that would be $15,000 in the title companies escrow account to be paid when the law suit is resolved. If the HOA looses the law suit, the $15,000 goes back to the seller. But it’s a way to get the property closed. Mechanic’s liens: This is when the seller had some work done on the house, let’s say a new furnace put it and they haven’t paid for it all yet. That bill must be paid before title can be issued, so the title company can issue “clear title”. Sometimes there is a dispute between the contractor that filed the lien and the homeowner. This can get sticky – but homeowner and contractor can usually work it out and come to agreement. Sometimes, the title company can help with this and sometimes, the two realtors can work it out. But it must be settled before recording can take place. Similar Names: Yes, this can be a problem. My husband’s name is Robert Carleson, but many times he has been lumped in with Robert Carlson – and believe me there are 1000’s of those! But common names can be a problem, William Jones, Ted Smith, Linda Williams, Debbie Davidson. These names can be confusing on a title. But there are ways to remedy this. A Statement of Identity/ID affidavit can work. Title will help with this. Partnerships, LLC and Corporations: We get into “who really owns the property and who has the right to sign it away?” There is a simple way to resolve this. All these entities have what is called a resolution. The title company can review this resolution and determine who has the right to sell and who does not. Title companies are invaluable for what you pay for a policy and it’s the only type of insurance that you only pay for ONCE! Now, many of the issues we talked about here could be resolved by your realtor or the title company, but sometimes we need to get an attorney involved.
