Ask Cora Hey Cora, I want to buy a house, but the market is so crazy right now with so many offers on one house. How can I make sure that my offer stands out in a crowd of offers? Signed Outstanding in a Crowd! Dear Outstanding: This is a really good question and there are many ways to make your offer look better than others. Let’s talk about a few of them; what are the positives and what are the negatives, and we can go from there. Contingencies. This means that there is something that needs to be done before this deal can close. Usually, in real estate, it means that a buyer needs to sell their house before they can buy a new one. It works like this: Bob Buyer finds the perfect home. His realtor, Rhonda Realtor, writes an offer contingent upon Bob selling his current home. Sally Seller gets 5 offers on her home. Bob’s offer is better than anyone else’s offer, but he must sell that home first. Sally’s Realtor, Ron, advises his client to choose an offer that is close to the price that Bob is offering, but one that is not contingent, and make a counteroffer at the price Bob offered. Because Bob had a contingency, it made his offer too risky so the seller will choose a different one to counteroffer. Advice: Keep your offers as “clean” as possible. Limit contingencies as much as possible. Remember, there are good things about this market too. If you have a house to sell, sell it first, then you can move forward without a contingent offer. Closing costs: There was a time when you could get the seller to pay some or all of your closing costs. Now just so we are on the same page here, closing costs are the expenses that come from getting a loan on the home. If you pay cash, the closing costs are very minimal, mostly just fees for the deed to be written by an attorney, recording fees to record the deed and escrow closing fees that the title company charges. But buyer closing costs for a loan can be spendy – you can calculate that if you are getting a loan for a mortgage, depending on what type of loan you are getting, closing costs will be between 2.5% and 3% of the cost of the home, so $300,000 means $7,500.00 to $9,000.00 just for closing costs – this does not include your down payment. Making an offer when you need the seller to pay those closing costs is much more difficult in this type of market because it makes other offers look stronger than yours. Sometimes, your realtor will advise you to increase the purchase price by the amount of closing costs you need. We all know offers are weighed by risk. Let’s take a look at this one with Bob Buyer and Sally Seller. Bob Buyer makes an offer on Sally Sellers home. Her home is for sale for $300,000. Bob offers Sally $309,000.00 for the house and asks Sally to pay $9,000 his closing costs. She also receives a full price offer, without the buyer asking for closing costs. The math for Sally works out virtually the same, so Sally accepts Bob’s offer. The loan process begins, and an appraisal is done on the house. The appraisal comes back at

Brought to you by $305,000.00. It needs to be $309,000 for Bob to finance his closing costs into the loan. The bank will only loan on what the appraiser says the house is worth. Bob needs to come up with $4,000 to inject his own cash into paying his closing costs, or Sally needs to bring the price of her home down to $305,000. They can also meet in the middle, with Sallying bringing the price of the house down to $307,000 and Bob coming up with $2,000. It’s all a negotiation. But if Sally would have accepted the full price offer, without paying any of the buyers closing costs, would she have done better? With Bob’s offer Sally could potentially loose $4,000 if Bob does not have the money to make up the difference. Sally now has to decide if she is going to lose $4,000 on her sale or terminate her agreement with Bob and give Bob his earnest money back and start all over again. Sally would have been better off to accept an offer of $300,000 and have the buyer pay their own closing costs. Multi Offers: There are several different ways to get your offer seen as the best when in a multi offer. 1) offer your highest and best! If the house is $300,000 and you know there are 5 other offers, offer your best! Let’s say you qualify for a loan of $325,000 and you have a down payment and closing costs saved up and you really want this house. Offer $325,000! You can put a caveat in the contract that states that appraised value must meet or exceed the purchase price, or you can say, buyer will pay up to $5,000.00 higher than appraised value. This way, the appraisal only has to come up to $320,000. It all depends on how much you want the home. 2) Write a nice letter. It’s not always about the price, sometimes its about the “story”, who you are, how you came to Alaska, what are your plans to do here and why you like the house. It may seem simple, but I know sellers who chose buyers from multi offers because they were schoolteachers, or because they were anxious to raise their children here. You just never know. 3) acceleration clauses. This means that Bob Buyers realtor write’s an offer that increases the purchase price over other offers. Meaning, “we will increase our price $1,000 over any other offer up to $330,000.00”. This can work too. However, if this is not a cash offer, and the house is being financed, you run into the same problem again. Sally Seller will come back with “buyer to pay in cash the difference between appraised value and agreed sales price”. And this of course means that Bob Buyer must have the cash on top of down payment and closing costs. My best advice – highest and best! Just make your highest and best offer. Keep it as free from contingencies as possible. Write a nice letter telling them all the things you love about their home. Avoid overpaying but pay what is fair in this market. Remember, it’s not a competition, it’s a place to live your life.
