Ask Cora Hey Cora: I was told that when I look at a house for sale, the seller must provide me with a document that tells me everything that is wrong with the home, is that correct? Well yes, it is correct. It’s called a State of Alaska Disclosure. It’s a document that is required by the state and it also protects the seller and the buyer. It protects the buyer from obvious defects that they may not know about otherwise, and it also protects the seller from being sued by a buyer later down the road. If the discrepancy was disclosed to the buyer, before they purchased, then the buyer cannot sue. (You can see an example of this form on my website www.coracarleson.com, click on seller, step 2 all the way to the bottom at Click Here) Here is an example of the questions on the form: What type of property is it, a single family home, condo, apartment building? Do you currently live in the property and how long have you owned it? When was it built? Age is an especially important factor in purchasing a home, so be as accurate as possible. What type of construction is it and what type of foundation does it have? There is section that asks what built in will stay with the house. Like, stove and water heater, dishwasher, window screens, does it have a water softener, ceiling fans, just all those special things that your home has. It also asks and have you had chronic problems with any of these items – does the stove work, is there a burner out on it, are the window screens ripped or broken. They also ask about structural components, driveways, walkways, foundation, roof, floors and ceilings, skylights, venting – all kinds of things. It may sound intimidating, but it’s not really. It’s just checked boxes and simple explanations; you can do it! Documents: When you bought the home, you probably got a ton of documents! Some of those can be used for your sale your home now. You probably have an as built survey, any energy rating certificates, well logs, septic info, that kind of thing. All of this is valuable information, and any of this will help your sale. Additional information are things like drainage, roof leakage, has the fireplace or woodstove been cleaned lately. What about the heating system? Has it been serviced lately and how old is it? Water heater too, how big is it and how old is it? I know I keep talking about age, but unlike women, who really get better with age, water heaters on the other hand, do not! They also would like well information, if you know how deep it is, let’s tell everyone if you don’t – then you don’t!
Brought to you by If you have a septic, that info is needed too. The document asks questions like is it holding tank? A trench? A mound? A Pit? What size is your septic tank? You may or may not know this information, but it might be on some documentation that you have. If you do regular maintenance on your septic system by having in pumped, that company would know what size your tank is maybe even what type of drain field you have. Have you had freeze-ups? What are your annual utility costs, is there anything on the title report that would be important to the buyer or the property? Setbacks and restrictions, this means that are any of the buildings on your property just stepping over the line into the setback? A setback is an invisible line on the inside of your actual property line where you cannot have permanent structure. Environmental concerns: Are there any hazardous materials in the house, like asbestos etc. Some sellers may know if there are. Are there underground storage tanks, are you in a flood zone, is there erosion and a big one – have you ever had an insurance claim? Now that seems interesting to me. If there has been an insurance claim, that means that everything has been repaired by the insurance company – why do we still need to disclose all that – but you do. The new buyer needs to know everything. There is soils stability, earthquake damages, landslides... all kinds of lovely things! Construction Improvements, they want to know if you have added on any rooms or and if so, did you do it right? I mean if it needed a permit, did you get one? Pests, this can be anything from ants to squirrels! I saw a house once that was have a remodel done that had HUNDREDS of pinecones in the walls from squirrels! Another house, dog food in the walls from mice! So funny when it’s not your house! Then there are the other things, the yucky things, murder, or suicide, has anything like that happened in the past 3 years? Any human burial sites on the property, let’s hope not! Noise – trains, airplanes, racetracks particularly noisy neighbors? And lastly pets, any pets in the house? And what kind. I knew someone that had a potbellied pig in the house – another woman had goats in the house! Disclose please! So that’s about it, see not so hard, think of it as “homework” for listing your home. As a Realtor, I can help you understand the question, but I cannot answer the question for you. It’s an important document and very much helps buyers and your friendly Realtor when selling your home.
