Three members of staff have achieved great results in their ARLA & IRPM exams and our sister company Resident has been selected for the Alpha Class of 2015 at the Dublin Web Summit.

Alexandre Boyes has this year seen the introduction of an in-house property maintenance team, providing a responsive service to our Block & Lettings clients. As part of that expansion, the first Alexandre Boyes maintenance van launched in March. Clients have a Child been so pleased with the responsive maintenance and repair work that we have now got a second van. Block management is continuing to expand with new clients joining us in Shipbourne, Tunbridge Wells, Clapham, Streatham and Twickenham.

TENACITY WITH TENANTS

LEE REEVES-PERRIN, PARTNER AT COOPERBURNETT, HELPS LANDLORDS NAVIGATE THE LEGAL REQUIREMENTS FOR SERVING NOTICE Q. I want to let out my house and go travelling for a bit, but can I still serve notice and recover possession when I get back? A. The simple answer is yes you can but, as of 1 October 2015, there are a few important matters that must be adhered to and that’s where a good agent like Alexandre Boyes comes in.

The Deregulation Act 2015 has introduced a few little changes to the way in which landlords and agents have to behave towards residential tenants for those tenancy agreements entered into after the 1 October 2015. In short, the changes mean that the section 21 Notice process cannot be used where: 1. The tenant has resided in the property for less than four months. 2. The landlord has had enough of the tenant and simply wants him/her out – the retaliatory reason. So complaints


of disrepair require action before a section 21 notice can be served. 3. The landlord has cut corners and not followed the legal requirements under the regulations. 4. The deposit has not been protected in the usual way. 5. Where the property requires a licence but remains unlicensed. There is a new Section 21 Notice form, which must be used for tenancies created on or after the 1 October 2015. It can be used for fixed-term tenancies created prior to the 1 October that become periodic tenancies on after the 1 October. The legal requirements include the provision of a gas safety certificate (a copy will do) and the provision of an energy performance certificate (free of charge). In addition, smoke detectors and carbon monoxide detectors are a must. Prescribed information remains a key ingredient. All landlords should note that the Section 21 procedure cannot be used if the tenant has not been given a copy of the booklet entitled DCLG: How to Rent: The checklist for Renting in England, except where the landlord is a

registered social landlord or where the landlord has already served the tenant with the booklet during an earlier tenancy. Landlords are still required to comply with the scheme provider’s terms and conditions and landlords should make sure that the tenants have been provided with a copy of the scheme’s prescribed information document. No Section 21 process is available unless and until the deposit has been protected within a scheme and the prescribed information served. The above is not a bar to gaining possession under one of the mandatory or discretionary grounds by serving the requisite notice under Section 8 of the Housing Act 1988.
