3.8% tax on Investment Income Dear Ask-O, I have been hearing a lot about the new 3.8% sales tax; how will this affect me if I sell my house in 2013? There is a lot of confusion and misinformation about the 3.8% tax that was passed to begin in 2013, as part of the Healthcare Reform Act (ObamaCare). This was caused by many erroneous and misleading documents that went viral on the Internet. Many of my friends and clients have forwarded such documents asking how it might affect their plans for the future. First of all this is NOT a transfer tax on real estate sales, as much of the information out there seems to claim! The new 3.8 % tax is more focused on passive income. The first thing you should know is that unless you make over $200,000 Adjusted Gross Income as a single person or $250,000 if you are married it won’t apply to you at all! That tax is also not imposed on your total AGI (Adjusted Gross Income), but the taxable income is based upon a formula in relation to not only your AGI, but also to where that AGI came from. There is a formula for figuring how that would affect you IF you make over the maximum income. The 3.8% tax will never be collected as a transfer tax on real estate at any time, so you will never pay the tax at the time you sell your home or other investment property. Also when selling your principal residence, you will still receive the full benefit of the $250,000 exclusion on the sale of your home, or $500,000 for married filing jointly. If your capital gain were to be over these amounts, and you make over $200,000 or $250,000 respectively, you may pay the 3.8% on the portions above those amounts also depending on your other income. Investment income from rents may be subject to the tax. If you make over $200,000, the tax will still only apply to your net rental income, therefore after all expenses and depreciation. If you feel that you will fit into the criteria where this tax could apply from these basic rules, than you may want to consult your accountant for the best way to handle your specific questions.

Founded In: 1884 Population: 6,867 (according to 2000 census) Elevation: 5,357 ft. Median Income: $32,397 Lander began in 1869 when the army established a small military post, Camp Augur (later Camp Brown), to protect Shoshone Indians from attacks by the Sioux and Arapaho Indians. Settlers moved here in the late 1870’s from the dying gold mines of South Pass, which is located to the South. Lander got its name from Col. Frederick W. Lander, who surveyed the Oregon Trails Lander Cutoff. One of the town’s early residents was the outlaw Butch Cassidy, who frequented Lander’s poker tables and dance halls. Once the railroad arrived in 1906, Lander became the last stop on the railroad for visitors traveling to Yellowstone and began its rapid growth. During the 1960’s and 70’s, Lander became a mining boomtown but the mine shut its doors in 1983. Modern day Lander is a bustling community. Its downtown area is lined with specialty shops, family owned restaurants and historic buildings. Each year, visitors enjoy world-class high mountain lake fishing, as well as mountain and rock climbing, snowmobiling, cross country skiing and hiking. Sinks Canyon State Park Sinks Canyon State park lies about 7 miles West of Lander on Wyoming Highway 131. There are 30 campsites located along the river amid jumbled granite boulders, pine and aspens. Some of the sites are accessible to RV’s up to 40-feet long. There are displays about ecology, wildlife and the history of Sinks Canyon at the visitor center. You can take a short interpretive hike in the area, watch birds, climb rocks and look for wildlife. South Pass City South Pass City began with a boom in 1867 with the discovery of gold on the southeastern end of the rugged Wind River Mountains. By 1868, Wyoming’s City of Gold boasted over 250 buildings along the banks of Willow Creek and the surrounding hillsides. South Pass City hummed with excitement as numerous saloons, stamp mills, hotels, and businesses took advantage of the gold driven economy. Over 1000 people called South Pass City home during this raucous time. South Pass City was the first of three towns established due to the discovery of gold in what became the Sweetwater Mining District. Median Income: $31,531 The town of Riverton lies within the Wind River Indian Reservation and is the hub city for Fremont County, Wyoming. Riverton’s route along the Yellowstone Highway has made it a favorite stop-over for visitors to the Yellowstone and Grand Teton National Parks. Central Wyoming College Founded in 1966 by a county-wide vote, CWC is one of Wyoming’s seven public two-year community colleges. Founded In: 1884 Population: 962 (according to 2000 census) Elevation: 6,917 ft. Median Income: $28,194 Lying between the Wind River Indian Reservation and infamous Togwotee Pass is the quaint, rustic town of Dubois (DEW-boys). The first settlers wanted to call it “Never Sweat” because of the lack of hard work with some of the settlers, but the federal government named the town Dubois after an Idaho Senator. Dubois runs alongside the Wind River and is surrounded by the Wind River Mountains to the South and the Absaroka Mountains to the North. These mountains make for good logging and so the forests were heavily logged in the first half of the twentieth century to help meet the endless demand for railroad ties to the Chicago and Northwest railroad. Scandinavian Paul Bunyan types known as tie hacks could cut and shape about thirty ties a day, burning about 9000 calories in the process and earning a mere ten cents a tie. Today, Dubois is a popular stop for visitors traveling to Teton National Park and Yellowstone National Park. Recreational opportunities in the Dubois area include camping, fishing, hunting, horseback riding, hiking, photography and many selections of guest ranches and outfitters. Although summer travel is a large economic part of Dubois, there are many winter activities as well. The Dubois area has more than 150 miles of groomed snowmobile trails and access to the Continental Divide trail. Ice fishing, cross country skiing and the Brooks Lake Lodge dog sledding rides are also popular winter activities. Big Game and the National Big Horn Sheep Center Dubois is a region which hosts a vast variety of wildlife. People from afar visit this area to see some of Wyoming’s most diverse big game. Big game species include bighorn sheep, elk, mule deer, moose, antelope and black bear. Cougar and grizzly bears are occasionally sighted, as are wolves. To the South of Dubois lies Whisky Mountain which is home to Wyoming’s big horn sheep and several elk herds during the winter, although many more elk take up winter residence on the Wyoming Game and Fish Department’s Inberg-Roy management area on the East Fork of the Wind River. Dubois is home to the largest wintering bighorn sheep herd in the Lower 48. Since 1949, more than 2,000 sheep have been transplanted to

Utah, Idaho, South Dakota, New Mexico and to other areas of Wyoming from the herd on Whiskey Mountain. Brooks Lake Located 20 miles West of Dubois, and about 7 miles off the main highway, Brooks Lake is located at the base of Brooks Lake Mountain. Brooks Lake Lodge was built in 1922 to serve as a stopover for the many tourists passing through the area on their way to Yellowstone. It is listed in the National Historic Register. The lake, lodge and mountain were named after one of Wyoming’s former governors, Bryant B. Brooks. Trail Lake Ranch Trail Lake Ranch, also called Whiskey Mountain Conservation Camp, is still owned by Wyoming Game and Fish. The facility is leased and programs are run by the Lucius Burch Center at Trail Lake Ranch, which continues the ranch’s long education history. Surrounded by sagebrush hills, massive mountain peaks and a conifer forest, Trail Lake Ranch provides the perfect outdoor classroom for exploring the natural world with expert guides.
