message from the president Dear Members of the Chamber, I am happy about the progress the Chamber has seen in the previous three months. At the beginning of the year, I spoke prophetically at the 2015 Annual General Meeting that the Chamber will see great improvement and I am glad we have something to show for it. A new board was elected at the 2015 Annual General Meeting. We had some new board members elected in: Will Pearson, Mike Musonda and Roseta Chabala. The existing board members that were up for election were all re-elected and I am glad to announce the new board is already making progress. We are currently in the process of formalizing partnerships and working relationships with the Zambia Tourism Board, Zambia Development Agency and the Sub-Saharan Africa Chamber of Commerce, which is based in the United States. We believe these partnerships will enhance the benefits AmCham members receive from the Chamber and are a good start to our goal of engaging relevant stakeholders. As we move into the second quarter, I am pleased to announce that the Chamber expects to have an addition of staff members: two new full-time staff members (including an Executive Director) and three new interns. With the increase in staff, there will be an increase in activities. Being a part of all these activities is a guaranteed way of benefitting from the Chamber and I would once again extend an invitation for you to be active in our activities, specifically committee activities. Lastly, I ask you all to get in touch with the Secretariat to schedule a site visit and to submit your 2015 membership survey. This will help guide the Chamber to ensure we provide the types of benefits you would like to receive from your membership. I wish you all a successful second quarter of the year. Yours sincerely, Jason Kazilimani, Jr. President

Commerce Minister Outlines 2015 Strategy Newly appointed Commerce Minister Margaret Mwanakatwe outlined her priorities for the next 18-months during a 10 March Zambia Chamber of Commerce and Industry (ZACCI) CEO breakfast. Emphasizing Zambia’s need to amend outdated laws and regulations governing the private sector, improve domestic business linkages, increase local content requirements and bolster regional trade, Minister Mwanakatwe reaffirmed some of the comments she had made at the AmCham General Meeting on 19 February. If Minister Mwanakatwe is successful in implementing her strategy during this abbreviated election cycle, there will be plenty to look forward to during 2015. On the legislative front, changes to the Companies Act and the Patent and Company Registration Agency (PACRA) Act are underway and could be passed in the fourth quarter of 2015. Minister Mwanakatwe stated in March that the PACRA Act is aimed at improving the efficiency of business registration to cut red tape and improve efficiency. As for the revised Companies Act, details are limited on the precise changes, as PACRA officials acknowledged at a briefing held by AmCham on 30 March. However, at that same event, PACRA representatives mentioned that as many as ten bills can be expected in the coming year to bring Zambia into conformity with global trends and standards for intellectual property rights, standards and quality. Also on the domestic front, Minister Mwanakatwe aims to improve business linkages in the mining and manufacturing sectors while also raising local content requirements. Doing so without decreasing the competitiveness of firms operating in Zambia will be crucial to winning private sector support and the minister noted that the government is already engaged in dialogue with the mining sector about increasing locally manufactured products in the mining sector supply chain.

By Will Pearson A final initiative for 2015 will be to bolster Zambia’s regional trade linkages. Zambia is working toward bilateral trade deals with its neighbors. Minister Mwanakatwe has specifically noted that the Democratic Republic of Congo and Angola are high priorities and that progress should be expected this year. Beyond bilateral deals, aforementioned private sector legislation amendments are meant to bring Zambia into conformity with regional standards ahead of proposed plans to launch the Tripartite Free Trade Area (TFTA) in May. TFTA intends to link the 26 member states of three regional trading blocks: the Common Market for Eastern and Southern Africa (COMESA), the Southern Africa Development Community (SADC) and the East African Community (EAC). Such a deal would create a common market of 625 million people with a combined GDP of $1.2 trillion, though many hurdles remain regarding implementation of the pact. Successful implementation of the TFTA would pave the way for an even more ambitious African Union strategy for a Continental Free Trade Area (CFTA). Progress on the regional trade front is critical to accelerating Zambia’s growth from the current 5-6 percent range. The Patriotic Front government has promoted its various road improvement projects as a necessary precondition to increase regional trade flows, but apart from infrastructure, much work is to be done. According to the World Bank Doing Business rankings released earlier this year, Zambia’s worst score was its abysmal 177 out of 189 score for trading across borders. If Zambia is truly going to capitalize on being a ‘land-linked’ rather than landlocked country, the government must take steps to address barriers to trade that reduce the attractiveness of investing in Zambia.

January On 13 January, the U.S. Embassy in Zambia invited AmCham members to attend the first the U.S. Department of State Overseas Security Advisory Council (OSAC) meeting in 2015. Mr. Kory Hammond, the U.S. Embassy in Zambia Regional Security Officer, directed the presentation, starting by reviewing the August 2014 OSAC meeting. OSAC was started in 1985 to promote the safety and security of U.S. private firms operating overseas. It has since expanded to include non-U.S. companies and operates in over 140 cities worldwide. OSAC is an opportunity for representatives of the private sector and NGOs to network, discuss topics of interest and to share concerns and best practices around matters of security in Zambia. Mr. Hammond notified participants of all the protective security programs the U.S. Embassy has in its operations. The presentation also provided information about day-to-day safety practices for individuals in Lusaka and an overview of the Zambia’s security situation compared to its neighboring countries. The meeting ended with the U.S. Embassy’s notes on the safety concerns regarding the, then, upcoming presidential elections. The next OSAC meeting date is still TBA and the topic covered will be emergency action plans and crisis management. If you are interested in learning more about OSAC, please visit their website at www.osac.gov.

On 28 January, the Regional Security Office, U.S. Embassy in Zambia, invited AmCham members to the special presentation “Art and Rule of Law”. The presentation brought together representatives from the financial, insurance, real estate and legal sectors to meet with artists and art lovers. Mr. Maurice Brungardt, a special agent with the Bureau of Diplomatic Security for the U.S. Department of State’s law enforcement and security branch, and Mr. William Bwalya Miko, a practicing Zambian artist, curator and culture consultant in Lusaka, led the evening’s presentation. The presentation aimed to simulate a discussion of the current art scene in Zambia and to discuss its potential for a burgeoning art industry. The presentation explored art in a wider context by examining the industry, its legal issues of criminal and civil nature and covered different aspects of regional art markets. Attendees were enlightened to the issues of concern for changing Zambia’s nascent art scene into a strong and economically competitive market. The presentation was followed by a reception hosted by the U.S. Embassy. The reception was an opportunity to encourage further discussion and to allow stakeholders to network with private sector and local law enforcement entities interested in helping market Zambia as an attractive commercial environment for artwork.

AmCham’s 2015 Annual General Meeting (AGM) was held on 19 February at the United States Embassy. With a focus on continuity, the Chamber brought together current and past Chamber members to discuss the previous year’s activities, how to move forward in 2015, voted for a new Board of Directors and concluded with a cocktail themed “American Chamber of Commerce in Zambia’s Vision for Doing Business in Zambia 2015”. The Guests of Honour were the Minister of Commerce Trade and Industry, Honourable Margaret Mwanakatwe and the United States Ambassador Eric Schultz. The Minister emphasized the need for AmCham Zambia to help strengthen economic ties between Zambia and the United States because America is an important partner for investment for Zambia. She added that Zambia is determined to open up to well-meaning investments by putting in place the necessary economic infrastructure. In his speech, Ambassador Eric Schultz urged the Zambian Government to improve its World Bank ease of doing business rating from 111 to at least 55 to attract more foreign and domestic investments. “Better polices will not only lead to greater growth now, but will also position Zambia to benefit when Africa becomes the emerging market and a principal driver of global growth in the future,” he said. Guests enjoyed the evening’s networking cocktail over food and drinks sponsored by Airtel Zambia and the United States Embassy in Zambia.

MARCH
On 5 March, AmCham president Jason Kazilimani Jr., along with other members of the Board of Directors, met with a visiting delegation of U.S. government officials led by Ambassador Bisa Williams to discuss private sector investment opportunities in Zambia. The delegation sought input from AmCham about Zambian government policy priorities, key areas of concern for the private sector in Zambia and suggestions on attractive sectors for U.S. firms to invest in Zambia. Much of the discussion centered on ongoing policy and taxation uncertainty in the mining sector along with volatility facing the kwacha. In addition, the delegation was keen to discuss the energy and agribusiness sectors. Of note, the meeting focused on ways that Power Africa, the Obama administration program to help build power plants in SubSaharan Africa, could be extended to Zambia and the role AmCham could play in advocating Zambia’s regional role in the Southern and Eastern Africa power markets, as a way to draw investment into the sector. The meeting was arranged by Adam Ross, Deputy Chief of Section for Political and Economic Affairs at the U.S. Embassy in Lusaka. Williams, the Deputy Assistant Secretary of the Bureau of African Affairs at the U.S. State Department, was joined by Eric Meyer, the Director in the Office of African Nations at the U.S. Treasury Department and Eric Andersen, the Zambia desk officer in the Office of Southern Africa Affairs at the State Department.
5 The Patents and Companies Registration Agency (PACRA) offered to give a special presentation to AmCham members on the different agency functions Chamber members could benefit from. PACRA is a semi-autonomous executive agency of the Zambian Ministry of Commerce, Trade and Industry. Its principal functions are to operate a legal system for registration and protection of commercial and industrial property and to serve as a legal depository of the information tendered for registration. It comprises two core departments: Industrial Property and Commercial.

The presentation was hosted in the beautiful Makumbi Room, which was graciously sponsored by AmCham member Intercontinental Hotel Lusaka on 30 March. Mr. Gabriel Mwamba (Senior Examiner of Patents and Industrial Designs), Mr. Jethro Ndhlovu (Acting Senior Examiner of Trademarks) and Mrs. Luse Chansa-Kalonga (Manager of Compliance & Awareness) gave presentations on the process of registering a business, patent, trademark and industrial design. They explained why it was important to register intellectual property and the rights one is entitled to once it has been registered. The presentation concluded with a question and answer session with a panel of representatives from PACRA and AmCham members Corpus Legal Practitioners and Corpus Global Corporate Business Solutions.
