Initial Ruling on Sunset Review Issued

The U.S. Department of Commerce (DOC) decided the existing tariffs on Iranian pistachios should remain in place. In its statement, published on August 5th in the Federal Register, the DOC stated that “a revocation of the antidumping duty order on certain inshell (raw) pistachios from the Islamic Republic of Iran would likely lead to continuation or recurrence of dumping if the [existing] order was revoked.” Therefore, the DOC is keeping the duties in place, specifically naming entities that have petitioned the DOC, as well as issuing a blanket order covering all other foreign entities. This is definitely good news for the U.S. pistachio industry. However, the U.S. International Trade Commission (USITC) still has their “full” Sunset Review to be heard later this fall or in early 2017. If the USITC’s decision opposes the DOC’s ruling, the DOC would have to reverse their findings and revoke the current antidumping order. So while an initial battle has been won, there is still more work to be done. Under the USITC’s “full” review, the USITC will prepare questionnaires which, when completed, will provide the federal agencies with aggregated economic information. The questionnaire will require detailed information from pistachio growers and handlers. Questionnaires that are not sufficiently completed by the grower or handler may be viewed negatively by the USITC. Under the initial 1986 antidumping petition and the 2005 Sunset Review, the California Pistachio Commission and APG (called Western Pistachio Association at that time) provided accounting assistance for growers and handlers unable to complete the questionnaire. APG is offering those same services for this 2016 Sunset Review. APG has worked tirelessly on this issue to advocate on behalf of the U.S. pistachio industry and, along with Western Agricultural Processors Association, will continue our representation. As the process moves forward, we will keep you updated. We will also inform you when we obtain knowledge that the grower and handler questionnaires have been sent out.

Farm Advisor, Emeritus Harvest: Growers started shaking Golden Hills and Kalehgucci the week of August 22, but I do not think most Kerman orchards (those still on P. atlantica will be earliest) will be ready until the first week in September. Everyone seems to now realize there are a lot of pistachios to harvest, thus there are already discussions about not having enough trucks or processing capacity to handle the peak. Read more …
