Man Pleads Guilty to Poaching $23,000+ Trophy Buck In addition, Alspaugh will lose his hunting privileges for two years. He will be entered into the Wildlife Violator’s Compact and most likely will lose hunting rights in 36 other states. The Division of Wildlife is also imposing restitution for the deer in the amount of $23,816.95. This is in accordance with Ohio’s revised restitution law for illegal taking of white-tailed deer. The law went into effect March 2008 and allows the Division of Wildlife to seek an increased recovery value on all illegally harvested wildlife.
Ohio Department Natural Resources BELLEFONTAINE, OH --(Ammoland.com)- A Logan County man pled guilty to three wildlife violations stemming from the illegal taking of a trophy white-tailed deer in the Bellefontaine Municipal Court on Monday, January 3.
The non-typical trophy deer, scored according to Boone & Crockett (B&C) guidelines, netted an impressive 218 7/8.
As a result, he will be required to pay $23,816.59 in restitution, according to the Ohio Department of Natural Resources (ODNR) Division of Wildlife.
A concerned citizen contacted Ohio wildlife officers Adam Smith and Jeff Tipton about the questionable shooting of the trophy deer in December 2010. Officers were able to recover the deer and determine that it was unlawfully taken.
James C. Alspaugh, 39, of West Mansfield pled guilty to three charges including hunting by the aid of a motor vehicle, shooting from a roadway, and hunting without permission. The Honorable Judge John Ross presided over the case and ordered Alspaugh to pay $400 in fines, an additional $151.50 in court costs, and to forfeit the deer. Alspaugh was ordered to spend 48 hours in the Logan County Jail.
The Division of Wildlife is encouraging citizens to report any illegal activity they observe by contacting the TIP line. Tips may be phoned anonymously to 1-800-POACHER. • If you are working on private lands, you’ll need to get the OK from the landowner to place baits on the property. • Baits will be placed between April 23 and May 15. You’ll receive directions from the DNR biologist about how to handle the baits. • Leave the baits for two to three weeks. Then, you’ll check the baits and remove them from the woods by May 31. The baits are loaded with food containing the antibiotic tetracycline. Tetracycline leaves a mark on bone tissue. During the bear hunting season, hunters will be asked to provide a rib sample which will show if the bear ate the tetracycline. DNR scientists will use information on the number of baits eaten by bears, bears harvested and harvested bears marked tetracycline to estimate the population. The 2006 study showed the bear population was much larger than other studies had suggested. In an effort to keep current on bear population trends, the DNR’s bear management plan calls for repeating this population study every five years. The final results of this upcoming study will be available in 2013. The DNR sends an early thanks to the Wis. Bear Hunters Association whose members already have volunteered to set and to check baits as part of this spring’s study. They also will build about 4,000 bait boxes and help find baiting material. Their participation was critical to the success of the 2006 research, and the DNR looks forward to working with the group and – and the new volunteers – again this year.

There is a strong likelihood that the three gun bills will pass out of committee, although HB 2797 will not likely be acted on on the 8th. But anything can happen and there is always the potential for damaging amendments or other problems. So we are asking that you contact the committee urging support for all three bills.

That being said it is important to note that committee schedules can change at any time, right up until the very last minute. If you plan to attend the hearing, make sure you double-check that there have been no scheduling changes.

It’s safe to say that the two members of the Judiciary Committee least likely to support gun rights are Carolyn Tomei and Mary Nolan. But, if the committee does pass any or all of these bills, the measures will then have to pass the full House. If we prevail there, the whole process starts again in the Senate Judiciary Committee whose Chairman, Floyd Prozanski, is not at all friendly to gun rights. We fully expect a battle to get any of these bills heard in his committee.

While we are making progress, we still have a lot of work to do. There are other bills in the House that have NOT been scheduled for a hearing and they only will be if you let the co-chairs of House Judiciary know they are important. These bills should not be seen as controversial, but they could easily become bargaining chips if we don’t make our voices heard. A brief review of them follows:
Salem, Oregon --(Ammoland.com)- WHERE WE STAND NOW This legislative session has seen a large number of firearms-related bills, both good and bad. But it’s no trick to get bills introduced; the typical session may see 4000 of them. The real challenge is to get any of them to go anywhere. As of now several bills are scheduled for action in their house of origin, in this case the Oregon House. Keep in mind, this is just one of many steps on the long road to a bill becoming a law.
HB 2791 Removes Department of State Police as designated state point of contact for purposes of National Instant Criminal Background Check System.
Three gun bills are scheduled for action on March 8th in the House Judiciary Committee. Two of those bills, HB 2792 and HB 2787, have already received hearings and are scheduled for “work sessions” where bills are amended and adopted. A third bill will receive its first public hearing. That is HB 2797.
There is a companion bill for this in the Senate, SB 934. Recently, the OSP has greatly increased the time it takes to conduct a standard background check with dealers often waiting over an hour to get through to the ID unit. You can imagine the strain this puts on business and it’s even worse at gun shows. Furthermore, a problem we thought we had solved in the past has come back with a vengeance. The incidence of complaints about unjustified delays on approvals has shot back up after having come down significantly. That’s why we want the State Police out of the background check business. That and their stated intention to TRIPLE their fees. (Slow downs, price increases…coincidence? You decide.)
To recap, HB 2792 recognizes other states’ concealed handgun licenses. HB 2787 protects the privacy of concealed handgun license holders. HB 2797 addresses the problem with Oregon law that forbids anyone to carry a loaded firearm on a snowmobile or ATV (but does not even define what “loaded” means) and also corrects the flaw in Oregon Statute that allows no practical, legal way to transport a handgun on a motorcycle unless the rider has a CHL. This is one of several bills dealing with carry on ATVs but the only one that deals with the motorcycle problem. OFF requested this bill after a Senate bill in 2009 inadvertently dropped the motorcycle language. We ask that you contact the committee and request that they support all three bills.
HB 2793 Modifies definition of public place for purpose of certain city or county ordinances related to possession of loaded firearms. In 2008 the Oregon Appeals Court turned our “preemption statue” on its ear by concluding that your car must be treated like a “public place.” Thus all the protections gun owners thought they had while traveling from place to place were gone and you could easily find yourself breaking some local code or rule because you drove into a locality with its own gun restrictions. Localities may only restrict guns in “public places” but who thinks their car is one? This important bill would reverse this problem and once again protect traveling gun owners.
Also scheduled for that meeting is HB 3100, a bill which modifies the jurisdiction of the “Psychiatric Security Review Board.” While this is not a “gun bill”, we are paying close attention to this body since now, thanks to the NRA, it has a lot of control over gun owners and it has shown no interest in protecting gun owners’ rights.

HB 2789 Authorizes issuance of concealed handgun license to person convicted or diverted for certain marijuana offenses in another jurisdiction if conviction or diversion is equivalent to conviction or diversion that does not operate as bar to obtaining license under Oregon law.

Oregon law allows a person with ONE conviction or ONE diversion for a small amount of marijuana to apply for a concealed handgun license. But, that conviction or diversion MUST have been in Oregon and MUST have been AFTER 1973. So a person with a minor out-of-state conviction or someone whose incident was almost 40 years old is locked out. We think this is an oversight and not fair. HB 2789 would correct that problem.

There’s only one reason Congress canceled the program. It’s the same reason at the heart of the teachers unions’ battle in Wisconsin. It comes down to this: control and educational indoctrination.
The Wisconsin Education Association Council leads the pack of lobbyists, spending two times as much and five times the amount of time as its closest lobbying competitor in order to buy, bribe and bamboozle legislators to do as it wants.
I wrote in the paperback expansion of my New York Times best-seller “Black Belt Patriotism: How To Reawaken America”: “The reason that government … (is) cracking down on private instruction has more to do with suppressing alternative education than assuring educational standards. The rationale is quite simple, though rarely if ever stated: control future generations and you control the future. So rather than letting parents be the primary educators of their children — either directly or by educating their children in the private schools of their choice — (government wants) to deny parental rights, establish an educational monopoly run by the state, and limit private education options. It is so simple any socialist can understand it. As Joseph Stalin once stated, ‘Education is a weapon whose effects depend on who holds it in his hands and at whom it is aimed.’”
What also chaps my hide is that a gigantic chunk of the WEAC’s gangster money and time is used to lobby against alternative choices in schools (including charter schools) and against tuition tax credit programs, which aid parents in sending their children to private schools. The fact is that teachers union-sponsored protests spreading the land are not primarily about the teachers or the students. They are about the unions and feds maintaining their Mafia-style rule over education and our kids and preventing people from choosing educational alternatives. Or are we naive enough to believe that Richard Trumka, president of the AFL-CIO, is stopping by the White House repeatedly for just tea and crumpets even though he admitted this past week: “I’m at the White House a couple times a week. … I have conversations every day with someone in the White House or in the administration”?
Parents deserve educational choices. Choice is what this country was founded upon. Want to better U.S. public education? Feed the competition!
It brings me back to that bully educational manifesto of President Barack Obama’s secretary of education, Arne Duncan, who explained in an NPR interview, “I’m a big believer in choice and competition, but I think we can do that within the public-school framework.” There’s something that the U.S. government and unions don’t want you to know. And it came out a short time ago in a Heritage Foundation report on education. It conveys the general public’s increasing dissatisfaction with public education and tells of the rising number of people opting for private education. The report explains that during the 2007 and 2008 legislative sessions, 44 states introduced school-choice legislation. Forty-four states! And in 2008, choices for private school were enacted into law or expanded in Arizona, Utah, Georgia, Florida, Louisiana and Pennsylvania. And as of 2009, 14 states and Washington, D.C., offered voucher or education tax credit programs.

Despite the growing public preference for private education, however, Congress last year canceled the District of Columbia’s Opportunity Scholarship Program, created in 2004 to offer students from low-income families in the nation’s capital an opportunity to join the school voucher community. The law provided $14 million in scholarships to help pay tuition at private schools of their choosing. But no longer.

(All of Thurgood Marshall Academy’s charter graduates are accepted to colleges.) Why would Congress phase out a program that cost $7,500 per student annually, compared with the $15,000 it costs in Washington’s public schools to educate a child?
