UNDERSTANDING THE 8 MYTHS DEBUNKED ABOUT THE NAR SETTLEMENT

TRUTH

ARE REALTORS® BEING FORCED TO REDUCE THEIR FEES?

No. The settlement in no way establishes any standard or limitation on what Realtors may charge nor the services they elect to deliver. REALTOR® fees have always been fully negotiable and are widely varied across each market.

DOES THE SETTLEMENT ALLOW SELLERS TO OPT OUT OF PAYING BUYER AGENT COMPENSATION FOR THE FIRST TIME?

No. There has never been any obligation for a seller to pay buyer agent compensation at any time.

ARE SELLERS PROHIBITED FROM PAYING COMMISSIONS TO BUYER’S AGENTS POST-SETTLEMENT?

No. The practice of paying a buyer’s agent is completely a seller’s decision and nothing changes in terms of options.

WILL SELLERS NO LONGER BEAR THE FINANCIAL BURDEN OF BUYER AGENT FEES?

Although sellers can elect not to pay a buyer agent compensation, that doesn’t mean they will avoid the economics altogether. Buyers may request certain concessions or contingencies requiring the seller to pay.

DOES THE SETTLEMENT REDUCE THE TOTAL COST OF TRANSACTION SERVICES?

No. Should sellers choose to compensate only the listing agent, buyers will now have to pay for their own representation if they don’t require the seller to pay it as a contingency. Just because two parties may now share the cost of services doesn’t mean the total cost of the transaction has been lowered.

CAN THE SETTLEMENT LEAD TO A MEANINGFUL DECREASE IN REAL ESTATE PRICES AND MAKE HOMEOWNERSHIP MORE AFFORDABLE?

No. General values in real estate are determined by the fundamentals of supply and demand. The real reason home ownership is increasingly less affordable is that homes have risen dramatically in value in recent years.

IS THE SETTLEMENT A SIGNIFICANT WIN FOR BUYERS IN FEE NEGOTIATION?

No. As a buyer having to provide the funds needed for a down payment and closing expenses, you’re more than likely happy to have the commission paid by the seller so you don’t have to come up with additional dollars at closing.

WILL THERE BE A SUBSTANTIAL RESTITUTION TO CONSUMERS FROM THE SETTLEMENT?

No. Dividing the settlement amount by the number of potentially qualifying consumers is negligible. Truthfully, the majority of REALTORS® work incredibly hard and go above and beyond for their clients.
