81 INVESTORS HAVE ALREADY OBTAINED THE SPANISH GOLDEN VISA According to data gathered up to May 5, a total of 81 high net worth investors and their families have obtained the Golden Visa in Spain, mainly from Russia and China, out of which 6 have invested in capital, 72 in real estate proper:es and 3 in projects of general interest. JC&A Abogados has successfully dealt to date with 4 of the 81 Visas, represen:ng a 5% of the total. As many of you may know last September the Spanish Government approved the so called “Law of Entrepreneurs” which contains the possibility that Investors can apply for Residency Visas and Residency Authoriza:ons. -‐ To those who acquire real estate assets for a total value of at least 500.000 Euros free of charges and encumbrances; amounts exceeding 500.000 Euros can be charged. -‐ To those who acquire 2 million Euros in Spanish public bonds or to those who invest 1 million Euros in Spanish bank deposits or Spanish companies’ shares. -‐ To those who promote a new business venture to be developed in Spain that could qualified and be considered of general interest. The investment can be carried out through a legal en:ty (company) provided that this later one is not domiciled in a tax haven and that the applicant holds the majority of the vo:ng rights and has sufficient power to appoint or dismiss members of the Board. The holders of the Investor Residency Visa or Residency Authoriza:on will have all the benefits of the Schengen Visa, en:tling the holder freedom of movement within the member states territories. The investor’s spouse, the investor´s children under age, and the investor’s children over 18 who are economically dependent of the investor due to health reasons, can benefit from the investor’s investment for the purpose of applying for the Residency Visa or Residency Authoriza:on. One year Residency Visa: is granted for an ini:al period of 1 year. The procedure starts with an applica:on for the Residency Visa at the Spanish Consular offices of the country of the investor/applicant. Residency Authoriza5ons: Ini:al Residence authorisa:on would be granted for a period of two years with the possibility of further renewals (two years each). To be able to apply for it, it is required that: -‐ The applica:on is submiJed when the Residency Visa has been issued and is s:ll valid or within 90 days ager its expiring date; -‐ The applicant has travelled to Spain at least once during the Residency Visa validity period; -‐ The applicant has maintained the investment required.
