Rental purchase rejected The city has countered with an offer to increase the allowed occupancy from 10 to 12 guests.

ANNA MARIA – City Commissioners recently rejected a counteroffer pertaining to the potential purchase of a vacation rental at 117 Willow Ave for $1.2 million.

The four-bedroom rental home in question is owned by 117 Willow LLC, which lists developer Shawn Kaleta and Anna Maria Vacations owner Joe Varner as authorized persons; and attorney Louis Najmy as its registered agent.

The mayor and city attorney are still awaiting final word as to whether the property owners will accept the 12-person occupancy exception offered as an alternative means of settling the owners’ Bert Harris claim. The city has received verbal acceptance of the 12-person occupancy limit, but the amended settlement agreement approved by the commission on Oct. 13 has not yet been signed.

Earlier this month, the city presented 117 Willow LLC attorney Aaron Thomas with a contract to purchase the home and its furnishings for $1,221,925. The contract required a $1,000 deposit and granted the city the ability to reassign the purchase contract to another buyer.

The counteroffer submitted on behalf of the property owners requested an additional $75,000 for the furnishings and a $100,000 deposit that would be-

come non-refundable 45 days after the purchase contract was signed, which would have put the city at risk of losing the deposit if the sale did not close within that timeframe.

The counteroffer requested the city not be allowed to reassign the purchase contract to another party, and the owners asked the city pay the real estate agent’s 4 percent commission fee, a fee usually paid by the seller.

“It’s my recommendation to reject

this counter offer,” City Attorney Becky Vose told the commission.

When Commissioner Chuck Webb asked if the city countered the counteroffer, Vose said “They made it pretty clear this is the minimum they would take.”

ANNA MARIA – The City Commission has approved nine more Bert Harris claim settlement offers, including one that proposes purchasing a vacant lot at 62 North Shore Dr. owned

by John and Lou Ann Lynch.

When presenting the North Shore Drive settlement offer at the Oct. 13 meeting, City Attorney Becky Vose said the Lynchs’ claim is based on their plans to build a 5,200 square foot second home that would also be used as a short-term vacation rental that accommodates 12 guests.

The Bert Harris claim cites $340,000 in diminished property value if the owners are bound to the city’s eightperson vacation rental occupancy limit.

Vose told the commission the submitted building plans indicate four bedrooms and a den. According to the two-plustwo occupancy provision being offered to other claim filers, this would allow for a maximum of 10 occupants. Vose said a house that large could accommodate more bedrooms and she suggested the owners consider eliminating the den and make that a bedroom that would allow for two more guests.

Commissioner Carol Carter agreed.

“That location is a perfect location for a pocket park, in addition to land that

would absorb water, because that is the first turn on the bike path,” she said.

Commissioner Dale Woodland made a motion to approve a settlement offer for the purchase of the vacant lot or the two-plus-two occupancy allowance, with a maximum of 12 guests.

“I can support the purchase, I can’t support the occupancy,” Webb said.

The commission approved the settlement offer 3-2, with Commissioner Nancy Yetter also voting in opposition.

Is the flooding getting worse?

The mayor is researching numerous actions that could be taken to help reduce flooding.

ANNA MARIA – The mayor, city commission and City Engineer Lynn Burnett spent an hour recently discussing drainage and flooding issues.

“With these last couple storms, it seems that we’ve gotten all kinds of feedback from residents who have lived here for a long time saying we never had flooding and now all of the sudden we’re getting flooding,” Mayor Dan Murphy said at the Oct. 13 commission work session.

“We’ve invested a lot of money in flood abatement with the vertical filtration trenches, yet I know there are places that are still underwater four or five days after a storm event. We don’t seem to be recovering as fast, and the effects seem to be worse that what they were in the past,” he added.

Burnett said the trenches were designed to be parked on, but the top layer of stones needs to be scraped replaced every 3-5 years. She also said the city of Holmes Beach uses a vacuuming device to remove sand and leaves that accumulate on the stones.

As he’s done before, Commissioner Dale Woodland praised the effectiveness of the filtration trenches and said

he was amazed at how well they’ve worked in most parts of the city.

When discussing the causes of the increased flooding, Burnett mentioned the increased frequency, intensity and duration of heavy rain events, and she said this weather cycle is expected to continue. She also said the sea level has risen eight inches since 1988.

The discussion produced a list of options for Murphy to research and bring back to the commission at its next meeting.

Burnett suggested installing WaStop check valves that would prevent water associated with high tides from flowing back into stormwater pipes that are trying to deliver rainwater to outfall areas.

When this occurs, the water backs up and produces standing water. Burnett estimated it would cost $250,000 to purchase 50 check valves that could be installed and maintained by the Public Works Department.

Murphy mentioned possibly installing lift stations that would help move the water along – some of which might be located on private property. He said some property owners have already offered access to their property in order to make drainage improvements.

Burnett stressed the need to continue elevating the roads as they are resurfaced every 15 years or so, and there was talk of possibly elevating some of the low-lying areas where water collects.

LETTERS TO THE EDITOR A $4 million dollar parking garage for Bradenton Beach!

Elected officials want to spend $4 million dollars to build a garage for 200 cars on Third Street South. Progress? Hardly. It would make traffic and our cost of living worse. And it might not improve the parking situation. Let’s take a look.

Starting with traffic. Imagine it's Wednesday afternoon in February. You’re driving south on Gulf Drive, seeking a happy hour watering hole. The Cortez Bridge is disgorging hundreds of motorists onto the Island, all moving south (because that’s where the action is, right?). Farther down the street, early birds are trying to turn left at Third Street South into a new parking garage that may or may not be full already. Pedestrians are doing what pedestrians do, crossing the road to see the beach before crossing back over for drinks. Nothing is moving. Not only are you stuck behind that overloaded Cortez Road intersection, but all Gulf Drive traffic is jammed at Third Street South. Perhaps you’re driving north to escape Longboat Key? You’re screwed, too.

Let’s assume the 200 spaces can turn over three times a day, a reasonable guess during the season. That’s 600 cars per day or as many as 1,200 daily turns onto and off of Gulf Drive. That’s a lot of stopping and

waiting, far more than now (1,200 times).

Let’s consider cost. Four million dollars at 4 percent interest is $160,000 a year, or $438 per day.

How about the cost of landscape and building maintenance, power, cleaning, trash cleanup, insurance and management? Sixty thousand dollars a year, or $165 per day, probably won’t cut it, but let’s use it for discussion. The combination comes to $602 per day. At a dollar per car in a full garage, business during the season might pay the way. But the season is just January through April. Who will pay the shortfall the rest of the year?

You will, Mr. and Mrs. Taxpayer.

Consider the blight. The proposed site, Joe’s Eats and Sweets, occupies a lot 104 feet long by 105 feet deep.

Allowing for reasonable setback dimensions, the garage would occupy a footprint measuring 120 feet x 80 feet. To fit 200 cars, we need a 450 foot long, two-story garage in which each floor contains two, 20-foot rows of perpendicular parking with a 25foot drive lane and two-way ramp.

That’s a monster. The Joe’s Eats and Sweets lot won’t be enough. The town will need five additional lots east of Joe’s to cram the thing in.

That’s the entire north side of Third Street South. Sure, we could condense the footprint – by going three stories tall. The building still would

be immense and completely out of character for Bradenton Beach.

"But parking is hard to find," you say. "We need a garage." No, we don’t. Nearby Coquina beach boasts tons of free parking and a free shuttle running every 20 minutes. Tipsonly transportation services have proliferated. There’s Uber. And the walk isn’t bad. We don’t need the additional traffic, the added cost or the blight on a quaint town. Tell the mayor and council – we don’t want or need a garage.

'Food raiser' success We had a terrifically successfull food raiser last weekend for the food banks. We want to thank the AMI Publix for allowing us to talk to their customers.

But most of all we want to thank the customers going into Publix who just wanted to concentrate on food but listened to us Rotarians on the way in and came out of the store with food for the hungry or generous cash for the food banks.

Plans in place to raise schooner The Italian schooner San Francesco is down but not out.

CORTEZ – With help from some new friends, Rick Stewart hopes to raise his sunken schooner by the end of the month.

Built in Italy in 1870, the wooden schooner San Francesco is currently sitting half-submerged on the bottom of the Intracoastal Waterway in front of the Seafood Shack restaurant. After the power to her bilge pumps failed, the schooner became flooded and sank due to the heavy rains associated with Hurricane Hermine.

The schooner also sank in January during a similar heavy rain event.

“I’m hearing rumors it’s going to be cut up for firewood or turned into a bar – all these different things. I came pretty close to throwing in the towel, but it’s not over yet,” Stewart said.

While having dinner at the Seafood Shack, Seminole resident and Tampabased mobile marine repair business owner Captain Joe MacFarlane inquired about the sunken schooner. This led later to a discussion with Stewart about raising the ship.

“Captain Joe had some great ideas, and he stepped forward, so I promoted him to the position of project coordinator,” Stewart said.

“A few days later, Captain Joe and I met with Curt Bowen, the publisher of Advanced Diver Magazine, who said he and his team of divers would be willing to raise the ship in exchange for having the opportunity to do a documentary about her,” Stewart explained.

According to MacFarlane, the divers will first examine the submerged hull to see if its damaged before airbags and pumps are used to raise the ship.

“It’s an 1870’s ship, and it deserves to be saved. We’re going to save that ship. They need help and I’ve got the connections,” MacFarlane said.

MacFarlane said the only reason the ship hasn’t already been raised is because the divers have been busy on Florida’s east coast raising other ships that sank during Hermine.

McFarlane has also located a hydraulic trailer that will later be used to transport the schooner by land to the FISH Boatworks on Cortez Road, where the wooden hull will be replaced while in temporary dry dock. Once the hull is replaced, Stewart hopes to get the San

BayFest parking tickets decrease The city issued 88 parking tickets during BayFest, which is 90 less than the 178 issued last year.

ANNA MARIA – Contrary to a popular story making its way around the Island, 400 parking tickets were not issued during the BayFest celebration that took place Saturday, Oct. 15.

According to a report obtained from the city, 88 parking tickets were issued in the city of Anna Maria on the day the annual BayFest event took place.

Mayor Dan Murphy and Sgt. Russell Schnering said all of the parking tickets were issued by Code Enforcement Department personnel, and none were issued by the Manatee County Sheriff’s Office deputies that worked the event, including three additional deputies who were brought in to provide more security. It had been rumored that the additional deputies were among those writing parking tickets.

“As far as I know none of our deputies issued any tickets. We were busy doing other things,” Schnering said.

“I was very happy we only had 88 this year. Last year we had 178,” Murphy

“I don’t think they have any realistic reason for doing it, other than trying to make it difficult for the city,” Vose said.

“When you look at the stipulations – jacking up the price for furniture and the sales commission – it appears to me they’re not anxious to sell that home,” Mayor Dan Murphy said.

“I don’t think this is a sincere offer,” Commissioner Nancy Yetter said.

After unanimously rejecting the counteroffer, the commission voted 4-1 against engaging in further negotiations to purchase the property, with Webb casting the only vote in favor of doing so.

When explaining her recommendation to allow two additional occupants, Vose said the house has a den with French doors that would allow it to serve as a bedroom, and it also has a large bedroom that currently contains two sets of bunk beds.

She said increasing the occupancy offer from 10 to 12 would allow two additional guests in the den or the large bedroom.

Commissioners Woodland, Carol Carter and Doug Copeland approved the amended settlement offer by a 3-2 vote, with Webb and Yetter opposing an amended settlement offer that would offer occupancy that exceeds the city’s eight-person limit for vacation rentals.

said. “I was pleased that half as many tickets were issued as last year. It was almost like a Saturday during season.”

Murphy said an average of 50 to 60 parking tickets are issued on a busy Saturday.

He attributed some of the reduction in tickets to the parking space provided by the CrossPointe Fellowship church on Gulf Drive.

“I was really pleased with the number of people using the CrossPointe park and ride and taking the trolley to BayFest. In the past that wasn’t used and we issued a lot of tickets because there was limited parking,” he said.

BayFest is hosted and organized by the Anna Maria Island Chamber of Commerce. Chamber President and event chairperson Debra Wing said she also heard the rumor about 400 parking tickets being issued, but her communications with Murphy indicated otherwise.

“It’s not an issue. It’s not an extreme number to the Chamber,” she said of the tickets issued.

She also offered praise for the mayor and the city for the assistance provided during BayFest.

“The mayor has always been very helpful,” Wing said.

A review of the surface materials allowed as part of the 40 percent lot coverage was also suggested, and it was noted that the prevalent use of shells that cover buried weed mats contributes to poor drainage.

Builders are required to comply with the city’s drainage and water retention requirements, and the mayor and staff will also look at whether those standards need to be increased.

“For the most part, builders are doing a great job,” Burnett said.

ANNA MARIA – Alfonso Abreu and Sylvia Noguera have spiced up the café at The Center of Anna Maria Island with an international flair featuring such delights as empanadas, chipas and yucca fries.

“We have a partnership with the Center to lease the space in the kitchen to operate our culinary operation and distribution center.” Abreu explained.

Abreu, originally from the Dominican Republic, grew up in the Bronx and developed a talent for music, but pursued a career in technology – from software to consulting and coaching to startups.

“My mom and dad were both great cooks, and I learned from them,” he said. “Through the years as I got better, I hosted parties, and people said I should open a restaurant, but I resisted.”

However, when he met Sylvia, that resistance melted. Sylvia, who hails from Argentina, grew up in a fam-

Folk School funding sought Donors are needed to fund a Folk School in Cortez.

CORTEZ – The Florida Maritime Museum plans to start a Folk School where people can learn woodworking, quilt making, fish cutting, net mending, vegetable canning, mapmaking and other traditional folk arts and crafts.

The year-round school will be the only one in Florida, museum supervisor Amara Nash said.

Classes will emphasize maritime heritage, which is at risk of being lost, and will “allow us a more active opportunity to preserve and share traditional knowledge,” she said.

The Patterson Foundation has provided a consultant to help the museum develop

a business plan for the school that will generate revenue. The 18-month-long planning process will culminate Nov. 3 with a “Shark Tank”-type presentation of the business plan to prospective donors, she said.

A rehearsal is scheduled on Thursday, Oct. 27, at 9 a.m. at the museum, 4415 119th St. W., for prospective donors and other interested community members to hear the plan, ask questions and offer suggestions prior to the formal presentation.

If the presentation succeeds in securing enough funding, a staff person could be hired to manage the school, Nash said, adding that otherwise, the school’s development will proceed, but at a slower pace.

Fire fees under study West Manatee Fire Rescue Chief Tom Sousa reported to fire commissioners that the district received only one proposal for a firm to provide consulting services to study its assessment and impact fees for possible updating. He said the firm’s fee is $30,000.

“We may not want to do what

they’re proposing, but they’re open to modifying the proposal,” he said.

He suggested that he and one board member meet with the firm’s representative to discuss the issue.

The board appointed Commissioner David Bishop.

Grassy Point gets permit

The Army Corps of Engineers last week issued a permit for the work at Grassy Point Preserve in Holmes Beach. The city has a contract with Tampa Contracting Services (TCS) to construct boardwalks at the preserve in two phases.

Phase I will begin where the current trail ends and proceed to a circular upland area.

Phase II will be a path from the circular area to the water and the site of the future observation deck.

The 32-acre environmental preserve is located along the east side of Gulf Drive across from Publix and the Anna Maria Island Center. It is closed during construction.

WMFR to sign agreement with Coast Guard West Manatee Fire Rescue commissioners authorized Chief Tom Sousa to enter into an agreement with the U.S. Coast Guard regarding assistance for shipboard fires in designated areas of Tampa Bay. According to Sousa, the most recent significant event that resulted in response from fire agencies occurred on Aug. 10, 1993.

HOLMES BEACH – Longboat Key Vice Mayor Terry Gans advised island elected officials last week that they must “keep an eye on” the Florida Department of Transportation’s (FDOT) planned barrier island traffic study.

“It will require a great deal of patience and acceptance from the majority of the public of the way these things move or don’t move,” he said, adding that the study will not take place until 2018.

“But that’s the ball park we have to play in if we want the state’s participation in getting relief,” he continued. “We have to hope the study is done intelligently and gives attention to solutions which are far reaching and probably are not going to be very palatable initially to FDOT and even elected officials.”

Manatee County Commissioner Betsy Benac said the Peninsula Bay and Lake Flores projects are to be included in the study.

“I have found FDOT has been very responsive in listening to the needs we’ve generated,” Holmes Beach Mayor Bob Johnson. “I think it will progress well. If we don’t study the ‘to and from’ and just look at the ‘on,’ we have accomplished nothing.”

HOLMES BEACH – The streets of the city resembled a Halloween horror movie with students of Anna Maria Elementary School marching from the Anna Maria Chamber of Commerce parking lot to the field next to city hall.

Some of them were downright horrifying – apes, zombies and other nightmarish creatures – and others were enchanting – princesses, a waitress with a platter of food and Bart and Homer Simpson. The nightmare ended at the field where AME’s 2016 Fall Fest got underway.

There were games, bounce houses and a big, long inflatable slide plus food and booths selling arts and crafts. It was all in the name of raising funds for the PTO. This is the second year the parade went north from the Chamber instead of south to the school.

• Coarsely chop onion. Cut ¼ pineapple into rounds and place to side. Cut remaining ¾ of pineapple into small cubes. Place chopped onion and chopped pineapple in blender. Add orange juice, distilled white vinegar, guajillo chile powder, garlic cloves, coarse kosher salt, oregano, ground cumin, chipotle chile, and adobo, then puree the marinade until smooth.

Place pork in large sealable plastic bag. Add marinade and seal bag; release excess air.

Chill for six hours.

• Prepare barbecue to medium-high heat. Grill remaining pineapple until slightly charred.

Grill pork with some marinade still clinging until slightly charred and cooked through.

Transfer pineapple and pork to cutting board.

Chop pineapple into 1/2-inch cubes. Chop the pork. Transfer pineapple and pork to a large bowl and toss to combine.

• Finely chop the remaining onion half and place in medium bowl. Add cilantro; toss to combine. Grill tortillas until warm and slightly charred.

• Serve pork-pineapple mixture with onioncilantro relish, chile salsa and lime wedges.

Sarasota Bay Watch’s 8th annual cleanup

O

n Nov. 5, from 8:30 a.m. to 12:30 p.m., Bay Watch (SBW) will hold its 8th Annual Monofilament Cleanup. Participants will meet at the Sarasota Sailing Squadron to conduct the cleanup of local bird rookeries.

Lunch will be provided after the event.

The cleanup is conducted during this time of the year because seabirds do not nest in the fall. Volunteers will search for and remove fishing line from mangrove shorelines and bridge fenders as well as bird nesting islands.

In past years, SBW’s fishing line cleanup has attracted up to 100 volunteers and removed over three football field lengths of line from the bay’s coastline. Materials that are collected will be weighed and measured and the data shared with scientists working on entanglement issues. This is a great opportunity to help protect seabirds and other marine wildlife.

Participants are encouraged to bring a boat or kayak. Those without boats

them from breaking free while trailing line. This is a death sentence for the birds when they roost. If you work the bird to the boat as you would a big fish, they can be held by the neck or head while the hook is removed. Care should be taken with all birds, especially ones that have sharp beaks. They don’t know you are trying to help them. A towel placed over the bird’s head will protect you and calm them. Handle birds carefully as they have very light, hollow bones. Carefully re-

move the line from their body, wings and feet and check them carefully before releasing them. If you see a hooked or tangled bird in an active rookery during nesting season, don’t approach them as their young may be startled and fall from the nest.

You can reduce the chance of hooking birds by following a few simple rules. First never feed birds, as this will teach them to look for a handout, a practice that annoys anglers and is dangerous to the birds.

aware of birds that might be targeting your bait or lure. It’s easy to pull the lure out of harm’s way at the last second a gull or tern dives on it.

In a separate action, the commission approved eight additional settlement offers to be made to rental owners seeking the two-plus-two occupancy allowance.

The three-bedroom rental home at 851 North Shore Dr. also includes a sleeping loft. Owner Corinna Oliashirazi has requested a 10-person occupancy, which would equate to two-plus-two if the loft is counted as a

bedroom. The city must first determine if the loft windows are large enough to be used as an emergency exit. If they are, the requested occupancy will be offered. If not, the owner will be given the opportunity to enlarge the windows or be presented with a reduced occupancy offer.

When the commission voted 4-1 to approve the settlement offers it marked the first time Yetter voted in favor of allowing additional occupancy.

Yetter said later that her own research and conversations with neighbors indi-

cated that none of these properties had generated any complaints about noise, parking or any other issues associated with problematic rentals.

“I did not think it would be harmful to show a degree of solidarity with my fellow commissioners. I do not foresee doing so again unless stronger cases are made. I definitely will not vote in favor of purchasing homes nor vacant properties because I feel that could adversely affect the residents of Anna Maria,” she said.

County Commission adds time and money to Cortez Beach groin project The contractor, Cayo LLC, hopes to have the project done sometime in December.

BRADENTON BEACH – The Manatee Board of County Commissioners has voted to spend more time and money to fix the middle of the three groins that were replaced this year. At its Oct. 20 meeting, the commissioners approved a 77-day extension to move the completion date to Dec. 1. They also added $578,575 to the budget. That brings the total budget for the project to $6,829,224.

The middle of the three groins extending into the Gulf of Mexico from Cortez Beach has been problematic due to a weakness in the base rock beneath the structure. High waves and winds from two tropical storms revealed a weakness in the seabed that caused a piling to move.

Gone and back with the wind As shifting winds bring red tide back to the beaches, Rep. Vern Buchanan plans to ask Congress for research funding.

A northeast wind that kept a lingering red tide bloom offshore in the Gulf of Mexico shifted last week, bringing it briefly back ashore on Anna Maria Island until favorable winds returned early in the week.

But the problem, which has plagued the Island for more than a month, is expected to remain at least through Thursday - NOAA forecasts moderate levels of red tide in the bay regions of Manatee County.

Medium concentrations of red tide were detected at the Rod & Reel Pier in Anna

Maria and the Longboat Pass boat ramp in Bradenton Beach, the Florida Fish and Wildlife Conservation Commission reported on Friday.

Citing harm to the environment and economy of Sarasota and Manatee counties, U.S. Rep. Vern Buchanan said in a press release that he plans to push Congress in November to fund red tide research in any year-end government funding bill it passes.

“Southwest Florida is a beautiful, vibrant place to live and we need to take any threat to that standard of living seriously,” Buchanan said in the release. “The recent bloom is devastating vulnerable marine life and discouraging tourists from visiting our beaches and coastal businesses. Congress needs to help protect our seashore by boosting red tide research and mitigation programs.”

Red tide is an unusually high concentration of organisms, called a “bloom,” that produces

toxins that can cause people to suffer respiratory and skin irritation and food poisoning from eating tainted shellfish. It can kill shorebirds and marine life, including manatees, dolphins and sea turtles.

The Florida Department of Health advises: • People with asthma and other respiratory conditions should avoid the beach or bring their inhalers during a red tide.

• Residents and visitors to beaches affected by red tide and up to five miles inland should close their windows and run their air conditioners.

• Some swimmers experience skin irritation and rash after swimming in red tide.

• Swimming in water where dead fish are present exposes swimmers to elevated bacteria levels.

• Sea foam contains a higher concentration of red tide that can cause skin and eye irritation.

• Shellfish like clams, oysters, and coquinas that are harvested from areas with red tide should not be eaten because shellfish concentrate the toxins produced by red tide.

• Crabs, shrimp and lobster can be consumed because they do not concentrate the red tide toxin.

• Scallops can be consumed if only the scallop muscle is eaten; scallop stew using the whole animal should not be consumed.

• Shellfish available through restaurants and commercial food suppliers are considered safe to consume.

Fire commissioners decry county’s ALS offer Island officials support WMFR’s request to provide advanced life support on fire trucks.

BRADENTON – West Manatee Fire Rescue commissioners last week discussed the reluctance of Manatee County officials to allow them to provide advanced life support (ALS) on fire trucks.

The county must issue a certificate of public convenience and necessity (COPCN) to allow providers to apply for an ALS license from the state. However when the county recently updated its ordinance on how to grant the COCPN, it did not provide a way for the county to grant one to a fire district.

WMFR Fire Chief Tom Sousa, as well as other fire chiefs in the county, has asked the county to amend the ordinance to allow for that. In addition, he asked the Island cities for resolutions to support this effort.

Sousa said he and five other fire chiefs

met with the county public safety director and EMS chief and were told, “They’re going to look into it, and they would prefer that it be county employees. They want to know if we would be interested in them hiring county employees and we share the cost, but they didn’t say what the percentage would be.”

Fire commission discussion

“Excuse me if I don’t laugh out loud,” Chair Randy Cooper exclaimed about the county’s offer.

Commissioner George Harris pointed out, “If we were to do this, I imagine when they have shortages on the transport trucks, we would lose that person for that day.

That’s common in Pinellas County.

“I would caution us to steer away from that direction. It’s hard for me to imagine with the labor problems they are having that they could even accomplish this.”

Commissioner Larry Jennis said, “It could be problematic with supervising and managing these employees. I’m not sure how it

would fit into our labor agreement.”

Sousa said it would be very expensive for the fire district, and Cooper said they already have the personnel and added, “It’s obvious the county isn’t going to cooperate with us,” and suggested that they continue their efforts to change the state legislation.

Sousa is working to further legislation to exempt fire districts from having to get permission from their county to provide the service.

Island officials support WMFR

At the Island elected officials meeting last week, Holmes Beach Mayor Bob Johnson said the fire district had been “rebuffed by the county administration, and I think it’s important that we move forward with support.”

Holmes Beach City Commissioner Jean Peelen asked if it is a budget issue for the county, and Johnson replied, “Absolutely not. It’s a matter of relinquishing control.”

Anna Maria Mayor Dan Murphy added, “It is a power play.”

Peelen asked why the county objects.

Manatee County Commissioner Betsy Benac said, “It’s big, a statewide issue. Fire departments throughout the state are trying to gain the right to act as EMS. “It is a turf war to some degree. The question is whether or not it will take away what EMS does and therefore the ability to provide funding.”

She said in Collier County the county board denied the COPCN to the fire department “because it was going to eat away at the EMS service without any ability to provide for the taxation.”

Johnson responded, “The only thing I think it will take away from is increasing growth that would be required, and you can dampen that down and say you don’t have to grow so much because we have some other resources that can take care of something without adding more cost.”

Bradenton Beach approved a resolution supporting WMFR’s request at its Oct. 20 meeting, and it is on the agenda for Holmes Beach commissioners Oct. 25 and Anna Maria commission on Oct. 27.

Fire board debates compensation The board will hold a public hearing Nov. 17 on a resolution to offer compensation to board members.

BRADENTON – West Manatee Fire Rescue commissioners are seeking public input on whether or not to compensate fire commissioners.

Fire Chief Tom Sousa brought up the issue at last week’s fire commission meeting and said due to downsizing the administrative staff, his office has become more reliant on board members regarding major projects. In addition, the board’s participation in workshops on major issues has expanded.

“Almost every special district has

compensation,” he said and offered a chart showing compensation in local special districts ranging from $250 to $500, either bi-weekly or monthly, and both Florida Statute and the district’s enabling act allows for it.

Commissioner David Bishop said serving as a commissioner had long been considered a community service, but things have become more complex He suggested that they invite the public to offer its opinions and then have board discussion.

“I think we should have a healthy debate and see what the public thinks about it,” he said.

Bishop also suggested that each commissioner have the right to refuse compensation, but Commissioner George Harris pointed out that they might be allowed to have that

“A lot of times, these meetings run my life,” Commissioner Al Robinson said, but added that he felt $250 was more appropriate than $500.

Chair Randy Cooper suggested that certain positions on the board could receive more compensation that the others, but Bishop felt it should be equal for all.

“For all of us it’s been more time and effort than just going to meetings,” Commissioner Larry Jennis

noted.

Sousa said he would check on the option of declining the compensation and said if compensation is approved it must be by a super majority.

Harris made the motion to prepare a resolution allowing for compensation with a maximum of $500 and to hold a public hearing at the next meeting on Thursday, Nov. 17, at 6 p.m. at the administrative building, 6417 Third Ave. W., Bradenton.

Do you really want to be scared?

H

alloween is in a couple of days, so you can expect hauntings by mini ghosts and goblins knocking on your front door. But does your home have hauntings every day of the year, and, if it has, what happens when you want to sell both your home and its hauntings?

Fortunately, when you sell your property, ghosts are a non-issue since the authenticity of a haunted house is subjective. The law recognizes this and does not require disclosure. Florida law states that if the property was a site of a homicide, suicide or death it is not a material fact requiring disclosure nor does an alleged haunted houses require homeowners to disclose something as ambiguous as a haunting.

However, in the “spirit” of good faith during the Halloween season and all year round, disclosing some facts about a property that may be considered stigmatized is probably a good business practice. Even if the law does not mandate this type of disclosure, buyers

But there are other ways to be scared if you’re purchasing and mortgaging a property that has nothing to do with ghosts. Specifically, obtaining a mortgage on condominiums, which we have many of in Florida, requires you to overcome a few more hurdles then single-family properties.

Lenders impose stricter regulations when financing condos because the homeowner isn’t solely responsible for

maintaining the value of the property.

When people buy a condo, they also are purchasing ownership in common areas.

Common areas can be pools, tennis courts, boat slips, grounds and more which are managed by the condo association.

Association fees paid by homeowners go towards maintaining these areas which are crucial to maintaining the value of the property. Therefore, lenders want to ensure that the association is sufficiently funded in the form of reserves to cover routine expenses as well as major outlays for repairs or unexpected expenses. Also, the history of special assessments, as well as any current assessments outstanding, need to be disclosed to both buyers and lenders. This is the reason that carefully examining the condo association’s financials and budget for an association you are considering buying into is important, since your lender will also be looking at them.

In addition, your lender will also be looking at what percentage of renters reside in

the association as well as what percentage of units may be owned by one investor.

This is usually only a problem in new construction where investors buy blocks of condos at pre construction prices with the intention to flip them later on. Never-theless, the pedigree of the current owners in a condo association is important to condo mortgage lenders.

Finally, getting back to Halloween and superstitions, have you ever noticed that most elevators in large buildings don’t have the number 13. According to Otis elevators up to 85 percent of elevator panes omit the number 13 generally considered an unlucky number. In addition, there are no room 13s in most hospitals either, and enough people don’t want to live on the 13th floor that many buildings simply eliminate the 13th floor.

Enjoy your little hauntings on Halloween night, and remember that when it comes to buying and selling real estate, there are much bigger things to be scared of.

When Sam started out his career, he was named Police Officer of the Year. I’ll preface that by saying he was the only one that was here for a full year,” Shearon joked.

He then introduced Tibbetts, a former police officer who now serves as a special assistant to Congressman Vern Buchanan.

Reading a letter from Buchanan, Tibbetts said, “On behalf of the people of Florida’s 16th Congressional District, I congratulate you on serving 30 years in law enforcement. I appreciate the time you have spent committed to protecting our citizens and community. I applaud your many accomplishments throughout your career, including the 20 years you have spent serving as chief of police for the Bradenton Beach Police Department. You can be proud to be the longest serving administrative law enforcement officer in Manatee County. I appreciate this opportunity to join the citizens

You have gone above and beyond for Bradenton Beach and all these residents

here truly appreciate all the hard work and the staff you brought together to make your police department one of the best in the state. It is greatly appreciated.”

Chappie presented Speciale with a plaque and also gave him a challenge coin.

Vice Mayor Ed Straight thanked Speciale for capturing a deer that once got loose from the Wildlife Inc. animal sanctuary.

“I love you guys. You don’t know how much of an honor it is to serve you. I just want to thank you,” Speciale said.

Speciale moved to the Island a couple years after his parents relocated from Chicago in the early 1980s. He was partners with the family that was opening a Zorba’s Pizza in Bradenton Beach. When the restaurant was broken into, he told the responding officer he always wanted to be cop. This led to a meeting with Police Chief Roy Little “I met the chief, and he said we’ll sponsor you if you want to pay for it. I went to the police academy. I started as a reserve in November of ’85 and graduated in February of ’86.

In October of ‘86 the chief called me and said, ‘Sam, you want a full-time job?’ I said, ‘Yes sir.’ He said, ‘Go home and get some sleep, you’re working midnights.’ So that’s how that started,” Speciale recalled.

In October, 1998, Speciale succeeded John Maloney as the city’s police chief.

CORTEZ – Stone crabs got a late start this year, but they made it to the docks last week, said Karen Bell, of A.P. Bell Fish Co. Commercial stone crabbers didn’t set their traps as soon as they normally do, she said – red tide was in the water and there was a chance that Hurricane Matthew could have destroyed the traps.

But while a small harvest after the Oct. 15 season opener ran out in a few days, the second wave brought in plenty of crabs, in plenty of time for the Fifth Annual Cortez Stone Crab Festival on Saturday and Sunday, Nov. 5-6, from 9 a.m. to 6 p.m. at the FISH Preserve at 4628 119th St. W., or Marker 49 by boat.

Tyler’s Ice Cream churns it up

After struggling to get through the regular season games, thanks to the unpredictable summer and fall weather that hit the Island in the past few months, the adult flag football playoffs started last week with excitement on the field Thursday night.

In the first game of the night, the two teams that ended the regular season in the middle of the pack, Tyler’s Ice Cream and Coldwell Banker, showed the parity of the league in the 40 minutes of football action.

The single elimination format of the playoffs set the stage for do or die action with the two consistent and confident quarterbacks Jason Sato for Tyler’s Ice Cream and Charles Buky leading Coldwell Banker.

Each team, looking toward the championship game to be played at 8:30 p.m. on Thurs., Oct. 27, played each snap of the football like it was the last.

With the sun shining bright and three officials on the field, the first whistle blew to start the night’s activities.

Karri Stephens set the stage for the action packed game with his amazing youthful speed taking the football the length of the field after a quick pitch from Buky for six quick points for Team Coldwell Banker.

Taking over on offense, Tyler’s Ice Cream marched the ball down the field in six plays with Josh Sato in the end zone to tie the ball game. Brother Nick Sato captured the extra point to put his team ahead early in the quarterfinal game, 6-7.

Players step up their game during the playoffs, and emotions run on high as team vie for the win. After arguing with the referee on a non-call for tackling, an unsportsmanlike call on Josh Sato, put Tyler’s Ice Cream in a long yardage situation on third down.

Under pressure by Stephens, QB Jason Sato hit N. Sato deep in the end zone with a jumping catch behind the last defender for the score. Making the extra point reception, Tyler’s Ice Cream increased its lead by eight points.

Marching down the field with successful offensive plays, Coldwell Baker closed the point gap with an across the body throw under pressure by Buky finding Matt Morgan at the back of the end zone.

With the score 12-14, Coldwell Banker executed a two point conversion, tying the ballgame 14-14 with the pass to Stephens.

The second half of play started with the game tied 14-14. Tyler’s Ice Cream started on offense with 20 minutes left to play in regulation time. Once again, Stephens lit up the field with a quick interception for Coldwell Banker near the end zone.

After the Coldwell Banker touchdown, the team had three attempts to get into the end zone for the point after. With penalties abound, Morgan found himself in the end zone with the ball, taking the score to 21-14.

The on the field action continued with Tyler’s Ice Cream moving the ball to tie the game. Under pressure, Jason Sato threw the long ball to Josh Sato making the catch in the air while keeping his focus as the ball bobbled in his hands. Gaining full possession before getting crossing in to the end zone, Josh Sato put six points on the scoreboard. Diving for the catch, N. Sato made the tying point conversion play.

The last few minutes of the game exemplified the spirit of playoff games at the Island’s community center. Coldwell Banker quickly took over the lead again with a touchdown and point after.

The never say die mentality of Tyler’s Ice Cream took the football the length of the field, but could not put points on the scoreboard. While some would think the game was over, the veteran players of the Tyler’s Ice Cream crew knew they were still in the hunt until the last second ticked off the clock.

Stopped but not defeated, Tyler’s Ice Cream held Coldwell defensively, giving the team another chance on offense. That chance is all they needed.

Moving the ball 40 yards, the Sato connection put six points on the board, closing the scoring gap.

With less than a minute on the clock and a score of 28-27 in Coldwell Banker’s favor, Tyler’s Ice Cream went big with a two-point conversion attempt. Finding Josh Sato open, Jason Sato threw the ball to his brother to take the lead with the score 28-29. see sports, page 33

Proposed rental rules headed to commission The Bradenton Beach Planning and Zoning Board has completed its work on recommended vacation rental regulations that will presented to the city commission for initial discussion in November. The proposed regulations suggest occupancy allowances of two persons per bedroom, plus two additional guests; an annual registration/licensing fee; rental inspections; side yard trash pick-up; exterior signs that provide owner/agent contact information; interior placards that state allowed occupancy and parking areas; and increased penalties for repeat offenders. The board also recommends the adoption of a false advertising ordinance.

After approving these recommendations at the Oct. 19 meeting, the board began discussing the next phase of recommended regulations that will pertain to lot coverage, live area ratio, bedroom size, bedroom to living area ratios and other land development code amendments aimed at limiting the number of bedrooms and occupants in respect to the construction of new vacation rentals.

Special master search comes up empty Bradenton Beach City Attorney Ricinda Perry told city commissioners last week that the city has received no responses to the request for proposals (RFP) the city issued in search of an attorney who can serve as the city’s alternative special master. The RFP was issued in response to resident and planning and zoning board member John Metz’s demand that someone other than William Robinson Jr. serve as the special master and conduct a hearing in an attempt to resolve a lawsuit Metz filed against the city in regard to a neighboring property being used as a vacation rental. In a separate matter involving Metz, Building Official Steve Gilbert is now reviewing an informal written complaint Metz recently submitted in regard to the beachfront Coastal Watersports business operation owned by City Commissioner Ralph Cole.

Obituaries Virginia Heatley Virginia Heatley, aka Shirley Heatley (nee Zgorski), 85, of Ellenton, Fla., has had the Lord open the door to his Kingdom on Saturday, Oct. 15, 2016, and welcomed her soul.

Virginia was born July 10, 1931, in Chicago, Ill., the first of three children,: brother, Richard A., and sister, Arlene M. Kivela. She was married to William Edward Heatley for 52 years. Virginia lived in Chicago and moved to Holmes Beach on Anna Maria Island, in 1975.

She moved to Ellenton in 2002.

Her children are Debra Elizabeth Heatley; Dennis William (Linda); Michael Edward (Patricia); William Jeffrey (Susan); Jeffrey James (Kathryn); and Richard Joseph, aka Logan Seven.

Her grandchildren are Jennifer, Kerry Lynne, Shannon, Adam, Heather, Nicki (Shannon) and Talitha and seven great grandchildren. Her grandson, Joshua, preceded her in death.

Virginia Heatley attended the Board of Education, Creiger School of Nursing in Chicago and began her nursing career in 1968. Her medical career was in obstetrics and office management for physicians. She was a devoted member of her Church, Harvest Field Community Church and was active in leadership. She was also a devoted member of All Island Denominations and received the Myron Bunnell Award in 1997 for her humanitarian work on Anna Maria Island.

Gary Griffith Hirshberg Gary Griffith Hirshberg , 73, of Bradenton, passed away peacefully on Oct. 16, 2016.

He was born April 20,1943, in Mckeesport, Pa., and moved to Bradenton, with his family at a young age. He graduated from Manatee High School with the Class of 1961, and served his country in Vietnam with the 231st Transportation Company of the U.S. Army. Gary was involved in various local family businesses with his father Norman and brother Ron including the Cotton Shop dress stores, Surplus Depot, Camp & Hike shop, and Hirsh Sailing Yachts to name just a few. He then spent the past 21 years as a successful Yacht Broker with Galati Yacht Sales on Anna Maria Island.

Throughout his life he enjoyed the outdoors and seized any opportunity he could to spend time outside with his friends and family. He loved camping, dancing, motorcycling and boating and was particularly fond of visiting the dozens of national parks and monuments throughout the country. Gary was a wonderful and giving father, friend, and confidant with a strong but gentle demeanor. He was the type of person that everyone wanted to be and was an inspiration to many with his courage and spirit. He will be greatly missed by his large family and many close friends.

Enrique Luis Viera Enrique (Rick) Luis Viera, born April 6, 1952, passed away Sunday, Oct. 16, 2016.

Born in Cuba to Irma Pereda Viero and Juan Benito Viera, Enrique came to Miami at age 8, where he developed a passion for boats. An accomplished boat handler, mechanic and restorer, he worked as a boat wrangler for the Miami Vice TV series and worked for Windjammer Cruises, converting ships to sail.

After moving to Manatee County, he shared his vast nautical experience with the Cortez boatbuilding program, especially on “Smiley,” on which he was the driving force. Viera worked at A.P. Bell Fish Co. as fleet manager, responsible for keeping the boats at work.

He is survived by brother Eduardo Viera, of Madrid, Spain; sister Rosario Guevara, of Camaguey, Cuba; and cousins, Luis and Josephina Viera, of Miami.

A celebration of life will be held in Cortez at a date to be announced.
