Florida’s second Sunshine law may never see the light of day.

The Florida Legislature passed the Sunshine Protection Act this year, signed by Gov. Rick Scott, that would allow the Sunshine State to have Daylight Saving Time all year.

But since the federal government controls American time zones, Congress must amend federal law to authorize Florida to enact its state law.

BRADENTON BEACH – Technomarine’s failure to install a floating public dock alongside the Bridge Street Pier has resulted in the Community Redevelopment Agency (CRA) initiating contractual default proceedings.

Commissioners consider aircraft nuisance ordinance Complaints on a twoperson aircraft flying too close to Island beaches and residential properties has Holmes Beach commissioners considering a nuisance ordinance.

HOLMES BEACH – Commissioners are considering enacting an aircraft nuisance ordinance that will carry hefty fines for violations.

During the Oct. 23 commission work session, Police Chief Bill Tokajer presented the proposed ordinance to commissioners, saying there have been complaints about the pilot of a two-person aircraft that flies along the Palma Sola Causeway and Anna Maria Island. Tokajer said the pilot’s intent to pick up and drop off passengers from the Manatee Public Beach also is a cause for concern because it creates a liability issue for the city.

If the new ordinance is approved, ultralights and other aircraft cannot be piloted over congested areas and places of open-air assembly. Under

Commissioners also agreed to include parks in the proposed ordinance. To fly over these areas, the pilot must fly no lower than 1,000 feet over the highest obstacle within a horizontal radius of 2,000 feet of the aircraft at any time.

Violation of the ordinance constitutes a nuisance, and offenders can

be charged $500 for the first violation, $1,000 for the second violations, $2,000 for the third violation and a fourth violation would amount to the highest fine allowable by law. City Attorney Patricia Petruff said she would research to determine what the options for the actual maximum fine could be. Commissioner Jim Kihm suggested also adding a provision that if the recipient chooses to contest the fine and go to a special

magistrate, the recipient should pay all fines plus the cost of special magistrate administrative fees if the fine is upheld.

Though the ordinance was scheduled for a first reading at the regular commission meeting immediately following the work session, Petruff said too many changes had been made, and a first reading would need to be scheduled for a future meeting.

Center hosts hurricane relief fundraiser The Center of Anna Maria Island is hosting a Hurricane Michael relief fundraiser for victims of the storm in the Florida Panhandle. The event is scheduled for 5 to 9 p.m. Saturday, Nov. 3 and features live music with food and drinks available for sale.

Donations for victims also will be collected.

Requested items include duct tape, tarps, cleaning supplies, toys and school supplies for small children, underwear, socks, non-perishable items, diapers, tooth brushes and tooth paste, deodorant, feminine products, gloves, masks, tools to cut through drywall, mud removal kits, camping stoves, lanterns, sleeping bags, and supplies for cooking and lighting without electricity. No water is needed.

City Attorney retained The Bradenton Beach City Commission, minus absent Commissioner Randy White, recently agreed to continue using the legal services of City Attorney Ricinda Perry for another year. The commissionapproved engagement letter maintains Perry’s discounted rate of $190 per hour. If needed, Perry additional paralegal assistance will be provided at $120 per hour. The agreement will remain in effect through December 2019.

City awaits Spring Lake proposals City engineer Lynn Burnett said she’s requested proposals to dredge Spring Lake and others to maintain the lake as freshwater and as saltwater.

She said three dredging proposals for the polluted lake have been requested. Aquatic Systems is working on the proposals to either clean the lake and maintain it as a saltwater tidal pool or to clean the lake and return it to its origins as a freshwater lake. Commissioner Judy Titsworth requested that Burnett provide regular updates on the lake and efforts to clean it at city meetings. In the meantime, Burnett is compiling historical data on the lake to help better understand what contributes to the ongoing pollution issues at Spring Lake and how to best repair the lake for future enjoyment of residents.

County Commission candidates discuss campaign issues

Island voters will help determine the winner of the Carol Whitmore/Candace Luther County Commission race.

MANATEE COUNTY – The winner of the District 6, atlarge County Commission race between incumbent Carol Whitmore and challenger Candace Luther will help represent Anna Maria Island and Cortez at the county level.

HOW SHOULD COUNTY COMMISSION-CONTROLLED TOURIST DEVELOPMENT COUNCIL FUNDS BE USED ON ANNA MARIA ISLAND IN TERMS OF PROJECTS VERSUS PROMOTION?

Luther: I would focus on projects. Make things better for visitors and residents by making improvements that didn’t have funding previously.

Give Visit Florida something to promote.

Whitmore: It’s very strict on how those funds can be spent.

We’re still trying to open it up for law enforcement, lifeguards and other things that make life better for Island residents. We need to push for the state not to interfere with our city and county home rule.

WHAT HAS/CAN THE COUNTY COMMISSION DO TO BENEFIT ISLAND AND CORTEZ RESIDENTS AND BUSINESSES?

Luther: Impose a moratorium on phosphate mining, the use of fertilizers containing phosphate for non-farming uses and the use of Roundup and similar glyphosate weed killers. Stop overdeveloping and adding to the traffic and sewage problems we already have. Get the bike trails built so people have alternative transportation.

Whitmore: The red tide cleanup. I worked with Anna Maria Mayor Dan Murphy and pushed for $750,000 in state

funding and up to $1.5 million in county funding for the pier replacement. I worked with all three Island mayors to Luther acquire $1 million in surplus beach concession funds and worked with The Center on its $100,000 request for concession funds. We have not raised the millage Whitmore rate since 2009.

WHAT HAS/CAN THE COUNTY DO TO ASSIST THE ISLAND’S CITY GOVERNMENTS?

Luther Create an Environmental Science Department to assess all things environmental – whether it be building, infrastructure, runoff drainage and sewers, roadways, chemical use, disposal methods, business operations and the transport of products.

Whitmore: Listen and stay involved. I routinely copy the Island cities’ elected officials on upcoming agenda items and anything related to the Island, so they’re informed of issues that affect them.

WHAT PERCENTAGE OF YOUR CAMPAIGN CONTRIBUTIONS HAVE COME FROM THE DEVELOPMENT AND REAL ESTATE COMMUNITIES?

Luther: Zero, not a single dollar. I have done most of this by myself without funding. That proves my dedication and that I am doing this because I truly care about my county and want to make it better.

Whitmore: My supporters are mainly the farming community, medical community and family businesses. Last year I had one fundraiser by the so-called developers that represent thousands of jobs and I have not had one since. I don’t accept contributions from Carlos Beruff or Mosaic, as they are so controversial.

WHAT HAS THE COUNTY COMMISSION DONE TO PROTECT THE COUNTY’S ENVIRONMENT AND NATURAL RESOURCES AND WHAT MORE NEEDS TO BE DONE IN THE NEXT FOUR YEARS?

Luther: Stop phosphate mining in the watersheds of Lake Manatee, the Myakka River and the Peace River. Lake Manatee tested positive for cyanobacteria over a year ago, yet they continue to pollute with weed killer all around the county and residents were never notified of this bacteria in the water supply to my knowledge.

Whitmore: With the help of Swiftmud and other state agencies, the county has been restoring properties along the bays, lakes, rivers and natural shorelines. Manatee County was awarded as the first platinum green government in Florida last month. Manatee County has had a ban on fertilizer for five to seven years now, seagrasses are their healthiest since the 1950s, and we require developers to treat their run-off and hold 150 percent before it hits the bays.

WHY SHOULD ANNA MARIA ISLAND AND CORTEZ VOTERS VOTE FOR YOU INSTEAD OF YOUR OPPONENT?

Luther: I have been out assessing the red tide situation and collecting samples trying to get something done to clean up this mess. Once I get the test results, I can identify the sources and start working on solutions. As an elected official, I should be able to finally get something done. A lot of citizens feel they have been ignored and have not had a voice.

That is why I am running for the at-large seat, so I can help anyone in the county. It is time our government starts working for the people again.

Whitmore: My opponent does not know the Island’s politics, elected officials and what’s important to Island residents. My opponent does not know what it’s like to live in a tourism community and the toll it takes on residents.

Many years ago, the county would not even visit the Island cites. That changed due to former commissioner John Chappie and myself.

Fire damages Shore restaurant Last week’s fire is expected to add two more months to the completion of the construction project.

LONGBOAT KEY – The Shore restaurant under construction at 800 Broadway sustained damage in a fire the night of Wednesday, Oct. 24. No injuries were reported, and the cause remains unknown.

The interior of the building appears badly damaged, but the exterior appears intact with charring to some surfaces and some hurricane windows melted or blown out.

The building is on the site of the former Moore’s Stone Crab restaurant, which closed three years ago.

Longboat Key Fire Rescue was on scene, joined by the State Fire Marshal, who is now investigating the fire.

“At 2202 hours (10:02 p.m.) on Wednesday, Oct. 24, Longboat Key, West Manatee, and Sarasota County fire departments responded with 20 firefighters to 800 Broadway for a reported com-

“The initial crews stretched two hose lines, quickly extinguishing the body of fire at the entrance and extended

rooms. The fire was under control within 30 minutes. There were no reports of any injuries,” the press release said.

“The State Fire Marshal was called to the scene and secured the site overnight. The investigation continued this morning where the State Fire Marshal had their arson dog called to the scene, as normal operating procedure, to assist

with locating any accelerants. Samples have been taken and will be sent to the state lab for analysis. The results may take up to four weeks to receive.

“This does not indicate the fire was arson, rather it provides further evidence to assist with a complete investigation. The scene is continuing to be investigated and once complete will be turned back over to the owners,” according to the press release.

At 8:30 a.m. this morning, co-owner Tom Leonard was standing outside the building, talking on his cell phone and still waiting to be let inside to examine the damage.

When asked, he said the construction project was approximately six to eight weeks from completion when the fire occurred. He estimated the fire would add an additional two months to complete the project. He said this timetable would depend in part on how long it takes for the insurance company to settle the claim.

Later, Longboat Key Fire Rescue spokesperson Tina Adams said she believed the construction site had been turned back over to the owners.

When construction is completed, the 185-seat, coastal-style eatery will join its sister establishment, Shore, on St. Armands Key.

Don't overlook Charter Review vote The Charter Review Commission is an independent city government commission established by the city charter, to be elected once every five years to serve the city. It is responsible to review the city charter and to propose changes to the citizens of Holmes Beach (not the City Commission) so that the citizens can decide by referendum vote what proposals shall be adopted or not.

“You will not successfully drive forward by looking in the rear view mirror!”

To adequately prepare for the coming increases in the planned area population density (full time and transient), to address our aging commercial areas, and to confront sea level rise, we need to effectively examine approaches to address the city’s and the Island’s infrastructure, operating services and redevelopment needs, approaches and funding over the next 10 to 20 years and beyond.

Our residential population has dropped more than 22 percent in the past 15 years, and our voting population is down to 2,883. Continuing to blindly follow the “we have always done things this way” path will result in ineffective management and oversight of our city.

We must look seriously to make the necessary and needed critical changes to our structure of government to ensure we

have the qualified city management and leadership continuity and stability needed in order to continue to progress, adapt and improve the delivery of our city’s administration and operations services and to sustain the quality of life we associate with our city.

Our citizens need the opportunity to say in our charter how our form of government must adjust to join the present era in order to take our city into the future well prepared.

The City Commission’s efforts to date have been to simply decide that our citizens do not need to make such a decision. This election of this Charter Review Commission is the opportunity for the system to work in the way it is designed to work. This Charter Review Commission can provide the means to address our current and future needs in an informed way and put the results in front of the public to consider and decide.

It is the opportunity for our citizens to decide that is the key – NOT the decision that is made.

Voting for Charter Review Commission candidates who want to get the issue in front of citizens in an informed way for their consideration and decision is the key election day opportunity for the citizens of the city of Homes Beach.

Red tide high again

High levels of red tide are back in the air and water around Anna Maria Island, according to the Florida Fish and Wildlife Conservation Commission (FWC).

Between 5 percent and 25 percent more water samples showed medium or high levels of red tide than the previous week, according to the Oct. 26 report, which shows high concentrations of red tide in water samples collected on Oct. 22 at Cortez Beach in Bradenton Beach, and medium concentrations at the Rod and Reel Pier in Anna Maria

and Longboat Pass boat ramp in Bradenton Beach.

Respiratory irritation was reported Oct. 18-23 and Oct. 25 at Coquina Beach in Bradenton Beach and Oct. 18, Oct. 20-21 and Oct. 23-25 at Manatee Beach in Holmes Beach.

Fish kills also were reported in Manatee County over the previous week.

Background concentrations of red tide cause no anticipated effects. Low levels can cause respiratory irritation, shellfish harvesting closures and possible fish kills.

Medium levels can cause respiratory irritation, shellfish harvesting closures and probable fish kills.

High levels can cause all of the above, plus water discoloration.

Red tide is a type of algae that emits a neurotoxin when it blooms. Deadly to fish, sea turtles, marine mammals and shorebirds that feed on affected fish, red tide makes shellfish unfit to eat, and can cause respiratory irritation in people, especially those with asthma, COPD or other respiratory diseases.

The toxic algae bloom has been spreading in the southwest Gulf of Mexico for the past year, reaching Anna Maria Island in early August. It was detected in Florida’s east coast waters early this month.

state and federal funding for red tide research typically increases in the years following these events. However, decades of history reveal that public attention and funding usually decline after red tide blooms subside.

The red tide bloom that formed in October 2017 in the Gulf of Mexico has proved uncommonly serious, according to Mote, persisting for the past year and fueling significant public concern and demanding an intensive response from Mote and partners.

Mote Marine Laboratory leaders will use a philanthropic investment of $1 million from The Andrew and Judith Economos Charitable Foundation to establish and support the first year of operations for a new Red Tide Institute.

The Institute will be an innovation hub of intensive research and development focused exclusively on advancing promising technologies for controlling and mitigating red tide impacts toward practical application, according to Mote. The Institute will also leverage other red tiderelated research by Mote and its partners at the Florida Fish and Wildlife Conservation Commission (FWC) and other organizations.

This fall, the state of Florida announced a $2.2-million investment to advance mitigation science at multiple institutions, including Mote’s novel mitigation technologies, such as its ozone treatment system pilot tested for dead-end canals hit hard by red tide, and using a new clay formula for red tide mitigation, a Mote partnership with Woods Hole Oceanographic Institution, University of South Florida and FWC. When Florida red tide hits the Gulf of Mexico coast, communities grapple with challenging respiratory irritation, dwindling tourism dollars, the sight and smell of countless dead fish and the heartbreaking losses of sea turtles and marine mammals.

Third-graders get civics lesson and more

Students spend day in Bradenton Beach

BRADENTON BEACH – Today I learned how the city government works and all about the community of Bradenton Beach.

The day was full of activities my 75 classmates and I got to experience. We got to meet Mayor John Chappie, who brought in his dog, Coleman. He made all of us feel welcome and his staff was so nice.

I was in the first rotation of students that held a City Commission meeting about a barking dog (Coleman). I was the mayor with five commissioners. Our commission voted to fine Coleman’s owner $500 and let Coleman’s owner build a doghouse. The teachers told me later that only one of the three classes forgave Coleman’s fines.

My classmates loved this experience, and I loved being mayor. It’s so cool to see how our government works, and City Clerk Terri Sanclemente had special certificates for us. My classmate, Teddy, said he wants to be a mayor when he grows up.

“I loved being a commissioner,” said Kierra Mays.

City Treasurer Shayne Thompson said, “You did a phenomenal job.”

Building Official Steve Gilbert said, “We really enjoyed watching all you kids reenact a real city commission meeting.”

PUBLIC SERVICES

Next, we went to the beach and Commissioner Ralph Cole taught us about having fun sailing while still being safe.

“All kids should have a chance to learn about sailing. It teaches them so much,” he said.

Afterwards, we walked down the beach to Turtle Watch Director Suzi Fox. Suzi and her 117 volunteers protected 30,000 baby sea turtles this year!

After that, we went to the Beach House and Will, Dave and Teddy showed us around the kitchen and bakery. We left with homemade cookies.

Next, we went to Tingley Memorial Library, and Mrs. Clarke and Ms. Bell read to us. I didn’t know the city had its own library, and I love to read.

Firemen are required to get their suits on quickly and Firefighter Derek got in his suit in 14 seconds (with a little help from another fireman). The most exciting part was when we got to go in the fire truck!

Then we went to Lou Barolo Park and played ‘Mayor says’ with Vice Mayor Marilyn Maro. She was very nice.

“Today is a good day. I think everybody is learning how the city runs and what everybody does,” she said.

A very exciting part of our day was when we went to the Police Department. Chief Speciale was at the door to greet us. He has a lot of trophies and cool toys in his office.

Sgt. Diaz took us through the building. Everyone wanted to be ‘booked’ in the intake area, but he said we were good kids.

They took us out to the police vehicles and that was so fun. We made as much noise as we wanted and there were all these honks, sirens and beeps.

“This is the coolest ever,” Kenny Hamilton said.

We also got a peek at Public Works, where Tom Woodard works. He brought us popsicles and we saw Kitty Dog, their adopted stray cat.

LUNCH AND MORE FUN

We ate a delicious cookout lunch at the Anna Maria Oyster Bar, provided by John Horne and his workers. It was very pretty sitting on the pier eating and watching the boats.

After we ate, we went on a boat

ride with Sherman Baldwin’s Paradise Boat Tours and saw lots of dolphins. The captain, David Merullo, is a commercial fisherman too.

We learned Bradenton Beach has 165-175 Atlantic dolphins that live between 35-45 years old, and the oldest dolphin that they know is 70 years old. Her name is Nicklow.

We ended our day with a game of putt-putt at Commissioner Jake Spooner’s Fish Hole, which has been open since 2008. When asked why he likes Bradenton Beach, he said, “To me, it’s the most beautiful place in the world.”

“This was a great event. We really enjoyed it. City staff had a great time hosting the Bradenton Christian third-graders. I think the program worked really nice and I hope we can do this next year,” Chappie said.

“The day went awesome. We had the best time with all the kids.

They all did a great job. We can’t wait to do it again next year,” Sanclemente said.

“I think it was a great opportunity for our students to see what’s going on in our government. I appreciate the city of Bradenton Beach opening their doors to our school,” Principal Jeff Myers said.

My teachers want to come back with next year’s third-grade class.

I learned so many things and was surprised by how much everyone works together and how nice everyone was. I love Bradenton Beach.

Seventy-five Bradenton Christian School third-graders spent Thursday, Oct. 25, in Bradenton Beach conducting mock City Commission meetings, learning about city services and visiting some of the local businesses.

The activities were part of the inaugural “Youth in Politics – Bradenton Christian School Takes Over Local Government Day” organized

by City Attorney Ricinda Perry and Mayor John Chappie and supported by the City Commission.

The students were accompanied by Principal Jeff Myers, third-grade teachers Danielle Morishita, Stephanie Dix and Elizabeth McBride and several parent chaperones.

Chappie and Perry said they hope last week’s pilot program will be utilized in future years by other local governments and embraced by the Manatee County School Board as a learning opportunity for public school students, including those that attending Anna Maria Elementary School.

CRA purchasing holiday decorations The Bradenton Beach CRA plans to purchase holiday decorations from the firm that decorates University Boulevard in Sarasota.

BRADENTON BEACH – The Community Redevelopment Agency (CRA) authorized member Jake Spooner’s proposal to spend $12,000 to $32,000 to decorate Bridge Street for the Christmas holidays using decorative elements purchased from Christmas Designers – the firm that decorates University Boulevard and the University Town Center mall in Sarasota.

When purchased, the decorations will be installed, removed, stored, main-

tained, insured and reused in future years for approximately $2,400 to $4,400 a year, depending on what is purchased. The most ex-

pensive components are the elevated skylines that would hang over Bridge Street.

“We’re in a tight time frame, and they’re super

busy right now, so we’re not sure if we’ll get the skylines this year,” Spooner said last week.

The CRA members recently directed Spooner to get three price quotes or, as an alternative, obtain a written partnership agreement from the merchants’ association that serves as a continuation of the merchants’ preexisting relationship with Christmas Designers.

As of Friday, Spooner was still waiting on an itemized invoice to present to city staff. He and Christmas Designers Joe Campbell were still researching the cost and requirements for the poles needed to mount the elevated skylines. Spooner said if the entire decorative concept can’t be finalized this year, the skylines can be purchased and added next year.

Political alliances at play in city elections The city elections will retain or reshape the commission majority for the next 12 months.

BRADENTON BEACH – The 2018 city elections will determine who holds majority control of the City Commission for the next year.

If either of the two incumbents – Marilyn Maro or Ralph Cole – are reelected, the often-likeminded commission majority that includes Mayor John Chappie and Jake Spooner would be maintained for another year.

During a recent interview with The Sun, Cole said he supported Maro’s candidacy. And Chappie has acknowledged assisting Maro with her reelection campaign.

If challengers Tjet Martin and John Metz both win commission seats on Nov. 6, they would join Commissioner Randy White in forming a new commission majority for the next year.

During the campaign season, Cole and Maro’s campaign signs have often been placed together, and Metz and Martin’s signs have often been placed together.

When interviewed by The Sun in 2017, White said, “If John Chappie wins and I win I’ll probably be the sole opposition on the commission.

Mayor Shearon and I agree on a lot of things. If he’s elected, I think we can get things done.”

Chappie defeated Shearon and White has frequently voted in opposition of the other four commission members. Martin is Shearon’s

significant other, and Metz is Shearon and Martin’s friend and next-door neighbor.

Martin and Metz are among the six defendants Cole named in a 2017 Sunshine Law lawsuit the City Commission initiated before White took office.

The lawsuit alleges Metz, Martin and four other then-city advisory board members violated the Sunshine Law by disMaro cussing potential board business at a Concerned Neighbors of Bradenton Beach (CNOBB) meeting that was not a properly noticed city meeting.

The lawsuit also alleges emails later obtained Martin from the defendants also violated the Sunshine Law because they pertained to past and potential future board business.

Before taking office, city commissioners are sworn to uphold the city Metz charter and to uphold state law, including the Sunshine Law. As part of his defense, Metz and his attorney are challenging the constitutionality of the Government in the Sunshine Act (Sunshine Law) enacted in Florida in 1967.

Since taking office, White has been the lone voice of commission support for the defendants in the still pending lawsuit.

During that meeting, White opposed paying an invoice for legal bills associated with the lawsuit.

Representing the city, attorney Robert Watrous now wants to depose White under oath as part of the ongoing lawsuit discovery process.

White has also been ordered to provide copies of all text message, email and Facebook Messenger exchanges he had with Martin, Metz, Shearon and other former CNOBB members between Aug 1, 2017 and July 6, 2018.

Although not a Sunshine violation, emails obtained from Martin as part of the Sunshine investigation shed light on CNOBB’s successful

efforts to help White defeat Cole in the 2017 commission race. Cole was then appointed to fill the commission seat vacated by Chappie’s successful pursuit of the mayor’s seat. Other emails indicate Martin’s unsuccessful efforts to defeat Chappie in the 2017 mayor’s race.

White was the only commissioner to support four unsuccessful charter amendment initiatives proposed this summer by the Keep Our Residential Neighborhoods (KORN) political action committee. Metz serves as KORN’s treasurer. When addressing the commission on this matter, Metz contended KORN did not have to follow the city charter when seeking to change the charter via petition initiative.

The commission voted 4-1 against placing the KORN amendments on the fall ballot, and KORN responded by filing a lawsuit against the city. A judge’s ruling is expected soon.

One of the primary goals with these repairs is to correct issues caused by exposure to the harsh environmental elements in the pass and seal the bridge to reduce the effects of rust and erosion in the future.

What motorists can expect, Jacobsen said, is to see nighttime lane closures between 9 p.m. and 6 a.m. with 15-minutelong temporary bridge closures allowed between 11 p.m. and 6 a.m. to move equipment. Detours where the bridge will be completely closed to traffic from midnight to 5 a.m. for two nights only, have already been mapped out. Jacobsen said the United

States Coast Guard has already approved the bridge closures.

Bradenton Beach Mayor John Chappie requested that FDOT keep Bradenton Beach and Longboat Key police in the loop regarding lane and bridge closures.

Jacobsen agreed, adding that the lane closures will be optimized to allow emergency vehicles through the construction area if necessary. He said lane closures are not allowed for Friday and Saturday nights. Prior to the start of construction Jacobsen said an environmental review of the area will be done to ensure that lighting for the project does not adversely affect nesting sea turtles on the beaches.

Cortez Bridge design phase scheduled The Florida Department of Transportation’s project development and environment study for the future of the Cortez Bridge is planned to be finalized in spring 2019 with the design phase for the new bridge beginning sometime in 2023.

During the October Island Transportation and Planning Organization meeting, David Hutchinson, of the Sarasota/Manatee Metro-

politan Planning Organization, said members of the public appealed to the MPO to do away with the elevated replacement design favored by FDOT. The official recommendation for replacement of the aging bridge is a 65-foot elevated bridge, eliminating the central drawbridge structure.

Though the bridge was the only one in the region rated poor in 2017, Hutchinson said repairs made since

The Cortez Bridge remains a high priority in the region, with an average of 15,000

trips across it by motorists per day, he said.

“Rest assured, the bridge is safe,” he said.

Anna Maria moves forward with city pier plans City commissioners have chosen a Tampa-based company to begin negotiations on rebuilding the city pier. The city hopes to begin work in December.

i+iconUSA was one of five Florida companies that replied to the city’s second round of RFPs to rebuild the world famous city pier. i+iconUSA had previously submitted a pier construction package to the city during the first round of RFPs in July.

Their bid to rebuild came in at around $3.66 million. The company’s first proposal was $4.13 million. There was no response as to why their price lowered by $500,000.

The city has budgeted $2.5 million to rebuild the pier.

Murphy said he wasn’t worried about funding the project. “We’ll find the money if and when we need it.”

ANNA MARIA – The city is almost one step closer to beginning it’s plan to rebuild the Anna Maria City Pier. City commissioners voted unanimously Oct. 25 – sans City Commissioner Dale Woodland – to allow Anna Maria Mayor Dan Murphy to begin the fact-finding process which could lead into negotiations with Tampa-based construction company i+iconUSA. Fact-finding involves laying out the actual proposed timeline of the build, inspections and costs of materials, permits, personnel and transportation and what the plans are if penalties are incurred from anything that could arise.

Once those questions are answered then, Murphy told the commission, they can begin negotiating.

“Negotiations are all about time and

The mayor said he hopes to have a negotiated proposal and price back to the commission in two weeks. The approximate date of return could be Nov. 8, during the commission’s next scheduled meeting.

According to Murphy, the plan, if

everything comes together, is for the pier to open to the public again approximately 200-plus days from construction’s start. The RFP specifically stipulated the work need to be done “Don’t quote me on that, though,” Murphy said, “There’s still a lot that can happen in the meantime.”

Hiccups in the plan could include man made obstacles such as transportation, permitting, material availability, and the uncontrollable temperment of Florida’s weather and waters – which

City field improvements get the green light With commissioners on board with the proposed layout, work can begin on renovations at the city field complex.

HOLMES BEACH – A new plan is on the table for the city field complex and commissioners are ready to start seeing progress made on the planned renovations.

After going through a few different attempts, City Engineer Lynn Burnett, with the help of commissioners and public input, finally hit on a layout for the complex that meets the needs of users and helps to better utilize the space.

With the newly approved layout, the large dog park will expand to .86 acres and take over much of the current baseball diamond and outfield leading to the fence separating the field with the small dog park. The small dog park is staying in its current location. During construction on the park complex, planned for the current and 2019-2020

the park will be relocated to the current skate park area, adjacent to public works. Parking will take up the current staging area. The tot lot is planned for relocation near the existing gazebo, where it can be expanded in the future, and the skate park is planned for expansion along Marina Drive. Burnett

also suggested ringing the complex with a jogging track with exercise stations and utilizing the area in front of public works as a future overflow parking area. She said the Anna Maria Island Privateer’s Skullywag land-bound ship would not have to be relocated.

The remaining park area is planned as a multipurpose field that can be used for festivals, community events, or bases can be laid down for a pickup baseball game.

A memorial tree with dedication plaque located in the Marina Drive facing area of the park complex will remain in its current location.

Commissioners agreed unanimously to move forward with the proposed plan. Burnett said that while the tot lot can be relocated in-house using public works employees, she will have to come back before commissioners with contracts to be approved for the other work to be done.

“I like it,” Commissioner Pat Morton said of the project.

“I think it’s great,” Commissioner Rick Hurst said, congratulating Burnett on a job well-done.

A haunting in Anna Maria The Fall Festival at Anna Maria Elementary School celebrates autumn and Halloween.

ANNA MARIA – Autumn was in the air Saturday morning as a cold front moved in. Anna Maria Elementary School’s PTO was holding its Fall Festival, and the fact that Halloween was coming meant the kids were wearing their scariest costumes.

This year, the PTO held the parade and Fall Festival in new venues – City Pier Park and The Center, where many of the students go after school.

Holmes Beach Police Chief Bill Tokajer still led the parade with AME Resource Officer Josh Fleischer and Holmes Beach Police Sgt. Vern McGowan.

The kids and their parents put effort into their costumes, and the winners were announced after the parade at The Center.

There was fun to be had after the parade disbanded. There were games, a bounce house, an inflatable slide and a tall rock-climbing wall and the haunted house, a masterpiece of terror built by the parents.

The Waterfront restaurant sponsored a hayride, and there were hot dogs and hamburgers available. Many of the kids will don their costumes again to participate in the Anna Maria Island Chamber of Commerce Trail of Treats, starting at 3:30 p.m. on Wednesday, Oct. 31.

New book sheds light on the local paranormal “Haunted Manatee County” by local paranormal investigator Liz Reed is a frightfully good read.

You might find her a little creepy or kooky, maybe a bit mysterious or spooky, but one title it’s hard to deny Liz Reed is the queen of the local paranormal.

With her leadership of the Paranormal Society of Bradenton, a group which she founded with her husband, Ron, in 2013, a new book and a burgeoning ghost tour business, Reed is closer than ever to realizing her dream of studying the paranormal on a fulltime basis.

“I love doing what I do,” she said. “I wish I could do it full time.”

In her new book, “Haunted Manatee County,” Reed explores the ghosts and history of what was historically Manatee County, including De Soto, Glades and Hardee counties. She said the book took about three years to research, including the research she did for The Original Downtown Bradenton Ghost Tour and it’s Bradenton Beach counterpart, and two years to write.

The hardest part, she said, was finding period-specific photographs of the places she and her team encountered paranormal activity for inclusion in the book. She said writing it and using many of her own photographs in the book helped realize two of her lifelong goals – to be a professional author and photographer.

Rather than reaching out herself, Reed said she was contacted by publishers Arcadia Publishing and The History Press to write the book based on her popular ghost tours. Soon she’ll have a second book published on the haunted history of Sarasota County.

In her Manatee County book, Reed uncovers the stories of the ghost of famous mobster Al Capone, who occasionally rides the elevators at the Hampton Inn, the history of the Cortez Village and the fishermen who lost their lives at sea, the ghosts of a woman and girl who play hostess at The Sign of the Mermaid and the shades seen frolicking on Bridge Street.

One of her most active Anna Maria Island ghosts, she says, is the spirit of

George Bean Sr. whom she said likes to flirt with some of the ladies on the ghost tour, going so far as to mischievously take one lady’s glove, which was never recovered. Reed said Bean likes to follow along with the ghost tours, and she believes he roams the Island to keep a watchful eye on things.

On the downtown ghost tour, she said her favorite areas to explore are the Hampton Inn and the old location of the Manatee Players theater, now a construction site for a new hotel. She said that site is very active due partially to the Native American burial grounds that were used as fill in the area.

When the new hotel opens, Reed said she hopes to be one of the first to check in.

The information for Reed’s book and ghost tours comes from various sources including the spirits themselves. Her paranormal investigation team has several ways of communicating with the ghosts. While some members of her team are especially sensitive to the spirits and can see and communicate with them just like they’re talking with the living, others rely on the electronic equipment they bring with them on paranormal investigations including video cameras, digital voice recorders, voice boxes, K-2 meters and other devices.

Sometimes, she said they find nothing on these investigations. Other times they may think they haven’t found anything but get home and hear voices on recordings and see orbs of light and fully developed spirits walking past their cameras as they record.

When they record evidence of spirits, Reed often posts the recordings on the group’s social media or website for the public to see for themselves.

When told a legend of a haunted place, encountering a new spirit or preparing for an investigation, Reed says she attempts to verify stories through historical documents. When the investigators know they’re going to a new place, Reed studies the history of the building to help better prepare for what might be found there.

Her fascination with the spirit world is born of her own experiences and attempting to find an answer to the age-old question of what happens when we die.

“We’re all made of energy so where does that energy go after we die?” she asked.

Finding action with snook CAPTAIN DAVE WHITE

Inshore fishing has been so crazy the last week! The water temperatures and the incoming front had fish gorging. We here at Anna Maria Charters had the privilege of putting quite a few clients on quality fish.

Snook action was the best that I’ve seen so far this year.

With some trips producing 50 snook in a trip. We also found a few big schools of oversized redfish. These fish would’ve eaten a bottle cap if you’d have flicked it out there. Even the captain got to tug on a few.

Mangrove snapper fishing is still going great. We’re getting lots of quality meat in the cooler for our clients looking to take dinner home with them as well.

There’s also starting to be good showing of flounder out there.

These delicate fish are one of my favorites for the table.

Hopefully this great weather continues and we can all enjoy our time outside. Tight lines.

I fished the coastal Gulf on a trip last Sunday. With the albies not there, rough water and poor visibility, conditions weren’t good for tripletail either. Pete Pedersen, from Massachusetts, fished the ICW with me before daylight on Tuesday morning. With a strong outgoing tide, snook were on a bite, and he had good action catching and releasing numerous snook on my Grassett Snook Minnow fly. I scouted the coastal Gulf later in the week with good conditions and found tripletail plentiful and caught and re-

leased several on my Grassett Flats Bunny fly.

Fishing dock lights in the evening or before dawn, which is the coolest time of day, is still a good option for catch and release snook fishing. This is also a great time of year to fish the coastal Gulf for false albacore, tripletail, Spanish mackerel and more. Our natural resources are under constant pressure from red tides fueled by agricultural and residential runoff, freezes, increasing fishing pressure and habitat loss and degradation. Please limit your kill; don’t kill your limit.

November is Manatee Awareness Month

Cindy Lane It’s been a tough couple of years for Florida manatees.

So far this year, 714 manatees have died, compared to 538 in 2017, out of about 6,000 estimated to live in Florida waters, according to the Florida Fish and Wildlife Conservation Commission (FWC).

Red tide has been active in Gulf and inland waters in southwest Florida since last October, killing 67 of the 714 manatees, with red tide suspected in the deaths of 121 others. Nine were found in Manatee County.

The red tide neurotoxin causes manatees to have seizures that can result in drowning. If rescued in time, most manatees can recover, so report a sick manatee (muscle twitches, lack of coordination, labored breathing, an inability to maintain body orientation) immediately to the FWC Hotline at 1-888404-3922, or send a text message or email to Tip@MyFWC.com. Use VHF Channel 16 on a marine radio.

To survive, manatees in Florida waters also have to avoid eating red tide-poisoned seagrass, flee cold water, escape from people who climb on them and ride on their backs and dodge boat propellers.

As the official state marine mammals head from the Gulf of Mexico, rivers and bays to the warmer winter waters of springs, boaters should be careful to note speed zones that take effect in November.

To help protect manatees, follow these tips: • Obey posted signs for manatee slow-speed zones.

• Wear polarized sunglasses to see manatees in your path.

• If you observe a manatee mating herd – several manatees gathered as males vie to mate with a female – watch from at least 100 feet away.

Former restaurant manager charged with fraud Benjamin Conlon will be arraigned on Friday, Nov. 9, starting at 9 a.m.

Hurricane Hank's owner Brian Mathae had a rude awakening in June when he checked the payroll records and now his former manager, Benjamin Conlon, faces a fraud charge.

Mathae said it began when he checked the manager’s computer for earnings and allegedly found duplicate paychecks to Conlon.

He called the police Conlon and Holmes Beach Detective Sgt. Brian Hall started an investigation. He found Conlon had allegedly taken $13,680 more than was allowed. Mathae found out Conlon was the only person to

have access to the payroll.

Hall sent a report to the state attorney’s office, and Conlon was arrested. He was bailed out and faces an arraignment on Nov. 9.

Mathae said he was disappointed, and his priority is to get back the money that was lost.

“The profit margin is tight in the restaurant business,” he said.

“This happened while tourism took a hit because of red tide.”

Trial date set in alleged burglary, assault

BRADENTON – The trial of a Holmes Beach man accused of burglarizing a Holmes Beach house and beating the female owner has been set for April 15, 2019, in circuit court.

Mark L. Snyder, 56, faces charges of burglary, assault or battery, aggravated battery (with great bodily harm – victim 65 years of age or

older) and seconddegree grand theft in the June 28 crime.

Snyder was arrested July 3 after a neighbor tipped police that he appeared to match a Snyder surveillance video’s description of the suspect, and he drove a vehicle that also matched the suspect’s vehicle.

According to the Holmes Beach Police report, the victim returned

home to find a man in her bedroom in the process of stealing her property. She told police she screamed, and he allegedly hit her a number of times, causing her to fall and bleed. He then fled the residence carrying bags of stolen jewelry.

The victim, who does not want to be identified, was taken to Blake Hospital with a broken bone in her face and lacerations to her head.

Snyder is still incarcerated after his bail was revoked.

Sandblast to hit the Island this weekend Keep Manatee Beautiful is once again sponsoring Sandblast, a design competition on Manatee Public Beach, 4000 Gulf Drive, this week.

There will be free sand sculpting clinics from 5 to 6 p.m. on Thursday and Friday, Nov. 2 and 3.

Check-in for the contest begins at 8 a.m. Nov. 3, and sculpting will take place from 9 a.m. to 1 p.m. It will be followed by an hour of judging and awards at 2 p.m.

The sand sculptures will stay in place for the public viewing until Nov. 30 or the first major rain that destroys their appearance.

The sand sculpture themes are free-form and wildlife.

The two divisions are Elementary-Middle School and High School- Adult.

an 80-ton exhibit sculpture created by Team Sandtastic, that has won many contests and awards around the globe (www.teamsandtastic.com).

Holmes Beach considers golf cart regulations Commissioners are considering an ordinance that would remove golf carts and low speed vehicles from city streets with a speed limit of 35 mph.

HOLMES BEACH – If you drive a golf cart in Holmes Beach, new regulations may be on the way that affect where you can go.

During the Oct. 23 work session, commissioners considered a draft ordinance brought forth by Holmes Beach Police Chief Bill Tokajer concerning the use of golf carts and low speed vehicles in the city. Tokajer said that Holmes Beach is the only one of the three Island cities currently allowing golf carts that are not street legal to be driven on all city streets by a licensed driver. With the new ordinance, he hopes to make the city’s streets safer for golf cart users and motorists by taking the slowest of the vehicles off main thoroughfares.

Tokajer suggested either requiring golf carts to be retrofitted to be street legal and registered with the Florida Department of Motor Vehicles or confining their use to Key Royale where a golf course is located. He estimates it would cost $1,300-2,000 to make a standard golf cart street legal with the biggest costs being the registration and installation of a windshield.

Commissioners recognized the need for increased safety on golf carts operated within the city but balked at the idea of restricting their use to the Key Royale neighborhood.

Commissioner Judy Titsworth said she agrees that seeing golf carts carrying children with no safety belts scares her, but she doesn’t want to take rights away from responsible residents who depend on their golf carts for local transportation and might not have funds to make an investment in making the golf carts street legal.

Commissioner Carol Soutek, a golf cart owner, said she also was concerned with the idea of taking away a mode of transportation that many Holmes Beach seniors depend on.

“The residents are pretty responsible with their golf carts because they appreciate having it,” she said. “I would like to leave the residents’ golf carts alone.”

In lieu of banning golf carts all together, Tokajer suggested commissioners consider requiring them to be retrofitted with seat belts, and any children of an appropriate age or size be required to ride in a car seat, just as they would be in a vehicle. He also presented a color-coded map with a suggested golf cart route through town focusing on back streets rather than main thoroughfares where traffic is more intense. He suggested disallowing low speed vehicles and golf carts on city streets with a speed limit of 35 miles per hour.

Commissioners agreed to consider the implementation of seat belts and restricting the use of the vehicles in higher speed limit areas. They asked Tokajer to come back with ideas for a city golf cart registration program.

Scary disclosures

W

hat do people do when they have everything they can possibly need? A safe and secure place to live, plenty of good quality food and access to modern health care.

You know what they do, they pay to be locked in a spooky room and challenged to find a way out.

One of the hottest forms of entertainment in our privileged country is called an escape room. In it you are literally locked in for an hour with a group of other people and look for clues while the ghost of a recently departed leaves hints to help you find an exit.

Crazy as this may sound, it’s not nearly as crazy as selling properties where there is a belief of hauntings or a death in the property. In September I wrote a column about property disclosure and discussed that the state of Florida holds sellers responsible to disclose defects in a property. Although this disclosure does

Castles in the Sand LOUISE BOLGER not have to be in writing, it is recommended for the seller’s protection that it is.

The state’s guidelines indicate that disclosure does not have to be made if the property was inhabited by a person infected with HIVB or AIDS or that a murder or suicide has occurred or is suspected to have occurred on the property.

Likewise, disclosure does not have to be made if the house is known to be haunted, since there is no way to authenticate a haunted house; it’s all subjective.

However, the guideline also states that disclosure must be made if there is po-

tential impact on the value or desirability of the property. This is a little bit of a conflict and a gapping gray area in an already ambiguous zone of disclosure.

Most real estate professionals would advise full disclosure for rumors about hauntings as well as unusual deaths in the property just as you would disclose foundation cracks hidden behind walls particularly if you’re asked.

Even though sellers are not obligated to do so and would not have a financial obligation after a closing, why make a buyer feel he/shehas been duped? Since some buyers are sensitive to previous activity in a property, disclosure is the best course of action, as silly as it may sound.

Even Bernie Madoff’s New York City condo had a problem selling because buyers didn’t want to be associated with the bad energy that may be lurking in the property.

But what about future developments

adjacent to properties or bridges? Manatee County is exploding with construction – some very big that will change the lifestyle of nearby residents, not to mention the rebuilding of both bridges out to Anna Maria Island, both of which could impact existing properties.

These are projects that have been approved, on the books but not begun and would not be obvious to a potential buyer. Are sellers obligated to disclose future approved projects that could have a substantial financial impact on properties? Don’t look to me for an answer, but if it were me and I knew something on the books would financially or aesthetically impact property I was selling, I would have a sit down with an attorney.

In the spirit of full disclosure you should disclose the spirits if you have any. Have a happy Halloween and watch out for the ghosts – even the friendly ones.

Management Agency, all of which have promised Anna Maria funds to rebuild. Murphy said the city can expect to receive combined total of a little over $3.5 million from the county, state and federal sources.

Added into the pot is an interlocal agreement from Manatee County. A week before the commission met Oct. 26, Murphy said he received an agreement for funds from Manatee County Administrator Ed Hunsicker, promising a 3:1 return of funds. For every $1 million the city spends rebuilding the pier, the county promises to gift them $330,000 from its beach concession funds.

The agreement from the county set commissioners back a step. Commissioner Bryan Seymour was the most vocal of the gathered four, asking why the county had promised them only 3:1.

Bradenton Beach and Holmes Beach had both been offered 2:1 interlocal agreements for other projects such as road improvements and pedestrian safety measures.

Murphy told the commission that

with this much money in play the variance in funds wasn’t a big factor.

“When you have this much in play, it’s immaterial,” he said.

He added he could go back to Hunsicker and try to renegotiate the agreement but it would hold up construction. If Murphy was able to renegotiate to a 5:1 ratio the city could receive an extra $170,000 per million spent.

“I can go back to Ed [Hunsicker] and complain. Then it would would go back to the County Commission for approval. But we might be sitting here for another 2-3 months,” Murphy said.

“We need to get pilings in the ground,” Seymour said.

The four commissioners gave the mayor unanimous approval to sign the 3:1 interlocal agreement with Manatee County.

The RFP deadline was 3 p.m., Oct. 5.

The city received packages from i+iconUSA; GLF Construction Corporation from Miami; American Bridge, also based in Tampa; and Speeler & Associates, Inc. from Largo, which

also had demolished the old pier.

After the city received the applications, it sent many of them back to the applicants with requests for clarification on proposed items or for simply more information that had been left incomplete.

The deadline for more information was Oct. 12.

After that Murphy began his due diligence into researching the companies, which, he said, included making sure their finances were sound.

The lowest bid was from Port Saint Lucie-based Cone & Graham Inc. at $3.45 million, but Murphy told the commission, its proposal was incomplete, even with the extended deadline the city allowed.

Unanswered questions didn’t sit well with the mayor. i+iconUSA, though second lowest, had a complete package, without unanswered questions and is financially sound, Murphy said. Only then was he confident he could bring a decent proposal and request to open negotiations to the commission.

The highest bid was $4.78 million from GLF Construction.

Proposals were based solely on constructing the pier itself. They did not include reconstruction of the buildings which had previously housed the Anna Maria City Pier Restaurant and bait shop.

Murphy said he’s still negotiating with Anna Maria City Pier Restaurant owner Mario Schoenfelder. Schoenfelder has a lease with the city for the buildings that were at the end of the demolished pier. Part of the lease, which is set to expire December 31, 2019, is that Schoenfelder would insure the previous buildings and help cover any repairs.

Reconstruction wasn’t specifically part of the deal, and the cost of rebuilding the buildings hasn’t yet been fully calculated.

If everything comes together; if nature and man don’t impede progress; if funds are found and plans are approved, the city is hoping the pier will be open again by fall of 2019.

“We’re all concerned about time and quality,” Murphy said. “We need to get cranking, and we need to get it done right.

Then and now - the Regina Spectators gathered along the beach on Anna Maria Island to witness the sinking of the 300-foot long molasses barge Regina in 1940. She was a converted tanker, loaded with 350,000 gallons of molasses, when she was caught by stormy seas. Clayton Adams, of Cortez, and other local men worked to rescue the crew as the March night grew cold and the temperature dropped below 40 degrees. The ship’s cook, Severino Canisares, and the ship's mascot, a German shepherd, drowned while trying to swim to shore. The water and the beach was filled with brown globs of molasses for months after the sinking. Today, the Regina wreck is a state underwater archeological preserve.

Natives in bloom Sea grapes appear green in July and ripen in October, providing food for birds, squirrels and people willing to make jam, salad dressing and wine from scratch. The salt and drought tolerant native Island plants also provide shade and shield sea turtles from lights. Sea grapes are protected by state law, which regulates trimming and removal.

Reed said she believes that some of that energy stays here, some of it crosses over to whatever lies beyond this life, and she’s fascinated by all of it.

“There’s no explanation for what we have found,” she said of the paranormal investigations, adding that she loves being able to explore the history of the area and verify stories from the past. For the naysayers, she offers guests on her ghost tours the opportunity to use some of the equipment that her paranormal group uses on investigations to allow them to experience the spirit activity for themselves.

“They just want to be known, that they’re still here,” she said of the ghosts she encounters.

As for the book, she said it was an interesting project, and she hopes that readers will enjoy it.

“I want five ghosts, not five stars,” she said.

OBITUARIES James Drew 'Jim' Adams James Drew ‘’Jim’’ Adams, 83, passed away Oct. 21, 2018. He was born in Tallahassee, Fla. Nov. 2, 1934, the son of Samuel Pitt Adams and Alice Beatty Adams. He moved to Anna Maria with his family as a young boy and went to the small one room school in Anna Maria. Jim graduated from Manatee High School in 1952 and joined the Navy serving in the submarine service. He graduated from Florida State University in 1961 as a chemical engineer, and it led to a career in aerospace with NASA, where he won many awards including the Manned Space Award for work on the shuttles and the Silver Snoopy award given by the astronauts that orbited around the Earth. He stated many times it was the best job ever.

Drive. A customer’s unsecured bicycle helmet worth $150 was stolen. Witnesses said the victim was seen arriving at the bar with no helmet so the officer closed the case.

The officer received a message on the radio that a careless driver was heading toward the Island on State Road 64 and he intercepted the vehicle. The female driver acted like she was under the influence. When asked if she had been drinking, she said she had consumed two glasses of wine. She forgot to unlatch her seatbelt when she tried to get out of her car. She agreed to perform a field sobriety test and the officer arrested her based on her performance.

An inspection of her vehicle netted several bottles of prescription pills and she was charged with possession of the pills without prescriptions.

10/24,consumption of alcohol in public, Island Branch Library, 5701 Marina Drive.

The officer responded to a call from a library employee about an intoxicated male who was loitering and sleeping while seated at a computer. He finally left, went to the west side of the library and fell asleep on the lawn. He was arrested and taken to the hospital.

10/24, driving with a revoked license, 600 Manatee Avenue. The officer stopped the driver because he had a badly cracked windshield, and it looked like he was not wearing his seatbelt. He found out the driver’s license was revoked because he is a habitual offender. He had a pistol and brass knuckles, but he was not a convicted felon. He was arrested for the lack of a license.

After two weeks of play in the fall adult co-ed soccer season, Sato Real Estate remains on the top of the leader board, despite the challenges of a new squad. Lead by team captain Josh Sato, the current Hayward Cup champions easily defeated Ross Built Construction Thursday night.

Ross Built Construction, without its leader Greg Ross, struggled to take shots and stop offensive powerhouse of the Sato team.

Sato Real Estate’s roster proved to be too much for the Ross Built defense, with Eric Pullen, Mark Rudacille, Francisco Oliviera and Sato all scoring for the team in purple, along with assists by Andrew Schmidt and Matthew Staggs.

Pullen started the offensive challenge with a pass to Oliviera. Oliviera’s shot was stopped by Ross Built Construction goalkeeper Robb Marshall, who returned to the team after a couple of seasons out of the league.

Less than a minute later, Schmidt got his first assist to Sato, who scored in the first minute of the game. Pullen struck with a beautiful arching shot just over the head of Marshall for the Sato Real Estate second goal taking the score to 2-0.

Four minutes into the game, Ross Built’s lone female player, who predominately plays defense, found a scoring opportunity to put her team’s first point on the scoreboard.

Defender Alta Bujarski showed her skills against Schmidt. Schmidt pulled away from Bujarski finding Pullen in striking position to score his second goal for Sato Real Estate, once again giving the team a two-point lead.

Ross Built Construction worked well on the Sato Real Estate side of the field but could not get the ball in the net. Ten minutes into play, Max Gazzo took the corner kick getting the ball to Vince Circharo, whose strong leg sailed the ball over the crossbar.

The Ross Built defense and Marshall’s goalie skills shut down the Sato Real Estate offense for a solid 10 minutes. In that time, Gazzo made a nice slide to the soccer ball to keep it in bounds, getting it to Chris Circharo for the second Ross Built Construction goal, narrowing the gap with the score 3-2.

To end the first half of the game, Team Sato scored its fourth goal of the game with a shot by Oliviera.

in front of the goal outside of the box just missed the net.

Marshall proved to be a force to be reckoned with a shot by Mark Rudacille that ricocheted off of the goalie’s hands, giving Sato Real Estate a corner shot. The corner taken by Sato put the soccer ball to Pullen’s feet in a swarm of defenders.

Working the ball out of traffic, Sato was finally able to take a shot that hit hard into the side of the net.

At minute 30, a rocket shot by Pullen bounced off the hands of Marshall and into the goal at the right post.

With the biggest lead of the game and the score 5-2, Sato Real Estate found itself on the defense for the better portion of six minutes, with only a few shot attempts.

After keeping the ball from going out of bounds, V. Circharo nailed a beautiful shot attempt that curved just short of the goal.

On a penalty on Sato that put C. Circharo flying in the air, V. Circharo took the free kick. Leaning back on the kick, V. Circharo’s goal attempt landed in the nearby tennis courts.

Rudacille finally found his footing and scored his first goal of the game after several attempts. Seconds later he scored his second point with a shot that went above

Marshall’s head, increasing the Sato Real Estate lead to 7-2.

Once again running across the field at full speed, V. Circharo sent a missile right to the hands of Marshall. The shot was too hard for Marshall to handle, sending the soccer ball into the net for the third and final Ross Built goal, and the final goal of the game.

The last three games of the night were close battles once again showing the parity in the league.

After 90 minutes of play, Ryan Moss’ Moss Builders tied Jiffy Lube, captained

by Danny Anderson, with six goals each.

Going into week three, Moss Builders finds itself in a three-way tie for fifth place with Slim’s Place and AMI Locals.

Lancaster Design walked away with a two-point victory in game three of the night against Slim’s Place. Its win currently puts Team Lancaster Design tied with Sato Real Estate in the first place position.

The third game with AMI Locals against Eason Builders Group was a close game during both halves of play. The come from behind victory by Eason Builders put it in fourth place in the league with a 1-1 record.

With four teams that have yet to capture a victory, Ross Built Construction starts this season much like the last at the bottom of the rankings with five more regular season games to play.

for a stalled city marina and campground renovation project and filed a lawsuit seeking to recoup $125,000 paid to Technomarine.

The Bradenton Beach dock sections were manufactured by Ronautica Marinas in Spain and shipped to Port Everglades in August. On Sept. 25, Technomarine CEO Erik Sanderson emailed Police Chief and Pier Team facilitator Sam Speciale and informed him the dock sections were trucked to a Tampa boat yard pending future barge delivery to Bradenton Beach.

To date, Sanderson has not provided an address for the undisclosed storage location and City Attorney Ricinda Perry said the docks remain Technomarine’s property until delivered to Bradenton Beach.

DEFAULT LETTER

On Oct. 18, the CRA directed Perry to draft a letter putting Technomarine and Sanderson on notice of being in default of the $119,980 contract the CRA and Technomarine agreed to in January 2017.

On Friday, Oct. 26, Perry sent the requested letter to City Clerk Terri Sanclemente and asked that it be reviewed by CRA chair

Ralph Cole before being sent via certified mail to attorney Roger Stanton at Technomarine’s North Palm Beach office. Perry also requested that Speciale email the letter to Sanderson.

“To date, you have failed to provide a proper set of engineered plans in accordance with the request for proposal submission by Technomarine, failed to provide the dock materials paid for by the CRA on July 31 and failed to timely install the floating dock. Technomarine has been largely unresponsive and has provided little to no communication or reasonable assurances as to when your legal obligations will be performed,” Perry’s letter states.

“Despite reassurances from Technomarine that the materials would be delivered to the CRA – to date no such delivery has occurred.

Significantly disconcerting is the testimony under oath provided by Erik Sanderson on Aug. 8 in his deposition from Karch v.

Sanderson, wherein he stated ‘the city of Bradenton Beach project, to my knowledge is paid in full and 100 percent complete.’

Mr. Sanderson also testified the ‘city of Bradenton Beach doesn’t make payments to Technomarine Construction. They make

This Sunday, Nov. 4, the time changes again. Mid-term elections are next week, Tuesday, Nov. 6, after which time the bill will have to be reintroduced.

And Congress is not in session this week, and won’t be until Tuesday, Nov. 13.

If the bill ever passes, it will not be the first time Floridians experience year-round Daylight Saving Time; during the oil crisis in the 1970s, Congress passed the Emergency Daylight Saving Time Energy Conservation Act of 1973, which temporarily made Daylight Saving Time year-round in part of 1974-75.

And Florida would not be the only state to be different; Arizona and Hawaii do not observe Daylight Saving Time at all.

ARGUMENTS FOR EXTENDED DAYLIGHT SAVING TIME • Gives people more time to be outdoors after work in the winter • Better for tourism, when tourists have more light in the evening to be shopping or at the beach • Benefits the economy, including the elimination of a substantial economic decline that comes every November when clocks move back, according to a study by JP Morgan Chase of major city regions, which found that there is a drop in economic activity of 2.2 percent to 4.9 percent when clocks move back.

According to City Treasurer Shayne Thompson, the city has made three payments to Technomarine Construction Inc. totaling $83,682 – including the $29,961 July payment Technomarine was supposed to reallocate to Ronautica Marinas.

When contacted Monday, Ronautica Managing Director Oscar Fontan said Technomarine has not yet paid for the Bradenton Beach dock sections, and Ronautica plans to file a $51,000 lawsuit against Technomarine.

Perry’s letter concluded by saying, “It appears that the actions of Technomarine are akin to defrauding taxpayer monies and civil theft. You have 10 days from the receipt of this correspondence to make appropriate arrangements to resolve the delivery of the dock materials. Failure to do so will result in my client exercising any and all of its legal rights to protect its public funds and this current project. Please contact me at your earliest convenience to work out an amicable solution.”

Perry recently told the CRA members it would be a waste of time and money file a lawsuit against the financially-strapped company.

referenced pertains to Sanderson’s Aug. 8 deposition as part of the ongoing legal actions stemming from a 2017 lawsuit in which Christopher Karch sought $3.87 million from Sanderson and Technomarine and in April was awarded $1.7 million that he’s now trying to collect.

In 2014, Karch agreed to serve as Technomarine’s qualifying contractor. The lawsuit alleges Sanderson and Technomarine wrongfully converted the proceeds of two multi-million-dollar marina projects and entered into those contracts without Karch’s knowledge or consent.

“Sanderson owns, controls and employs Technomarine Group as a sham entity to defraud creditors,” Karch claimed in the lawsuit complaint.

According to the written transcript of Sanderson’s August deposition, Technomarine Construction has not accepted any contracts in 2018 and is “unwinding as a company because it’s a loss leader.”

Sanderson also said Technomarine did not plan to renew the lease on its North Palm Beach office space and he was not sure if he planned to file bankruptcy, according to the deposition transcript.
