Franchise moratorium approved on first reading No new formula businesses will be permitted in the city for eight months from June 14.

HOLMES BEACH – Commissioners approved the first reading of an ordinance establishing a moratorium on new franchise, or formula, businesses for eight months beginning June 14.

The issue began when commissioners learned that Dunkin Donuts and Baskin Robbins were planning

to come to the Anna Maria Island Centre, owned by the Benderson Development Company. This was followed by complaints from other business owners and residents about losing the Island’s character and Old Florida charm.

City Attorney Patricia Petruff said, “It allows you to take a step back and study the issue and see if anything would work well with Holmes Beach on how to regulate these types of businesses.” see franchise, page 13

Sun nabs 8 awards A photo of a twister hitting the Skyway Bridge and a cartoon of a cyclist being ticketed by a cop were two entries that helped the Anna Maria Island Sun walk away with eight awards in this year’s Florida Press Association Better Weekly Newspaper Contest.

The Spot News Photo winner was taken by Sun contributor Tyler Kapela and framed the dramatic moment just before a tornado descended from the sky and slammed into the lower portion of the Skyway.

FPA judges said: A once-in-a-lifetime photo and the epitome of the perfect spot news photo. Stunning.

The other first place entry was from The Sun’s multi-award winning cartoonist Steve Borggren. The cartoon depicts a bike rider whose pants have come unbuckled and has been pulled over by a traffic cop. The caption reads: I’m citing you for not buckling up.?

The cartoon was in response to a Sun survey that asked if bicyclists should be made to comply with traffic laws.

The annual FPA contest includes more than 1,500 entries from newspapers throughout the state of Florida.

The Sun competed in Division B, for newspapers with circulations of 7,000 to 15,000. The Sun was the only newspaper from Anna Maria Island to win an award.

Board approves beach patrol agreement Holmes Beach commissioners authorized the mayor to enter in to an interlocal agreement with Manatee County to provide law enforcement at Manatee Public Beach for $10,000.

“I thank the county commissioners for all their assistance in helping us out here with this overload, which they admit,” Commissioner Carol Soustek said, with tongue in cheek.

“I appreciate them acknowledging that the city is paying to monitor and protect all those visitors that come here with their own city tax.”

Commissioner Jean Peelen praised the county’s “generosity to give us a whole $10,000 to keep the beach safe.”

Commissioner Marvin Grossman asked Police Chief Bill Tokajer if he keeps track of the time spent on beach patrol and Tokajer said he does. Tokajer noted that Bradenton Beach receives more than $90,000 from the county to patrol Coquina Beach.

Mayor salary to double Holmes Beach commissioners approved on first reading an ordinance increasing the mayor’s salary from $1,000 to $2,000 per month.

Commissioner Jean Peelen, who proposed the increase, said the job is no longer for a “part time volunteer. It’s a full time job.

“I’m doing this to recognize the importance of that position and trying to indicate that position has worth and value and that person has to work very, very hard in it.”

According to the city charter, the mayor’s salary cannot increase during his current term. It states, “Until such term expires, the mayor shall continue to receive the compensation in effect immediately prior to the effective date of this ordinance.”

Since Mayor Bob Johnson is unopposed in the November election, the salary increase will begin when he is sworn into office in November..

Parking fine to increase Holmes Beach commissioners approved a draft ordinance that would increase the fine for parking violations from $35 to $50. It added right of way to places where vehicles must be “stopped or parked with the right hand wheels parallel to the direction of traffic and in a manner that does not impede traffic.”

Police Chief Bill Tokajer said it also added a section that designates all city rights of way intersecting Gulf beaches as emergency access points where parking is prohibited.

“It allows us and the fire department to get our emergency and rescue vehicles on the beach,” he explained. “It would be a $75 fine.”

The ordinance will go to first reading at the next commission meeting.

Bert Harris claims continue

The city has received 67 Bert Harris claims and made settlement offers on 57 of those claims.

ANNA MARIA – The city of Anna Maria received two more Bert Harris claims last week.

On Tuesday, Sept. 13, a claim was filed by the Blalock Walters law firm on behalf Benjamin and Julie Asper for the four-bedroom short-term vacation rental they own at 507 S. Bay Blvd. The Aspers are claiming $345,000 in lost property value due to the occupancy limits imposed on a rental unit that had a pre-vacation rental ordinance occupancy of 10 persons.

On Thursday, Sept. 16, the Steven M. Jones Law Firm filed a claim on behalf of Violet and Neil Rosenbilt, the owners of a six-bedroom plusden vacation rental located at 804 N. Shore Dr. The Rosenbilt’s claim cites $525,000 in assessed lost property value for a structure that listed a pre-rental ordinance occupancy of 18 guests.

Like 20 of the 28 settlement proposals presented to the commission earlier this month, the Rosenbilts are seeking an occupancy limit that would allow four more guests than the two-plus-two provision would allow. Property owners seeking more than the two-plus-two occupancy limits are now being offered the two-plus-two provision or a purchase offer that represents a 1.5 percent increase over the assessed property value.

According to City Attorney Becky Vose, some of the first 29 claimants who received settlement offers have

accepted the two-plus two provision as an alternative to a monetary settlement. As of Sunday, Vose had not heard back from any of the 20 property owners who recently received purchase offers as an alternative to the two-plus-two provision the city is willing to accept. Earlier this month, Vose told the commission she does not intend to present them with any settlement offers that offer occupancy limits in excess of two-plus-two.

To date, 67 Bert Harris claims have been filed with the city and settlement offers have been made on 57 of those claims. By law, a settlement offer must be made in response to every individual claim filed.

HOLMES BEACH – The city received two more Bert Harris claims from property owners.

Attorney Scott Rudacille, on behalf of client Robin Rokisky, filed a claim for the property at 3078 66th St., which she said she purchased in 2013 as an investment property for vacation rentals.

According to the claim, “the property contains a six-bedroom home, which is configured for, advertised for

and regularly rented to parties of 15,” and when the city approved Ordinance 15-12, it limited the occupancy to 12.

The claim stated, “According to the appraisal report, “the property is worth $1,325,000 without the occupancy limitation and is worth $980,00 with the occupancy limitation in place.

Thus the value of the property has been reduced by $345,000 as a result of the city’s adoption of the ordinance.”

The second case involves Lizzie Lu’s Island retreat, 214 54th St., Units A and B, and is being handled by Morgan Bentley, of Bentley & Bruning.

According to the claim, Lizzie Lu owns 10 parcels, which are used as short-term vacation rentals, and one of those is affected by Ordinance 15-12,

which restricts it to a lower occupancy.

The claim stated that the restriction causes “a substantial diminution in the property owner’s reasonable, investment backed expectations. While the property may be entitled to a non-conforming status, there is no practical way for the petitioner to change the configuration of the structures on the property such that petitioner may both continue to use the property as per its existing use and comply with the provisions of the ordinance.”

The claim also maintains that the property may be entitled to have a larger unit, but it would still be restricted to two bedrooms on each side.

The claim states an appraisal establishes the loss in value at $730,000.

HOLMES BEACH – City commissioners last week reviewed an ordinance establishing public urination as an offense with a $75 fine.

“We need an ordinance that allows us to fine people who urinate on the beach,” Police Chief Bill Tokajer explained. “We see it every day. We drive down and see somebody in the bushes taking a leak.

“Right now, as a police officer, we can’t take legal action. We have to have a citizen that would be a willing participant to say it is offensive to them and sign an affidavit.”

EDITORIAL Thanks from the publisher

I

t isn't often that we get a chance to publicly say thank you to those closest around us.

But now is one of those times and we get to do just that.

Congratulations to all of the staff at The Sun for a job well done over the past 16 years, and a particular attaboy for those who collected our eight awards in this year's Florida Press Association Better Weekly Newspaper Contest.

This is a statewide competition in which newspapers throughout Florida submit their best work in a variety of categories, including reporting, design, photography, you name it. It is a popular contest and one that entices hundreds of weekly publications to send in what they consider their best work done over the previous 12 months, in this case calendar year 2015.

The Sun took home eight awards this time around, including two first place winners for cartooning and photography. Look at Page 3 in today's edition for reproductions of those entries. The front page, which is from our Oct. 14 edition, shows a twister descending from the sky just before it swept over the lower, southern portion of the Skyway Bridge. It may be the most dramatic Page 1 we've ever produced, in terms of sheer impact. The judges agreed, calling the photo by Sun contributor Tyler Kapela "a once-in-a-lifetime shot" and "the epitome of the perfect spot news photo."

Sun cartoonist Steve Borggren walked away with the other first place entry, which is nothing new for him. Steve has won so many awards for his editorial cartoons that the FPA probably should name the category after him.

We count nine firsts since our inaugural edition in 2000, including one year when he won first and second. He is a clever, talented cartoonist and we consider ourselves fortunate to have him lampooning Island life for us.

The other Sun winners all deserve a shoutout as well, and they are likewise chronicled in today's Page 3 story. We thank them all for their efforts and congratulate them on a job well done.

We at The Sun are going to continue covering the news on AMI, just as we have for the past 16 years. We're also going to continue to be the most awarded newspaper on the Island.

By far. And to the few haters out there who have tried recently to silence this journalistic voice, you have failed.

LETTERS TO THE EDITOR Flooding requests In response to Mary D. Harrison’s letter (The Sun, Sept. 7) about the Cortez Bridge, the alternative requiring acquisition of Bridgeport condominiums for a retention pond is one of three pond sites the Florida Department of Transportation is studying. We would likely select the pond site located entirely within existing FDOT right-of-way, which is the least expensive option, and no residences would be acquired.

A new bridge to Longboat Key must be prioritized by the Sarasota/ Manatee Metropolitan Planning Organization (MPO) before FDOT can initiate a study. A new bridge is not in the MPO’s 2040 Long Range Transportation Plan.

Cortez Bridge is showing signs of its age. FDOT completed a major repair project in 2015 to maintain the integrity of the bridge for up to 10 more years. The bridge could be repaired again, but will not last long-term due to corrosion within the bridge components. The bridge remains safe, but lacks modern safety features like shoulders for emergency or disabled vehicles that could impede traffic during an evacuation.

The federal study process for improving Cortez Bridge requires that all viable alternatives be analyzed, from no-build/repair to replace-

ment. FDOT considers comments from the public and stakeholders.

The Manatee County commissioners said if the replacement alternative is selected, it should include modern amenities for bicyclists and pedestrians.

FDOT held public meetings in August 2014 and last month to gather public input. The results of a survey distributed last month show 67 percent of the over 400 responses support replacement of the bridge while 29 percent favor the no build/repair alternative.

A public hearing to present the recommended alternative(s) and gather public input is planned for early 2017. FDOT will make a final decision about the future of Cortez Bridge after that hearing.

Kudos to public works I would like to take a moment to express my appreciation to the members of the Anna Maria Public Works Department. During our recent encounter with Hurricane Hermine, the job done by this group was, to say the least, outstanding.

I would like to comment on the actions of Dean Jones (assistant director of Public Works). I know for a fact that on Wednesday, Thursday and Friday of that week, Mr. Jones was on duty until late into the evenings, checking throughout the city for the deep water and the issues it created.

HOLMES BEACH – Commissioners reviewed changes to the vacation rental ordinance that were added to address illegal advertising of vacation rental units.

City Attorney Patricia Petruff said Section 4.14 makes the city’s expectations clear by stating that all advertising shall state the maximum occupancy limit of the vacation rental unit and the maximum parking.

The following statement was added to the section, “Advertisements that do not contain this information or that contain inaccurate information, shall be deemed a violation of this ordinance and subject to the penalties contained in Section 4.11.”

She said it would take awhile for the city to issue all the certificates and asked, “Is there any time frame on how long they have to get it on their website?”

Police Chief Bill Tokajer replied, “Their advertising needs to be listed once they’re issued their certificate. It will be a reasonable amount of time. We’re more concerned with compliance.”

Penalties

Petruff questioned a provision in the penalty section that states, “After a third violation or an irreversible violation, the property shall lose the vacation rental certificate for one year from the date of violation making it ineligible to be used for vacation rental.”

“I do not recommend that we yank that license. I do not want to be the test case in the state of Florida for that particular action.

“Basically it would be ratcheting fines but not taking away the license. It flies in

Petruff said they would check that when they get the recorded deeds, but “unfortunately for some people it will be a surprise.”

Grossman pointed to the prohibition on diving boards and platforms and asked if they could make existing ones have insurance coverage, and Petruff said no and explained, “You are meddling in people’s private property rights.”

Commissioners agreed to move the ordinance to first reading.

Occupancy rehearing denied Judge Gilbert Smith Jr. has denied a request submitted by Florida Gulf Vacation Homes LLC, doing business as Anna Maria Vacations, for a rehearing on the plaintiffs’ unsuccessful challenge to the eight-person occupancy limits contained in the city of Anna Maria’s vacation rental ordinance.

Earlier this year, Smith ruled that the city-imposed occupancy limits do not conflict with state law that says a local government cannot prohibit vacation rentals or limit the frequency or duration of rentals.

After Smith ruled in support of the city’s occupancy restrictions, 67 short-term vacation rental owners subsequently filed Bert Harris claims seeking greater occupancy allowances or financial compensation for the assessed loss of value the occupancy limits impose on a specific property.

Florida Vacation Homes LLC has until Sept. 23 to file an appeal with the Florida Second District Court of Appeal in Lakeland.

$12.3 million budget gets first OK One resident said the city should not be funding nonprofits such as The Center of Anna Maria Island.

HOLMES BEACH – Commissioners approved the 2.25 millage rate and $12.3 million budget on first reading last week.

City Treasurer Lori Hill explained that the budget includes $187,000 in additional revenue from vacation rental

certificates, and outside agency funding of $56,000, which includes The Center, Keep Manatee Beautiful and any other agencies that request funding.

In reply to a question from resident Jim Kihm regarding funding for The Center, Chair Judy Titsworth said, “There is money for the community center in this year’s budget, but the City Commission has not agreed if we’re going to fund it this year. If not, it will be rolled over to the general fund.”

“I want to express my displeasure that its in the budget at all,” Kihm said.

“I don’t think it has a place in there. I

don’t think it’s appropriate for any of the cities on the Island to be placing government funds in a non-profit.”

Commissioner Jean Peelen said the funds are not earmarked for any agency in particular and Kihm replied, “I find that a very slippery slope that we have that little wedge in there, and people can find ways of making things happen.”

Peelen asked if they planned to discuss The Center’s funding, and Titsworth said, “It will come back to us on a future agenda. If we do any more than the standard, they have to show a need. There will be no check until the

HOLMES BEACH – At the City Commission meeting following the budget hearing last week, two people spoke against funding for The Center of Anna Maria Island.

Last year, Island residents rallied around fitness center owners Jen Crady and Barbara Caning to oppose the installation of a fitness center on the second floor of the Center and asked the Island cities to withdraw The Center’s funding. In the fiscal year 2015-26, the city of Holmes Beach donated $22,500, the city of Anna Maria donated $16,000 and the city of Bradenton Beach donated $250.

Jeff Nash, a resident of Anna Maria, said, “I support Jen with the gym. Do not allow tax money to support The Center. It’s doing OK on its own. Jen doesn’t have tax money to support her.”

The proposed budget shows total operating revenues of $6,723,918 and carryovers/reserves of $5,630,725 for a total of $12,354,643. It shows expenditures of $3,964,202 for personnel, $1,749,168 for operating expenses, $1,704,070 for capital outlay, $4,858,103 in assigned/ unrestrictive funds and $79,100 for debt service for total of $12,354,643.

Anna Maria budget goal: No red ink The city will enter the 201617 fiscal year with $2.4 million in unbudgeted reserves.

ANNA MARIA – The city will conduct its second and final hearing on the 2016-17 fiscal year budget on Wednesday, Sept. 21, at 6 p.m.

The commission expressed unanimous support for the proposed budget presented by Mayor Dan Murphy at the first budget hearing on Sept. 7.

Proposed as a balanced budget, the 2016-17 budget anticipates the city receiving $4,738,514 in total revenues and spending the same amount in city expenditures.

The new budget represents an increase of $239,657 over the 2015-16 budget adopted last fall that anticipated $4,498,857 in total revenues and expenses.

The current fiscal year will end on Sept. 30, and the latest projections included in the budget documents predict

The fiscal year budget planning process that has taken place inside Anna Maria City Hall in recent months will conclude this week. the 2015-16 budget will close out lower than projected last fall, at $4,058,364.

Anticipated year-end expenses are expected to be $676,757 lower than what was budgeted for last fall, and anticipated final operating income is expected to be $440,494 lower than projected last fall, resulting in a projected increase of $236,263 to the city’s general fund.

The budget documents presented to the commission state the city is expected to have $2,456,057 in unbudgeted reserves as the end of the 2015-16 fiscal year.

Revenues

Using the same 2.05 millage rate levied in recent years, the new budget calls for the city to receive $1,769,243

in ad valorem tax revenues. Due to increased assessed property values, city taxpayers on average will see their property tax bills increase by more than 9 percent, which in turn will generate an estimated $191,542 in additional tax revenues for the city.

The budget projects $961,700 in license and permit fee revenues, including $454,700 in vacation rental registration fees, $450,000 in building permit fees and $57,000 in planning fees.

The city is expected to receive $596,424 intergovernmental revenues, including the half-cent sales tax, multiple gas taxes and the five-cent local option tax.

The $514,686 in projected miscellaneous revenues includes $142,786 in rent payments from pier tenant Mario Schoenfelder.

The budget anticipates $490,431 in stormwater utility revenues, including $155,931 collected from property owners who pay annual stormwater fees and a $278,000 grant from the Southwest Florida Water Management District. see budget, page 12

Fire district receives grant for three firefighters The firefighters will work out of Fire Station 3 in Holmes Beach.

BRADENTON – West Manatee Fire & Rescue Station 3 in Holmes Beach will receive three new firefighters thanks to a federal grant.

Fire Chief Tom Sousa reported to fire commissioners last week that the district received a SAFER (Staffing for Adequate Fire and Emergency Response) grant in the amount of $564,243, which will cover the cost of salaries and benefits for three firefighters, one per shift, for 24 months. After the 24 months, the fire district will be responsible for paying the firefighters’ salaries and benefits.

“We cut two administrative positions and will have the funding that will cover half the cost of the three positions,” Sousa explained.

He said the grant would allow the district to meet the NFPA (National Fire Protection Agency) Two In, Two Out Rule, which allows two firefighters to go into a structure while two remain outside.

ALS engines

Sousa reported that work continues on the district’s proposal to enhance emergency medical service delivery from first responder to advanced life support (ALS) While there is no provision in the county’s ordinance to allow for that, and he and other fire chiefs are attempting to address that issue.

In addition, he is working with the

North Collier Fire District in an attempt to further legislation to exempt fire districts from having to get permission from their county to provide the service.

Commissioner George Harris declared, “This is great. The ball is finally rolling.”

Commissioner Al Robinson asked why county governments are opposed to fire districts having that capability.

Sousa said it is a political issue and added, “It’s not about that. It’s about getting there and starting care and saving lives.

“Collier is taking the lead and has asked for our help. Collier wrote the bill, and I will be asking Rep. (Jim) Boyd to sponsor the bill.

Commissioner David Bishop said he has received anonymous negative emails regarding the district’s efforts.

In other business

• Commissioners approved the contract with Suncoast Professional Firefighters’ Local 2546. Union members approved it on Sept. 7. The contract will be retroactive to Oct. 15, 2015, and expire Sept. 30, 2018.

• Commissioners learned that two personnel accepted the new fire boat in New Orleans last week, and it will be delivered to Bradenton on Wednesday, Sept. 21.

• Commissioners approved moving the cell tower revenue to the general fund.

• Commissioners approved the first reading of the amended firefighter retirement plan.

• Dan Douglass, of Manatee Commercial Real Estate, told commissioners that the day care property adjacent to Station 1 in Bradenton is for sale.

Expenses

The city anticipates $1,985,145 in total operating expenses for the coming fiscal year. Of that, $1,114,908 is attributed to personnel costs that include $693,373 in regular salaries and wages, $143,000 for insurance, $67,798 for retirement contributions and $50,094 for FICA taxes.

The city’s contracted professional services expenditures during the fiscal

year that begins Oct. 1 will include $688,236 for Sheriff’s Office services, $276,980 for attorney fees, $138,000 for building official services, $65,000 for city planner services and $25,000 for the city engineering services.

The attorney fees include an estimated $150,000 budgeted to the Code Enforcement Department for the defense of the city’s vacation rental ordinance. These fees will be offset in part by vacation rental registration fees that will range from $951 to $695

per rental unit, depending on whether vacation rental owners take advantage of the discounts being offered to those who pay early and file their registration paperwork electronically.

The budget calls for $490,431 in stormwater maintenance projects, $340,593 for road maintenance and $7,000 for sidewalk replacement and beach walkovers.

The budget anticipates $250,000 to be spent on preliminary services associated with the future rehabilitation of

the Anna Maria City Pier, but Murphy hopes to recoup those costs from other sources.

The budget includes $192,345 in monthly loan payments for the City Pier Park property and an additional $100,000 lump sum payment that will further reduce the city’s interest expenses. It also calls for $59,275 in improvements for City Pier Park and an additional $8,500 for a new flag pole and sign at that location.

Tree house attorney appeals petition denial A judge ruled that a proposed ordinance for an initiative petition could not be submitted to voters.

HOLMES BEACH – Tree house attorney David Levin on Sept. 6 filed an appeal of Judge Don T. Hall’s final order that the proposed ordinance regarding an initiative petition was prohibited under Florida law and could not be submitted to voters.

The initiative petition filed in 2013 by tree house owners Richard Hazen and Lynn Tran sought to allow voters to decide if the tree house in front of Angelino’s Sea Lodge at 103 29th St. is legal.

The city alleged that the petition would be invalid under state law because the process is prohibited with regard to development orders. The city attorney requested a declaratory judgment, which was heard by Hall on July 15.

However, tree house attorney David Levin maintained that the prohibition in state law applies to a development order and that the tree

house is an accessory structure.

Hall agreed with the city and said the ordinance acts as a development order and the city is permanently prohibited from submitting the proposed ordinance to voters.

In other action, a special magistrate ruled in a May hearing that Hazen and Tran did not bring the property into compliance with a code enforcement board order by removing the violations or demolishing the structure.

The magistrate ordered a fine of $50 per day starting from July 22, 2015, but Levin has appealed the ruling.

Commissioner Carol Soustek asked if an “established business on the Island wants to sell to a chain. How would we approach that?”

“If business X were to sell to business Y, then Y can’t get a sign because it’s a new formula business,” replied Petruff.

“You can’t stop the contractual relationships between the parties, but you will not grant a license to the new business.”

Commissioner Jean Peelen said people used to joke about franchise businesses moving to the Island because “there was no business in the summertime and fall.

However we are becoming more and more a year ‘round vacation spot and that’s being sold by the TDC (Manatee County Tourist Development Council).

“They’re pushing the shoulder seasons – spring, summer and fall, therefore, we’re becoming very attractive to formula businesses, so this is the perfect time to enact this.”

Commissioner Pat Morton agreed and said, “The Island used to shut down in May and start back in November.”

Chair Judy Titsworth said after the final passage of the ordinance, the mayor and staff will come back to the commission with possible solutions.

Anchorage to get more policing

BRADENTON BEACH – The City Commission has approved an interlocal agreement that will allow for $93,208 in Community Redevelopment Agency (CRA) funds to be used for city services provided within the CRA district during the new fiscal year that begins in October.

Approved in the form a resolution at the Thursday, Sept. 15, commission meeting, the agreement provides a funding mechanism that allows the city to assign certain costs to the city’s restricted CRA fund rather than the general fund that covers the majority of the city’s annual operating costs.

CRA funds and general funds are both controlled by the commission and one of the primary purposes of the agreement is to provide additional policing in the CRA district, which in turn will free other officers to patrol the rest of the city.

The CRA district’s current boundaries extend from the south side of the Cortez Bridge to Fifth Street South.

When the interlocal agreement takes effect next month, Police Chief Sam Speciale will have the discretion to assign two officers to work five-hour shifts during peak periods for a total of 20 combined hours per week. The CRA fund would be charged $35 per hour for the additional policing and over the course of a year that could amount to a maximum cost of $36,800.

When the interlocal agreement was discussed last week, it was noted that the agreement originally included funds to purchase two Segways for the officers patrolling the CRA district to use. Speciale told the commission that his officers were not comfortable with the idea of riding Segways, so the agreement was amended to allow for the purchase of an ATV utility vehicle for use in the CRA

district.

In addition to law enforcement, the agreement also pertains to services provided to the CRA by the building and planning departments, the city attorney, the city treasurer, the city clerk, the city engineer and the Public Works Department.

This includes services provided by City Attorney Ricinda Perry as part of the efforts to update the city’s currently outdated CRA plan. The goal is to create a new CRA plan that clearly defines what projects can be pursued within the CRA district using CRA funds received from various taxing authorities. The city receives between $200,000 to $300,000 a year in CRA revenues.

The city commission has expressed its desire to expand the CRA district boundaries to include the navigable waters that serve as an unmanaged anchorage south of the Historic Bridge Street Pier. Including this area in the CRA boundary would allow CRA funds to be used to police the anchorage using the police boat and other means of enforcement.

In accordance with an ordinance adopted in 2009, the Bradenton Beach Police Department already has policing authority that extends 1,500 feet from shore from the centerline of Eighth Street South to the southern right of way of Cortez Road.

“Once the CRA boundaries are expanded, I can use CRA funds to put an officer out in the anchorage, and it won’t affect my general fund budget,” Speciale said later in the week.

“Right now, every time I put Officer Eric Hill out there, that comes out of my regular budget,” he added, noting that the annual police department budget does not provide for extensive marine patrols.

Additional policing of the anchorage would allow for better enforcement of new state laws that apply to vessels that do not comply with safety and environmental regulations.

“If the city of Holmes Beach allows The Center to continue to bully everyone around, show no respect for the taxpayers or the

city officials that have continued to support them through years of unstable practice, then the city is sending a poor message to its residents, taxpayers and small business,” she said. “It's time to stand up for what is right and protect our taxpayers and businesses.

“The Center is using public funds to run my small business out of business. This, essentially, is a government taking without just compensation, and I'm pretty sure that it's a violation of my constitutional rights as well.

“Please show Holmes Beach that it's city leaders care to protect its small business, residents and taxpayers. I urge you to withhold the ‘pathetic’ contributions and keep the funding within Holmes Beach to be used on more productive community development programs.”

Turtle laws still apply

It ain’t over ‘til it’s over, Suzi Fox reminds Anna Maria Island beachfront residents and visitors.

Sea turtle nesting season does not end until Oct. 31, and in the meantime, turtle laws apply, including those prohibiting beachfront lighting and leaving furniture and other objects on the beach after dark, the director of Anna Maria Island Turtle Watch and Shorebird Monitoring said.

People are saying they don’t see any nests on the beach and are turning on their beachfront lights in violation of the law, she said.

But some nests are unmarked because summer storms washed the stakes away that mark the nests, Fox said, adding that just because a nest – marked or not – is not in front of a certain property doesn’t mean that a hatchling won’t come out of a nest farther down the beach and be disoriented by a light at that property.

During sea turtle season, May 1 – Oct. 31, please follow these tips: • Turn off lights visible from the beach

and close blinds from sundown to sunrise; lights confuse nesting sea turtles and may cause them to go back to sea and drop their eggs in the water, where they won’t hatch.

Light can also attract hatchlings away from the water.

• Don’t use flashlights, light sticks, or cell phone or camera flashes on the beach at night.

• Remove all objects from the sand from sundown to sunrise; they can deter sea turtles from nesting and disorient hatchlings.

• Fill in the holes you dig in the sand before leaving the beach; they can trap nesting and hatching sea turtles, which cannot live long out of the water.

• Don’t use sky lanterns or fireworks; they litter the beach and Gulf.

• Do not trim trees and plants that shield the beach from lights.

• Never touch a sea turtle; it’s the law. If you see people disturbing turtles, call the Florida Fish and Wildlife Conservation Commission’s Wildlife Alert hotline at 888404-FWCC (3922).

gauge his interest in selling the property at 106 Third Street South that is adjacent to Spallino’s property. Spooner believes the two properties combined would provide the space needed for a 200-space parking facility.

Spooner provided the commission with some basic information he obtained from Current Builders regarding a parking garage that firm built for the city of Delray Beach in their downtown area and he estimated to cost of the project to be in the neighborhood of $4 million.

He said Spallino has already received an offer for his property, so time would be of essence if the commission wished to pursue the idea of purchasing his property.

“I think it’s a great idea,” Commissioner Jan Vosburgh said.

During the impromptu discussion that ensured, Mayor Bill Shearon acknowledged that the potential parking garage location next to the public works building that he proposed a week earlier was too small to accommodate a multi-story parking facility.

Spooner suggested the county might be willing to help fund the construction of a parking structure, but he doubted the county would assist with the purchase of any needed land.

He also said his conversations with city staff indicated the city’s comprehensive plan would have to be amended to allow for a stand-alone parking facility. The comp plan currently only allows for parking elements directly associated with a specific business or businesses.

One scenario would involve a partnership with Spallino in which he providing his land to the city in exchange for a share of the revenues generated by a parking garage. The city would then purchase Hardesty’s property in order to provide the additional space needed for a parking facility.

retirement revenue out of the deal,” Spooner said.

The alternative scenario would involve the city purchasing both properties.

Spooner envisions using an automated payment system that alleviates or minimizes the need for fee collection and enforcement personnel. He said the city’s share of the parking revenue could be used to pay off any debt incurred and after those obligations are met, the parking garage would provide a continued source of revenue for the city.

Is your house ready for the competition?

S

elling your home may not qualify as an Olympic sport, but you can bet there will still be plenty of competition. If this is the year you decide to sell and move on, you need to get your house in shape, and it’s going to take more than a stroll around the block.

For most people, it really doesn’t take a lot to get your house ready for sale. Of course, there are homeowners who have put off not only updating projects, but also maintenance projects, and they will be paying the price.

But for the majority of us, it’s a lot easier. This week let’s talk about staging your home, and next week we’ll tackle the not so much fun stuff like maintenance and renovations.

We’ll start with the item that is always at the top of every “getting your house ready for sale” list – getting rid of the clutter. Getting rid of clutter doesn’t only mean picking up the shoes, toys and stack of mail lying around. It also means getting rid of actual pieces of furniture and reducing the clutter in the closets.

Castles in the Sand Louise Bolger Storage space is always a selling factor. Professional home stagers frequently eliminate half of the owner’s furnishings, making the house look much bigger and eliminating the distraction of furniture. In addition, too many personal items will also distract buyers who may be more interested in your daughter’s wedding pictures than the fresh coat of paint on the walls.

Too many of us have rooms that either have no purpose or a purpose that is not customary to the average buyer. For example, bedrooms converted to music rooms and family rooms converted to formal dining rooms that may only be used on Thanksgiving and Christmas.

Time to repurpose these spaces so they appeal to traditional buyers. Put the formal dining room set in storage and furnish this space with a few comfortable sofas and a large screen TV, and replace your son’s guitars with a desk and some soft lighting.

Give yourself permission to move the furniture. Just because the armchair has been in the same spot for 10 years doesn’t mean it’s anchored to the floor. It may actually work better in another room, perhaps the former music room. Another staging trick is to float furniture away from the walls, creating conversational groups with a user friendly flow.

Also add green plant elements to cozy things up along with a very few decorative items like books, baskets and neutral pillow accents. If you’re an art collector, remember that every square inch of a wall does not need to be covered better to let the walls breathe a little.

Making a small investment in new bedding, bathroom towels and throw rugs to perk

up older tile floors will end up being a great return on your money. It’s also something you can take with you when you move.

Finally, staging is all about lighting, something that is frequently overlooked. The rule of thumb is a total of 100 watts of light for each 50 square feet. That should be spread out among ambient overhead, task lighting using pendant, under cabinet or reading and accent lighting using table lamps and wall accents. Sounds complicated, but the objective is to create a warm and welcoming space with great lighting.

Next week, we’ll talk about some of the more practical things you need to do before selling, so break out the rubber gloves. You may not be able to buy your house running shoes to get it in shape, but you will be able to buy it a can of paint and a bottle of bleach.

The Island Players open their 68th season with “The Red Velvet Cake War,” by Jesse Jones, Nicholas Hope and Jamie Wooten, which will run from Thursday, Sept. 29 to Sunday, Oct. 9. Mike Lusk is the director, and Bortell’s Lounge is the co-producer.

The play is about a wacky Southern family’s reunion in the heat of July and in the middle of tornado season in Texas.

There will be plenty of laughs and Southern drawls.

For Team Moss Builders, Emily Moss and Rainia Lardas presented a tough team presence in the late night game, playing a strong defensive game and making Tyler’s Ice Cream earn every yard.

Once again the Sato family, sprinkled with two Aldersons, are featured in the game of the week, but this time they came away with the win for Team Tyler’s Ice Cream. The loss for Moss Builders and all of the Moss family players, with the exception of Jon Moss who plays for Beach House Real Estate, brought each of the teams’ records to 2-2 for the season.

Moss Builders, led by captain Ryan Moss, started on offense. Hitting his offensive weapon, the first pass of the night was to Andrew Terman for a 15-yard gain. Jordan Ganey was the target for the second down pass, which lead to the first touchdown play to Terman in less than three minutes.

The impeding the rusher call against Team Moss Builders negated the extra point attempt, leaving the score at 6-0.

After the incomplete pass to Rob “Ice Cream” Alderson on first down, L. Sato caught the first of her 35 total receiving yards in the game. E. Moss quickly made the flag pull to stop L. Sato’s forward progress and prevented what could have been a breakaway play down the sideline.

With intense defensive pressure, Josh Sato threw the third down pass over the head of his sister-in-law, giving the football back to Moss Builders.

In an attempt to gain yardage, Terman worked hard to evade Tyler’s Ice Cream defenders, gaining five yards down field, despite many more yards laterally. Team Moss Builders’ offensive run was cut short with an interception by Josh Sato.

Hoping to increase their lead, R. Moss gave Terman the ball behind the line of scrimmage, giving him the option to run or pass the football. Terman saw Lardas wide open, but threw it over her head.

Getting the football to the most reliable player on the field, Gillum made the first down catch. The initially missed flag pull allowed Gillum to gain significant yardage before heading into traffic between R. Alderson and L. Sato.

Taking the football in the shotgun position gave R. Moss critical time to get the play off, despite N. Sato almost stopping the play with a tipped pass. L. Sato quickly followed up with a quick flag pull ending Terman’s run after the pass.

With five minutes lit up on the scoreboard, the pass by R. Moss was nearly picked off by a sprinting Josh Sato.

Challenging the referee’s call, Josh Sato lined up defensively, fired up and ready to prove a point.

behind the line of scrimmage between R. Moss and Terman, R. Moss ended up with the football and threw an intercepted caught by Josh Sato who ran past the Moss Builder’s defense. With the last missed flag pull by R. Moss, the ballgame was tied 6-6.

Back on offense, two consecutive passes to Gillum gave Moss Builders another first down. The incredible defense by Ben Sato stopped the forward momentum and score by Moss Builders, taking the game to the second half of play.

Neither team having a weak player set the stage for a close matchup in the game of the week. With the start of the second half of play and a one point lead for Tyler’s Ice Cream, the first play of the second half to L. Sato set the stage for final 20 minutes of the game. L. Sato’s reception was met with a fired up E. Moss. Ready to chase her opponent down, E. Moss snagged the waiving flag preventing the L. Sato score.

Finishing the game with 140 passing yard, elder Sato hit L. Sato and Josh Sato in the next two plays to gain the first down. In an unfortunate play, Jason Sato’s pass was tipped up by teammate R. Alderson, giving R. Moss the opportunity to intercept the ball in a heads up play. R. Moss raced down the length of the field for a Moss Build-

ers touchdown.

After snapping the ball, Gillum sprinted into the end zone for the extra point, taking the score to 13-7.

With a Moss Builders lead of six points, both teams were unsuccessful during their next possessions. Regaining the football, Tyler’s Ice Cream’s Alderson nabbed the third down catch just over the first down line, with Terman holding on to the pants of the receiver and getting the holding penalty call.

L. Sato made the next catch with speedy lateral yardage to get within five yards from the score. The diving catch attempt by L. Sato was called incomplete. The unending fight of L. Sato resulted in a one-handed catch, pinning the football against defender E. Moss in the end zone for six points, tying the ballgame.

The extra point jump catch by Josh Sato in the corner of the end zone gave Tyler’s Ice Cream the 13-14 lead.

The game clock had ample time for the experienced and calm R. Moss to take his team to victory. Terman was R. Moss’ go to man for three consecutive plays, giving Moss Builders the first down with 90 seconds left on the clock.

Despite the effort by a determined Moss Builders, Tyler’s Ice Cream maintained the lead as the last second of the clock ticked off giving the Sato/ Alderson family team the one point win, closing out the fourth week of the eight week season.

Anniversary for TIFF’s Initiative

Christine Olson, who works at the Rod & Reel Pier restaurant, started TIFF and TIFF’s initiative after her daughter, Tiffany, died in an accident 10 years ago and she was not notified for several hours because her daughter did not have ID with her.

She contacted authorities in most states asking them to make sign up material available so that drivers can have their contact information recorded with a registry. First responders and police can find out who to inform when someone is injured or killed in an accident.
