Understanding The Cedar Ridge Select Internet Auction Simply sit down at a computer and enjoy looking at and evaluating dozens of the finest Arabians and Half-Arabians available all at one time in one place. View videos of each horse as well as pictures and full description, along with the seller’s comments. (Individual equine health reports are available on CD.) Call the seller’s agent to discuss any questions you may have about the horse. If you want to inspect the horses in person, come to Cedar Ridge Arabians at 6:00 p.m. on Tuesday, February 16, 2010, to view a presentation of all the horses across the stage, or you can contact Leah Beth Boyd to schedule a private showing of any horse. You decide when to shop. You decide how much to spend. You evaluate medical records before bidding. You decide, and your decisions are completely confidential. With Internet auctions, the process is simplified. You make a bid and continue bidding until you’ve reached your maximum. Or, you can enter a maximum bid and the auction program will bid on your behalf in $250 increments over the last competitive bid, up to your maximum. You can check at any time to view the current high bid amount and the user name (confidential code name) of the high bidder. If you want to purchase the horse at any time for the stated “Buy Now” price, you can do so and the auction will immediately end on that horse. How Do I Buy A Horse At The Cedar Ridge Select Sale? Get started using these steps: 1. Register. It all starts with registration. Fortunately, it’s free and fast. Register now or learn more about it by contacting one of the professionals from the Cedar Ridge Select Sale (CRSS) team. 2. Choose a horse. Browse through our list of horses on our CRSS home page or our sale catalogue. 3. Learn about the horse you’re interested in. Read the horse’s description carefully. If you have any questions about the horse, you can ask the seller or talk with any of the professionals from the CRSS team to discuss the horse’s pedigree, training, health and show ring potential. 4. Review the seller’s reputation. Talk with previous buyers from the Cedar Ridge Select Sales to be certain that this is a seller you feel you can trust. 5. Bid Or Buy Now. Check the horse’s page to see what purchase options are available for that particular lot. You can either place a bid on an item or purchase it instantly using BUY NOW. Remember, all bids are active until the auction ends. If you win a horse listing, you are obligated to complete the transaction. 6. Pay For The Horse. After you’ve won or bought a horse, payment must be made to Cedar Ridge Arabians within one business day from conclusion of the sale. CRSS will let you know how and where to make your payment. If you’re picking up the horse, you may pay by any method that CRSS accepts. Listing & Buying Options Buy Now – Sellers have opted to place a BUY NOW feature on many horses, allowing a bidder to pay an established price, thus ending that sale. However, once a bid is placed within $1,000 of the Buy Now price, the BUY NOW feature will disappear and not be available again. Reserve Listing – Some sellers may have chosen to establish a confidential RESERVE PRICE. In the event the highest bid does not meet the RESERVE PRICE, the seller/agent may decline to complete the transaction. Staggered Endings – We have scheduled the END OF AUCTION times to be staggered, allowing buyers to take the opportunity to compete with other buyers for specific horses, should that situation arise. These staggered END OF AUCTION times also give the buyer the option to bid on other horses should they not be the winning bidder on a previous lot. The end time will be pre-determined or 5 minutes after the placement of the last bid, whichever is later. Important: Checks, money orders, and bank wire transfers are allowed for most purchases. Neither the Consignor, Cedar Ridge Arabians, Inc. nor any other person is authorized to make representations or warranties about any horse. No oral or written statement constitutes a warranty, and all such oral or written statements, other than those contained herein, shall not be relied upon by any bidder or buyer, and are not part of any contract of sale. TITLE AND DELIVERY: Title passes to the buyer at the close of auction and is subject to payment of all or such part of the purchase price. All risk of injury to the horse becomes the buyer’s risk upon close of auction. The horse will be held for the buyer by the Consignor until the buyer makes full payment as provided below. The right of a successful bidder to purchase, as determined by the auction site, is not impaired in the event that an Acknowledgement of Purchase is signed by another bidder. Upon settlement by the buyer, the horse shall be released to the buyer with a Stable Release provided by the Consignor. The buyer shall present the Stable Release to Cedar Ridge Arabians, Inc. to remove the horse from the sales premises after taking possession, but in any case taking possession of the horse by the buyer shall constitute delivery thereof. If the buyer fails to cause any horse to be removed promptly, will result in board charges from Cedar Ridge Arabian, Inc at a rate of $20.00 per day, this will be at the buyer’s risk and expense. LIMITATION OF LIABILITY: The buyer’s exclusive remedy for any breach shall be limited to the return of the horse (as described in the following paragraph) and repayment of the purchase price received by the Consignor, less commissions and costs of sale. The liability of the Consignor or the Consignor’s agents with respect to any sale or anything done in connection therewith, whether arising out of contract, negligence, strict liability warranty or otherwise, shall not exceed the total purchase price, less commissions and cost of sale, of the horse upon which liability is based and which has been received by the Consignor. Except to the extent set forth in this and the following paragraph, the buyer shall not under any circumstances be entitled to, nor be able to, recover any damages, including but not limited to consequential damages, incidental damages, special or general damages or loss of other property, or loss resulting from any general or particular requirements and needs of the buyer. RIGHT OF RETURN: Any horse sold in this sale that does not conform to the representations and warranties set forth herein, shall be subject to return to the Consignor in exchange for a refund of the total purchase price, less commissions and costs of the sale, and reimbursement for reasonable expenses for keep, maintenance and transportation of the horse from the close of auction PROVIDED THAT WITHIN FORTY-EIGHT (48) HOURS AFTER THE CLOSE OF AUCTION AND PRIOR TO REMOVAL FROM THE SALES PREMISES, THE CONSIGNOR RECEIVED WRITTEN NOTICE FROM THE BUYER THAT SUCH A NON-CONFORMING CONDITION EXISTS, AND THAT THE SAME EXISTED AT THE TIME OF SALE. TIME IS OF THE ESSENCE IN RETURNING A HORSE ALL WARRANTIES. TERMINATE FORTY-EIGHT (48) HOURS AFTER THE CLOSE OF AUCTION, AFTER WHICH THE BUYER
SHALL HAVE NO RIGHT OF RETURN UNDER THIS PARAGRAPH. The right of the buyer to return the horse as provided herein to the Consignor shall be the sole and exclusive remedy against the Consignor with respect to the warranties, and the Consignor shall not be liable for any further actual or consequential damages.

ASSUMES NO RESPONSIBILITY FOR THE CORRECTNESS OF ANY CATALOG OR OTHER DESCRIPTION OF A HORSE, OR ANY OTHER INFORMATION WITH RESPECT TO ANY HORSE, WHETHER CONTAINED IN THIS CATALOG OR OTHERWISE. BIDDING: The highest bidder recognized by the auction site shall be the buyer. Bids tendered after the fall of the close of auction are not valid grounds for the dispute. If any dispute arises between two or more bidders, or in the event of doubt on the part of the auction site as to the validity of any bid, the auction site will have the final discretion either to determine the successful bidder, or to re-offer and resell the horse in dispute. The auction site’s sale record is conclusive and is not subject to challenge. The auctioneer reserves the right to reject any bid. DELIVERY TO BUYER: No horse shall be delivered to the buyer until payment in full has been received in full by one or more of the means set forth below.
BUYER’S PAYMENT: The buyer shall pay for the horse within one (1) business day of the conclusion of the sale, and shall pay CEDAR RIDGE ARABIAN, INC the total purchase price (or as described in terms) by one or more of the following means: U.S. currency, cashier’s check, traveler’s check, personal check, Credit Cards accepted: (with a 3.5% user fee) Visa, Master Card or American Express, subject to clearance prior to the release of the horse. TERMS: Cash Purchase - Buyer shall pay purchase price in full as described in buyer’s payment.
DEFAULT OF PURCHASE: If any person shall purchase a lot and fail to pay for it in the manner described above, the Consignor shall have, in addition to all other legal rights, the right to resell the lot, or at his option, bring an action for specific performance, in which event the defaulting buyer agrees to pay all costs of such suit, together with all reasonable attorney’s fees and cost. In the event of a resale the defaulting buyer agrees to pay all cost of resale, plus any deficiency between the original total purchase price and the total purchase price upon resale. TRANSPORTATION: The buyer, at his own expense, shall transport the horse from the sale premises.
LAW AND TAXES: These Terms and Conditions of Sale shall be construed and governed by the laws of the State of Arizona in effect as of the date of the sale, and any dispute shall be resolved pursuant to the laws of the State of Arizona. Jurisdiction and venue shall be in Maricopa County, Arizona. Each buyer agrees to pay any city, county or state sales, transaction, privilege, or use tax which may be claimed because of the buyer’s failure to qualify for an exemption. Applicable Arizona State sales tax rulings and state statutes may apply. WITHDRAWAL RIGHTS: The consignor and Cedar Ridge Arabians, Inc. reserve the right to withdraw any horse from the sale without liability to anyone.
INSURANCE: Immediate full mortality insurance coverage is effective upon the close of auction for the amount of the total purchase price. The insurance coverage is effective upon the close of auction, for the amount of the total purchase price. The insurance, arranged by the Sale Management with C. Jarvis Insurance Agency of Solon, Ohio will remain in effect until the purchaser signs the contract or until midnight of the first business day after the sale, whichever occurs first, by which time it is the obligation of the new owner to arrange permanent insurance if desired. RESERVES: Sale Management will allow Consignors to establish a reserve, which is the confidential minimum price below which such lot will not be sold. The auction site may implement such reserves by bidding on behalf of the Consignor.
