FROM THE EVP’S DESK Count Your Change If there’s one constant in life, besides death and taxes, it’s change. And by change I don’t mean those loose coins in between your car seats. I mean real change as in transformation or modification. Change is happening all around us and it’s happening every day. For recent changes we needn’t look any further than our own industry; Look how fast the now-ubiquitous world of technology has changed the way we do business and communicate with our clients. Look at all the construction going on along the Gold Line corridor or our recent Lockbox exchange – change is happening all around us and it’s happening every day. It’s important for us to embrace the fact that change is essentially good - there are term limits with our politicians for a reason. One of the most corruptive phrases we learned at some point in our lives is, “if it ain’t broke, don’t fix it”. These seven small words are largely responsible for impeding the self-improvement and forward progress for countless numbers of people. If we aren’t constantly trying to improve our own lives, our families lives, our communities, etc., then we will forever be condemning ourselves to eternal life in the present. If we aren’t moving forward we’re moving backwards. To get ourselves out of a potentially career-ending rut or slump, we need to start by making a change now. But take heart. Beginning a self or career -metamorphosis doesn’t have to be radical at first. We can start slowly by doing small, simple, bite-sized changes to ease us into the mindset of change. The emphasis here is on the keyword “mindset” because at the end of the day making changes starts and ends in our heads. These small changes to start you on the road to change can be as easy as driving a different route to the office (great way to spot new FSBOs), or answering the phone with a different business greeting or even sitting in a different seat at Wednesday’s MLS Marketing Meeting (I know some people who have sat in the same seat for more than 20 years – you know who you are!) Are these examples too simplistic? Of course, but that’s the point. These small changes will actually cause you to think while doing them and as mentioned, thinking about making a change is the start. Whatever your first change is, the point is to make at least one small change now to get over the huge hurdle of making a change in the first place. Then build upon that. Unfortunately, as creatures of habit, we’re naturally predisposed to be reluctant towards change. So were the dinosaurs - and look what happened to them.

By Dave Freeman, Association Counsel 1. RECONVEYANCE OF NOTE AND TRUST DEED: When a Promissory Note is paid off, the property owner should receive the original Promissory Note, signed and marketed, “Paid in full”. Also, they should receive the Reconveyance document and record same in the County Recorder’s office. Occasionally, the bank or lending institution fails to record the Reconveyance. But where the problem arises more often is where the loan was made by a private party, for instance a carry back seller. When the Note is paid off, frequently the borrower and the lender are not even aware a Reconveyance must be recorded, and when the property is to be sold or refinanced, the old Trust Deed is discovered by the title company. At this point, the original lender may not be locatable, or may have passed away, causing serious problems in getting the Reconveyance signed and recorded. The solution at this point is to file a suit to Quiet Title, which is expensive and time consuming. Further, the borrower must show records that the loan has been paid off. Best solution: Advise your clients and friends to get the Reconveyance recorded and the original Promissory Note signed off and returned, or a similar document signifying final payoff of the Note. 2. EASEMENTS: Easements are usually created for access (ingress and egress) to a property. Sometimes the easement is the only way in and out of the property, other times it is an alternate access. Easements can be created by a written document granting the right to pass, or they can be acquired by prescription (open and obvious use of the area for the purpose of ingress and egress, without permission, for a period in excess of five years). Other easements frequently found involve access for plumbing,

electrical and cable conduits. They can be overhead or underground, and are usually granted by written documents to utility companies. Easements, particularly prescriptive easements, frequently lead to lawsuits, resulting from the disagreement as to the existence of a right to pass, the location of the easement or the amount of usage permitted. When purchasing a property, it is important for the purchaser and their agent to walk the property and look for any obvious usage by neighbors or other property owners which might be, or ripen into a form of an easement, as title insurance will not discover or insure prescriptive easements. Title will generally pick up and insure granted easements. 3. 1031 TAX DEFERRED EXCHANGES: As the market is picking up, more people are participating in 1031 exchanges. Some important points to consider: A. Property can be converted from residential to investment, and vice versa, but one should wait a reasonable period of time after the conversion prior to the 1031 exchange (some experts estimate one year). B. The 45 days from close of escrow to identify the replacement property is generally the most difficult grant of qualifying for a 1031 exchange. Therefore, it is advisable to include in the counter offer that the seller will: 1. Have the option of extending the close of escrow by 30 days (perhaps

twice), or 2. The sale will be contingent upon the seller finding a satisfactory replacement property for the exchange. C. The 1031 exchange does not eliminate the tax responsibility, but defers it until the eventual sale of the property without a doing a 1031 exchange. However, if the exchangor continues to do 1031 exchanges until they decrease, the heirs will receive a stepped up basis and the capital gains tax will be eliminated at that time. D. In order to qualify for a 1031 exchange, it is important to use a trustworthy Qualified Intermediary or Exchange Accommodator, that is both insured and bonded. There have been many cases in the past where the accommodator has either disappeared with the exchangor’s money or invested the money improperly (ask what the accommodator does with your money while holding it – banks are a good solution). Always consult with your tax advisor regarding the details of 1031 exchange, and ask questions of your Exchange Accommodator prior to and during the process of exchanging.

“Thinking Outside the Box at APRECE 2013” By Charles Gabriels, AAR Global Real Estate Committee Member

The Arcadia Association of REALTORS® has the honor of being a “sister Association” to the Singapore Institute of Estate Agents (IEA). They recently held their first Asia Pacific Real Estate Conference and Expo (APRECE) and the AAR was ecstatic to have several representatives present for this monumental event. A very good and dear friend of mine asked me prior to our departure for Singapore, “Why spend your time and money on a venture with an unknown and uncertain outcome”? My response? I do not want to wonder in a few years, how different my life might be, had I gone. So I signed up and went, with no regrets. Our current real estate market is abundant with REALTORS®. It is important to find a “niche” or to set yourself apart in some form. So, I asked myself, once I arrived in Singapore, how would anyone know who I was, why I was there and what I was about? Thus began my plan to set myself apart from the average Australian, American, New Zealander and others. Before leaving, I drove to a local Pasadena silk screen shop and purchased three white Polo shirts imprinted with advertising on the back (with my contact information) and on the front, a Malibu scenery on one, Surfing on another, and beaches on the third. I am quite sure my contemporaries in Singapore thought I appeared ‘tacky’, but I had a purpose for my purchase. Next, I bought two red silk ties, because red is a lucky/prosperous color in the Asian culture. I then

downloaded and printed several California Association of REALTORS® Referral Agreement forms, which I loaded into my briefcase in order to interface with those real estate agents from overseas. In additional preparations, I had new business cards printed, with the backside imprinted in large bold letters, “Contact Me For California Real Estate Investments” and I ran an ad in the real estate classified section of the Asian Wall Street Journal, hitting the streets of Singapore on the opening day of the APRECE Convention, stating my arrival, contact information and purpose. The final preparation task I completed was venturing to an Army/Navy Surplus store and purchased three American Flag patches, which I pinned on the lapel of my business suit and sports jackets. All of these things I did in the name of setting myself apart. I wanted to ensure that I would be noticed and therefore, remembered. I relay this all to you, to illustrate that the business of creating your “niche” and setting yourself apart is not “Rocket Science”. If you do not figure out a way to be and stay competitive, you will not be thinking “outside the box”. British author, James Allen once said: “All that a man achieves and all that he fails to achieve is the direct result of his own thoughts.” In closing, I’d like to thank AAR member Sandra Yap and her husband for organizing the travel to Singapore and also the AAR for helping to promote the event to our members.

“The Business of Insurance” By Pablo Pomes, Mercury Insurance Group

The field of insurance is very interesting because every homebuyer brings different situations. I enjoy the challenge of resolving unique transactions as well as the satisfaction of knowing I helped a family into a new home. The typical scenario includes a buyer finding the home of his or her dreams and opening a 60 to 90 day escrow. Although this process lasts a few months, it is highly recommended that the buyer contact his or her insurance professional right from the start. Just as important as it is to find the right home, it is equally important to finding the right insurance to protect this new home. The buyer should plan ahead so that the entire team can work smoothly in closing the escrow process. From the lender to the title, the home inspector, the appraisal and the home warranty, everyone works very hard in unison to complete an escrow transaction.
