Notice to Members of C.A.R. Review of Suspensions and Expulsions At their mid-year meeting in Washington D.C. the N.A.R. Professional Standards Committee approved a motion to allow California to adopt a procedure for implementation of a pilot program (2-years) so that a suspension or expulsion that is imposed by a local Association of REALTORS® for violation of the Code of Ethics shall be reported to C.A.R. to be reviewed by a panel of state directors, and possibly imposed on a state-wide basis. The Arcadia Association of REALTORS® (AAR) is participating in this program. If a REALTOR® is suspended or expelled by the AAR as a result of conduct that is in violation of the Code of Ethics, The AAR will file with C.A.R. a Suspension/Expulsion Report, which names the REALTOR® as respondent. The Report will be reviewed by C.A.R. and referred for hearing before a panel of three (3) C.A.R. Directors, to determine whether the suspension or expulsion should be imposed on a statewide basis. Like Bowie, Madonna and Apple Did To extend their musical careers, David Bowie and Madonna reinvented their personas and musical styles many times. Before Apple became the behemoth they are today, they nearly went bankrupt and by sheer necessity they created a new business platform. As REALTORS® and small business owners, there is a critical need for us to reinvent ourselves at least once in our business life, as well. There may be a moment, an inspiration, an event, a conversation or a pink slip that will cause us to start the reinvention process. And as the last 4 or 5 years of our ever-changing industry has taught us it’s that we must keep reinventing our business to adapt to new trends and the needs of our clients. In his book, Creative Approaches for the Cost Effective Organization, Steve Martin says there are five generations of corporate growth. The principals relate to us as independent contractors as well:
1. Work: The entrepreneurial stage.
2. Sell: Focus on sales growth and market share.
3. Cut: Focus on efficiencies to drive the bottom line.
4. Buy: Acquiring assets to reach the next level.
5. Think: All actions are proactive as intellectual and financial resources focus on knowing the next best step, instead of guessing.

While we’re reinventing our business, let’s not forget to do the same for ourselves. Each generation of a business’ growth requires a different type of personal thought process.
and parallel to, that of our business. Consequently, keeping our personal intellectual growth in sync with our business requires constant attention and honest self-analysis. But take heart, personal reinvention doesn’t mean you go from being a luggage handler to being the captain of the plane. It means that instead of being intimidated by technological advancements you actually become a visionary expert on how to leverage new capabilities Sometimes, circumstances require you to reinvent yourself whether you’re ready or not. Look around you and see how your peers have drastically changed their respective business models over the past 5 years. In closing, please remember this: Only REALTORS® and other business owners who embrace change can run and grow successful businesses. Be like Bowie and Madonna or be like a one-hit wonder - reinvent or be forgotten.

By Dave Freeman, Association Counsel 1. STOPPING FORECLOSURE: If your client and/or you are working on a loan modification or short sale, but the lender records a Notice of Default, and the property goes into foreclosure, action must be taken. The lender will frequently tell you that the property is not in foreclosure, or that the foreclosure sale has been postponed. Do not believe them, unless you have that statement in writing signed by somebody at the bank! They most often will continue with the foreclosure and your client will lose the property. If you cannot get the foreclosure sale postponed, with a signed document from the bank that the sale will not proceed, and if the client has good equity in the property or other reason to stop the foreclosure, one method is for the client to file bankruptcy, either Chapter 7 or Chapter 13: A. Chapter 7 is a normal full bankruptcy whereby the client gives up their assets and has their debts removed. B. Chapter 13 is where the client agrees to pay their debt eventually, but needs time and a program by which they can pay less than they are obligated to pay on a monthly basis until they get back on their fee. Either way, the filing of a bankruptcy action in the Federal Court immediately stops the foreclosure, giving you time to get the property sold, or some other solution, if there is decent equity in the property. Please be sure to get the client to a competent bankruptcy attorney well in advance of the foreclosure sale date so that this procedure and others can be discussed and prepared ahead of time. 2. USE THE CORRECT NAME (COMPANY OR TRUST): Two different situations elucidate this point: A. Recently a contractor sued for over $200,000.00
owed to him. The contract, the contractor’s license and the lawsuit all bounced back and forth between the company’s name with L.P. (Limited Partnership), Ltd. and even Ltd. L.P. The homeowner who owed the money refused to pay, and fought the contractor based on the incorrect name being used on the contract (different from his license). Although the contractor eventually prevailed, he had to go through a Superior Court action and trial and an Appellate Court action in order to do so. Use your proper company name when signing contracts and encourage your clients to do the same. B. Recently a purchase contract was entered into using the husband and wife’s names. During escrow it was discovered that the title to the property was actually held in the name of the trust. When the sellers backed out of the transaction, they argued that the owner of the property (the trust) had not even signed the contract. Ensure that your contracts are not disputed, and that you get your listing commission. Make sure who owns the property (title search) prior to executing the Listing Agreement and prior to the Purchase Contract. 3. AGREED BOUDARY LINE: A year ago I wrote:
FENCES – ENCROACHMENT: A frequent question I receive concerns the location of fences or walls on or near the property line between properties. Frequently the fence/wall will have been in place for many years, and before either of the current property owners owned their respective properties. The neighbors then call or write, saying that they are going to remove the fence or wall because it is in the wrong location and encroaches on their property. My clients usually state that they have landscaped up to the wall, or used the property or don’t want to lose the extra yard area that they have enjoyed for many years since they purchased the property. The problem is: the property line is where the property line is, and a survey can show this location. The location of the fence/wall does not change the ownership and the property line. Usually, the party on whose property the fence/wall encroaches has the right to move the fence/wall to the property line or to the edge of his or her property. As you may recall, much of the San Gabriel Valley was once open range and then chicken ranches. Fences and walls were placed rather haphazardly, without exact surveys. However, long term placing of a fence or wall does not normally acquire the rights to leave the fence/wall in that location similar to a prescriptive easement. A recent Appellate Court case has just confirmed the above. Many cases have argued, some successfully, the Agreed Boundary Rule. This Rule was argued to apply where a fence had been in place long before the current owners, it appeared to be placed there by agreement and for a reason (large boulders, river beds, or canyons). It also required that it was difficult or impossible to perform an accurate survey at the time. Of course, an accurate survey can easily be drawn today. The Appellate Court ruled that unless an actual agreement can be shown to have been reached, the Agreed Boundary Rule would not apply. Therefore, the common sense does apply, and the paragraphs I wrote a year ago are still good law.

statement explaining why they believe the suspension or expulsion should not be imposed on a statewide basis. There will be no hearing to attend with C.A.R. A panel of C.A.R. Directors, in a closed session, will consider the documents submitted by the local Association, along with the REALTORS® written response and will determine whether to impose the suspension or expulsion on a statewide basis. The decision made by the Directors at such a hearing does not disturb the findings or recommended discipline of the local Association that initially imposed the discipline, but only determines whether or not there is a state-wide imposition of the same discipline. A decision by C.A.R. to impose the suspension or expulsion state-wide shall be disseminated to all participating associations in the state.

N.A.R. Leadership Conference - Chicago

Several AAR leadership members recently traveled to Chicago, Illinois to attend the annual National Association of REALTORS® Leadership Conference. Our packed agenda for the 3-day trip started immediately upon landing in Chicago. We had a chance to meet Rob Rueter, N.A.R. Young Professionals Network who set up a little “meet and greet” for those who arrived early.
Incoming 2013 N.A.R. Leadership members being introduced at the Leadership Conference. Here are some highlights from each committee / forum meeting we attended: • REALTORS® Political Action Committee (RPAC): The National Association of REALTORS® has funding to back political candidates, conduct polling and assist with advertising. N.A.R. is always looking for candidates to support land initiative in the local communities. • Commercial Forum: Commercial real estate is still lagging a bit behind both regionally and nationally. The bright spots are Multi-Family housing. Rental rates are the highest since 1999 and the vacancy rate is below 5%, which means that Multi-Family is currently a landlords market. This area is near 4.3%. Offices are still lagging a bit as well. Retail is making a nice comeback as both our imports and exports increase. • Young Professionals Network Committee: YPN attendees listened to speakers present different scenarios regarding what the future might hold for our Associations and our industry. This session was a wonderful experience to help encourage future leaders in our industry and promote the role of facilitation. On the final day, we attended several more meeting sessions. One session discussed REALTORS® mindsets of the future of real estate and the “American Dream” concerning the “Y” Generation. Generation “Y” makes up over 70 million people in the United States. That is 20% of today’s population – the largest generation since the Baby-Boomers, as defined by their numbers. This generation will have a huge social and economic impact. They are driven by social media and use technology for everything. They are laden with debt from student loans and home ownership is not important to them. What does that mean for us in the future? Marketing needs to adjust as more and more families and individuals cannot afford to live alone. Take action as changes in our market take place. Don’t wait to react but educate, think and plan with an open mind. So the question over the 5-10 year shift: “What is the new American Dream?” The Leadership Conference closed out with motivational speaker Captain “Sully” Sullenberger. Captain Sully is the pilot who landed his bird-ridden jumbo jet into the cold Hudson River in New York in 2009. He spoke of how leadership and teamwork kept everyone alive that day. He went on to show that we need to each trust in our teams and be a leader with ourselves and our clients. We have trained for this. Utilize your training.
Senator Dianne Feinstein Luncheon
Members of your Local Governmental Relations (LGR) Committee and Board of Directors attended a recent luncheon at the City of Hope to listen to an address by Senator Dianne Feinstein. Feinstein presented a Washington Report on healthcare and the economy. Her remarks were followed by a Q&A session at this luncheon co-sponsored by the City of Hope and the San Gabriel Valley Economic Partnership (SGVEP) of which the AAR is a proud member. AAR YPN Donates to American Cancer Society
At a recent MLS Caravan meeting, AAR Young Professionals Network Committee Co-Chairman, Kelvin Chang and AAR Executive Vice President, Andrew Cooper presented a check in the amount of $2,316.59 to representatives of the American Cancer Society, Beth Goldberg and Ann-Marie Dodge. This money was raised in a combined effort with both the Arcadia Relay for Life in June and the YPN “Party for a Purpose II” in July. The Arcadia Association of REALTORS® believes in the importance of supporting such an outstanding cause. It is our hope that with these funds, the battle against cancer can and will continue to be fought. AAR Relay for Life Team Captain, Tony Moon (L) assists Kelvin Chang, YPN Co-Chairman (Middle R) and AAR Executive Vice President, Andrew Cooper (Far R) to present a donation to Ann-Marie Dodge (Middle L) and Beth Goldberg (M) on behalf of the American Cancer Society.
