automotive brake pad dust that is washed off roadways and into the sea during rain storms. In comparison, very little comes from boat bottoms. Can you imagine how many tons of brake dust are dumped on the 405 freeway each year with all the stop-and-go traffic during rush hour? All of that gets washed into the sea. None of the socalled safe bottom paints are particularly effective. They are more expensive, have a shorter life, require more frequent cleaning and generally require full removal of existing paint before application. This is just another example of a bureaucracy trying to justify its existence. I’m all for clean water, as are most boaters. It is, after all, the environment in which we operate. And may I remind the bureaucrats that Marina del Rey was built as a small boat harbor, not an aquarium. Even so, the sea life seems to be doing very well, thank you. Mike Reinert Marina Del Rey
I’m fortunate to live on a dock full of very nice outgoing people. We often get together on the dock at day’s end for cocktails and conversation. Recent discussions have centered on how much sea life we see in the marina. Schools of small fish are sometimes so thick that the water appears to be in motion as the fish break the surface. Pelicans and other sea birds have a ball diving on these fish. Sea lions get their licks in, too. In fact, the activity is often so heavy that our conversation comes to a halt and we just watch. With that in mind, I was surprised to receive a letter from the Los Angeles Regional Water Quality Control Board telling me and others that copper paint on boat bottoms is killing off marine life here in the marina. I guess all those fish, birds and sea lions didn’t get the message. This same attack on boaters and their bottom paints occurred at Shelter Island in San Diego. State board proposes dredging Marina del Rey

By Pat Reynolds On a recent weekday morning in a small public meeting room in Marina del Rey, about two dozen residents heard representatives of the California Regional Water Quality Control Board introduce a proposal that could affect millions. The issue before the Small Craft Harbor Commission: water pollution in the harbor. According to the state board’s Los Angeles office, the waters of Marina del Rey are on their way to becoming too toxic an environment to sustain many of the organisms that inhabit it. In a 56page report, the agency details an array of water quality concerns and several scenarios for cleaning up the area — but none was more jarring than a proposal to dredge the entire Marina del Rey harbor at a potential cost of more than $200 million. But let’s back up. The report details myriad ecological issues that exist in the harbor, which is essentially a parking lot for boats. There is data on zinc contamination, PCBs and increased levels of DDT, but the main and most pressing thrust was the amount of copper, a biocide, detected throughout the harbor’s water column. There’s no mystery surrounding where this copper is coming from — the bottoms of nearly all boats in Marina del Rey are coated with a copper-based paint of one kind or another. Monthly boat cleanings with abrasive scrubbing tools release tiny particles of copper from the hull and into the environment. How serious of a problem this really is and how to solve it is where factions and frictions begin to emerge. Last month the state board sent a one-page bulletin to boaters proposing a switch to alternative paints, saying they were working with the paint industry to supply “effective options.” But boaters argue that there are currently few acceptable alternatives to PAGE 6 THE ARGONAUT January 2, 2014
copper paint and virtually no effective ones. Some involve costly preparations and are deemed not nearly as effective as copper. All are projected to be expensive for boat owners — an additional cost as high as $8,000 per boat, according to some estimates. “As of today, there are no viable nonbiocide [paints] available for use in Marina del Rey,” says Greg Schem, who owns The Boatyard in Marina del Rey. Even though he could make a lot of money repainting boats, Schem spoke up about the lack of feasible paint alternatives during the Dec. 11 meeting. “It’s ironic, because this could be a windfall for the boatyards,” Schem says. “We’d be required to do all this work … [and] $8,000 times 5,000 boats is $40 million, but the fact is we have to do what’s right. If we’re all boaters and in this for the long haul, this is not the right
way to approach it. We have to be more rational.” Also controversial were the state board’s proposals for cleaning up the existing problem — sediment capping, dredging or a combination of the two. Sediment capping, according to the report, means “to cover contaminated sediment by a layer of clean sediment, clay, gravel or other material.” But capping is only workable under certain circumstances and “is most effective in large, deep water bodies,” which the marina is not. So dredging seems to be the more effective option, but a full-scale dredging of Marina del Rey for environmental purposes was a jaw-dropper for many in attendance. The type of dredging that’s proposed is hydraulic dredging, which is a much different process than the mechanical dredging done last year at the main entrance of the harbor for navigational purposes. Instead of an enormous crane and barge, the dredge involves equipment about the size of a mid-sized boat that basically vacuums the bottom. Though less intrusive than a more conventional dredge, the process is still quite expensive and complex. Gary Jones, acting director of the Dept. of Beaches and Harbors, said dredging the roughly 400 acres of water in the harbor was cause for great concern. “I’m sure that the reality of such a project would see a cost far in excess [of $200 million],” Jones said. “With regards to marketability, our fear is that if it is less attractive and more costly to moor your boat in Marina del Rey, then we will see vacancies increase. That will have an effect on not only county revenue but also the revenue of our lessees, the marina operators.”
The state board has set a pretty lofty goal for cleaning up the harbor. They hope to achieve an 85% reduction in copper levels by March 2024. A similar dredging took place at Shelter Island in San Diego, where those efforts achieved a reduction of only 10% in seven years. Schem and others said the 10-year timetable is far too short, considering the lack of established alternatives for boaters. The state board representatives also took heat for offering a short window for public comment. As of now, residents have a Jan. 15 deadline to weigh in about the proposed dredging. “The reconsideration document is extremely technical and full of information which has been studied for a long time by the board,” Schem wrote in comments about the situation. “Given the scientific complexity of the issue, a more reasonable time for public review and scientific analysis [should] be at least six months.” So here we sit. The California Regional Water Quality Control Board has deemed the water in Marina del Rey toxic and harmful to the sea life that inhabits it. The culprit is the paint that exists on nearly every boat in the harbor. The dilemma and challenge at hand is finding the most reasonable and cost-effective way to make a substantial and lasting change. By Joe Piasecki A private security guard was found shot to death early Monday morning at the recently opened Shores apartment complex in Marina del Rey, leaving residents shocked and saddened. The victim, described by Los Angeles County Sheriff’s Department investigators as a black man in his 40s, worked at the building as part of a 24-hour “courtesy patrol” unit, a Shores representative said. His name was still being withheld at press time. Sheriff’s deputies discovered the victim, believed to have been unarmed, at around 3 a.m. in the front parking lot of the complex at 4201 Via Marina, according to law enforcement officials, who provided few immediate details about the investigation. Deputies cordoned off the area in front of the upscale apartment complex well into Monday afternoon as crime scene investigators searched for physical evidence. Jen Kalban, an events promoter who moved into Shores in September, said she heard several gunshots from inside her apartment. “I don’t know what woke me up, but I heard someone running through gravel,” said Kalban, 25. “I heard someone shout ‘Hey, what’s up,’ then a gunshot, a pause, and then two [gunshots] back-to-back.” Kalban said she called emergency responders but was afraid to look out from her balcony. “I was really shaking,” she said. “I didn’t want to move. I just got on the phone. Called my mom.” Several Shores residents said the shooting victim was an African immigrant who went by the name Patrick. “Patrick was a really sweet guy. He gave my dog treats. He always said hi,” resident Gladys Bernadac said. “Patrick was the sweetest, kindest, most caring person you’d meet. He always smiled. He was a helper, a server, and whoever did this needs to be caught. It’s an outrage,” said a tearful woman who identified herself only as Sally.

The victim and other courtesy patrol staff were hired through a third-party security firm, said David O. Levine, chief of staff to Shores LLC managing partner Jerry B. Epstein. “This is a terrible, terrible tragedy. The victim was beloved both by staff and residents here at Shores, but beyond that I can’t really comment,” said Levine, who is also president of the Marina del Rey Lessees Assoc., a nonprofit organization that represents the interests of developers leasing parcels in the county-owned harbor. There are 544 apartments in the 12 buildings that make up Shores. About half are occupied, Levine said.

The first two buildings in the complex opened in August and the final building hit the rental market in November. Known for fine dining, yacht clubs and waterfront views, Marina del Rey has one of the Westside’s lowest violent crime rates. Only 14 violent crimes have been reported over the past six months, according to reports by the Sheriff’s Marina del Rey Station. But Monday’s shooting death is the second killing to rock Marina del Rey residents in the past six weeks. Venice resident Guillermo CarmonaPerez, 24, was found stabbed to death shortly after midnight on Nov. 18 near the intersection of Pacific Avenue and
Washington Boulevard, only a few feet outside Marina del Rey. According to Los Angeles police, Carmona-Perez was killed shortly after leaving a Marina del Rey restaurant where he worked as a line cook. The last murder to take place within Marina del Rey was in July 2010, when 90-year-old Mary Jane Sternal and 81-year-old Harry Antler were found shot to death in the 14000 block of Palawan Way. alston Edward Henry can’t stand still. Not when the music’s going. The lithe, agile lead singer of the band Black Party Politics addresses the audience with the intonation of a charismatic Baptist preacher — “I ask you only this one thing: testify with me” — and then suddenly explodes into movement, feet kicking, arms waving, hips swinging along to a barrage of drums and bursts of electric guitar. Backed by his bandmates’ revved up, polyrhythmic beats and bouncy grooves, Henry leads a physical, genre-mashing stage show rooted in equal parts soul and rock. It all started nearly a decade ago at Venice High School, when a teen with prematurely gray hair caught Henry’s attention while playing a rendition of a Jeff Buckley song (“Lover, You Should’ve Come Over”) on an
acoustic guitar. “I went back into the school to hang out and there was what I thought was a 25-year-old man playing guitar,” Henry, who goes by the nickname Eddie, said of Black Party Politics guitarist Miles Safford. “I still have the Live Journal post of the day I met him.” The two got to know each other because, at the time, “Miles was trying to date some girl in my artsy-fartsy group of friends,” Henry said. Cut to college, and Safford is by then dating another friend of Henry’s. At Cal State L.A., the pair performed as Lipstick from Nowhere for a class assignment, but then came a second gig at sculptor Laddie Dill’s warehouse art space on Electric Avenue in Venice. “We decided to keep the band together,” Henry said. Drummer Chris Wilson had also come aboard but later left to found electronic duo Our Name (Continued on page 14)

The Santa Monica Playhouse revival of Jerry Mayer’s cruise ship comedy “Aspirin and Elephants” promises more belly laughs than headaches By Michael Aushenker Santa Monica Playhouse co-artistic director Chris DeCarlo can hardly believe it, but here he is directing Jerry Mayer’s comedy “Aspirin and Elephants” again, a quarter century after helming the play’s debut on the very same stage. “It was a fun piece of theater [and] the author came back and updated the material,” DeCarlo said. Mayer’s cruise-ship comedy centers on a wedding anniversary trip in which a woman and her parents all find their relationships on turbulent waters. DeCarlo said the play has been a success for Mayer because everyone can relate to the ill-fated voyage, stuck-on-a-cruiseship-in-paradise premise. For Mayer, it started with a real-life trip he took with his in-laws and his wife's sister and brother-in-law, exaggerated for comedic effect.
“I was on a cruise once and that’s exactly what happened,” Mayer said. “Both marriages were having trouble. It’s a kind of interesting story and it really worked.” “Aspirin and Elephants” has gone on quite the journey since debuting at the Fourth Street Theater in 1986. In 2002, Jack Klugman played the father character in a Kansas City production. Recently, it’s been translated into German. For its most recent iteration, Mayer didn’t have to go far to update its timeless comedy. “I went from a ‘typewriter’ to an ‘iPad,’” Mayer said, chuckling. “It was quite easy to update. … “There’s a lot of good humor in it, but it’s real. It’s funny. It really held up.” DeCarlo likens Mayer’s work to “Neil Simon, in terms of the humor and human drama,” but Mayer’s writing credits are

formidable and impressive in their own right. As a freelancer, Mayer sold telescripts for produced episodes of “All in the Family,” “Mary Tyler Moore” and “M*A*S*H*,” and he later became a story editor and writer on yet another 1970s Emmy-magnet, “The Bob Newhart Show.” In the 1980s, Mayer worked as executive producer of “The Facts of Life” and also contributed to “Punky Brewster.” As TV work waned by the late 1980s, Mayer’s passion for writing plays intensified. “I thought it would be an adventure to write stuff that people would have to pay
to see,” he said. Often building plays on autobiographical anecdotes, Mayer finds live stage gives him the freedom to personalize his comedy in ways he couldn’t with feature films, where other scribes are brought in for rewrites. “And even with television [that happens],” he said, “although, with television, at least you’re getting paid for it.” Mayer’s upcoming play for 2014, “One Foot Out the Door,” has, as its subtext, a message of “don’t’ get divorced so fast,” he said, believing that contemporary couples quit too soon after hitting speed bumps in the marital road. About two years ago, he premiered “Black and Bluestein” at Santa Monica Playhouse. The play, set a week after the Kennedy assassination in 1963, found inspiration from a period when Mayer lived in St. Louis. Decidedly less autobiographical and more ambitious was his riff on French actor Maurice Chevalier and German native Marlene Dietrich: “Dietrich and Chevalier: The Musical.” Currently living in Pacific Palisades, Mayer says Santa Monica Playhouse is the ideal venue for his work. Mayer, whose wife Emily produces his plays, often finds himself tiptoeing on egg shells around family members when coming up with these pieces. For that first play, “I had to get permission from my mother-in-law, because it had to do with her having an accident when she was 16.” Likewise, Mayer was concerned how his brother-in-law might feel about “Aspirin” — ex-brother-in-law, to be precise. Like the sparring couple in “Aspirin,” the real-life counterparts were kaput by the time Mayer’s play hit the stage. The play doesn’t paint him in a good light, “but he loves it because he’s in the spotlight,” Mayer said. We love growing with a place like that,” Safford said. Black Party Politics released their first album, “Hive Mind,” in 2012, and formed deeper bonds with each other last year while going through bad breakups in their personal lives. “We’ve all been through the love ringer,” said Henry, who turned lyrically “Victorian horror, Dorian Gray, man vs. monster themes” in the aftermath of his own broken relationship. The band will showcase the bulk of its

catapulted rap into America’s suburbs. “Licensed” became the first-ever rap album to top Billboard’s charts. Rubin had started Def Jam out of his dorm room in the early 1980s while he and Adam Dubin were New York University cinema students. Rubin lived in Weinstein Hall, where Menello, a decade out of NYU Film School, worked at the dormitory’s front security desk. Rubin and Dubin — and non-NYU students
Simmons and the Beastie Boys — enjoyed interacting with Menello, a gregarious aspiring filmmaker as knowledgeable about Jean-Pierre Melville and Claude Chabrol as he was about Francis Ford Coppola and Martin Scorsese. Thanks to Menello, Giordano landed his post at Def Pictures, where he became one of the producers of the failed 1988 Run-DMC vehicle, “Tougher than Leather.” He initially turned
Rubin and Menello down. However, they “kept calling me, driving me nuts,” Giordano explained. Since Rubin offered to hire Menello if Giordano kickstarted Def Pictures, Giordano intended to pull “a hit and run: do the job and get back out!” History had other plans. After the first single off “Licensed to Ill” hit radio, MTV wanted a video. “If Rick Rubin had not been making ‘Tougher than Leather’ (Continued on page 19)

Kelly Nagle, spokeswoman for the Santa Monica Convention & Visitors Bureau, said the now annual event recognizes that “wellness is not only a big part of the lifestyle, but also our culinary scene.” For the inaugural Eat Well Week last January, venerable cartoon stars Popeye and Olive Oyl were on hand to launch the concept — and who better than a spinacheating sailor and his girlfriend with the salad-dressing moniker to communicate healthier menu options to kids? King Features Syndicate, home of the “Popeye” comic strip, had sent over kabuki costumes of their characters for the inaugural event. “He’s a Santa Monica native,” Nagle said of Popeye, “and last year, we had a spinach-cooking competition [featuring] Lago, Ocean and Vine, and The Lobster.” This week, in coordination with California Restaurant Month, organizers aim to comingle “good taste and healthy food” in ways that prove the two are not mutually exclusive, Nagle said. By Michael Aushenker It should come as no surprise that Santa Monica, known for being a progressive city, is “going green.” Only this week, the phrase applies more directly to peas, kale and broccoli. To promote healthier lifestyles and the many local restaurants that can help diners achieve them, the Santa Monica Convention & Visitors Bureau is launching the city’s second annual Eat Well Week on Sunday. For locals, this means that many of the city’s top restaurants will offer discounted prix fixe menus and other options to “satisfy both the wallet and the waistline,” according to the event’s website. The promotion runs through next Sunday, Jan. 12. So Rubin gave Menello the assignment — and only $40,000 — to shoot the video for “(You Gotta) Fight for your Right (to Party).” “Menello was too nervous to do it himself,” Dubin continued, “so he asks me. He couldn’t produce the video, he couldn’t get it done.” With the Beasties’ blessing, Menello and Dubin set off to build a comedic, mayhem-filled video featuring a party-crashing Beastie Boys. “Let’s make it like the party at ‘Breakfast at Tiffany’s,’” Dubin said they decided. “Ric said, ‘Come over, we’ll watch the movie, we’ll eat, and then we’ll write the gags.’” At Menello’s family home in Brooklyn where he still lived, Menello’s mom, Lucille, very much the quintessential Italian mother, made “enough food on the table for an army,” Dubin said. “Surely there must be other people coming over.” Several helpings later, Menello, who spent his disposable income on laserdiscs, pulled out Blake Edwards’ 1961 classic. “As we’re writing all the gags, we’re also storyboarding it out on 5” x 7” cards,” Dubin said. The video, which packed the Manhattan apartment of photographer Sunny Bak (now a Venice resident) with Beasties friends and associates, was shot across Thanksgiving Weekend

Cali Dreamin’ Confident enough to direct solo, Menello helmed rap videos for MC Lyte and Slick Rick as well as “Going Back to Cali.” “That’s him on his own,” Dubin said of “Cali.” “He’s trying to be Welles, who he could also do a flawless imitation of.” Giordano added, “I remember I was the one who dealt with the problems when the mother of the underage girl dancing on the top of the [Venice Beach] phone booth had her lawyer contact us to have the shots removed from the video. So I had to delicately find a solution to that [situation].” “I had a strong feeling of how L.L. should look in the video,” Rubin told NPR in 2011. “This was at a time when rappers all wore a lot of gold jewelry. And I was very insistent that L.L. not wear any jewelry.” Cool J complained to Simmons, who instructed him to obey Rubin. “I tried to explain to him,”
Rubin told NPR, “like ‘the reason you don’t want to wear jewelry is because everyone’s wearing jewelry. And it’s much more interesting when everybody’s wearing jewelry for you not to.’ And he was like, ‘How are people going to know I’m successful if I’m not wearing jewelry?’ And I said, ‘Because you’re so successful, you don’t need jewelry!’” In a 2012 article in Entertainment Weekly, L.L. Cool J recalled making the video. “I went out of my comfort zone,” he told the magazine. “It’s funny, because Rick Rubin always hated ‘I Need Love,’ and there was a time when I hated ‘Going Back to Cali.’ It ended up being something really special, but it took me a minute.” Following its video’s release, the quirky “Going Back to Cali” (no relation to an identically titled 1997 Notorious B.I.G. song) peaked at No. 31 on Billboard’s Hot 100 in 1988. “The video is a wonderful match for the song,” Def Jam’s Adler said. “There’s never been anything quite like them, before or since.” After Menello’s father died in the mid-1990s, Menello and his mother relocated to New Jersey until her 2007 death, when he returned to Brooklyn. In Ditmas Park, “he knew everybody,”
Dubin said. “We walked down the street. There’d be hardcore African-American guys. They’d be like, ‘What’s up, Ric?’” In recent years, Menello got closer to his dream of becoming a feature filmmaker as the screenwriting partner of filmmaker James Gray on “Two Lovers” (2008) and “The Immigrant” (2013), both starring Joaquin Phoenix. On March 1, Menello, 60, died of a heart attack. Giordano has set up a tribute website to his cousin at ricmenello.com. “He had time for people,” Dubin remembered. “He would read screenplays for people. He did exactly what he did at the front desk of that dorm.” Last September, Eminem paid tribute to the “Cali” video in his video for “Berzerk,” the first single off his new album, by having Rubin recreate his cardgame cameo from the “Cali” video. Turning 46 this month, Cool J, now star of CBS’s highly rated “NCIS: L.A.” and living in Studio City, has come a long way from that Venice Beach shoot after finding success in Hollywood. course of the tenancy, the tenant has the obligation to notify the owner once the tenant becomes aware of a problem with the smoke alarm and, of course, the owner is then required to correct any reported deficiencies in the smoke alarm. Finally, enforcement of the new law will be done on two levels. First, the law provides that building permits for alterations or repairs of $1,000 or more on residential properties will not be signed off by the permit issuing agency until the property owner demonstrates that all smoke alarms installed in the unit are on the State Fire Marshal’s list of approved devices. Second, landlords who fail to comply with the law will be charged with an infraction, punishable by a maximum fine of two hundred dollars ($200) for each offense. However, the law, as amended, also permits the State Fire Marshal to create exceptions to these requirements, or suspend enforcement of the requirements altogether for up to six months if the Fire Marshal determines there is a shortage of suitable alarm systems available to the public. In that situation, the Fire Marshall will notify the public by posting their decision on their website at http:// osfm.fire.ca.gov. In the end, the new laws can be summarized as follows: as of January 1, 2014, owners are required to ensure that all residential rental units have operable smoke alarms installed at the beginning of each new tenancy. Additionally, owners are required to inspect and maintain the devices in all residential units, and each smoke alarm installed must be on the State Fire Marshal’s list of approved devices. In order to install, inspect and maintain the device, owners are permitted to enter the unit during normal business days and hours, provided they give the tenant written notice at least 24 hours in advance. Failure by the owner to comply with any part of the law is an infraction that can result in a fine of $200 per violation. This week’s question is answered by Michael A. As of January 1, 2014, all smoke alarms installed in residential rental units must be on the State Fire Marshal’s list of approved devices. In order to be on the list of approved devices, the device must display the date of manufacture on the device; provide a place on the device where the date of installation can be written; incorporate a hush feature; incorporate an endof-life feature that provides notice that the device needs to be replaced; and contain a non-replaceable non-removable battery that is capable of powering the smoke alarm for minimum of ten years (this last requirement applies only if the device is battery operated). Under current law, only owners of multi-family rental units are responsible for testing and maintaining the devices, while owners of single family units are under no such obligation. However, as of January 1, 2014, owners of both multi-family and single family rental units who rent or lease their property will be responsible for testing and maintaining the smoke alarms within all of the units in, or on, their properties. In the case of apartment buildings with two or more units, landlords will be responsible for testing and maintaining the devices in every unit, including vacant units. In order to facilitate the owner’s obligation to test and maintain the devices, owners or their agents are permitted to enter the unit for the purposes of installing, repairing, testing, and/ or maintaining the devices. However, owners are required to provide tenants with reasonable notice, in writing, of their intent to enter the unit prior to going in. Reasonable notice is generally considered to be 24 hours in advance of entering, and entrance may be made only during normal business hours (generally Monday through Friday between 9 am and 5 pm). Of course, where a tenant grants permission or requests the landlord to enter on days other than those listed above, it is perfectly acceptable to do so. Additionally, owners are required to ensure that smoke alarms are operable at the time a new tenancy is created. However, during the
