LEASES A lease is an agreement between landlord and tenant to transfer possession of property to the tenant for a certain period of time in exchange for payment. A lease can be written or verbal, but we highly recommend that you always get your lease in writing. A written lease fixes all terms of the agreement so that no changes can be made during the term of the lease, unless both the landlord and tenant agree to the changes in writing. Make sure you read the lease thoroughly and understand what it says.

These are a few important components to look for in your lease: •

What is included in the lease? Utilities? Furniture? Washer/Dryer?

What are the expenses I will incur? Deposit (refundable or not)? Utilities?

Are there “rules and regulations” or other policies I need to abide by? Are there fines for violations?

Can I move out before the end of the lease? Is there a penalty?

For what reasons can the landlord evict me?

TYPES OF LEASES

APARTMENT/HOUSE LEASE You are signing a lease for the whole apartment/house. PROS: You are signing a lease for the whole apartment/house and control who you live with CONS: You are liable for the whole rent even if one of your roommates doesn’t pay their share

INDIVIDUAL LEASE You are signing a lease for your specific bedroom. Many student housing complexes lease this way. PROS: You are responsible only for your own rent CONS: The landlord may control who your roommate(s) will be

FIXED TERM LEASE This lease is for a specific length of time. Check to determine if the lease is for the academic or calendar year. PROS: You are guaranteed the apartment and rental rate for the duration of the lease CONS: Unless otherwise noted, you are responsible for paying the landlord for the entire duration of the lease, even if you vacate early

MONTH-TO-MONTH LEASE Both you and the landlord have the right to terminate the lease at any given time with 30 days notice. PROS: Gives you more flexibility to move out if you need to (after giving appropriate notice) CONS: Since this type of agreement automatically renews on a monthly basis, the landlord has the right to raise the rental rate

SECURITY DEPOSITS Any sum you pay the landlord at the beginning of your lease term (other than your first month’s rent) is considered a “security deposit.”

HERE ARE SOME IMPORTANT FACTS:

The total amount of such charges cannot be more than one and one half times your monthly rental amount.

Cleaning and redecorating charges are not part of the security deposit, if separately identified. If these charges are non-refundable, the landlord must state that fact in writing. If it is not in writing, these charges cannot automatically be withheld when you move out.

Make sure the charges you pay at the beginning of your tenancy are clearly explained in your lease. For example, if your landlord says you can use your security deposit in lieu of your last month’s rent, make sure that is in your lease.

Make sure you note any problems with the condition of your apartment when you move in. The landlord should do a move-in walkthrough and document any damages before you take occupancy. This form should then be used to document the condition of the apartment when you move out. This will protect you from being liable at the end of your lease for damage that was there when you moved in.
