Dear Mr. Weberman: You appealed from the action of the Federal Bureau of Investigation on your request for access to records pertaining to Aron Morton Kay maintained in the New York Field Office. As a result of discussions between Bureau personnel and members of my staff, a supplemental release of records either has been or will soon be made to you directly by the F.B.I. In light of this fact and after careful consideration of your appeal, I have decided to affirm the modified action in this case. Mr. Kay is not the subject of any New York Field Office file which was not reported to F . B . I . Headquarters , but is alluded to briefly in two files, the subjects of which are other individuals or organizations. You are being furnished only the portions of those files which pertain to him. Certain of the materials pertaining to Mr . Kay are classified and I am affirming the denial of access to them on the basis of 5 U.S . C. 552(b) (1). These materials have been referred to the Department Review Committee for review and determination whether they warrant continued classification under Executive Order 12065 . You will be notified if the Committee •s final decision results in the declassification of any information. Other materials were properly withheld from you pursuant to 5 U.S . C . 552(b) (7) (C) and (7) (D). These pertain to investigatory records compiled for law enforcement purposes, the release of which would, respectively, constitute an unwarranted invasion of the personal privacy of third parties, in some instances by revealing an investigative interest in them on the part of the F.B . I . , and disclose the identities of confidential sources. Names of Bureau agents and other government personnel were also excised on the basis of 5 U.S.C . 552(b) (7) (C) . None of the material being withheld is appropriate for discretionary release.

6/13/70 public rally sponsored by the Committee Unite.d :for Political Prisoners (CUPP} at Los Angeles, Calif'orniaJ a Special Agent of the FBI observed an individual burning an American flag. Investigation developed the identity of the individual as AROH MORTON KAY. A misdemeanor warrant was obtained by the LAPD on 6/29/70; ·charging KAY with violation o:f the California Military and Veterans Code, Section 614. KAY was arrested by the LAPD on 8/2/70, appeared in Los Angeles Hunicipal Court (LAl·lC) 8/3/70, and pleaded not guilty. He appeared in LAMC on 8/17/70; at which time his trial 'qas set for 8/26/70', in Division 35, LAMC. Reviews of records of LASO and LAPD as well as LAMC are set forth. Records.of Los Angeles City Attorney's Office reflect KAY appeared in Division 3.5A of LAMC on 8/26/70, and pleaded nollo contendere to a charge of 415 PC (Disturbing the Peace.) and the charge of violation o:f 614 Section D, California ~lilitar.y and Veterans Code was dismissed. KAY paid a fine of $50 plus $15 Court cost in lieu of five days in the County Jail.

DETAILS: Investiga~ion wa~ this matter upon receipt of information from SA , Vlho advised that he attended_a public rally a assy Auditorium, . Los Angeles, California, on June 13, 1970, sponso:rieidliblylt the Committee United for Political Prisoners. SA~ observed an individual described as a 1·1hite .male, approximately 6' tall, 200 pounds, 22-?4 years of age, -" 1·1earing levi pants and a levi jacket,Jl"stood Up in his seat and removed an 'American flag approximately eight inches by ten inches from his right arm. This individual held the flag in f-ull vie1·1 of the audience and set fire to it. As the flag began to burn he moved from his seat to the aisle and the burning .flag dropped to the aisle of. the auditorium. At this point monitors of the rally extinguished the fire and forcibly evicted the individual from the auditorium. I
Subsequent investigation developed the identity of the individual as ARON MORTON KAY. A misdemeanor warrant was obtained by the Los Angeles Police Department (LAPD) ·on August 2, 1970, ·charging KAY with violation of California 1-!ili tary and Veterans Code, Section 614.
KAY Vias arrested by the LAPD on August 2, 1970, appeared in Los An'geles l•lunicipal Court· (LAl-lC) on August 3, 1970, and pleaded not guilty. He appeared for trial setting in L.4J.lC on August 17, 1970; and the trial 1~as scheduled for August 26, 1970. T{.e sidence Source One advised on November 21, 197.3, that Kay still resides at 1076 South Crescent Heights noulevard, Los i\.ngeles, California. llo<;.1ever, investigation at Los Ange les has revealed that Kay travels e }~ tensively and spends much of his time on the East coast, namely New York City and Hashington, D.C. ACTIVITIES Youth International Party (YIP) . · The YIP, also known as Yippies, is · a loosely knit, anti-establishment revolutionary youth org anization, formed in New York City in Jatlllar~ 1968.
On July 4, 197.3, Sources Two and Three advised that Kay ,.,as present at a YIP sponsored demonstration in \-lashington, D. S . on that date. This dcmonotration l.:as held in support of the leg alization of marijuana and for the impeachment of President Nixon. Sources advised that K~y spoke at a rally on the step~; of the Capitol Building during this demonstration.

Volume 1, Number B issue of the "Yipster Times", undated, but received by on 11/21/73, reflects that this newspaper is pub ed by the Youth International Party {YIP) News Service, Post Office Box 392, canal Street Station, New York City 10013. Page 2 of this issue reflects an article entitled ~·sept. 1, 1973, New York Enacts One of the Toughest Marijuana Laws in This Country", which states that ~ON KJ>:Y. sells the "~ipster T~es" on the streets , 1 ,) of many Amer~can c~t~es. A sit-in · dem ons tration was initiated; however, the subject agreed to move o n at the request of the police. The YIP followers then marc k .d to the residence of Ne\'1 York Attorney Roy Cohn on E'ls t L>9t.h Street, Ne\'1 York City, Nhere they scre.amed for Cohn Lo come out, stating that he ~~illed Ethel and Julius . Ros.enber~, stnce he ~ssi!ited in the prosecution of the Ros enl.Jergs in their espionage trial. The demonstration at Cohn' s residence lasted about five minutes, when the police arriv e d and arrested the subject and an unknown YIP follower and r J. aced them in a poli c e van and drove off.

Re New York teletype to Bureau, 4/27/76, captioned Youth International Party; IS; OO:NY. On 5/13/76 New York initiated a preliminary investigation regarding subject for the purpose of determining his activities with the Youth International Party (YIP) and their plans for disrupting the Democratic National Convention to be held in New York City, July 12-17,1976. Subject is a leader of YIP and is likely to be instrumental in formulating plans for the group.
New York will conduct its investigation in accordance with the Attorney General Guidelines for Domestic Security Investigations, and the Bureau will be kept advised.
