Dear Mr. Weberman: You appealed on behalf of Aron M. Kay from the action of the Federal Bureau of Investigation on his request for access to records pertaining to himself maintained in its Los Angeles Field Office. As a result of discussions between Bureau personnel and members of my staff, a s upplemental release of records either has been or will soon be made to you directly by the F.B.I. In light of this fact and after careful consideration of your appeal, I have decided to affirm the modified action in this case. Mr. Kay is the subject of one Los Angeles Field Office main file -- Security Matter -- from which the Field Office processed only those documents not previously reported to Bureau Headquarters. Mr . Kay is also alluded to briefly in two files, the subjects of which are other individuals or organizations. In these latter instances, Mr . Kay was furnished only those portions of the files which pertain to him. Two pages of the materials pertaining to Mr. Kay are classified and I am affirming the denial of access to them on the basis of 5 U.S.C. 552(b) (l). These materials h ave been referred to the Department Review Committee for review and determination whether they warrant continued classification under Executive Order 12065. You will be notified if the Committee 's final decision results in the dec l assification of any information. Other materials were proper l y withheld from him pursuant to 5 U.S.C. 552(b) (7) (C) and (7) (D). These pertain to investigatory records compiled for law enforcement purposes, the release of which would , respectively, constitute an unwarranted invasion of the personal privacy of third parties by revealing an investigative interest i n them on the part of


• - 2 the F.B.I. and disclose the identities of confidential sources. Names of law enforcement and other government personnel were also excised on the basis of 5 u.s¡.c. 552(b) (7) (C). None of the material being withheld is appropriate for discretionary release. Please be advised that a review of the Bureau's Electronic Surveillance Index disclosed no reference to Mr. Kay. The documents pertaining to Mr. Kay, including the materials withheld from release, contain no references to the "pie-throwing" incident mentioned in your letter of May 12, 1978, nor do they contain evidence of any visits by the Field Office to Mr. Kay's parents or friends. Judicial review of my action on this appeal is available to your client in the United States District Court for the judicial district in which he resides or has his principal place of business, or in the District of Columbia, or in the Central District of California, which is where the records he seeks are located. KAY is described as white, male, born 11/14/49, at Winnipeg, Canada, address 1076 South Crescent He~ghts Boulevard, Los Angeles, California~ 90035, telephone 935-15e4, Social Security Number 551-80-~180. . , He attended Los Angeles City College, 855 North Vermont Avenue, Los Angeles, C lifornia, for one semester, September 1969, ho~ever, he completed no courses. His number is 268780 and he previously attended Fairfax Adult School, Los Angeles, California, December 1967 - January 1969. Investigation instituted in this matter, 6/8/73, based upon arrest of ARON ENNO, aka Aron Morton Kay, on 8/23/72, during riotous street demonstration at the Republican National Convention, 11iami Beach, F;J.orida. The arrest was made by the Dade County Public Safety Department, whose Field Arrest Form, recently made available, showed only that the subject was arrested at the Miami Beach Convention Center and is a white, male, born 11/14;49, place of birth not shown. For information of Los Angeles, charges against virtually all arrested during the Republican and Democratic 1972 national conventions were eventually dismissed, the exception being aggravated cases. Subject's case was not included among these exceptions. J•1iami indices negative re subject. On

'(/16/75, Miami submitted an FD-9 re subject.

On 7/26/75, FD-9 was returned by the Identification Division. Enclosed Identi1'ication Record showed one arrest each for an ARON MARTIN KAY and an ARON MORTON KAY, possibly identifiable with the subject. KAY, FBI# 589 73~ H, was arrested by the Los Angeles, California PD on 8/~/'/0 as ARON MARTIN KAY, File No. LA 950 t)6?-K. The charge was "614D, Military & Veterans Code." No disposition ~ shown. llie second arrest, also by the Los Angeles PD, was on 10/25/70, for an ARON MORTON KAY, File Number LA 950 867 K. The charge was "b47c PC (begging misd)." Subject stated that a FBI Agent had come to his house and asked to· speak with him, and that he had told the Agent he did want to talk to him. Subject stated the reason he ~old the FBI Agent that was because his mother was also home and he did not want to upset her. Subject stated he would like to know what the Agent wanted, but he does not want the Agent to come to his house since his mother is easily upset. Subject said the only thing he remembers about the Agent is that he had blond hair.

ARON MORTON KAY Sl! - YIP OO:NY During the late afternoon of Thursday, February 27, 1975 1 subject ARON HORTON KAY, telephonically called the writer to inquire as to whether or not I had been out attempting to interview him earlier in the day. He said he understood "You have had my file in the past." The writer has not attempted to interview KAY~ and has no idea· where he got my name. He also explained that he had been in~e in the early afternoon and inquired of SA if he knew who had been out in 'an attempt to interv~ew • The results of his inquiry at that time were negative. KAY said he had been home (at his parents house) at the time a tall blond SA of the FBI came to the house and wanted to talk with him. He said "I refuBed to talk with him because I was really freaked out at the time." He said also his mother was the only· other person in the house with him at the time and he did not want to have her become overly alarmed. He said,"I have been active in radical movements, maybe that's why they want to talk to me.n The writer advised KAY that at no time had he ever cane to his house in an attempt to interview him, much less had he contacted KAY earlier that same day. KAY refUsed to fUrnish his home address or telephone number, saying he did not want to be contacted at his home; and that he(had already fUrnished that information to some other SA df the Los Angeles Division of the FBI over the telephone earlier· in the day.
