Requirements

for the Dental Office

A small business such as a dental office has a multitude of legal requirements that must be met. While they all are important, none is more important than OSHA compliance, because it makes your facility safer for all who work there and eliminates your exposure to costly and embarrassing fines.

There is often considerable misunderstanding as to what OSHA regulates and many confuse OSHA requirements with infection control recommendations. OSHA, in fact, is concerned with only one thing---the safety of employees.

OSHA, which is an acronym for the Occupational Safety and Health Administration, was formed through an act of Congress and its requirements are federal law. OSHA does not care if the hazard is from a chemical, a bloodborne pathogen, an electrical device or a fire. The only concern it has

is the protection/safety of the worker, and this includes all employees in the dental profession.

To begin your compliance efforts, choose someone to be your Compliance Director. A trusted and organized dental assistant, hygienist or officer manager is suggested; by having an accountable individual, progress can quickly be made. Next, assign your Compliance Director to review and implement one step at a time, using the following outline:

Hazard Communication Standard The Hazard Communication Standard deals with hazardous chemicals in the workplace. In dentistry, these include disinfectants, restorative materials, acids, cleaners, impression materials, etc. This Standard requires a written chemical safety plan, material safety data sheets for each hazardous chemical/product, labeling of these potentially hazardous products and training of employees who are exposed to them.

Bloodborne Disease Pathogens Standard

Ionizing Radiation

Because dental office employees are exposed to blood and saliva every day, this Standard is an extremely important one. Requirements include having a written Exposure Control Plan, providing the Hepatitis B immunization at no cost to exposed employees, and making available personal protective equipment (mask, gloves, safety eyewear, long-sleeved protective clothing). In addition, employees must have interdepartmental meetings at least annually to consider safer medical devices. As with all OSHA regulations, training is paramount. Employees must understand the modes of transmission for bloodborne diseases such as Hepatitis B, Hepatitis C, and HIV. They must also know what to do in the event of a needle stick or other exposure incident and have access to proper follow-up medical care.

OSHA regulations require an employer to evaluate their facility for any potential radiation hazard and provide employees with the appropriate training and monitoring equipment. The only source of ionizing radiation in a dental office is radiographic equipment. While some states require the wearing of radiation badges by dental workers, others do not. It is recommended though, that workers who take radiographs (assistants and hygienists) wear monitoring badges, since there is no such thing as a totally safe dose of ionizing radiation.

Means of Egress Every building is required by law to contain adequate exits that allow for escape of all occupants in case of fire or other emergency. There must be at least two of these means of egress in every building. Exits must have no locks or fastening devices that may prevent free escape and must be clearly visible and conspicuously marked with illuminated or glow-in-the-dark signs. Non exits need to have similar signs that state “Not an Exit.” In the event of power failure, reliable emergency lighting must also be available for all exits and signs.

Walking and Working Surfaces

Electrical Safety Electricity is such a normal part of everyday life that is often overlooked as being potentially dangerous.

Everyone has experienced a minor shock, but may fail to realize that severe shocks can cause death. Dental facilities make considerable use of electrical devices including autoclaves, instrument washers, ultrasonic cleaners, model trimmers, lathes and curing lights, as well as a host of others. It is important that no extension cords be used, that plugs and cords are checked for wear/ intact insulation and that plugs match their outlets (e.g. three-pronged). In addition, cords should not be twisted around each other, but should run in parallel, and circuits/outlets must not be overloaded.

This part of the OSHA regulation is often called the housekeeping standard. It requires all rooms and passageways to be kept clean, orderly and sanitary. All aisles and hallways must be kept free of debris/clutter and floors must be kept clean and dry. Additionally, stairways must have railings/guardrails and any ladders used must be OSHA approved.

Ventilation Ventilation in the dental office is very important, as a variety of potentially hazardous substances can become airborne and cause illness or injury. To identify if a substance is hazardous in the form of a gas, fume, vapor or dust, consult the appropriate material safety data sheet or product label. One of the best recommendation is to put the heating/cooling system fan in the “on” position during working hours to allow for adequate turnover of air in the office. In addition, encourage the proper use of high volume evacuation during restorative procedures or any other procedures involving rotary

instruments. If working with monomers or other volatile liquids in the lab, use the vent fan or a vent hood. For those offices that use nitrous oxide, remember to use your scavenger system and test for nitrous levels in the air on a quarterly basis.

Medical and First Aid This part of the OSHA regulation does NOT dictate what type of medical drugs and/or equipment you have in place for patient medical emergencies, as is often thought. Remember that OSHA regulations are only concerned with employee safety. The requirements include having medical personnel available to provide emergency care if needed and to have an employee trained in first aid available during working hours. A first aid kit should be available as well as CPR microshields or other barrier devices to use when performing resuscitation. Remember to have emergency numbers posted on the phone and to have an eyewash station installed for flushing of the eyes.

Fire Safety OSHA requires fire safety training. This training must include reviewing a list of all flammables in the workplace and their possible ignition sources.

Employees must also know what their responsibilities are in the event of fire and the location of a safe meeting place after evacuation. Having an accessible fire extinguisher and training employees on its proper use is also required.

Record keeping As in so many other areas, proper record keeping is mandatory. Requirements include employee medical records, records of training, environmental monitoring records (results of nitrous oxide and radiation testing) and material safety data sheets archiving. Employees have a right to access these records and they must be allowed to do so within 15 days of their request.

Summary OSHA requirements for dental offices are nothing more than a safety program for its employees. By appointing a Compliance Director and making him/her accountable, rapid progress can be made. If their time is limited, it may be advisable to consider a commercially prepared program to guide them through the process.

FiteBac Hand Gel Germicidal Hand Gel Study Introduction: The routine use of lotions to minimize the development of dermatitis on hands of health professionals that undergo many wash procedures per day has been a component of infection control recommendations for many years. In the past, the primary role for these lotions was to lubricate epithelial tissue and replace emollients that were removed. The overall purpose of this study was to examine antimicrobial properties of FiteBac Germicidal Hand Gel (Kimmerling Holdings Group) using the gram-negative bacillus Serratia marcescens as an indicator microorganism for effectiveness.

Experiments were developed to initially determine the antimicrobial activity following bacterial challenge on hands coated with the hand gel. The product was also tested for extended effectiveness during prolonged glove use by volunteers. Finally, the ability of FiteBac Germicidal Hand Gel to exhibit a demonstrable antibacterial effect following repeated hand washing was investigated.

Hands of potential volunteers for the investigation were initially screened for any observable skin conditions or injuries (i.e., broken skin) that could prevent them from participation in the project. The condition of the volunteers’ hands was also visually evaluated throughout the three phases of the study. Four (4) volunteers were then instructed to wash their hands with a non-antimicrobial liquid soap and water for one minute to initially cleanse the skin before application of the experimental gel. A small amount (dime size) of FiteBac Germicidal Hand Gel was then applied onto the participants’ hands and rubbed vigorously into the skin. Immediately after this application, a 2 x 2” square section of the dorsal surface of each hand was swabbed with a 1:100,000 dilution (left hand) and a 1:1,000,000 dilution (right hand) of a 24-hour broth culture of the red-pigmented bacterial species, S. marcescens. These two bacterial dilutions were used following multiple preliminary experiments that were carried out to determine concentrations of S. marscecens that would reproducibly challenge hand gel activity. The resultant concentrations of S. marscecens used to challenge hands were approximately 1 x 105 bacteria/mL (left hand) and 1 x 104 bacteria/mL (right hand), respectively. Applied bacterial suspensions were allowed to dry before proceeding with further testing. Subsequently, antibacterial activity of FiteBac Germicidal Hand Gel as determined by the presence of S. marcescens at the application sites was assayed by swabbing the 2 x 2” test areas with sterile cotton swabs moistened in sterile trypticase soy broth. Sample intervals of 1 minute, 30 minutes, 2, 4, 6, and 8 hours were utilized. Collected samples were streaked onto trypicase soy agar plates and incubated aerobically at room temperature for 48-72 hours. Incubation of S. marcescens under these conditions allowed for both microbial growth and red pigment production by the bacteria.

Four volunteers initially prepared their hands as described above. FiteBac Germicidal Hand Gel was applied to both hands and allowed it to dry, followed by application of the 1:100,000 and 1:1,000,000 dilutions of cultured S. marcescens.

Hands were allowed to dry and zero minute control samples were taken before proceeding. Participants then washed their hands for 15 seconds with a non-antimicrobial soap after sampling at designated periods of 0 (control) minutes, 30 minutes, 2, 4, 6 and 8 hours. Samples were taken from the S. marcescens-seeded hand sites using sterile broth moistened cotton swabs, cultured on trypticase soy agar plates, incubated, and observed for bacterial growth as described above.

The participants washed their hands as described above prior to the glove use portion of the investigation, followed by application of FiteBac Hand Gel. The S.marscecens test dilutions were swabbed onto the right and left hand test sites, respectively. Participants then donned nitrile gloves and continued to wear them for one hour while performing routine work tasks. At the end of this interval gloves were removed, samples collected from test sites using moistened cotton swabs, and trypticase soy agar plates seeded with material from the skin. Prepared culture plates were incubated at room temperature for 48-72 hours prior to observation for red-pigmented S. marcescens colonies.

Sixteen (16) test samples from each S. marcescens dilution (1:100,000 and 1:1,000,000) were assayed. Culture findings are presented in Table 1. All S. marcescens control cultures collected without exposure to the hand gel yielded confluent bacterial growth. With regard to the 1-minute samples, 25/32 cultures were positive for red-pigmented colonies. These showed higher levels of bacterial growth on each plate than was detected for later experimental collection intervals. In most cases the pigmented growth for the one minute-exposure plates was similar in intensity per plate to that noted for the positive control plates, or was slightly less (Figures 1 and 2). For all other test cultures where positive growth was observed, the presence of bacteria cultured for these intervals was considerably less (Figure 3). It was interesting to note that that as the time intervals of skin exposure to FiteBac Hand Gel increased, the resultant detection of S. marcescens colonies decreased, until by six hours none of the test cultures yielded red-pigmented colonies (0/32) (Figure 4). No hand dermatitis problems were noted for any of the volunteers.

Eighteen (18) test samples of each dilution were completed for Phase 2 and the observed results are presented in Table 2.

The zero-minute time interval represented the only sampling before any hand washing had occurred. The observed results were comparable to the one-minute data obtained in Phase 1, in that all test samples produced positive results but the per plate quantity of growth was much less than that observed on the corresponding positive controls. All other positive test cultures observed at later time intervals produced considerably less pigmented growth, much like what was seen for cultures in Phase 1. No hand dermatitis problems were noted for any of the volunteers.

All except one (15/16) experimental cultures from samples taken after removal of gloves were negative for red-pigmented bacteria (Table 3, Figure 5). In contrast, in a separate positive control assay, a participant applied bacteria only and wore gloves for one hour without the use of FiteBac Hand Gel. Resultant cultures from control test sites were positive (4/4) (Fig 6). The qualitative presence of S. marcescens in these controls was much less than that found for control plates using diluted bacteria only (16/16). No hand dermatitis problems were noted for any of the volunteers.

Summary: The present investigation demonstrated that FiteBac Hand Gel provided an antimicrobial benefit. Laboratory testing with S. marcescens demonstrated that the gel was effective in inhibiting test bacteria applied onto the skin during multiple hand wash procedures and prolonged wearing of gloves. Additionally, none of the participating volunteers demonstrated any irritation dermatitis symptoms with exposure to the FiteBac Hand Gel.

DENTAL ADVISER Retirement Plan & IRA Limits for Many retirement plan and IRA limits are indexed for inflation each year. Some of the key numbers for 2012 are discussed below.

Contribution Limits: 2012 Tax Year*

Elective Deferrals If you’re lucky enough to be eligible to participate in a 401(k), 403(b), 457(b), or SAR-SEP plan, you can make elective deferrals of up to $17,000 in 2012, up from $16,500 in 2011. If you’re age 50 or older, you also can make a catch-up contribution of up to $5,500 to these plans in 2012 (unchanged from 2011).

(Special catch-up limits apply to certain participants in 403(b) and 457(b) plans.)

If your 401(k) or 403(b) plan allows Roth contributions, your total elective contributions, pretax and Roth, can’t exceed $17,000 ($22,500 with catch-up contributions). You can split your contribution any way you wish.

For example, you can make $10,000 of Roth contributions and $7,000 of pretax 401(k) contributions. It’s up to you.

If you participate in a SIMPLE IRA or SIMPLE 401(k) plan, you can contribute up to $11,500 in 2012 (unchanged from 2011). If you’re age 50 or older, the maximum catch-up contribution to a SIMPLE IRA or SIMPLE 401(k) plan in 2012 is $2,500 (unchanged from 2011).

*Contributions can’t exceed 100% of your income. Special catch-up rules apply to 403(b) and government. 457(b) plans.

IRA Limits Remain the Same for 2012 The amount you can contribute to a traditional or Roth IRA remains at $5,000 (or 100% of your earned income, if less) for 2012. The maximum catch-up contribution for those age 50 or older remains at $1,000.

You can contribute to an IRA in addition to an employer-sponsored retirement plan.

But if you (or your spouse) participate in an employer-sponsored plan, your ability to deduct traditional IRA contributions may be limited, depending on your income. Roth contributions are also subject to income limits.

should contract a qualified valuation expert to restate the financial statements. By recasting financials away from tax-based accounting, a potential investor or buyer should be able to see what the profits would have looked like if the business were run like a public company.

You may have a “number” in mind of what you believe your business is worth. But are you sure it is right? It might be too low.

More often, small-business owners have an unrealistic price in mind. Among the pitfalls, business owners assume a generic multiple for their industry times annual revenue equals the selling price, or they compare themselves to a local competitor’s sale six months to a year ago. It is in your best interest to discover the true worth of your most valuable asset.

The value of your business depends on the type of business being valued and the standards used. In many cases, the purpose for the valuation determines the appraisal methods used to determine the value of the business. FEE DISCLOSURE RULES

Make no mistake about it: These rules are a game changer for an industry that has survived on hidden fees, poor service and conflicts of interest. No one knows what the unintended consequences of these new rules will be; however, we do know the intentions of these rules. The rules intend to make business owners, trustees and participants more educated consumers. The Department of Labor will no longer allow, “I did not know,” as an acceptable defense.

Congress has been working on new industry requirements for 401(k) plan vendors, and the Department of Labor (DOL) has ramped up its enforcement of existing fiduciary duties.

It is no longer acceptable in the eyes of the DOL to just sponsor a 401(k) plan without a complete understanding of your fiduciary responsibility and consistently acting on these responsibilities.

This means that you must understand what services your plan is getting and what your participants are paying for these services.

On July 16, 2010, the Department of Labor issued an interim ruling on these new rules for defined contribution plans (e.g., 401(k) plans) and defined benefit plans (e.g., pensions).

Under the Employee Retirement Income Security Act (ERISA), the regulations aim to increase plan sponsor and plan participant understanding of the fees they each pay.

There are three parts to the new rules: f Section 408(b)(2) of ERISA Requires service providers (e.g., record keepers, Third Party Administrators, Investment Advisers, Custodians, etc.) to disclose the services they are providing to the plan, the fees they are charging for these services, if they are acting in a fiduciary capacity, and any conflicts of interest they have in acting in their contracted role. These disclosures must

be made to the plan sponsor before April 1, 2012. f Section 404(a)(5) of ERISA Requires that plan sponsors disclose, on a quarterly basis, the costs that each participant is paying for plan services from their account balances in dollar and cents terms. It also changes how investment costs are disclosed and presented to participants. Each investment option must disclose the investment’s annual cost in terms of dollars and cents for every $1,000 invested. It also requires that plan sponsors report the investment options’ performance in a more user friendly format to help participants better understand the cost/benefit of each investment option. This rule will go into effect 60 days after 408(b)(2), or May 31, 2012. f Schedule C of Form 5500 Requires plan sponsors with more than 100 participants to disclose additional information about fees that are being paid to the plan’s service providers. This rule has been in effect since 2009.

Business owners should start to look at their 401(k) plans each year, just like they do their health insurance. You need to make sure you have processes in place to review your vendors and that you act on these processes. If you

haven’t received bids from outside vendors in the last two to three years, you should get in a habit of implementing this process. It will be very difficult to prove your plan’s costs are reasonable if you don’t know what other vendors charge for the same services.

Once you have evaluated these proposals, you should document your findings in a fiduciary file. Remember: Most 401(k) plans are priced based on average participant balances. As assets in the plan grow, your pricing should improve. However, most vendors do not automatically adjust their prices. It will be up to the company and the named plan fiduciary to initiate pricing changes through the plan renewal process.

Taking the time to review and update your plan before these new rules go into effect can save you time and money from the almost certain wave of employee complaints and possible lawsuits.

COST SEGREGATION Cost segregation is an effective means of accelerating tax depreciation deductions for property investors. However, the rules are complicated. In brief, they allow a taxpayer to separately depreciate components of a building that are unrelated to its “maintenance and operation” over shortened depreciation periods. In addition, these deductions are computed using an accelerated depreciation method. This allows costs to be recovered more quickly than under the “straight-line” method.

For tax purposes, the straight-line method, generally, depreciates residential rental real estate properties over 27.5 years and commercial real estate properties over 39 years. However, under IRS cost segregation guidelines, a significant portion of a building’s cost can be depreciated over much shorter periods—usually five or seven years!

Many types of building components can qualify for the shortened depreciation period and accelerated depreciation method. It would be impossible to list them all, but common examples include: f molding, millwork and other decorative elements; f carpeting and wall coverings; f partitions; f window treatments; f counters, cabinets and shelving; f special lighting,

An Example of the Benefits Below, the same amount is depreciated over different time intervals. The “original” column shows the building cost depreciated, using the straight-line method (39 years).

The “segregated” column carves the land improvements and personal property from the building cost and depreciates them over shorter periods. The result is the same amount depreciated over different amounts of time.

The benefit of doing that cost segregation is a tax deferral of $57,455, which may result in additional taxes when the building is sold. However, your current cash funds increase by this amount.

f specialized machinery and equipment, and f the costs of plumbing and electrical allocable to such equipment.

In addition, certain land improvements located outside a building may be depreciated over 15 years. Land improvements include items, such as, landscaping, fences, sidewalks, curbs, parking lots, lighting, utilities, signs, swimming pools, tennis courts and playgrounds.

When these nonstructural components are segregated and reclassified as personal property, substantial savings may be realized, depending on the size of the building and the nature of the personal property. As much as 50% of a building’s components may be reclassified into a shorter recovery period. Whether under construction, being remodeled or purchased, there are valuable tax deductions hidden in your property.

The Internal Revenue Service reinstated a form of component depreciation in 1999, and has helped investors with guidelines to determine real and personal property. When properly implemented, cost segregation is an attractive tax saving tool for reducing taxes, increasing cash flow and improving the rate of return on investment.

How to Determine Necessity A cost segregation study is an engineeringbased approach to identifying assets, within a building that can be reclassified into a much shorter depreciation class than the building itself. A cost segregation study should be conducted by a qualified engineer, as only engineering-based studies will likely withstand IRS scrutiny.

To determine if a study is appropriate, the following circumstances would apply: f Is the cost of your building at least $500,000? f Have you purchased, constructed or renovated any property since 1987? f Do you plan to retain the property for the next few years? f Do you have net income that is being taxed?

If you answered “yes” to these questions, then cost segregation could be a valuable tax benefit for you.

Insurance Premiums Paid A business can deduct certain business expenses that it has properly paid. To be deductible, business expenses must be both ordinary (i.e., common and accepted in your field of business) and necessary (i.e., appropriate and helpful for your business).

Your company may be able to deduct—as a business expense—insurance premiums paid for a variety of coverages. These include: f Fire, theft, flood or other casualty insurance f Employee group medical insurance f Life insurance provided for the benefit of employees f Business liability insurance f Professional malpractice insurance f Business interruption insurance f Auto and other vehicle insurance used for business (unless the standard mileage rate is used to figure car expenses) f Credit insurance However, if your business is the beneficiary of a life insurance policy (either directly or indirectly), it can’t deduct the life insurance premiums it pays on behalf of an owner, employee, or any person who has a financial interest in the business. How to Determine the Necessity Business valuations are needed for various reasons, i.e., determining selling price, shareholder disputes, estate planning, gift taxation, divorce litigation, allocating purchase price among business assets, and buy/sell agreements. f Estate, Gift and Trust Planning: To determine estate taxes, a value must be placed on all assets, which include the business. f Buy/Sell Agreement: A buy/sell agreement is an understanding between shareholders of a closely held business that specifies the terms and prices of a buyout when one or more shareholders want to sell. f Employee Stock Ownership Plans (ESOP): An ESOP is a retirement plan in which company stock is donated

Casualty or Theft Loss Deductions If there’s a casualty loss, a company can deduct 100% of the loss against business income (assuming there’s no insurance reimbursement). To compute a business casualty loss deduction, you’ve got to know three things: f The decrease in the fair market value (FMV) of the property as a result of the loss; f Your adjusted basis in the property before the casualty or theft (adjusted basis is usually the property’s original cost, plus the cost of improvements, minus depreciation), and f The amount of the insurance reimbursement that you receive (or the salvage value).

If your property was damaged but not destroyed, the casualty loss equals the decrease in the property’s FMV as a result of the damage, minus any insurance reimbursements. If your property was completely destroyed, ignore the FMV instead of cash. The value of the stock must be determined, annually, to establish the employer’s deduction for the contribution. f Mergers or Acquisitions: If the merger is through the exchange of stock, both companies must be valued to establish a fair exchange. f Divorce Settlements: Typically, a business must be valued during divorce proceedings. The business is usually given to one spouse while the other spouse receives assets of equal value. f Initial Public Offerings: When a company goes public, the corporation’s stock must be valued to set the initial offering price.
