WORKING INTERVIEWS really WORK? by Larry M. Guzzardo Working interviews are so widespread in the dental industry that it’s become a standard part of the interview process for most practices. At first glance, it seems like the perfect idea – why not assess the skills of a potential candidate without the financial risk of having to hire the employee to find out. Seems like everyone wins; doesn’t it? Everyone gets the concept of conducting a working interview to assess the skills and assure you don’t make a bad hire. And of course, it has to be a good idea to test someone out before you actually hire them. The key is to do it without getting into legal trouble. Once I spoke to a dental assistant who was looking for a job and said she had done an unpaid working interview for a day at a local practice, then never heard back from them. She wondered if this was legal? Great question! The answer is; probably not. While working interviews can be a good tool in the hiring process, most of the time they must be paid, and it must be done right to keep you out of trouble.

Even though the “working interview” is widespread, unfortunately, the way that the majority of dentists understand how they work is mostly based on misinformation. Because so many dental practices utilize working interviews, dentists probably assume that the practice has been vetted as the correct way to determine the skills of a potential employee. It seems logical to use a working interview to evaluate the skills of a new hire; however, the reality is that working interviews, as they are often conducted, can get you in trouble with Department of Labor laws. Temporary employment agencies actually started the concept of the working interview. It originates from the fact that employment agencies could provide a practice with multiple candidates for an available position on a “trial” basis before they were hired. If the dentist didn’t like the candidate they could simply ask the agency to send another applicant, and another, until they found the right

This system doesn’t violate employment laws because an applicant supplied by a temporary agency is actually an employee of the agency, not the dental office. Doing it this way, the responsibility to have all of the proper documentation in place fell on their employer, the temporary agency, rather than the office where they were performing a working interview. Whether we like it or not, applicants on a “working interview” are considered employees. When an individual is brought into your office to perform work that is customarily performed in your practice, they should be treated as an employee of your practice too, because legally they are. When job candidates work with patients, assist the doctor or hygienist while treating patients, answer phones, make chart notes, or do any other duty that would normally be assigned to an employee in your practice, then all of the mandatory new hire eligibility procedures and paperwork should be put in place for that person, including;

• A completed I-9 form. • Tax withholding forms. • HIPAA training should be conducted before they access personal health information, your business reports, or treat a patient. • Agreement in advance regarding wages. At least, minimum wage must be paid for their time. • Tracking of hours worked to ensure there is an accurate record of the hours worked for proper payroll processing to ensure that taxes are accounted for appropriately. • Individuals on a working interview should be given a form detailing the temporary status of their employment and indicating that the working interview does not constitute a guarantee of continued or future employment. • Acknowledgment that they have read and understood policies listed in your staff policy manual.

“…Classifying an applicant as an independent contractor during their working interview will not cover you legally either.” Unfortunately, there is no exception, even for applicants on a working interview, to any existing employment laws at the local, state, or federal level. This means if you are planning to ask applicants to go through this type of process, any individual you put to work performing the basic duties required of your employees, according to the Fair labor Standards Act, must then be treated as an employee. The only exception to paying for a working interview is when you have someone come to your office just to observe. If no work is performed by them and no training is given to them, you would not need to pay them. Do not forget that having someone who is untrained, and perhaps even a poor fit, come in for a working interview can actually be a disruption in your practice. Make sure that you are prepared to have a current team member work with them to provide direction and minimize any negative impact to your patients or staff productivity. Without all of the proper hiring procedures in place, exposing your patients to an inexperienced candidate, providing access to personal health information, and allowing them to work in your practice leaves you vulnerable to not only HIPAA violations but, wage and hour violations, and even accusations of negligence. When someone comes into your office to perform work and bypasses your usual hiring process you are also taking the risk that the candidate may become injured; steal from you; sexually harass an employee; list you as a prior employer on an unemployment compensation application; or wreaking havoc because you hadn’t run a background check to find out that they have embezzled from a prior office or even a violent offender. Even if you go strictly by the book, you run the risk that an unselected candidate could file a complaint

It may seem like overkill to pay someone for just one day of work but by the time you account for taxes owed, fines, fees, penalties, the risk of an injury to occur that will not be covered by your workers compensation insurance, as well as the potential for an audit by the Department of Labor or IRS because of the applicant’s claim, plus the amount of time you’ll have to spend to settle any such case, the overkill can begin to compile quickly. Compared to this, following the rules seems too easy. Classifying an applicant as an independent contractor during their working interview will not cover you legally either. There are strict laws that indicate who can and cannot be treated as an independent contractor, and few, if any, positions in a dental practice are likely to meet the criteria. This also holds true for paying an employee in cash or offering them a gift card for their time. If the candidate is performing work that would routinely be completed by an employee, the candidate must be properly classified and paid as an employee of your practice according to the Fair Labor Standards Act. Most dentists do not believe that they’ll get caught holding working interviews. Unfortunately, I’ve worked with too many dental practices who found out the hard way how this practice can come back to haunt you in the end for me to promote another approach.

potential risk and ultimate costs associated with having a working interview, is the reason why I recommend that dentists learn to get the information they want through other proven effective methods such as behavioral interviews or having candidates perform a skills test. Everyone knows what a traditional interview is like – the employer asks candidates a series of questions in order to glean some insight into their personality and ability to fit in with the organization. We’ve all been through this before. Usually the questions asked are hypothetical in nature (“Tell me how you would handle a rude patient?”) Or abstract, (“Tell me what being in the dental profession means to you?”). And because of this all too well-known structure, candidates will answer these questions based on what they think the interviewer wants to hear… the “perceived” correct answer. By asking situation-based questions you’ll get a better picture of how a candidate has performed in a particular situation based on past performance, which is the best indicator to how they will perform in the future. Situational questions are centered around a specific situation unique to your office and how the candidate handled that situation in the past. The concept is to construct your interview questions around the situations that you would like to know can be handled by the candidate and ask them to describe ways that they have handled those situations in the past. Situation based interview questions are open-ended and require attention to detail. They cannot be simply answered with a reply of “yes” or “no.”

What can you really learn about someone’s skills in a single day anyway? I have found that you are not going to learn anything more about a candidate in a single day of work than what that candidate wants you to know. Even the chronically late individual has the ability to show up on time for their interview. For the most part working interviews don’t usually work out the way you want them to. Considering the

Technical Ability: Question: “Tell me about a time when you had difficulty getting an x-ray on a patient who gagged, and your first attempt did not work. How did you proceed?” Question: “Tell me about a time when you struggled to communicate with a patient. What was the situation? How was it resolved?”

Patient Oriented: Question: “Give a specific example of a time when you had to address an angry patient. What was the problem and what was the outcome? How would you assess your role in diffusing the situation?” Question: “Tell me about a time when you failed at something related to your job. How did you deal with that situation? We were able to rectify it? Why or why not?”

Detail Orientation: Question: “Tell me about a job or setting that required great attention to detail to complete a task; how did you handle that situation?”

The Skills Test: If your goal of a working interview is to evaluate your candidate’s ability to perform certain job tasks, there are ways to do that without having them interact directly with patients and without exposing yourself to potential legal claims should you decide not to hire the candidate. I am talking about a skills test, which involves having candidates demonstrate their technical proficiency at a certain task without having them perform actual work on patients at your practice. Skills tested during the interview process should be specific to each position being considered, and they should give you an idea about a candidate’s ability to think on their feet and complete specific duties that will be required of them if hired. The following are examples of tests you can use to determine if a candidate has the necessary skills required for an available position.

Listening Skills: Question: “Describe a situation in which you effectively “read” another person and reacted according to your understanding of his or her needs and values.” Question: “Have unforeseen problems or obstacles with a patient ever caught you off guard? How did you respond to the situation?”

Front Office Positions:

Treatment Room Set Up: Instead of having an applicant set up a treatment room for an actual patient, show them one that is already set and asked them to duplicate the set up in another treatment room. It would be okay to help them navigate your office for the appropriate instruments, equipment, and materials, and you could also ask them to walk you through the process verbally and explain why each step is necessary as they executed.

Typing Test: Any member of your staff will need to be able to take accurate notes while talking to patients, ask them to transcribe something as you talk and evaluate their performance. Even better, play the role of a pretend patient and act out a conversation that would be similar to what they might expect to deal with when interacting with live patients.

Sterilization and Cleanup: Arrange a treatment room as if it had just been used with a patient and ask your potential candidate to demonstrate how they would go about putting everything back in order. Ask them to explain which instruments and pieces of equipment need to be sterilized after procedure and demonstrate how to sterilize those items properly (tell them how to use your sterilizer if they have never used the model before, but not before they’ve explained the steps in the sterilization process). Patient Walk Through: Have the applicant walk you through a complete new patient process without giving them access to an actual chart. You can even act as the patient yourself, another staff member could play the role, or you can just have a “pretend invisible” patient for the exercise. Have them escort the “pretend patient” to the treatment room, demonstrate how they would take x-rays, gather patient history and basic information, etc. You could even step in and act as the dentist to perform a mock procedure in order to see how they might perform in a situation that involves treating an actual patient. A Mock Procedure: By using another team member, a set of dentures, a model, or a pretend patient as your subject, ask your applicant to walk through and demonstrate the steps they would take to complete a specific procedure, such as a full mouth debridement or application of a sealant, etc.

Patient Records: Have your applicant walk through the process of setting up a new patient chart, step-by-step. This might require for you to explain a little about your practice management software or procedures that are unique to your office. Still, you can get a good idea of an applicant’s familiarity with the process by asking them to demonstrate how they perform the task in other positions they have held, or have them explain the most important parts of the process along with why they are important. Coding and billing: For positions that require knowledge of insurance codes give the applicant a fictitious chart and ask them to demonstrate the billing and insurance submission process for the treatment performed. Scheduling: Provide your applicant a handout indicating a few basic procedures with doctor and assistant time listed and ask them to create a schedule for you. Mentoring role-play: Ask your applicants to outline their mentoring and disciplinary strategies, the present typical situations that would occur in your office for them to address (discussing a new employee’s chronic tardiness and or a senior employee’s poor performance, for instance). Play the role of the employee and ask your applicant to have the necessary “tough conversation” with you.

During these last few moments put the emphasis on making a positive, lasting impression. Thank them for participating and if they are not going to be offered a job, rejecting an applicant with dignity is part of a positive hiring experience and can form a lasting impression of you and your office.

Just as the first few moments create a long-lasting impression; so do the last few. Don’t let the day end without bringing it to a successful conclusion. If there hasn’t been an opportunity for the applicant to ask any of their own questions, give them the opportunity now. As the employer you could start things off by simply asking; “What questions do you have for me?” Ask the applicant for references that can verify their performance. If you asked them to bring a resume, the prepared applicant will have everything ready for you. Then let them know you’ll be contacting the
