Questions concerning the outcome of the medical legislation currently before Congress, DUH UHFHQWO\ WKH PRVW RIWHQ DVNHG RI RXU RIÂżFH I can give you the all too often used lawyer’s answer, “it dependsâ€?. If you have never been turned down for a PHGLFDO FHUWLÂżFDWH \RX FDQ WDNH advantage of the current sport pilot, driver’s OLFHQVH PHGLFDO 7KDW LV \RX FDQ Ă€\ D OLJKW sport plane, as long as your state’s Department of Motor Vehicles would allow you to drive a car. While DMV does not conduct a medical for most driver’s licenses, they do disqualify certain driver’s for severe medical conditions. Since there have been no accidents due to pilot medical incapacity in the sport pilot area in the eight years following its enactment, the research is overwhelmingly good. If you have been turned down for any class medical, this option is not available as it now stands. There are currently two bills making their way through Congress that are designed to eliminate the third class medical for certain Ă€LJKW RSHUDWLRQV 7KH )$$ ELOO LV PXFK PRUH restrictive than the Aviation Caucus bill, but both would ease some of the requirements. The rational is simple, right now every pilot selfFHUWLÂżHV WKHLU DELOLW\ WR Ă€\ HYHU\ GD\ IROORZLQJ their medical exam day. If you develop a condition that would disqualify you, one day after taking your exam, it would be up to the pilot to ground himself or herself. Depending on which Bill passes and what changes are made to it, it is premature to guess how much less restrictive the new law will be, so stay tuned and stay healthy. Understand that the FAA was given 90 days to promulgate this new standard, and that was over 9 months ago. You might ask, what if a pilot was denied a medical for some condition in the past and then clears the condition and is granted a new medical. I’m glad you asked. Under those conditions, a pilot is not deemed to have been denied a medical for the purposes of the sport pilot license. The clock starts running again, and the denial must be for your most current medical.

There is nothing in the FAR’s that prohibit a straight in approach ZHOO VRUW RI UHDG RQ :KHQ WUDIÂżF is heavy, a straight in approach can be downright dangerous, and is certainly rude. The AIM covers the proper way to approach a non-towered airport, calling for a 45 degree entry into downwind, followed by a base DQG ÂżQDO JLYLQJ UDGLR FDOOV DV QHFHVVDU\ WR NHHS WKH WUDIÂżF LQ WKH DUHD DSSULVHG DV WR \RXU position. The AIM is not regulatory, meaning WKH )$$ FDQQRW FLWH WKH $,0 DV WKH VSHFLÂżF violation they wish to charge. However, the )$$ FDQ FLWH WKH $,0 WR GHÂżQH ZKDW LV WKH “best practiceâ€?, and often does. In the case where an aircraft truly causes a dangerous situation, the FAA will often cite a violation to Section 91.13 of the FARs (operating in a reckless or negligent manner). 7KH\ ZLOO WKHQ GHÂżQH QHJOLJHQW PDQQHU DV being your operation outside the scope of the best practices as outlined in the AIM. So while the AIM is not the violation VWDWXWH WR EH FLWHG LW GHÂżQHV WKH PRUH EURDG section of the law in §91.13. The FAA has clearly cautioned about the use of straight in approaches at non- towered airports in AC9066a, where they remind pilots that a straight in maneuver is only to be used when it would QRW GLVUXSW WUDIÂżF LQ WKH SDWWHUQ Also remember, landing lights ON and VXIÂżFLHQW XVH RI &7$) FDOO RXWV IRU DOO operations near the airport, as well as the right of way rules of FAR §91.113. In the perfect world, we would hope that all pilots would use the safest and best practices in operating around the airport. But we humans do not always live up to those standards. Sounds like you made the prudent maneuver while in the air and saved the conversation for the ground. Good form. It is up to the pilot population to help police those kind of activities and avoid stupid pilot tricks.
