As 2024 opens, owners of small businesses that include self-service laundries may find themselves facing new rules that will have a direct impact on their operations.
The National Federation of Independent Business (NFIB) recently hosted “The 2024 Small Business Landscape — Legal, Regulatory, and Economic Updates for the New Year,” a webinar designed to shed light on some of the new rules that have been, or soon will be, put into place.
“Many of these are rules that I will say at the outset that NFIB has opposed or worked to lessen the impact on small businesses,” says Beth Milito, executive director of the NFIB’s Small Business Legal Center, “with some areas finding more success than others.”
JOINT EMPLOYER RULE
The new Joint Employer Rule, which at press time was set to go into effect Feb. 26, applies to those businesses where an employee might be considered working for more than one company in their position.
“Concerted activity is activity to improve working conditions, so that’s a very broad term,” Milito says. “The National Labor Relations
Act confers on all employees and the private sector to engage in concerted activity. So that gives the NLRB the ability to regulate your business, whether or not you have unionized employees who belong to a union or have signed a collective bargaining agreement.”
The Joint Employer Rule states that if a business other than the main employer has any authority to control certain employment terms, it will be considered a joint employer.
Some of these terms include wage, benefits and other compensation; hours of work and scheduling; assignment of duties; work rules and direction, including grounds for discipline; tenure of employment, including hiring and discharge; and working conditions related to the safety and health of employees.
Under the new rule, more businesses will have to bargain with labor unions and may be subject to union picketing and boycotts, as well as unfair labor practice claims, Milito says. Franchises may have to choose between reducing a franchisor’s involvement in a franchisee’s operation or opening themselves up to collective bargaining and litigation. Businesses that rely on staffing agencies or other firms to provide temporary or seasonal labor may also be subject to this rule.
Evaluate your agreements—especially franchise agreements—to determine if another business may have authority over any of the listed employment terms, Milito suggests. Closely examine your training

materials or any other documents to ensure that you have not accidentally created a joint employee relationship. When in doubt, contact an attorney to help in your review.
“This is a way for the NLRB to find more than one business liable for labor law violations,” Milito says. “So, this is challenging for small businesses and for subcontractors, too.”
EMPLOYEE RETENTION TAX CREDIT (ERTC) RESET
“Many small businesses received relief credits through the Employee Retention Tax Credit (ERTC),” Milito says. “This was a COVID program that started in 2020 and received a lot of attention. It really was a lifesaver for many businesses.”
While the program helped many who needed it, it was also a target for those with less-than-honest intentions.
“Unfortunately, there was a bit of fraud that occurred with the program and, frankly, the IRS became overwhelmed with ERTC claims.” Milito says. “As a result ... the IRS paused the processing of ERTC claims. The IRS, despite what some news reports have said, did not stop the program or cancel it — it paused the processing of the claims.”
“They’ve taken this pause period to hire and train additional employees and also to put out a lot of publications and help for small businesses that might have filed claims that were ineligible. So, there’s a process now for businesses who maybe filed an ERTC claim and now think they might not have been eligible. These businesses can go back and fix claims.”
The IRS, Milito says, will resume the processing of the claims, which can still be filed through April 15, 2025.
“They’re going to go in the order received, and I heard that’s the exact phrase a Treasury official used,” Milito says.
UPDATED FORM I9
The U.S. Citizenship and Immigration Services (USCIS) has published a new simplified version of the Employment Eligibility Verification form, Form I-9, used to verify identity and eligibility to work in the United States.
“This is the form that has been around since the 1980s,” Milito says. “There’s no exemption for small businesses for filling out the I-9. An I-9 must be filled out for all employees hired — and that’s employees, not independent contractors.”
WHO’S GOING INTO OVERTIME?
“Currently, under the U.S. Department of Labor’s overtime rule, employees who are making $35,000 annually can be exempt from overtime,” says Milito. “In a proposal the Department of Labor issued, the overtime threshold would increase from $35,000 to $55,000.”
That’s a significant jump, she says, “particularly considering that the overtime threshold was just increased in 2019 from $23,000 to the $35,000 that we now have.”
Milito added that the NFIB opposed this proposal: “I know we had many members who also filed comments with the Labor Department expressing a concern about the impact this would have on their business. Many of you may have managers or assistant managers or salaried workers that earn under that $55,000 threshold.”
Milito believes that the final ruling on this proposal will be issued around June 1.
“One thing I’m encouraging business owners to do is to make sure

they are in compliance with the existing overtime rule,” Milito says. “It’s always a good idea to, on occasion, perform a wage and hour audit.”
She also says that employers should understand the differences between exempt and non-exempt employees, and make sure they’ve structured their pay practices accordingly.
Non-exempt employees are paid for actual hours worked; must keep records of time worked, e.g., time sheets or time cards; must earn at least minimum wage for all hours worked; and are entitled to overtime for any hours worked over 40 in a seven-day workweek at rate of 1.5 times regular rate of pay.
Exempt employees, on the other hand, are paid regardless of quantity or quality of work; have no limit on the number of hours that employee may work or be required to work per week; have no minimum wage requirement; and have no overtime requirement.
INDEPENDENT CONTRACTOR RULE
“The new Independent Contractor Rule is another Department of Labor rule that will impact many, many small businesses,” says Milito, “because what business does not have a contractor or an outside vendor?”
The proposed regulation would mean that more workers will be classified as independent contractors, Milito says, “so this is another area where an audit in your business would be a good idea.”
A key element of the proposed rule would be a “totality-of-thecircumstances” analysis to determine whether a worker is economically dependent upon an employer for work, versus being in business for themselves, under the Fair Labor Standards Act (FLSA).
“Let’s use an example of an IT person,” Milito says. “They started out as a contractor coming in once a month, then they were coming in several times a month. And now that person is in your office, sitting at a desk next to employees. To an outsider, it would look like they were an employee of your business. That’s a situation where you may want to think about putting the individual on payroll as a W-2 employee.”
The proposed Department of Labor rule would make it more likely that more workers will be classified as “employees” for purposes of the Wage and Hour laws.
“So that means they could potentially be eligible for overtime,” Milito says. “You don’t want to have misclassification of either exempt versus non-exempt employees or employees versus independent contractors. Wage and hour classification mistakes are expensive to fix.”
MINIMUM WAGE UPDATES
A number of states and metropolitan areas updated their minimum wage requirements as of Jan. 1. These include Alaska, $11.73; Arizona, $14.35; California, $16.00; Colorado, $15.69; Connecticut, $11.73; Delaware, $13.25; Hawaii, $14.00; Illinois, $14.00; Maryland, $15.00; Maine, $14.15; Michigan, $11.73; Minnesota, $10.85; Missouri, $12.30; Montana, $10.30; Nebraska, $12.00; New Jersey, $11.73; New York City, Long Island and Westchester, $16.00; New York (remainder of state), $15.00; Ohio, $10.45; Rhode Island, $14.00; South Dakota, $11.20; Vermont, $13.67; and Washington state, $16.28.
“The state minimum wages are always available on the U.S. Department of Labor’s website and they keep this updated all the time,” Milito says. “The (DOL) also has a good webpage that has break and meal break laws, too, and break it out by state. There’s actually a lot of helpful information on the … website, and I don’t say that about all federal agencies.”

CRAFTING CREATIVE SELFSERVICE LAUNDRY PROMOTIONS
Wouldn’t it be great if there was one easy promotion that would bring in as many customers as you wanted?
But there are all kinds of people out there with all kinds of needs. Different people respond to different promotions, so it’s best to create a variety of promos and switch them up from time to time.
The word “free” is a real attention-getter but the public has grown wary of it. They know there are usually strings attached.
Same thing with percentage discounts or even price drops. You may get some who will try out your promo but if it isn’t a true deal for them, they’ll be disappointed.
Not all successful promotions involve giving price discounts. For instance, you may want to hire a popular costumed character to appear at your mat to entertain the kids as well as their parents with laundry.
Let me to cut to the chase. The promotions that will truly boost your bottom line are those perceived as real honest deals.
Case in point: Saturdays and Sundays are probably your busiest days, so it’s a good idea to offer senior discounts on Wednesday, since most can come any day of the week. The seniors will know it’s a true deal for them. You can do the same with other groups, like first responders or college students.
This also goes for things the customer “earns,” such as “early bird specials.” If they qualify for the deal by coming in early, they know it’s genuine.
Lots of promotions will get folks in the door but how do you get them to come back? If you want to retain as many “promo people” as possible, you need to make your mat stand out from your competitors. You need to have an awesome mat.
And by awesome, I mean it’s big, beautiful and clean, with all equipment working well, and a friendly crew. When you

have that, a creative promo isn’t as important in the first place. An awesome mat is your single best promotion!
It’ll generate good word of mouth, plus positive reviews online, and your business will grow automatically. But what if you can’t make your mat as awesome as it can be? Then you have to get a little creative.
THINGS THAT REEL THEM IN
It seems like a long time ago when some mat owners would offer free dry. They’d jack up the wash price just to get the words “Free Dry” out there. These stores saw success in the beginning but the strategy ruined markets because competitors joined the show and then no one was special anymore.
Instead of offering free dry, how about trying a “free laundry day” event? You could try contacting the LaundryCares Foundation, which is skilled at organizing such efforts. They know how to do these events and can sometimes get the local press or TV station to visit your mat. It’s just one day and they are usually very popular.
You can even try organizing a “Free Wash Day” yourself. You’ll have to come up with some bucks for extra help, free food, some prizes, and the time and energy to manage the hectic day.
Be sure to promote your event starting a month or two ahead of time. The day will cost you, but your good deed will go a long way in your favor.
WHAT’S A LOSS LEADER?
Large retailers have been using loss leaders for decades. They load up on a popular item and sell it at a price so low that it brings people in while hoping that customers also buy other items with a higher markup while there.
The best loss leader I ever used was putting my smallest group of washers on sale for a low price, but for cold water only and with one rinse instead of two. I made every double loader $1.50 when the regular double loaders cost $2.
Not a huge discount but cheaper than my competitors, and I discovered many customers chose a cold-water wash just to save 50 cents! Most of them would also use the big washers or the hot-water machines as well, but it was the
$1.50 promo that drew them in.
If your sale washers are located in the back of your mat, so much the better. Customers will have to pass up more desirable machines to get to the specially priced ones, possibly choosing the higher-priced washers along the way.
THINGS THAT KEEP THEM COMING BACK
Paper Whites — They are small bulb plants, similar to daffodils, aka Narcissus. One day, I discovered a bag of Narcissus bulbs at home and brought them in to one of my mats.
I lined the bottom of a nice, clear glass bowl (a deep serving tray can do) with white marble rocks, filled the bowl with water, and placed about seven bulbs on top of the small rocks. As time passed, the plants took root and grew!
The display initiated a lot of friendly conversations. Each week, customers would come in to see their progress. They were beautiful, interesting and uplifting, and customers liked seeing them, especially since it was mid-winter at the time. Remember, promotion isn’t always about dollars and cents. People like to dwell where they feel good.
The “Surprise” Free Wash — If you want to create excitement and get people talking about your mat, introduce the “surprise” free wash.

I learned of this idea decades ago when I read about a mat out west doing it.
The owner wired a switch behind every coin slide in his store, all leading to a carnival-like metal control box that had chaser lights, a bell, and a flashing “FREE WASH” sign. Randomly, his control box would ring and flash if a lucky customer pushed in the right coin slide.
I didn’t have the level of expertise to build a contraption like that, so I did something similar, albeit not as exciting. I stuck “Free Wash” stickers on our single-use vended laundry products when I loaded the vending machine. I made up a sign that said a free wash would be randomly marked on the vended boxes, and the customer could turn in the winning box for their free wash. This promo improved my vended sales plus created a little buzz of excitement.
CREATING THE PATH OF LEAST RESISTANCE
Humans tend to seek the path of least resistance. One of my greatest promotions wasn’t technically a promo per se, but an infrastructure strategy to make my mat more convenient for customers. Once set up, there was literally no
more expense beyond maintenance.
For drop-off customers, it was the walk-up window. We installed a bell outside the window to alert us when a customer was there. My mat was located on a busy commuter road, with a bus stop only a few feet away.
A vehicle would quickly pull into the bus stop and the customer would quickly jump out to drop off or pick up. Besides offering them convenience, it turned out to be terrific advertising for us. The visual of a customer standing on the sidewalk performing a transaction was hard to duplicate with signs.
For self-service customers, a similar convenience would be automatic doors so they can easily walk in pushing a cart or carrying bags filled with clothing.
PROMOTING THE PROMOTION
Most of your promos should be advertised in advance. It can take weeks, sometimes months before a good percentage of people in your trading area become aware of them.
Naturally, the more you shout it out, the more people will become aware and ready to
try it. So a “coming soon” approach is good for creating excitement and anticipation.
Lastly, if you really want to get your message noticed, you might try spreading the word in a unique way. I had good success with a cold air balloon.
Sometimes called a rooftop balloon, this is a big balloon installed on your roof that looks just like a hot-air balloon. In the right situation, it can be seen from miles away. You can have a banner attached to the balloon with any message you want.
There are a couple of caveats: Some building codes won’t allow them, and you’d better have it anchored well in case a strong wind blows through. I think it’s best to have a balloon rental company handle everything for you.

PAYRANGE, KIOSOFT SETTLE MOBILE PAYMENT TECH PATENT DISPUTE
PayRange Inc. and KioSoft Technologies have settled a four-year patent dispute over mobile payment technology used to enable consumers to pay self-service retail machines such as laundry and vending machines, the companies announced via a press release.
PayRange had alleged that KioSoft and its affiliate, TechTrex, had infringed on numerous PayRange patents. KioSoft has agreed to license PayRange technology that could exceed $62 million over a 10-year period based on outcomes with a base license of $40 million.
While KioSoft had challenged the PayRange patents vigorously, the Patent Trial and Appeal Board (PTAB) upheld them.
“Although we disagreed with the result, we must now accept that PayRange has valid claims,” says Charles Lee, president of KioSoft. “We respect the technologies that have helped the self-service industry thrive; and we look forward to continuing to lead innovation and development by providing best-in-class service to our customers with this fully licensed technology, without any further legal distractions.”
PayRange has developed technology that empowers consumers to pay unconnected self-service machines with a smartphone, which has provided significant improvements in convenience, improved sales for machine owners, and reduced operating costs. The earliest patents date back to 2013, which PayRange says makes it a pioneer in the space.

WHIRLPOOL CORP. TO ADD WIND, SOLAR POWER TO WASHER PLANT
Whirlpool Corporation has entered into agreements with One Energy to add onsite wind and solar power at two of its manufacturing operations, including one where its single-load washers are manufactured, the company reports.
Wind and solar power will be added to its Ohio operations in Clyde, where the washers are made, and Findlay.
They are among the largest behind-the-meter renewable energy projects in the United States, Whirlpool says, and once complete will ensure the Clyde and Findlay plants receive at least 70% of their energy needs from onsite renewable energy.
The expansion involves three additional turbines at Findlay, bringing its total number of onsite turbines to five. This will be the first introduction of onsite renewable energy for operations in Clyde, with the construction of three turbines. A ground solar array will also be installed at each location. The projects are expected to be online and operational by early 2025.
The two combined will create 40.8 megawatts of renewable energy, bringing Whirlpool into the top 25% of companies on the Environmental Protection Agency’s national Green Power Partnership list.
ACI UNVEILS ‘PACKETS UP!’ SPANISHLANGUAGE SITE
The American Cleaning Institute (ACI) has launched a Spanish version of its Packets Up! Webpage. Now in its 11th year, the Packets Up! effort works to help reduce the number of unintended exposures to liquid laundry packets among children at home and in laundromats.
The new webpage features a whiteboard video, safety clings, “Store not Décor” campaign, safety tips, activity sheets and more.
Safety clings that can be attached to cabinets or washers are also available in Spanish and are free by request.

EQUIPMENT MANUFACTURER PROMOTES PELLERIN TO VICE PRESIDENT
Commercial and industrial laundry equipment manufacturer Pellerin Milnor Corp. reports it has promoted Brock Pellerin to company vice president, effective immediately.
Pellerin formally began his career with Milnor in 2006 as a member of the Application Engineering Department, but spent numerous summers throughout his life working in the mailroom, the Human Resources Department, and on the factory floor. The experiences helped him cultivate a deep understanding of company operations.
In 2013, Pellerin was promoted to regional sales manager, supporting Milnor’s dealer network with his industry expertise.
Pellerin’s responsibilities as vice president include fostering system sales throughout Milnor’s dealer network, and his goal is to utilize his knowledge and expertise to continue growing sales of Milnor equipment in North America.

ONDEMAND SERVICE HAMPR LAUNCHES COMMERCIAL VERTICAL
Peer-to-peer on-demand laundry marketplace hampr, based in Lafayette, La., reports having launched its commercial vertical, providing businesses with flexible outsourced laundry options.
“With our commercial offering, business owners no longer have to choose between handling laundry personally or relying on larger service providers,” says hampr CEO Laurel Hess. “Now, they can liberate themselves from inflexible contracts and scale their laundry services seamlessly.”
A hampr representative schedules a pickup time (recurring or ondemand) at the user’s convenience. Professional and vetted “washrs” handle the pickup and ensure the linens are cleaned with high-quality detergent per user specifications, then the cleaned linens are returned fresh and folded the next day.
The company’s commercial offering gives stay-at-home parents, caregivers and retirees a steady and flexible income stream, allowing them to generate income from home. The washrs go through rigorous background checks, hampr says, similar to those for school teachers to ensure a high level of trust.
Beyond receiving service, choosing hampr means contributing to and supporting community members, the company adds.
