ecruiting and retaining members is vital to everyone involved with the Austin Apartment Association. Owner/management members join to be able to use the Texas Apartment Association lease and forms, take advantage of the education opportunities and have access to a list of vendors who understand the rental housing industry. Suppliers members join to network, find new clients, and grow professionally…and personally. Supplier members: to get the most out of your membership, you must attend committee meetings and events; mingle and introduce yourself to other members and potential customers. Events are a great time to meet many onsite team members, but to make the event networking easier, find a committee or two that sounds interesting and attend the meetings. Make a goal to meet one or two people every meeting and before long you will have built a nice network of fellow members. Check the calendar in this issue or go to the AAA website to find dates and time of upcoming committee meetings. New member, or seasoned member, you should take advantage of our Association 101 sessions. The informal sessions are designed to help new

classes was easier for me because, (sitting next to someone for three hours), it was easier to strike up a conversation. Letting people know you are new to the committee or the association is important. The coolest thing for me was when I attended events like Vegas Night, I recognized people I had met through classes and committee meetings. Guess what, I had someone to talk too and they welcomed me. For the record, I attended majority of these things by myself because the onsite team members I worked with were not active. This was very uncomfortable and out of my comfort zone, but by staying in your comfort zone will not allow you to grow. If you are a supplier and want to find new business leads get involved and get your name in front of the membership as many times as possible. Owner members, you too have to get involved by attending various events. Networking is the key to building success out of your membership!

Industry UPDATE SWIMMING POOLS AND TAX REFORM By Paul Cauduro, AAA Director of Government Relations
City of Austin Dives in With New Swimming Pool Inspections
...new policies and procedures for swimming pool inspections and permits
Last year, AAA members hosted a meeting with city of Austin officials to discuss the Change of Ownership Swimming Pool (CHOW) Inspections and how these inspections cause confusion and frustration among property owners and property managers. The City has decided to alter their inspection procedures, and will implement new actions related to property ownership changes and swimming pool code compliance this April. At issue are swimming pools at apartment communities (and hotels) that have been honestly operating for years, but when the property ownership changed they received a new, full code compliance inspection and the pool was shut down because many code items were found to be out of compliance. Major items were often flagged for non-compliance, and new property owners faced shockingly high costs to bring the pool into compliance before the City would
issue a new permit and re-open the pool for resident use. CHOW inspections are unique to Austin and similar inspections are not performed by other Texas cities. City officials explain that only in recent years has the city enjoyed the luxury of having swimming pool code inspection specialists. Up until a few years ago, the code inspection department worked essentially as a single unit with inspectors dispatched for a wide variety of heath and property code compliance inspections. As a result of both the complexity of the swimming pool code and the high demand for city inspection services, it seems that many code items may have been simply overlooked by well-intentioned, but not fully specialized, city inspectors. Some of the major code violations cited during CHOW inspections include: location of waterfall features and landscape planters, zero-entry slope angles, the distance between ladder steps and the rise and run of the pool’s stair step entry. At the AAA meeting held with city officials the code inspection staff
emphasized their municipal obligation to enforce the pool code but they also expressed a willingness to find a solution that would allow property owners to keep the pool open and operating while correcting code violations. As a result of this initial and subsequent meetings with the City, the City of Austin Public Health Department (formerly Health and Humans Services) crafted new policies and procedures for swimming pool inspections and permits. The new inspection will involve CHOW-type inspection given to all swimming pools during the pool’s annual inspection. This annual inspection will be done using new inspection forms that clearly indicate all items inspected. Pool owners and operators will receive a complete listing of inspected items. Only critical life-safety items found in non-compliance such as those related to the Suction Vacuum Release System (SVRS) and main drain covers and grates will result in pool closure. Any other items found in non-compliance that are deemed not critical to life safety, such as distance between depth markers and the distance of the wading pool from the pool, can be addressed by the pool owner without any re-inspections. When a property changes ownership, all items on the form must meet compliance. In this manner, as part of the due diligence efforts taken prior to purchasing a property, potential buyers can review the most recent pool inspection form to know what repairs and upgrades will be needed in order for the pool to be fully compliant and in legal safe harbor with state pool standards. The changes are slated to begin April 3, 2017. It should be noted that in conjunction with these new inspection procedures, the City will renew enforcement of the minimum separation distance between two or more suction outlets. The City suspended enforcement of this item in August 2016 to avoid summertime pool closures and in anticipation of

asset if, instead of selling their property, they exchange it for another comparable property. These rules encourage property owners to remain invested in the real estate market. · Preserve investment incentives. Borrowing is a central part of how apartment housing is financed and without business interest deductibility, the cost of debt financing would increase and shift many real estate business models thereby and inhibiting development activity. · Take care when making changes to cost recovery rules like depreciation so that changes do not harm real estate investment. · Protect the Low-Income Housing Tax Credit (LIHTC). The LIHTC is the central vehicle producing housing for moderate- and low-income families and this program must remain a vital part of the strategy to address our nation’s housing needs.

NAA Capitol Conference Focused on Tax Reform On March 8, apartment industry professionals from all over the country will convene in Washington, D.C., for the NAA Capitol Conference. This is the industry’s largest advocacy event and is dedicated to educating grassroots activists on key issues and mobilizing them to advocate with their members of Congress. As NAA’s Greg Brown, Senior Vice President of Government Affairs, recently wrote: “Tax reform is front and center on the congressional agenda, and there is a real chance it will become law this year. The last comprehensive tax reform legislation was the Tax Reform Act of 1986 (TRA 1986) signed into law 30 years ago by President Ronald Reagan. We all remember how that bill devastated the industry for years, so it is imperative that we engage with policymakers to ensure a more positive outcome.” While engaged in the tax reform effort the NAA has established these primary objectives and priorities
to ensure that any reforms made will promote economic growth and investment in rental housing without unfairly burdening apartment owners and renters relative to other asset classes: · Protect “flow-through entities” (e.g., LLCs, partnerships, S Corporations, etc.), which are the dominant business structure in our industry. · Maintain “like-kind exchanges” where property owners can defer tax on the gain on sale of an

Meagan Johnston Regional Property Manager, Greystar I think creating the team environment is important. We work together and I cannot accomplish my duties without them. Their success is my success and their failure is mine as well. My team knows they are capable of making decisions as long as I can see a thought process. If it’s a wrong decision, we turn it into a learning situation. I believe sharing that responsibility helps them feel valued, trusted, and appreciated. To me it doesn’t take a lot to show appreciation and that we are all a part of a team. Hearing them out Listening to your team’s concerns and hearing them out goes a long way. It’s the Little Things I love when I get the chance to get a coffee or tea with my team or take them out to lunch to thank them. This is not only getting a chance to show my appreciation for them, but also is fun to have that time away from the office with them.

Asset Management, LDG Development Employee appreciation is important because what gets rewarded, gets repeated. Acknowledging someone goes a long way in retaining good employees. When people feel appreciated, it helps them feel a part of something bigger. You have to be careful not to overreward your employees because the kudos then lose their luster. I feel the non-monetary things make the biggest impression. In the more-better-faster social media society we live in, we often forget to acknowledge when someone does something great or went above and beyond. Make a phone call, (or an in-person visit), to tell the individual thank you and let them know they did an awesome job. Send e-mails praising them amongst their peers. Send hand written thank you cards – if it was a team effort, ensure every team member’s name is on the card. We pay for our employees to take their NALP, CAMT, CAM and CAPS and take our managers and regionals to the TAA Education Conference as rewards. Both are win-win situations; the team members get a break from their property, get motivated and bring new ideas back to the site. When a team member does something big that deserves a nice reward, we try to purchase that employee something they can enjoy for themselves and/or family. For example, last year we bought a manager and her family some awesome tickets to a Houston Texans Game. They are die hard Texan fans and would never spent the money for seats in a great Location. She is still talking about those tickets.

I’m fortunate to work for a company that values its employees from the top down. This is not just for our internal employees, but also our field employees who are out working for our clients each day. It all starts with a positive mindset and keeping a positive mindset even when the going gets tough. I believe that, (even when a mistake is made or a teammate is having a bad day), you need to be there to lend an ear, give helpful advice, and offer ways to learn and grow from an experience. I sincerely feel that a pat on the back will go much farther than a kick in the tail, especially when you are encouraging your team. Also, just doing the little things to show your appreciation. A simple “thank you” or letting a team member know you appreciate them and their hard work can go a long way. Instilling the sense of being a team and working together on a goal together is so important to our success here. And as a supervisor, it is our goal to keep the team focused, upbeat, and maintaining a positive and winning mindset. We often say around here, “Teamwork makes the dream work!” Of course, breakfast tacos or pizza for the team isn’t a bad way to show your thanks either.

I also believe in giving credit where credit is due, whether it be for an idea, a contribution, or an achievement. For example, when one team comes up with a creative outreach marketing idea, I like to share it with all team members and managers. I will send pictures, share their story and how they executed the idea. No success can be achieved without a team effort and collaboration. If our teams succeed, we all succeed. Recognition is not just about awards; it is about finding what is rewarding to that individual and providing it. We all understand that people have different motivations. Sometimes it is public recognition, sometimes it’s a trophy, sometimes it’s money and sometimes other gifts are more rewarding. A gift doesn’t always have to be something physical. Give your time, be a sounding board, or just provide affirmation on a decision an employee has made. Your time may be the most difficult gift to offer. As a leader, you may not be present all the time, however be available when needed, be available when there are major changes and make sure your staff know your door is always open.

An overflowing water heater‌at 3:00 a.m. These are maintenance emergencies; tasks that are best left to your maintenance professionals. In the best of times, your maintenance crew will be touching up paint in a rental model, fixing a broken ice maker, or switching out smoke alarms. Again, jobs best left to the professionals.

Ask any maintenance tech in the business and you’ll probably hear they have plenty on their to-do list without getting a request to change out a lightbulb in their inbox. Plus, giving your residents the green light to perform light-duty tasks might cut down on emergency requests during off hours. While not everyone is mechanically inclined, or should be allowed to get within three feet of an Allen wrench, here are a few maintenance requests your residents should be able to handle.
Do’s Filter changes
Most indoor A/C units have a filter base in the A/C closet and are easily accessible by a resident to change out their filters on a monthly basis. If the air handler is a ceiling mount unit, the filter housing will typically be overhead with two latches. It’s a good idea to keep various filter sizes in the office so residents can request them when they pay rent.
GFCI reset
Inside restrooms and kitchens, it’s required to have a GFCI (ground fault circuit interrupter) within close proximity to the sinks. A GFCI is very simple to reset with the push of a button located in the middle of the plug. However, if the GFCI will not reset, have the resident contact maintenance.
Garbage disposal reset
At the bottom of each garbage disposal under the kitchen sink, there is a small red button that’s simple to reset. In the event the button resets but the disposal is still loud or non-functional, have a service tech come out to further diagnose.

Breaker resets
By no means have a resident reset a breaker. There is a reason the breaker tripped and if forced to reset without diagnosing further, it poses a risk to cause a fire by creating an arc flash.
Smoke Detectors
Never allow a resident to replace their own batteries or smoke detectors for liability purposes. Not only are risks present from improper installation; but fires can be caused when the two points of contact on 9-volt battery comes into contact with another metal object. We all have that miscellaneous drawer in the kitchen with odds and ends. All it would take to create a fire is tossing the battery in that drawer and have it come in contact with a paper clip, steel wool, or some loose change.
Plumbing
Anything plumbing related like leaks or major clogs MUST be handled by maintenance staff or a licensed contractor. Although it may seem like a good idea to have the resident turn off the angle stop under the sink or toilet; if done carelessly the pipe couple break and a massive flood on your property will take place.
A/C closet switch
Its inevitable in maintenance to have a call that that an A/C unit is not coming on and the display on the thermostat has no power going to it. In most cases, residents will store miscellaneous items in the A/C closet and by doing so, they accidentally turn off the “kill switch”. Simply have the resident remove the items in the closet and flip the switch.
Light bulbs
At some communities, residents are responsible for replacing their own light bulbs. As long as the fixture doesn’t contain a cover, or isn’t overhead lighting in the kitchen, this is a fairly simple task.
Take Control of Your Maintenance Costs.
Toilet plunge
Consider providing a new plunger as a part of a move in gift for new residents. Most toilet clogs are easily repaired with a plunger and will minimize after-hours emergency calls.
Mystery switch
If a resident’s dishwasher won’t come on, have them check the light switch next to the disposal. Other cases of the mystery switch can arise when there is no overhead lighting in a room, but there is a light switch on the wall. This switch is meant for a lamp to be plugged in to an outlet that has an “ear” broken off. Put simply this creates a break in continuity and will only kick on the 120 volts with the flip of a switch.

WHO IS THE A-TEAM ? Who is the A-Team? Let me clarify: who are the “AAA” A-Team? In the first case, the A-Team is a cadre of soldiers of fortune on the lam from the federal government. The A-Team is led by the suave George Peppard. The A-Team pities the fool. In the second case, the AAA A-Team is a group of special people. Ryan Harmon, Gage Multifamily, is co-chair of the A-Team with Rene Flores, Crystal Clear Pools & Spas, this year. Together, they lead an energized group of AAA members who are excited about getting other AAA members involved. They do this by making in-person visits to engage with current AAA members and share the many benefits of membership, such as building relationships, giving back to the community, and furthering their education. Five A-Team members recently received their A-Team badge for completing 12 association surveys completed by AAA members. As you will read, these people really believe in the value of membership and how it can benefit you. Read how AAA membership and A-Team involvement has benefited them.

hat if a residential tenant attempts to prevent a landlord from entering a rental unit? Since the tenant does not own, but merely rents a dwelling, how can they do this? The simple answer is that they cannot. This article will explain why. There are many reasons the owner or manager of an apartment may need to enter. In fact, according to paragraph 28 of the Texas Apartment Association (TAA) lease, individuals including repairers, service providers, contractors, law [enforcement] officers, and prospective residents or buyers may have valid reasons for entry. Some people, however, simply do not want a stranger in their apartment, certainly when the resident is not present. Perhaps these individuals are apprehensive about being burglarized. The tenant may be a terrible housekeeper, and is embarrassed by anyone seeing the conditions under

which they live. It may be possible that some very private things occur or are present in one’s dwelling, which should remain private (they believe) in every circumstance. There may also be evidence of criminal activity occurring in the dwelling, and if a stranger views that evidence, its existence might be reported and criminal prosecution could follow. There is a certain balancing act which is required. Certainly, the resident who is in compliance with his or her lease has every reason to expect that their right to privacy will be honored. Likewise, the owner of that dwelling can reasonably expect to have an absolute right to enter property they own for reasonable business purposes. Paragraph 28 of the TAA lease provides that the owner’s representatives, including those with its authority, may “peacefully enter the apartment at reasonable times for
reasonable business purposes.” Reasonableness, as readily can be seen, is of paramount importance. Texas allows the parties to a lease to determine whether, and under what circumstances, a landlord may enter the rental property. Only if the lease prohibits, or fails to address, entry by the landlord would a tenant have some justification for keeping the landlord out. No such justification exists for those who use the TAA lease. Paragraph 28, with its title “When We May Enter,” is squarely on point. It both authorizes landlord entry and addresses the entry itself. If the resident is present when the landlord’s representatives attempt to enter, there is authority for the entry. The restriction, however, is that the entry must be done peacefully. If the tenant insists that the entry not occur at that particular time, and creates a disturbance which disrupts and disturbs the peace, the landlord’s representatives should not press the issue. If entry at any particular time will result in a breach of the peace, temporarily postpone the entry. There are a couple of options available here. First, go ahead and provide

advance written notice to the tenant as to when (date and time) you intend to return for entry. Then return at that time and see what circumstances you encounter. The second option would be to simply return at a time when the tenant may not be present. In that scenario, according to paragraph 28, the landlord may enter by duplicate or master key for reasonable business purposes, provided written notice of the entry is left in a conspicuous place in the rental unit immediately after the entry. How do you determine a reasonable time? According to Black’s Law Dictionary, it is a period determined from trade practice, custom, or from circumstances like those at issue. In other words, look at comparable situations to determine reasonableness from those examples. Typically, a landlord’s entry will be during normal business hours. Although this term can vary, it will usually be between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday. Interestingly, that is when the majority of people who have day jobs are working. Ultimately, you may enter when the resident is absent. Leaving notice of your entry in a conspicuous place, therefore, is essential. What is a conspicuous place? Again, using Black’s Law Dictionary, it is the place that something can be seen so it can be observed and easily seen by both interested and disinterested parties. Dictionary.com includes in its definition of the term the phrase, “readily visible or observable.” The Austin Tenants’ Council (ATC), to which many tenants direct inquiries, writes on the subject of a landlord’s entry into rental premises on its website. The ATC offers both interesting and useful advice. First, it states that “...regardless of what is
written in the lease agreement, the landlord can never force his way in or enter without first seeing if someone is at home....” ATC advises the tenant who is at home, but does not want the landlord or anyone else to enter, to engage their keyless bolting device on all exterior doors. What if your tenant does that when you try to enter? One available recourse would be to give a notice of lease violation, specifically a violation of paragraph 20(d), disrupting the owner’s business operations. Two or more of these will create a valid basis for a lease default under paragraph 32.1(B), leading to a right of eviction under paragraph 32.2. The more serious your need to enter the unit, the fewer number of violations you will need for a default. Look again at paragraph 28 of
the TAA lease. It provides that you may enter for reasonable business purposes. In the TAA lease contract, which was copyrighted in 2012, paragraph 28 had wording quite different than the current wording. Instead of using the phrase, “reasonable business purposes,” paragraph 28 from five years ago substituted a list of reasons for entry by the landlord. It was quite an extensive list. In the context of this article, some of the most useful reasons were the following: making repairs, performing pest control, doing preventative maintenance, changing filters, leaving notices, removing or re-keying unau-
thorized security devices, inspecting when immediate danger to person or property is reasonably suspected, or showing the apartment to people like government representatives, lenders, contractors or prospective buyers. Arguably, each of the foregoing fit the current phrase “reasonable business purposes.” Sometimes, having so many defined purposes could actually weaken the term reasonable business purposes. If the list is extremely exhaustive, one could argue that something not on the list could not possibly be reasonable. One of the more interesting purposes for landlord entry concerns removing or re-keying unauthorized security devices, namely locks. Many of you may have encountered the situation where one occupying your rental unit has, unbeknownst to you, changed the locks and not given you a new key. To begin with, this is a violation of section 92.163 of the Texas Property Code. That legislation states that a tenant may not remove, change, rekey, replace, or alter a security device, or have any of those things done, without permission of the landlord. Although that section of the Property Code does not directly provide remedies for a tenant violation, the next provision in the Property Code does. While the remedies in section 92.164 are tenant remedies, a good argument can be made for comparable remedies to be available to a landlord. These include actual damages, punitive damages, a civil penalty of one month’s rent plus $500, court costs and attorney’s fees. Again, these potential remedies will serve as a guide only, for they are not specifically stated in connection with section 92.163 of the Texas Property Code. In addition to the statutory prohibition against lock changes by a tenant,

going to enter your dwelling. Sometimes the giving of advance notice is easier than at other times. It is most helpful for the resident to know the date and time that the entry is to occur, so they can make a decision whether to be present or not. It is pinpointing accurate timing which creates the most problems for the giving of advance notice. Again, however, the TAA lease does not require advance notice when the landlord or
its representatives will enter pursuant to paragraph 28. Your resident, moreover, cannot unreasonably delay the landlord from entering the apartment. If the occupant is sick, rescheduling of the entry is advised. The term “reasonable” is used four times in paragraph 28 of the TAA lease. As long as the owner’s representatives are peacefully entering at reasonable times for reasonable business purposes, the entry is permissible.
It does not matter whether the tenant wants the entry or not, because he or she has agreed to the entry by signing the lease. There is one final caveat. It may be fairly easy to determine in advance that your resident intends to obstruct your contractual right of entry by cluttering your path with obstacles, including unfounded allegations against your personnel. In those cases, act in a preventative manner. Provide advance notice, to the best of your ability. Leave a notice behind which details the date and time the entry occurred, along with the purpose for the entry. Leave this behind whether the resident was present during the representative’s time in the dwelling or not. In more extreme situations, have more than one person involved in the owner’s authorized entry. That way, your maintenance or other personnel will not be involved in a swearing match, one-on-one with the resident, about what occurred during the time in the unit. Also, do not avoid entering the unit if the purpose of the entry is essential. This is, after all, rental property owned by someone other than the occupant. You have the right to preserve and protect your property. You also have statutory obligations to a tenant concerning repairs provided for in the Texas Property Code. Simply because the entry may be complicated and unpleasant, never let those reasons deter you from achieving your lawful purpose for the entry. Be careful out there.

the lease has a similar prohibition in paragraph 25.2. It provides that the tenant must not alter the landlord’s property, make lock changes, rekey locks, or alter, damage, or remove the owner’s property including locks and security devices. If your tenant acts in such a way as to violate paragraph 25.2, that would be an act of default under paragraph 32.1(B) of the lease. When that occurs, the landlord may, in some situations, resort to remedies which may include eviction. A court would likely expect multiple attempts by the landlord to get the tenant to provide a key to the changed locks. The tenant’s refusal would have to be continuous before most judges would agree to evict because the tenant would not give the owner a key. In fact, the ATC website states that when the landlord is allowed to enter the rental unit but does not have a key, the key can be requested from the tenant. Once requested, says ATC, the tenant is obligated to give the landlord a copy of the key. As a prerequisite, the landlord must have the contractual right to enter the rental unit. Landlords using the TAA lease have both the right to enter (paragraph 28) and the right to a key (paragraph 25.2 and Texas Property Code Section 92.163). Texas law does not require the landlord to give a tenant advance notice of entry. From a tenant relations standpoint, giving advance notice of entry may be both prudent and appreciated. As a gauge, consider what you would expect or desire if a stranger was
