his year has been a whirlwind and I can’t believe my time as president is coming to an end. It’s been an honor and a privilege to serve as your association President. At the beginning of my term, I asked you to find your passion and get involved. The Austin Apartment Association exists because of its members. As a member, your involvement is key to keeping this association and industry’s voice strong. There are so many different areas where you can volunteer and we need your help in order to ensure we are heard and represented. It was amazing to see many new people find their passion and get involved with the organization that helps strengthen their careers. Thank you! Industry UPDATE ENERGY AUDITS AND CODENEXT By Paul Cauduro, AAA Director of Government Relations
Austin Energy Audit Outreach Initiative Underway
Energy experts have long stated that multifamily buildings nationwide present a tremendous opportunity for energy savings.
In February, Austin Energy launched an initiative to visit multifamily properties in compliance with Austin City Code’s ECAD Ordinance requirements. Austin Energy staff is scheduling appointments and delivering updated ECAD Audit Results certificate and Energy Guides to onsite property managers and leasing personnel, but in some cases, the contact information may need to be updated without the convenience of setting appointments in advance. These site visits are part of Austin Energy’s 2017 ECAD multifamily community outreach plans and are intended to answer any ECAD and AE energy efficiency program related questions the properties may have. As part of the initiative special attention will be paid to small unit properties with no office or on-site management. City officials are open to industry input regarding certificate postings at the property and how audit result information is transmitted to prospective tenants by the owners or manag-
ers. It is important to note that many of these properties present unique energy upgrade opportunities through the use of Austin Energy rebates and innovative financing options that can provide the upgrades and resulting operating costs savings with no out of pocket costs because of Travis County’s designation as a property assessed clean energy district (PACE). The ECAD program began in 2009 by first applying to single-family homes requiring all homes sales must include an energy audit prior to the sale of the property with a copy of the results provided to prospective purchasers. A report to Council dated August 1, 2014 indicated that slightly more than 10,000 homes had an ECAD audit. A success rate of only 52%. The Austin City ECAD ordinance was phased to apply to multifamily communities in 2011. To date 850 multifamily communities have reached compliance. That’s a success rate of approximately 80% representing 6,292 buildings and 74.6 million square feet. ECAD defines multifamily properties as any property with five or more residential units. The rules require that apartment buildings greater than
10 years old must have an energy audit or perform an audit within 10 years of the completion of construction. The Austin ECAD audits investigate air conditioning and heating system efficiency, air filtration, duct performance, air sealing in plumbing areas, weather stripping, windows and attic insulation The aim of the ordinance is to find inefficiencies and spur energy efficiency improvements such as duct sealing and added insulation in order to provide more comfortable and desirable spaces for tenants. Tenant surveys indicate that tenants living in an energy efficient unit are likely or very likely to renew their lease. Energy experts have long stated that multifamily buildings nationwide present a tremendous opportunity for energy savings. Comprehensive, cost-effective upgrades in multifamily buildings can improve efficiency by 15-30%, representing an annual sector-wide savings of almost $3.4 billion. To help offset the cost of improvements, Austin Energy provides a wide range of rebates to owners for making energy and water efficiency upgrades. The City of Austin promotes the ECAD ordinance as a way to help tenants avoid the surprise of high energy bills in the unit before a lease is signed. Austin Energy publishes a guide that provides residents with an estimated average monthly energy cost and encourages renters to use the guide as a tool to compare properties. The City also offers an online data portal to help tenants search for energy-efficient apartment properties in the Austin Energy service area. A review of the ECAD requirements is as follows: · The property owner or manager is responsible for making sure the ECAD audit is done. · Energy audits must be done for all properties within the city limits served by Austin Energy the year the complex turns 10 years old. The Energy Professional provides a copy of the energy audit to Austin Energy as well as Audit Results to provide to residents. ECAD energy professionals set their own prices and it is recommended that properties get at least three estimates and check references. · Energy audit results should be posted at the property for all current and prospective residents to review. · For current residents, the property owner or manager must give a copy of the audit results when requested or automatically provide it before current lease is renewed. · For a prospective resident, the property owner or manager must provide copy of the audit at lease application before any application fees are paid. An apartment community can be proactive by exempting itself from the ECAD requirement for 10 years. The exemptions are given to properties that have used an Austin Energy Rebate for comprehensive duct remediation work and/or replacement of air conditioning equipment for all units. As with any adopted ordinance, there are penalties for non-compliance and requirements for high energy users, and anyone may file violations with the City of Austin Municipal Courts for review and action. A funny THING HAPPENED ON THE WAY TO THE MODEL Shopping War Stories from the Apartment Industry’s Leading Shopping Company by, Joanna Ellis, CAM, CAPS CEO Ellis, Partners in Management Solutions After 30+ years of shopping apartment communities in almost every state in this country, we still never say, “We’ve seen it all!” Why? Because after hundreds of thousands of shopping reports, we continue to get the occasional new “twist” on the standard apartment leasing presentation. Some of these twists are often downright twisted. Most are entirely inappropriate and represent huge leasing no-nos, and some things that happen when we are out shopping are downright unforgivable. Yet they are often hilarious! Below are just a few of the more unusual shops we have done through the years. Enjoy!
It was a nice spring morning, and our shopper was looking forward to completing his shopping evaluation. He realized it would mean a tour of the community in the beautiful weather. As he approached the leasing office of what seemed to be a well-maintained apartment community, his expectations of this leasing presentation were high. The initial impression of this property was very positive and everything seemed to be in order. As he entered the leasing office, a nicely dressed and wellgroomed woman was sitting at a desk in the nicely-appointed room. She looked up from her paperwork, smiled, and said hello. But she didn’t stand to greet our shopper or offer him a seat. Yet as instructed, the shopper walked up to this on-site professional and inquired about a one bedroom. At that point, the manager did the unthinkable. She pulled a set of master keys from her desk drawer, handed them to the shopper, and pointed in a general direction. “The only thing I have left is on the second floor, Apartment 234. It’s right up the second set of stairs going that way. See what you think.” The shopper was flabbergasted by this action of the apartment owner’s agent. For just a second he considered taking the keys and driving off. Instead, he completed his assignment by viewing the apartment, walking the grounds, and returning the master keys to the otherwise friendly on-site representative. Interestingly, the apartment he saw on his own was in perfect condition. We don’t know at which convenience store this manager is now working!
C’mon Up, Big Boy! This shopping incident actually happened to Rick Ellis, well-known multifamily industry consultant and one of our “best” shoppers. This

shop took place more than a few years ago in the west Texas town of Midland. Rick was younger, had more hair, and fewer pounds back then. You’ll see why this is relevant in just a moment. The apartment community he was shopping was upscale and desirable. The leasing professional was poised, friendly, and gave an incredible performance. Rick was thinking that this would likely be a perfect shop and earn the company’s highest report score. Everything was going great until this otherwise outstanding leasing professional did something very inappropriate. This young woman invited Rick up to her apartment! Can you believe that? But it was not quite as bad as it sounds. She was having a party in her apartment that evening, and she was inviting him to that little celebration. Unfortunately, it ruined what could have been an award-winning leasing presentation. And it confirmed our client’s concern about why this particular leasing consultant seemed to only close her male prospects!
Oh, Sorry. I Had a Little Party Last Night! From time to time an on-site person who is being shopped will show their own apartment to a prospect. While this could be considered inappropriate by many companies, when done correctly, it can be quite persuasive and appealing to the prospect. But we don’t recommend the practice! Yet this is what the leasing consultant chose to do in a shop that I was doing myself. And had I not seen it with my own two eyes, I would never have believed it. You see, the particular floor plan I requested during this shop was not available. So this friendly and accommodating leasing professional offered to show me her apartment. I agreed and off we went. As she opened the door to her apartment, I immediately noticed

a stench of beer and cigarette smoke. She smiled and apologized. “Sorry about the mess. We had a party here last night.” The place was a wreck, with beer cans and other trash strewn all over. And on the balcony was a spent keg of beer, still floating in the tub. I was not looking forward to writing up this evaluation! Then it got worse. As she walked me through her apartment, I noticed something soaking in her bathroom sink. Now there are times we should just keep our mouths shut, but this poor thing blurted out, “Oh, it’s that time of month.” (More information than I needed!) Other funny comments seem to have recurring themes. Here are a few we hear quite often. · A leasing professional complains to our shopper about their manager or management company. · The onsite person who does or says a “no-no” and then comments, “Gee, I’m glad you’re not a shopper or I would be in big trouble!” · How about the leasing professional who had just returned from McDonald’s when our shopper showed up. She asked the shopper, “Do you mind if I finish my lunch before I show you the apartment?” Please understand the vast majority of our shops are good or very good. We are proud of the overall professionalism and expertise of the thousands of on-site professionals in this great industry! Lest you think I’m poking fun at our wonderful customers, let me tell you a few stories on us -- on our shopping company. Hey, we all make mistakes sometimes, right? Well, don’t tell anyone about these stories because they are downright embarrassing! And while these goofy messes happened to EPMS, any shopping company has similar stories to tell. We had a shopper in Houston who “fabricated” eight shopping reports and turned them in to us for payment. Fortunately, some inconsistencies were noticed during our second review. It seems the shopper’s experiences were very similar — too similar - at each community. We had this shopper visited by our collection person, “Nick the Knife!” “Let’s strike a deal,” said our shopper to the leasing consultant he was to shop. He called her up by phone and offered to split his shopping fee if she would just help him fill the report out and avoid a time-consuming trip to the property. (Ouch!) Fortunately, this honest on-site professional reported our lazy shopper to her supervisor, who immediately called EPMS. Boy, were we red faced! And then there are the shoppers who decide to fill out the shopping report during the leasing presentation, in full view of the person being shopped! Some shoppers just don’t get the concept. And, finally, there is the occasional male shopper who simply can’t resist the temptation to ask a cute leasing professional for her home phone number. Hey, buddy, we’re not running a dating service. This is a shopping company! Now you see why I say that anything can happen during a shopping evaluation! I hope you enjoyed this lighter side of the apartment shopping and employee evaluation business. Perhaps I or one of my shoppers will see you at your property in the future. Happy leasing!

It was a great ice-breaker!” “Yvette noticed that I was really impressed by the trees, clean air, and overall lack of city noise at the property. She suggested that for less money than I was currently paying for an apartment, I could have so much more. She called it a little ‘piece of harmony’.” “Michelle had a son the same age as mine and offered to invite him over so he would have an instant friend when we moved in.” “Richard referred to the two apartment floor plans as the ‘Heaven’ apartment and the ‘Paradise’ apartment.” “Todd asked me to complete the guest card and I commented that I had not brought my reading glasses. He jokingly reached into his desk drawer and offered me a magnifying glass. We laughed at his resourcefulness.” “When I said I was just beginning to look she said, ‘How lucky for you! You found your new home on the first visit!’” “On the phone Felix got me excited about visiting by saying, ‘I can get you a mansion!’ He also offered to personally paint an accent wall in my apartment when I moved in.” “Joseph overcame my objection of no ice maker by laughing and demonstrating how to fill the ice tray. He was very funny!” “Farrah invited me out to ‘fall as much in love’ with her community as she was. I wanted to see what she loved so much!”

1. Always have a game to play at booth (hint: award drink tickets) 2. Be engaging and fun as a vendor; this is the best way to leave your impression with current and potential customers.
4. Have good give-away promos and lots of candy. Make attendees have a place to drop their business cards for a chance to win your prizes! Everyone likes the chance to win cash and prizes. (Getting their business card also gives you the opportunity to build up your contact list.) 5. Don’t sit behind your booth table; stand out front and engage people as they walk by! 6. Have a great time! Stand up at all times and smile. 7. Pre-Promote, Pre-Promote some more. Start including your booth number on all of your emails, invoices, social media and marketing collateral months before the trade show.

8. Make a checklist of what to bring and set up the day before the show. You don’t want to get caught high and dry the day of the show. 9. Follow-up after the show with an email, phone call or letter to attendees. It is rare that you have over 1,000 customers in one room and get their full contact information. Use this information to make a database for the next year to email all of them about your booth and what special drawing or event will take place. 10. At your next trade show, watch the busiest booths and see what it is they are doing and think of what you can do your next show. 11. Most important: put it on Fowler’s tab!

On March 8, apartment industry professionals from all over the country convened in Washington DC for the National Apartment Association’s (NAA) Capitol Conference. This is the industry’s annual advocacy event that educates grassroots activists on key issues and then mobilizing them to advocate with their members of Congress. AAA members and staff attending the conference held separate meetings with all member of the Austin area Congressional delegation: Michael McCaul, Judge John Carter, Lamar Smith, Roger Williams, Lloyd Doggett and Bill Flores. Meetings were also held at the office of Senators John Cornyn and Ted Cruz. This year the industry’s advocacy efforts focused on: · Fair Housing and the Americans with Disabilities Act (ADA), · Tax Reform, and · the National Flood Insurance Program Reform and Reauthorization. On the topic of Fair Housing and the ADA, the industry is trying to eliminate “drive by” lawsuits whereby apartment
communities are notified that the property my not be fully compliant with ADA requirement and that a complaint will be filed unless settlement payments are made. The request for lawmakers is a “fix” that allows property owners 120 days to cure any defects before lawsuits or filed or any settlement monies are paid. When speaking about National Flood Insurance Program (NFIP) Reform the apartment industry is seeking reauthorization for continued availability of flood insurance. Advocacy efforts also centred on reforms to the flood maps as well as changes to how replacement costs are determined and paid to apartment communities following a flood event. Advocacy on tax reform is a key priority for the NAA. While advocating for tax reform industry members listed several primary objectives and priorities to needed ensure that any reforms will promote economic growth and investment in rental housing without unfairly burdening apartment owners and renters relative to other asset classes. S One of the easiest ways to get into trouble in connection with a former tenant’s security deposit is not to account for it in a timely fashion.

ome residents will vacate your property and owe you money. Does that surprise you as much as Bugs Bunny single-handedly defeating the Gas House Gorillas in the classic cartoon Baseball Bugs? I didn’t think so. These debts arise daily in the rental housing industry. The debt may be substantial. It may consist of unpaid rent when your tenant vacates before the end of the lease term, gives you no notice of their early departure, and the unit they have vacated is not likely to be rented again quickly. The amount owed may also be small. It could be comprised of deductions for failing to clean the carpet or the bathroom, or the cost to repair a broken window caused by a baseball (perhaps a screaming liner) crashing through a glass window in the unit. In either event, you will be faced with questions about how you plan to collect what you are owed. Care must be taken so you do not end up owing your former resident

money. There are several ways in which this could happen. The most common would be a situation where you mishandled the security deposit. Perhaps you did not give the departed resident a timely accounting of his deposit. Maybe some of your deductions were excessive under the circumstances. A situation may have arisen where the property changed ownership or management, or there was a significant personnel change, which resulted in a particular tenant’s security deposit falling through the cracks. In any of the foregoing situations, you could end up owing the former tenant money. Faced with that possibility, it makes sense to have a plan in place so that you properly and timely account for one’s deposit, and you place yourself into a position where you can prove that you did so. There is an entire section in the Texas Property Code devoted to security deposits. It is set forth in Sections 92.101 through 92.110. Those statutory provisions address everything from

definitions and obligations to refund, to the significance and timing of having a forwarding address. One of the easiest ways to get into trouble in connection with a former tenant’s security deposit is not to account for it in a timely fashion. The general rule is that the landlord shall refund the security deposit to the tenant on or before the 30th day after the date the tenant surrenders the premises. Using the two-part definition of paragraph 41.2 of the TAA lease, a resident has surrendered the apartment when the move-out date has passed and no one is living in the apartment in the reasonable judgment of the landlord, OR when apartment keys and access devices have been turned in to management. Surrender occurs whenever one of those two things first happens. For surrender to occur, you do not need to have reached the end of the lease term. If a resident signs a 12-month lease, then during the fifth month of that lease turns in keys and access devices to management, surrender has occurred. Do not make the mistake of thinking that you have no obligations concerning the accounting for and refunding of the deposit until

the ending date of the lease. Those obligations arise upon surrender, whenever that occurs. In the typical situation, if you fail to account for a security deposit in a timely manner, a presumption that the landlord acted in bad faith will arise. This is provided for in section 92.109(d) of the Texas Property Code. That provision states that the landlord who fails either to return a security deposit or to provide a written description and itemization of damages on or before the 30th day after the date the tenant surrenders possession is presumed to have acted in bad faith. In the security deposit context, a landlord acts in bad faith if the landlord acts in dishonest disregard of the tenant’s rights or intends to deprive the tenant of a lawfully due refund. The presumption of bad faith is a presumption which may be defeated. That means that the landlord is afforded an opportunity to rebut the presumption of bad faith through the presentation of various facts. Case law has held, for example, that evidence that a landlord had reason to believe he was entitled to retain a security deposit to recover reasonable damages is sufficient to rebut the presumption of bad faith created by the Texas Property Code. Other qualifying examples of facts which rebut the presumption of bad faith include where the landlord is an amateur lessor who owns only one unit as his rental property. Another example would be where the landlord had no knowledge of the requirement to submit an itemized list of all deductions from the security deposit. Yet another possible excuse arises when extensive damage was
done to the residence. Also, the landlord may have attempted to do some of the repairs himself to save money, or had a reasonable excuse for the delay such as being on vacation. As you can see, most of these facts which might help to overcome presumed bad faith apply to small landlords owning a very small number of rental properties. Few, if any, would be especially useful to professionally managed property. Overcoming a presumption of bad faith based upon failure to meet the 30-day deadline is only half the battle. If successful, the landlord will also be required to prove that his retention of
every portion of the security deposit was reasonable. This is an interesting situation. Former tenants may sue the landlord for allegedly mishandling their security deposit. Filing such a suit makes the former tenant the plaintiff in the lawsuit. In a typical court case, the plaintiff bears the burden of proof. A security deposit lawsuit, however, does not proceed in a typical manner. When such a suit is filed, the defendant (i.e. the party who got sued) bears the burden of proof to show that all of the deductions from the deposit were reasonable.
Case law involving security deposit disputes has held that the landlord is not required to establish the amount of damages with “mathematical precision” but “needs only to present sufficient evidence to justify a finding that the costs were reasonable and the repairs were necessary.” To be able to persuade the trier of fact that you have satisfied that burden, the landlord is going to need evidence such as clear and very illustrative photographs. Oftentimes, a photograph will not effectively show the totality of the damage, its size, where it is located within the rental premises, and how obvious it is when contrasted with undamaged areas of the rental unit. For these reasons, a video (easily taken with a smart phone) may be much more effective than a photograph. It is also important to have people with firsthand knowledge of the damages available to go to court when trial begins. Through no one’s fault, maintenance personnel and others from the management team may have moved on to other properties or management companies when trial of a security deposit case actually commences. For this reason, it becomes very important to make sure that your tenant files are well documented with proof of damages. Also anticipate that some of your star witnesses may not be present when the trial begins, and get written statements from them when the damages are first discovered. Even notations on a communications log may be helpful here. The most significant thing to remember is that management bears the burden of proof to establish that the deductions were reasonable. Do

not be surprised if a former tenant’s version of the facts is significantly different than management’s version. The judge many have to decide between nearly opposite stories. You want your version of the facts to be more believable. If you have a situation where a rental unit has a lot of damages, and there are likely to be multiple deductions from the security deposit, make sure that more than one person from the management team sees those damages with their own eyes. Stated another way, if a cursory walk-through of the apartment shows an absolute disaster, have as many people as you can from the management and maintenance teams personally walk through the apartment. Ultimately, their involvement may be nothing more than spending five minutes walking through the rental unit and seeing it in its actual move-out condition. What you are trying to ensure is that even if your community has staff changes, at least one person from the staff who personally observed the move-out condition will still be around to testify if your case goes to trial. Such measures to preserve firsthand knowledge are often overlooked. What you must to do is make sure that people will be able to testify on behalf of the defendant about a condition that they personally observed. That way, when the resident testifies that she left the apartment spotless, and that there were no damages, somebody will be able to counter that testimony with personal observation of the condition upon move-out of the rental unit in question. What do you do if there was no security deposit required of the tenant when they took possession? Section 92.110 of the Texas Property Code addresses this scenario. It provides that if a security deposit was not required by a residential lease, and the tenant is liable for damages and charges on surrender of the premises, the landlord is
still to give the former tenant a form of accounting. The statute states the landlord shall notify the tenant in writing of the landlord’s claim for damages and charges, and do so on or before the date the landlord reports the claim to a consumer reporting agency or third-party debt collector. Many owners who are owed money by a former resident will seek to collect that debt by using the services of a collection agency. Simply because there is no security deposit against which to offset damage claims does not mean the damage claims should be ignored. If a resident had paid a security deposit, and the amount of damages exceeded that amount, the sum not paid by the security deposit is often turned over to collections. Why do anything less when you never received a deposit in the first place? In the situation of a lease without a security deposit, care must be taken to nonetheless advise the former tenant of what the damages are before submitting the debt to a collection agency, or for that matter, to a collection attorney. This is a similar requirement to detailing all deductions from the totality of a security deposit. Know that if you intend to try to collect what you are owed, there is an expectation that you disclose your damage calculations to your former resident. Do this whether the resident paid a security deposit or not. According to Section 92.110(c) of the Texas Property Code, if the landlord does not provide the required notice, even to a tenant who paid no deposit, the landlord forfeits the right to collect damages and charges from that tenant. All the former tenant has to do is claim that they were surprised to hear from a debt collector because their former landlord had never advised them they owed any money after they left. At that point in time, you should be asking yourself whether you can prove you provided the tenant written notice of your claim for damages and charges,
and you did so before reporting your former resident to a consumer reporting agency or third-party debt collector. The Property Code states that forfeiture of the right to collect damages and charges from the tenant is the exclusive remedy for the failure to provide the proper notice to the tenant who paid no security deposit. In other words, there will not be any remedies such as multiple damages or attorney’s fees. Forfeiture of the right to collect a substantial debt, however, could be a substantial punishment in and of itself. When written notice is required, and the timing of the notice is important, the landlord should think long and hard about being able to prove the relevant facts about the notice. Are you willing to send your written notice via certified mail, at a cost of approximately six dollars, or are you only willing to spend approximately fifty cents for a regular stamp? The answer to this question is not dictated by statute, but rather by practicality. Section 92.1041 of the Texas Property Code, for example, concludes the landlord is presumed to have refunded a security deposit or made an accounting of security deposit deductions, before the date required, if the refund or accounting is placed in the United States mail and postmarked on or before the required date. There is no mention of certified mail, or any other delivery service which allows for tracking the delivery. Should it not be okay, therefore, to simply say that you mailed the deposit accounting in a timely manner? Absolutely not. One of the most difficult evidentiary hurdles in a security deposit case is proving that you sent your written notifications in a timely manner. As soon as your opponent in court (who is your former resident) states that he or she did not receive any deposit accounting, the seat you are sitting on begins to get extremely hot. still working for you? Is that person actually in court? Are there believable facts supporting your contention that a particular envelope was mailed on a particular date, even when the mailing occurred a year or more ago? There is much to be said for the use of certified mail when you are faced with the prospect of owing money to a tenant who actually owed you money following surrender of the premises. Do you really want to save mail expense of around $5.50 and run a substantial risk of owing statutory damages? If you are unable to prove timely compliance with your security deposit deadlines, the presumption of bad faith will arise. If you are unable to overcome that presumption, you may leave the courtroom owing your former resident an amount equal to the sum of $100.00, three times the portion of the deposit wrongfully withheld, and the tenant’s reasonable attorney’s fees in a suit to recover the deposit. In addition, the landlord who in bad faith does not provide a written description or an itemized list of damages or charges forfeits the right to withhold any portion of the security deposit. It will be quite challenging for you to establish that your security deposit deductions were reasonable when the law provides that you have forfeited the right to withhold any portion of the deposit. In this same vein, do not make the mistake of not mailing the deposit accounting because you have not received a forwarding address. It is true that section 92.107 of the Texas Property Code states the landlord is not obligated to return a tenant’s security deposit or give the tenant a written description of damages and charges until the tenant gives the landlord a written statement of the tenant’s forwarding address for the purpose of refunding the security deposit. Keep in mind, however, that a resident may testify in court that they did provide that written statement, whether they did or not. Will you
have the right people in court, with personal knowledge, to persuade the judge that your former resident is not being truthful about that point? To avoid that dilemma, even if you do not know the forwarding address, timely send your accounting anyway. Send it to the last known address of your former resident. That is an easy one. It is the address at your property which they just vacated. As a landlord, do not bank on the technicalities of the security deposit statutes. Avoid putting yourself in a situation where you must try to justify not mailing an accounting because your former resident never provided
you their forwarding address. The risk does not justify the reward. Many words have been spent on the security deposit statute. Yet the there is an important provision in your lease, specifically paragraph 32.5, which is often overlooked. It is the last sentence of paragraph 32.5 of the current TAA lease. It reads as follows: “You must pay all collection-agency fees if you fail to pay sums due within 10 days after we mail you a letter demanding payment and stating that collection-agency fees will be added if you don’t pay all sums by that deadline.” A typical collection agency will deduct 35% or more of what they collect before paying you the balance. The foregoing provision of your lease
enables you to avoid that, and justifies collection of 135%, for example, of the amount of the debt you turned over to a debt collector. That way, you get 100%, the debt collector gets their 35%, and everyone except your former resident is happy. There are two keys to making this work. First, you must write the former resident a letter demanding payment. The final account statement is not such a letter. The letter must be over and above the final account statement. It can, however, be sent with the final account statement. In fact, if you are sending your final account statement by certified mail, this will enable you to save another roughly $5.50! Be sure your letter says something along these lines: “Dear Former Tenant, Enclosed is our final account statement, showing you owe us $100.00. Demand is made upon you for payment of that sum. If you do not pay it within 10 days after the date of this letter, collection agency fees will be added to the debt if you don’t pay all sums by that deadline. Yours truly, The Management.” Second, you must communicate with your debt collector, should you choose to use one, advising them that you have sent such a letter. Provide them with a copy. Now the debt collector will know that they can ask your former resident to pay $135.00, rather than just $100.00. This assumes, of course, that your debt collector intends to charge you 35% as their share. Collecting money from former residents is never easy. There are traps along the collection path, moreover, which could cause things to backfire. Developing a plan which ensures that you can prove you acted properly will go a long way toward enabling you to recover what you are owed. At a minimum, it will enable you to avoid converting a situation where your former tenant owes you money into a situation where you owe your former tenant money. Knowledge of the statutes and the lease provisions works to your benefit. Let’s be careful out there!
As a landlord, do not bank on the technicalities of the security deposit statutes.
