President’s

PERSPECTIVE A PRESIDENT’S RESTROSPECTIVE ON HIS FIRST YEAR’S HIGHLIGHTS What a year! I can’t believe it was just ten months ago that I was sworn in.

I

t truly has been an honor leading such a wonderful association and I appreciate everything that our dedicated volunteers have done over this last year. We have seen so many accomplishments this year and I wanted to give kudos to each committee chair as well as the committee members and volunteers.

Legislative Committee: Lead by AAA staffer Paul Cauduro and chaired by Karen Temborius, Christy Sanchez, and Katya Watson. The legislative committee was kept very busy this year. Some of the most significant items were staying involved in the Code Next process (rewriting of the city’s municipal land development code), special meetings with council members to discuss topics like the effect of property taxes on rental rates, code enforcement, and the permitting process. The committee was instrumental in getting city officials to meet with the committee to discuss the new carbon monoxide detector ordinance as well as the swimming pool permit

inspection process. Other items that kept them busy were involvement in the annual permit discussion, tax abatement for property owners, and working with the city on the development of a criminal background guidebook for property owners to use as a best practices guide. Ambassadors A Team: Led by AAA staffer Robbie Robinson and chaired by Amanda Seamans and Beverly Boyd Miller. The Ambassadors introduced using ribbon cutting ceremonies and revamped the site surveys to be more streamlined. Mentors M Team: Also led by AAA staffer Robbie Robinson and chaired by Cindi Bewley and Ryan Harmon. The Mentors Team kicked off their first year with a bang. They have gathered an excellent group of mentors to welcome in new supplier members and mentor them on how to get the most from their association membership. Their first new member mix and mingle happy

hour was a huge success with 17 new supplier members attending! Austin Supervisor’s Council: Led by AAA staffer Kristan Arrona and chaired by Christi Pyle and Shannon Green met several times this past year to discuss industry standards, local events and best practices. Community Outreach: Led by AAA staffer Jennifer Cox and chaired by Anna Samaratunga, Lindsay Doud, and Michael Garcia. The Community Outreach committee did a phenomenal job this year by assisting with the Food Drive, volunteering for the back to school drive as well as dressing up to take pictures that benefitted Brady’s Bridge. Doc& Gale Young Food Drive: Led by AAA staffer Jennifer Cox and chaired by Paige Russell, Stephanie Naylor, and Terri Needham. The committee really focused on making this a record year in honor of Doc Young. Through hard work by many


volunteers and heartfelt donations, the Food Drive raised over $70,000 to provide Thanksgiving meals to Austin area families! Doc would have been so proud. COMAC: Led by AAA staffer Jennifer Cox and chaired by Stephanie Naylor and Lindsay Doud. The committee focused on more online engagement by increasing Facebook Live moments and improving the AAA Facebook page to make it a more exciting place to interact with peers. Facebook likes have grown to almost 2,500 this year. Windows magazine got a fresh new look this year and the publication online was improved to be able to share content with Facebook and LinkedIn. The email advertising was sold out every month! They also saw much success with the AAA website, as the site had over 10,000 page views each month.

Investment Committee: Led by AAA staffer Kristan Arrona and chaired by Ben Wells and Colleen Grahn. Quarterly meetings were held Enclave Investors to review the details of the associations investments. Even with a volatile first quarter of 2018, the AAA portfolio has performed very well this year. Education Advisory Council: Led by AAA staffer Jerrica Deloney and chaired by Dedra Bouffard. The

PAC: Led by AAA staffer Paul Cauduro and chaired by Sandy Eckhardt and Theresa Ebner, the Political Action Committee – or Apartment PAC Austin – engaged with members and raised much needed PAC funds to give our industry a voice in local, state and national politics Young Professionals/NextGen: Led by AAA staffer Robbie Robinson and chaired by Rachael Bostick and Shay Mickler. The committee made a successful shift from recruiting committee members from an “age” basis to a “new leader” basis, which generated a lot of excitement and it showed in the increased attendance at each meeting/event. Monthly social events helped cultivate new relationships and networking opportunities. We also saw a substantial increase in attendees from the Austin NextGen at the TAA Board of Director’s meeting in February. NextGen committee members also added an education

committee was very successful this year by substantially increasing the number of attendees to each meeting. All the involvement led to modifications to the Property of the Year judging process, and a new meeting format to generate more “task force” oriented meetings. Overall education classroom attendance showed a marked increase. Education Foundation Board: Led by AAA staffer Kristan Arrona and chaired by Brooke Mahoney. The AAAEF foundation has been developed around a unified mission and the awareness campaign has been officially kicked off thanks to creative

efforts from Jennifer Cox and the selected board. Initial efforts will include the distribution of the James Solt scholarship and the Rich Ellmer scholarship. We are excited as the Solt scholarship will provide monies towards NAAEI credentials for our aspiring members. And the Ellmer scholarship will focus on continued partnership with Goodwill, ACC, and local education opportunities to introduce new talent to our industry. Lyceum Taskforce: Led by AAA staffer Kristan Arrona and chaired by Colleen Grahn and Stephanie Naylor. Stephanie and Colleen worked hard on creative new ideas to improve the curriculum and the students experience. Among those ideas were adding a section to the curriculum about Leadership and Emotional Intelligence and the first ever class project involving community service by making breakfast at the Ronald McDonald House. I would like to personally thank all the chairs, committee members, volunteers and our members that participated in events, for making this a wonderful year. I am sure our volunteers will continue to contribute in the future and hope that their hard work has inspired future volunteers to get involved. I also want to thank the AAA staff - Kristan Arrona, Jennifer Cox, Dana Bolz, Jerrica Deloney, Jeanette Gonzalez, Amy Magnuson, Robbie Robinson, and Paul Cauduro - for all their hard work and support. You all exemplify what an association professional should be. Along with the staff ’s regular responsibilities, they also had to take on a change from anniversary date membership renewals to the renewals all occurring in January. Like many organizations, our association is not immune to employee turnover. With two vacancies to fill this year, the whole team jumped in to cover those extra duties and make sure our members’ needs were met!

You all exemplify what an association professional should be.

Industry UPDATE INDUSTRY ADVOCACY IS WIDE-RANGING AND NEVER-ENDING By Paul Cauduro AAA Director of Government Relations

CodeNEXT DEBATE GOES TO CITY COUNCIL

All AA members are strongly encouraged to examine the land use zoning changes proposed for their property and properties in the surrounding area.

CodeNEXT, the new land development code and zoning map for the entire City of Austin, is entering the final phase the adoption process. Maybe. If the document can survive the public hearing and council amendment process, as well as the legalities of a citizen petition aimed at putting it on the November ballot for citizen not city council approval, the code should be approved by the end of the summer. Once approved the code will establish new building setback lines, new building height requirements, new parking requirements and other development and re-development requirements for a vast amount of both occupied and unoccupied properties in the city. All AA members are strongly encouraged to examine the land use zoning changes proposed for their property and properties in the surrounding area. To view the proposed changes, go to www.austintexas.gov/department/codenext. The document that will be debated and amended by the city council in the weeks ahead is the third and final draft version. Each of the previous versions has been met with its own controversy surrounding the potential impacts to existing neighborhoods. The third draft lessons the neighborhood impacts by placing more growth and apartment housing along the corri-

dors. The plan also greatly expands the use of density bonus programs that allows more building height or bulk in exchange for including affordable units in the project. Last year the Austin Apartment Association joined the Evolve Austin coalition to amplify our engagement in the CodeNEXT approval process. Evolve Austin is a broad-based coalition of business and advocacy groups united in support of removing regulatory barriers to development and streamlining the opportunity to build and re-develop a variety of attached and detached wall housing to meet demand. To date, the coalition has been effective in securing changes to the document that increase housing, but many issues remain in the third draft version and will be raised in the pending public debate. NAA MEMBERS ADVOCATE FOR ALL On March 14, apartment industry professionals from all over the country gathered in Washington, D.C. for the NAA’s Advocate Conference. This is the

industry’s largest advocacy event and is dedicated to having the grassroots of the industry members advocate the issues with their members of Congress in their Washington, D.C. office. At last year’s conference much of the focus was centered on advocating for tax reform. Late last year the apartment industry’s objectives were largely met when comprehensive tax reform legislation was signed into law and included key provisions sought by our industry. Without resting on laurels, the National Apartment Association is taking aim at resolving new issues confronting the industry as well as a few issues that have lingered on the industry’s agenda.

Data Security As an important new issue for our times, Congress continues to pursue data breach and cybersecurity legislation and the apartment industry seeks the adoption of reasonable approaches to safeguard consumer privacy and thwart cyberattacks. Currently, rental AAA advocacy team members join with members of the Houston Apartment Association meet with U.S. Representative Michael McCaul’s staff. Representative McCaul represents Texas’ 10th District that stretches from the northern tip of Lake Travis eastward across northcentral Austin to northeast Houston including the cities of Katy, Cypress and Tomball.

housing operators, like all businesses, must comply with a patchwork of 48 different state laws governing data security, breach notification & privacy standards. The NAA and its members advocated that the House & Senate advance legislation that provides for: • Federal preemption of existing state data security, privacy and breach notification laws. • A reasonable, flexible and scalable national standard for data protection and that this standard consider the needs and available resources of small and large businesses as well as the sensitivity of the data in question. • Financial and legal liability being assigned to the entity that actually suffered the data breach—especially in the case of third party providers. • A requirement that third-party providers notify their customers of any breach and allow them to notify the consumer, if they so choose.

ADA Right to Cure While this issue has lingered on the industry’s advocacy agenda in recent years the number of ADA public accommodation/access lawsuits driven by financial gain, not improvements to access for people with disabilities, continues to grow. Fortunately, our efforts have produced results. The House passed bipartisan legislation on February 15, 2018 (H.R. 620)

to address frivolous ADA lawsuits that would provide a business owner with up to 120 days to cure an alleged ADA design defect prior to the initiation of a lawsuit. This speeds remedies for the disabled and creates an important disincentive for complaints motivated purely for financial gain. During our recent group advocacy effort the emphasis was to thank the House members who voted to approve the bill and encourage Senators to introduce a companion measure and get it passed for the President’s signature.

Flood Insurance The National Flood Insurance Program (NFIP) ensures access for all multifamily projects to affordable flood insurance, which is required for all federally backed mortgages. Despite past advocacy efforts, this important program has been operating on short-term extensions. The NAA continued its push for the long-term viability of the program. Because many multifamily properties need the NFIP for some or all of their flood insurance coverage the long-term viability of the NFIP is critical to lessen taxpayer funded disaster assistance and help apartment communities mitigate risk and protect properties. Included in the NAA’s idea of long-term viability is a more viable private market to allow for rental property owners the flexibility to better

mitigate their flood risk. Other aspects of the program discussed with members of Congress included: • Allowing NFIP umbrella coverage for owners of multiple properties or garden style communities so that owners do not have to obtain individual coverage for every structure on the property. • The call to expand the NFIP to include Business Interruption coverage for rental properties • The need for the NFIP to provide Replacement Cost Value (RCV) instead of Actual Cost Value (ACV) to damaged rental properties, and; • Increasing apartment communities’ access to current flood mitigation funding and programs

Infrastructure The NAA membership believes that any major investment in the nation’s infrastructure should seek to remove barriers to housing development and rehabilitation. A cooperative approach to housing and infrastructure planning maximizes benefit and promotes efficiencies in transportation, land use and public works. The Administration has proposed a $1.5 trillion plan to expand and revitalize the nation’s infrastructure. If passed the funding would open areas to needed apartment growth and improve existing communities. As a new issue on the NAA advocacy agenda, the members pressed Congress to ensure that an infrastructure package addresses housing and supports measures that drive new investment in housing, promotes transit-oriented and high-density development and funds community-level infrastructure needs. Obviously, time will tell if the advocacy efforts on these issues helped advanced the discussion. What is certain is that having hundreds of apartments professional from all levels of an industry that is responsible for more than 12.3 million jobs and $1.3 trillion to local economies on Capitol Hill at the same time did leave a positive impression on the 435 Congressional offices visited in our nation’s capital.

The Administration has proposed a $1.5 trillion plan to expand and revitalize the nation’s infrastructure.

Technology continues to grow at a rapid pace which results in an overall change to the way all companies and industries market their business. Banners and bandit signs as the driving force of leads is quickly becoming a thing of the past. The present consist of review sights, social media and endless apps available to everyone, almost constantly. While this can seem like a daunting challenge, it can be an incredible opportunity to build a timeless presence through the creation and successful implantation of a brand. While marketing is necessary in the promotion of a business, it is nothing without proper branding. The brand is the core. The brand is who you are. Defining who a business is requires creativity and consistency. Time Magazine states that Americans look at their phone 46 times per day, on average. That results in 46 opportunities for your business to be noticed and stand apart from others. So how do you stand apart?

SHOW LOCAL LOVE

Whether you’re in a tiny town or a trendy neighborhood in a large city, there are always local business and organizations that can be principal component in building a brand that establishes a community presence. Visit local business, share your experience, use their hashtags, check-in at their location, etc. Businesses within your neighborhood are a part of what makes your community appealing and will draw your clientele in. These businesses also thrive on word of mouth and mutual marketing relationships. Local organizations will show their appreciation by creating a positive word of mouth and providing potential referrals. SHOWCASE YOUR COMMUNITY’S GREATNESS

Amenities are often important in the leasing process. However, being able to feature your current residents enjoying those amenities and having an excellent experience is much more influential. It gives your prospect the ability to see themselves in your community and imagine what their experiences and lifestyle would be like. DON’T LET YOUR BUDGET STOP YOU

For example, if you lack in funds to create a mini model considering filling blue and white balloons for the bathtub to mimic bubbles! MailChimp helps you create beautiful email campaigns and enables you to analyze your results. There are three pricing levels: Free, $10 per month, and $199 per month. Campaign Monitor is another software that helps you create professional-grade email campaigns,and allows you to track who is opening your emails and where they are located. Their three pricing levels are $9 per month, $29 per month, and $149 per month. Campaigner is an email automation platform that helps your property get results from email marketing campaigns. The software offers advanced segmentation, A/B split testing, templates, and tracks purchase behavior. They have a variety of pricing options based on the number of contacts your property has, ranging from 1,000 to 10+ million contacts Email marketing not only generates a substantial amount of leads for your property, but it is also a marketing strategy that successfully nurtures your leads. You will stand out to potential residents who are looking for a community that understands their wants and needs. Conduct proper research before developing your campaigns, and you will be well on your way to reaching capacity.

Now that you have targeted your audience, use your homepage to capture interested users. Establish a list of potential renters and place a “Subscribe Now” button on your homepage. This allows the people that you may have missed on your list to still have a chance to become part of your community. The key to successful lead generation and nurturing is consistent messaging that is relevant and enhances your property as a trusted authority in the multifamily community. DEVELOPING AND NURTURING LEADS People check their phones up to 150 times per day. This gives your property or company multiple opportunities to get on your target residents’ radar, but you have to send the right content at the right time. First just wow! As Vice President of AAA, the thing that worried me the most was choosing a theme for this year’s Trade Show. I can honestly say one of my true weaknesses is that I am not a very creative person, and this had me fearful for my association life.

I

asked myself and a slew of other people what the theme should be this year. I even asked Kristan what the themes were for the last decade. She provided me with the list and still I came up empty handed. I came up with sports themes which is totally me but it just didn’t feel right either; I mean it just wasn’t original, ya know? Decade themes were played out, movies, TV shows, music, Mardi Gras…all fell flat. Then all the sudden, someone said, “clowns” to me. Yes, that’s it! Clowns! Then I found out Terri Needham is terrified of clowns. No joke. So pulling off Pennywise from the movie “IT” was out the window. What could I do? Seriously! Somehow I came up with Carnival—a spoof off the clown thing. Yes, there you have it but wait, I’m not quite there yet. I wasn’t sold on this theme 100% either. What would we do for the cover? How would everyone get involved with it? What would they dress up as? I truly was concerned because it wasn’t visual to me yet. SO are you ready?! Here’s what happened… I went to the movies with my wife and daughter and saw the “Greatest Showman on Earth.” If you haven’t seen it, I strongly suggest doing so. I’m man enough to admit it. It’s a little more of a musical than I like but I walked out pretty impressed. P.T. Barnum’s story sold me on the Carnival theme. I finally saw the vision. I mean with help from Dana and Jen, of course. A quote he wrote that inspired me was “The noblest art is that of making others happy”! What a concept with such a great meaning for our industry. Like a true showman, let me say, “ Come one, come all to the

Greatest TRADE SHOW on Earth”! The 2018 Carnival Trade Show, where I’m sure we will make it a circus! he 2018 Austin Redbook seminars were great! That seminar always draws the largest and most interactive audiences. While it is designed to cover a vast array of topics, there are always questions which arise, yet cannot be answered due to time restrictions. Drawing upon a wealth of very intuitive inquiries, this Law in Order: The Warren Report will answer some of those questions to round out the 2018 Austin Redbook experience! Question from Amy: “For assistance animals, can a pet interview still be required? Or does this go away like breed and weight restrictions?” Answer: Giving yourself an opportunity to see the animal before you approve it, even if it is an assistance animal, is a good idea. There is a lot of phony and misleading information for sale on the Internet which is designed to deceive you about “service animal” status. It is therefore likely that you will base your approval of the animal on the way the applicant or tenant describes it, using their potentially false

information. This is very risky. When one seeks approval of an animal by using pretend paperwork bought on the Internet, the situation addressed in that paperwork frequently fails to accurately identify the animal. This indicates to you that further inquiry may be necessary before you grant an animal accommodation request. Also, if a support or service animal poses a direct threat to person or property, approval may be denied or even revoked. It is better to know before the animal moves in, therefore, if it truly is as represented, and if it poses a direct threat. One of the best ways to make that determination is to see the animal for yourself and evaluate (even informally) how it responds to various people and circumstances. Question from Greg: “In the context of a hostile environment, what would be the best course of action if a resident brings a situation to management, but fearing retaliation, asks you not to address the situation?” Answer: As was indicated on Slide No. 97 of the Redbook presentation,

management and ownership can be exposed to liability for harassment by a third-party if they become aware of harassment yet take no corrective action. If you evaluate the situation presented to you creatively, you ought to be able to discover a way to address it without revealing who reported it to you. You would certainly not identify the complainant, either by name, address, or even apartment building. But you could send a letter to the party being complained of and advise them of how the prohibited conduct provision of the lease (paragraph 20) prohibits certain conduct (which you allude to using lease paragraph 20 terminology). You would not need to accuse the recipient of that letter of having engaged in that conduct. You would only need to bring to that person’s attention the reported improper conduct, using what you believe to be the most relevant provisions and terminology from paragraph 20 (Prohibited Conduct). Once you do that, you could note that lease paragraph 32.1 (Acts of Default) causes a violation of paragraph 20 to become a default under the lease. You could then take it one step further and point out how a lease default gives the owner various remedies under lease paragraph 32.2 (Eviction). Hopefully you would make your point and the conduct would be reduced or eliminated. If not, the


problem could be severe and more direct action might be necessary. Question from Anonymous #1: “If you approved an emotional support animal for an incoming resident, but at that time did not require paperwork to establish the nexus between the specific disability related need and the animal in question, can you require paperwork upon lease renewal?” Answer: The answer depends upon the nature of the disability of the animal owner. For example, if the disability related need and the disability are obvious or readily apparent, you may not seek paperwork in the first place. On the other hand, if neither are readily apparent, it is prudent for you to make additional inquiries which may result in you receiving paperwork. In this situation, the emotional support animal was already approved without paperwork. Unless there were circumstances which arose during the tenancy (e.g., examples of the animal posing a direct threat) it would not be wise to ask for paperwork upon renewal. Remember, however, that even though the support animal was initially approved, that approval may be revoked under certain circumstances. A situation where the animal poses a direct threat to a person or property is one. Another would be if you learn that the person does not meet the definition of a person with a disability. Yet another would be if you learn that fraudulent representations were made in connection with the approval of the animal, which you relied upon to your detriment in granting the accommodation. Question from Elizabeth: “If you enter an apartment in accordance with lease paragraph 28 (When We May Enter), what do you do if the resident, who is not present upon entry, accuses you of theft?” Answer: Anticipate that such an allegation might arise. Make reasonable

If false allegations of theft are made, be prepared to defend against them by having appropriate paperwork, following appropriate written protocol regarding the entry, and having multiple, honest people available to accurately describe all that occurred during the service call.

doing that if the visiting person is in the rental unit at least 40% or more of the time, especially if they stay overnight. The fact that you deemed it appropriate to have them complete a rental application in the first place suggests that these caretakers are there frequently. Obtaining information via the application, then processing that information, and exercising due diligence to learn all you can about those people is a wise practice. If the caretakers will be on your property regularly, and therefore able to encounter other residents, occupants and guests on a frequent basis, you should give serious thought to adding them to the lease. If they will be on your property full-time, add them as a resident. If they only visit part-time, or do not spend the night, add them as an occupant. According to TAA lease paragraph 29 (Multiple Residents) if any resident or their guest or occupant violates the Lease or rules, all residents in the rental unit are considered to have violated the Lease. If the violation ties in with TAA lease paragraph 20 (Prohibited Conduct), a violation of that paragraph is a default under lease paragraph 32.1(B), which states that a resident will be in default if the resident or any guest or occupant violates this Lease, apartment rules, or fire, safety, health, or criminal laws, regardless of whether or where arrest or conviction occurs. Upon default, moreover, lease paragraph 32.2 authorizes the owner to end that resident’s (and all his/her occupants’) right of occupancy through the giving of a proper notice to vacate.

That paragraph also provides that the owner may, but is under no obligation to, give prior notice or make appointments. Lease paragraph 28 also states that the owner’s representatives may peacefully enter the apartment at reasonable times for reasonable business purposes. Keep all of this in mind and remember that you are entering someone’s home. If the resident appears to be the uncooperative type, it may be prudent for more than one person to enter and remain throughout the ser-

True, one of the seven federal protected classes from a fair housing perspective is familial status. This frequently means persons with children. If prohibited conduct is occurring, take the appropriate steps to document those violations through well-crafted lease violation notices. Use specifics in the notice, like date, time, and a reasonably detailed description of the misconduct, and state your expectation (e.g., that the noise be significantly subdued or altogether eliminated). All your residents are easily going to be members of multiple protected classes. Presence in a protected class, however, does not excuse lease violations or acts of default. Question from Stacey: “Can an early termination fee be charged when there is a ‘skip’ (i.e., abandonment as defined in TAA lease paragraph 41.3) as opposed to the cost of reletting and accelerated rent?” Answer: There are two forms available in this situation which appear in the Redbook. One can be found on page 145 of the Redbook, entitled “Lease Addendum for Early Termination of Lease Contract.” The other can be found on page 359 of the Redbook, entitled “Agreed Early Move-Out Date and Lease Termination.” The first one, the addendum, is to be completed at the time the initial TAA lease contract is signed, to allow the owner to give the resident a unilateral right of early termination sometime in the future, and any move-out date is uncertain. Use of this addendum precisely states the procedure for early termination in

its paragraph three and addresses the payment of fees and other sums in its paragraph four. When this addendum has been signed, use its terms and provisions only. As an addendum, its terms supersede contrary terms in the lease. If you use the second form, note that it is an agreement rather than an after-the-fact addendum. The form appearing on page 359 of the Redbook is essentially a template into which the parties insert their agreed-upon terms, deadlines, payment responsibilities and special provisions. According to the commentary on Redbook page 359, this form is not a lease addendum, but is for use when an early lease termination was not

anticipated when the lease was originally signed. If you have an abandonment (skip), and neither of the foregoing forms have been signed, the owner’s financial remedies are set forth in the lease. Lease paragraph 10 identifies the amount and the four conditions under which a reletting charge may be collected. Lease paragraph three identifies the beginning and ending dates of the lease term. Lease paragraph six identifies the monthly rental amount and any late charges. Lease paragraph seven identifies financial responsibilities for utilities and services. In the event of an abandonment, the resident is responsible to pay rent and other sums as provided in the lease until the premises have been rented to others, who then begin to pay rent for

themselves. The financial obligations of the lease continue until the earlier of the date of lease expiration or a replacement resident has been found and begins their own performance. Question from Anonymous #3: “If a tenant defaults on a lease or is evicted, can the tenant be charged for all cleaning costs or just those above normal wear and tear?” Answer: The standard practice for security deposit deductions and charges due upon move-out is to only charge for detrimental conditions beyond normal wear and tear. Paragraph 40 of the TAA lease goes further and adds clarity. That paragraph sets forth an exhaustive list of permissible charges and deposit deductions. By including those charges in the Lease, which is signed by both owner and resident, an agreement as to those types of charges being legitimate is reached. Of course, you should be prepared to prove that charges of the type specified in paragraph 40 are necessary and supported by documentation or photographs. You cannot punish a defaulted tenant or one who is evicted by ignoring the reasonable wear and tear standard. You can, however, hold such a tenant to all lease obligations and enforce your rights under the security deposit statute. Question from Annie: “Do applicants have to disclose if they have been arrested if the case was dismissed/ expunged? If not disclosed, is that considered a misrepresentation?” Answer: The current Rental Application for Residents and Occupants can be found at page 689 of the Redbook. In the section entitled “Criminal History,” it does not ask if one has been arrested. An application fee, however, is not necessarily limited to the sums you paid to a third-party. You may incur internal costs of screening an applicant for acceptance; and if you do, reasonable costs for that could also be included in the application fee. Perhaps you previously referred to these internal costs as administrative costs. Bear in mind, however, that it is easy to justify what you pay to a third-party, for you will likely be invoiced for their services. Your internal costs are harder to quantify, making them easier to challenge. Remember that when the TAA application eliminated reference to administrative fees, it did so as a business decision. The law does not prohibit the charging of administrative fees; but if you do charge them, be certain you are able to justify their necessity and amount. If you cannot honestly or realistically do this, trouble may ensue. The foregoing questions represent only about one third of those which were written on note cards and provided at the Austin Redbook Seminars. Space simply prohibits responding to all of them in this article.
