yan brings over 13 years of high level sales experience to Gage Multifamily Services. He most recently spent 2.5 years as a Regional Sales Executive working primarily in Austin and San Antonio. Angel’s role will be to supervise a crew of HVAC technicians and electricians performing R410A conversions & electrical work in and around the Austin area. Prior to joining SKLD Mechanical, Angel spent 11+ years on the owner/management side doing

on-site maintenance and has held positions from Groundskeeper to Director of Maintenance for an entire portfolio. Angel is a former AAA Education Committee chair from 2013-2015, serves on the Board of Directors for both the Austin Apartment Association, and AAAEF (Austin Apartment Association Education Foundation) and is a proctor for Esco Institute and R.S.E.S. (Refrigeration Services Engineering Society).

PERSPECTIVE NEW YEAR, NEW GOALS.

A

s we wrap up 2016, it’s time to look forward to January, the new year, and new goals for ourselves. If one of your goals is to become more involved in the association or learn more about the association, THIS IS THE TIME! Check out the AAA Bucket List in this issue for some ideas on how you can get involved in 2017. Many people think you have to know someone already involved in the association to get involved. I won’t lie: it is easier to attend events with someone else and sometimes a company will pay for only one person to attend. I’m here to tell you, those are excuses keeping you and your career on hold. No more excuses! Let me share how I became involved in the association because I didn’t start out with the networking group I have now and I certainly didn’t know Kristan or any of her team many years ago. I began working as a leasing consultant to put

myself through college. As a leasing consultant, we would get to attend the Summer Boat party which is like today’s May Madness. The company I worked for did all their training in-house so the only educational event we attended was for Fair Housing training at the association. Those two things comprised my start in association involvement. I attended training classes by myself, so I had to make new friends during the seminars. As I attended more classes and various events, I met more people and when I would attend an event I would see them there so I would know someone. Then after a couple years, I started attending the education committee where I met a few more people and began feeling more

comfortable around the association. By the way, education wasn’t the first committee I attended, but it was the one where I felt most comfortable and able to grow my involvement. As you can image, through staying involved in different committees and education classes, my network of friends grew. Still today I try to meet new people when attending various functions, not only to continue to build my industry network, but because I was once that new person and wanted to become more involved. My ask of you, is when you see me at an event or meeting, please come up and introduce yourself, then turn around and find that new person in the crowd and make them feel at home within the association.

Industry UPDATE TENANT DISPLACEMENT NOTIFICATIONS, EXPEDITED PERMITTING, AND ENDING VETERAN HOMELESSNESS IN AUSTIN By Paul Cauduro, AAA Director of Government Relations Citywide Tenant Displacement Notification Rules Now in Effect

“AAA is committed to participating in the rule-writing process so that the ... requirements are practical and do not cause undue compliance burdens on members.

After nearly three years of on-and-off discussions and stakeholder outreach, (including several draft iterations of an actual ordinance in the last three months), the Austin City Council finally adopted the Tenant Notification and Displacement Ordinance. The program establishes notification standards and procedures for tenants being displaced for development projects. The program also establishes fees to be paid into a citywide “Displacement Fund” by development applicants for redevelopment or demolition projects that will displace existing residents. Prior to their final vote, the Council rejected language proposed by Councilmember Sherri Gallo that would have better defined “displaced tenant” and would have made only those tenants current on rent and not under an eviction judgment eligible for tenant displacement funds from the city.

In general, the adopted ordinance works as follows: 1. Notification Requirement Multifamily: Applicants seeking to rezone, demolish or partially demolish multifamily buildings of 5 or more residential units would be required to provide notification to tenants at least 120 days before the permit application is processed. The notification will be crafted by the city and will include information on available relocation assistance and other programs and policies relevant to tenant needs. Signage on the property is also part of the notification requirement. 2. Notification Requirement Mobile Home Park: Applicants seeking a rezone of a parcel with a Mobile Home (MH) designation, or seeking a change of use or site plan approval for a parcel with a mobile home community, would be required to provide notification to tenants at least

270 days before the park would be closed. Like the multifamily displacement notices, the notification language will be crafted by the city and will include information on available relocation assistance and other programs and policies relevant to tenant needs. Onsite signage is also required. 3. Relocation Assistance Fees: Compliance with the tenant relocation program would be required for any Planned Unit Developments (PUDs) within the City’s zoning jurisdiction where the PUD would displace tenants. Development Applicants seeking other discretionary land use approvals, such as rezones or changes of use may also be required to pay into the fund. 4. Creation of Tenant Relocation Assistance Program: The ordinance would create a tenant relocation assistance program to be administered by Neighborhood Housing & Community Development. This program would include financial assistance distributed to income-eligible tenants if they are displaced due to demolition or redevelopment. The fund may also provide assistance to those displaced due to development that does not involve PUD’s or rezoning and displacements due to temporary or emergency relocations. is uncertain. The City’s Tenant Displacement Program will be guided by “Administrative Rules” that are being written and a citywide study must be performed prior to establishing the fees. However, initial funding for the program has been secured for the 2016-17 city budget and the program will begin absent rules and applicant fee revenue. AAA is committed to participating in the rule-writing process so that the notification procedures and related requirements are practical and do not cause undue compliance burdens on members. Austin Creates Expedited Permitting Process The City of Austin’s Development Services Department is creating a new, voluntary program that will accelerate the building plan review and permit

process. Once created, the Expedited Permitting process will involve a single review session with a consolidated team of plan reviewers representing all the required disciplines for permit approval including building code, mechanical code, plumbing code, electrical code, fire code, tree arborist, zoning code and more. As tentatively planned, project applicants will attend a pre-scheduled, single-review session with the Expedited Permitting team ready to make on-the-spot decisions and changes to the plans as needed. Project contractors and owners will be encouraged to attend the review session. If the plans meet the respective codes and ordinances, permits can be issued after the review session. If the review requires changes in the drawings, the jointly approved changes can be made during the review session and signed by the applicant’s consultants as required. If revisions cannot be completed or agreed upon at the review session, a follow-up review session with the

same team will be scheduled. The rate structure is currently in development but for small scale multifamily projects Expedited Permitting is estimated to cost approximately $1,500 for a two-hour session. Despite the appeal of one-day permit approval uncertainties exist among the development community regarding the program requirements established by City Council. The mandates stipulate that any projects using the Expedited Permitting Process must include construction worker protection standards including workers’ compensation coverage, payment of the city’s calculated living wage with oversight and safety training and onsite safety monitoring. The worker protections standards are not supposed to be required for residential projects, but mixed use multifamily projects and multi-phased projects with a residential component may not be exempt from the worker protection mandates. Guidelines for the Expedited Permitting are being finalized and AAA is involved in the stakeholder process. HUD Secretary Castro Recognizes Efforts to End Veteran Homelessness Housing and Urban Affairs Secretary Julian Castro recently traveled to Austin to announce the U.S. Interagency Council on Homelessness, HUD, and the Department of Veterans Affairs have confirmed the City of Austin has effectively ended homelessness among veterans in Austin. This designation reflects the USICH’s confidence that Austin has built the infrastructure and systems that will ensure any homeless veteran in Austin will quickly get the help he or she needs to get into a permanent home. A total of 682 veterans have been placed into permanent housing as a result of Austin’s efforts. In their public remarks both Secretary Castro and Austin Mayor Steve Adler recognized the role the Austin Apartment Association played in building Austin’s system by engaging rental property owners through extensive

Nationwide more than 700 communities have taken on the challenge to end veteran homelessness but only 31 communities have been recognized for their success.

AFD APARTMENT INSPECTIONS

GUIDE&CHECKLIST F R O M T H E AU S T I N F I R E D E PA R T M E N T

Have local fire department safety inspectors visited your property lately? If not, don’t worry — they’ll be contacting you soon. Local fire departments are ramping up their inspection efforts to make sure all area rental communities are providing a safe place for residents to call home. Do you know what the inspectors are looking for and if your property is in compliance? Following are the inspection criteria used by the Austin Fire Department. 1 Are address, building AND apartment numbers

clearly visible? a. Street address numbers shall be plainly visible and legible from the street fronting the property. A minimum of 8” in height is recommended for any new sign placement. b. Building numbers must be visible from the fire access road, and are to be a contrasting color to the numbers’ background. A minimum of 8” in height is recommended. c. Apartment Numbers are required on each apartment and are to be a contrasting color to the numbers’ background. A minimum of 4” in height is recommended. 2 Can emergency vehicles enter the access gates?

a. Except in rare circumstances, AFD only requires ONE

entrance to an apartment complex. i. Unless approved by Fire Prevention, this entrance needs to be from the street on which the complex is addressed. b. All electronic gates that may be used to enter an apartment complex must be operable by a KNOX key. c. A chain and a KNOX padlock are allowed if the gate is not electronic. d. Entry gates shall be a minimum of 25 feet (can be 20 feet with Fire Prevention office approval) for two way traffic and a minimum of 15 feet for one way traffic. i. If there is an island for electronic resident access in the middle of the entry road, it is considered to be “one way traffic” on each side of the island. 3 Are Knox boxes installed as required?

a. Knox boxes are required on any property (including apartments) that has a monitored alarm or sprinkler system. b. Knox boxes should be located at the front access gate or the main office or clubhouse of an apartment complex. c. Keys are required for entry into all riser rooms and for entry into the building which houses the alarm panel.


4 Are the fire lanes being properly maintained?

a. Proper fire lane markings must be maintained. b. The markings must be red with white stenciling or white with red stenciling reading “FIRE ZONE/TOW AWAY ZONE” or “FIRE LANE/TOW AWAY ZONE” in lettering at least three inches in height. The stencils shall be at intervals of 35 feet or less. 5 Are the gas meters located in an area where they

are subject to vehicular abuse? a. Above ground gas meters, regulators, and piping must be protected from vehicular damage. b. Texas Gas Service will install protective posts at a charge to the property owner. The price will vary according to the amount of materials needed to complete the job. from buildings? a. Dumpsters shall not be stored in buildings or placed within 10 feet of combustible walls, openings, or combustible eave lines. b. Fences placed around dumpsters are allowed, but must also not be placed within 10 feet of combustible walls, openings, or combustible eave lines.

7 Are all smoke detectors installed as required and

are those smoke detectors operational? a. Detectors shall be in installed and operational. b. The detectors may be installed on the ceiling (not less than 4” from the wall or less than 3’ from an AC register), or on the wall (not less than 4” nor more than 12” from the ceiling). c. In all residential occupancies (including apartment complexes), a smoke detector shall be installed in each sleeping room and at a point centrally located in the corridor or area giving access to each separate sleeping area. d. If the apartment unit is more than one level, detectors are required on each level. e. When sleeping units are on an upper floor, a detector should also be placed on the ceiling in close proximity to the stairway. f. We will be checking 10% of the units’ detectors, and recording the percentage of un-installed and/or non-operational detectors. i. If there is a high incidence of failures, we will be required to check the detectors in all units in the complex. ii. Although replacing batteries is the tenant’s responsibility, it is a good idea to have the maintenance personnel bring spares, just in case.

8 Are fire extinguishers properly installed and

maintained? a. For every 3000 square feet of floor area, one 2A 10BC extinguisher is required to be located in a common accessible area. b. There can be a maximum of 75’ travel distance from anywhere in the complex to the nearest accessible extinguisher. c. Except for extinguishers that are located in individual apartments (see below), all extinguishers must be mounted in a conspicuous location, as follows: i. The top of the extinguisher can be no more than 48” from the floor. ii. The bottom of the extinguisher can be no less than 4” from the floor. iii. The operating instructions should be facing out. d. Centrally located extinguishers (as outlined above) must be tested annually. A punched tag (any color, other than red) must be affixed to the extinguisher, unless the extinguisher is less than one year old (with proof of purchase). e. A 1A 10BC extinguisher may be placed in every apartment/condominium unit, as a substitute for the above requirements. They may also be substituted in separate office areas. i. 1A 10BC extinguishers located inside of individual units are required to be present and charged. They do not require an annual inspection, and do not require a tag. ii. If 1A 10BC extinguishers have been substituted for the larger, centrally located extinguishers, each attached garage requires an additional 2A 10BC extinguisher. f. Detached garages always require a 2A 10BC extinguisher.

9 Is the sprinkler system in proper working condition?

a. If the complex has a sprinkler system, it must be annually inspected by a State Licensed Sprinkler Inspector and (blue) tagged. This blue tag must state that the inspection was for an ANNUAL inspection and that the test was ACCEPTABLE. If the test was unacceptable, either a yellow tag or red tag should accompany the blue tag. If theproblems identified in the yellow or red tags were fixed, then a white tag should be added stating that the yellow or red tag impairments have been corrected. Each riser should have their own inspection tags. b. NOTE that if a sprinkler system is red tagged (or found to be inoperative), a fire watch will be required. c. If a sprinkler system is yellow tagged, a fire watch is not normally warranted, but a follow up inspection is required. d. Fire Department Connections (FDC’s) must be plainly visible from the fire access road. e. Fire Department Connections (FDC’s) must have caps installed. 10 Is

the alarm system in proper working condition? a. If the complex has an alarm system, it must be annually inspected by a State Licensed Alarm Inspector and (blue) tagged. This blue tag must state that the inspection was for an ANNUAL inspection and that the test was ACCEPTABLE. If the test was unacceptable, either a yellow tag or red tag should accompany the blue tag. If the problems identified in the yellow or red tags were fixed, then a white tag should be added stating that the yellow or red tag impairments have been corrected. These tags should be affixed to the main fire alarm control panel. b. NOTE that if an alarm system is red tagged or found to be nonoperational, a fire watch may be required. c. If an alarm system is yellow tagged, a fire watch is not normally warranted, but a follow up inspection is required. d. A fire alarm system is retroactively required in all multi-family occupancies more than three stories in height OR with more than 16 dwelling units when the complex does not have a supervised automatic sprinkler system with local notification.

storage causing a fire or life safety hazard? a. Combustible materials may not be stored under stairways. b. Motorcycles and other fueled equipment may not be stored under stairs or inside apartment units. c. Combustible materials may not be stored in mechanical rooms. d. Combustible materials may not be stored within 18” of gas water heaters. e. Storage may not block any emergency exits. f. Flammable liquids and pool chemicals shall not be stored in apartment units (see 15 &16, below).

attic draft stops installed as required and being maintained in good condition? a. Required when the attic space is over 3000 square feet (and is at least 30” in height). b. Existing draft stops must be maintained. c. Draft stopping materials shall not be less than 1/2” sheetrock, 3/8” wood structural panel, 3/8” Type 2-M particle board or other approved materials. d. Small gaps which are less than 1/4” are allowed by code. e. Doors separating attic areas must be of the self-closing and latching type.

13 Are barbeque grills being stored in or near buildings?

a. Barbeque pits, hibachis, or other cooking appliances utilizing charcoal, wood, or gas as a fuel may not be used or stored on any balcony, within 5’ of a combustible building, or within 15’ below any portion of a combustible balcony. b. Electric cooking appliances are specifically excluded from these requirements. 14 Are propane cylinders being stored or used on balco-

nies or inside any building? a. Propane cylinders are not allowed to be stored or used on balconies or inside any building. 15 Are pool chemicals being stored safely?

a. The door to the pool chemical storage area must be labeled “WARNING—POOL CHEMICALS” or “OXIDIZERS” or labeled using an NFPA 704 diamond (3-health, 0-flamability, 2-reactivity, oxidizer). b. More than 110 pounds of Calcium Hypochlorite, 150 pounds of other Chlorine products or more than four gallons of Muriatic Acid requires a Hazardous Materials Permit. c. Oxidizers (Chlorinator) and combustibles must be separated by either a non-combustible, liquid-tight, line-of-sight barrier or by providing a minimum 5’ separation between chemicals. Storage in a hazardous materials cabinet is also acceptable. d. These chemicals may not be stored in any building or room that is in or directly connected to any apartment building. 16 Are flammable liquids being stored safely?

a. Flammable liquids to be used for maintenance and equipment operation must be stored in approved containers. b. These liquids may not be stored in any building or room that is in, or directly connected to, any apartment building. c. Up to 10 gallons may be stored on site without a Hazardous Materials Permit.

17 Are the laundry rooms safe?

a. Lint must be removed from dryers on a regular basis. b. One 2A 10BC fire extinguisher must be accessible and in a conspicuous location, inside the laundry room. 18 Are the fire hydrants in good working condition?

a. Hydrants must be maintained in good working condition. If they are private hydrants, they must be inspected annually by an (Austin Water and Waste Water) approved contractor. Documentation must be provided. b. Must have 3’ clear working space around hydrant. 19 Is the swimming pool protected from unwanted entry

by very young children? a. All swimming pools must have enclosures of a minimum 4’ in height. b. All gates shall be equipped with self-closing and self-latching devices. c. No openings in the pool enclosure can be more than 4” in diameter. d. Each pool or spa shall have a telephone that is capable of immediately summoning emergency service and that is readily accessible within 200 feet from the pool or spa water. i. Any other electronic means of summoning emergency service will qualify as a telephone if clear instructions for its use are provided by signage. ii. A telephone that is answered by an on-site office does not meet the requirement. iii. A telephone that is answered by a State Licensed, Alarm Monitoring Company does meet the requirement. iv. The telephone may be located inside or outside of the pool yard or spa yard if the enclosure entry gates and doors of the pool yard or spa yard are never locked in any manner. 1. If the pool yard or spa yard is ever locked (inside or outside) for any reason, the telephone must be located inside the pool or spa yard. v. If the telephone is not readily visible from the pool or spa, a sign shall be placed inside the pool yard or spa yard giving a concise description of the location of the telephone. 20 Are there any other fire or life safety hazards on

this property? a. Are exit lights illuminated and working on both AC power and battery backup? b. Is emergency lighting operative? c. Are interior exiting hallways clear of obstruction? d. Are exterior exiting breezeways, balconies and landings clear of obstruction? e. Is there combustible vegetation or rubbish too close to apartments and determined to be a fire hazard?

AAA Community Outreach has a long history of helping the community. From the Doc & Gayle Young Food Drive to the Red Cross, the association is active in the community of caring. While these efforts benefit a great many people in many different ways, once in a while, we are able to support a cause near and dear to an association member. In 2014, the committee chose to add Brady’s Bridge to the roster of outreach beneficiaries.

A

family with a special needs child, AAA member Tabitha Fry and her husband created Brady’s Bridge as a way to help other families in the same circumstance. Here, Tabitha gives a little more information on their organization and how AAA members can help.

What is Brady’s Bridge and whom do you help? Brady’s Bridge is a 501c3 Non-Profit. Our mission is to ease hardships for families of kids with special needs or long term illness by providing financial support and resources.

When, why and how did Brady’s Bridge begin? Brady’s Bridge became a business/Non-Profit in 2012. However, our journey truly began the prior year, with the birth of our son, Brady. At 20 weeks in the womb, the doctor diagnosed our baby boy, Brady, with hydrocephalus. Brady was born on 1/2/11 at 28 weeks’ gestation. He had a 120-day stay in the NICU. His first year included a total of 25 surgeries (10 before he left the NICU), 24 of those were

brain surgeries (shunt revisions). The other surgery was for a g-button to allow for a feeding tube. In December of 2011, we were in the hospital with Brady from December 2nd until December 24th. It was tough being in the hospital during the holidays, but we found ways to celebrate being together. One way was by putting up a two-foot Christmas tree in our room. The nurses loved it as a night light and it brightened our spirits. During that stay at Dell Children’s Hospital, my husband and I realized it was in both of our hearts to help Brady’s first day of Kindergarten


and ornaments for $10 each. The easiest way to help is with donations. Every $10 donated, brightens the room of a child in the hospital this year. It is also something the child can take home and keep and reuse. Each year it is a reminder of what they have overcome. In the long term, additional fundraisers and volunteer opportunities can be found on our website, www.BradysBridge.org. Other fundraisers will benefit families financially.

What have you gained or learned through the creation and work of Brady’s Bridge? First, I have learned that heroes come in all shapes and sizes. I have learned how precious every moment is with your loved ones and the importance of enjoying the moment you are in. A smile can change your day and everyone around you. I have also gained an incredible admiration for the people I work with and this industry as a whole, for the love and support they have shown our family and others.

Where do you see Brady’s Bridge going in the future? In the midst of our “new normal” with Brady, we found it was incredibly challenging to find resources, such as different therapies that might help children with special needs and finding daycare options that could accommodate our son. There also was the added stress of medical bills and equipment that private insurance would not cover - that truly was a necessity for Brady developmentally. Our goal is to increase fundraising opportunities to provide financial support and resources for families in need. We truly want to “bridge the gap” for families lacking these necessities.

The Warren Report PREVENTING A “FAILURE TO COMMUNICATE”

The U.S. Department of Housing and Urban Development (HUD) publishes a guidance preventing LEP discriminatory housing practice.

ailure to communicate can be problematic. Sometimes, the failure is easily cured simply by being a more careful listener. If there is a language barrier, the failure can easily continue until those communicating master essential elements of one another’s languages. One of the great actor Paul Newman’s most famous movies is Cool Hand Luke. Lucas Johnson was a decorated Korean War veteran who, upon discharge from the service, went back to the small town where he grew up. One drunken evening, Luke was cutting the heads off of parking meters in the town square. When asked why, he responded “this is a small town, not much to do in the evening.” Not being persuaded that the deed should go unpunished, the judge sentenced Luke to two years in a Florida chaingang prison. Luke often, although always unsuccessfully, tried to escape.

In one of the movie’s most famous scenes, the warden appeared in the prison yard with Luke and the other inmates after Luke had been apprehended on an escape attempt. As he was explaining to Luke and the others why Luke would now have to wear chains, and how it was for his own good, Luke commented that he wished the warden would quit being so nice to him. After doling out some painful punishment, knocking Luke off his feet, the warden offered this explanation: “What we’ve got here is failure to communicate. Some men you just can’t reach.” Following that cue, the U.S. Department of Housing and Urban Development (HUD) recently published a guidance aimed at preventing a “failure to communicate” from becoming a discriminatory housing practice. On September 15, 2016, the General Counsel for HUD, Helen R. Kanovsky, published an eight-page

paper entitled Guidance on Fair Housing Act Protections for Persons with Limited English Proficiency. This HUD guidance is not law. It does, however, conclude that the Fair Housing Act (FHA) prohibits housing providers from using Limited English Proficiency (LEP) in a way that causes an unjustified discriminatory effect. HUD lays down the rule. Selective application of a language-related policy, or use of the LEP as a pretext for unequal treatment of individuals based on race, national origin, or other protected characteristics, violates the FHA. Because there is a close link between LEP and certain racial or national origin groups, notes Ms. Kanovsky, restrictions on access to housing, based on LEP, disproportionately burden certain protected classes. If not legally justified, such restrictions may violate the FHA under a discriminatory effects theory. What is LEP? LEP refers to a person’s limited ability to read, write, speak, or understand English. Individuals who are LEP are not a protected class under the FHA. HUD states that there is a close nexus, however, between LEP and national origin.

Although language discrimination is not necessarily national origin discrimination, national origin discrimination includes discrimination because an individual has the physical, cultural, or linguistic characteristics of persons from a foreign geographic area. As it did with its April 4, 2016 guidance on the use of criminal records, HUD supports its LEP guidance with statistics. It states, for example, that more than 25 million persons in the United States, which is approximately 9% of the total American population, are LEP. Among LEP persons in America, the U.S. Census Bureau states that approximately 65% (16,350,000) speak Spanish, 7% (1,660,000) speak Chinese, 3% (850,000) speak Vietnamese, 2% (620,000) speak Korean, just under 2% (530,000) speak Tagalog (the basis of a standardized national language of the Philippines), nearly 2% (410,000) speak Russian, and smaller numbers speak dozens of other languages. HUD sets forth even more statistics it deems pertinent. Focusing on place of birth, in the United States 61% of persons born in Latin America and 46% of persons born in Asia are LEP, as compared with 2% of persons born in the United States. Based upon these statistics, HUD concludes that housing decisions that are based on LEP generally relate to race or national origin. Interestingly, national origin means the geographic area in which a person was born, or from which his ancestors came. That geographic area need not be a country for it to be considered someone’s national origin. Rather, that geographic area can be a region within a country, or a region that spans multiple countries. There has been a lot of recent political

discussion about wanting Americans to live in this country as opposed to non-citizens. The national statistics quoted by HUD in its LEP guidance demonstrate an inescapable connection between citizenship and LEP. For the U.S. population 18 years of age and over, 63% of non-citizens are LEP. Only 39% of naturalized citizens and 1% of native-born citizens are LEP. Once again, limited English proficiency (LEP) is not a protected class. A housing provider, nonetheless, violates the FHA if the provider uses a person’s LEP to discriminate intentionally because of race, national origin, or another protected characteristic. The key question when discrimination is alleged is whether the complainant suffered an adverse housing action because of their protected class. According to HUD, courts address-

ing the connection between language and national origin have often established a nexus between language requirements and national origin discrimination. What are some examples of LEP discrimination? A blanket refusal, obviously, to deal with LEP persons in the housing context is one. Such a refusal, concludes HUD, is not motivated by genuine communication

concerns. For example, LEP persons may speak English well enough to conduct essential housing-related matters. They may also have a household member who can provide assistance as needed. Other practices which HUD labels as suspect and likely to be discriminatory include advertisements containing blanket statements such as “all tenants must speak English,” or turning away all applicants who are not fluent in English. According to HUD, because a person’s primary language generally derives from his or her national origin, singling out persons for disparate treatment because they speak a certain language is typically national origin discrimination. National origin is one of the seven federal protected classes, even though LEP is not. If the housing provider, the applicant or the resident can access free or low-cost language assistance services, any costbased justifications for refusing to deal with LEP persons, says HUD, would be immediately suspect. Ms. Kanovsky goes on to add that the languages residents speak amongst themselves or to their guests do not affect the housing provider or neighbors in any legitimate way. Thus, she states, bans on tenants speaking non-English languages on the property, or statements disparaging tenants for speaking non-English languages, have no cognizable justification under the Fair Housing Act. Stated another way, absent such justification, HUD is inclined to find discrimination. HUD General Counsel Kanovsky notes that some try to align LEP issues in the employment context with LEP issues in the housing context. HUD points out that a housing provider’s relationship with the resident is quite different from that

of a supervisor with an employee. Generally, a supervisor in the workplace must instruct and monitor the employee to improve performance. Some employers believe that employees must speak English for effective supervision, a cohesive workforce and to put customers at ease. HUD does not believe the same reasons exist in the housing context. The relationship among neighbors, notes Ms. Kanovsky, also does not resemble that of coworkers because generally neighbors can coexist effectively with minimal communication. It is not always the inability to speak English which leads to claims of discrimination by LEP persons. HUD notes that a person’s accent and his or her national origin are “inextricably intertwined.” In its LEP guidance, HUD makes clear it is inconceivable that a housing decision which treats someone differently, because he or she speaks English fluently but with an accent, is anything but intentional discrimination because of national origin and a violation of the FHA. If you are a housing provider, and are only inclined to take adverse action against those speaking one foreign language rather than all foreign languages, HUD warns that you will still have serious problems. If you have a policy disfavoring LEP persons, notes Ms. Kanovsky, this can have a disparate

impact on persons of multiple national origins. Stated another way, the members of the injured group need not all be of the same national origin. According to a United States District Court case out of Hawaii, “If a policy differently affects individuals from nations where English is the primary language and nations where it is not, then the policy has a disparate impact.” Adverse actions against applicants, residents or occupants in the landlord-tenant context can be avoided. HUD contends in its LEP guidance that English proficiency is not always necessary in the landlord-tenant context, where communications are not particularly complex or frequent. A landlord may employ a management company with multilingual staff, or perhaps can otherwise access language assistance. If you have translated documents readily available, says HUD, provide them to the person in need. Likewise, do not restrict an applicant’s or resident’s use of an interpreter. Do not require that an English speaker sign as a guarantor on a lease, solely to get someone fluent in English involved in the leasing transaction. Some housing providers may believe that their language-related policy or practice is necessary to achieve a substantial, legitimate, nondiscriminatory interest. If that has been established in the discrimination analysis, HUD will require an

LEP Complainant to prove that the landlord’s nondiscriminatory interest could be served by another practice with a less discriminatory effect. In its LEP guidance, HUD offers tips. First, allow a tenant a reasonable amount of time to take a document, such as a lease, to be translated. Second, consider obtaining written or oral translation services. Third, draw upon the language skills of staff members of the owner or management company. Fourth, if the applicant’s or resident’s family has a member who speaks English, or brings another person along to interpret, agree to communicate through those English-speaking individuals. Each of these, notes HUD, could be a viable alternative to refusing to deal with anyone who does not speak English. As a footnote to its LEP guidance, HUD notes that for government assisted housing providers, requiring tenants to rely on family members rather than providing language assistance may not be permissible under Title VI. No further detail concerning this footnote, however, is provided in the LEP guidance. The movie, Cool Hand Luke, teaches two very useful lessons. First, some excuses for bad behavior simply do not work. Luke’s explanation that he cut off the heads of local parking meters because he lived in a small town, where there was not much to do in the evening, didn’t keep him off of the chain gang. Second, when what we’ve got here is failure to communicate, those in authority may dole out some pretty harsh punishment. Perhaps HUD General Counsel Kanovsky saw the movie, Cool Hand Luke, and took special note of the chain gang prison warden’s comment: “Some men you just can’t reach.” Her LEP guidance, after all, may not only reach but also shake some sense into those wanting to make housing decisions because of the language one speaks.
