PERSPECTIVE THIS ONE’S FOR DOC! This year’s annual volunteer food drive needs YOU.
T It is gratifying to be able to help so many people enjoy a Thanksgiving meal with their families.

he annual volunteer food drive began in 1986. 31 years ago, the drive was headed up by Steve Cartelli and served 600 Thanksgiving meals to Austin residents. Michael “Doc” Young got involved in 1987 and continued to devote his time to help feed Austin area families until he retired in 2012. He was happy to give his all year after year to accomplish the goals that were set and his passion for the food drive inspired so many people to become a part of this great event. Since its inception, the Food Drive has grown each year providing more and more families with wonderful Thanksgiving meals. And that’s not the only thing that increased each year under Docs guidance; this event also saw an increased number of volunteers and donors who really enjoy giving back to the community. As an added bonus, everyone was having

BIG FLOODS AND BIG TAX CHANGES CAPTURE INDUSTRY ATTENTION By Paul Cauduro AAA Director of Government Relations
Hurricane Harvey
Heavy rainfalls and subsequent flooding seem to happen somewhere every year.
Hurricane Harvey packed a wet wallop as a Category 4 storm that dropped some 51 inches of rain in and around the Houston area on August 25. Early estimates peg the damage caused by this storm at $180 billion which is more than any other natural disaster in U.S history except some of high estimates of the damage caused Hurricane Katrina in 2005. While official numbers are still being tallied, Hurricane Harvey damaged 203,000 homes including what could be more than 10,000 apartment homes. While 51-inch rain events like Hurricane Harvey may occur once in a lifetime, heavy rainfalls and subsequent flooding seem to happen somewhere every year. Long before this latest flood disaster struck Houston the National Apartment Association (NAA) and the National Multifamily Housing Council (NMHC) were pressing Congress for reauthorization of the National Flood Insurance Program (NFLIP) that was set to expire on September 30. When the NFIP was last reautho-
rized in 2012, the maximum NFIP policy coverage limit available for multifamily properties increased from $250,000 to $500,000 per building. This increase has been very positive for multifamily borrowers because it makes complying with lender flood insurance requirements easier when securing project
financing. Approximately 100,000 to 150,000 NFIP claims from hurricane Harvey’s flooding are anticipated to be filed. Existing law requires apartment properties with federally regulated and insured mortgages in highrisk flood areas to purchase flood
• Requiring Federal Emergency Management Agency (FEMA) to provide premium reduction to multifamily property owners to account for alternative methods of flood mitigation such as elevating utility systems since traditional steps like building elevation is not always achievable. • Ordering the FEMA Administrator to study the feasibility and soundness of offering business interruption coverage to multifamily property owners so they can recover and get residents back into their homes faster in the wake of a disaster. insurance, and the NFIP is the only coverage option available to the vast majority of apartment firms across the country because the private insurance carriers are hesitant to widely expand coverage beyond high-value and less-risky multifamily properties On Thursday, September 8, the President signed a three-month extension of the National Flood Insurance Program (NFIP). This action delays NFIP re-authorization until December 8, 2017. Between and then the NAA and NMHC will continue pushing for a 6-year reauthorization of the program with reforms that ensures flood coverage continues to be available at all times, in all market conditions for every at-risk rental property. Specific improvements that aim to better allow multifamily owners and operators to protect their properties from the continued risk of flood disasters include:

Tax Reform The topic of tax reform is dominating many of the discussions in our nation’s capital. The tax reform effort aims to not just simplify the code but to encourage investment and boost productivity to help workers. However even though there is strong support for a sweeping rewrite of the nation’s tax code, some pundits remain skeptical a that a tax reform can happen by the end of 2017. Since tax reform has the capacity to fundamentally reshape the multifamily industry the National Apartment Association (NAA) has been an active participant in the tax reform discussions. The NAA’s goal is to work with Congress and support a tax reform package that promotes economic growth and investment in rental housing without unfairly burdening apartment owners and renters relative to other asset classes. The NAA’s tax reform work s important not only for member companies but for the future of housing and housing affordability. The apartment industry nationally
supports 38.8 million residents and 12.3 million jobs, while contributing $1.3 trillion to America’s economy, and according to recently released research, by the end of 2030, the United States will need to build 4.6 million apartment homes to meet growing demand. To advance its tax reform goals the NAA in partnership with the National Multifamily Housing Council has launched a “Protect the Lease” campaign designed to ensure that lawmakers know what’s at stake for the apartment housing industry when it comes to tax reform. The campaign supports smart tax policy promoting economic growth, job creation, and investment in our neighborhoods and communities. Among the specific goals of the Protect the Lease program are: • Make known that debt financing plays an important role in building apartments and to make sure that the apartment industry can continue to deduct business interest costs. Any changes to how business interest handled could very well increase investment costs and reduce the number of new apartment units constructed. • Make sure that every type of
company benefits from tax reform so that multifamily real estate companies do not inadvertently shoulder the cost of a tax cut for large multinational corporations. • Ensure that the Low-Income Housing Tax Credit (LIHTC) program continues as a incentive that promotes housing production. The LIHTC program helps hard-working Americans should both be retained and significantly expanded in an overhauled tax code.
The NAA’s tax reform work s important not only for member companies but for the future of housing and housing affordability.

At that site you can take action by submitting a letter to our Congressman and Senators outlining the industry’s position on this topic. More than 30,000 letters have been sent to elected officials through the site, and as this issue heats up it is critical that your voice is included. THE POLITICAL ACTION COMMITTEE FUND GROWING STRONG.
T
he Austin Apartment Association established a general purpose political action committee (PAC) in the 1990’s to have greater participation in the local and state political process. A general-purpose PAC is devoted to a point of view not a political party, and the AAA PAC’s devoted point of view is: a free enterprise housing market works best when private property rights are honored and property owners and related housing service providers are able to provide dwelling units for rent without burdensome taxes, regulations and fees. Last year the PAC was revamped and given the new “Apartment PAC Austin” name with a new logo and new procedures to solicit and accept contributions. When it comes to non-event related contributions from members, we now ask these contributors to renew their investment in January rather request contribution renewals throughout the year. Those that make individual contributions at the $99 Downtown Studio level and above are invited to attend an exclusive annual “thank you” reception held in February. Watch for an announcement soon revealing where the 2018 reception will be held. Key association events such as the Fall Golf tournament, Spring Top Golf and the Annual Business exchange are still used to raise funds for both Apartment PAC Austin and the National Apartment Association PAC, and participation in those events is very much appreciated. When resolving conflict, do you go with the flow,

Conflict abounds, but it is not always a bad thing. Think of conflict like water – it’s everywhere - it has immense power to be both destructive and calm. To be both dangerous and harmless. To move forwards and backwards. However, unlike with water, we have a choice in how we use conflict to change. There is a potential for conflict in all our relationships — family, friends, co-workers, residents and suppliers. When conflict happens - you have two choices. 1. Blame someone else, pass the buck and judge others; or 2. Take responsibility. Irresponsibility is easy. But, don’t be too hard on yourself – it’s in our nature to pass on responsibility, for fear of making a wrong decision. No one wants to be blamed for a bad result. The problem is if we don’t all fight the fear, nothing gets resolved. Being accountable is hard, especially in a situation involving conflict. Addressing any conflict directly is almost always the best way to deal with an issue. Here are a few other steps you can take that might help you take responsibility.

Withdraw from emotions. Conflict can feel very personal. Although it’s difficult, try to remove emotions from the situation. This is especially true in professional relationships. A resident’s dissatisfaction with their rent increase is not an attack on you personally (although it might seem like it).
Analyze the disagreement. This step is extremely important. If someone is upset (i.e. hasn’t withdrawn from their emotions), what they are trying to tell you and what you are hearing can be two different things. Clarify the conflict so that all parties understand the real issue. We are all too often juggling multiple conflicts, issues and problems
at the same time and one can often cloud another. Grant others the same courtesy you do for yourself (“I have a lot going on in my life, they must, too.”)
Take ownership
Each party should take ownership of their portion of the disagreement and possible resolution. This is also an appropriate time to seek advice from others (boss, friends, co-workers), but without giving up your authority. If you are a manager and a resident complains and the first thing you say is, “I will need to ask our regional manager,” they will never want to speak to you again. You have given up your authority and power and they will always want to speak to the regional.
Explain the solution(s) Just as with the “Analyze” step, this one must be thoroughly understood by both parties. If a resident believes the solution is waiving a pet fee, but you believe it to be a pet fee reduction – neither of you will be pleased. As much as you may want for a solution to be a Win-Win, it’s not always real life. In addition to explaining the solution, you must also explain the reasoning.
Resolution Successful resolution is the goal. When a conflict is resolved, it is important to grant forgiveness, even if unspoken. If you carry a grudge (against a resident, co-worker, supplier, friend, family member), you haven’t really resolved anything. Healthy relationships handle conflict and they can be made stronger.

Remember, conflict can be a catalyst for good change. It’s not always a bad word or an unpleasant experience. Just like water, it can overwhelm you or it elevate you – the choice is yours. After the storm had passed, we all saw the widespread devastation Harvey wrought on the Texas Gulf Coast. Members of AAA’s NextGen group jumped into action and decided to gather supplies from - not only our association members - but the entire community.
O
nce the initial post about collecting supplies hit the web, it was shared through various social media channels and AAA members, apartment communities, friends, family, neighborhood HOAs and even Leander ISD’s Henry Middle School donated items to this relief project. It was amazing to see everyone come together to help families in their hour of need. After about a week of collecting supplies, which resulted in two full truck loads, a few NextGen members made the trek to the coast to deliver items to families in Port Aransas. Most of the residents who live in Port Aransas lost everything. It was heartbreaking to see the devastation in person and all the damage caused by Harvey. What made this donation effort so worthwhile was seeing the appreciation and gratitude the residents, volunteers and emergency teams all had when we pulled up with all the items collected for their community. They were surprised we came all the way from Austin just to help them. The entire experience was

AAA Forms Housing Partnership with City of Austin in Wake of Hurricane Harvey In the wake of Hurricane Harvey, AAA called on all member property owners and management companies to upload any available rental vacancies, (as well as any possible concessions), to a portal developed by the City of Austin. Â Hurricane Harvey survivors in need of housing will be able to connect with available apartments in the Austin and broader area through a new website www.HousingOurSurvivors.com. The initiative is a partnership of the City of Austin and the Austin Apartment Association to facilitate connections to housing accommodations for survivors of Hurricane Harvey. The objective of the Web site is both to create an easy repository of information for regional rental property
owners and community managers who can highlight vacancies and incentives to assist as well as create an efficient place by which the public and emergency agencies can better facilitate access to available housing, not only after the recent disaster, but as needed in future situations.
AAA Makes Donation to Hurricane Relief The Austin Apartment Association Board of Directors voted at the September board meeting to donate $5,000 to the Red Cross. The board also earmarked an additional $2,500 to go to the Houston Disaster Relief Fund. AAA joins TAA and NAA in donating to hurricane disaster relief. The state and national associations each pledged $10,000 to the Red Cross for Hurricane Harvey relief.

association dues AAA Shifts Dues Renewal to Annual Cycle Beginning in 2018, AAA changes the annual membership renewal cycle to every January. In order to achieve this renewal cycle change, all members have been paying a prorated amount in 2017. Shifting renewal cycles means all members will renew their membership every January rather than the month the company joined the association (i.e. anniversary date).
Better Government Fund (BGF) The BGF is a suggested voluntary contribution amount included

The Warren Report THE VALUE OF COMPASSION AND EMPATHY There’s more to the relationship between an owner and a resident than just a contract.
T It’s important to understand a situation and exercise appropriate empathy and compassion to address it.

he last several months have afforded us much to reflect upon. Hurricanes, flooding and natural disasters have besieged the Gulf Coast. An unprecedented and meaningless shooting took scores of innocent people from us in Las Vegas. What’s going on? In 1970, the Motown performer Marvin Gaye recorded a song asking that same question. Although released in the spring of 1971, more than 46 years later a line from that song is relevant to today’s setbacks. The line is: “Talk to me, so you can see, what’s going on.” We do not need disasters to find people in trouble. In the business of providing housing to others, you are frequently faced with people who are experiencing some sort of problem. Perhaps your resident cannot afford to pay rent on time. Possibly your resident wants you to permit them to have one or more family members temporarily reside with them in their

rental unit, pushing the occupancy beyond your permissible limit. This increase may have been requested to enable those additional individuals to respond to the effects of a natural disaster which ousted them from their own home. The potential problems are endless. Compassionately addressing those problems, and enabling respect to be prevalent throughout the process, is priceless. The purpose of this “Law in Order: The Warren Report” is to underscore the importance of understanding a situation and exercising appropriate empathy and compassion to address it. If we can do this successfully, we have entered the heart of our respective professions. Empathy is defined as the ability to understand and share the feelings of another. Compassion, on the other hand, despite often being mistakenly seen as synonymous with empathy, is actually defined as sympathetic pity and concern for the sufferings and

misfortunes of others. In the rental housing industry, it is easy to overlook the value of compassion and empathy. The core relationship between an owner and a resident is contractual. We have a lengthy lease, with multiple addenda, which set forth the legal relationship between the parties. Contained within those agreements are matter-of-fact solutions to many problems that arise. In addition, we have forms and notices through which an owner can advise a resident of misconduct, deadlines, contractual violations, and unpaid indebtedness. Such documentation has been so well crafted that emotion, compassion and empathy can be effectively removed. Or can it? Having so many contracts in play at any one time provides many opportunities for lawyers to weigh in on what is happening. It is easy for an attorney, whose task is to interpret the lease and apply the law to the facts, to leave no room for concern about the emotional state of the parties who are directly dealing with the problem. It is commonplace for a lawyer to want to approach each case simply as a factual matter and give no more than minimal attention to the emotions involved. To view the practice of law as a set of legal problems that must be solved
like a puzzle is not a novel viewpoint. What becomes more novel, it seems, is to allow the law to be used as a vocation that assists people who have problems involving both factual and emotional dimensions. When you use an attorney to help you address a resident situation, you trust that the lawyer will, appropriately, evaluate all the dimensions as you and legal counsel collectively seek the appropriate solution. The attorney perceives that trust, and works to reward it. Many of you have either read the book, seen the movie, or both for the classic novel written by Harper Lee entitled To Kill a Mockingbird. The key character in that story, Atticus Finch, (outside the courtroom and in a highly personal context) told his daughter, Scout, “you never really understand a person until you consider things from his point of view...until you climb into his skin and walk around in it.” Such an undertaking, oddly, should not necessarily be discouraged. As with any profession, the rental housing industry presents us with frequent opportunities to evaluate and react to a resident or applicant issue by thinking outside the box. The box can be the contracts governing the landlord-tenant relationship. But the rest of the story begins and may even end with communications concerning the reason for the anticipated or actual breach of the contract. Why wasn’t the rent paid on time? Why did the resident advise you they are surrendering possession of leased premises well before the lease ending date? Is there
really a legitimate disability-related need for that service animal accommodation request? Is the tenant’s demand, (for money or an early release from the lease), something to be compromised and settled, or disputed and refused? It is often easy for problems to be grouped together rather than viewed individually. When we experience or hear about similar issues too frequently, it is easy to lose a connection with them. There may be a resistance to hearing someone speak. You may believe you know what a person will
say before they say it. If statements are presupposed, before they are actually made, the communication in which they are made is likely to be ineffective. If you operate with an agenda, but hear information from a tenant that doesn’t fit with your agenda, the result may be a glossing over of the issue without affording it the attention it needs for resolution. Joshua D. Rosenberg published an article in the 2004 University of Miami Law Review designed to enlighten lawyers about the skills
and importance of human relationships in the practice of law. Professor Rosenberg, for example, commented upon how easy it is for lawyers and academics to vastly overestimate the importance of reason and logic. He noted how there are important differences between the kind of dispassionate reasoning and analysis one is tempted to engage in at a desk in the office, and the kind of activities in which we engage when we are dealing in real time with real people. Stated another way, do not believe that effective concentration upon a lease, a notice, or a statutory provision leaves no room for concern about the emotional state of the parties involved. The practice of law, just like the living of life, is not simply a set of problems to be solved like a puzzle. To successfully practice and live requires assisting people who have problems involving both factual and emotional dimensions. This article is certainly not advocating that the well-refined contracts which we operate under in the rental housing industry be abandoned and that we all get soft. To quote Beverly Blanchard, who writes a blog entitled Ancient Wisdom, “the law of compassion is basically about allowing tenderness and kindness into all your thoughts and actions with yourself and others. It is softening your attitude, and allowing others to be who they are without judgment or condemnation. You simply allow yourself to see the world through someone else’s eyes.” Ms.

There is value to compassion and empathy in your profession.
Blanchard notes that there are many people who believe feeling pity for someone or something means they are exhibiting compassionate behavior. Yet she points out that compassion laced with pity almost always has its roots in guilt and fear, and carries a sense of condescension. For some there is even a smug feeling of “I’m glad it’s not me.” The value of a contract such as a residential lease can be balanced with empathy and compassion to achieve greater overall success and satisfaction. Success can be measured, for example, by the value to both you and your resident when you opt not to immediately evict a resident who is in the midst of temporary troubles, and instead choose to creatively use an “Eviction Hold Off Agreement.” Begin with communication. Seek honest answers to critical inquiries. Does the resident want to pay the rent? Can the rent be paid reasonably quickly? Are you willing to communicate with the resident in arrears to determine the underlying causes for the non-payment of rent? Positive answers to questions like these may enable you to become a competent evaluator of the facts and utilize traits like empathy, compassion, experience and understanding to guide your decision-making. In the end, perhaps the rent gets paid, the resident avoids eviction, and you avoid a vacancy and lost rent. Again, the cornerstone of the landlord-tenant relationship, the lease, need not be abandoned or even de-emphasized. Actually, the lease can be successfully utilized by both landlord and tenant if those parties
are willing to avoid certain empathy detracting behaviors. These include the use of clichés, distorting what is actually said, or responding defensively or negatively to questions. Communication will be effective if inappropriate language is avoided, legal jargon is minimized, and stilted phrases are eliminated. Often, the quality that elevates us from being great, and moves us into the next level beyond greatness, may simply be caring. Your job is difficult and challenging. You deal with all sorts of personalities, some good, others not. You are respon-
sible for the owner’s bottom line, yet seldom given adequate credit for your efforts and ingenuity. You are often blamed by residents for problems you did not create. Rude demands are frequently made of you, when a simple request would be much better received. Some residents believe you owe them the world, yet they agreed to nothing near that. The next time you are under the impression that someone has done something you perceive as wrong, take a step back before acting. Then try to take a step forward in their shoes. Try to understand what may be motivating
their behavior. Take the time to really listen to them. The blogger, Beverly Blanchard, states it like this: “compassion is not about sympathy, empathy or pity. It is not about doing something out of politeness, obligation or guilt. Living a compassionate life does not mean being a doormat to others. It does not mean allowing others to dump all their problems on you or to take advantage of you.” There is value to compassion and empathy in your profession. Certainly, that value is also present in my profession. Since we often work together as lawyer and client, think of our shared opportunity for gaining the satisfaction of knowing an effort was made to try to make a bad situation a little better. The end result may be the same. The rent may never get paid and an eviction may be necessary. The request for the emotional support animal may be entirely bogus, and made in bad faith. We may take the same action after employing empathy and compassion that we would have taken had we not done so. Again, the quality that elevates us from being great, and moves us beyond greatness and into the next level, is readily available. That quality simply may be caring. As Marvin Gaye sang in his song, “What’s Going On?” “you know we’ve got to find a way to bring some lovin’ here today.” It takes very little creativity to see how closely the word love is connected to the words compassion and empathy. Never hesitate to consider something from another’s point of view. You’ll be glad you did.
