Questions and answers with AAA’s new president

“This year I aim to broadcast the best kept secret that is our industry even further.”

On Friday June 8th, we recognized 33 finalists and 11 winners at the Austin Apartment Association 2018 Property of the Year Awards. As each team approached the stage to receive their award, it felt as if they had won an Academy Award. Each group was so overwhelmed with excitement and approached the stage as a close-knit team. In an industry where change is constant, and teams must work so closely together, I couldn’t help but wonder about the secret ingredient that each team added to their recipe for success. So, my question is, “What is the secret for success in our industry?” Is it the amenities? While the budget for your property may be limited there are simple things that you can do to enhance your amenities? With more renters today being renters by choice as opposed to necessity, they are really taking the time to make sure

the community they are choosing to call home has what they need. Is your conference space offered with a reservation for the resident who works from home and needs to host a meeting? Do you offer WiFi in all common spaces including your pool area? What are you doing for package deliveries? Residents expect to retrieve the new shoes they ordered when the schedule is convenient for them. The options are growing on this amenity. Lockers, package rooms, and even ancillary package delivery companies. In Austin, Texas, we can’t forget our furry residents. Are you hosting social events that include their fur babies? What about a paw inspired kiddie pool for your dog park? Is it your apartment homes? I hear the saying all the time, “We are all offering the same thing, a white box of time.” But what can you do to set your white box of time apart from the neighbor across the street? An

accent wall is an affordable way for a resident to feel connected to their new space and help them take on a sense of ownership. Not only a simple paint color, but faux wood on the walls. Pull out your inner Chip and Joanna. What are you doing to make your vacant units feel special? Do you have great mini models that once the customer leases they get to keep some of the fun stuff? You would be amazed at what a $200 trip to target can do for your vacant apartment home. Is it your team? This is the secret ingredient to each property’s recipe that can have the most impact on success. How is your team working to exude exceptional customer service every day? This area is where the smallest things mean the most. Are they standing up to greet each customer? Are they really working to find out why someone is moving so they can work to create rapport


based on the customer’s personal situation? While we get bogged down with the daily tasks of property management, it is important to remember our residents are making their largest monthly payment to our properties. When things aren’t going well with the thing they spend the most money on, it impacts them on a personal level. What is your team doing to improve those personal interactions? As I watched each of the 2018 property of the year winning teams approach the stage, I couldn’t help but think the thing they all had in common was their engaged team. Team members thrive and improve when they are encouraged to broaden their skills and network. This is where the Austin Apartment Association can give back to you. The education offerings are endless and are as defined as an introductory excel class and as ambitious as earning a Certified Apartment Property Supervisor designation. Our team members also grow by giving back to their community. There are countless oppor-

tunities and the next one will be our Doc and Gayle Young Food Drive with the kick off Karaoke Happy Hour scheduled for Wednesday September 12th. Giving back to

the association that supports our industry not only moves our industry forward, but it can also be one of the secret ingredients to your success.

CodeNEXT Halted

In the resolution passed by city council halting CodeNEXT it directed the city manager to develop and propose a new process to rewrite the Land Development Code.

The Austin City Council has voted unanimously to halt the new re-write of the land development code known as CodeNEXT. In the resolution passed by council that brought an end to the code adoption process, the council stated that: “due to a combination of significant disruptions to the process, CodeNEXT is no longer a suitable mechanism to achieve its stated goals or address the critical challenges currently facing our City.” The origins of CodeNEXT go back to 2012 when Council approved Imagine Austin, a comprehensive 30-year plan to guide the city’s growth that called for rewriting the land development code. The effort to overhaul the existing code, adopted in 1984, was buoyed by rapid development, housing shortages, traffic congestion and the simple recognition that a new code was needed to better meet the needs of a changing and growing city.

As the long re-write process unfolded, the divide between those that wanted to see more urbanlike density and those that believed that the new development rules in CodeNEXT would adversely impact the existing neighborhoods and incite more gentrification. The Austin Apartment Association (AAA) was an active participant in the CodeNEXT process but did not view the re-write as a density versus preservation effort and did not participate in those debates. While increased housing density, and especially the development of more attached wall housing, would be a great boon for the apartment industry, the AAA’s participation in CodeNEXT was to simply to offer property management and multifamily development perspective and to advance the movement toward a “compact and connected” city as clearly envisioned by Austinites when the comprehensive plan was crafted.

To be sure, as the CodeNEXT was moving through its final adoption process the AAA acknowledged that valid questions lingered about the code and its rules. However, the Austin Apartment Association still supported the CodeNEXT effort to the end and did not want the city to totally abandon the costly project. Early in the code re-write process the AAA joined Evolve Austin, a coalition of Austin organizations eager for more efficient and predictable land development rules and the construction of a wide variety of housing products. Evolve Austin issued a statement before the final council vote to end CodeNEXT and the AAA shares the sentiments. The statement read in part: “Evolve Austin understands the need to pause and reevaluate the CodeNEXT process. At the same time, we are discouraged that a small but vocal minority has sown mistruths and misinformation through our neighborhoods and constructed a narrative that making any changes to our broken, outdated land development code is unwanted or unpopular. We urge our city leaders to not capitulate to proponents of the status quo that have relied on scare tactics and litigation to grind this process to a halt. Across our city, thousands of residents support the need for new solutions to the ever-growing affordability crisis, environmental degradation, and standstill traffic that the outdated land development code has contributed towards.” In the resolution passed by city council halting CodeNEXT it directed the city manager to develop and propose a new process to rewrite the Land Development Code. The AAA will again participate in the new process once revealed by the city manager. Austin Moves to Expand Floodplains The City of Austin is the process of changing their floodplain maps and related regulations and light of a National Weather Service (NWS) study of historical rainfall. Changes to the city’s floodplain map may trigger new insurance requirements for existing apartment properties. Currently, the city’s floodplain regulations and drainage criteria are based on the 100-year flood, which has a 1% chance of occurring in any given year. It is currently defined as 10.2 inches of rain in 24 hours. The National Weather Service study indicates that this definition is too small. The current 500-year rainfall, which is 13.5 inches of rain in 24 hours, more closely represents the rainfall that has a 1% chance of occurring every year. For this reason, the

city is proposing to use the current 500-year flood for their regulations until the official FEMA floodplain maps can be redrawn. The Federal Emergency Management Agency (FEMA) is currently modernizing the nation’s floodplain maps, through a collaborative effort with local governments and non-government entities. Once completed the new flood maps, known as Flood Insurance Rate Maps (FIRMs) are used as the basis for community floodplain management regulations and flood insurance requirements as well as supports the sale of flood insurance under the National Flood Insurance Program (NFIP). The new FEMA maps may not become official for at least two years. While increased insurance requirements and its associated costs may not be triggered until the FEMA maps are released, the actions taken by the City of Austin in the next few months to

re-define the floodplain boundaries would require property owners and businesses in the current 500-year floodplain to follow new restrictions if they want to develop, expand, remodel or improve their properties. The city estimates that there are approximately 2,800 buildings and 3,400 acres in the 500-year floodplain that would be affected. The City of Austin has a floodplain mapping tool that allows you to view your property. Using the online tool you can see the both the 100yr and 500yr floodplain for your address. Again, any property in the 500yr floodplain would be impacted by the city’s efforts and could very well be subject to floodplain insurance requirements when the FEMA maps are released. CHALLENGES AND SOLUTIONS FOR LEASE-UP PROPERTIES All multifamily properties face challenges. Some are universal to all properties, regardless of the age or amenities, and some are unique to certain types. A lease-up property is any property that is less than 18 months old and less than 70% occupied at the time of nomination. With Property of the Year 2018 a quickly fading memory, we asked our lease-up property award nominees a few questions and here are a few of their answers. What is one new or interesting amenity you incorporated into your new property? What has been your residents’ reaction to it? What is a challenge you face as a new property? The layout for the community allows for ample opportunities for residents to interact with one another. We have found that this really promotes the sense of the community and helps with our overall retention and reviews! The highlight of our amenity package is certainly our large outdoor kitchen and gaming lounge that runs parallel between the courtyard and pool. This is a haven for anyone who wishes to relax, play games with a friend, host a party or even just serve dinner somewhere aside from the kitchen table.

Food Drive

T

he Austin Apartment Association’s annual Doc & Gayle Young Food Drive is a volunteer-driven fundraiser to purchase Thanksgiving foodstuffs for Central Texans in our 11-county jurisdiction. Just one $45 donation gives a family their Thanksgiving food pack this year. 100% of collected funds go toward

buying family food packs for needy families and individuals in Austin and surrounding areas. Fundraising begins in earnest early September and ends mid-November. Food packs are hand-delivered by volunteers to local beneficiaries on the Tuesday before Thanksgiving. But, who benefits from the Doc & Gayle Young Food Drive?

Food Drive leaders and AAA leadership have identified the Austin Housing Authority, Partnerships for Children Rainbow Room, SAFE Alliance and Foundation Communities as beneficiaries of the food drive. By far our largest beneficiary, the mission of the Austin Housing Authority is “to cultivate sustainable affordable housing communities and partnerships that inspire self-reliance, growth, and optimism.” Families and seniors who receive food packs are chosen by on-site property management employees. The mission of Partnership for Children is “to empower and support abused and neglected children in the care of Child Protective Services. As a nonprofit in Central Texas, Partnerships for Children leads a collection of programs that offer resources, support and comfort for foster children and families in our community. [Their] accessibility to CPS, efficient practices, and ability to connect with kids at all stages in their lives allow [them] to better serve those who need [them] most by providing real and impactful solutions.” Thanksgiving food packs supplied by the Doc & Gayle Young Food Drive are given to foster families deemed the most in-need by caseworkers.

The SAFE Alliance is a merger of Austin Children’s Shelter and SafePlace and exists to stop abuse for everyone. The SAFE Alliance is “dedicated to ending violence through prevention, advocacy, and comprehensive services for individuals, families, and communities that have been affected by abuse.” Their mission is “to lead in ending sexual assault and exploitation, child abuse, and domestic violence through prevention, intervention, and advocacy for change.” Our food packs are used to stock the emergency shelter pantry for families currently residing in the shelter. Foundation Communities is a local nonprofit. “We provide affordable, attractive homes and free on-site support services for thousands of families with kids, as well as veterans, seniors, and individuals with disabilities. We offer an innovative, proven model that empowers our residents and neighbors to achieve educational success, financial stability, and healthier lifestyles. We own and operate 23 communities all over Austin and in North Texas.” Residents who receive food packs are chosen by on-site property management employees. An outreach initiative coincided with the 30th anniversary food drive in 2016. Food Drive leaders wished to include and aid food pantries in all 11 counties in

AAA’s jurisdiction, not just Travis County. Due to overwhelming fundraising success in 2016, the food drive was able to give financial donations to food pantries in Williamson, Hays, Burnet, Caldwell, Bastrop, Gillespie, Blanco, Lee, Fayette and Llano counties. Thanks to generous donors yet again in 2017, food pantries in the same counties received financial donations yet again from the Doc & Gayle Young Food Drive. Our financial donations allow these food pantries to purchase fresh produce, meat and pantry items from the Capital Area Food Bank. This growing tradition is one we hope to repeat for many years to come.

MARKET AND ATTRACT Gen Z Renters

ook out Millennials, Generation Z is gaining ground. This group of individuals — born between the mid-1990s and 2010 — are beginning to come of age, with the oldest members in their early twenties. And if they aren’t already, Gen Z will be the next slew of renters at your properties. Contributing about $44 billion to the American economy, the Gen Z population should definitely be a key focus in your marketing strategy. It is no longer efficient enough to list your apartment online or use traditional methods of marketing, as Generation Z has specific expectations for their new pad. From smart technology appliances to shared-space amenities, Gen Z is looking for more. But to understand how to attract these renters, you first must understand the differences between this generation and Millennials.

Gen Z vs. Millennials Gen Z, often misconstrued as Millennials, make up about 26% of the United States population as compared with Millennials at 22%, according to Nielson’s Total Audience report. Growing up in the age of technology, Gen Z cannot comprehend a time before the digital age. Due to the rapid growth rate of technology, they are often less focused and have a shorter attention span as compared with Millennials and other age groups. Furthermore, Gen Z spend considerably less time accessing the internet via PCs as the vast majority of their time is spent on mobile devices. And with this technology at their fingertips, everything of interest to Generation Z is connected to social media. Marketing should therefore focus extensively on the most popular social media platforms, and continuously adapt as new ones gain in popularity.

Focus on Social Media Generation Z are great multi-taskers, with the ability to juggle several social media platforms at once. However, this generation is prone to scroll quickly through those platforms, and responds best to concise, pointed, and attention-grabbing advertisements.

For best results, focus your marketing efforts on videos and other visually appealing content. Bold graphics, vibrant colors, and playful fonts are great ways to capture a Gen Z renter’s attention. Videos can also prove beneficial by showing a targeted advertisement as long as you hone in on your core message quickly or risk losing interest.

Smart Technology Appliances When marketing to Gen Z renters, it is important to consider what amenities they want and how to properly market those features. For example, Gen Z renters do not just want to access the internet via their computers and phones; they also prefer connected appliances such as smart thermostats that save money, and keyless locks for enhanced security. Similarly, cable internet services are not enough to attract this group. They expect wireless, fast reception. For Gen Z renters, consider focusing on advertising your property’s quick internet speed and reception that beats your competition.

Highlight Shared Amenities Additionally, this age group is prone to be less physically active than previous generations, so things like a swimming pool and fitness center may not be as appealing to them. You could instead focus your attention on advertising indoor and outdoor lounge spaces, community areas, and other shared amenities. Research shows that Gen Z renters are looking for common spaces to mingle with their neighbors. This group also tends to have a more entrepreneurial and networking mindset, which means coworking environments and convenient workspaces might be more attractive to them than a desk area in their own apartment. While Generation Z is attracted to visually appealing graphics and creative content, the most important thing to consider is that through these marketing media, they want to know where they will be living, what the accommodations are, and how the apartment will benefit their lifestyle. Efficiency and creativity are the foundation for attracting Gen Z renters with your marketing plan.

frequently than you would think. In the area served by the HPD alone, several hundred apartment community night-drops were burglarized and literally thousands of money orders were stolen and forged during the approximately 14-month period of June 2010 to August 2011. It is a crime that consistently plagues apartment communities throughout the state. On occasion, the funds stolen through night-drop fishing may be recovered. According to Sergeant Walker, Bank of America, Wells Fargo, Chase, and many other banks treat their money orders like a regular check. They will send them back if they are reported stolen and forged. Sergeant Walker states, however, that more times than not, a money order company will not send a reportedly stolen money order back as a collection item. If the money order is not sent back, says Sergeant Walker, the result is the purchaser of the money order often cannot get their money back. This in turn often results in the apartment community not getting their rent payment. Then the eviction remedy may be pursued. Who bears the risk of loss in the event of a stolen check or money order? It is an open question for which there currently is no absolute answer. The determination a judge or jury makes to that question, however, will significantly impact the outcome of an eviction trial with these issues.

To begin with, there may be a shifting of the burden of proof in an eviction suit like the one involving Ms. Karr and The Pointe. The landlord must establish an agreement to pay rent in a sum certain and by a definite deadline. This is usually done through testimony and the provisions of the lease. The landlord must then testify that for a particular period, rent was not received from the particular tenant against whom the eviction was filed, as agreed in the lease. Following that testimony, the burden of proof shifts to the tenant to establish the way their payment was attempted. There is an expectation that the resident can prove their purchase of the allegedly stolen money order, their appropriate completion of it, and their actual deposit of it into a drop box controlled by the landlord. There will then be an evaluation of the credibility of the evidence presented to determine if, and when, the tenant’s obligation to pay rent was discharged, despite the night-drop fishing theft. The tenant has a contractual obligation to pay rent. That obligation is clearly set forth in paragraph six of the

Texas Apartment Association (TAA) lease. Paragraph six, for example, refers to the tenant as “you,” and states that “You will pay $___ per month for rent, in advance and without demand.” The same paragraph provides, again referring to the tenant’s obligation, as follows: “You must pay your rent on or before the first day of each month.” Also, paragraph 32.1 of the TAA lease, addressing acts of default, provides as follows: “You will be in default if … you don’t timely pay rent or other amounts you owe …” What does it mean, then, to pay? According to Black’s Law Dictionary, “to pay is to deliver to a creditor the value of a debt, either in money or in goods, for his acceptance, by which the debt is discharged.” In that definition, “creditor” is the landlord, “debt” is the monthly rent, and “for his acceptance” means permitting the landlord to negotiate the check or money order and receive funds. When a drop box is involved, the focus switches somewhat. Now, the issue becomes the meaning of the phrase “to deliver to a creditor.” Again, using Black’s Law Dictionary, deliv-

ery is defined as the transfer of the possession of personal property from one person to another. In the Karr scenario, the personal property would be her $535.00 money order. It gets more complicated than that. There are the differing concepts of absolute delivery and conditional delivery. Absolute delivery is that which is complete upon the actual transfer of the instrument from the possession of the party making the payment. Conditional delivery, on the other hand, will not be completed by mere transfer of possession, but requires the happening of a specified event. Again, using the Karr scenario, the specified event would be the deposit or cashing of the check or money order by the landlord, so that the funds received can be applied to the payment of rent. Police, courts, judges and juries want to know who bears the risk of loss when a night-drop is involved. Shouldn’t it be the tenant, who deposited the payment into the night-drop, rather than using a more secure method such as online payment or delivery to an actual person in the management office? One can certainly

see the reasoning behind that position. Then again, should the risk of loss fall upon the landlord, who - by providing a night-drop - created the possibility for after-hours delivery of a valuable document that would remain, unattended, in the night-drop until the management office next opens for business? There is some logic to that position as well. Who is the actual victim of the crime of a “Night-Drop Fishing” theft? Arguably, it is the tenant. Their “money” was stolen before their landlord received it. Although other means of payment were available, the tenant selected the least secure option and was subsequently victimized by the theft. Should the night-drop be an option at all? Probably not; but that may depend upon the community and its resident base. The risk may not, in some scenarios, outweigh the reward. It is a very subjective determination. Although older versions of the TAA lease used to provide the possibility of paying rent through a night-drop, that option is no longer contained in the TAA lease. It would have to be added where there is currently a blank space. Arguments can be made that both landlord and tenant should have certain expectations placed upon each of them. Some of the expectations may be quite expensive to meet, however, such as providing for a drum type of night-drop, such as that used by a

bank, that does not allow easy access. Given that a tenant has so many other options for payment available, however, it seems to be inequitable to expect the landlord to incur the significant cost associated with attempting to make the night-drop ultra-secure for those who choose to use it. Quite candidly, it may be time to drop the drop box. Tell your residents, in a somewhat joking manner, that the drop box has “gone fishing” and is not expected to return. There is no requirement in either of the last two

versions of the TAA lease that a landlord provide the option of a “nightdrop” for receipt of rent payments. The frequency of the crime of “Night Drop Fishing” theft, using Sergeant Walker’s somewhat limited and dated statistics alone, is certainly enough to warrant removal of what may appear to many criminals to be irresistible. If you are not ready to drop the night-drop, consider some other procedures that may protect both

tenant and landlord. If you plan to accept money orders, consider a strong recommendation that your residents purchase only BANK money orders. This was a suggestion made by Sergeant Walker. Also consider mandating that an instrument like a money order or check be FULLY COMPLETED. It is quite common for people to tender a check or money order where the payee line is blank. Thieves know this too. Even a less sophisticated criminal, who lacks access to the chemical washing materials, can readily negotiate a blank instrument. Require your residents, therefore, to complete the instrument in its entirety. Otherwise, reject it. This will also make it much easier for you to determine which rental unit to credit the check or money order to. Remove the guesswork the lack of a payee presents. In addition, consider adding language to the Special Provisions paragraph (No. 9 in the TAA lease). Insert a statement along these lines: “If a rent payment is stolen from the night-drop, Resident will not receive credit for the stolen item.” Such language is supported by various lease provisions. For example, TAA lease paragraph number 34 uses the phrase “when we receive money.” In addition, TAA lease paragraph 24.5 provides that the landlord is not liable to the resident for loss caused by criminal conduct of other persons, including theft.

These proposed language changes would help to establish whether the apartment community or the resident will be responsible for any stolen money orders or checks. According to Sgt. Walker, law enforcement must be able to identify who is suffering the loss. Do all you can to clarify that it is the resident suffering the loss, since depositing an item into the night-drop is a conditional delivery, rather than an absolute delivery. A conditional delivery is dependent upon the happening of a specified event to become complete. As stated above, that “event” is the negotiation of the payment instrument, whether money order or check, by the landlord and the crediting of the funds to the account of the resident. Last but certainly not least, be willing to work with a resident who has been victimized by the theft of their attempted rent payment. Consider use of TAA’s Eviction Hold Off Agreement, which would give the resident an extended period within which to pay the rent that was stolen. During this delay, agree not to

charge late fees. Enable the resident to report the theft to the authorities, get the necessary documentation, make a claim with the issuer of the money order for reimbursement, and hopefully be reimbursed for the stolen instrument. Consider again, the situation involving Miriam Karr’s Western Union money order, described at the beginning of this article. The appellate opinion described how Ms. Karr requested a refund from Western Union, but they required a police report and an affidavit from her attesting that she was not at fault as a prerequisite. She then discovered that to obtain a police report, she needed

a copy of the money order from Western Union and other information from Western Union about the location of the money order. It took several months for Ms. Karr to straighten it out and, because of the delay in receiving a Western Union refund, and her inability to come up with funds to pay the lost rent before the refund was received, her family was evicted for nonpayment of rent. The potential solutions do not come in a one size fits all. Yet understanding the crime and its frequency is a good beginning. Add in some compassion and flexibility to enable the passage of a reasonable amount of time needed to accomplish a resolution of the claims related to the theft. There is, finally, one other important consideration. If you file an eviction based upon nonpayment of rent, and the resident contends their rent payment was made but stolen from your night-drop, there is no assurance that the landlord will prevail in that eviction case. Knowing that could make a fishing trip, instead of a trial, sound pretty attractive.
