PERSPECTIVE WHAT DOES PROFESSIONALISM MEAN TO YOU? The importance of interacting with our colleagues and residents

We constantly should be questioning ourselves about what it means to do our jobs professionally in order to make the necessary changes to make it not just a job, but a career.

s it in how we interact with our residents and/or prospective residents? Do we stand up and greet them with a smile? Do we shake their hand and make them feel welcome? Do we show a genuine interest in their concerns and needs? Is it in the way we handle addressing those concerns and needs, even when we are not able to do what they expect? Do we maintain a friendly demeanor, even when they are not? Are we following through to make sure the residents needs are being met? Is it in how we interact with our fellow employees? Are we going out of our way to be a part of a team, rather than just getting our job done? Are we constantly looking for ways to improve how we communicate with each other to achieve a common goal? Are we showing respect for each other? Do we have each other’s back’s and do what it takes to get the job done?

Is it how we interact with our vendors, suppliers, and contractors? Do we respect that they have a schedule to keep and plan the week so that they can fit our needs into their daily/weekly schedules? Do we make them aware when they are not performing as expected in a manner to help them improve their services? Do we greet them with a smile and make them feel welcome when they enter our offices? Do we take the steps necessary to ensure that they receive payment in a timely manner? Is it in how we treat ourselves? Are we finding ways to enjoy the work we do and are not just going through the motions? Should we be looking for ways to increase our knowledge in what we do, not only to improve our daily activities, but also to improve how we go about doing those activities? Are we looking for ways to be efficient so that the job does not become too stressful? Are we setting weekly/monthly goals for ourselves to feel a sense of achievement?

The Austin Apartment Association is a trade association composed of diverse groups that represent and serve the rental housing industry. One very important component of its stated mission is to “Participate in the legislative process,” and participate we do. The goal of our participation in the legislative process is to protect the free market housing system and private property rights and keep our industry free from unnecessary taxes, regulations and fees so that that quality housing and wholesome living environments are available to all. Our participation takes many forms and, to be sure, participation in the legislative process includes all levels of government - local, county, state and federal - as well as regulatory bodies, boards and commissions. There is even active participation in the organization structure of other associations when necessary to build coalition partners in order to confront the many issues that affect our industry.

Tests Underway for Shared Solar Energy at Apartment Communities In the City of Austin, renters in multifamily buildings make up over 50% of the City’s residents. While residential solar installations within Austin Energy’s service territory have soared with a total installed capacity of 29 megawatts (MW) as of the end of fiscal year 2017, the majority of them are on the roofs of single-family homes. Apartment residents, especially those living in affordable multifamily housing, have been largely omitted from accessing this clean energy option due to various financial, physical, educational, market and other barriers. In order to increase solar installation at multi-tenant properties innovative programs are essential. In October 2017, the City Council

approved a resolution for creating incentives and innovative solar programming for underserved markets including multifamily properties. In support of the City’s resolution, Austin Energy is developing an innovative metering and billing “Shared Solar” solution that enables more cost-effective solar installations on multi-tenant properties. Currently, a solar photovoltaic (PV) system must be electrically connected behind the meter for an electric account to receive the power and associated incentives and credits. For multifamily properties with individually metered units, this can mean many separate PV systems, with separate wiring, meters, and interconnections for each unit, adding complexity and cost. The Shared Solar program aims to alleviate this problem by allowing a single PV system to serve multiple units in the building. By enabling virtual fractional metering of a single PV meter, using the utility’s Meter Data Management System, multiple residential electric accounts in a multifamily property will be able to receive a prorated portion credits from the on-site solar PV system. The end

result will be that PV system’s energy production will be allocated to the residential units in the property, in proportion to the unit’s square footage, and will lower the tenants’ electric bills. In the coming months Austin Energy will be testing this innovative program at just a few select properties that serve low-income residents. The experience and lessons obtained from this pilot program will help Austin Energy in various aspects including a better understanding of the technical, financial and programmatic barriers and challenges on solar deployment to underserved communities and multifamily properties in general. Of course, the test program will also help to refine Austin Energy’s meter data management and billing system and know how the behavioral aspects of residents affect energy performance in an apartment context. If the testing of this program is successful apartment properties can anticipate a full program roll-out and the opportunity to obtain energy solar energy credits while offering residents the ability to lower their energy bills by living in units served by on-site solar energy systems.

In order to increase solar installation at multi-tenant properties innovative programs are essential.

AIR CONDITIONERS Save energy and money while keeping your residents comfortable and cool. Replace old air conditioners with energy-efficient models and use up to 40% less electricity. You can earn a rebate for installing new energy-efficient air conditioners and heat pumps. Any licensed air conditioner installer, including maintenance staff, can perform installations. We recommend you install ceiling insulation before installing your new air conditioner. This may reduce the new air conditioner’s size and initial cost.

ROOFS Cool roof materials deflect heat and protect against solar heat and UV rays. They can save you money in cooling costs and lengthen the life of your roof. Cool roofs offer several key benefits: • Reduce roof surface temperature • Reduce the amount of heat transferred into the building • Reduce the need for air conditioning throughout the building

• Protect against UV rays that shorten roof life Traditional roofs can reach 150 degrees or more in the summer. According to the US Department of Energy, a cool roof under the same conditions could stay more than 50 degrees cooler. For roofs in good condition, this can be a more economical way to protect the roof from the heat. You may qualify for a rebate if you apply a spray-on reflective roof coating or new reflective roof membrane to your existing, non-reflective roof. In addition to adding a cool roof coating, properly functioning air ducts can prevent cool air from escaping an air-conditioned space. You may qualify for a rebate to replace, improve, or seal leaky duct systems.

WATER HEATERS When you install new water heaters for your property, consider heat pump water heaters. Heat pump water heaters can save your residents money and are friendlier to the environment. A heat pump extracts heat from the air

and transfers it to water in an enclosed tank. In cold temperatures, it uses a heating element. In warmer Texas climates, the heating element is not often needed. Heat pump water heaters are more efficient because they use electricity to move the heat instead of creating heat directly. This method delivers nearly twice the heat of a conventional electric water heater. During high demand periods, heat pump water heaters switch to standard electric heat, providing sustained heat. You can earn a rebate to install heat pump water heaters in existing rental units only. For common areas, including the office, clubhouse, and fitness rooms, you may qualify for the commercial Heat Pump Water Heater rebate.

LIGHTING Lighting typically makes up 20 to 40% of your electric bill. Energy-efficient lighting uses less energy and last longer than traditional lamps. Energy-efficient light fixtures can help your residents save up to 75% on lighting costs. They also provide superior lighting quality. Multifamily Rebates are for energy efficiency improvements installed in rental units for the benefit of residents. For common areas, including the office, clubhouse, and fitness rooms, you may qualify for the commercial High Efficiency Lighting rebate.

WINDOWS Solar shading and window replacements save energy and increase comfort. PACE FINANCING AVAILABLE Austin Energy provides various opportunities for our customers to purchase energy efficient technologies. extiles, such as clothing, shoes, and other home accessories, account for nearly 5 percent of all landfill space in the U.S. Each year, the average apartment resident discards approximately 35 pounds of these materials.* Consider the impact apartment communities could have in the Houston metro area alone. Annually, with roughly 580,000 units and two residents per unit, more than 40 million pounds of textiles are being thrown away rather than reused.

Why Recycle? A common misconception is that textiles can only be donated and resold; meaning heavily used or worn items are better candidates for the trash. “No one would want this,� a person might say, but as raw materials, those burned oven mitts and torn sneakers become useful again in any number of ways. Pieces of denim serve as insulation behind drywall. Wool and nylon are used in carpet padding. Old textiles can be upcycled into new materials or turned into absorbent wiping rags


for industrial uses. Small household appliances like toasters and hair dryers, while not considered textiles, are accepted for recycling as well; if a device doesn’t work, its parts can be salvaged and repurposed. Globalization has created a market of fast fashion – clothing and other goods that are sold at such inexpensive rates they’re considered disposable by consumers, but the costs are high for the environment. The production of textiles from new materials is a notoriously energy-hungry and polluting process. Large quantities of water and pesticides are used in growing cotton, for example, and the manufacturing of polyester employs considerable amounts of crude oil and releases harmful emissions and wastewater by-products. Global manufacturing also raises human rights concerns such as the treatment of workers, low wages and child labor. One way to reduce this harmful footprint is to ensure that textile materials truly reach the end of their life cycle before they’re discarded. Education about the importance of textile recycling, as well as easy access to a means of textile recycling, can make a world of difference. There’s no better place to begin this effort than in a multifamily community where residents could have access to a shared recycling pod to efficiently and conveniently extend the life of secondhand goods at no cost to them or to the apartment owner, since the expenses of servicing the recycling pod are recouped from the resale of the items and raw materials. REBATE EARNING POTENTIAL Let’s say your property has 260 units and your recycling company partner charges $.35 per pound: Annual volume that can be recycled per unit: 70 pounds Total: 18,200 pounds/year Rebate to apartment community: $0.035/pound Annual projected Revenue: $637.00

Green as an Amenity Residents consider eco-friendly amenities a big plus when deciding where to rent, and sometimes they view it as a given. During a tour, in addition to pointing out a recycling pod’s presence, apartment communities can share concrete data on how the pods are performing. Make sure to hire a recycling company that will record the volume collected each

month from individual pods and send this information to your apartment managers, who will often highlight community participation via social media, newsletters and community websites. Recycling goals can be set for a community, with progress tracked month by month. Holly Creek Apartments in The Woodlands, with 348 units, recycled 3,865 pounds of textiles in just three months, which became a great piece of data to share with prospective residents. A recycling pod is a useful resource for residents during move-in or move-out cleanings, as well as for those who have limited mobility or no access to a car. And sometimes having a recycling pod at your doorstep just makes life easier. A resident from Riverwood Apartments in Conroe called us to express

her appreciation for the property’s recycling pod, saying she was able to recycle six bags of used clothing that had been taking up space for many months because she’d never found the time to drive them to a donation center. Your recycling pod should be placed in an area best suited for your residents and their needs, whether in the community’s dedicated trash and/ or recycling center, near the laundry facility or another public space. Service of the pod can be scheduled as often as twice a week or once every 15 days, based on the community’s typical output, and no contract is required. Unlike traditional dumpsters, the design of recycling pods is aesthetically pleasing, and pods are typically refurbished every two years, or as needed, to ensure that they meet the standards of your apartment community. There are pods that come with a QR code that can connect the pod to your apartment manager’s smartphone, alerting them anytime the pod needs immediate attention. High-rise and mid-rise apartments that don’t have space for a dedicated pod always have the option of valet pickup, in which residents simply leave their textile waste outside their door, marking bags with special decals that denote the contents are textile recycling.

Give Back and Get Back Residents like to see that their recycled items continue to positively influence the environment and the community. On the recycling pods, recycling companies will typically list the charities to where monetary donations are donated. If you decide to partner with a recycling company, ask if they have a rebate program. A rebate program allows your apartment property to make money off of its participation - the greater the participation, the more a property will make. Depending on your recycling partner’s rates, an apartment property with a high unit count might expect to make around $500 to $600 annually.

The Warren Report THE 2018 TAA LEASE IN DEPTH

Reliable Questions, Answers and Practices Concerning the 2018 TAA Lease

O

n January 23 and January 25, 2018, this author and Texas Apartment Association General Counsel Sandy Hoy presented a statewide lease webinar. The webinar addressed the new TAA lease form. Hundreds attended online, and many insightful questions were submitted throughout and following the webinar. The purpose of this Law in Order: The Warren Report is to address some of these great questions in a short Q&A format. Let’s begin. Question from Jerry G.: When can month-to-month fees be charged? Answer: They should never be charged. Paragraph three of the lease provides a date certain on which the lease term ends. “...[A]fter that, this Lease will automatically renew month-to-month unless either party gives at least _____ days’ written notice of termination or intent to move out.” Renewal of the lease means that

all of the terms from the original lease carry forward, with the exception of agreed upon changes, including the scheduled ending date of the monthto-month term. If you give an offer letter to the current resident, and present options for the existing resident to renew the lease, or enter a new lease with you, you will state various rental rates for various lengths of a proposed new lease term. Since longer term tenancies are often preferred, the lowest rate may be for a 12-month term, the next lowest rate may be for a sixmonth term, and the highest rate may be for a month-to-month term. It is important to remember that the terms “month-to-month fee” and “month-to-month premium” are inaccurate terms, which if used will make an offer letter misleading. There is no fee, and there is no premium. There is a new lease term, for which a specified amount of monthly rent will be due.

Questions from Darby H.: “How can a lease renew month-to-month with an increased rental rate under the provisions of lease paragraph 16? Does the rent increase notice need to be received or postmarked at least five days prior?” Answer: Paragraph 16 of the TAA lease provides as follows: “...If, at least five days before the advance-notice deadline referred to in paragraph three, we give you written notice of rent increases…that become effective when the Lease term or renewal period ends, this Lease will automatically continue month-to-month with the increased rent….” The purpose of this contractual provision is to give the resident an opportunity to have enough time to still satisfy the advance-notice requirement, imposed upon the resident by lease paragraph three, if the resident does not want the new terms to take effect. Stated another way, if the resident believes that the proposed month-to-month rental rate is too high, that resident essentially has five days within which to decide to test the market and possibly move elsewhere by giving the notice of intent to move out. This extra time within which to decide is very important. Darby’s question alludes to a


possible postmark. Mailing the notice, however, is unlikely to satisfy the purpose of paragraph 16, for three or more days could easily be lost if the notice containing the five-day “cushion” is sent by mail. Paragraph 16 of the lease specifically states, “we give you written notice”. To effectively “give notice” there must be a realistic expectation of prompt receipt. Lease paragraph 33.1 contains a new revision, very relevant to this discussion, which provides as follows: “... Notice may be given electronically by us to you if allowed by law.” Take advantage of this new clause. Email the offer letter, containing the proposed month-to-month rental rate, if you are confident that you have a current email address for your resident. If you lack that confidence, the next best alternative would be personal delivery of the offer letter, containing the proposed monthto-month rental rate, to the inside of the main entry door. If you do that, moreover, make notations on your copy of the offer letter, which you keep in the tenant file, stating who delivered it, at what time of day, and in what manner; and have the delivery person sign that note. You will keep that in your records for possible future use. A photograph showing the delivered offer letter would be helpful. During the webinar, the importance of identifying all adults as residents was emphasized, rather than occupants. Question from Stacee V: “What verbiage would you use with parents that push back on requiring their 18-yearold child to sign the lease [as a resident] instead of remaining an occupant [who is not required to sign]?” Answer: We will assume that the 18-year-old has already reached the age of 18 and will not reach it during

the term of the lease. If there is an already existing 18-year-old at the time the lease is signed, that 18-year-old is legally considered an adult. That adult person should sign the lease, along with the parents. By making this your policy, you avoid “making the call” whether the young adult will sign or not on a case-by-case basis. You want to avoid having some 18-year-old individuals sign as resident and allowing other 18-year-old individuals not to sign, and instead be identified as occupants. This could needlessly raise fair housing concerns for you. In many cases, the 18-year-old person may still be fully claimed as a dependent by parents. The 18-yearold may be a full-time student, not earning any noteworthy income. There may be other reasons why it

might appear to make some sense, on a case-by-case basis, to allow an 18-year-old adult to be identified in paragraph two of the lease as an occupant and omitted from identification in paragraph one as a resident. Do not, however, talk yourself out of the right decision. You do not want to make this a subjective determination. A fair housing complaint may loom around the corner if you do. The best practice is to require all adults (that is, age 18 and above) to be identified in lease paragraph one as a resident and to sign and initial the lease. Tell the parents who want to push back that paragraph 29 provides that “each resident is jointly and severally liable for all lease obligations.” The parents, therefore,

if they so choose can take care of all the monetary obligations; and therefore, they can control whether their 18-year-old child will not have to pay any of them. Question from Jerry G.: “Is it lawful to charge the reletting fee after a judgment has been issued in an eviction case”? Answer: Absolutely. There are four scenarios, identified in lease paragraph 10.1, under which one will have to pay the reletting charge. Judicial eviction is one (item [D]) of them. Remember, as this lease paragraph reminds the resident, the “reletting charge” is not a cancellation fee and does not release you from your obligations under this Lease. Question from Brittany D.: “Should everyone sign the pet addendum at move-in to avoid them not knowing the rules and the amounts due?” Answer: Sometimes yes and sometimes no. If there is no pet involved at move-in, no one should sign the animal addendum until an animal is moving in to the rental unit. The Animal Addendum is designed for a specific animal, which is to be specifically identified, not speculated about. On the other hand, if there is at least one animal which will be living in the leased premises at the time the Lease is signed, all the residents should sign the animal addendum. Paragraph 20 of the Animal Addendum expressly states that each resident who signed the Lease Contract must also sign the addendum. It goes on to provide that each resident is jointly and severally for damages and all other obligations set forth in the Animal Addendum, even if the resident does not own the animal. Paragraph 18 of the Animal Adden-

The Animal Addendum, in addition, will specifically identify and describe the animal which will occupy the rental unit. Require specificity.

dum, furthermore, makes it clear that “… you [the animal owner] and all co-residents are jointly and severally liable for the entire amount of any damage the animal causes, including cleaning, defleaing or deodorizing ….” The animal addendum language on liability for damages is mirrored in the Lease itself. As was noted in the answer to an earlier question, on the topic of joint and several liability, paragraph 29 of the Lease states “each resident is jointly and severally liable for all lease obligations.” The obligations imposed upon the tenant (and animal owner) become part of the lease through paragraph 42, provided the box in front of animal addendum is checked. If an animal causes damages to the premises, therefore, all the residents who reside in those premises are jointly and severally liable for those damages. Ownership of the animal is not the determining factor, at least not from the landlord’s perspective. Whether one owns the pet or not, therefore, if an animal is going to be living in the leased premises (even a service or support animal), all the human residents who will also be living in the leased premises should sign the animal addendum. Question that just crossed your mind: Are we allowed to require that an animal addendum be signed if there is a service or emotional support animal? Answer: Yes, and be certain that you do so. Whenever there is an animal living on your property, require that it have your approval to be there and that the resident(s) who have it living with them sign the animal addendum. Do not charge an animal deposit or

pet rent if the animal is a service or support animal; but the owner of that assistance animal must still agree to comply with all the other provisions in the animal addendum. These include terms affecting care and control of the animal, a detailed identification of the animal, and a clause which provides that failure to comply with the addendum constitutes a failure to comply with (and a breach of) the Lease. The Animal Addendum, in addition, will specifically identify and describe the animal which will occupy the rental unit. Require specificity. See if each resident who signs the Animal Addendum describes the

animal, if asked to, in essentially the same way. This is very important information. With the internet making it easy to misrepresent several facts pertaining to service and support animals, you want every opportunity to confirm that the animal who lives on your property as a service or support animal is the same animal you made a reasonable accommodation to your resident for. Tiffany G. asked this question, which is being asked more and more, as follows: “Can residents refuse to initial the class action waiver?”

Answer: No. Absolutely not. The class action waiver is in the Lease, paragraph number 43. It is as much a part of the Lease as any of the other 42 preceding paragraphs. Its terms are as important, for example, as the terms concerning payment of rent (paragraph 6) or concerning not engaging in prohibited conduct (paragraph 20). You would not allow one to refuse to agree to the amount of rent to be paid, or its due date, would you? Would you allow someone to refuse to be bound by the prohibited conduct provisions of paragraph 20? Of course, you would not. Would you permit the resident to pick and choose which obligations will bind them? No way. If one refuses to agree to the terms of lease paragraph 43, which concerns the class action waiver, they are not agreeing to your lease. The lease is your contract with the resident. If the resident won’t agree to the terms of that contract, they should not be allowed to lease from you. If your efforts at persuasion fail, just tell them they will have to live elsewhere if they will not agree to all the terms of your lease. There are certainly many more questions which have been asked, and which will be asked by those who view the lease webinar in the future. The purpose of this article was to highlight some of the more common questions and provide reliable guidance on how to proceed with a best practice.
