What to do you hope to achieve in your presidency? I am so honored to have the opportunity to serve the Austin Apartment Association. This year I am hopeful to broadcast even further the best kept secret of our industry. Our association works to give back in so many ways to our industry. This year,

I hope to define our scope by working to draft a strategic plan (aka writing down our goals and officially memorializing them). After all, they say that goals that aren’t written down are just dreams. We also have some big shoes to fill with our own association executive, Kristan Arrona, set to retire this year. It is no secret that this is going to be a huge task. She has poured herself into the Austin Apartment Association for more than 26 years, and has been a secret to the success of the association. Well, one out of two ain’t bad right? We celebrated Kristan Arrona’s many accomplishments with an amazing retirement gathering in October and the search committee went straight to work to find her replacement. Emily Blair has stepped into the role and is already making an impact on the
organization. While the strategic plan is certainly not finalized, we will be well underway in the research and drafting process as my term comes to an end, and we have a strong executive committee committed to seeing it through before the end of the year. What does AAA need from its members? All I ask is that each of you find your passion and give back. I have also learned that there are so many ways to give back. Giving back to the association can be with your time, with your expertise, with your creativity, and on occasion, we might ask for a donation or two. It is no secret that the Austin Apartment Association would not be successful without the members. Dip your toe in and attend a meeting. If you aren’t sure what to do…. ask. ow, I can’t believe my year of service as the president of the Austin Apartment Association is wrapping up. I am so grateful for the opportunity to have served such an amazing organization. What has been one of the quickest twelve months of my career has also proven to be the most rewarding. At the beginning of this journey I was asked a couple of questions that lead to some important goals. Let’s look at these goals and what results have come about.

we are always ready to serve you! thing works…. ask. There is no silly question, and the only real secret of the Austin Apartment Association is that it is the best kept secret of the industry. While I can’t say that I fully executed my two goals, the organization and our members finished strong. This year our members raised a phenomenal $63,000 for the Doc and Gayle Young Food Drive, and with this money we were able to feed 1,350 families in Central Texas for the Thanksgiving holiday. In addition, we were able to donate $5,000 to surrounding area food banks. Our membership hit the elusive 1,100-member mark last fall and our M Team has done an amazing job with their retention efforts netting the Austin Apartment Association 83% retention rate. With this year being a legislative year, our members were called to serve and advocate during Day at the Capital and they
showed up strong with an impressive 67 members representing the Austin Apartment Association. What was most inspiring during Day at the Capital was the representation from
our Next Gen group…let’s just say we showed up in numbers and Houston took notice. As I look back on this year, I am incredibly humbled by the experience
that I was afforded serving the Austin Apartment Association. As I began my involvement with the Austin Apartment Association, I continued to hear people reference the group as an extension of their family. I could not agree with this more. Just like my family, we didn’t always agree, the things each of us are passionate about, we fight for, but most importantly, if someone else were ever to mess with one our members you would see where the true family connection lies. I continue to see the Austin Apartment Association as one of the best kept secrets of the real estate industry in Austin, Texas. This association has given me skills that I will take with me for the remainder of my life. I have learned how to gain consensus, how to sit back and listen, when to speak up, and most importantly…I am now a confessed hugger.

Regional Fair Housing Assessments Identifies Rental Barriers
The finding that most directly affects the rental housing industry is that strict rental policies limit housing options and are causing disproportional impacts on disabled and low-income populations.

The Central Texas Assessment of Fair Housing (CTAFA) document is now complete and the findings are a mixed bag of lingering issues that the region has known and is trying to confront while others are findings are likely to spur debate and usher in new efforts to keep them from taking deep root. The document underwent a 30-day public comment period and a final draft document is slated to be submitted to the U.S. Department of Housing and Urban Development (HUD). The analysis of fair housing is required in order to received federal funds used for housing programs. The document comes on the heels of some controversy surrounding the how cities and regions discover fair housing failures and challenges and work to overcome them. In early 2018, the Trump administration announced that they would be suspending an Obama era rule crafted to better assess fair housing challenges. The need to assess fair housing challenges is

embedded in the Fair Housing Act of 1968, but assessment requirement was never fully implemented by HUD until the Obama administration drafted the “Assessment of Fair Housing” (AFH) rules. The AFH rules were accompanied by the creation of a computer-aided fair housing assessment tool. When the Trump administration suspended the AFH rule it caused confusion surrounding how cites would analyzing and subsequently “affirmatively further fair housing” choice because many cities had already begun complying with the new AFH rule. In the end, the rule suspension caused cities to revert back to completing an Analysis of Impediments (AI) to Fair Housing Choice as had been done prior to the Obama rule. The CTAFA document is an AI but it does contain many assessment aspects that were part of the AFH rule. However, what makes the CFATA document particularly unique is that is a regional assessment of fair housing and, in fact, is one of only a very few regional assessments ever performed. It is also the largest regional assessment ever performed and takes in the cities of Austin, Georgetown, Pfluger-
ville and Round Rock along with Travis and Williamson Counties. Several area housing authorities also participated in the report. The regional joint effort approach was taken by these participating jurisdictions not only to save some money through collaboration but also in acknowledgment that fair housing issues, and possible patterns of discrimination, likely extend beyond city and county boundaries. The regional view is also deemed necessary to fully understand demographic patterns and housing market trends. Through surveys, community engagement programs, focus groups and “pop up” events to gather opinions, the CTAFA lists many findings, and, as stated, some of the findings have been previously identified in past reports while others have not. For example, like past AI’s, the CFAFA finds that cities are limited by state law in their ability to use inclusionary zoning as a tool to broaden housing choices. The report also repeats past findings regarding the challenge for federal Housing Choice Voucher (HCV) holders to find suitable housing. Yet, it is interesting to note that the report also states that Austin “stands out” for its “many affordable housing options, both publicly and subsidized rentals and rentals affordable to Housing Choice Voucher Holders”. Since this is a regional assessment one can only assume that while Austin may have units available for HCV holders the surrounding cities may not. The finding that most directly affects the rental housing industry is that strict rental policies limit housing options and are causing disproportional impacts on disabled and low-income populations. The strict rental policies cited are the “3x rent income requirement”. The report states that Texas law prohibiting cities from including Source of Income as a protected class is preventing renters from claiming legal unearned income such as child support and disability insurance as eligible for the 3x income threshold. Another rental policy cited is “onerous criminal lookback periods that
do not take into account severity of crime or time period in which is was committed”. It will now be interesting to see how the findings of the regional assessment approach extend to new policies and housing development decisions in each of the participating cities. The report states that “city staffs are resource constrained and already committed to workplans to respond to the growing housing crisis." In other words, cities are so busy trying to manage growth that they simply to not have the capacity to fully act on housing barriers identified in the report. The report’s participating cities seem to agree that a regional working group be formed to craft a workplan to overcome the fair housing barriers identified. It is also stated that the Regional Affordability Committee convened by the City of Austin several years ago could serve this role. Either way, the Austin Apartment Association will be asserting our role as stakeholders and will fully participate in any city or regional discussion spurred by the CFAFA. San Marcos Housing Assessment
Although not related to the CFAFA, but yet performed by the same consultant, the City of San Marcos has issued a “Housing Needs Assessment” (HNA). This assessment was done as part of the city’s Workforce Housing Task Force effort. The aim of this Task Force is to develop a comprehensive housing policy aimed at addressing the housing challenges facing working families. The findings of the HNA are that while San Marcos seems to have plenty of student housing, students still have difficulty finding affordable units to rent. The same holds true for family seeking units with more than one or two bedrooms. The findings also suggest that the affordable units that exist in San Marcos are in need of repair and are older
than what is desired. The San Marcos Workforce Housing Task Force was originally created to identify strategies to increase homeownership opportunities for its workforce, but it has now recognized that rental housing in an integral component of any workforce housing policies and has since expanded its scope to craft housing policy recommendations to increase housing opportunities for renters as well. More than sixty-five Austin Apartment Association members attended the Texas Apartment Association’s Day at the Capitol on February 13. While at the Capitol AAA members met with sixteen Austin-area legislators and discussed a wide range of topics, including the need for new state law language regarding late fees and transparency for when cities change fees and permits.

Washington, D.C. | March 2019 The Austin Apartment Association joined forces with the San Antonio Apartment Association to meet with the office of freshman Congressman Chip Roy. Roy’s District 21 covers area in Hays and Travis Counties but also extends south to near downtown San Antonio and extends westward covering Kerrville and Medina. The topics of discussion during the meetings included reform to the Section 8 program, the need for a nation infrastructure program and reauthorization and funding for the National Flood Insurance Program (NFIP).

WHAT’S NEXT FOR APARTMENT TECHNOLOGY Technology in the rental housing industry is at a tipping point, the likes of which hasn’t been seen in 15 years.
D
uring the late 1990s and early 2000s, the industry experienced an onslaught of game-changing technologies: Automated credit screening, pricing and revenue management (PRM), Web-based Property Management Systems (PMS) and resident/prospect portals. The ensuing 10-plus years saw, at best, minor advancements in process through technology; but that is clearly changing. While not yet certain exactly how they will play out, technologies such as artificial intelligence (AI) and machine learning, smart-home devices and short-term rental (STR) marketplaces will clearly have a major impact in how we do business—a much bigger impact than the new technology that has entered our business since the early 2000s. Based on interviews with 20 COOs and CIOs to get a sense of the “state of the state” for rental housing operations, a glimpse into where the industry is headed with technology during the next couple of years became apparent. The white paper “20 for 20: Where Multi-Family Housing Operations is Heading by 2020” addresses the situation.
THE TOP 5 OBSERVATIONS
1. One big project. Half of those interviewed for this paper had a technology project in 2018 that basically dominated resources to the exclusion of any other major project; and 70 percent of those were either a transition to a new PMS or a major upgrade to their existing PMS. These infrastructure investments only pay off if they are followed by significant projects that build on top of that infrastructure. 2. Short-term priorities and tech hype not yet aligned. The key topics presented at NMHC’s OpTech Conference in November included AI, smart-home platforms and STR technologies. Yet none of the COOs or CIOs interviewed listed any of those
among their “top three” priorities for 2019. That doesn’t mean they have no interest or activity (intentional double negative), but it does mean the rental housing industry is a bit early in the hype cycle for each of the three. There is first-mover advantage in AI and STR because efforts from those movers learn and mature sooner than others and can maintain that cultural advantage for years. Conversely, smart-home tech may have a first-mover disadvantage if it ends up investing in the Betamax version in a VHS world. 3. Recruiting and retaining talent. Everyone said that recruiting and retaining quality talent was increasingly difficult. As challenging as they said it was in 2018, all stated they expect it to be equally difficult (or more difficult) in 2019. Most are focusing on culture (creating a sense of belonging to something with a greater purpose), policies (e.g., loosening tattoo and piercing standards to attract a wider talent pool) and investing in career development and training as key strategies for dealing with this challenge. On the development side, the clear No. 1 priority is investing in sales (leasing) performance improvement. That is not surprising given a 10-year bull-run in apartment performance doesn’t exactly leave metaphorical sales muscles at their peak level. For executives peering into a future rife with possible slowdowns, it seems wise to improve those capabilities in preparation for potential clouds ahead. 4. Business Intelligence (BI) adoption. Several interviewees mentioned BI projects as a key area of focus though few were completely satisfied with their results to-date. We noticed that the pace of the adoption cycle for BI has differed from the technology mentioned earlier. Those were clearly led by owner-operators and followed a path where early innovators spent years getting just a handful of customers before hitting a tipping point of rapid adoption. In contrast, BI is following a slow, steady pace of adoption with no rapid increase and seems to be equally led by fee managers as by owner-operators. The motivation for fee managers is the need to meeting their clients’ expectations for quantity, quality, pace and customization of data and reporting. Candidly, most BI projects are not set up for success. They tend to be IT-led and/or report-centric rather than business-led and focused on dashboarding and predictive analytics. A company driven by analytics is highly recommended. 5. PRM turns 18. This month is the 18th anniversary of the very first property that went live on LRO (for any trivia buffs, it was Hunters Run in Austin, Texas). When asking executives what they thought was missing in PRM, CIOs told us they haven’t been involved in PRM for years and COOs struggled to articulate any driving needs. It’s concerning that executives have become complacent about PRM. Other industries (e.g., hospitality) view PRM as a Sisyphean task and never stop working on refining models and processes. At a minimum, there is opportunity in better lease-up pricing, unit amenity evaluation, renovation return analysis and ongoing development of PRM associates. TAKE NOTICE OF THE LAW ABOUT NOTICES TO VACATE

ou are hereby given notice to vacate¼.” That simple phrase is the core of every notice to vacate that precedes the filing of an eviction lawsuit. One may be asked to vacate several different things: the dwelling, the premises, the house, the apartment, a duplex, the leased space, etc. There is no requirement of one-size-fits-all description. The notice to vacate is neither a question nor a request. This is not a time to be polite. “We would appreciate it if you would vacate,” while sounding less harsh than, “You are hereby given notice to vacate,” creates a problem. The more polite phrase suggests the resident needs to agree to vacate for the vacate notice to be effective; that is far from the case. “You failed to pay rent for the month of May 2019. If you do not pay your delinquent rent and other charges you will be asked to vacate the premises.” That is another poor choice of words. It is what is called a “pay or vacate notice.” The vagueness of your stated intentions created uncertainty and enabled the recipient of the notice to question what might

happen next. Doubt entered the picture. Do not allow doubt. Your notice to vacate must clearly state the consequences of the tenant’s default. If you believe you may be willing to allow the default to be cured later, when you use the straightforward language, “You are hereby given notice to vacate ...” you will still be able to do that. Keep your cards close to the vest. Maintain your option not to act upon the vacate notice after (and despite) having given it. Do not create a possibly fatal ambiguity with a “pay or vacate notice.” In an eviction lawsuit, a notice to vacate is a prerequisite. It is something that has to occur before such a lawsuit is filed. Texas Property Code Section 24.005(a) says it like this: The landlord must give a tenant who defaults or holds over written notice to vacate the premises before the landlord files a forcible detainer suit. The statute provides that the notice period must be at least three days, although it allows the parties to contract for a shorter or longer notice, in a written lease or agreement. In the TAA lease contract, the parties agree upon a minimum one-day notice
period. Your notice to vacate, to be effective, must tell the resident of the premises in question, in no uncertain terms, that he needs to vacate those premises by a date certain; and that date must be before the date on which the eviction case is filed. Do not give multiple notices to vacate. This is especially true when the vacate date set forth on one notice is before the date the lawsuit is filed; but in another notice, the vacate date is after the date the lawsuit was filed. Because the notice to vacate is a prerequisite to the filing of suit, a notice to vacate given after the date suit was filed is completely ineffective. If the eviction suit is filed before the date the tenant is to vacate according to the notice, the eviction suit will fail. Every time. Occasionally the owner’s representative will attempt to justify giving multiple notices. “Even though we had already filed the eviction, I just wanted them to be sure they knew we wanted them out.” Or maybe something like this: “When I filed the eviction, it was because the tenant didn’t

pay April rent. After I filed, the tenant also failed to pay May rent. That second failure was also a default under the lease, so I thought it would look good if we asked them to vacate again.� You meant no harm. Certainly you did not think giving another notice would undermine the effectiveness of the earlier notice. Both notices instructed the resident to vacate. Both notices were based upon different tenant defaults. Yet the second notice could raise the presumption that there was a period of time, between the date you filed the eviction and the date you gave the second notice to vacate, during which you had changed your mind about actually proceeding with eviction. Doubt again entered the picture. When it did, it created an opportunity for the defendant tenant to state at trial that she did not really know if or when she had to move. Even if, ultimately, she did not prevail at trial, your defendant may nonetheless get an opportunity to cure the default, when such an option was not one you preferred. Trust me, once is enough. There is also no need to give multiple notices to vacate when there is a change of ownership or management before the eviction case proceeds to trial. An eviction case concerns possession of premises. According to Rule 510.3(e) of the Texas Rules of Civil Procedure (TRCP), the only issue in an eviction case is the right to actual possession [of premises] and not title [to premises]. The change in ownership, management, or both, does not change the physical premises in question. There may be some situations where a notice to vacate, due to its age, has become stale. Imagine a
hypothetical situation in which you gave a notice to vacate three months before you filed the eviction case. In that scenario, the court might wonder what prompted the delay. The court might also conclude that it was reasonable for the tenant, interpreting your three months of inaction, to determine that their three-monthold nonpayment of rent no longer bothered you and that you had become okay with it.
While that point of view is certainly a nonsensical stretch, the defendant may get some mileage out of it. How is that possible? When a judge orders someone to be removed from the premises where they live, that determination is considered a harsh remedy. While sympathy should not play a role in a judicial decision, it occasionally does. Knowing that, do all you can to prevent a lengthy delay from coming into existence. It should now be clear that a proper notice to vacate must exist for an eviction case to be successful for the owner. The form itself must
say the right things. It must also be delivered to the right people, in the proper manner. Property Code Section 24.005(f ) and (f-1) each provide that the notice to vacate is to be given at the premises in question. Section 24.005 (f ) provides that the notice to vacate may be given in person or by mail. Notice in person may be by personal delivery to the tenant or any person residing at the premises who is 16 years of age or older. It may also be affixed to the inside of the main entry door. Another option is for delivery by mail, including one or more of regular mail, registered mail, or certified mail return receipt requested. Regardless of the type of mailing used, the notice to vacate must be delivered to the premises in question. Mailing a vacate notice, especially to an apartment, is strongly discouraged. Very few apartments have a mailbox at the premises. On the contrary, the mailbox for the premises is typically located some distance away, at a central mail facility where scores of other mailboxes are also located. No matter how close the location, problems are created, because the box is not at the premises in question. Why needlessly raise the issue of whether or not you complied with the statute? You have already learned that having a proper notice to vacate is essential to prevailing in your eviction case. Your trial evidence needs to establish delivery of the notice to vacate to the premises in question. Since eviction trials happen quickly, there is a good chance you would not have a signed “green card� from the certified mailing of your notice to vacate before trial. You are unable, in addition, to provide the court anything showing that first class mail was ever actually received at the premises in question.
While sympathy should not play a role in a judicial decision, it occasionally does.

In 1994, the Texas Supreme Court held, in the case of Thomas v. Ray, that when a letter containing a notice [to vacate] is properly addressed and mailed with prepaid postage, a presumption exists that the notice was received by the addressee. The presumption may [however] be rebutted by an offer of proof that the addressee did not receive the letter. What might such an offer of proof consist of? How about a statement from the tenant to the court stating that your defendant never received the notice, and that this is the first time, in court right now, that they ever viewed this document? A statement like that could certainly get one to thinking that the presumption of receipt was rebutted! Do not take any chances by mailing the notice. Despite the fact the
Property Code allows a notice to vacate to be mailed, practical interpretation of that statutory provision requires you to steer clear of using the Postal Service. Without question, delivery to a person is the best option. Posting on the inside of the main entry door, where neither snow, nor rain, nor heat, nor gloom of night can remove it, is the next best choice. As of January 1, 2016, the Texas Legislature created another viable option, but it requires jumping through some hoops. The new option is to affix the notice to vacate to the outside of the main entry door. But not so fast! Consider the prerequisites. First, the premises must not have a mailbox. Next, it must have a keyless bolting device, alarm system, or dangerous animal preventing the
landlord from entering the premises where the landlord would be able to affix the notice to vacate to the inside of the main entry door. If the landlord reasonably believes that harm to any person would result from personal delivery to the tenant or a person residing at the premises, or would result from personal delivery to the premises by affixing the notice to the inside of the main entry door, you have also satisfied a prerequisite to outside posting. You cannot simply assume, however, that the necessary prerequisites will be available to you. You may have to offer evidence at trial about what you did to determine that you were entitled to take the action you did when you taped the notice to vacate to the outside of the door. Prepare to offer such testimony

at trial. Knock on the door. Try to get in with the key. Make a note of what sounds you hear coming from inside the unit and consider how a stranger to the situation might react to those facts. Once you decide you are eligible for posting the notice to the outside of the door, make sure you have come to the unit well prepared. Have lots of sturdy tape with you. Be sure the face of the envelope containing the notice to vacate is fully addressed with the tenant’s name and address, and on it are written, in all capital letters, the words “IMPORTANT DOCUMENT.” Last but not least, after you have securely affixed your notice to vacate to the outside of the main entry door, go to a post office or official mailbox. Why? Because an identical copy of the notice to vacate that was affixed to the main entry door must be mailed, not later than 5:00 p.m. of the same day, in the same county in which the premises in question is located. Document the USPS location where you mailed it and what time that was. You may be asked to describe your actions later. In a perfect scenario, the mailing of that notice would be by certified mail, return receipt requested, done at a post office. In that situation, the postal clerk would give you a stamped and printed receipt indicating the date and time of the mailing. Otherwise, if you simply stick a first-class letter into a standard mailbox, you may encounter resistance concerning what time of day there was a postal pickup from that particular box. Do not take chances. Too much is riding on this. Significant sums of money could be lost through carelessness. Finally, what should the notice to vacate contain? It should name all tenants obligated under the lease
residing at the premises whom the plaintiff seeks to evict (TRCP 510.3[c]). Keep in mind that no judgment or writ of possession may issue in an eviction suit, or be executed against a tenant obligated under a lease and residing at the premises who is not named in the petition and served with citation. To be named in the petition requires that notice to vacate first be delivered. Since a proper notice to vacate,
with proper delivery, is an essential prerequisite to an eviction petition, be certain that each such defendant is given an opportunity to receive their own notice to vacate. The law is unclear on this point. It does not appear to require that three separate tenants, all residing in the same leased premises, should receive their own, uniquely addressed notice to vacate. It would be prudent to err on the side of caution, however, and give each resident their own notice to vacate. This is especially true when the notice to vacate is affixed to the outside of the main entry door in
the sealed envelope, under Property Code Section 24.005(f-1), as discussed above. Since you will have to mail a duplicate copy of the notice delivered in that manner, you want to be able to testify that each resident you are seeking to evict had their own letter addressed and mailed to them at the premises in question. Also, do not put them all in one envelope. One more thing: include the phrase “and all occupants” after the name of each resident to whom a notice to vacate is going to be delivered. When you are faced with trial testimony by the tenant to the effect that she did not receive the notice to vacate, all you can do is prove that you adhered to the statutory requirements. Unless your delivery was directly to a person at the premises in question, all you can do is speculate about what actually happened. Be prepared. Bring a witness with you to observe what actually gets done. And do not fail to bring that same witness with you to trial. All your dutiful adherence to proper procedures before trial does is prepare you to tell a judge or juror about it at trial. Having the right witnesses in court who can testify from personal knowledge relating to the notice to vacate, could make your case presentation on the notice issue ironclad. Remember the old television show “Ironside”? It aired from 1967 through 1975. It starred the former television lawyer, Perry Mason (from the show of the same name), in the title role as a special police department consultant. “Ironside” was the star’s nickname. When Ironside was involved, the case was always successfully resolved. Ironclad will have the same results!
It would be prudent to err on the side of caution, however, and give each resident their own notice to vacate.
