s our own Kristan Arrona looks toward retirement, I struggled to put into words what she has done for our association and the legacy that she will leave behind. After sitting down with her team and talking with several past presidents who have worked with her there was one common thread everyone had to share: Kristan inspires kindness and always looks to find the best in every person. I can assume this is how she earned the nickname, Mom. When you talk with Kristan about the members, her team, and the leadership of the Austin Apartment Association it sounds like you are talking with her about her own children. Her eyes light up, and she is immediately able to tell you their life story, how they got started in the association, and what their biggest strength is. Kristan consistently leans into her members and engages their strengths to help move the association forward. Just like any mother would, Kristan encourages her members and her team and consistently builds them up. As we look to share the legacy that Kristan Arrona has built in this issue, I thought about her and how she is able to utilize her member’s strengths. So, I channeled my inner Kristan and turned to our own association journalist, aka

Stephanie Naylor. Stephanie and I sat down with Kristan and her entire team to hear their thoughts on the legacy that Kristan will leave behind. I am so excited to share the following that shares Kristan’s legacy and is so eloquently written by Stephanie Naylor. It was inside of a homemade teepee that Kristan Arrona began her career. Teaching a class full of third graders, she built the purple and white structure out of cloth and good vibes. Students gathered inside as a reward, but within its conical walls, they learned from each other. They learned to be kind, to be patient. They learned that being caring, considerate and flexible would serve them well in life. They learned that a quick smile and bent ear were integral to their future success. It was the Philosophy of Kristan. In 1991, a few years removed from her classroom and fresh off a stint in association management in Colorado Springs, the opportunity to move to Austin arose. A Northeasterner by birth, Kristan recalled her father’s frequent advice, “You only live once,” so she seized the opportunity and her new journey began. Wearing a skirt that was too short for Colorado, but just long enough for Austin in the 90s, she arrived at the Austin Apartment Association as the new
Executive Vice President. Her welcome from staff and members proved as warm as the Austin heat and Kristan felt immediately at peace with her decision. Although the people were great, the situation she stepped into was not as rosy. AAA was facing financial insolvency. “We couldn’t even make payroll,” Kristan remembers. Working with children gives you resolve, but Kristan began to feel nervous for one of the rare times in her life. Although she had always considered herself fiscally responsible, the state of AAA forced her to adopt a new persona as a budget hawk, one that stuck with her though the decades that followed. It was the earliest crisis she faced and by every measure, she conquered it. Kristan’s twenty-seven-year legacy at AAA is full of successes. She has twice been named as TAA Association Executive of the year (1999 & 2010) and once been honored as the NAA Association Executive of the year (1999). During her tenure, AAA won numerous state and national awards for community service, membership and education. There have been so many achievements, but you would be hard pressed to get Kristan to accept any credit for them. It’s always the staff. It’s always the members. In her
mind, it’s never Kristan, but anyone that has worked with her through the years knows just how much she brings to the table. She’s a leader. A captain of a strong but whimsical ship and it’s her passion that puts wind into the sails that keeps it on course. So much of Kristan’s leadership style was borne out of her desire to teach. She tries to go into every interaction attempting to impart knowledge. She remembers a recent conversation with a member who wanted a full, more realized understanding of the association and its benefits to the industry that it supported. It was a long, easy conversation. Her love of the association allowed her to launch into a detailed explanation that might have struck the member as scripted had it not been for the smile in her eyes or the authenticity of her message. She spoke of the symbiotic relationship between member and association. She talked at great length about the shared values and common purpose. As she watched the member walk away, she knew she had experienced one of her favorite kind of moments. The revelatory look she received when things click into place. The “a-ha” moment that was equally as rewarding in a child of eight or a man in his mid-30s. These conversations are Kristan’s lifeblood and she loves nothing more than
seeing her advice put into practice by members and staff. It’s the love a mother might feel for a child or a teacher for her students. It is the kind of love that has defined her time at the association, molding the organization into a place of inclusivity. For Kristan, it’s all about community and, through her efforts, she helped transform AAA into a home. Because of this, she quickly became known as “Mom” amongst a large portion of members and staff. She’s quick with advice (“Always keep a little cash in your wallet.”), generous with praise, but often without a filter when it comes time to providing honest feedback. She’s the mom we all deserve, and our favorite teacher rolled into one. To identify Kristan as simply a mentor or simply a teacher would be at the expense of understanding Kristan the person, discounting all her silliness and idiosyncratic tendencies. She sings in the office, says “boo” instead of “hi” and staples papers on the right (um, wrong) hand side of the page. She clicks her pen incessantly, wins the award for “worst whisperer” and she is a little resistant to technology. She once called staff member, Amy Magnuson into her office to fix Google when the landing page had changed. While there is no doubt that she could
still do the job she has loved for nearly three decades, she feels it’s time to take a break, spend some time with family and travel. You might even see her handing out samples at your local Sprouts. Her hopes for the future of the association are continued growth especially in the areas of on-site involvement in legislative issues and in education with the development of the Austin Apartment Association Education Foundation. She has every confidence that so long as the staff and members remain a cohesive unit, anything can be accomplished. At a recent brainstorming session at NAA, she had a chance to share with her peers her formula for career success. To be a success in the association world, one must be: Kind, Patient, Caring, Flexible, Considerate, Prepared, A Good Listener, Quick to Smile and Thankful. You can learn from every discipline in the industry – not one is more important than another. If you give it all you have and have fun along the way, you will succeed. It was a familiar statement built within the walls of her third grade classroom and used countless times in the years that passed to motivate and support staff and members, family and friends. It was the Philosophy of Kristan.

session begins January 2019. A City Fee Transparency Bill aims to induce certain good government actions into the city budget adoption process. More details are to come in the months ahead, and much can change throughout the legislative process, but if passed such a bill could require municipalities to spotlight fee increases early in the budget process and clearly identify them in fee schedule that indicates the dollar or percentage increase to the fee, establish opportunities for business operators to request direct notification about any fee changes and provide that city fee schedules must be adopted separately by a city council and not buried within, or in the back pages of, the proposed budget document.
Expanding Floodplains Fee Increases and the Need for More Transparency

This past August, just prior to the release of the 2018-19 proposed budget for the City of Austin, the Austin Fire Marshal sent a letter to the area’s fire protection service companies announcing new testing protocols and a Fire System Inspection Permit fee increase. The fee increase is from $20 to $30 per test and each multifamily building with a sprinkler system and interconnected fire alarm requires two tests. The Fire Marshal’s letter and fee increase prompted the AAA raise the issue before the city council. At the city council meeting the Austin Apartment Association explained that the new testing protocols increase the number of tests required and what appears to be a small ten-dollar fee increase is misleading because some multifamily properties require dozens of tests. The validity and need for the fee increase were also ques-
tioned since no explanation was given from the fire department why the fee was increasing. Following the council meeting several members of the AAA Legislative Committee sent letters to council members urging them to keep city fees in check and reminded them that city fees greatly impact housing affordability. In the end, the city council adopted their new budget with the Fire System Inspection Permit fee increase as well as a wide range of other increases. The issue of city fees being increased year-after-year with little explanation, outreach or notification to the business operators who pay the fees occurs in many municipalities across Texas. To address this issue the Texas Apartment Association is poised to again pursue passage of statewide legislation by the Texas Legislature. TAA’s efforts to advance “City Fee Transparency” legislation fell just short of full passage in the last legislative session that ended in June 2017. The next legislative
As highlighted the last edition of WINDOW, the City of Austin is the final stages of changing their floodplain maps and related regulations in response to a recently completed National Weather Service (NWS) study of historical rainfall. The anticipated changes to the city’s floodplain map may trigger new insurance and other requirements for existing apartment properties and all other affect properties. During the city’s presentations on this topic the city has described the floodplain changes as essentially a renaming of the existing 500-yr projects flood boundary as the new 100-yr flood level boundary. This change is not small and affects over 3,000 individual land parcels throughout the city. All properties captured within a newly established 100-yr flood boundary will fall under city and federal flood regulations that impact development, redevelopment and building design. Leaving the Wood Pile Higher In 1991, the year AAA Executive Office Kristan Arrona took the AAA helm, the region’s population was less than 500,000, the number of apartment units totaled 68,000 and city leaders dubbed Austin “The Live Music Capital of the World” because of the large number of live music shows and venues found throughout the city. During that same time the city was seeing an influx of technology companies and grappled with issues involving growth management, housing affordability and environmental protections.

Soon after she arrived, Kristan worked with the Tenants Council to secure a seat on the Council’s dispute arbitration committee and kept pace with rapid changes being made to the city’s housing policies and procedures. As the years progressed her budget stewardship allowed her to hire a staff person dedicated to working on advocating for the apartment industry at Austin city hall and beyond other city halls in the region. Whether on her own or through her direction, Kristan has made sure that the AAA membership was well-represented and involved in a wide range of government regulatory and legislation changes. Kristan’s close ties to the city helped when, in 2005, a close partnership with the city was needed to identify vacant units and coordinate housing placement for the large number of people in Austin displaced by Hurricane Katrina Fast forward to today when the region’s population has reached more than two million, the City of Austin
is the 11th largest city in the nation and the number of apartment units is rapidly approaching 230,000. The regulatory and legislative changes confronting the industry have also grown rapidly but the foundation of our involvement on the issues is strong and at just about every meeting I attend a city staffer or policy leader asks about Kristan. There is an adage about how, when spending time in a winter cabin that others will also visit during the winter, that you should leave more wood stacked onto the wood pile than was there before you arrived. Making sure the woodpile is higher for others that follow will make their cabin stay better and ensure that the fire burns long after you are gone. The wood pile Kristan is leaving runs both high and deep, and we will be using the wood she stacked for years to come when working to resolve the wide range of government related issues confronting the apartment industry.

Today, almost all marketing efforts revolve around a digital strategy. Whether it’s monitoring your multifamily property’s online presence or using new software to collect data on your target audience, it is critical to stay ahead of the marketing technology (martech) curve.

hile some of these martech tools specialize in either automation or analytics, elect to combine them on a simple user dashboard. Marketing analytics and automation are two categories that will increase ROI and integrate marketing efforts on all touch points in your consumer decision-making process. Here are some of the most valuable tools to add to your marketing arsenal: 1. HubSpot HubSpot is the ultimate tool for inbound marketing, a technique used to pull consumers in through content marketing, social media, and search engine optimization (SEO). This application publishes and analyzes almost all forms of digital channels including email and websites. HubSpot also allows you to build blogs and landing pages to increase ROI for your small business. 2. Google Analytics Google Analytics is a free application that enables you to see data from many different touch points. The platform allows you to see a complete picture of your consumer’s journey. With Google Analytics, you can track customer behavior, channel performance, acquisition, and more. Analytics data can then be used to create paid boosts through Google such as Google ads and AdWords.

3. Hotjar Hotjar is the best way to see what visitors are interested in on your website. Using heatmap technology, you can see where your page has the most clicks, track movement, and see how far your users scroll. This tool also allows you to split data based on different devices that visitors have used to view your site. 4. Google Optimize Google Optimize enables you to put your data insights to the test. Integrated fully with Google Analytics, this tool gives multifamily marketers the opportunity to test their analytics efficiently on a simple platform. A/B, multivariate, and redirect testing is easily created and deployed with Google Optimize’s visual editing interface. Then, the app pulls the data from these tests, allowing you to maximize your target reach, impressions, and engagement. 5. Klipfolio In need of a dashboard that displays all of your marketing analytics in one? Klipfolio is the tool for you. With the Klip Editor tool, you can easily build your data story to fit your specific analytics needs, as well as customize visualizations such as different charts and graphics to provide clear information for your team and your client.
6. Cyfe With Cyfe, you can monitor and analyze data across several online touchpoints including social media, email channels, websites, and SEO all on one platform. This app is integrated with more business systems than any other business insights product, so you can easily schedule social media posts and track your marketing efforts. Cyfe also functions as a project management tool to keep your team on track with deadlines, tasks, and projects. 7. MailChimp MailChimp is a marketing automation tool that creates email campaigns and partners with Google Analytics to track e-commerce sales. EZ Texting EZ Texting is a tool to send mass SMS texts that include options like reminder campaigns, picture messaging, and analytics. 1991-2018 How do I wrap 27 ½ years of working at the Austin Apartment Association and put it into something that will be read? I am not a writer by any means, but will give it all that I have. I walked into the Austin Apartment Association office on May 21, 1991, a youngster at that time, and a transplant from the Apartment Association of Colorado Springs. I was eager and ready to learn about the “Texas Way” in the multifamily world and make our association an example of what a thriving association could be. Twenty-seven and ½ years later, I am happy with what we have accomplished with the ongoing support of the staff, volunteer leadership, and every member of our association; there are no solo victories here. The success of this association relies on teamwork – everyone working together for what is best for AAA.Never in my wildest dreams would have I thought that my work family would be truly a second family to me. Sheri Gallo, thank you for agreeing to meet with me during the NAA meeting in D.C. in March 1991. David Stapleton, thank you for having enough confidence in me to hire me during your tenure as President. I was not sure then, but believe now that you made the right decision. After just a few short months, doesn’t he up and move to Dallas (!) but I always knew that I could count on him for direction. Fast forward: I have the incredible experience of working with such a talented team every day. The team at AAA has one mission: to have a servant’s heart. Being part of this team has given me more than professional experience; my relationships on a personal level are

in a better place than they once were, thanks to some of the things I have learned from many of you. Amy, you have been by my side for over 21 years. I am so very proud of what you have learned over the years and all that you have accomplished – you make my day every day and are truly that “daughter” I never had. If there was anyone that knows as much about every department, it is you, Amy. Thank you for agreeing (most of the time) to learn something new or to embrace a change. You are truly amazing. Dana and Jen, thank you for listening to my stories over and over again and never poking fun. I have shared many stories over the years and more to come I am sure. Your commitment to this organization is second-to-none and may you always continue to do it your way and the right way. You both bring so much to the table at AAA; I can’t imagine the association without you. Jerrica and Robbie, you have blended so very well into the environment at our office; I could not have dreamed of a better “dream team.” Jeanette, I know you spend much alone time in your “command center,” but thank you for being so gracious and welcoming to all those who come to our office. Paul, thank you for being front and center at the numerous stakeholder meetings and city council meetings, just to mention a few. You analyze before you act, and you consider our members’ experience before delivering a message. You have an innate ability to foster relationships with many disciplines. Thank you for putting our association at the table.
Everyone knows that the association belongs to the members, not the staff nor the board. Members are the constant piece of an association. A superior team and the membership focusing on all working together is what makes our association a success. Competition for business is great amongst all our owner/management company members, as well as our supplier partners, but you all are the best at what you do and support one another to keep Austin in the limelight. To all of the members of the association: it truly has been a pleasure working along side so many of you during my tenure as the executive vice president. This has been a fantastic learning experience and I am thankful for the skills I have acquired. I feel as if being a part of this association has made me a complete and more well-rounded person. I have learned from you the importance of taking direction, as well as accepting criticism and compliments. I learned that to make a great final result on any project, I had to be open-minded, value other people’s opinions and consider others’ ideas along with my own. What makes our association leadership so special is that we work hard together and then have fun together because we like and have mutual respect for one another. To the many wonderful leaders over the years, you have my sincere appreciation for all the time and energy you have given to me and the association. You have made it a top-notch association. I have
had the privilege of working with 28 wonderful presidents, one incredible Attorney-at-Law, my friend Bill Warren, and oh so many members of the products service council. Without the strength of all these leaders, the Austin Apartment Association would not be what - and where it is today.
Finally, keep the following words of advice in mind: to be a part of the Austin Apartment Association, be kind, listen, be considerate, care and be caring, be honest, be flexible, be prepared, be present and pride yourself on being the best you can be. My sincere thank you for allowing me to serve.

RENTERS REALLY WANT
E
veryone in the industry these days is talking about amenities. What renters want, what they don’t, and what they will want in the future. The problem is, most developers aren’t listening to the actual renters. Over my career, I have spoken with 100’s if not 1000’s of renters, listening to their wants and needs for a place to call home. Contrary to popular belief, not every renter is a millennial who wants a smoothie bar in their bathroom. The vast majority of renters have simple needs in a building or community when it comes to amenities.
REAL CLOSET SPACE When I say “real,” I think we all know what we are talking about. Not the closets with one bar that can fit a shirt and jeans. We’re talking about walk-in closets or ones with built-in storage. Renters these days are older or moving from established households and have more clothing. Many developers are “afraid” to take a portion of a bedroom to enlarge a closet, but I can tell you from firsthand experience, I think most of us would like larger closets and a smaller bedroom.
MORE STORAGE This is a must-have for most renters these days. Unlike prior years, when renters were younger with very few things, today’s renters are older and have amassed a lot of items. It’s important to give residents enough space to make a difference, especially when units are small. I’ve never seen a renter say “I’m going to give up all my possessions so I can live in this community.”
DOG WALKING AREA As buildings and communities start accepting pets, dog walking areas are very important. It’s highly convenient, safer than walking your dog outside the community during evening hours and can be a great place for residents to socialize with other residents. Great additions to these areas are dog washing stations, disposal spaces, and doggie water fountains.
REAL FITNESS CENTER I’m not talking about a treadmill a TV and some mirrors here. Developers need to invest in full fitness centers. Renters often look at the cost of the apartment and try to figure out if they can save

money by dropping their gym memberships. Want to increase your rent roll? Add a great gym.
ONSITE CHILD PLAYROOM / DAYCARE One of the best amenities added in the last couple of years to some developments are children’s playrooms. This is a game changer for families with small children not yet in school, but needing an escape from their apartments. I’ve seen parents actually choose one location over another just for this space. Some of the better complexes have even started operating an on-site day care, which in my opinion, would be the ultimate amenity for parents.
AMENITIES RENTERS DON’ T WANT In a push to seem more “hip” or “relevant,” developers have opted to add some amenities that seem like they add value, but in fact, take space away from the amenities renters really want. If you have the space to add these AND all the entries above, that’s a win, but a lot of these amenities are underutilized and add nothing to your community’s bottom line.
· Coffee Bar - There are probably 1-2 residents per day that use · · · ·
this, so it doesn’t really justify the expense or upkeep required Business Center - Can’t remember last time I saw anyone using one of these. On-Site Kitchen - While nice in theory, once again, is only used on rare occasions. Movie Rooms - This is a “maybe” in my mind. Great for sporting events, etc., but usually ends up being prime real estate that can be used for something more “valuable.” Putting Greens - Once again, I don’t think I’ve ever seen a resident use these. Could be an excellent place for a dog park instead?

“Kid Friendly” AMENITIES FOR APARTMENT COMMUNITIES Justin Cleary, BreadBox Consulting
I recently posed a question to a group of developers...What if you started looking at your communities from the standpoint of children being the residents, instead of the adults?
Now obviously, I’m not talking about a community where every unit is filled with slides and see-saws or kids roaming the grounds like Lords of the Flies. But it’s a question to highlight what can be done if the primary motivation for the planning of amenity space, marketing and the overall feel of a community was done with children in mind. With 33% of all renter households (14.3 million) having minor children, it’s an important question. And as more and more residents with children decide to rent instead of buy, having a true “family friendly” community can become a huge differentiator in the marketing and retention of tenants. So what would a community that is designed around the family and actual children look like?
ONSITE DAYCARE This may be a game changer when it comes to “family friendly” communities. One of the most significant issues for families is finding quality child care close to their residence. Having an on-site daycare within your community solves many problems for working parents and could be a tremendous asset to your residents. We see partnering with a local daycare to open in a retail section of your community or underused space. You get a great tenant that genuinely adds value to your community, and your residents get a one-of-a-kind amenity.
ON-DEMAND BABYSITTING With services like Care.com, you can set up a “portal” for your residents to use to find babysitting, dog walking and much more. It has the added value of also making sure those babysitters / visitors to your community are screened before arriving. This “value-add” can be a much-touted aspect of your “family friendly” marketing. You can even run contests where the winners get several hours of babysitting “on the house”.

CHILDREN FOCUSED EVENTS Many communities already run events for residents like food truck night, contests, meet & greet BBQ’s and others. But what about a Magic Show? How about a Treasure Hunt around the community? Nothing says fun like an ice-cream truck event! Adding even one “kid-focused” event per month would be a great addition to your Event calendar.
PLAYROOM Some communities have already adopted this idea into their developments. This space should be comfortable, with chairs and tables, areas for crafts, puzzles, and learning. With the proper use of lighting and mirrors, this space can be an interior area that is normally underutilized due to lack of windows. Make sure to use carpeting and make walls stain resistant. I’ve seen many parents use spaces like these for their pre-k children and it’s a wonderful space for learning and exploring with their children.
PLAYGROUND Suburban communities can somewhat easily accomplish adding a playground into their community, but what about urban areas? One idea would be to create an indoor playground complete with slides, jungle gyms, monkey bars and other items. This does not need to encompass a large area, as small children will primarily use it. Think McDonalds use of playgrounds into their stores. No matter the size, just having space for children to let off steam and parents take a break in a safe and fun environment is worth it. Whether it’s one of these ideas or something else, it’s important to think about how to develop your community to be truly “family friendly.”

e all like top ten lists. They’re fun, right? We’ll even begin with a song. As Waylon Jennings would have sung, while envisioning tasty holiday chili and Luckenbach, Texas, “…Maybe it’s time we got back to the basics of ... ESAs.” What? That’s in the song? Maybe not. But with all the internet detours (e.g. CertaPet, Service Dog Registry, The Notorious Dr. I’ll Say Anything, and countless others) it is easy to get carried away in song and lose focus on how to analyze an ESA situation. Time now to rein in the wandering and begin our Top Ten Basics.
Basic Number One: What Is an ESA? An ESA is an Emotional Support Animal. An ESA is a form of “assistance animal,” defined by HUD as an animal that works, provides assistance, or performs tasks for the benefit of a person with a disability, or provides emotional support that alleviates one or more identified symptoms or effects of a person’s disability. HUD (U. S. Department of Housing and Urban Development), the primary agency involved with housing discrimination, points out that “assistance animals” perform many disability-related functions. HUD notes these include, but are not limited to, guiding individuals who are blind or have low vision, alerting individuals who are deaf or hard of hearing to sounds, providing

protection or rescue assistance, pulling a wheelchair, fetching items, or alerting persons to impending seizures. In addition, HUD also tells us that “assistance animals” provide emotional support to persons with disabilities who have a disability-related need for such support. It is the latter part of the definition that leads this discussion to an ESA.
from the earlier paragraph, which are reserved for people who pay to live at the community. The publicly accessible areas of the leasing and management office permit the mailman, delivery personnel, salespeople, prospects, and applicants, none of whom are currently living at the community, to enter upon the premises.
Basic Number Two: Know the Law. People involved with residential rentals are primarily affected by two fair housing acts. There is a federal Fair Housing Act (FHA), codified at 42 U. S. Code 3601-3619, with penalties for violation at 42 U.S. Code 3631. There is also a Texas Fair Housing Act (TFHA), codified in Chapter 301 of the Texas Property Code. The TFHA “provides rights and remedies substantially equivalent to those granted under federal law.” It is recognized that the TFHA is “substantially similar” to the FHA. The FHA and the TFHA pertain to most areas and activities of an apartment community. That would mean the apartments themselves, the common areas, the amenities used by residents and occupants, and certain areas of the leasing and management office. There is another part of the community (that being the publicly accessible areas of the leasing and management office) governed by an additional statute (that being the ADA [Americans With Disabilities Act]). The ADA does not cover most of the areas and activities
Basic Number Three: Understand the Procedures. Consider this hypothetical scenario: You have an apartment community with certain animal restrictions. You permit animals, but no more than two in any apartment unit. You require an animal deposit to be paid for each animal. You also have restrictions on the maximum size of an animal and the type of animal permitted. The presence of every animal on your property is to be disclosed to management and approved by management. Approval is formal and takes the form of a completed and signed animal addendum. Continuing on with our hypothetical scenario, during a routine maintenance visit to an apartment, your staff discovers the presence of a previously undisclosed animal. You use the TAA lease; it provides in paragraph 27.1 that no animals are allowed, even temporarily, anywhere in the apartment or apartment community unless the owner/ manager has given written permission. In the hypothetical, you either speak with the resident, provide a
written lease violation notice, or both. The response you receive is, “That’s my ESA.” At that point in time, your understandable response could easily be, “So what?” Why? Because at that point in time, there has been no request for an accommodation to your policies, rules or procedures. Until that accommodation request is made, you have nothing but a lease violation (i.e. of TAA lease paragraph 27.1), and a flippant response (i.e. “That’s my ESA.”). Curiously, the FHA and the TFHA prohibit disability-based discrimination. Yet in our hypothetical, we have not heard a single word about disability. Our situation, therefore, has no context. Basic Number Four: The Term “Disability” Is Strictly Defined. The definition of disability involves two distinct inquiry prongs. First, is there a physical or mental impairment? Second, does that impairment substantially limit one or more major life activities? Both prongs must be present. Housing discrimination is not general. It is specific. We are not simply looking for a disability. We are seeking to determine whether the person making the accommodation request is a “person with a disability.” The categories of disability are somewhat general. For example, they can be mental or physical, intellectual or developmental, and may affect hearing, speech and vision. A disability can also be a stress disorder (e.g. PTSD) or a health impairment that requires special ambulatory devices or services. Once there is a person with a disability, discrimination against that person is prohibited. Persons with disabilities have the same right as persons without disabilities to the full use and enjoyment of a dwelling, whether owned or leased, in which persons reside. It can be the renter himself (resident) or any person associated with the renter (occupant or possibly frequent guest). Basic Number Five: Disability Is Only Half of the Inquiry. In addition to there being a person with a disability, there must also be a disability-related need before you can properly analyze an ESA
situation. The process needs to begin with an affirmative act on the part of the resident or applicant; they must request something from you. That person typically will want to have a particular animal on your property. They should, therefore, make a request for a reasonable accommodation, in which they will ask you to permit them to possess what they identify as an assistance animal in a dwelling. When this type of request is made to you, and you will be applying the FHA or TFHA rather than the ADA, you will be faced with two initial questions. Question One: Does the person seeking to use and live with the animal have a disability (that is, a physical or mental impairment that substantially limits one or more major life activities)? Question Two: Does the person making the request have a disability-related need for an assistance animal? In other words, according to HUD, does the animal for which your approval is being sought work, provide assistance, perform tasks or services for the benefit of a person with a disability, or provide emotional support that alleviates one or more of the identified symptoms or effects of a person’s existing disability? Basic Number Six: An Accommodation Must Be Requested. Previously, we considered a hypothetical situation in which a resident had been caught with an unauthorized animal. When confronted with that fact, the resident’s only reply was, “That’s my ESA.” That statement contained no request for an accommodation affecting your rules, also hypothetically set forth above. Hearing only the statement, “That’s my ESA,” fails to give you any facts enabling you to answer either of the two initial questions set forth above. You neither have facts to determine if the person has a disability, nor to determine if the person has a disability-related need for an assistance animal. That is why an understandable response to the comment, “That’s my ESA,” could be, “So what?” Basic Number Seven: Analyze the Accommodation Request. Assume hypothetically that you have received
a request along these lines: “I need the dog (“my ESA”) to live with me and I do not want to pay any fees, any deposits, or have any restrictions about what characteristics my animal can or cannot have.” Always begin your inquiry with the two initial questions: (1) does the person making the accommodation request have a disability? and (2) does the person making the accommodation request have a disability-related need for the ESA? If the answer to question one OR question two is NO, you are not required to change any of your policies or restrictions to accommodate the requesting party. If the answer to EITHER question is NO, moreover, the accommodation request may be legally denied. Consider a different scenario: When the answers to question one AND question two are YES, you will be required to change or provide an exception to your policies, procedures and restrictions. The result must be that you will permit the person with a disability to live with and use his or her ESA in all areas of the apartment community where people are normally allowed to go. Basic Number Seven: Ask Questions but Do So Very Carefully. How do you gather the information to answer the first question: whether the person has a disability or not? If the disability IS NOT readily apparent or known to the housing provider, the person claiming to have the disability may be asked to submit reliable documentation of a disability (as well as of their disability-related need for an assistance animal). On the other hand, if the disability IS readily apparent or known, but the disability-related need for the assistance animal is not, the housing provider may ask the individual to provide only documentation of the disability-related need for an assistance animal. You are within your rights to ask someone who is seeking a reasonable accommodation for an assistance animal to provide documentation from a professional in the medical or social services field. When the accommoda-

tion request made to you is for an assistance animal that provides emotional support, documentation may be requested from a physician, psychiatrist, social worker or other mental health professional. You may insist, within reason, that such documentation address how, (and conclude that), the animal provides emotional support that alleviates one or more of the identified symptoms or effects of an existing disability which the requesting individual currently suffers from. Documentation you receive generally will suffice if it establishes the particular individual has a disability, and the specific animal you are being asked to permit will provide disability-related assistance or emotional support to that person. The disability and the need must correspond; there must be a clear nexus between the two. That nexus will be lacking, for example, if the accommodation requests you to permit a German Shepherd “seeing-eye dog” for a person whose disability is PTSD. Here, the disability-related need (i.e. an animal to occasionally calm an agitated person and diffuse their anger) typically will not be met by the particular animal (i.e. whose skill and training permit it to guide a blind person in public and avoid danger). Basic Number Eight: Remember That Each Assistance Animal Must Uniquely Qualify. Requests for multiple ESAs are becoming more common for those seeking to avoid additional pet fees or breed and weight restrictions. Even though one ESA would accommodate the person with a disability and their specific disability-related need, the resident or applicant wants to include more than one animal. After all, if there is no animal deposit for an ESA, why not claim that all your animals are an ESA and save yourself multiple animal deposits?
There must be a separate analysis of each request for a specific assistance animal. If there are three dogs, for example, each of which the requesting party tells you are ESAs, you are entitled to know how and why each dog is needed as an ESA. Assume there are three dogs: Moe, Larry and Curly. Ask the question below three times, and in each question, insert a different dog name. Also, assume you have received a letter from a person held out as a medical professional. Further assume that you are writing to that professional with the requesting party’s permission. Here is the question for the “medical professional”: “How does Moe provide the specific assistance of the type you say is needed by John Doe [the person making the accommodation request] in your letter?” That same question would be asked for Larry and Curly as well. Next, assume the “medical professional” has rendered the opinion that John Doe is qualified to have an ESA. Here’s the question: “Your letter states that you have determined that John Doe is qualified to have an ESA. Please describe why the assistance Moe provides to John Doe is not adequate, in and of itself, making Larry and Curly also be needed before John Doe can receive the specific assistance you have concluded his condition requires.” Ask that same question about Larry and Curly and change the names of the other dogs so all three names appear in each question. Basic Number Nine: If the Request Will Be Directed to You, Do Not Make the Request Yourself. There are endless resources for a person with a disability in need of an assistance animal to determine what to do. Yet increasingly owners and managers are practically asking for the accommodation themselves. It is true that accommodation requests for assistance animals can be confusing and complex. Yet you rarely
will ensure an accurate and truthful accommodation request if you merely provide a form with simple questions, many of which can be answered by the party seeking the accommodation with a simple “yes” or “no” answer, or by placing a mark in a box. Let us return to the resident you caught with the unauthorized animal, whose flippant response was, “That’s my ESA.” If your knee-jerk response is, “In that case, come to the office and I will provide you with a form for you to complete to make your reasonable accommodation request,” you will have made a significant mistake. Likewise, many of these forms invite seemingly obvious answers that will practically compel you to agree to the accommodation request, whether that response is justified or not. You cannot allow the requesting party to be the one who establishes the existence of the disability and the disability-related need. Do not provide a form, therefore, enabling that. Remember Basic Number Seven! America faces a growing problem with assistance animals. The problem is the unlimited ability of a person, who would not meet the definition of disability, to simply purchase “certification paperwork and documentation” off the internet to create a fake ESA for a phony disability. Unscrupulous individuals have learned there are advantages to being characterized as a “person with a disability” in the context of fair housing. One advantage is with this characterization, they may be able to have their dog, regardless of breed, size or history, share their apartment with them. Not only that, if they carefully inject some free “buzzwords” relating to animals that serve disabled people into their communications with landlords, they not only may avoid paying an animal deposit but also even completing an animal addendum. It has become far too easy for a dishonest individual to get what they

want by having their animals impersonate service animals. In response, many disability organizations are pushing for legal changes that would make it more challenging to have an animal recognized as an actual assistance animal. Basic Number Ten: There Are Penalties for Assistance Animal Impersonators. In the Texas Human Resources Code, Section 121.006 addresses the criminal conduct of and potential penalties for people who lie about assistance animals. The statute provides that a person is guilty of misdemeanor if they use a service animal, with a harness or leash of the type commonly used by persons with disabilities who use trained animals, to represent that his or her animal is a specially trained service animal when training has not in fact been provided. On conviction, that misdemeanor shall be punished by a fine of not more than $300 plus 30 hours of community service that must be performed for a governmental entity or nonprofit organization that primarily
serves persons with visual impairments or other disabilities. That statute, while clearly focusing on people who have their dogs impersonate “seeing-eye dogs,” is a valiant beginning. Do not be surprised if, in the upcoming legislative session, new laws are sought to expand the scope of illegal service animal impersonation and make the penalties more severe. Conclusion. Despite its length, this article barely scratches the surface of the problems owners and managers of residential premises face from an increasing number of unscrupulous individuals who are frequently dishonest with their landlord about disabilities and assistance animals. With a minimum of effort and an affordable expenditure, these unscrupulous individuals can acquire the services of professional con-artists who will assist and enable them to abuse valid and necessary policies and practices pertaining to animals living in rental property. It truly is time we got back to the basics.

After a fall during the fourth quarter and a slight rebound in the first, the second quarter came in with a bang and retrieved all that was lost during those slow quarters. Occupancy gained nearly a full percentage point, which is twice that seen in typical second quarters, to reach 92.3%. Effective rental rates also had quite a showing with a 3% increase over the quarter, rising to $1.44 psf, or $1,235/mo. Absorption figures continued to climb, with 2,836 more occupied units during the quarter. Not only was absorption positive, but it outpaced new unit additions by 450 units. Annually, absorption figures are up 37% from this time last year. Currently, there are over 19,533 units in all property types, under construction throughout the Austin area. The second quarter saw the addition of 2,385 new conventional units, and the next two quarters are expected to see about the same. In addition to the current construction, there are over 24,760 more units proposed or in the permitting process. However, there are several hurdles for developers to overcome to make their projects come to fruition. Ongoing issues of rising labor and material costs have now been joined by an increase in interest rates and a tightened lending market. In addition, developers are now faced with rising land costs that prohibit some otherwise affordable developments. This has prompted new development to move east, while inner city areas embrace smaller projects. The number of sales increased over the quarter, with 18 properties changing hands. The heightened number of sales is expected to be a trend to continue through the remainder of the year. Expect next quarter to continue the positive trend seen thus far.
