O
ne of the first AAA supplier members I met was Doc Young. Doc would drop by our leasing office with his friendly smile and a good story every once in a while. Sometimes he’d talk a little about carpet; sometimes he’d talk about some AAA event going on. Most times we’d just shoot the bull. He was always a welcome visitor and I got to know him on a personal level. Now that I’m no longer working at a property, I really miss those impromptu visits from Doc and other suppliers who would drop by the property. I felt I really got to know them and become friends, not just business associates. When I was working on-site and first became involved in the Austin Apartment Association years ago, I quickly came to realize that I could depend on AAA supplier members to help me in my day-to-day business – especially those with whom I had a personal connection. While the Austin Apartment Association was formed with the basic purpose of advancing the rental housing industry, we need to recognize the huge impact and personal involvement our supplier member partners have within the industry and our association — from community outreach to every event AAA puts on. Yes, association involvement benefits their business, but we need to get to know our

Kudos to that supplier who helps out the Go-Getter committee; hooray to that supplier who picks up school supplies at a dozen properties for Operation K.I.S.S.; and a heartfelt thanks to that supplier who speaks to legislators at the Capitol on behalf of the multifamily housing industry — not on behalf of the carpet cleaning or valet trash industry, but the multifamily housing industry. Sometimes supplier involvement is obvious and sometimes it’s behind the scenes. Either way, get to know your suppliers and I guarantee that you’ll learn at least one of them plays a big part in the continued success of our association. Our association is getting ready to pull off two of the biggest events of the year: the Speakeasy Trade Show and the Doc and Gayle Young Food Drive, two events heavily influenced and driven by our supplier members. The annual trade show is a great chance to meet AAA supplier members face-to-face and learn about all the new and interesting
products and services these businesses have to offer. The food drive is a chance to see the heart and soul of our supplier members. Both events are superb opportunities to get to know your suppliers — not just to do business, but to foster friendships and strengthen your professional and personal network. In the thick of student turn or some emergency, it’s easy to pick up the phone or shoot an email to a supplier and expect a quick and efficient solution to a problem…whether it’s during working hours or three o’clock in the morning…on a Saturday…during Spring Break. And that’s the way it should be; it’s all part of the multi-family business for both the management and supplier sides. I can’t tell you how many times I hear, “the association is all about making connections,” and “I have made so many ‘forever friends’ through my association membership.” It’s just so much nicer when the voice on the other end of the line at 3:00 a.m. is a friend, and doing business with friends is a big part of what our association network is about.

Jeff spent most of his professional time in meetings with various City Councils and Board of Directors for large utility companies. However, we met Jeff at the Austin Apartment Association Doc & Gayle Young Food Drive where he had been volunteering and attending many events. We recognized his warm
and outgoing personality right away and was thrilled when he decided to join Camp as an Account Executive. Industry UPDATE AUSTIN’S STRATEGIC HOUSING PLAN DRAWS INDUSTRY COMMENTS By Paul Cauduro, AAA Director of Government Relations

he public discussion on the issue of housing affordability that is taking place in the Austin area is also taking place in many regions throughout the country. Top housing markets such as Denver, Nashville, Tenn., Richmond, Va., Portland, Ore., and, of course, San Francisco and Seattle, are exploring options, implementing programs and enacting policies aimed at maximizing the number of citizens paying at or below 30% of his or her income for gross housing costs. According to a white paper issued by the Real Estate Council of Austin, here in Austin half the city’s renters and 28 percent of homeowners spend more than the recommended 30 percent of their income on housing. The paper suggests that this issue has been simmering for years and that in last two decades the Austin market has gone from the least expensive to the most expensive among Texas’s four major metropolitan areas with average rents increasing 50 percent from 2004 to 2013 while median incomes rose by only nine percent. To address the issue the City of Austin has created its first-ever Strategic Housing Plan to help align resources, ensure a unified strategic direction and facilitate community partnerships to achieve a housing vision. The plan recommends new funding mechanisms, regulatory changes, and other creative approaches the City of Austin and community partners should utilize to achieve both market rate and affordable housing.
As stated in the city plan, Austin’s population is projected to grow by almost three percent per year, with 400,000 additional people expected to live in Austin by 2045 necessitating the production of 200,000 housing units over the next thirty years. The stated short term goal in the plan to meet the demand for housing calls for adding 75,000 new units with 35,000 of them being affordable and with 25 percent of those being family-friendly, meaning they have two or more bedrooms. For rental housing specifically, the plan recommends that City Council adopt a goal for each Austin ZIP code to have at least 10% of rental housing units that are affordable to households earning at or below 30% MFI or $24,300 or less for a four-person household in 2016. Both the long and short term goals of the plan will be achieved through new funding mechanisms, regulatory changes, and creative approaches, and, if the plan works as claimed, it will help prevent households from begin displaced and priced out of Austin, create new and affordable housing choices for all Austinites in all parts of town, foster equitable communities and even help Austinites reduce their transportation costs. At press time the Austin Apartment Association was preparing comments on this first ever plan issued by the city. The City Council is expected to discuss and adopt the plan in the weeks ahead. The AAA comments mostly focus on the wide variety of regulatory
changes and creative approaches identified in the document such as: land banking, housing preservation, density bonus programs, rental assistance and tax incentives. Some of these strategies are time-tested and work well in a wide variety of housing markets. Policies attached to tax credits, strategic infrastructure investments to help lure development and tax exemptions in exchange for guaranteeing unit affordability may be particularly helpful. While some of the strategies proposed may have merit, some, like rent control, inclusionary zoning and renewed efforts to roll-back recently passed legislation allowing landlords to deny a lease contract to a prospective tenant based on source of income, are untenable and would be an unfortunate diversion of city time and resources. The Texas Legislature has demonstrated a strong propensity to protect private property rights and it is not likely to adopt rent control and affordability mandates in the coming Legislative Session that begins in January 2017. The AAA comments regarding these strategies will focus on how legislative efforts are not bona fide housing strategies and should not be included in the Austin Strategic Housing Plan. In many respects, the most effective strategy to address housing affordability is to eliminate barriers and related red tape that impedes the construction of more units. As recently reported by the Austin American Statesman, there are almost 17,000 apartment units currently under construction that will grow the total number of units by 7.7%. This unit expansion is second only to Nashville, Tenn. This large pending influx of units, on top of the large influx of units that has come on the market in the last eighteen months, has caused a welcome slowdown in rent increases for area tenants. This rent slowdown, however slight it may seem, helps proves that infill development comprised of garage apartments, small apartment buildings and duplexes in all parts of town combined with traditional construction at a pace that keeps up with growing local demand are necessary to address affordability.

We are in such a fun, lively neighborhood with UT and Hyde Park right behind us.

AUSTIN APARTMENT ASSOCIATION What you need to know about Apartment PAC Austin and the Better Government Fund
Do you remember that time the Austin Apartment Association sued the City? It wasn’t too long ago the City of Austin tried to implement an ordinance that effectively compelled nearly all rental housing properties in Austin to honor housing choice vouchers and participate in the federal Housing Choice Voucher (Section 8) program, but AAA felt this was an overreaching burden on members and their ability to do business. So, we sued ‘em. Called the lawyers, signed the papers and sued ‘em. Sued the City of Austin. Got the Texas Apartment Association involved, too, and they took it up with Texas State Legislators, who passed a state law, nullifying the Austin ordinance.
Maybe you heard of it? SOI — Source of Income. Ring any bells? The actions taken by the Texas Legislature against Austin’s SOI ordinance was supported by a wide-range of apartment association leaders, members and staff who provided critical and timely information in support of private property rights and how federal housing programs are voluntary. The efforts taken by the apartment industry helped prevent a patchwork quilt of municipal regulations involving federal housing vouchers and protected owners and managers of rental units from unnecessary and unwarranted housing discrimination claims. Your membership dues in the Austin Apartment Association pay for a lot of different things, but lawyers are expensive and getting local, state and national policymakers elected — and keeping them informed — must come from another pot. The Austin Apartment Association established a general purpose political action committee (PAC) to have greater participation in the local and state political process. A general purpose PAC is devoted to a point

of view not a political party, and Apartment PAC Austin’s devoted point of view is: A free enterprise housing market works best when private property rights are honored and property owners and related housing service providers are able to offer dwelling units for rent and operate without burdensome taxes, regulations and fees. All contributions to Apartment PAC Austin are voluntary and all levels of contribution are welcome. The funds contributed to Apartment PAC Austin are distributed to candidates running for state, county and local office that share our pro-rental housing point of view. Apartment PAC Austin funds may also be used to support bond elections, ballot initiatives and similar efforts that can help improve the quality of life for residents in the Austin area.

By way of example, in the past year AAA has helped revoke mandates on property owners to participate in the Section 8 program, worked with city staff to draft a sensible parkland dedication ordinance and partnered with the Mayor in the effort to end veteran homelessness. AAA’s efforts will now be bolstered by the Better Government Fund (BGF). This fund is formed from voluntary contributions paid when joining or renewing your AAA membership. These contributions will be used to help facilitate positive change for the apartment industry. When research is needed to combat an important issue, when printed materials are needed to communicate critical information to the public, when an event needs to be held with elected officials or when items are needed to help raise funds for the AAA’s political action committee (APARTMENT PAC AUSTIN), the source of funding will be there for prudent use. Contributions to Apartment PAC Austin must come directly from an individual’s personal account, whether it’s the individual’s personal checking, credit card, or cash. No corporate funds can be accepted by Apartment PAC Austin. Often referred to as “hard money,” Apartment PAC Austin funds can be given directly candidates running for office under rules and regulations promulgated by the Texas Ethics Commission. On the other hand, BGF contributions are often referred to as “soft money” and can come from an individual or a corporation. Contributions to the BGF are not used to support candidate running for office but instead can be used to for a variety of purposes including activities to raise funds for Apartment PAC Austin. Through the BGF, members have a great way to make contributions in order to keep the advocacy efforts of the AAA moving forward. I can’t believe it is that time of year already. Time to gear up for the 2016 AAA Tradeshow.

As Vice President of AAA, the biggest task of the tradeshow, (actually my only task — or more accurately the only thing they would let me be in charge of ), is deciding on a theme that inspires everyone to take part and get involved. What to do? What to do? I have been bouncing ideas off everyone for the last six months and no theme really seemed to stick. And man did I have some great ideas! I still cannot figure out why some of these didn’t get approved: “Barbarians and Librarians!” “Rabbis and Rednecks!” “The Communist Party!” “The Wizard of Oz-tin!” And of course my favorite, “The Fightin’ Texas Aggie Maroon and White Celebration of All Things Gig’em Tradeshow!” Everyone could dress up as thumbs and farmers and we could let sheep run wild on the trade show floor. Exciting, right? I’m still not sure why this was voted down so quickly, and it took me a while to get out of a defeated funk afterwards. So what theme in the world would bring everyone together? Religion? No. Politics? No. What is something we all have in common? Where do I see and get to talk to members of the Austin Apartment Association in a fun, social setting? A bar! I see and meet lots of people at events, (at the bar), and if we are not at an event we are at a happy hour, (at the bar!). What do ALL of us have in common while hanging out at the bar? What is the one thread that binds us all? “Put it on Fowlers tab!” So I went back to the board and exclaimed, “I GOT IT!” Let’s call it the “2016 Put it on Fowlers Tab AAA Trade Show!” This…did not go over well. Now I truly was at a loss. I was stumped. I had passed through dozens of ideas and one after the other the board looked down and said, “Silly Aggie, these just won’t do!” These were dark times and I was at an all-time low…feeling blue…eating comfort food…erasing everything in my music playlist, saving only the Justin Bieber songs. I was close to giving up. I wasn’t sure whom to talk to or where to turn. The fear of being fired from my job as Tradeshow Theme Decider was overwhelming. I was now standing at the edge, wondering if this was really it and where would I go if I failed at the very FIRST task given to me? It was at that moment I called my psychic and after being on hold for what seemed like forever, she finally took my call and it was like a million thoughts were going through my head and they were all coming out at once. I was talking at a rapid pace, almost screaming into the phone about where I was,
how I was letting down my wife and daughter and how I would be a disappointment and outcast at work. When I finally stopped to take a breath, I heard a comforting voice, almost like it was from the heavens, or maybe from Dana Bolz that said, “Sam, my son, take a breath and speak easy.” What did she just say? Speak easy? Wow! That was it! Speak easy! SPEAKEASY! I had it. Suddenly I got another call and it was a client screaming at me that my bid was late and I better get my S*%T together or I would never work with them again. I called Kristan and she approved the trade show theme…right after telling me that this was the longest she ever had to wait for a theme idea and that I’d better get my S*%T together or I would never work with her again. So there you have it. The 2016 Speakeasy Trade Show! Now that the theme has been unveiled, we encourage everyone to participate, vendor exhibitors and owner/management company attendees alike! Vendors, you will be asked to participate by decorating your booths in the best Speakeasy theme you can muster and attendees, you are asked to attend the show in the best Speakeasy costume you can create. Both booths and costumes will be judged anonymously, and both categories
awarded just one “Best in Show” trophy — one for best vendor booth and one for best costume by an attendee. As usual, the Trade Show will be FREE to attend for all owner/ management company members and we ask that you register for the event as soon as you can so that we can plan accordingly for food and free beer. If you are a vendor member, please note you must have a booth in order to participate. If you have not purchased your booth, I highly recommend you do so today… the booths will definitely sell out! Use the show to investigate new tools and improved for your employees, and community enhancements for your residents. Let your budget be your trade show guide. Go into the show with your budget as a way to figure out which vendors you really must see. If you are looking for something or someone in particular, grab a trade show map and head to those booths first, then walk through the rest of the show. Bring business cards and I always make a list of upcoming projects so I make sure to see all the vendors that would possibly oversee my upcoming work. Be sure to bring your business cards. They are a great way to give an exhibitor your contact information for follow up calls, but also a great way to enter give away drawings at the individual booths.

Residents are increasingly connecting with properties online throughout all phases of the renting process, from research to retention. As a result, property managers need to be able to do their jobs online, and that requires them to have a certain amount of autonomy. Social media presents several opportunities for leasing, marketing and building relationships. However, it also presents many risks.

It’s natural for corporate management to want complete control over their properties’ online activity, as doing so would limit risk and maintain consistent brand messaging across all properties. However, this isn’t realistic. The key to success in digital marketing lies within the property managers—they’re the ones who know their residents better than anyone else. They live and work in the communities they serve, and they’re the ones interacting with residents on a daily basis. So how do we find a balance between brand consistency (corporate-level) and local content / personalized service

(property-level)? The answer is quite simple, actually. It just calls for a little training and education.

Successful training requires an earnest effort on the part of each property and its employees. Without their commitment, an effective digital marketing strategy is impossible to implement. It’s the property manager’s responsibility to consult their regional or national corporate representative anytime they have questions, feedback, or insight regarding social media use. Corporate management should serve as a resource for properties, and vice versa. Property managers should provide feedback on local marketing efforts (What works? What doesn’t?). They should also be able to ask corporate representatives for help in unfamiliar situations and provide them with insights from their resident community. Open communication is the key to balancing strong brand messaging on social media with local personality and service. any of you may be reeling from the curious title to this article. Don’t be. It’s football season at last, and Texans love their football. Have you ever heard the phrase “End Run”? According to Dictionary. com, this phrase has two meanings. In a football context, an End Run is a running play in which the ball carrier attempts to outflank the defensive end. In a non-football context, an End Run is an attempt to surmount a difficulty without confronting it directly. Stated another way, an End Run can be an evasive or diversionary maneuver. Our Texas Legislature, as of January 1, 2010, attempted an End Run when it enacted Section 92.254 (a-1) of the Texas Property Code. In that statutory provision, the Texas Legislature converted a fair housing Modification to an Accommodation. It did this in the context of a smoke alarm which is capable of alerting a hearing-impaired person in the bedrooms it serves — a visual rather than an audible smoke alarm. How did this occur? What is the significance of whether a visual smoke detector, which flashes lights instead of making sounds, is called a modification or an accommodation? The answer is simple. When a reasonable modification has been requested and approved, the resident who requested the modification typically pays for the acquisition and installation of items needed to complete the

If the landlord receives federal funds, it may be financially responsible for the modification, provided such financial obligation does not produce a great financial or administrative hardship. Given that a visual smoke detector could probably be obtained, installed and wired for less than $500.00, it is unlikely to cause the landlord a great financial hardship. If federal funds are not received by the landlord, however, the typical procedure is to have the disabled resident pay for the modification. When the handicapped resident requests a reasonable accommodation, the standard rule is that there will not be a charge for the accommodation. As the definitions below illustrate, an accommodation typically has little or no out-of-pocket costs. According to the Fair Housing Act, 42 U.S.C. Section 3604(f )(3), it shall be unlawful for any person to refuse to permit, at the expense of a handicapped person, reasonable modifications of existing premises, if the proposed modifications may be necessary to afford the handicapped person full enjoyment of the premises. The Fair Housing Act also addresses
reasonable accommodations, and states that it shall be unlawful for any person to refuse to make reasonable accommodations in rules, policies, practices, or services, when such accommodations may be necessary to afford a handicapped person equal opportunity to use and enjoy a dwelling unit. In an online publication by the National Association of the Deaf on the issue of housing discrimination, an example was given that deaf tenants are permitted to install visual doorbells. The National Association of the Deaf considered this a reasonable modification, and stated that the tenant must pay for such a modification. It went on to note that the landlord cannot forbid the tenant from installing the special equipment. Of significance here, however, is the analogy between a visual doorbell and a visual smoke detector. Arguably both would be considered modifications as opposed to accommodations, even under analysis by the National Association of the Deaf. In the State of Texas, however, an End Run was successfully accomplished as of January 1, 2010, converting a modification at the tenant’s expense into an accommodation.

Remember, a resident cannot be charged for a reasonable accommodation, so the expense of acquiring and installing the visual smoke alarm, typically a modification, fell upon the landlord. Score that a touchdown, six points for the resident. According to David Mintz, the Government Affairs Liaison for the Texas Apartment Association, the Property Code’s conversion of a visual smoke detector from a modification to an accommodation occurred in the context of Texas Senate Bill 1715. Mr. Mintz told me he testified in 2009 at Senate hearings on that bill. He stated that the Texas Apartment Association supported the bill, and recalled various compromises made with the bill’s sponsor. Sadly, the statutory language remains somewhat confusing, because it is silent about who must pay for the visual smoke alarm, either the landlord or the tenant. When reading Texas Property Code Section 92.254(a-1), one sees reference to “a reasonable accommodation for a person with a hearing-impairment disability” in the discussion about the visual smoke alarm. Stated another way, the legislature switched the burden of payment for acquiring and installing the visual smoke detector from the tenant to the landlord. By law, visual smoke detectors cannot be battery-operated. They are to be hardwired into the rental property’s electrical system. That fact, coupled with the unquestionable conclusion that installation of a piece of equipment constitutes a modification, shows that the Texas Legislature attempted, to quote Dictionary.com, “to surmount the difficulty without confronting it directly.” Keep in mind that the Fair Housing Act is a federal statute. It is to be applied in the same manner in all our states and territories. It is to have
predictability and clarity so that its enforcement will be fair, reasonable and absolute. Had the Texas Legislature wanted to surmount the issue of payment for the acquisition and installation of equipment in residential leased premises, to enable a handicapped person to have full enjoyment of the dwelling, they should have sought a change to the federal statutory language. That was not done. What resulted is a situation unique to Texas, which undermines the commonly
accepted practice that a private rental property owner, who does not benefit from government funds, does not have to pay for a disability-related modification of its premises. This author is not suggesting that hearing impaired individuals do not have the right to make modifications to their rented premises, in order to grant them equal opportunity to fully enjoy their living unit. The question is really
whether a state should be allowed to create new obligations under a federal law. In Texas, if we use Property Code Section 92.254(a-1) for precedence, the answer appears to be yes. In the online version of the Merriam-Webster Dictionary, a slightly different, yet very insightful definition of End Run is found. As with Dictionary. com, the definition has two parts. There is the football play, in which the ball carrier attempts to run wide around the end of the line. There is also the second meaning. The Merriam-Webster Dictionary provides that an End Run is also “an evasive trick or maneuver,” and provides as an example where one “made an end run around the regulations.” In the context of compassion and respect, it is a good thing to ensure that hearing impaired individuals are protected from the possibly dire consequences of a fire through the use of a smoke alarm which will likely get their attention. All apartments and rental properties protect individuals who have no hearing impairment by providing audible smoke alarms, so it is only fair that a hearing-impaired individual should be afforded the same protection, only with a non-audible alarm. This author has absolutely no problem with that concept, nor does he believe that owners of rental property would either. There is an undated article appearing on the Internet, written by Stefanie A. Lindquist and Frank B. Cross for the University of Texas School of Law. Their article focused on stability, predictability and the rule of law. They state, for example, that in the absence of stability and predictability in law, citizens have difficulty

managing their affairs effectively. They also state that legal stability has a moral valance insofar as it assures that like cases will be treated equally. They recognize, however, that the stability of precedent must sometimes be subverted in order to achieve other beneficial objectives. While greater legal stability is generally preferred, they say, absolute legal stability would produce a rigid legal paradigm impervious to changing societal norms and practices. Experience rather than logic, note Lindquist and Cross, vitalizes the law, and allows it to occasionally bend to changing circumstances. These are insightful comments. Perhaps they explain why the Texas Legislature felt that protecting hearing-impaired individuals from possible harm and loss of life in the event of fire requires the bending of absolute predictability in the law. The Texas Apartment Association, by supporting Texas Senate Bill 1715 in 2009, obviously agreed. This author agrees as well. In conclusion, know that Texas law now requires the landlord to pay for the acquisition and installation of one or more visual smoke detectors for a hearing-impaired resident when such a resident makes a disability-related request for such alarms. This is just one modification, among many, serving only one protected class, among many. Will there be additional state laws enacted which undermine federal law in the future? Perhaps so. After all, look at all the football rule changes we have to keep up with each new season! We must remember that the times, they are a changin’.
