An Abbott Liberal Government is considering a disallowance motion against the $1.2 billion funding pool for wages, according to written advice provided by the office of the Liberal Opposition spokesperson for ageing Senator Concetta Fierravanti-Wells. The additional $877.8 million was given to aged care employers with no requirement that it be spent on improving wages. When ANMF began enterprise negotiations in the private and not-forprofit aged care sector the following year not one employer said they could afford to pay “more competitive wages”.

Understanding qualifications allowance Liz Gliszczynski, Information Officer
The qualification allowance in its present form was introduced in the public sector via an enterprise bargaining agreement in 2000. Mental health, private hospital and aged care enterprise agreements followed suit. In 2006, the ANF ran a successful case in the Australian Industrial Relations Commission to have the Nurses (Local Government) Award varied to include the qualification allowance for nurses employed in local councils – primarily maternal and child health nurses and immunisation nurses.
I’m a registered nurse/ registered midwife. When am I entitled to a qualification allowance? Most registered nurses and registered midwives are entitled to a qualification allowance when a component of their postgraduate qualification relates to their current area of practice. To receive the allowance you must provide your employer with evidence of your postgraduate qualification and, if requested, demonstrate that a component of it is applicable to your work. If you hold more than one relevant postgraduate qualification, you are entitled the allowance for the highest qualification.
I’m an enrolled nurse working in the public sector. Why has my employer stopped paying me the 4% allowance that I used to receive for completing a medication administration course? The enrolled nurse structure was changed in the 2012 public sector nurses and midwives enterprise agreement to reflect the inclusion of medication administration in current courses leading to enrolled
nurse registration. An enrolled nurse who can administer medications is classified at level 2 with a pay rate at least 4 per cent more than an EN who cannot administer medications. A Nursing and Midwifery Board of Australia qualification to administer medications or a post-registration qualification in mental health nursing is among a number of criteria a psychiatric enrolled nurse (PEN) can use to advance to a level 2 psychiatric enrolled nurse. Nevertheless, a general enrolled nurse or a psychiatric enrolled nurse who has done a post-registration course of six months duration relevant to their work, other than a course leading to endorsement to administer medications, remains entitled to an additional qualification allowance. Previously you may not have had access to the sixmonth qualification allowance if you were receiving the medication allowance.

What about double degrees? The payment of a qualification allowance for a double degree varies according to the enterprise agreement relevant
to your workplace. For example, in the public sector the only pre-registration double degree recognised is the nursing/midwifery double degree. The Healthscope EBA recognises all double degrees, a four-year degree and an honours degree. Unless specifically mentioned a double degree is not considered a postgraduate qualification.
I’ve completed a direct-entry midwifery course. Why do the other midwives where I work receive a qualification allowance for their midwifery qualification but I do not? The qualification allowance cannot be FODLPHG IRU DQ HPSOR\HH·V EDVLF WUDLQLQJ A registered nurse who has completed a post-basic course such as midwifery, and uses a component of that course in their current area of practice, is entitled to the postgraduate midwifery allowance. A direct-entry midwife, similarly, must complete a postgraduate qualification to attract the allowance.
Will I get paid the allowance if I go on leave? Qualification allowances may be paid during leave dependent on the enterprise agreement. A common clause would allow for the payment on all leave except personal leave beyond 21 days and long service leave.
I work part time. How do I calculate how much I get paid for my qualification? Part-time and casual employees are paid the qualification allowance on a pro rata basis. The body responsible for the review of the enrolled nurse and nursing assistant qualifications has extended its deadline following an ANMF submission arguing further review should be paused until the completion of the current review of the Australian Nursing and Midwifery Accreditation Council (ANMAC) Competency Standards for the Enrolled Nurse. Enrolled nurses must meet these standards to be eligible to make an application to the Nursing and Midwifery Board of Australia for registration. The Community Services and Health Industry Skills Council has extended its review of the enrolled nurse qualifications and the community training packages from December 2014 to December 2015. ANMF will continue to represent members in these important reviews.

Negotiations between ANMF and prison operator GEO Care Australia began in the Fair Work Commission on 31 July and at the time of print were ongoing. The 19-month long negotiations had VWDOOHG RYHU PDQDJHPHQW¡V UHIXVDO WR QHJRWLDWH RQ WKH QXUVHV¡ FODLPV RQ WKH timing of the back pay and improvements to entitlements such as penalty rates which are currently well below health industry standards. The nurses had been participating in administrative bans and stop work meetings to demonstrate the depth of their concern about GEO undervaluing their work and contribution to the correctional system.
Managements at Eastern, Monash and Barwon health are yet to announce which campuses and wards will take part in a new health assistant in nursing pilot program. Victorian Health Minister David Davis announced the pilot in June. ANMF has written to Directors of Nursing seeking more details. Members meetings will be held at the affected campuses and wards when the pilot locations are announced. Meanwhile, ANMF was disappointed that a recent meeting of Australian health ministers decided not to regulate personal care workers and health assistants. Regulation was a recommendation of the Francis Report which investigated the substandard treatment of patients in two English hospitals. Regulation will require strong leadership from those who understand how it would improve patient safety.

The annual event provides executive members from each Special Interest Group an opportunity to exchange ideas and successes. ANMF (Vic Branch) Assistant Secretary Paul Gilbert outlined the new legal requirements governing registered organisations including trade unions and our Special Interest Groups. Significant amendments to the Fair Work (Registered Organisations) Act 2012 came into effect on 28 June this year and require changes to the rules and operation of registered organisations which include ANMF and its SIGs. ANMF aims to work with the SIGs to finalise any changes before the end of 2013. Mr Gilbert also emphasised the opportunities that this presented for SIGs to have greater access to ANMF resources, both human and financial.

ANMF (Vic Branch) mental health nurse membership increased by 290 per cent over the past five years. The rise reflects the increased ANMF dedicated mental health nursing resources focusing on the industrial, professional and health and safety issues of mental health nurses. This membership increase also coincided with the 2007 and 2011/12 mental health enterprise bargaining FDPSDLJQV ZKLFK KDYH LPSURYHG QXUVHV· working conditions and ability to provide safe client care, increased nursing positions and raised the profile of mental health nurses. ANMF continues to be a key mental health stakeholder and is included in local, statewide and national
consultations on issues such as the development of new Victorian mental health laws, workforce strategies and policy reforms. We have contributed to strategies to reduce restrictive patient interventions highlighting the need for adequate funding to ensure safe and sustainable implementation. ANMF continues to be a strong advocate for the extension of the Federal *RYHUQPHQW·V 0HQWDO +HDOWK 1XUVH Incentive Program and we successfully opposed the introduction of compulsory credentialing of mental health nurses for the purposes of MHNIP employment in Victoria.
