New developments in court case Managed by the same group that manages Costa Linda Beach Resort Nos Seguro N.V. thanked all the 3 foreign financial insti-
The Aruban Resort is back in operation tutions, the group of time-share owners and all others that contributed to the negotiations and he promised that a screening will take place in the future of those that would want to do business in Aruba. The agreement reached before the Judge entails that the Cooperative Association of Members will see to it to call a meeting before three weeks are over to elect a new board.
After the operational damage caused by the operators of The Arubian Resort, that affected further the employees and Aruba’s name, a tentative solution has been reached. The then operators of the resort left the island and also left a debt of 7 million dollars behind. In a press conference held in the morning of Tuesday, February 2nd Minister Otmar Oduber of Tourism informed that efforts are being done to reach the end of this week, the re-opening of The Arubian Resort. It was in court that certain commitments were reached to have the hotel become operational again. The first step is to sign an agreement with the Aruba Investment Bank and the timeshare owners in order to start the opening process. Minister Otmar Oduber expressed that he is very happy with this solution, because he did not want
the hotel to turn in something like the Bushiri Hotel that closed for a few days and those few days resulted in five years. Bushiri until today remained non-operational. A management team will start operating the hotel, and after that they will open the casino and to start the process of looking for a buyer of good reputation to take over. At the same time a public meeting has been requested for coming Monday, where the Government will present the agreement that has been reached. In the agreement lies the guarantee of salary for all employees and also the guarantee for the resort to open its doors again. The amount involved is 750 thousand Aruban florins. This is nothing compared to the 20 million that the resorts generates per year. Minister Oduber
Also it is imposed three levels of merit before making use of the Government guarantee money. The loan at the AIB Bank will be covered by the hotel operation and if that is not enough, the owners of the time-share weeks agreed to dispose the maintenance fee in an escrow account managed by the AIB. The Maintenance Fee money is about 2 million dollars. The same owners will remain responsible for their property and by the 4th level merit; the use of the Government guaranteed money can be considered. Thus the biggest risk for the Government is 320.000 dollar. The Management Team taking over the management of the resort is the same one that is managing Costa Linda and it manages 10 other companies around the world. The Royal Resort, which has a good reputation, will manage the Resort until the owners in the US get a buyer. And the management company is able to continue managing the resort if the new owners desire to do so. Only 90 employees from the 110 will be taken in service of the resort.
Rough waters caused damage to boat as per Hadicurari Tuesday, the Center for Fishing, Hadicurari, was informed of boat in problems. The boat was anchored at the pier at Brisas Del Mar in Savaneta. A soon as they noticed what was happening, the members of the center looked for information on who is the owner of Lincemar. After searching for the owner, they finally found the boat named Lincemar to belong to Marcelino Croes. Hadicurari Center was informed by the owner that the strings were cut and consequently the boat was hitting the pier. Due to the rough seawater, the boat continually hit the big rocks, got damaged and filled with water. After this, the boat went
down. In the morning, the owner tried to empty the water with a buck, but was not successful and the boat got holes while the ocean remained rough. The boat was practically gone. The personnel of the Hadicurari Center teamed up and came up with a plan to help the owner of the damaged boat. Besides the team many other people were involved and also the employees of the Santa Rosa DLV V (government agriculturefisheries and husbandries department) and Serlimar. Repairs started on the boat. Hadicurari team thanks all those involved in extending a helping hand.
The company’s lawyer reacts
Around midday, Dr. Geoffrey Wever, attorney-at-Law, in representation of his client Nos Seguro N.V. informs the press that they will appeal on the seizing of the company’s bank accounts. He informed that his client would have much difficulty in continue doing business with the frozen accounts. He furthermore informed that some points in this case are in dispute. In said case, the claim made by the Aruba Security & Crime Prevention N.V. on the cancellation notice is not completely true. As per Dr. Geoffrey Wever, the AS&CP claimed that the company is insured for 800 thousand guilders, but in court the insured amount is much less. He also informed that the company was advised by the broker, but the ultimate responsibility of informing about the cancellation lies with the insurer. In this case the insurer is Nagico. The lawyer claims that his client informed the AS&CP was informed by a letter, but the security company claims never receiving the letter. Dr. Wever’s informed that AS&CP was even discussing with his client the possibility of changing insurance company. They were advised and discussions were taking place in regards to changing insurance company. The security company’s policy was coming to an end in June 2008. There are many details and points that need to be looked into again and the reaction by the lawyer is to appeal on frozen bank accounts of his client. He trusts to solve the matter of his client’s bank account and the overall case soon.
