An attorney, Gary Jander was assigned by then-president of Hidden Valley Kiwanis, Fred Wollman, as investigator of charges against Mr. Geary. Mr. Jander is a former Governor of Cal-Nev-Ha. He investigated the charges and agreed that Dave Geary was guilty of “conduct unbecoming a Kiwanian.”
2016-2017. I have come to know and love many of my fellow Kiwanians.
But there is a tarnish developing within Kiwanis. A bit of a cancer within anotherwise great organization. A few bad apples within Kiwanis could conceivably put Kiwanis out of the public service business. That would be a terrible shame. But it may be happening right here in San Diego County. There are those men who seem
to enjoy intimidating others. Particularly if they are women.
There are those who suggest that Dave Geary is such a man.
Dave Geary owns a computer sales and repair store in Escondido, California, is a retired Air Force veteran, and a long time member of Kiwanis. Kiwanis is a great organization but it’s having some internal problems that appear to be growing to an unmanageable state.
Now the attorneys and courts are involved. It didn’t have to be this way.
But Dave Geary apparently felt the need to try to intimidate yet another woman. It appears he picked the wrong woman.
He attempted to intimidate Evelyn L. Madison, associate publisher of The Paper. Initially, he succeeded. He frightened her, big time.

But Evelyn does not intimidate easily. She fought back.
In the course of her investigation she found that apparently Mr. Geary had a consistent record of intimidating other women. He had a number of domestic violence complaints filed against him involving a former wife, a former girl friend, and a family member. There is evidence he continued his intimidation against women by harassing Lori Butler, his successor as Lieutenant Governor for (Kiwanis) Division 37, Cal-Nev-Ha. (California - Nevada - Hawaii) During her tenure she complains that Geary shouted at her, berated her in front of her peers and subordinates, and threatened her. She claims she feared for her personal safety on several occasions when confronted by Mr. Geary. As did Mrs. Madison.

Tim Cunning, then Region 2 Trustee, launched an investigation and found the charges to not only be valid but uncovered numerous other complaints against Geary and his management style of bullying and intimidations by other Kiwanis Clubs throughout North San Diego County. Came the day for election to the Trustee position. Geary was told he he had two options. He could run for election but the voters would be told of the many complaints against him prior to the votes being cast, or he could choose to withdraw and the matter would be closed. The electors would not be told of the complaints against him. Geary and Kiwanis mutually agreed to keep the reason for his withdrawal confidential and that Geary would not contact any individual who had filed a complaint against him. Geary withdrew from the election.
Geary apparently broke that pledge within 24 hours, contacting many North County Kiwanians and complained he was the subject of a political attack and had not made the statements attributed to him. Several week earlier to the elec-
tion Geary had stormed onto Evelyn Madison’s property, unannounced, uninvited, and yelled at her, demanding that she retract anything she had said. At first, Ms. Madison didn’t know what he was talking about.
Geary, being from Boston, has a very heavy Boston accent and when he’s upset or excited, talks fast. When he talks fast it’s next to impossible to understand what he is saying. When Madison finally understood what Geary was saying she held her ground, refusing to back down. Unknown to Madison, Geary was tape recording the entire conversation. In California it is illegal to tape a conversation without the full knowledge and consent of the person being taped.
Geary then allegedly made contact with many Kiwanians stating that Evelyn Madison had recanted, claimed that individuals at the Hidden Valley Kiwanis Club had not confirmed he had made the statements attributed to him.

Then-president, Fred Wollman, called a meeting in his office in late March, to try to defuse the situation. Dave Geary was ordered to play the tape recording. He played a brief portion in which Evelyn Madison said, “I don’t know,” and Geary turned off the tape recorder and said “see, she acknowledges she didn’t know the situation.” Geary was ordered to let the remainder of the tape recording play and, sure enough, Evelyn confirmed there had, indeed, been complaints filed at the Hidden Valley Kiwanis Club and that several witnesses heard him make the insulting, racist remarks about his competitor

On July 17, 2017, an executive board meeting was held by the Hidden Valley Kiwanis Club board of directors at which charges against Geary were heard. The report by Attorney/Investigator Gary Jander finding Geary guilty of conduct unbecoming a Kiwanian was heard. A subsequent exeutive hearing was held on August 8, 2017 at which all complainants and Geary were heard. The board did not vote on the claim - the Geary did something illegal; they only voted and determined that Geary’s actions of intimidation against Ms. Madison was inappropriate and unacceptable. He was told to apologize to Ms. Madison but Ms. Madison did not receive an apology.
What is significant about this meeting is that three board members should have recused themselves from voting as they had a clear conflict of interest. Evelyn Madison’s attorney, Anthony Abbott, of San Marcos, offered Geary an opportunity to avoid a law suit by agreeting to a cease and desist order. He did not respond within the 30 days allocated so Evelyn Madison, to protect herself and her rights, then filed suit against Dave Geary, the Hidden Valley Kiwanis Club of Escondido, and Kiwanis International. A search of court records revealed that Geary has a history of intimidation tactics against women. In one case, (Bissett vs Geary, DVN 13926, 9/03/2008) Domestic Violence was charged by Angela P. Bissett, then living in Rancho Bernardo, now living in Rancho Santa Fe. In this complaint Bissett complained that Geary had used her credit cards, without her consent, and had also abused her physically, pushing her into a chair, and threatening

The National Council on Aging encourages events like this to raise awareness about how to prevent fall-related injuries among older adults. In another Domestic Violence complaint Geary’s former wife, Justine N. Geary, (Geary vs Geary, DN 150130 DGB) complained that he had verbally and physically abused her and sought a restraining order against him.
Lori Butler, former Lt. Governor for Division 37, CalNev-Ha, past president of Vista Kiwanis had similar complaints of intimidation and sought out the court records cited above.
When asked why she retrieved court documents showing a series of Domestic Violence charges against Geary: “(He) had been threatening me in all kinds of fashions. And I was very frightened and felt that this was a pattern of behavior part of his personality, and I wanted to see how scared I should be. When asked when Geary threatened her, she said: “Constantly.”

The Paper • Page 4 • December 13, 2018 Suspected Wrong-Way Bicyclist Involved in Serious Injury Traffic Collision
On December 7, at 6 A.M., officers from the City of Carlsbad Police Department responded to a report of a bicyclist that had collided with a vehicle on El Camino Real near Palomar Airport Road. Arriving 0fficers found a 58-year-old male bicyclist lying in the roadway.
The Carlsbad Fire Department responded and transported the bicyclist to a local hospital where he is being treated for his injuries. The preliminary investigation suggests that the bicyclist was riding northbound in the southbound lanes of El Camino Real just south of Palomar Airport Road when the collision occurred. Alcohol is not believed to be a contributing factor in the collision. The 31 year old driver of the vehicle remained at the scene.
The investigation into the cause of the collision is ongoing.
It is important to remind bicyclists of the rules of the road, always riding in the same direction of travel. Also, the importance of visibility during hours of darkness. Final Local Election Results
The Registrar of Voters show Paul “Mac” McNamara defeating two-time
incumbent Escondido Mayor Sam Abed by 1,544 votes.
MacNamara received 21,183 votes (51.89 percent of the total) to Abed’s 19,639 votes (48.11 percent).
Many have theorized that an increase in the Latino vote in the city played heavily into Abed’s defeat.
In the City Council District 1 race, incumbent Ed Gallo was trounced by challenger Consuelo Martinez, who received 65.18 percent of the vote: 3,692 for Martinez, 1,972 for Gallo.

McNamara, Martinez and incumbent John Masson, who comfortably won re-election in his District 2 race by receiving just over 50 percent of the vote in a three-way contest, were sworn in last night (Wednesday). Abed and Gallo say they will attend the meeting and offer some closing thoughts before stepping down.
McNamara and Martinez will join Councilwoman Olga Diaz in what appears to be a new Democratic majority on a council that has been controlled by conservative Republicans for close to 20 years. McNamara, 65, a retired Marine Corps colonel, considers himself to be a moderate Democrat.

The incident was reported about 12:15 a.m. Saturday, Oceanside police Officer Nick Nunez said.
The skipper had left Santa Catalina Island and was headed home to a marina in Dana Point in Orange County late Friday, but his navigation equipment went out sometime during the journey. He decided to head for Oceanside, which he believed he could get to without instruments, Nunez said.

Changing of the Guard: Well, we have a new Mayor in several cities of North County. In Escondido, retired Marine Colonel Paul McNamara beat out long time Mayor Sam Abed by a surprisingly large margin. We had actually predicted that Sam would win, given his large plurality in the last Mayor’s race against Olga Diaz. He was, and is, a good campaigner, out walking the precincts, excellent at holding Town Hall meetings. I am not a big fan of the Escondido Christmas parade and it would not cause even one salty tear to flow down my cheek if it were to be canceled altogether.

He had actually called her business partner, Lyle, all kinds of vile names in front of myself and two other Kiwanians that were trying to counsel him that his behavior was not befittng of a Kiwanian.

trustee. --- “And the language again was, his face was bright red, threatening me, threatening Tim, threatening all of us, and he was going to -- he called Lyle all kinds of - I was in the process of explaining to him that that’s not how we talk about fellow Kiwanians and he called him a blankety-blank backstabber.”
When asked why did one of the pages of a court document seeking a Temporary Restraining order frighten you? Ms. Butler said: “Because it said, ‘He began pushing me around. He shoved me down in a chair and held me down. He threatened to kill me. He also threatened to destroy my car. I was able to free myself by kicking him.” When I gave the paperwork to Evelyn (Madison) I said, ‘You know, I would encourage you to read the pages where it talks about violence, because I am frightened for you.’ When I heard that Mr. Geary had come over to her home unannounced and I was one of the first people she called - she was - she was frightened and scared. And she called me, not knowing that Mr. Geary had been doing these things to me. She just called me because I was the current Lieutenant Governor, and she was the person who had filed the complaint--one of the many people who had called me during the election for trustee to state that they had some issues with Mr. Geary’s behavior. There was--it wasn’t just Evelyn; there was a list of people.”

When asked about Geary’s confrontation with Ms. Madison, she said: “I can remember she was crying and I’ve never seen Evelyn Madison really cry and sob like that, except maybe a little bit when we’d lose someone in Kiwanis that she cared about. But she was scared and frightened.”
Asked if Evelyn Madison told her Geary had raised his voice and was yelling during the conversation, Ms. Butler said, ‘Absolutely. I don’t--I don’t know any other way Mr Geary speaks. He’s very very very loud and he’s very, very intimidating. I’ve never had a conversation with him where his voice was not elevated and loud.” My club, Kiwanis--the KYDs Club of Kiwanis, had charges against Mr. Geary for conduct unbecoming, and we found him guilty and removed him from office. The independent counsel (investigator) makes the recommendation and the club chooses to remove the person.
The basis for Mr. Geary having been found guilty of conduct ounbecoming of a Kiwanian? “Same thing, His rude-rude, anger his rudeness, his anger, not showing up for meetings when he was the president. I-I don’t know. I wasn’t on the board of the club. I was only a member.”

A meeting was held with Trustee Candidate Geary on March 16th, 2017. The attendees were Candidate Geary, Lieutenant Governor Folsom, Chairman Cunning. Also present was Lieutenant Governor Butler via telephone. Earlier in the day, candidate Geary had repeatedly made oral and written denials of the allegations. From the very first, he said they were false. The panel had questions for Dave and offered him an opportunity to address them and explain his conduct. While Dave denied the allegations, his credibility became an issue as he contradicted himself, accused others of lying and resorted to name calling. One instance of credibility became an issue when Lieutenant Governor Butler shared something that a member from another club told her that Dave said. Dave denied saying it and called that member a liar. Chairman Cunning contacted this member after our meeting with Dave and member confirmed Lieutenant Governor Butler’s statement.”
Then at the bottom of that same page, it says, “Recommendation. The panel considered the investigative results, the statemetns of the witnesses, the emails exchanged, the candidate’s own conduct and admissions, and what appeared to be unethical behavior beyond the precise violation. Chairman Cunning, Lieutenant Governor Folsom, Lieutenant Governor Butler agree a campaign violation of CNH Policy 501.2 (e) did, in fact, take place. Further, the totality of Candidate Geary’s behavior during the campaign and admissions to the panel justify our findings that the Candidate has violated CNH Policy Section 501, as well. As such, we find the CNH Region 2 District Trustee Candidate David Geary has disqualified himself from candidacy and therefore request the he submit his withdrawal of candidacy from this Region 2 District Trustee race.” Follow-up questions to Mr. Cunning: Was Geary given the option to withdraw from the Region 2 Trustee Election? Cunning; Yes.
Did he agree to pledge confidentiality as to the withdrawal and reason for same? Cunning: Yes

How would you describe Geary’s management style? Cunning: Abrasive. He often raised his voice. He was also abrasive when he served as President of Hidden Valley Kiwanis Club of Escondido, and, later, as Lieutenant Governor.
Cunning confirmed that Geary was found guilty of conduct unbecoming a Kiwanian by the KYDS Club of Escondido. He had received two votes of “no confidence” in him as president. The club then began the process of vacating the office. Prior to the hearing, Geary resigned. Cunning found Geary “deceitful and untrustworthy.”
What of the other two parties in the dispute? The Hidden Valley Kiwanis Club of Escondido and Kiwanis International.
Evelyn Madison complained against them because she claims that (a) Hidden Valley Kiwanis Club of Escondido and its then president, Fred Wollman, failed to follow prescribed rules and regulations for when official complaints are followed - that they failed to keep the complaint confidential until after an investigation was completed, and also neglected to demand absention from voting from three members who had a clear conflict of interest, and, (b) in the case of Kiwanis International, for failure to follow its established rules and regulations for handling disputes and complaints, and (c) for failing to notify all clubs with Division 37 of Dave Geary having been found guilty of “conduct unbecoming a Kiwanian” as they are required to do. (This rule presumably is so other clubs would be forewarned to not accept for membership anyone with this finding within their background check.) Evelyn Madison:
And what of Evelyn Madison, the injured party in this story?
While she has not seen professional help for emotional distress and depression, she has, she says, suffered from both. She complains of difficulty sleeping, of disappointment in her long-time fellow Kiwanians not offering her more support, and disillusionment with the ethics and morality of both Hidden Valley Kiwanis and Kiwanis International. Back At It
Last week we returned to the Capitol where I joined Assembly Speaker Anthony Rendon to welcome our colleagues for a brief and mostly ceremonial session to begin the 2019-2020 legislative session. We have now adjourned for the holidays, but will return January 7th when the new session really begins.
The previous day, Governor Brown held a reception at the old Leland Stanford Mansion for new and returning members. Since his historic last term will soon be ending, I’d like to take this opportunity to congratulate the Governor for his public service. Governor Brown has served as California’s chief executive for 4 terms -- 16 years, and has the distinction of being the state’s youngest and oldest Governor. While we have not always agreed on some issues, he took his responsibility to manage the state’s affairs seriously, and often restrained some of the more extravagant proposals presented by the Legislature. And over the past 6 years, he signed dozens of my bills, proving that bipartisanship still lives in Sacramento. Before the swearing-in ceremonies,

It was passed around and often read aloud in taverns, contributing significantly to spreading the idea of republicanism, bolstering enthusiasm for separation from Britain, and encouraging recruitment for the Continental Army.
The Nearly Forgotten Founding Father
Not all of our so-called “Founding Fathers” sat in Independence Hall or rode with Washington in battle. British-born Thomas Paine armed himself with a pen and wrote two of the most influential papers to help fuel the American Revolution.
Paine, born Feb. 9, 1737, was an American political activist, philosopher, political theorist, authoring the influential pamphlets at the start of the American Revolution: Common Sense and The American Crisis, inspiring patriots to declare independence from Britain.
Born in Thetford in the English county of Norfolk, Paine migrated to the British American colonies in 1774 with the help of Benjamin Franklin, arriving just in time to participate in the American Revolution. Virtually every rebel read (or listened to a reading of) his powerful pamphlet Common Sense (1776), proportionally the all-time best-selling American title, which crystallized the rebellious demand for independence from Great Britain. Paine’s The American Crisis (1776–1783) was a pro-revolutionary pamphlet series. Common Sense was so influential that John Adams said: "Without the pen of the author of Common Sense, the sword of Washington would have been raised in vain.” Paine's work, which advocated the right of the people to overthrow their government, was duly targeted by the British, issuing a writ for his arrest in early 1792. Paine fled to France in September where, rather immediately and despite not being able to speak French, he was elected to the French National Convention. But, in December 1793, he was arrested and taken to Luxembourg Prison in Paris. While in prison, he continued to work on The Age of Reason (1793-1794). Future In November 1794, U.S. President James Monroe used his diplomatic connections to get Paine released. Paine became notorious because of his pamphlets. He argued against institutionalized religion in general and Christian doctrine in particular. He published the pamphlet Agrarian Justice (1797), discussing the origins of property and introduced the concept of a guaranteedminimum income. During the course of the American Revolution, a total of about
Common Sense was immensely popular in disseminating to a very wide audience ideas that were already in use among the elite who comprised Congress and the leadership cadre of the emerging nation, who rarely cited Paine's arguments in their public calls for independence. Some American revolutionaries objected to Common Sense. Late in life John Adams called it a "crapulous mass.” Adams disagreed with the type of radical democracy promoted by Paine (that men who did not own property should still be allowed to vote and hold public office). Adams published Thoughts on Government in 1776 to advocate a more conservative approach to republicanism.
In late 1776, Paine published his second pamphlet, The American Crisis to inspire Americans in their battles against the British army. General Washington had The American Crisis read aloud to them. It begins:
“These are the times that try men's souls: The summer soldier and the sunshine patriot will, in this crisis, shrink from the service of their country; but he that stands it now, deserves the love and thanks of man and woman. Tyranny, like Hell, is not easily conquered; yet we have this consolation with us, that the harder the conflict, the more glorious the triumph…” In 1802, he returned to the U.S. where he died on June 8, 1809, in more or less obscurity. Only six people attended his funeral as he had been ostracized for his ridicule of Christianity. Paine’s writing has endured through the ages as bricks in the foundation of democracy. At the time of his death, most U.S. newspapers reprinted the obituary notice from the New York Evening Post that was, in turn, quoting from The American Citizen: "He had lived long, did some good, and much harm.” He was buried under a walnut tree on his farm near New York City.

Volunteers of America Southwest Has New Resource/Recovery Center Location – A nonprofit, faith-based organization with a mission to change the lives of vulnerable individuals by providing services and tools to improve their quality of life, Volunteers of America Southwest, recently held a ribbon cutting for its new 10,000 sq. ft. Resource and Recovery Center location. The Center is located at 4525 Mission Gorge Place, San Diego, 92120. The Volunteers of America organization operates more than 20 programs in five counties, including San Diego county. The Resource and Recovery Center will serve approximately 500 individuals annually from Volunteers of America Southwest’s Renaissance Treatment Center (RTC), a substance abuse addiction treatment program. Clients currently in RTC treatment or who have recently completed treatment and opt to continue their recovery will find support at the Resource and Recovery Center. $2 Million Donation from Darlene Marcos Shiley to Academy of Our Lady of Peace – The oldest high school and only all girls’ school in San Diego county, Academy of Our Lady of Peace (OLP) has received a $2 million donation from Darlene Marcos Shiley. This is the largest cash gift ever received by OLP. The funds will be used for the renovation and reconstruction of an academic building which will be named the Shiley Center for Science and Innovation. The building will feature a 1,500-square-foot engineering makerspace and innovation lab that will engage students in creative higher-order problem solving, hands-on design and construction in engineering and robotics classes. The new facility will include five fullyoutfitted multidisciplinary science labs that will accommodate 150 students at any one time. “We are so deeply honored and humbled by Darlene’s generosity,” said Dr. Lauren Lek Head of OLP School. “The new Shiley Center for Science and Innovation will stand as an enduring tribute to Darlene for her support of science, technology, education, and math (STEM). We are blessed to have her in our community.”
At OLP, STEM engages students in integrated learning as they explore the world around them, create innovative solutions to problems and communicate their results. The proof is in their numbers, with 100% of OLP graduates going on to pursue higher education. OLP’s curriculum includes access to more than 53 classes in STEM disciplines and more than 30 Advanced Placement and Honors courses. In 2015 the Academy of Our Lady of Peace created the STEM certification program to recognize students for their achievements and involvement in STEM-related activities. Why do Christians go to so much trouble to decorate for Christmas? Because every decoration points to a portion of the miracle of Jesus’ birth. The Christmas Tree is an evergreen, because Jesus came to bring everlasting life (John 3:16). It’s decorated with lights because Jesus came to bring light to the world (John 1:5). It’s branches run perpendicular to its trunk to remind us that the story climaxes on Easter, with Jesus dying in our place on a Cross. We put gifts under the tree to remind us that “God so loved the world that He gave…” The Candy Cane: in 1844 by a Christian candymaker wanted to

After serving the San Marcos City Council for the past 14 years, I officially signed off as your Mayor and welcomed incoming Mayor-elect Rebecca Jones along with council members Randy Walton and Maria Nuñez on Tuesday, Dec. 11. Serving as your Mayor for more than a decade has been an honor. It is with a tremendous pride that I, and your city council, made decisions based on your community values to set San Marcos’s foundation for tomorrow.
Our great city is a rising star. We are the safest city in North County and have gone from 25 to 37 parks in just ten years. As North County’s education hub, our world-class educational institutions are creating a talented workforce—a pipeline for regional talent capable of keeping and attracting high-paying jobs and industry to our region.
In fact, there are 25 percent more businesses than a decade ago; these businesses are offering more than 40,000 local jobs. Our housing stock is up with more diverse housing opportunities for young families and professionals.
During my tenure as Mayor, every decision that the City Council has made focused on how we can leverage your hard-earned tax dollars to work for you— create revenue without raising taxes to continue offering services that provide for an exceptional quality of life. At the same time, we never spent more money than what the city earned and kept reserves strong. Senior residents are an important part of Vista’s v o l u n t e e r community, with hundreds of seniors donating their time to make a difference each year.
Two departments, currently in need of senior volunteers are the Vista Fire Department and the Vista Sheriff’s Station.
Vista Fire senior volunteers help with dayto-day administrative services; fire prevention education; conducting station tours, assisting with the Smoke Alarm program; and providing support such as hydration and food to firefighters at fires
and other extended emergency incidents.

Last week we likened The Computer Factory to Duffy’s Tavern. This week we’re a Blacksmith Shop. For centuries, up until the mid 1900s, the blacksmith was the most important and respected craftsman in the community. There was one in every crossroads community. They didn’t just shoe horses; they designed, forged and repaired the tools and equipment that made modern society run. They created the industrial revolution. They represented the pinnacle of practical technology. Then advances in automation, communication, transportation and standard-

At The Computer Factory we often find ourselves “shoeing horses.” Not of course in a literal sense. Our horses are the computers that have long been considered irrelevant and obsolete but for some reason still fill an important need for their user. Twelve years ago Microsoft put Windows XP out to pasture yet today there are still between 120 million and 140 million XP PCs still in use around the world. Many are “imbed” computers that run things like ATMs or Casino gaming machines, but there are still a fair number of XP users out there. Folks use them for “off line” tasks like playing CD/DVDs, writing and playing games. Businesses use them for contact management, financial or CNC (controllers) programs that run only in XP. Many businesses have an old XP machine somewhere that prints labels, asset tags or provides some other useful function. Often the useful application is discontinued or incompatible with more modern systems. Replacing a system that works well would be unnecessary and expensive but what if the computer
breaks? Best Buy, Staples or Fry’s can’t fix it. That’s when you bring to us, the “blacksmith.” We keep an inventory of Windows XP desktop and notebook PCs ready to go. We also have the parts and knowledge to repair most DOS and old Windows PCs.

It ran an irreplaceable software program essential to his business. He also brought in an identical computer from storage that had failed several years before. an assessment district that the merchants pay into. Officials expressed concern that the body wasn’t living up to the responsibilities it was tasked with, including planning community events downtown.
The final straw for the City Council came at Tuesday’s meeting, when representatives of the business association were scheduled to provide a presentation on their activities and accomplishments, but no one showed up. That persuaded council members that the business association was in over its head managing the assessment fees.
The business association has been in operation since the late 1980s, Ham said, and merchants have paid into the assessment district since the 1990s.
Over the years, the city assessment fees have been managed alternately by the city and the business association. For the past three years, the city has contracted with the business association to handle the funds, but council members ultimately decided to pull the plug on the contract for the current fiscal year. The downtown assessment district raises $53,000 per year from 283 businesses in the area along Vista Village
