Convictions of man who shot at APD reversed BY CARLA NOAH STUTSMAN A man serving time in the Texas penitentiary after being convicted of assaulting a public servant with a vehicle, assaulting a public servant with a shotgun, evading arrest with a vehicle, and deadly conduct will get a new trial. John Berry Isbell, now 55, of Haltom City, was sentenced to 20 years

for the evading charge; 20 years for the deadly conduct charge; and 45 years for each of the assault charges on March 26, 2014. Exactly one year later, a three-judge panel from the Texas Second Court of Appeals issued a memorandum opinion reversing the trial court’s judgment and remanding the case(s) for a new trial(s).

According to Azle Detective Sgt. Kevin Rogers, police were dispatched to an alarm call shortly after 11 p.m. March 24, at The Juice Joint Vape Shop in the 500 block of North Stewart Street. When they arrived, police found the front glass of the store had been busted out and was lying on the sidewalk in front of the store. Burglars ID’d via social media

two men climbing over a sofa to get into the store and then running back out, tripping over the sofa and tumbling onto the ground. Both men then ran toward Chicken Express. The owner of the store posted the video on his Facebook page, and obtained information about the identities of the two burglars as a result. Also through social media, police learned that words similar to those “tagged” on the side of a local salon were also posted on the social media pages of the two suspects. Photos of the two wearing the same clothing in the surveillance video were also found on social media. “The graffiti and the social media

posts – they’re basically associating themselves with a gang possibly known as the East Side (Fort Worth) Blood Gang,” Rogers explained. Police obtained a search warrant to search the home where the two suspects live where they found clothing matching that seen in the surveillance video from the burglary as well as additional evidence that will assist in prosecuting the case, Rogers said. Banks Runneth Over

Mother Nature wasn’t fooling when furious storms rolled through the area April 1, dropping as much as three inches of rain and hail right into the Eagle Mountain Lake watershed. In that case, Isbell participated in a violent home-invasion robbery in Houston that left two people dead and three others wounded. Isbell was on parole for that crime when he led police on the high-speed chases in Tarrant County.

covered bullet holes in her rear bumper and license plate. Azle police recovered a shotgun near the place where a witness reported seeing it thrown from the vehicle. They also found a spent shell and a damaged shell – both fired from the shotgun tossed from the Jeep – in another location. The following evening, Haltom City police located the Jeep in a residential area in that city. The chase was on again. For more than 20 miles, officers pursued the Jeep as it drove 70 miles-per-hour in a 30 mileper-hour zone, ran into other vehicles on a highway, jumped medians, and reached speeds as high as 125 miles-per-hour. The Jeep even rammed a police cruiser occupied by an officer at one point. Finally, the Jeep hit a mailbox and came to a stop. Both the driver – Isbell, this time – and his passenger, Haney, fled on foot but were eventually caught and arrested. The appeal Isbell’s attorney appealed the trial court’s conviction based three issues: • the trial court erred by granting the State’s motion to consolidate; • the trial court erred by failing to instruct the jury on the accomplice-witness rule; and • improper jury argument. The conclusion The opinion of the Second Court of Appeals indicates the State concedes error in consolidating the four charges but contends the error was harmless. The appeals court decided not to conduct a harm analysis because of its disposition of the second issue. The second argument is that the only evidence linking Isbell to the two indictments for July 17 in Azle was Haney’s testimony and therefore, the jury should have received instructions about the accomplicewitness rule. Haney, Isbell contends, was an accomplice to those crimes. AHS grad’s photography on exhibit Molina’s Texas photos displayed at UTD campus through April 17 UTD Campus in Richardson. Raised in Azle and a 2001 graduate of AHS, Molina has loved Texas and its landscapes and cultures from a young age. Wizard of Oz airs in park April 11 Another free Movie in the Park is slated for 8 p.m. Saturday, April 11 at the Central Park amphitheater. Hermus E. Prine, Jr. passed away Tuesday, March 31, 2015. Funeral services were held in Eastland, Texas on April 4, 2015. Hermus was born Sept. 11, 1928 in Bainbridge, Georgia to Hermus E., Sr. and Alpha (Daniel) Prine. He met the love of his life, Norma Pearl Agnew, while stationed at Briggs AFB in El Paso. They were married

June 5, 1954 in Fort Worth, Texas. He was a member of Cocoa Baptist Church while living in Merritt Island. They had two children before moving to Abilene in 1969. He lived and worked in Abilene until retiring from the Texas Highway Department in 1993. Hermus was preceded in death by his parents and brother John Edward Prine. Survivors include wife, Norma Prine; brother, Joe Prine and (Harriett) of Merritt Island, Florida; daughter, Linda Russell and (Steve) of North Richland Hills; son, Tim Prine and (Lesli) of Leander, Texas; four grandchildren, Allie, Joseph P. Fox, Jr., 94, passed Whitney, Payton, and Karley; away Wednesday, April 1, and two great-grandchildren, 2015. Gage and Dylan, as well as Funeral services were held many nieces and nephews. 11 a.m. Saturday at Good Shepherd Lutheran Church The Azle News, under the direction of White’s April 8, 2015 Edition Azle Funeral Home. Joseph was born June 8, 1920 in Stuart, Iowa to Joseph Priestly Fox, Sr. and Henrietta of Azle. Nancy J. Bovea was born Ernestine Burns Fox. After Pearl Harbor he taught Dec. 23, 1929 in Olney to W. S. flying as a civilian instructor. and Mattie Bonds Davis. She had retired from Southwestern He married Barbara Marie Swift in March of 1944 in Perry, Bell after 43 years of service. Nancy was preceded in death Iowa. He graduated in 1949 by her parents; a brother; and from Iowa State and was hired husband, Meredith in 2001. by Caterpillar, Inc. in Peoria, She will be greatly missed by Illinois. He joined Cessna Aircraft in Wichita, Kansas. In all her family and friends. Survivors include son, Patrick 1964. Joe flew around Africa in Bovea and wife, Machele; a Cessna calling on dealers and granddaughters, Taylor and customers. Joe accepted the job Mattie Bovea; nephew, Craig of Sales Mgr. at Holt Bros. in Davis and family.

Stockton, California. He rejoined Caterpillar Inc. in 1973. Joe was responsible for innovations such as the Variable Horsepower Tractor and the Agricultural Tractor. He retired in 1987. Joe’s lifelong love, besides his family and Cat., was Aviation. He and Barbara made many cross country trips in his Cessna 180. Joe flew to Alaska in 1995 and 2000. He was a member of the Peoria Experimental Aircraft Assoc. at Mt Hawley Airport and missed very few EAA fly-ins at Oshkosh, Wisconsin the last being attended in 2014. He was also a member of Quiet Birdmen. After Barbara passed in 2004, Joe married Valerie McInnis of Azle in 2006. They spent 9 years together surrounded by Valerie’s large, loving family. They traveled the world together going to England twice, Scandinavia, Australia and New Zealand plus multiple visits back to Morton, Illinois where Joe kept his house. Joe knew no strangers only friends he had not yet met. He will be dearly missed by his family and many friends. Survivors include wife, Valerie Fox; children, David Joseph Fox and wife, Rhonda; daughter, Meredith Lynn Fox Bradley and husband, John Tidwell; grandchildren, Gregory Phelps and Shannon Fox; and a host of extended family and friends. Azle Police Blotter Officers with the Azle Police Department arrested the following individuals during the last three weeks: • Richard Carrol Monk, 25, of Azle, was arrested March 17 in the 300 block of Lochridge Drive and charged with assault family violence with a previous conviction. Monk was transferred to the Tarrant County jail, where he remained April 7 in lieu of $10,000 bond. • Raymond Lee Livingston, 47, of Azle, was arrested March 24 in the 1500 block of Southeast Parkway and charged with possession of a controlled substance, one to four grams, as well as possession of marijuana less than two ounces. He also was the subject of seven class C warrants out of Fort Worth PD.

Livingston was transferred to the Tarrant County jail and remained there April 7 in lieu of $7,933 bond. • Samuel Daniel Vincent, 64, of Springtown, was arrested March 24 in the 700 block of Boyd Road and charged with driving while intoxicated. Vincent posted $2,500 bond and was released from the Azle jail. • Souel Berry Rowe, 18, of Fort Worth, was arrested March 28 in the 900 block of Southeast Parkway and charged with possession of marijuana less than two ounces. Rowe was transferred to the Tarrant County jail, where he posted $1,000 bond and was released. • Christian Levi Newman, 34, of Azle, was arrested March 27 in the 400 block of

• Jimmy Steven Brashear, 41, of Azle, was arrested April 3 in the 600 block of SH 199 and charged with DWI. He posted $3,500 bond and was released from the Azle jail. • Tonya Laree Gist, 47, of Azle, was arrested April 4 in the 200 block of North Stewart Street and charged with DWI, her second. She remained in the Azle jail in lieu of $5,000 bond on April 7.

Green Scene Garden Tour fundraiser slated May 3 Proceeds fund Azle-area beautification projects by carla noah stutsman An enjoyable and fruitful biennial event, the Green Scene Garden Tour is on tap from 12 noon-4:30 p.m. Sunday May 3. Sponsored by the Azle Area Chamber of Commerce, proceeds from the tour will go to the Rock School Outdoor Learning Center garden, a beautification project at the Azle Museum, and other Main Street beautification projects, according to event organizer Peggy Davis. A small portion of money goes to reseed bluebonnets every two years at the “Welcome to Azle” sign on the west side of Boyd Road near Walnut Creek.

Tickets for the Garden Tour, which features six beautiful gardens this year, are $15 each, available at the Azle Area Chamber of Commerce, at Queen Bee’s Garden in Azle, from individual members, and at the first garden. Sack lunches, $5 each, may be purchased al fresco at a dining area in the first garden. This year’s gardens emphasize sun and shade, and range in size from several acres to compact. Three include interesting water features. The six gardens are: Texas Rustic Elegance, Folk Art Fantasy, Celebration Gathering, Enchanted Wood, An English

Turn, and Heirloom. The first garden on the tour, located out in the country, uses native stone from the site and mostly indigenous plants. One home features a multiacre garden in and around dense woods. In town, a compact garden will be decorated for a bridal shower. Another city garden features folk art and old iron implements in a complementary way. A shaded and winding stream cools one garden on the hottest days. Eagle Mountain Lake provides the setting for a shaded fern garden and sunny rose and perennial area.

Mobile Storm Help

Lake Report

In response to reports of significant hail damage in the area from storms Wednesday, April 1, State Farm has set up a mobile catastrophe unit in the 100 block of Industrial Avenue in Azle. The unit is in the parking lot next to Pizza Hut and is intended for automobiles and light trucks only. A State Farm spokesman on site said the first thing anyone who sustained damage should do is contact their agent and file a claim. A claims specialist will set an appointment to bring your vehicle to the mobile catastrophe unit or to send a claims adjuster to your residence or your place of work. Property claims will require an adjuster visit your property. The spokesman said State Farm will be in the location for “as long as it takes to get the job done.” Photos by Carla Noah Stutsman

fighting for Texas independence. Rice wrote the governor of Texas, Edmund J. Davis, and applied for his pension. He wrote, “I am an old Texan Soldier who Inlisted [sic] in Libber Rating [sic] Texas from Mexico.” Rice had to get letters and depositions from people who could vouch for his service in the Texas Revolution, and finally in 1875 received a pension of $500 per year, which was a generous sum in those days. The home the Rice family built near Azle was a frame house on present Nine Mile Bridge Road about three/ tenths of a mile southeast of its intersection with Silver Creek Road. The house sat on the land until it burned in the 1950s. Rice lived there until his death February 16, 1878. If anyone wants to locate his grave today to see the new brass plaque placed on his marble marker, enter the cemetery at the eastern gate of the two gates that are on South Stewart Street. Glance to the right as you drive slowly. The monument and a black Texas Historical Marker stand side by side at his grave. The new, round medallion dedicated March 28, is a “Defender Memorial Medallion” and was inserted in the already existing monument. It is quite an honor that a wounded hero of the Texas War for Independence rests in our city.

Those golfers due on Friday, April 10 are hoping to pass the PAT – Playing Ability Test. Buhrmann said he has hosted them before out in West Texas, his earlier stop. All ages will tee up for the PAT at CTGC. Buhrmann said they could

age from retirees who are looking for another way to work to young former pros or college players seeking their PGA-certified card. To get that coveted honor, golfers must beat the course rating plus 15 strokes, Buhrmann said. “That’s usually in the mid70’s,” he said. “Usually only 15 to 20 percent of any group passes.” The PAT is part of the apprenticeship that “demonstrates” a golfer’s skill level to work at

the professional level. Passing the PAT and other requirements means a golfer is talented enough to give lessons, the CTGC pro said. Azle is just one golf course in the region that offers a PAT. McKinney’s Stonebridge Ranch Country Club has already hosted. Other chances for hopefuls include stops in Odessa, Plano, Richardson, Grand Prairie, and Mansfield in 2015. But 10 or so might first reach their dream in Azle.

Hornets fall to Boswell After one inning, Azle and Boswell were tied at the Hornet diamond. But that one run for AHS would be all Azle could muster in an 8-1 loss in District 5-5A play. The Hornets managed just 4 hits and, worse, committed 5 errors. At the plate, 13 AHS batters struck out. Half of Azle’s hits came from Trey Ramos who scored the lone Hornet run. Trevor Boiles batted Ramos in with a double. The other safety came from Zack Tucker. Blake Hall pitched 6 innings;

Devon Oliver threw the other frame. The Hornets will host Wichita Falls April 10, marking the beginning of the second round of 5-5A play.

Furious car movie is anything but fast As expected, Furious 7 – yet another sequel in the Fast and the Furious series – destroyed the April record book. With its gigantic take of $144 million, you can be sure that another movie looms in the series – even with the death of a major actor, Paul Walker. His isn’t the most famous post-death role, but it’s up there. About the film Plenty of actors have popped up in movies after they have expired – that’s the nature of the business. Most famous, of course, is Heath Ledger who won a Best Supporting Actor Oscar as the Joker in The Dark Knight (2008, Movie Man No. 782, an 8), even though another movie he was making was cobbled together later, The Imaginarium of Doctor Parnassis (2009). James Dean’s final two movies in the can after he died in 1955 were huge: Rebel Without a Cause and Giant, the latter released over a year after he was killed in a car crash. However, the usual case, sadly, is that a final movie isn’t one the actor would’ve chosen to go out on. Robin Williams’ last movie was a small part in last year’s Night at the Museum: Secret of the Tomb, a bummer from a guy who turned in many memorable roles. Other recent deaths include James Gandolfini and Philip Seymour Hoffman but their finales, The Drop and God’s Pocket, respectively, disappeared quickly. Well-liked others who finished with a posthumous flub include Natalie Wood (1983, Brainstorm), Phil Hartman (1998, Buster & Chauncey’s Silent Night), Bernie Mac (2009, Old Dogs), and John Candy (1995, Canadian Bacon).

brother. So he’s out to get the gang. (One bit the dust at the end of Fast and Furious [MM #1037, 6].) A super-duper black ops guy, Statham is a “shadow” and can’t be caught. Government secret dude, “Mr. Nobody” (Kurt Russell), convinces Diesel that he can deliver Statham to Diesel but first he must deliver a special device called God’s Eye that can find anyone, anywhere – a device that was created by Ramsey (Nathalie Emmanuel). She’s being transported and guarded by a mini-army. No problem for the Furious gang. But Statham is still out there and, after trips to Abu Dhabi and, finally, America, Statham Diesel face off. There are others to help in the manhunt. Agent Hobbs (Dwayne “The Rock” Johnson) comes to the rescue and there’s always Diesel’s crew which includes his amnesiac wife Letty (Michelle Rodriguez), Roman (Tyrese Gibson), and Tej (Ludacris) – not to mention Brian (Walker). What works If you like cars being driven really fast and stunts so preposterous that you can only chuckle, then this movie is for you. It’s so ridiculous that you have

to shake your head – and keep watching. As dull as Diesel is, he makes Johnson shine even brighter. When The Rock is on the screen, things always ratchet up. That dude is funny, he’s ripped, and he’s the best thing in this movie by a mile. Too bad he’s in it so little. The rapport between Gibson and Ludacris is witty and they play it well. The first big bit – the rescue of Emmanuel – is okay, but the real winner is when the group goes undercover at Abu Dhabi. That’s when Furious 7 has its broadest appeal. Homeowners should beware of roofing scams in wake of spring storms BY NATALIE GENTRY Mere days after strong winds and hail caused damage to commercial and residential structures throughout the area, fly-by-night “storm chaser” roofing contracting companies descended in droves. Just a day after the storm in Springtown, Parker County Commissioner George Conley said 22 different companies had placed over 200 signs in the area – all picked up, he said. While not all storm chasing roofers are bad, homeowners need to be careful with who they allow to work on one of their most valuable assets – their home. High pressure sales tactics The Texas Department of Insurance (TDI) website recommends homeowners don’t allow contractors on their roof before their insurance adjuster has inspected it, as there have been reported cases of crooked contractors creating more damage in order to receive a larger payout. The agency also cautions homeowners to be wary of door-to-door solicitations, an all too common recent occurrence. “I’ve had several people call me and beg me to put a sign in

their yard so the out-of-town roofers will leave them alone,” Blake May, owner of Diamond B. Roofing said. “The signs used to mean that, say, a homeowner had already chosen a roofer, but now they are just being ignored. “One of my customers was pressured so hard that he finally told the guy to replace my sign in the yard just to get him to leave.” One warning indicator of a potentially unscrupulous contractor is the push to have homeowners sign an agreement on the spot. AAA Texas tips to avoid roofing scams • Make sure the roof damage is covered by your insurance policy. • Be cautious about door-to-door offers of roof repair services and flyers or business cards that are left at your property. • Obtain estimates from more than one roof contractor – including a summary of work to be done, time schedules, guarantees, and payment schedules in writing. • Obtain everything in writing. The best way to avoid disputes over what is or isn't expected from a home improvement/repair job is to write out the details in a contract. • The roofing repair contract should be as specific as possible regarding materials to be used, including the quality, quantity, weight, color, size, or brand name as it may apply.
