Sie wird jedem Nächtigungsgast ab 6 Jahren ausgegeben. Die Leistungen können Sie entweder inklusiv (Inklusive-Symbol) nutzen oder Sie erhalten bei den Bonuspartnern (Bonus-Symbol) eine entsprechende Ermäßigung auf die angebotene Leistung. Die Bad Kleinkirchheim Card ist von 2. Dezember 2011 bis 9. April 2012 für den Winter gültig, wobei nicht alle Leistungen im gesamten Gültigkeitszeitraum der Card angeboten werden. The card is given to every overnight guest aged 6 and over. Die Ausgabe und jede Art der Verwendung einer Bad Kleinkirchheim Card unterliegen den nachstehenden ALLGEMEINEN GESCHÄFTSBEDINGUNGEN 1. Allgemeines: Die Bad Kleinkirchheim Card (im Folgenden kurz: „die Karte“) ist eine regionale Gästekarte. Sie wird allen in den bei der Bad Kleinkirchheim Card teilnehmenden Beherbergungsbetrieben ordnungsgemäß gemeldeten Nächtigungsgästen der Kurgemeinde Bad Kleinkirchheim für die Dauer ihres Aufenthalts (inklusive An- und Abreisetag) vom jeweiligen Beherbergungsbetrieb kostenlos zur Verfügung gestellt. Ein käuflicher Erwerb der Karte ist nicht möglich. Betreiberin der Karte ist die Bad Kleinkirchheimer Tourismus Marketing GmbH (im Folgenden kurz: „die Betreiberin“), Dorfstraße 30, 9546 Bad Kleinkirchheim. 2. Leistungen: Die Karte umfasst je nach Saison (Sommer: 1. Mai bis 31. Oktober und Winter: 2. Dezember bis 9. April) unterschiedliche Leistungen. Ab Erhalt der Karte besteht für den jeweiligen Karteninhaber die Möglichkeit, die in der Broschüre dargestellten Leistungen nachstehender Kategorien in Anspruch zu nehmen: a) Leistungen von Inklusivpartnern: Inklusivleistungen umfassen die kostenlose Inanspruchnahme ausgewählter Leistungen des jeweiligen Inklusivpartners. b) Leistungen von Bonuspartnern: Bonusleistungen umfassen entweder eine Ermäßigung auf das für die jeweils in Anspruch genommene Leistung zu bezahlende Entgelt oder einen entsprechenden Mehrwert durch Gewährung einer zusätzlichen Leistung oder einer Beigabe. Maßgeblich für den Umfang und die Art der Leistung ist stets der Inhalt der Bad Kleinkirchheim Card-Broschüre. 3. Leistungsumfang/Haftung: Sämtliche Partnerbetriebe sind verpflichtet, Karteninhabern im jeweiligen Geltungszeitraum der Karte und im jeweiligen Angebotszeitraum der Leistung zu ihren gewöhnlichen Geschäftszeiten und ihren allgemeinen Beförderungs- und Geschäftsbedingungen ihre als Bad Kleinkirchheim Card-Leistung gekennzeichneten Leistungen qualitativ und quantitativ in vollem Umfang zur Verfügung zu stellen. Beschränkungen der Inanspruchnahme von Leistungen der Karte können sich generell aus den Betriebszeiten und den Kapazitätsgrenzen einzelner Partnerbetriebe sowie aus witterungs- und saisonbedingten Umständen ergeben. Darüber hinaus können sich Einschränkungen aufgrund individueller Sperrfristen oder allfälliger Zugangsbeschränkungen ergeben. Die vom jeweiligen Leistungspartner angegebenen Öffnungszeiten sind zu beachten. Bei nicht oder nicht vollständig erbrachter Leistung besteht kein Ersatzanspruch. Außerdem behält es sich die Betreiberin vor, die Vereinbarungen mit einzelnen Leistungspartnern, aus welchen Gründen immer, jederzeit zu beenden, ohne dem Karteninhaber für die hiedurch entfallende Möglichkeit der Inanspruchnahme angebotener Leistungen Ersatz leisten zu müssen. Die Betreiberin übernimmt für allfällige Schäden, die ein Karteninhaber im Zusammenhang mit der Inanspruchnahme angebotener Leistungen erleidet, keine wie immer geartete Haftung. Allfällige aus dem Betrieb des technischen Systems „Bad Kleinkirchheim Card“ resultierende Ansprüche gegen die Betreiberin sind auf die Fälle grober Fahrlässigkeit und Vorsatz beschränkt. Bei Inanspruchnahme der Leistungen der Bad Kleinkirchheim Card wird der Karteninhaber Vertragspartner des jeweiligen Leistungspartners, sodass alle daraus resultierenden Ansprüche ausschließlich gegenüber diesem geltend zu machen sind. 4. Verkehrsmittel: Die Karte berechtigt zur kostenlosen Benützung des „Ski-Thermen-Busses“. Das Angebot umfasst ausschließlich die Linienfahrt laut Fahrplan, nicht aber Sonderfahrten und Sonderleistungen. 5. Gültigkeitsvoraussetzungen: Die Bad Kleinkirchheim Card ist nicht übertragbar und gilt nur in Verbindung mit einem amtlichen Lichtbildausweis. Die mit der Karte verbundenen Leistungen kann ausschließlich die auf der Karte namentlich angeführte Person innerhalb der Gültigkeitsdauer der Karte in Anspruch nehmen. Der Leistungszeitraum, in dem die einzelnen Inklusiv- und Bonusleistungen in Anspruch genommen werden können, ist grundsätzlich aus der jeweils gültigen Bad Kleinkirchheim Card-Broschüre ersichtlich. Abweichungen, insbesondere aus den in Punkt 3. genannten Gründen bleiben davon unberührt. Der Gültigkeitszeitraum jeder einzelnen Karte richtet sich nach der jeweiligen Aufenthaltsdauer und ist auf der Karte vermerkt. Ein Anspruch auf Barablöse oder eine sonstige Abgeltung bei Verzicht auf die Karte ist ebenso ausgeschlossen wie eine Kostenrückerstattung für ungenutzte oder nur teilweise genutzte Karten. 6. Verwendung: Der Karteninhaber weist bei Inanspruchnahme der mit der Karte verbundenen Leistungen dem jeweiligen Leistungspartner seine Karte vor, der diese auf ihre Gültigkeit prüft. Auf Verlangen ist der Karteninhaber verpflichtet, einen amtlichen Lichtbildausweis vorzuweisen. Ist er dazu nicht in der Lage, können die Leistungen der Bad Kleinkirchheim Card verweigert werden. 7. Kinder: Kinder, die bei Ausstellung der Karte das sechste Lebensjahr bereits vollendet haben, erhalten eine eigene, auf sie persönlich ausgestellte Karte. Jüngere Kinder können das Leistungsangebot lediglich in Begleitung ihrer Eltern, sofern diese im Besitz einer gültigen Karte sind, in Anspruch nehmen. Dies gilt auch für jene Kinder, die während des Geltungszeitraums der Karte der Eltern das sechste Lebensjahr vollenden. 8. Missbrauch: Bei missbräuchlicher Verwendung oder bei bloßem Verdacht auf missbräuchliche Verwendung sind die einzelnen Leistungspartner berechtigt und verpflichtet, die Karte ersatzlos einzubehalten. Die Weitergabe der Karte an Dritte ist, selbst wenn es sich dabei um Familienmitglieder handelt, nicht gestattet und zieht strafrechtliche Folgen nach sich! Darüber hinaus haftet der Karteninhaber für jede missbräuchliche Verwendung durch Dritte. 9. Verwendung personenbezogener Daten: Mit der Entgegennahme einer Bad Kleinkirchheim Card stimmt der Karteninhaber ausdrücklich zu, dass seine Stammdaten (Name, Geburtsdatum, Post- und E-Mail-Adresse sowie Telefonnummer) sowie die im Wege der elektronischen Datenverarbeitung erfassten Nutzungsdaten von

der Betreiberin insbesondere zu statistischen und Marketingzwecken ausgewertet und verwendet werden. Der Karteninhaber erklärt sich weiters damit einverstanden, per Telefon, Fax, E-Mail und SMS Informationen auch zu Werbezwecken, als Direktwerbung oder in Form von Massensendungen von der Betreiberin zu erhalten. Der Karteninhaber hat das Recht, seine Zustimmung zur Datenverwendung jederzeit schriftlich zu widerrufen. 10. Diebstahl/Verlust und Beschädigung: Bei Verlust oder Diebstahl der Karte kann der Karteninhaber diesen Vorfall beim jeweiligen Beherbergungsbetrieb melden. Im Fall des Verlusts oder Diebstahls sowie bei Beschädigung der Karte wird dem Karteninhaber vom jeweiligen Beherbergungsbetrieb eine Ersatzkarte (Duplikat) ausgestellt, woraufhin alle dem Karteninhaber bisher ausgestellten Karten ihre Gültigkeit verlieren. Der Leistungsbetrieb, die Leistungspartner und die Betreiberin übernehmen keine Haftung bei Diebstahl oder Verlust. Ebensowenig haften sie für alle aus der Beschädigung der Karte resultierenden Folgen. 11. Anwendbares Recht und Gerichtsstand: Sämtliche Streitigkeiten aus der Verwendung der Bad Kleinkirchheim Card unterliegen österreichischem Recht unter Ausschluss von Verweisnormen des IPRG und des UN-Kaufrechtsübereinkommens. Als Gerichtsstand wird die ausschließliche Zuständigkeit des für Klagenfurt sachlich zuständigen Gerichts vereinbart. Dies gilt nicht nur gegenüber der Betreiberin, sondern auch bei Geltendmachung von Ansprüchen gegen Leistungspartner und von Leistungspartnern der Bad Kleinkirchheim Card, sofern deren Allgemeine Geschäftsbedingungen nicht anderes vorsehen.

The issue and all forms of use of a Bad Kleinkirchheim Card are subject to the following GENERAL TERMS AND CONDITIONS OF BUSINESS 1. General: The Bad Kleinkirchheim Card (referred to hereinafter in brief as: “the Card“) is a regional guest card. It is provided free of charge to all overnight guests who are properly registered with the Bad Kleinkirchheim Card at the participating accommodation businesses in the spa municipality of Bad Kleinkirchheim by the respective accommodation business for the duration of their stay (including arrival and departure days). It is not possible to buy the card. The card operator is Bad Kleinkirchheimer Tourismus Marketing GmbH (referred to hereinafter in brief as: „the Operator“), Dorfstraße 30, 9546 Bad Kleinkirchheim. 2. Services: The Card comprises various services according to the season (Summer: 1 May to 31 October and Winter: 2 December to 9 April). Once the respective Cardholder has received his card, he is able to use the services shown in the brochure under the following categories: a) Services from inclusive partners: Inclusive services comprise the use free of charge of selected services from the respective inclusive partner. b) Services from bonus partners: Bonus services comprise either a reduction in the charge to be paid for the respective service being used, or a corresponding added value through an extra service or free gift. The content of the Bad Kleinkirchheim Card brochure is always decisive for the scope and type of service. 3. Scope of services/liability: All the partner business are obliged to provide those of their services which are identified as Bad Kleinkirchheim Card services to Cardholders to their full extent qualitatively and quantitatively during the respective validity period of the Card and in the respective offer period during their normal business hours and under their general terms and conditions of carriage and business. Restrictions on the use of the Card benefits can generally arise due to the business hours and capacity limits of individual partner businesses and also due to circumstances caused by the weather and the season. In addition restrictions may arise due to individual closed periods or general restrictions on access. The opening hours stated by the respective service partner must be observed. No entitlement to compensation exists in the event of a service not being provided or not being provided in full. In addition the Operator reserves the right to terminate the agreements with individual service partners at any time for any reason without having to pay the Cardholder compensation for the lost opportunity of using the services. The Operator accepts no liability of any kind whatsoever for any losses which a Cardholder suffers in connection with the use of the services offered. Any claims against the Operator arising from the operation of the „Bad Kleinkirchheim Card“ technical system are limited to cases of gross negligence and intent. When using the services of the Bad Kleinkirchheim Card, the Cardholder becomes a contractual partner of the respective service partner, so that all claims resulting from this must be enforced exclusively against the latter. 4. Means of transport: The Card entitles Cardholders to free use of the „Ski-Thermen-Bus“ („Mountainthermal spa bus“). The offer applies only to regular travel in accordance with the timetable, but does not apply to special trips and special services. 5. Conditions of validity: The Bad Kleinkirchheim Card is non-transferable and is valid only in conjunction with an official means of identification with a photo. The services associated with the Card can only be used by the person named on the Card within the validity period of the Card. The period of performance within which the individual inclusive and bonus services can be used is strictly as shown in the Bad Kleinkirchheim Card brochure valid at the time. Variations, especially due to the reasons stated in Point 3, remain unaffected by this. The period of validity of each individual Card is determined by the duration of the stay concerned and is noted on the Card. Any claim to replacement in cash or other compensation when the Card is not used is excluded, as is any reimbursement of costs for unused or only partially used Cards. 6. Use: When using the services associated with the Card, the Cardholder must show his Card to the respective

service partner, who will check that this is valid. If requested the Cardholder must present an official means of identification with a photo. If he is unable to do so, the services of the Bad Kleinkirchheim Card may be refused. 7. Children: Children who have already completed their sixth year at the time of issue of the Card will receive a Card of their own, personally issued to them. Younger children can use the services offered only when accompanied by their parents insofar as these are in possession of a valid card. This also applies to children who complete their sixth year during the period of validity of the Card. 8. Misuse: In the event of improper use or merely where improper use is suspected, the individual service partners are entitled and obliged to retain the Card without replacement. It is not permitted to pass the Card on to third parties even when these are family members, and this will lead to consequences under criminal law! In addition, the Cardholder is liable for any improper use by third parties. 9. Use of personal details: By accepting a Bad Kleinkirchheim Card, the Cardholder expressly agrees to his basic details (name, date of birth, postal and email address and telephone number) as well as the details of use recorded in the course of electronic data processing being evaluated and used by the Operator for statistical and marketing purposes in particular. The Cardholder also further declares his agreement to receiving information from the Operator by telephone, fax, email and SMS for advertising purposes, direct advertising or in the form of mass mailings. The Cardholder has the right to withdraw his agreement to the use of his details at any time in writing. 10. Theft/loss and damage: If the Card is lost or stolen, the Cardholder can report this incident to the respective accommodation business. If the card is lost, stolen or damaged, the Cardholder will be issued with a replacement Card (duplicate) by the respective accommodation business, whereupon all the Cards issued to the Cardholder up to then will cease to be valid. The service business, the service partners and the Operator accept no liability in the event of theft or loss. Likewise they shall not be liable for any consequences resulting from damage to the card. 11. Applicable law and place of jurisdiction: All disputes arising from the use of the Bad Kleinkirchheim Card are subject to Austrian law with the exclusion of the rules on the conflict of laws of the IPRG [Austrian Act on International Private Law] and the UN Convention on Contracts for the International Sale of Goods. As the place of jurisdiction, it is agreed that solely the court responsible for Klagenfurt in the matter shall be competent. This applies not only in respect of the Operator, but for the enforcement of claims against and by service partners of the Bad Kleinkirchheim Card provided their General Terms and Conditions of Business do not provide otherwise. The German version of these General Terms and Conditions of Business is the authoritative version. The German version shall therefore be used if any divergences or difficulties in interpreting these General Terms and Conditions of Business exist.

L’emissione e qualsivoglia utilizzo della Bad Kleinkirchheim Card sono soggetti alle seguenti CONDIZIONI GENERALI 1. In generale: la Bad Kleinkirchheim Card (di seguito in breve: “la tessera“) è una tessera regionale per gli ospiti. È fornita gratuitamente a tutti gli ospiti pernottanti, debitamente registrati della Bad Klainkirchheim Card presso le strutture ricettive partecipanti del Comune di Bad Kleinkirchheim, per la durata del loro soggiorno (inclusi i giorni di arrivo e di partenza) da parte di ciascun albergatore. La tessera non è acquistabile. La società di gestione della tessera è la Bad Kleinkirchheimer Tourismus Marketing GmbH (di seguito in breve: “il gestore“), Dorfstraße 30, 9546 Bad Kleinkirchheim. 2. Prestazioni: a seconda della stagione (estate: dal 1° maggio al 31 ottobre e inverno: dal 2 decembre al 9 aprile) la tessera include svariate prestazioni. Una volta ricevuta la tessera, il possessore della stessa ha la possibilità di usufruire delle prestazioni illustrate nell’opuscolo, appartenenti alle seguenti categorie: a) Prestazioni incluse presso gli esercizi affiliati: le prestazioni incluse prevedono l’utilizzo gratuito dei servizi selezionati presso il singolo esercizio affiliato. b) Prestazioni degli esercizi „Bonus Partner“: le prestazioni con il bonus prevedono uno sconto sul corrispettivo dovuto per la prestazione utilizzata oppure un relativo valore aggiunto dietro concessione di una prestazione aggiuntiva o di un supplemento. Ai fini dell’ambito e del tipo di prestazione fa fede esclusivamente il contenuto dell’opuscolo della Bad Kleinkirchheim Card. 3. Ambito delle prestazioni/responsabilità: tutti gli esercizi affiliati sono tenuti a mettere a completa disposizione dei possessori della tessera, in termini di qualità e quantità, le proprie prestazioni contrassegnate come prestazioni della Bad Kleinkirchheim Card, nel periodo di validità di volta in volta riportato sulla tessera e nel periodo indicato per l’offerta, durante i propri consueti orari di apertura e nel rispetto delle proprie condizioni generali commerciali e di trasporto. Eventuali limitazioni all’utilizzo delle prestazioni della tessera potranno essere dovute, in genere, agli orari d’esercizio e ai limiti di capacità dei singoli esercizi affiliati nonché a determinate condizioni atmosferiche e stagionali. Inoltre potranno insorgere eventuali limitazioni a causa di singole date di chiusura o di eventuali restrizioni all’accesso. È necessario osservare gli orari di apertura indicati

da ciascun esercizio affiliato. In caso di mancato utilizzo o di utilizzo parziale della prestazione non sussiste alcun diritto al rimborso. Inoltre il gestore si riserva di risolvere, in qualsivoglia momento e per qualsivoglia motivo, gli accordi con i singoli esercizi affiliati, senza dover risarcire il possessore della tessera per la mancata possibilità d’utilizzo delle prestazioni offerte a seguito di tale risoluzione. Il gestore non si assume alcuna responsabilità per eventuali danni subiti dal possessore della tessera in relazione all’utilizzo delle prestazioni offerte. Eventuali pretese derivanti dall’uso del sistema tecnico “Bad Kleinkirchheim Card“ nei confronti del gestore sono limitate ai casi di dolo o colpa grave. Usufruendo delle prestazioni della Bad Kleinkirchheim Card il possessore della tessera diviene parte contraente del singolo esercizio affiliato, così che tutte le pretese da ciò risultanti dovranno essere rivendicate esclusivamente nei confronti di quest’ultimo. 4. Mezzi di trasporto: la tessera consente di usufruire gratuitamente del “Ski-Thermen-Bus“. L’offerta comprende esclusivamente le corse di linea come indicate nell’orario e non le corse o i servizi speciali. 5. Requisiti di validità: la Bad Kleinkirchheim Card non è trasferibile ed è valida soltanto se esibita insieme ad un documento ufficiale d’identità. Le prestazioni correlate alla tessera possono essere usufruite esclusivamente dalla persona il cui nominativo è indicato sulla tessera, entro il periodo di validità della stessa. In linea di massima il periodo in cui possono essere utilizzate le singole prestazioni incluse e scontate, è indicato nell’opuscolo della Bad Kleinkirchheim Card di volta in volta vigente. Con riserva di eventuali differenze, in particolare per i motivi di cui al punto 3. Il periodo di validità di ciascuna tessera dipende dalla durata del singolo soggiorno ed è annotato sulla tessera. Si escludono il diritto ad un controvalore in contanti o altro compenso in caso di rinuncia alla tessera, nonché il rimborso dei costi in caso di mancato utilizzo o di utilizzo parziale delle tessere. 6. Utilizzo: per usufruire delle prestazioni correlate alla tessera, il possessore della stessa la esibirà al singolo esercizio affiliato, il quale ne verificherà la validità. Su richiesta, il possessore della tessera è tenuto ad esibire un documento ufficiale d’identità. Qualora egli non fosse in grado, le prestazioni della Bad Kleinkirchheim Card potrebbero non essere concesse. 7. Bambini: i bambini che abbiano già compiuto i sei anni al momento dell’emissione della tessera, hanno diritto ad una propria tessera personale. I bambini di età inferiore ai sei anni possono usufruire delle prestazioni soltanto se accompagnati dai loro genitori, ove questi siano in possesso di una tessera valida. Ciò vale anche per i bambini che compiono sei anni durante il periodo di validità della tessera dei genitori. 8. Abuso: in caso di abuso o di mero sospetto di abuso nell’utilizzo della tessera, gli esercizi affiliati sono autorizzati e tenuti a trattenere la tessera senza concedere alcun rimborso. La cessione della tessera a soggetti terzi, anche se si tratta di componenti della famiglia, non è consentita ed è punibile per legge! Inoltre il possessore della tessera risponde di qualsivoglia abuso della stessa da parte di terzi. 9. Utilizzo dei dati personali: accettando una Bad Kleinkirchheim Card il possessore della tessera acconsente esplicitamente alla valutazione e all’utilizzo, da parte del gestore, dei propri dati personali (nome, data di nascita, domicilio, indirizzo e-mail e telefono) nonché dei dati utente registrati ai fini dell’elaborazione elettronica, in particolare a fini statistici e di marketing. Il possessore della tessera acconsente inoltre a ricevere via telefono, fax, e-mail ed sms, eventuali informazioni dal gestore, anche a scopi pubblicitari, di pubblicità diretta o sotto forma di comunicazioni tramite mailing list. Il possessore della tessera ha la facoltà di revocare per iscritto, in qualsivoglia momento, il proprio consenso all’utilizzo dei dati. 10. Furto/smarrimento e danno: in caso di smarrimento o furto della tessera, il possessore della stessa può segnalare l’accaduto presso il proprio albergatore. In caso di smarrimento o furto nonché di danno alla tessera, il possessore può richiedere una tessera sostitutiva (duplicato) presso il proprio albergatore. In tal caso tutte le tessere emesse fino a tal momento a nome del possessore, perderanno la loro validità. La struttura ricettiva, gli esercizi affiliati e il gestore non si assumono alcuna responsabilità in caso di furto o smarrimento della tessera, né rispondono di eventuali conseguenze derivanti dal danneggiamento della tessera. 11. Diritto applicabile e foro competente: tutte le controversie derivanti dall’utilizzo della Bad Kleinkirchheim Card sono soggette alle leggi austriache, con esclusione delle norme di rimando dell’IPRG (legge internazionale sul diritto privato) e della Convenzione delle Nazioni Unite sui contratti di vendita internazionale di beni mobili. Si elegge a foro competente esclusivo il tribunale di Klagenfurt competente in materia. Ciò trova applicazione non soltanto nei confronti del gestore bensì anche in caso di rivendicazione di pretese nei confronti e da parte degli esercizi affiliati della Bad Kleinkirchheim Card, salvo per quanto diversamente previsto dalle loro Condizioni generali. Ai fini dell’interpretazione delle presenti Condizioni generali fa fede la versione in lingua tedesca. Pertanto, in caso di incongruenze o problemi d’interpretazione, dovrà essere considerata la versione in lingua tedesca.
