OWNING PROPERTY in Mexico

exico's 1914 constitution introduced Article 27, prohibiting the foreign ownership of land within 31 miles of its coastline and 62 miles of its borders, including the entire Baja California peninsula. A 1971 presidential decree then allowed Mexican banks to hold "restricted zone" property in a trust instrument called a Fideicomiso. As ironclad as the deed to your home in the States or Canada, the Trust designates the property buyer as its Beneficiary with legal title placed with the bank chosen by the buyer as trustee. The bank administrates the property in accordance with the instructions of the Beneficiary, who enjoys the same rights of ownership as a Mexican citizen. He/she may build on the property, modify or tear down existing structures, rent, lease or sell at anytime, conforming only to the general laws of Mexico. The Trust's term is for 50 year periods, automatically renewable by law. In other words, title may rest with one beneficiary indefinitely, protecting your heirs and your investment.
