Every day was exciting and filled with unimaginable new experiences. he magic of the Baja lies in its amazing beauty and history. The fascinating story of property ownership in Baja is as alluring as the seas that surround it. In 1533 Spanish galleons sent by Cortez accidentally discovered the lower Baja peninsula, making contact with its native people. Soon after their discovery, Spain created the Manila galleon route from Acapulco to the Philippines, sending their goods past the shores near Los Cabos. Pirates, under the command of buccaneers such as Francis Drake and Thomas Cavendish laid in ambush, waiting for the Spanish treasure ships following the route. In 1821, Mexico, having had its fill of Spanish rule, declared its independence. Spain conceded without too much of a fight and the Baja became part of Mexico. Four years later, Daniel Webster offered to buy the Baja peninsula for twenty million dollars, but Mexico refused. President Polk upped the offer by 20 million but his offer met the same fate. After the war between the US and Mexico for the

California Territories, the US became disinterested in the Baja, clearing the way for the signing of the Treaty of Guadalupe Hidalgo after 2 years of war. In the new constitution of 1914, Article 27 was included and prohibited foreign ownership of any land within 31 miles of any coastline and 62 miles of any border. Although not too restrictive on the mainland, the article had tremendous impact on Baja, making the land virtually off limits to foreign ownership To get around the law, foreigners who wanted to live in Baja’s paradise leased the land for a period of 10 years from the owners of desirable beach property. They could then re-lease the land for an additional 10 years. (This system was legal, but was so abused that it gave “owning” property in Mexico a bad name). With prospects of tremendous tourism dollars an enlightened government under President Luis Escheverria Alvarez wrote a presidential decree allowing Mexican banks to hold property “In Trust” for
foreigners. It’s called a Fideicomiso and you can consider it as ironclad as the deed to your home in the States or Canada. The Trust designates the buyer of the property as beneficiary of the Trust. Legal title is placed in the name of the bank selected by the buyer, as his trustee. The bank administrates the property in accordance with the instructions of the Buyer/Beneficiary. The beneficiary enjoys the same rights of ownership, as does a Mexican citizen. He may build on the property, tear down existing structures, modify them, rent, lease or sell at anytime conforming only to the general laws of the country established for all persons. The term of the Trust is for 50-year periods automatically renewable by law. In other words, title to the property may rest in one beneficiary indefinitely- which protects your heirs and your investment. Today, US Title Insurance and U.S. Mortgage financing is available for properties held in Trust making it easier and more secure than ever before to own property in Los Cabos.

ever before has it been easier, safer and affordable for foreigners purchasing real estate in Los Cabos. With the introduction of financing, U.S. Mortgage companies are offering long term, fixed rate financing for periods up to 25 years using your property in Mexico as collateral. This new chapter in Baja’s history creates an affordable reality for those who could have only dreamed of owning a vacation home in Los Cabos. This new market of buyers is having a huge impact in the number of sales taking place in Los Cabos and on property values. Today a purchaser can place a down payment on a mortgage, rather than pay full price out of pocket. Most finance companies will lend up to 70% of the purchase price with fixed interest rates averaging at 8%. Los Cabos is no longer exclusive to the cash buyer. Once the U.S. Mortgage company has approved your loan, they will contact the Public Notary to draft the Trust document. The Trust Deed will be registered and you will make payments to the U.S. Company as you would any loan. Interest and other tax deductions apply in the United States. Currently GE Financing is available through many new mortgage financing brokerages in Los Cabos. hen Baja Properties first opened up in 1986 the real estate market in Los Cabos didn’t need much more than an exchange of consideration and a handshake in order to buy and sell property. Many of the properties were still held in the name of the very first title holder and there wasn’t much confusion or doubt about who owned the land and who had the legal authority to transfer the title. At closing the sellers would present themselves to the Notary Public to sign the Trust Deed to the foreigner. It was simple then. The real estate industry in Los Cabos is enormous now with subdivided properties, master planned developments, condominiums
and homes throughout its 200 mile region. In 1998 U.S. Title Insurance companies began offering title insurance for Trust Deed ownership in Mexico. Today protection for buyers is easily achieved. Buyers can have more confidence then ever before regarding the security of their purchase. U.S. Title insurance can be purchased for properties in Los Cabos through the services of Fidelity-Global Solutions of New York, Stewart Guarantee Title of Mexico and US based, First American Title. We at Baja Properties highly recommend title insurance to our clients. A title commitment
can be provided prior to closing, however the actual insurance policy is issued to the purchaser when they receive their Trust Deed in their name. Some properties have title insurance commitments in place removing any doubt of the status of the title. Some properties do not meet the guidelines established by the title companies. Baja Properties will only show investors properties which can and will meet the standards of title commitments and insurance.

T
hey say my father was born carrying a sword so powerful in its silver beauty that it would never touch the body of another man. A simple glance at the sun reflecting off its shiny tip was enough to send any man running back to his family. It was a sword of mercy, a gift from the gods, a weapon to end weapons; a gift to keep safe the sacred sweet water treasure of San Jose del Cabo. For centuries, we men of the sea, pirates they say, have protected the treasure of San Jose, that treasure left by the “Santa Ana”, a Spanish ship burned at sea in the late 1500’s. The Santa Ana dragged its way across the angry blue seas of the Pacific, its guns nearly underwater from the great weight of goods and gold. The ship was a strange sight to us men of the sea. My great great grandfather, a man with eyes white as the midnight moon, was there the day the Santa Ana, with its magic treasure, was burned and fell to the floor of the sea. He wrote that as the ship sunk, the mountains grew higher, the sea grew calm, the fish began to jump, and the clouds of the sky disappeared. As the barrels of gold and pearl kissed the ocean floor, the water grew pure, the cows grew fat, and the trees grew green. The people’s eyes cried tears of amazement. The stars danced lazily to new homes across the sky. On this day, Baja and our Sea of Cortez changed forever, and my great great grandfather knew he had to keep it this way. He knew if the treasure was moved, all this magic would be undone, that paradise would be lost. For the next one hundred years, ships sailed angrily into our Sea, seeking our magic treasure. My people were always silently awaiting, beneath the mountains of Lands End or along the golden sand beaches. Ships came with cannons, with people of all colors, with guns. Vizcaino landed in Los Cabos, staying just south enough of our treasure, before he headed north to discover San Diego and Santa Catalina in 1602. He was one of the lucky ones. Many times there were battles and blood, smoke and fire, strange diseases and sickness. It is said, in time, the gods became tired of the fighting

in this magical place. Someone, or something, was needed to keep the Baja beauty safe without the disaster of war and death. If our treasure was taken, the majesty of Baja would be undone. They blessed my father with his magic sword to end the violence.... a sword so beautiful it would never see a drop of blood. My father sailed the Sea of Cortez, watching over the shining magic treasure, for 50 years. As a ship came near, he would weave his way frantically to the bow of the ship, his shipmates watching in amazement under the bluest of skies, and hold his sword mightily into the Baja breeze. It is said that the sun would reflect off the magic silver sword for endless miles, all the way to the stars, and the ships would quietly turn away. They say music would descend from the sails of my father’s pirate ship, lulling the foreign sailors to sleep. With the visiting men sleeping, the pirates would jump onto their ships and turn them back where they came from. My father performed his duty to protect the magic treasure of the Santa Ana until one day the ships stopped coming, at the order of kings and queens across the world. On the day my father died, in front of tens of ships of the treasure’s faithful protectors, he set his sword calmly into the sea, where it sleeps quietly above the sacred treasure. Anyone who comes to take the treasure is sent away by the timeless sword, the sword that keeps our magic treasure safe, keeping the skies blue, the oceans full of fish, and the sun rising each day. Though a pirate will never be known as a hero (it is true my people were often not the most respectful), the lands of Los Cabos have us to thank for their majesty. So as I lay here in the year 1850, preparing to join the sun along its nightly descent into the universe, I leave you this legend on the most precious of palm leaves, written with the most precious of cactus needles, that shall live as long as the treasure of San Jose is kept safe by a magic sword in our magic sea. efore Baja became home to its inviting mexican culture, and long before gaining its international reputation of rich in beauty and opportunity, the truest of Baja natives were silently going about their business in the deserts and mountainsides of this unique state. The flora of Baja offer a chance to view a rare combination of vegetation. The peninsula is home to 125 plant species that cannot be found anywhere else in the world along with a number of vineyards and farms producing fruits and vegetables. When speaking of the plants of Baja, botanists divide the state into three regions; the California region, the Sonoran desert, and the Cape region. The California region offers an extension of the vegetation of the state of California (or vice versa), and is home to many wine producing vineyards and fruit trees, especially in its higher altitudes. The Sonora desert region offers some of Baja’s most unique, if not peculiar, plant species. Barrel cactus, cholla cactus, elephant tree, organ pipe cactus, prickly pear, and the cirio are just some of what are found in the desert region. Most memorable and unmistakable is the cirio plant, looking as cacti viewed through the lens of fairy tale. The cirio seems a cactus too lazy to grow arms, opting instead to pull itself as close to the sky as it will would allow, searching for the elusive rain sleeping in Baja’s morning clouds. The deserts of central Baja are filled with these magnificent, protected plants. Should you take the trip up Highway 1 to explore, make sure to keep one eye on the road as you gawk at the strange and alluring cirio. The Los Cabos area offers a great chance to get to know, and grow, many of the plants found in both the Sonora desert region and the California region. The East Cape region, where los cabos resides, is home to many of the types of cactus found in the desert, but also offers a number of low spreading trees and more dense vegetation due to the increased rainfall in mountains and higher altitudes. That’s right, rain in Baja! To get to know some of the region’s vegetation, take a short trip to the Pacific side and try some fresh strawberries and vegetables, or take a look at some of the wonderful gardens many Cabo area residents have graced their home with. Don’t miss the opportunity to dine on nopales, the round, low to the ground, flat looking cactus that tastes great in salad or authentic mexican dishes. As seems the case with so much of what Baja offers, the plants (flora) of the region are unmistakably unique in their beauty, offering yet another opportunity for some unforgettable Baja memories. The Corridor

The plant spends a minimum of 8 years maturing, after which it is suitable for fermentation, then undergoing a process of pruning and harvesting, as farmers do their best to insure the quality of the plants natural sugars. the first Marlin
A Letter to John Michael Schaible, January 9, 2006 Hey Pal, Well, you finally did it.. you caught your first marlin! I know it took us a while, but you had to warm up to it... deserve it. We had fun catching sierras and dorados, huachinangos and roosters, but your 10 now, and caught that 60lb rooster this summer and the giant squids. You worked hard and learned how to stand up to a tuna, fish sardines, run Panga Bella, and tie a perfect knot. It was never a matter of “if ” you would catch a marlin, just when. Marlin are special... some people fish all of their lives and never get the chance to battle one, but you’ve grow up here in Los Cabos where we have the chance to catch one just about any day of the year. Growing up in New Jersey I remember fishing for fluke and bluefish with my Dad and Brothers when I was your age. Marlins were those majestic monsters I would see on the cover of the magazines in the pharmacy, and I always imagined the exotic places and those lucky people fishing on those beautiful boats. Like you I got hooked on fishing when I was young and wanted to go offshore whenever I could. I started fishing for sharks and tuna when I was in High School and soon after became a mate on board Skip Boyles charter boat Lifesaver. We are spoiled here in Cabo being able to fish for big boys only a few miles from the marina, in Jersey we use to have to leave in the dark, or the day before to get to the continental shelf 80 miles or more offshore. We would target tuna, and caught a bunch, then one day a Blue Marlin came up and ate a green machine lure that was catching Longfin Tuna all day long. I remember it even though it was about 16 years ago, Skip was running the boat, Joe Kelly and his family from Lavalette were the charter, and we were fishing the 100 fathom curve of the Lindenkoll Canyon. The blue was about 300lbs and was tail wrapped so the fight took a long time. I remember her coming up backwards, her sides were brown and she wasn’t fighting anymore. I un-wrapped her from the leader and grabbed her bill trying to revive her. I held her upright and swam her next to the boat for what seemed like forever but she wasn’t responding. We really wanted to release her alive but it wasn’t looking good, Skip made the decision that we had to put her in the boat and take her home. I remember putting a gaff towards her head but hesitating for a moment when suddenly she moved her eye, she was still alive. We gave her more time to swim and after a few minutes she started moving her tail, her brown sides started turning gold and her back deep blue, she was ok, so I let her go... I remember her swimming off and thinking how much more special this first Blue Marlin was because she lived to fight another day. Since that day I have always had a deep respect and appreciation for marlins and that day is probably one of the reasons why I wound up living my life here in Los Cabos. I have helped lots of people catch their first marlin but helping you was different as we have been fishing together since you were 2 years old, so this day was very important to me too. When you were standing on stage next to me at the Bisbees awards banquet holding that big check for winning the release division, I knew it was time for you to catch one, to join the club exclusive to us fisherman who get the thrills from the battle with that beautiful fish and the satisfaction of letting them go alive to fight another day. I decided to write you this letter because I want you to remember exactly how, when, where and why you caught that fish, so maybe one day, when you help someone catch their first marlin you will be able to share your story with them too. It was Sunday and we were planning on fishing on the panga for small tunas and dorados. Fishing wasn’t great close to San Jose and we would have had to run pretty far to find any fish so I called you with a choice, we could fish the panga like we planned or we could fish aboard Las Mananitas with Capt. Maury and try to catch your first marlin. I knew our chances were good as good reports were coming in from the boats fishing the Pacific side. Your reaction was predictable I didn’t have to convince you, just your Dad. You were in the background yelling “please, please Daddy” as we talked, I explained to him that the timing was right and I thought
The Line-Up is easy to find as you know you are there when the Old Falso lighthouse at the middle of the hill lines up with the New Falso Lighthouse on the top. Because of the boat traffic we decided to drift fish with live mackerel, we put two down deep with weights and let one swim free on the surface. I was in the cockpit with your Dad holding one of the deep rods with the surface rod in a holder next to me and Maury was fishing another deep one off the bow while you and Eduardo did laps around the boat, not staying in one spot for more than a few seconds. The seas were flat calm and we saw whales swimming by, spouting as they went and showing off their tails as the sea lions floated by lying on their backs sunbathing not caring about a thing. As you were racing Eduardo back to the cockpit from the bow you picked up the surface rod. You didn’t have it in your hands for more than a minute before the line started peeling off the reel, I showed you how to set the hook and the battle was on! She came up jumping a few hundred meters off the stern, a Striper of about 140lbs as Dad helped you get in the chair and you settled in for the fight. We were using the bait rods that were only spooled with 30lb test line and 15 feet of 90lb leader, the light line helps us to get the bite but makes it harder to put a lot of pressure on the fish. The fish fought on the surface for a while and Maury backed down after her so you could get some line back, but when she went deep you had to do all the work. There were times that you thought the fish was going to win and you thought of asking
We celebrated while Maury brought us back to the spot where we got the bite, we still had some time before we had to leave in order to keep our schedule of being home by noon. It didn’t take long until we got another bite, this time Eduardo grabbed the rod and jumped into the chair. After watching how you did it he did a great job and after a while I grabbed the leader and
released Eduardo’s first marlin as well. Mission accomplished! We would have been back to the marina by noon but you guys needed the full treatment that people get when they catch their first marlin. The myth, rumor, tradition is that you need to get thrown into the water after catching your first billfish or you will never catch another... so you and Eduardo had to go swimming and your Dad and I were glad to toss you both off the boat. I am proud of you! Not only for doing a good job fighting that big fish but more importantly because, you get it... you love to be out there, regardless of what we catch and you understand how important it is for us to let the marlins go so they can live to fight another day, and who knows, maybe you will meet that same marlin again some day when both of you are bigger, stronger and wiser... Congratulations on your first! I know it won’t be your last, just the start of a long life in Los Cabos that I am sure will include many marlins, but this one, this day was special, you will never catch your first again and for that it is a day that I will always remember and be proud...

In December and January huge schools of Greenback Mackerel move South along the Pacific coast as the water cools, they settle into fishy spots like canyons and seamounts and attract the attention of hungry Striped Marlin that follow the mackerel from their breeding grounds off Magdalena Bay. We were fishing a place called the Line- Up, on the 100 fathom curve of the Falso Canyon, a popular spot for the charter fleet as it is a short trip and has a lot of structure that holds the bait and attracts the marlin.
for help, but that was not an option. I told you then that you will appreciate it more and enjoy it more after you were done and able to do it all by yourself. You fought your marlin for over 30 minutes until she got close enough for me to grab the leader and it to officially be a catch, she was still fighting hard when she got to the boat and all I had to do was pull on the leader to break the knot and release her. She swam away so fast that I am not sure how much you saw of her but let me tell you... She was beautiful!

The park boundaries stretch from the Bay of Las Barracas to the north, to the Bay of Los Frailes to the south. The area’s nutrient rich waters results in a plankton rich environment that form the base of a vast food web of invertebrates, fish, birds and mammals, making the Sea of Cortez one of the most productive waters in the world. Coral reefs like Cabo Pulmo, created over centuries, are often called the rainforests of the sea because of their magnificence and biological richness. The reef at Cabo Pulmo is the only hard coral reef in the Sea of Cortez and one of only three living reefs in North America. The reef is made up of eight hard coral fingers scattered throughout the bay. Four finger reefs extend from the center of shore: two solid lengths called Las Navajas, an unnamed broken length used by (harmless) nurse sharks as a breeding zone and a solid, kilometer long finger known as El Cantil. Running more or less parallel to the shore are the reef fingers of La Esperanza, El Baja de los Meros and Outer Pulmo. Soft coral heads can be found at El Islote, a rock island near La Esperanza and at Las Casitas, rock caves just off Corral de Los Frailes at a depth of 45 feet. O
ne of the most thrilling events to occur in Baja California is the annual Grey Whale migration. The Grey Whales amazing journey begins in the Bering and Chukchi Seas and ends on the shores and lagoons of Baja California Sur. It is considered the longest migration of any mammal in the world and is more than 6000 miles each way. The trip takes about 2 and a half to 3 months. After almost being hunted to extinction, the Whales now represent a successful international conservation effort. How do you know if you’ve seen a gray whale and not some of the other whales that frequent our waters? The gray whale has no dorsal or top fin. About 2/3 of the way back on its body is a prominent dorsal hump followed by a series of 6 to 12 knuckles along the dorsal ridge that extends all the way to its fluke (tail). Its flippers are paddle shaped and pointed at the tips. Its fluke is about 10 to 12 feet across, pointed at the tips, and deeply notched in the center. Gray whales reach sexual maturity at 5 to 11 years of age or when they reach about 35 to 40 feet in length. Gestation is 12 to 13 months. Females bear a single calf, at intervals of 2 or more years. Courtship and mating behaviors are complex, and frequently involve 3 or more whales of mixed sexes. Mating and calving occur primarily in the coastal waters of Baja California Sur, although sometimes they can’t wait until they get here.
There is no place on earth where more whales can be seen at such close range than around the western coastal waters and lagoons of the Sea of Cortez in Southern Baja. The whales like the shallow water and can easily be seen during the months of December, January, and February through March. Towards the end of March the Whales begin their northern trek, with newly pregnant whales and new mothers with plump 5 ton calves in tow. Visitors to Los Cabos during the winter and early spring months will witness dramatic up close displays of 40 foot whales leaping out of the Sea, spouts of water shooting straight up like a geyser out of the water and will hear the mighty blow. Mothers and calves will come almost to the shore at some sandy beaches and the rambunctious males will leap and splash, providing quite a performance. Mothers are very protective of their calves, and have earned the name Devilfish from early whalers in the lagoons because of their violent behavior. Most people will admit that the day they looked a whale in the eye their life changed just a little bit. It’s a mighty experience to coexist with nature and to witness it in its purest form. We highly recommend that you take the opportunity to go on a whale watching boat trip or an all inclusive airplane and panga adventure to Magdalena Bay which will give you an incredible up-close experience.
