Obama: China’s neighbors must not be ‘elbowed aside’

Kingston, Jamaica, AFP, Thursday 4/9/2015 – US President Barack Obama warned Thursday that China shouldn’t “elbow aside” countries it is in conflict with in the South China Sea, where the United States has sounded an alarm over Chinese construction on disputed islands. Speaking from a town hall meeting while on a visit to Jamaica, Obama warned against aggressive acts by China while at the same time welcoming its strong economy and global reach. “Where we get concerned with China is where it is not necessarily abiding by international norms and rules and is using its sheer size and muscle to force countries into subordinate positions, and that is the concern we have around maritime issues,” Obama said responding to a question about the South China Sea. “Just because the Philippines or Vietnam are not as large as China doesn’t mean that they can just be

elbowed aside.” His comments come as the US warned that Chinese efforts to enlarge and build up disputed islands in the South China Sea are a threat to regional stability. A newly released set of satellite images revealed that China is artificially expanding a reef in disputed waters, presumably to strengthen its territorial claims. “In our view, China’s land reclamation and the construction activity are fueling greater anxiety within the region,” State Department spokesman Jeff Rathke told reporters. AT&T to pay $25M penalty for data breaches in PHL, Mexico, Colombia Washington, United States, AFP, Wednesday 4/8/2015 – AT&T will pay a $25 million fine for “lax security” at overseas call centers where employees stole personal data for mobile phone traffickers, US regulators said Wednesday. The Federal Communications Commission announced the settlement in the case which affected some 280,000 AT&T customers. FCC officials said the lack of security at AT&T call centers in Mexico, Colombia, and the Philippines allowed employees in those locations to steal personal information which could be used to “unlock” stolen phones. The employees “provided that information to unauthorized third parties who appear to have been trafficking in stolen cell phones or secondary market phones that they wanted to unlock,” an FCC statement said. The breach allowed those in the scheme to get customer names, full or partial social security numbers and other data that could be used to submit an “unlock” request to the big US telecom carrier, allowing them to resell stolen devices. Beijing, China, AFP, Thursday 4/9/2015 – Beijing reaffirmed its right to build on disputed islands in the South China Sea on Thursday after satellite imagery emerged of construction operations turning tropical reefs into concrete artificial islands. The newly released images prompted concern from the United States, which warned China that its island building activity posed a threat to regional stability. “In our view, China’s land reclamation and the construction activity are fuelling greater anxiety within the region,” State Department spokesman Jeff Rathke told reporters. Rathke said Washington is concerned that China “might militarise outposts on disputed land features of the South China Sea.

Staff at the Philippine embassy were alerted to the plight of Abby Luna, who claims she was raped and beaten by her

employer’s son, after she posted the video on her Facebook page on Thursday morning. The video attracted about 78,000 shares and 19,000 likes. “The rescue was prompted by the video message... She is now under the care of our embassy,” foreign ministry

BI reminds foreigners: Secure ECC before leaving MANILA, Apr 9 (Mabuhay) – Foreign nationals leaving the Philippines should first secure an emigration clearance certificate (ECC) to avoid being denied departure. The Bureau of Immigration issued this reminder after noting about a third of foreign travelers were denied departure because they failed to present ECCs. “It is unfortunate that we have to deny the travel of our foreign friends, but we have to implement the law,” BI spokesperson Elaine Tan said. Citing airport statistics, she said foreign nationals who failed to present their ECCs comprised 33 percent of travelers denied departure. Under Section 22-A of the Philippine Immigration Act, a foreign national about to leave the Philippines temporarily or permanently should seek clearance from the BI Commissioner. This seeks to ensure the foreign national has no pending obligation with the Philippine government. On the other hand, Tan warned against fixers. “We likewise warn our foreign friends against fixers who issue fake and fraudulent ECCs to unsuspecting victims. We encourage them to file the ECCs by them-

Luna said her employer did not believe her claims of being raped and beaten and insisted she finish the remaining two months of her contract before she could go home. Her employer also told her to have an abortion if she fell pregnant, she added. Luna is among an estimated 10 million Filipinos working overseas to escape poverty and high levels of unemployment in the Philippines. Many overseas Filipino workers, who account for a tenth of the country’s population of 100 million, work in menial jobs and endure dangerous working conditions. Last year, a Filipina maid, Nargelene Mendez, was rescued from a house in Saudi Arabia after posting a video on her Facebook page claiming her employer had abused her. Maids working in the Middle East frequently suffer abuse. Human Rights Watch has called on the United Arab Emirates to reform a restrictive visa system and pass a labor law to stop domestic workers from being exploited.

Pinay mom charged after teen falls to death in Hong Kong Hong Kong, China, AFP, Thursday 4/9/2015 – The Filipina mother of a teenager who plunged to her death from an upmarket Hong Kong apartment was released on bail Thursday after being charged with neglect, as her lawyer told of the “unraveling” of their happy family life. Herminia Garcia emerged from court hand in hand with her British partner Nick Cousins, a businessman, who was also arrested after the 15-year-old’s fatal 21-storey fall. Although police said there was “no suspicious element” to the tragedy, they detained the teenager’s parents on suspicion of “ill-treatment or neglect of a child or a young person”. Cousins, 58, is the managing director of the Hong Kong office of British multinational Jardine Lloyd Thompson (JLT), one of the world’s leading insurance brokers. He is already on bail and has not yet been charged with any offence, while Garcia, who goes by the name Grace, was charged with neglect. The 53-year-old was also charged with overstaying her visa, while Cousins is be-

ing investigated for aiding or abetting the overstay. The couple are not married. Garcia is a former domestic helper, according to local media. The couple also have a younger daughter. Garcia appeared before magistrates in Hong Kong Thursday where proceedings were interpreted for her in Tagalog – a Philippine language. Cousins accompanied her, sitting in the public gallery, often with his head bowed. The charge sheet said that Garcia’s treatment of an unnamed 14-year-old “Child X” was likely to cause “unnecessary suffering”. No further detail of the neglect charge was given. Garcia’s lawyer Christopher Morley told the court how Garcia had lived a “happy normal life with her de facto husband” before her daughter’s death, which had led to the “unravelling situation” for the family. He asked that Garcia be released on bail on humanitarian grounds. “This lady is grieving from the loss of her beloved daughter. If she is remanded in custody, she will be denied the support of her family,” he said.

US, PHL, Japan stress unity at WWII memorial Mount Samat, Philippines, AFP, Thursday 4/9/2015 - Philippine President Benigno Aquino and the US and Japanese ambassadors on Thursday vowed to work closer together in facing new challenges like maritime security and “terrorism” at a World War II memorial event. Aquino and the two envoys made the promise on the anniversary of the “Fall of Bataan” – marking the surrender of US and Philippine forces to Japanese invaders in 1942. “We stand united with former allies and foes in continued pursuit of widespread peace and prosperity throughout the world,” Aquino said at the Mount Samat shrine overlooking the Bataan battlefield. Aquino cited the swift assistance extended by the US and Japan particularly during disasters like Super Typhoon Haiyan in 2013 as an example of the generosity of these two countries. “I wish to express our heartfelt apologies and deep sense of remorse for all who suffered during those fateful days. We all remember and never forget what happened here,” Japanese ambassador Kazuhide Ishikawa said at the same event. But he added that Japan had since become a democratic nation, a close partner and ally of the Philippines and US. The Philippines and Japan have been broadening their security cooperation at sea as they both deal with their own respective maritime territorial disputes with an increasingly aggressive China.

The US has also been expanding its own defense cooperation with the two country’s as part its strategic “pivot to Asia”. US ambassador Philip Goldberg hailed the valor of the Filipino and American soldiers in World War II and also praised the 44 Philippine police commandos who were killed in January while hunting down two militants on the FBI’s “most wanted terrorist” list. Malaysian Zulkifli Abdhir was killed in the raid, while Filipino Abdul Basit Usman, who the US describe as a “bomb-maker”, escaped. But the heavy death toll proved an embarrassment to Aquino, and raised questions about the US role in the operation as American personnel were apparently monitoring the Filipino forces. Goldberg stressed that the US mutual defence treaty with the Philippines was “ironclad”. “Whether we are fighting terrorism or responding to the devastation of natural disasters, we face them together. And when the Philippines is threatened, it is not alone,” he said. His remarks came amid concerns over the extent that the US would support the Philippines in a dispute with China. “Let us not forget that 70 years after the end of World War II, we are joined in our efforts to protect the security and defense of this region by Japan. Yesterday’s enemies are today’s allies and strategic partners,” the US envoy added.

Fish, other food prices should stay down due to cheap fuel – LPG-MA MANILA, Apr 9 (Mabuhay) – House Deputy Minority Leader and LPG-MA Party-list Rep. Arnel Ty on Thursday said prices of fish and other food products should stay fairly low as long as fuel costs are down. “Fuel is the single biggest expense in fishing operations, and since fuel costs are down, there’s no reason for fish prices to go up,” Ty said. “Depending on the size of their vessels and onboard refrigeration, commercial fishing operators spend around 30 percent of their income on fuel,” said Ty, a minority bloc in the House committee on trade and industry added. Galunggong was quoted at Php140 per kilo and alumahan at Php200 per kilo in Metro Manila’s public markets, as of April 7, based on a survey by the Philippine Statistics Authority. “The deflationary impact of cheaper oil on consumer prices is widespread. It cuts

across a broad range of food production, processing and manufacturing industries that are driven by fuel. So overall, food prices ought to stay depressed,” Ty pointed out. Meanwhile, partially due to the steep drop in fuel costs, tuna prices, which have fallen from a peak of US$ 2,350 per metric ton in 2012 to a low of US$ 1,175 per metric ton in 2014, have remained deflated, according to COL Financial Group Inc., the Philippines’ largest online stockbroker. In a research report, COL Financial said the Philippines’ biggest tuna canner, Century Pacific Food Inc. “is taking advantage of low tuna prices by stocking up inventory, considering that once canned, the shelf life of tuna is extended to three years.” Oil firms rolled back their pump prices by Php0.65 per liter for gasoline, Php0.15 per liter for diesel, and Php0.25 per liter for kerosene on Tuesday.

Cayetano calls for 30-day moratorium on ‘no plate, no travel’ policy MANILA, Apr 8 (Mabuhay) – Senate Majority Leader Alan Cayetano on Wednesday called for a 30-day moratorium on the “No Plate, No Travel” policy being implemented by the Land Transportation Office (LTO), saying “it’s unduly punishing motorists for the agency’s inefficiency.” Cayetano made the call after the LTO and its license plate contractor reportedly failed to deliver and process license plates on new vehicles. “People should not bear the burden of government inefficiency. Vehicle owners are penalized for not having license plates that the LTO and its private contractor failed to deliver on time,” he said in a statement. “Media earlier reported the delay in the issuance of license plates by the LTO, creating an unnecessary backlog. Plus car dealers cite the insufficient LTO manpower involved in the releasing of plates. Thus, even though plates have been made available, issuing [these] to vehicles has been a slow process,” he pointed out. The senator said a 30-day moratorium should straighten out “kinks” in the process, without unduly punishing motorists with fines. The moratorium, he said, will give the private contractor time to produce the new plates, the LTO to overcome the backlog and car dealers to immediately claim the car plates of buyers. Car dealers earlier claimed they have paid LTO for the plates. And to make sure the public would not be punished unwittingly because of government inefficiency, Cayetano said he will file a bill which will hold government officials and private contractors liable and accountable when there is a delay in government agency’s actions, which ultimately causes inconvenience to the public.

MANILA, Apr 10 (Mabuhay) – Backed by retired military and police officers, former senator Panfilo Lacson said he is open to run for president in the 2016 elections. “Yes, I confirm,” Lacson said in a text message on Friday when asked about his reported intention to join the presidential race. “Last night, I was invited by several retired AFP and PNP officers, some of whom were not able to sign the manifesto that came out in the newspaper ads and most of them pledged to help in the effort even before I make the decision to go for it. That’s where we are now,” he said. AFP is Armed Forces of the Philippines, while PNP is Philippine National Police. Lacson was PNP chief during the time of then President and now Manila Mayor Joseph Estrada. The manifesto he was referring to was a full-page ad signed by 35 retired police and military officials that recently appeared in broadsheets urging both Senator Grace Poe and Lacson to “run in tandem for higher office in 2016.” Asked if he would run as an independent backed by retired military and police officers in case he makes a final decision, Lacson said: “For a start, yes, that’s where it stands.” “Politics in our country and even in other countries of the world is always bound by numbers, and support from political parties and groups is largely dependent on the winnability of prospective candidates. At least that’s what I learned in the 12 years

that I spent in the Senate.” “Of course, there are those who support because they are believers and share the same advocacies as their prospective candidate. Let’s face the reality that most of our political leaders are natural fencesitters which is a normal course in politics,” he further said. In an earlier radio interview, the former senator categorically said that he is open to run for the highest position in the land. “When asked if I’m considering another run for the presidency, I said, “if you are asking if I have the intention, yes, I have the intention but my decision will depend on many factors which I am currently discussing with my old and new regional leaders, coordinators and volunteers,” Lacson said. “I also mentioned that while I’m rating very high in the senatorial surveys (58.3% as of the latest Pulse Asia survey), the same amount of support and approval do not seem to resonate in the presidential survey. So I asked them to find out why and think of ways to translate even a fraction of that 58% into a higher position,” he said. Lacson earlier said that he would make a decision about his plans in 2016 either in August or September this year. “August or September this year should be a practical time to decide,” he said in a text message last March 26. Carlo J. Caparas refuses to enter plea in tax evasion case MANILA, Apr 9 (Mabuhay) – Film director Carlo J. Caparas refused to enter a plea during the arraignment of his P101million tax evasion case. The Court of Tax Appeals Third Division then entered a not guilty plea on behalf of Caparas as required under the rules. Caparas refused to enter a plea due to a pending petition with the Supreme Court. Caparas is facing a case for violating the National Internal Revenue Code (NIRC) for failing to file Value-Added Tax (VAT) returns for the years 2006 to 2009 resulting

in tax deficiencies of P101,819,722.19. Caparas was investigated by the BIR when a television newscast reported about two television shows funded by the Philippine Charity Sweepstakes Office (PCSO) and produced by Caparas caught the attention of the BIR. The two shows titled “Ang Pangarap Kong Jackpot” and “Kroko” were apparently part of the P1.3-billion contracts entered into by PCSO and Caparas, for which he received a total of P850.95 million from the years 2006 to 2009.

Purisima firm on not allowing lawmakers to access his phone records MANILA, Apr 8 (Mabuhay) – Former Philippine National Police chief Alan Purisima has remained firm in his resolve not to allow lawmakers to take a peek into his phone records to determine who he was communicating with during the Mamasapano anti-terror mission. At the House of Representatives’ third hearing Wednesday on the botched police mission, Purisima rejected ACT-Teachers party-list Rep. Antonio Tinio’s request for the joint House panels to obtain a log of the phone numbers the resigned police chief called and texted last Jan. 25. “The same request was made by the Senate, but I did not agree to give a waiver,� he said.

Purisima remained unmoved even after Tinio said the committee was not interested in obtaining the actual text messages on Jan. 25, but just the time log of sent and received text messages, including the numbers he was communicating with. “When we agree that the record of telcos be opened, it does not necessarily mean they can filter the data that they collected. It may be used for other purposes, that’s why I don’t agree,� he said. Last February, Purisima turned down the request of the Senate committee on public order and dangerous drugs to sign a waiver for Smart Communications to release his phone records during the Mamasapano police mission.

Senate panel urged to invite Cardinal Tagle, Davide to BBL hearing MANILA, Apr 9 (Mabuhay) – Senator Nancy Binay wants Manila Archbishop Luis Antonio Cardinal Tagle, former Chief Justice Hilario Davide Jr. and other convenors of the National Peace Summit to attend the resumption of the Senate public hearing on the proposed Bangsamoro Basic Law on Monday. In a press statement issued Thursday, Binay asked Sen. Ferdinand Marcos Jr., chairman of the committee on local government, to invite the ‘citizen leaders’ earlier tapped by President Benigno Aquino III to review the proposed BBL to be present at the hearing. “I am urging Senator Marcos to invite them as resource persons to the hearings on the Bangsamoro Basic Law. Their presence in the hearings will not only ensure that every sector is well represented but also provide for more information that will lead to a better understanding of the Bangsamoro Basic Law,� she said. Binay believes Cardinal Tagle, Davide, businessman Jaime Augusto Zobel de Ayala, former Ambassador Howard Dee, and peace advocate Bai Rohaniza Sumndad-Usman can aid the Senate committee in making decisions pertaining to the BBL. “Hingan po natin ng komento ang lahat ng concerned dito. It seeks to create the Bangsamoro political entity which will replace the Autonomous Region in Muslim Mindanao. It will also specify wealth- and power-sharing arrangements between the national government and the new political entity. Mamasapano clash The criticisms against BBL snowballed following the bloody Mamasapano clash that resulted in the deaths of 44 Special Action Force commandos, 17 Moro Islamic Liberation Front fighters, and five civilians. The Senate committee suspended its hearing on the proposed BBL to get the clearer picture on the incident, which was initially blamed on the the MILF members who allegedly engaged the SAF troops in a firefight when the latter neutralized Malaysian terrorist Zulkifli bin Hir alias Marwan on January 25.

Iqbal alias, MILF ‘deception’ may affect peace pact – Marcos MANILA, Apr 9 (Mabuhay) – The revelation of chief rebel negotiator Mohagher Iqbal that he used an alias raised many questions and could affect the peace agreement, said Senator Ferdinand “Bongbong� Marcos Jr., who accused the Moro Islamic Liberation Front (MILF) of deceiving the government. Marcos, chair of the Senate committee on local government, said Iqbal’s disclosure raised many questions that would need to be answered when hearings on the Bangsamoro Basic Law (BBL) resumed on Monday, April 13. Marcos suspended his committee’s hearings on the BBL following the deadly Mamasapano, Maguindanao, clash last January 25, when 44 police Special Action Force commandos were killed. The senator said he would bring up the revelation at the resumption of the hearings on the BBL, citing its possible implications on the peace agreement which Iqbal signed as the chief negotiator for the Moro Islamic Liberation Front (MILF). “I will bring it up. This is an important revelation and raises many questions,� he said. “We need to find out the implications of this,� Marcos said in a text message

to reporters who sought his comment on Iqbal’s revelation. Questions have been raised whether the peace agreement between the government and the MILF was still valid since the rebel group’s negotiator used an alias in signing it. The BBL, which would create the Bangsamoro entity in Mindanao, is an offshoot of the peace pact. The illegal use of an alias is a crime under Philippine law. “Who notarized the agreements he signed and what were the documents he represented identifying himself as Iqbal?� Marcos said. “Beyond legal implications, it calls into question the MILF’s good faith in interring into the peace agreement. Why deceive the Philippine government in this way? I will try to get some answers on Monday,� he added. The senator said he wanted to know why Iqbal used a pseudonym. “Why did he feel needed to hide [under] an alias? Who is he? Did the GPH panel know this?� he asked. Marcos said he already invited Iqbal to Monday’s hearing but the latter had not indicated if he would be coming. “His presence, I will strongly encourage,� the senator said.

The Senate panel, headed by Senator Grace Poe, had wanted to obtain Purisima’s call and text log to verify the timeline he gave regarding his correspondence with President Benigno Aquino III on Jan. 25. Wrong information At a private meeting with lawmakers in February, President Aquino said he felt Purisima “lied to him� by telling him “help was already on the way� for the SAF (Special Action Force) troopers trapped in a gunfight with Moro rebels in Mamasapano on the morning of Jan. 25. Purisima told lawmakers at the House joint panel probe on Tuesday that he sent his first text message to Aquino at 5:45 a.m., when he informed the President of the ongoing SAF operation to arrest high-

profile terrorist targets in Mamasapano. Their correspondence continued until around 11:38 a.m, when Purisima informed the President that the SAF troops involved in the operation had begun withdrawing from the area. However, Purisima (then-suspended PNP chief) did not receive a reply from the President. Purisima texted Aquino again at around 6:20 p.m. informing him of the heavy casualties suffered by the SAF in a clash against members of the Bangsamoro Islamic Freedom Fighters, Moro Islamic Liberation Front and other armed groups. Over 60 individuals, including 44 SAF troopers, died in the botched police operation. (MNS)

But since his disability has given him two distinct personalities when he is not taking his medication, client’s second personality whom we will call client 1-B, as distinguished from client 1-A who mortgaged the truck the first time to the first check cashing store, decides to mortgage the same truck to the second check cashing store. This time, the interest is less than the first. It’s only 98.95% annual interest. That’s 12.05% savings on interest per year right there. Client 1-B can’t wait to tell client 1-A later that he got a better deal on the loan! Client 1-A has stopped paying the installment payments on the first loan since February. Client 1-B has stopped paying the installment payments on the second loan since March. Both client 1-A and client 1-B now agree that it’s panic time because both of them signed power of attorneys allowing the 2 loan sharks to sell the same truck upon default. To prevent the loan sharks from selling his beloved truck, client decides to seek bankruptcy relief. A Chapter 7 will not work because the same truck secures both loan sharks. Chapter 7 will discharge both loans, but all hell will break lose when two loan sharks sell the same car. Two buyers will claim ownership over the same truck. We do not want to have this kind of situation. It’s hard enough to get my software to understand that the same truck has been mortgaged twice. Chapter 13 will protect his truck by preventing the exercise of the power of attorney to sell the truck, and allowing the two secured loans to be paid over 60 months at zero interest. Both client 1-A and client 1-B decide to file for Chapter 13 because both concur that zero percent interest is a lot better than 111% and 98.95% interest! They agree to disagree on many things, but on zero interest, there is no argument from either one. Client No. 2 Client is only 32. I remember when I was 32, which was 3 years ago, or was that 3 decades ago? Wait, my son is 36, so how can I be 32 three years ago? I digress. Whatever, at 32, client obtained $30K of

credit card debt, which he used in college to supplement his student loans. College drugs to help you study better and to help you socialize, they don’t come cheap you know. He owes $120K of student loans. He tells me that he lost his job last December, and has not been able to obtain new employment thus far. Aside from wanting to get rid of all his credit card debt of $30K, he also wants to discharge his $120K of student loans. I told him that we can get all his credit cards wiped out, but it’s almost impossible at this time to discharge his student loans. When he starts to have two personalities like the first client, and that prevents him from getting employment, then it may be worthwhile to file an adversary case to discharge his student loans. But until then, we can only get rid of his student loans. “Fair enough,� said the young client. He said that he was paying $1,000 a month to keep the cards current, and he has been paying that amount since he graduated from college ten years ago. Well, that means he has paid out $120K to keep $30K of credit cards current for the last ten years since he graduated from college. So, I told him that if he did not have these cards ten years ago, he would have saved $120K now, and he can use that money which he would have saved to pay off all of his student loans now. Young client decides to seek Chapter 7 relief. Good decision. If he gets new employment, which I am certain he will eventually, he can pay off his student loans probably in ten years since he doesn’t have to pay credit cards anymore. And in ten years, the fact that he filed for bankruptcy will not even appear on his credit report. Manila, Philippines, AFP, Wednesday 4/8/2015 – The family of a Filipina on death row in Indonesia made a tearful appeal for her life on Wednesday, insisting that an international drug syndicate duped the single mother of two. Mary Jane Veloso, 30, has been in an Indonesian jail for five years after being caught at Yogyakarta airport with 2.6 kilogrammes (5.73 pounds) of heroin, and is among a batch of foreigners facing imminent execution. But in an interview with AFP in Manila, her parents and sister said a crime syndicate involving a friend had deceived her, and she did not know the drugs had been sown into her suitcase before flying from Malaysia. “Please don’t kill my sister. She is innocent. If you kill her, you will have blood on your hands,� Veloso’s elder sister Marites Veloso-Laurente said in a plea to Indonesian President Joko Widodo. With tears streaming down his cheeks, Veloso’s father said the syndicate that used her as an unwitting drug mule had pledged to kill all family members if they reported

the racket to authorities or went to the media.“Life’s been hard. We’ve been living in fear. My daughter’s recruiters have been threatening us... they threatened to kill us one by one,� said 59-year-old Cesar Veloso. The family is from a poor farming town about three hours’ drive north of Manila, and Veloso had sought to provide for her two young sons by working as a maid overseas. The single mother initially worked for nine months in Dubai in 2009 but was forced to come home after her employer tried to rape her, according to her father. A family friend then offered Veloso work as a maid in Malaysia. When Veloso got to Malaysia she was told the job was no longer available but there was another one in Indonesia if she flew there immediately, according to her parents. “My sister’s a loving person, she’s so kind. But she trusts too much. We don’t engage in vices or anything illegal, no cigarettes, no alcohol,� her elder sister said. When Veloso was arrested, her sons were aged just one and seven and they too have become victims.

During this period, three call center employees were paid by outside parties to obtain customer information that could then be used to submit online requests for cellular handset unlock codes, the FCC said. In Mexico, some 68,000 customers had data compromised, according to

investigators. The probe later was extended to call centers in Colombia and the Philippines. In those two countries, 40 employees were able to access the confidential data and sold information on around 211,000 customers, the FCC said. The FCC said the case represented its “largest privacy and data security enforcement action to date� and also requires AT&T to upgrade its security procedures and appoint a privacy compliance officer. AT&T said in a statement regarding the case that it sees customer privacy as “critical.� “We hold ourselves and our vendors to a high standard. Unfortunately, a few of our vendors did not meet that standard and we are terminating vendor sites as appropriate,� the company said “We’ve changed our policies and strengthened our operations. PHL, US set to hold expanded war games Manila, Philippines, AFP, Monday 4/6/2015 – The United States and the Philippines will double the size of their annual war games this month, with some exercises to be staged close to a South China Sea flashpoint, the Filipino military said Monday. The 10-day exercises between the long-time allies will be held as fears grow in the Philippines that China is seeking to take control of the strategically vital and resource-rich sea. Nearly 12,000 soldiers will be involved in this year’s edition in several locations in the Philippines, including a naval station directly facing the disputed waters, military spokesman Lieutenant Colonel Harold Cabunoc said. That number, which includes 6,600 American troops, compares with a total of 5,500 soldiers who participated in last year’s Balikatan (shoulder-to-shoulder) exercises, Cabunoc said. He emphasized the expanded war games highlighted the deepening military alliance between the Philippines and its former colonial ruler.

“The higher strength of Balikatan 2015 for this year only reflects the Philippines’ and the United States’ growing commitment to enhance our capability to conduct joint military and non-military activities,” Cabunoc told AFP. He said the decision to expand the numbers involved in the games was not directed at China, which claims nearly all of the South China Sea, even waters and reefs close to Southeast Asian nations and far from its nearest major landmass. However, part of the exercises will be held from Zambales naval base, which is located 220 kilometers (137 miles) east of Scarborough Shoal in the South China Sea. The shoal is a rich fishing ground within the Philippines’ exclusive economic zone but has been controlled by China since 2012. The Balikatan exercises, which start on April 20, will also be held on the central island of Panay, Palawan in the southwest and a former American airbase north of Manila. These men are the soldiers who fought America’s first ground battles of World War II. The United States Army awarded its first three Congressional Medals of Honor of World War II to Philippine Scouts: Lt. Alexander R. Nininger, Sgt. Jose Calugas and Lt. Willibald C. Bianchi, for their heroic actions on Bataan. Ultimately, all 80,000 American and Filipino servicemen in the Philippine Islands became Prisoners of War, and more than half of them died in Japanese prison camps. The Philippine Scouts were a unique and special U.S. Army organization consisting of highly-trained Filipino soldiers, and American and Filipino officers, who formed the backbone of General Douglas MacArthur’s United States Army Forces in the Far East (USAFFE). In the wake of the Japanese attacks on Pearl Harbor and the Philippines on December 7, 1941, the Philippine Scouts were reinforced by U.S. Army National Guard units and joined by Philippine Army Infantry divisions, and ordered to hold back the Japanese advance. On Bataan Peninsula and Corregidor Island these men were surrounded and starved out by the Japanese Army and Navy, but managed to fight on for more than four months while every other country and island in Southeast Asia and the Western Pacific succumbed to the Japanese. They bought America time to repair Pearl Harbor and throw a cordon of defense around Australia at the beginning of World War II. Today, less that 100 of the original 12,000 Philippine Scouts are still with us, scattered around the U.S. and the Philippine Islands. Those who are able to do so will meet in Long Beach, where families and admirers will join them for two days of discussions, business meetings, and celebration. As their numbers grow smaller, the Philippine Scouts Heritage Society seeks to preserve their memory and raise public awareness of the role these men played in the early stages of World War II, and the horrible treatment they received as prisoners of the Japanese Army.

OPINION Aquino not liable for breaking chain of command rule, De Lima maintains

MANILA, Apr 8 (Mabuhay) – Justice Secretary Leila De Lima on Wednesday maintained that President Benigno Aquino III cannot be held liable for breaking the chain of command rule of the Philippine National Police (PNP) as he is not covered by the said policy. At the resumption of the the House of Representatives’ hearing on the bloody Mamasapano clash, De Lima bucked the statement of former President Fidel Ramos that Aquino can be held administratively liable for the Mamasapano incident as he violated Executive Order 226 or the rule on “command responsibility” which the former President authored in 1995. “Doon sa EO 226 na sinasabi ni Pangulong Ramos, ang chain of command ay hindi pwedeng i-apply sa Pangulo (Aquino), in the same manner that he is the chief executive in all other executive offices and department. Under Section 1 of EO 226, “Any government official or supervisor, or officer of the Philippine National Police or that of any other law enforcement agency shall be held accountable for ‘neglect of duty’ under the doctrine of “command responsibility if he has knowledge that a crime or offense shall be committed, is being committed, or has been committed by his subordinates, or by others within his area of responsibility and, despite such knowledge, he did not take preventive or corrective action either before, during, or immediately after its commission.” De Jesus, for her part, pointed out that during a Philippine Military Academy graduation in 2013, Aquino categorically said that the AFP is under his direct “command responsibility.” But De Lima insisted that whether in terms of the operation of the AFP nor the PNP, the President is not covered by the chain of command rule. “Ang ini-insist ko po ay siya ay chief executice in civilian organization like the PNP, and as commander-in-chief when it comes to AFP, the President cannot be deemed to be part of chain of command. Senator Antonio Trillanes has made some serious accusation against Court of Appeals justices. The senator alleged that these “honorable” judges are receiving grease money in exchange for favorable court rulings. This is a serious allegation. Although he never mentioned the names of justices supposedly “on the take,” it was obvious that the Senator was referring to the recent decision handed down by the Court of Appeals preventing the Office of the Ombudsman to suspend Makati Mayor Junjun Binay from office for six months. The Philippines has 23 CA divisions, with 66 members in all headed by Presiding Justice Andres B. Reyes Jr. Trillanes also accused Vice President Jojo Binay’s family for spending a “fortune” for them to get a favorable injunction from the Court of Appeals for his beleaguered son, the Makati mayor. The Office of the Ombudsman has ordered the preventive suspension of Mayor Binay, while being investigated for alleged graft and corruption, the most recent of which involved the “overpriced” Makati car park building. This parking facility was constructed at a cost of more than P2 billion. Senator Trillanes revelations about corruption in the Court of Appeals, whether it is true or not, has put the entire judiciary in a bad light. People’s faith in the country’s judicial system will be further eroded as a result of the allegations made by the former naval officer, who won a Senate seat while in detention for his alleged involvement to overthrow the government. This is really bad for the country. People no longer trust President BS Aquino for lying every now and then. Same with some senators and House members, whose main intentions while in office are merely to fatten their wallets, instead of enacting laws meant

to spur economic growth and improve peace and order in the country. I do not know the real motive of Senator Trillanes for his exposé. Is it mere publicity gimmick or desire to cleanse the judiciary of corrupt “men in robes?” Senator Trillanes should back up his claims – that money changed hands as a result of a favorable court ruling Mayor Binay got from the Court of Appeals. I hope he will make good his promise to expose soon all the people involved, including those who received the bribe on behalf of the justices, the liaisons and how much was involved. Let us just wait if Trillanes will honor his promise. Meanwhile, any further investigations on the Mamasapano massacre should be terminated. It is just a waste of time. People already know that the President is deeply involved in the planning and execution of the botched police operation. The President’s allies in the Senate and the lower house will always shield him from any responsibility from the covert police operation that resulted in the brutal slaying of 44 SAF commandos. I pity former SAF Commander Getulio Napeñas. He should have told the truth from the beginning. Now he is trying to extricate himself from being responsible for the death of his fellow SAF officers in the hands of Muslim rebels. He once told the media that he is not absolving himself from any responsibility. He however said that other ranking government and military officials should stand up and be “man enough” to admit their culpability in the Mamasapano incident.

Newly-released satellite images on the website of the US-based Center for Strategic and International Studies (CSIS) think tank show a flotilla of Chinese vessels dredging sand onto a feature known as Mischief Reef. Before-and-after images of other outcrops in the Spratly Islands show aircraft runways appearing from jungle, smooth-sided solid masses where there once was coral and man-made harbours replacing natural reefs. Analysts say the pictures show how China is attempting to create “facts in the water” to bolster its territorial claim. Manila, among the most vocal critics of Beijing’s actions in the region, on Friday appealed to the international community to intervene conceding it and other countries were powerless to stop China’s construction of the artificial islands.

Ara Mina and Bulacan Mayor Patrick Meneses are rumored to be going through a rough patch and have supposedly ended their relationship before Holy Week. A reliable source claimed the breakup occurred when the couple had dinner at a restaurant in Quezon City last March 22. The source related seeing Ara walking out of the resto supposedly teary-eyed. Patrick was presumably seen walking some distance away from Ara. While the issue has spread online, the actress has yet to make a statement on the matter. On December 17, Ara gave birth to her and Patrick’s first born child, Amanda Gabrielle (baby Mandy).

In her 2012 interview, Ara said that she and Patrick are already talking marriage. “Oo naman. Nandoon na kami sa gano’ng usapan. Nasabi ko naman na before na ready na ako – ready na akong magpakasal. Asian legal group joins other advocates calling on Texas Appeals Court to allow Obama’s immigration action In a friend-of-the-court brief filed early this week in the federal appeals court in Texas, the Asian American Legal Defense and Education Fund joined more than 150 groups contending that President Obama’s executive immigration actions would allow millions of immigrants to apply for relief

from deportation and work authorization and would improve the nation’s economy and society. This brief was one of several in support of the Obama administration’s immigration actions, which economists predict will raise the GDP by more than $200 billion over the next 10 years.

USCIS reaches H-1B cap set at 20,000 visas; More petitions received than allowed by law WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated H-1B cap for fiscal year (FY) 2016. USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U.S. advanced degree exemption. USCIS will use a computer-generated process, also known as the lottery, to randomly select the petitions needed to meet the caps of 65,000 visas for the general category and 20,000 for the advanced degree exemption. USCIS will first randomly select petitions for the advanced degree exemption. All unselected advanced degree petitions will become part of the random selection process for the 65,000 general limit. The agency will reject and return filing fees for all unselected cap-subject petitions that are not duplicate filings. Before running the lottery, USCIS will complete initial intake for all filings received during the filing period, which ended today. Due to the high number of petitions, USCIS is not yet able to announce the date it will conduct the random selection process. USCIS will continue to accept and process petitions that are otherwise exempt

from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap, and who still retain their cap number, will also not be counted toward the congressionally mandated FY 2016 H-1B cap. USCIS will continue to accept and process petitions filed to: Extend the amount of time a current H-1B worker may remain in the United States; Change the terms of employment for current H-1B workers; Allow current H-1B workers to change employers; and Allow current H-1B workers to work concurrently in a second H-1B position. U.S. businesses use the H-1B program to employ foreign workers in occupations that require highly specialized knowledge in fields such as science, engineering and computer programming. California laments ‘dismal’ water cuts after drought call Los Angeles, United States, AFP, Tuesday 4/7/2015 – Californians cut their water use by a “dismal” 2.8 percent in February, officials said Tuesday, days after the state’s governor demanded 25 percent reductions to counter a historic drought. The cut compared to the same month in 2013 was the lowest since California began recording reductions in response to the western US state’s worst drought since records began, now in its fourth year. “Today’s ... results are very disturbing and provide even more support for the governor’s call for an immediate 25 percent mandatory reduction in urban water use statewide,” said State Water Board Chair Felicia Marcus. “Californians need to step up now—especially those who have not been doing their share .. We are in a drought like we’ve not seen before, and we all need to step up like never before,” she added. It said the “dismal conservation rate is the lowest monthly figure since the State Water Board began tracking the data in July 2014.” Governor Jerry Brown last week announced sweeping statewide water restrictions for the first time in history in order to combat the region’s devastating drought. Despite the drought—which has seen lakes and reservoirs sink to historic lows— many Californians continue to water their lawns and fill their swimming pools as if nothing was happening, according to a recent study. On average wealthier neighborhoods like Beverly Hills consume three times more water than less affluent ones, according to the study by researchers at the University of California Los Angeles (UCLA). “With income and water use so tightly bound together, further incentive must be given to higher water users—and thus higher-income customers—to conserve more,” said the study. Brown’s 25 percent reductions would be achieved by ramping up enforcement to prevent wasteful water use, while investing in technologies designed to make California more drought-resilient. The order also set out new measures to reduce water use, including the replacement of 50 million square feet (4.6 million square meters) of lawns with droughttolerant landscaping. The measure orders campuses, golf courses, cemeteries and other large consumers of water to significantly cut use. The drought has left swathes of California’s landscape unrecognizable, with normally brimming lakes and rivers now dry and losses to the state’s agricultural industry estimated at several billion dollars.

Margaret Fung, executive director of the Asian American Legal Defense and Education Fund (AALDEF), said: “As a national civil rights organization that advocates for fair immigration policies, we support the president’s immigration actions that could provide relief from deportation to almost 1.5 million undocumented Asian immigrants in this country.” She said that AALDEF offers legal assistance to Asian immigrant youth who may be eligible for the Deferred Action for Childhood Arrivals (DACA) program and plans to represent individuals who would have qualified for the new deferred action initiative for parents of U.S. citizens (known as DAPA) and lawful permanent residents and an expansion of DACA. On February 17, 2015, a federal district court blocked implementation of the expansion of a federal initiative that would have allowed certain immigrants who arrived in this country as children to apply for deportation relief and work authorization (known as an expansion of DACA). The court also blocked implementation of an initiative that would have allowed certain parents of U.S. citizens or lawful permanent residents to apply for deportation relief and work authorization The groups argue that delays in implementing DAPA and expanded DACA harm the nation’s economy and prevent aspiring Americans from more fully participating in their communities. The brief features profiles of primary breadwinners, small

business owners, and social justice activists who would be able to increase their economic and societal contributions if granted the relief proposed by DACA and DAPA. Among those profiled in the brief are Pulitzer Prize-winning journalist and AALDEF 2013 Justice in Action Award recipient Jose Antonio Vargas, who arrived in the U.S. at the age of 12 from the Philippines. He missed the age cutoff for the original DACA program by only a few months. Nga, the survivor of domestic abuse, is the mother of a U.S. citizen child who would have more stable employment opportunities if she were granted DAPA. Today’s filings are the latest legal step in Texas et al. v. United States et al., the 26-state challenge to the administration’s immigration actions. On April 17, the Fifth Circuit will hear oral argument in a request for emergency stay of the lower court injunction. If granted, the emergency stay would allow the U.S. government to begin implementation of the DAPA and DACA initiatives. The Asian American Legal Defense and Education Fund (AALDEF), founded in 1974, is a national organization that protects and promotes the civil rights of Asian Americans. By combining litigation, advocacy, education, and organizing, AALDEF works with Asian American communities across the country to secure human rights for all.

So far, more than 4.2 million Qatari riyals ($1.1 million) has been pledged on just 24 separate and unique car registration numbers being auctioned by the interior ministry of the energy-rich state. The bidding started on Tuesday afternoon and ends on Thursday night. By Wednesday, the highest single bid was 460,000 riyals for the number plate 377773. Bid prices are expected to increase over the course of Thursday. As in Dubai, owning a distinct number plate has become a desirable status symbol for Qataris to publicly show off their wealth. Most in demand are those with fewer numbers – most ordinary Qatari registration plates have six figures – repeated digits, or those in sequence. A previous auction for “fancy vehicle numbers” at the end of last year saw one driver bid a reported 200-million riyals (almost $55 million) for the number plate 333355.

Nissan pledges self-driving cars in Japan in 2016 (Tokyo-AFP) – The boss of Nissan wants to put self-driving cars on Japan’s roads next year, and says they will be able to navigate busy urban environments on their own by 2020. Carlos Ghosn, chief executive, said formidable technological and legal challenges remain but that the direction of travel was plain. “There will be a Nissan product in Japan, which will carry autonomous drive,” he told reporters on Thursday at the New York International Auto Show. “Obviously when you have this kind of technology, you want also the Japanese market to enjoy it as soon as possible.”

A five-year tie up with NASA on the technology would see the initial roll out by December 2016, with cars that can drive on highways without anyone at the wheel. In 2018, models should have the ability to avoid hazards and to change lanes, and by 2020, vehicles should be able to autonomously maneuver through crowded city roads. “It’s going to happen step by step, because we need to make sure that the regulators in the different countries feel comfortable,” Ghosn said, according to Kyodo News. “To persuade the regulators that you can take your hands off the wheel or your

eyes from the road is going to take a lot of demonstration.” Nissan, Japan’s second biggest automaker, is also looking at working with domestic rivals Toyota and Honda on the technology. Reports in February said the three are planning to team up with electronics giants and the government in a bid to propel the country into the front ranks of self-driving cars. The move is part of a government initiative to support domestic industries as competition in the field intensifies globally, with Google testing its own car

and Apple also reported to be working on such a vehicle. The Japanese government has set up a panel to look at the legal issues surrounding autonomous cars, which under current laws are not allowed on public roads. One of the key factors is that of who bears responsibility in the event of an accident when a car is driving itself. Advocates of self-driving cars say they could help reduce the number of crashes on the roads because they remove the potential for human error. More than 4,000 people die in traffic accidents in Japan every year.

BMW recalls almost 80,000 ‘flawed’ vehicles in China Hong Kong, China, AFP, Wednesday 4/8/2015 – German top-of-the-range carmaker BMW has recalled almost 80,000 of its vehicles in China due to flaws in their engines, China’s quality regulator said Wednesday. Some 53,310 X3 vehicles produced between October 2011 and December 2013 have been recalled, according to a

statement from China’s General Administration of Quality Supervision, Inspection and Quarantine (ASDIQ). Flawed wiring in the engines could cause the power supply to short-circuit and result in accidents, ASDIQ said. In a separate statement the regulator also announced the recall, starting July 8, by BMW and its local partners of another

26,418 vehicles produced between June 2012 and March 2014. There could be problems with their feed pumps and a possible fire danger, it said. Last month Jaguar Land Rover recalled more than 36,000 cars from China after it was criticised by state television over allegedly faulty gearboxes.

Foreign auto manufacturers are already under pressure in China, the world’s largest car market, following a sweeping investigation into alleged monopoly pricing for parts and complete vehicles. Last year China fined 10 Japanese auto parts firms more than $200 million in total for price-fixing.
