Pacquiao will not have to post a cash bond of 3.3 billion pesos ($75.2 million) and the government is banned from seizing any of his assets while his income tax case is being heard, according to a Supreme Court ruling. Pacquiao expressed relief at the ruling, which came ahead of a China tour starting next week to promote the Macau defence of his World Boxing Organization welterweight title against unbeaten US challenger Chris Algieri in November.

Pacquiao, who has held world titles in eight separate weight divisions and is also a member of Congress, has become one of the highest-profile targets of the tax office’s sweep. DOH predicts Filipinos with HIV/AIDS to hit 32,000 by end of 2014 MANILA, Aug 19 (Mabuhay) – By the end of 2014, the number of people living with human immunodeficiency virus (HIV) and acquired immune deficiency syndrome (AIDS) in the Philippines is projected to hit 32,379, according to the Department of Health. During the Senate inquiry on six bills that will strengthen policies on HIV and AIDS prevention and treatment, DOH Assistant Secretary Enrique Tayag said the reported HIV cases has reached 19,330 since 1984 when the first Filipino HIV case was confirmed by the DOH. “The new HIV cases has actually increased by 532 percent from 2008 to 2013 and for January to June this year alone, the total reported cases hit 2,814,” Tayag told the Senate committee on health and demography chaired by Sen. Pia Cayetano. Tayag said out of the 19,330 reported cases from 1984 to June 2014, a total of 1,766 are AIDS cases. He said the number of persons who do not voluntarily undergo testing for HIV infection are included in the projected number of persons with HIV by end of this year. Escudero urges DOF to run after those responsible for botched NorthRail project MANILA, Aug 21 (Mabuhay) – Senator Francis ‘Chiz’ Escudero has urged the Department of Finance (DOF) to run after those responsible for the botched NorthRail project which has already cost the government a total of US$ 180 million on top of the $ 50 million in outstanding loan or a total of Php 9 billion. “Someone should pay for it, someone should go to jail and land in jail for this particular fiasco. The taxpayers are the ones paying this now,” Escudero said. During last Wednesday’s 2015 budget briefing of the Senate Committee on Finance, Escudero asked members of the Development Budget Coordinating Council (DBCC) if anyone had been charged for the scuttled railways project. “I presumed it was scrapped because of the corruption allegations associated with it. But do you agree, Secretary, that someone should pay for this? We are paying so much for something we did not continue, that the Filipino people did not benefit from,” Escudero asked DOF Secretary Cesar Purisima. “I fully agree, Mr. Chair. I will have to get back to you on that; I am not familiar on the latest on the investigation of the NorthRail. All I’m familiar with is the
financial aspect of NorthRail,” Purisima said. National Treasurer Rosalia de Leon told the finance committee that the government had paid part of its sovereign obligation to China Exim Bank amounting to about USD 180 million. “But we still have an outstanding obligation. The commercial component to parties is about USD 50 million,” she admitted to senators. The NorthRail project, an 80-kilometer railroad that would link Caloocan with Clark in Pampanga, was contracted out by the administration of President Gloria Macapagal Arroyo in 2003 to the China National Machinery and Equipment Corporation (CNMEC) for an original contract cost of US$ 421 million. The flagship project was funded by a government loan of $ 400 million from China’s Exim Bank and the balance to be sourced from the Development Bank of the Philippines. In 2009, CNMEC increased the contract price to USD 593 million, with the government agreeing to shoulder the cost of the variation. More than 1 million fishermen now tagged for gov’t incentives MANILA, Aug 22 (Mabuhay) – The Bureau of Fisheries and Aquatic Resources on Friday said that beneficiaries of a government program that aims to improve the lot of local fishermen have reached the one million mark. In an interview during a simple ceremony at the Department of Agriculture, BFAR director Asis Perez said that they have registered 1 million out of the estimated 1.7 million fishermen nationwide under the National Program for Municipal
Fisherfolk Registration (FishR). “We are finally addressing a task that had seen a backlog for 16 years,” Perez said. “Our target is to complete the listing of all the 1.7 million fisherfolk by end of 2014.” Republic Act No. 8850, or the Philippine Fisheries Code of 1998, mandates the development of registry of municipal fisherfolk for the purpose of identifying priorities, managing the municipal waters, monitoring fishing activities and other related purposes.

At least, that’s what his wife, Dr. Evangelina Palparan, says. “Tumawag [siya], gusto niya mag surrender, kaso inignore siya ni President Aquino,” Mrs. Palaparan said. Earlier, presidential spokesperson Edwin Lacierda confirmed that President Aquino was informed of surrender feelers from Palparan. Lacierda, however, said he could not recall why the surrender feelers from Palparan’s camp did not gain ground. Palparan had gone into hiding for nearly three years after being charged with kidnapping and serious illegal detention charges over the disappearance of UP students Sherlyn Cadapan and Karen Empeño in Bulacan in 2006. At the time of the incident, Palparan was commander of the Army 7th Infantry Division based in Fort Magsaysay in Nueva Ecija. Palparan, considered one of the country’s “Big 5” fugitives, went into hiding in December 2011 after the Bulacan RTC issued a warrant for his arrest in connection with the disappearance of Cadapan and Empeño. The former military officer was arrested Aug. 12 in Manila’s Sta. Mesa district by agents of the National Bureau of Investigation and intelligence personnel from the Philppine Navy. At present, he is detained at the Bulacan Provincial Jail. Despite the accusations against Palparan, Evangelina believes her husband is a mere victim of enemies he made while conducting anti-insurgency operations. “I have decided to grant this interview, so as a family we can air our side, kasi forgive me for saying, yung left, yung kabila lang ang naririnig. Lahat na lang ng namamtay sa kaniya na lang sinisisi eh,” she said, adding that her husband was merely effective in his post as a military man. “Naging effective siya eh, yung campaign niya sa anti-insurgency, very effective siya,” she said.

Americans among 12,000 foreign fighters in Syria: US WASHINGTON, August 21, 2014 (AFP) – Some 12,000 foreign jihadists from 50 countries, including Americans, have gone to fight in Syria since the conflict began, the US State Department said Thursday. A US official, speaking on condition of anonymity, estimated that more than 100 US citizens have traveled or tried to travel to Syria to join the conflict. They have traveled to join radical groups including the Islamic State (IS), militants fighting the regime of Bashar al-Assad in Syria who have expanded into neighboring Iraq. “We think that there are approximately 12,000 fighters from at least 50 countries in Syria – foreign fighters, including a small number of Americans – that may have traveled to Syria since the beginning of the conflict” more than three years ago, said deputy State Department spokeswoman

US officials have been unable to identify an organized recruitment effort aimed at US citizens, as is the case in Europe. Instant noodles carry health risks for women: study WASHINGTON, August 21, 2014 (AFP) – Women who eat instant noodles, like Ramen, at least two times a week face a greater risk of high blood pressure, elevated blood sugar and high cholesterol, US researchers said Thursday. The study looked at data from 10,711 adults – just over half of whom were women – in the Korean National Health and Nutrition Examination Survey. Researchers at Harvard University found that there was a 68 percent higher risk of metabolic syndrome among women, but not men, who ate instant noodles more than twice per week. Metabolic syndrome is a group of conditions that raise the risk of heart disease and diabetes. It includes carrying too much fat around the waist. “The consumption of instant noodles was associated with increased prevalence of metabolic syndrome in women,
independent of major dietary patterns,” said the study in the Journal of Nutrition. In other words, it didn’t matter if women ate a largely traditional diet of rice, fish and vegetables, or a diet heavier in meat and fried foods – if they ate instant noodles twice weekly, they were at higher risk of health problems. It was unclear why the effect was seen in women but not men. Since the data was based on surveys, researcher Frank Hu, a professor of nutrition and epidemiology at Harvard, said it may be that women reported their diet more accurately than men, or that women were more sensitive to the effects of carbohydrates, fat and salts. So how much is too much when it comes to instant noodles? “Once or twice a month is not a problem,” Hu was quoted as telling The New York Times. “But a few times a week really is.”

Among the changes proposed in the draft were the removal of Spanish terms like reclusion perpetua, and the lowering of criminal liability age to 12 years. According to Justice Secretary Leila de Lima, the Criminal Code Committee, established in April 2011 to lead the revision, has just finished the last phase or Book 2 of the new Criminal Code on Crimes and Penalties. In November 2012, the Department of Justice announced that the CCC completed Phase 1 or Book 1, which contains general principles applicable to the punishment of crimes. “We responded to the call of the President to undertake a codification project and for the first time in our history, we have a draft criminal code developed by justice stakeholders that is reflective of our societal norms,” de Lima said in a statement. “We shall now endorse the final product to both the houses of Congress for their consideration to realize its passage as the new Criminal Code of the Philippines on or before 2016.” The CCC was tasked to review the Revised Penal Code – the country’s general criminal code – because some of its provisions stemmed from an “antiquated” general penal law enacted during the American occupation in 1932. The CCC is composed of representatives from the Supreme Court, the Philippine National Police, the Department of Justice and its attached agencies: the National Bureau of Investigation, Bureau of Immigration, Public Attorney’s Office, Office of the Government Corporate Counsel, Office of the Solicitor General, Board of Pardons and Parole, and the Land Registration Authority. The key features of Book 2 include: structured based central themes with common features; rarionalized penal provisions by categorizing into three major titles, namely, Crimes Against Persons, Crimes Against Property and Crimes Against the State; modernized archaic provisions by integrating and consolidating several penal laws which refers to the same criminal act.

GPS measures western US drought, finds Earth rising WASHINGTON, August 21, 2014 (AFP) – Scientists using GPS technology to study the extent of the western US drought said Thursday the water shortage is causing parts of the Earth’s crust to rise. Some 62 trillion gallons – equivalent to a six-inch (15-centimeter) layer of water – have been lost since 2013, causing a slight upward lift across the region, according to the study in the journal Science. The “uplift” effect equals some 15 millimeters (more than half an inch) in California’s mountains and around four millimeters (0.16 of an inch) across the west. The study was conducted by scientists at Scripps Institution of Oceanography at the University of California, San Diego. Researchers found that precise GPS stations within the National Science Foundation’s Plate Boundary Observatory and beyond had moved upward in recent years,
coinciding with the current drought. The study said the rise is not likely to increase the risk of earthquakes since it has “virtually no effect on the San Andreas fault.” Scripps researcher Dan Cayan said the technique could be used to measure changes in fresh water stocks across the globe. “This technique can be used to study changes in fresh water stocks in other regions around the world, if they have a network of GPS sensors,” said Cayan. A NASA study out last month found the drought posed a major threat to underground water resources and the regional water supply. Since 2000, seven western states – including Arizona, California, Colorado, Nevada, New Mexico, Utah and Wyoming – have seen the driest 14-year period in a century.

GK-USA is a non-profit organization that supports the work of GK in the Philippines. “We exist to assist GK headquarters in the movement to create a culture of sustainability and scalability in the Philippines; while encouraging our Filipinos and Filipino-Americans here to connect to their country; so that together, Filipinos in the Philippines and Filipinos here, can create and promote shared values,� said Glenda Genio, GK-USA executive director. To foster this spirit of partnership, GK executive director Luis Oquinena flew from the Philippines, to give an update on GK’s work, more important of which was financials: “Since 2009 until late last year, we have been operating in the red. But we addressed that by revisiting pricing and reorganizing,� he said. “We have asked some workers to ‘change lanes,’ enabling us to trim our staff from 222 to 102. We reviewed fixed cost versus project-based cost; and now we have a lean core of workers.� Oquinena also shared his observation that “God has been building up our brand and credibility.� He happily noted that several more companies are choosing to engage GK; and even the Philippine government has taken notice and action. “A few years ago, no one ever thought of giving free land to the poor. Now even the government is doing it, giving value to our people’s sweat equity,� as he talked about the wealthy sharing their treasures with the needy. Haiyan was a game-changer. And this was the consensus among the group. “As sad as it was, we also saw the gift it brought,� Olaes said, referring to the spirit of bayanihan that was kindled and rekindled among Filipinos. “More people started to care.� “GK is all about the landless, building homes for communities; but also relocating families that live in danger, to safer areas before calamities strike,� said Oquinena, adding that the disastrous effects of Haiyan made everyone, including the whole world, realize that the poor are indeed most vulnerable. And they are the ones whom we cannot leave behind. “’Walang Iwanan’ means no one left behind, and to some extent, ‘Never say die,’� Oquinena explained. “In the PBA (Philippine Basketball Association), that’s the battle-cry of a team called Ginebra. That’s the barangay spirit, the spirit of community. And that’s what GK is about.� As part of this spirit, Oquinena reported that this year’s Bayani Challenge that ran from April 9th – June 12th, attracted 1.7 million volunteers from around the world. ‘There were about 1 million volunteers in Bohol alone.� Bayani Challenge is an annual summer activity started by GK to
encourage everyone to spend a few days immersed in depressed communities, to build homes with GK. “This 2013 was special because of the earthquake and then several typhoons, capped by Haiyan. There was a lot of rebuilding to be done and we needed a lot of volunteers.� According to Oquinena, when the team was projecting numbers before the summer event, they pegged the volunteer size at 1 million, thinking it was already an ambitious figure to hit. But when they not only hit; but surpassed their own objectives, it made them realize that it is right to challenge boundaries, especially at this time. After all, 5 million families is in itself a big target. Believers of GK are banking on the power of volunteerism. And the lifeblood of volunteerism is inspiration. “People want to join if the inspiration is clear,� Oquinena said, talking about a recent GK partnership with Xavier University where GK helped train the students and the final product was a village for the poor, called “Eco Village.� And here, according to Oquinena, lies the heart of growth: “We don’t care to lose the Gk identity, so long as the mission is being accomplished. If we want to grow, tension will lie between mission and identity. What will you choose?� GK believers agree that the GK identity should take a backset to the GK work and objective. Oquinena’s forecast is that of the 5 million families, only 700 thousand will be helped by GK; the remaining 4.7 million will be assisted by other organizations. “What is emerging is that many organizations want to connect to GK, either to help us in our work; or use our model. And when others use our model for helping the poor, that should be enough. We shouldn’t fear as much that the GK identity gets lost. What’s important is our work,� Oquinena said. Looking beyond and more specifically, forward to the next 10 years, Oquinena dares every Filipino to challenge the boundaries; to think of bigger things; and more importantly, to allow ourselves to be the answer to somebody’s prayers, the prayer for food, for shelter, for a dignified way of living. GAPASCA scholarship program gets boost during inaugural ball CERRITOS – The scholarship program of the Gapan City Association of Southern California (GAPASCA) got a big boost last August 9 during the inaugural ball of the new organization at the Cerritos Sheraton Hotel. Following the inspirational speech by GAPASCA chairperson Nimfa Castro, three benefactors contributed $1,000 financial grant each before the night ended. With the added funds, GAPASCA will be able to sponsor 12 graduating students from various high schools in Gapan. Each scholar will be given financial assistance of up to P40,000 each towards tuition. Castro said some officers and members of GAPASCA will hold a banquet for the scholars in March 2015 in Gapan. She thanked the members and benefactors for their overwhelming support to the scholarship program. The successful inaugural ball was full house and attended by Gapanenses from all over California. They were joined in the celebration by town mates from other states and from the Philippines. Client with wage garnishment files Chapter 13 to save house from foreclosure Client is 60 years old and married. She has gross income of $3,000 as a caregiver. Husband is not employed and waiting for social security benefits, which is still two years from now. Due to a car that was repossessed last
year, client owes $18,000 on a car loan deficiency. Her salary is subject to wage garnishment of $600 monthly because of the repossessed car. Because of this client has not paid her mortgage on their residence
for the last 8 months. Their mortgage is $1,500 a month, so their mortgage default is $12,000. They owe $40,000 of credit card debt, which they have not paid for the last 12 months. They have a car loan on a new Camry with a balance of $20,000 on which they pay $500 monthly at 10% interest. They are one month behind on the car payment. The mortgage holder has sent them a “Notice of Default� with a recording date last week advising them that their house will be foreclosed upon after 90 days pursuant to foreclosure law in the state of California unless the amount of default of $12,000 plus costs and attorney’s fees is paid in full at least 5 days before the foreclosure auction sale date, to be set, after the lapse of 90 days. A few days later, the LA county recorder’s office sends them the same information telling them that they will lose their house to foreclosure unless they pay the default in full by the deadline, and that they should contact a lawyer for assistance if they want to save their house. Any homeowner who is in this situation and wants to save the house from foreclosure, and is serious about saving the house, should file a Chapter 13 forthwith. There

are other options that can be taken but none of those are as effective in stopping a foreclosure on its track as a Chapter 13. The reason is that Chapter 13 is specifically designed by law to help homeowners save their houses from foreclosure. How will client benefit from her Chapter 13 petition? She will benefit as follows: The wage garnishment will stop immediately, thus providing her $625 more of net income monthly. The foreclosure process will stop immediately. Mortgage holder cannot proceed with selling her house in a foreclosure sale. The mortgage arrears of $12,000 will be paid over a period of 5 years, no interest, at $200 a month. If client wants, the car payment can be paid at the rate of $333 monthly for 60 months, instead of $500 a month. In the Chapter 13 plan, she will only pay the default of the house at $200 a month for 60 months and paying zero to her $40,000 of credit cards. She does not have to pay any part of the $40,000 credit card debt at all. In addition to the stopping of the wage garnishment for the repossessed car, client will pay zero on the unpaid balance of the $18,000 car repo deficiency. If she completes the plan payment of $200 for 60 months, the court will discharge the $40,000 of credit card debt and the $18,000 car repo deficiency. During the next 5 years, as long as client is making the plan payments in a timely manner to the trustee, the house foreclosure is stopped, and none of her creditors can sue her for collection or garnish her wages or levy her bank accounts. She gets peace of mind and order from chaos. Client has to resume her current mortgage payment of $1,500 on the month after the date of filing. Thus, on year 5, she will be back on current status again with her house mortgage. Client does not have a 2ēĉ trust deed or a home equity loan, but if she did, assuming the legal requirements are satisfied, she could have also gotten rid of the 2ēĉ trust deed, converting it to an unsecured debt just like a credit card debt with client paying the 2ēĉ trust deed holder, again nothing, zero. If she owed $100,000 on a HELOC, that entire amount will get discharged upon plan completion, on zero payment. So, as long as she completes all plan payments, she can retire in peace at the age of 65. At that time, her husband will be receiving social security benefits boosting their household income when their unsecured debt has been reduced from $58,000 to nothing. They will be debt free at 65 and their house will become current on mortgage payments again. Ben Evardone said he has filed House Bill 4786 mandating the Department of Tourism (DOT) in coordination with the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) to immediately take steps to facilitate and assist in the formulation and implementation of a tourism development plan. The bill aims to exempt the Philippine Arena from the payment of application and similar fees and related charges and allows it to enjoy appropriate incentives and benefits similarly enjoyed by registered tourism enterprises. Evardone, Vice-Chairperson of the Committees on Appropriations and Public Information, said the overall vision of the master plan would eventually see inclusion of shopping centers, a hospital and large-scale residential developments.

To minimize the spread of HIV infection, Tayag said the DOH has listed 75 priority areas for HIV intervention, including 53 in the Luzon, led by Angeles City and Caloocan; 12 in Visayas including Cebu City; and nine in Mindanao particularly in Davao City. Tayag said the DOH has proposed a P308-million budget, including P11 million for the purchase of condoms, for 2015. “There are 11,384 projected persons living with HIV who will need Anti Retroviral
Therapy (ART) by 2015,” Tayag said. Under Senate Bill 1217, Sen. Grace Poe proposed the removal of the HIV and AIDS legal framework that conflicts with laws recently enacted, “thus restricting actions that are crucial to halt the spread of the epidemic.” Poe also proposed the establishment of a National HIV and AIDS Plan, and strengthening of the stigma reduction mechanisms of the present law—Republic Act 8504 otherwise known as “The Philippine Aids Prevention and Control Act of 1998.” In his own Senate Bill 879, Sen. Jinggoy Estrada proposed the counseling and testing of pregnant women and newborn infants for HIV infection. On the other hand, Sen. Reps. Mariano Piamonte and Julieta Cortuna (Party-list, A TEACHER) filed House Bill No. 4715 in consonance with the policy of the State to improve the quality of education in all areas nationwide. Piamonte said in far-flung areas of the countryside where electricity is not available, public school classrooms are also without electricity. “This fact simply demonstrates that public schools in some areas could not be provided with computers as a learning support tools because of the absence of electricity,” Piamonte stressed. Piamonte said it is logical to conclude that students who came from these schools could not learn much of the basics in today’s information technology age. “Because of the absence of electricity in some areas, the students in public schools suffer from educational content gap – an important content at that,” Piamonte stressed. Cortuna said when electricity is not available, support technology for a quality education could not be delivered. Cortuna noted that the installation of 200 watts solar panels in selected classrooms or facilities will ensure that
all schools nationwide will have power to energize basic teaching tools such as computers, printers and other laboratory equipment, enabling them to deliver the same degree of quality teaching as other schools to improve the quality of education. Under the measure, the Department of Education (DepEd) is mandated to ensure that all public elementary and high school buildings nationwide which cannot be connected to the grid shall be installed with solar panels with a capacity of at least 200 watts. The solar panels that will be installed in school buildings shall include system components which include but not limited to charge controllers, inverters and batteries for it to generate at least 200 watts of alternating current (AC) at a standard voltage of 220 volts. Covered in the solar panels installation are public elementary or high school buildings not smaller than the size of three classrooms in barangays where electrical line installation is not available. Also covered is the school laboratory or educational support facility of any size located in barangays where electrical line installation is not available. The DepEd shall cooperate with the Department of Energy (DOE) and the Department of Science and Technology (DOST) to address the technical requirements. (MNS)
Bilibid OIC: ‘Tunnel’ is just part of drainage MANILA, Aug 19 (mabuhay) – A supposed tunnel leading outside the New Bilibid Prison’s maximum security compound is nothing more than part of a drainage system and cannot be used by inmates to escape, the national penitentiary’s superintendent maintained Tuesday. NBP officer-in-charge Superintendent Roberto Rabo also said that while the drainage is no longer used, it cannot be used as a means to escape. “’Yan ay nilagyan ng maliit na tubo na semento. Ang tubong ‘yan pinagdikit-dikit at binuhusan ng semento. Hindi madadaanan ‘yan,” he said. Also, he said regular inspections are
held in the area. “May sistema tayong nilagay diyan na hindi pwede daanan ng tao, tubig lang,” he said. On Monday, Justice Secretary Leila de Lima ordered an investigation into reports of the tunnel leading outside the NBP maximum security compound. She had ordered NBP head Franklin Bucayu to investigate the matter. Initial information indicated the tunnel was discovered by workers of a water concessionaire. DOJ completes draft amendment for new Criminal Code MANILA, Aug 19 (Mabuhay) -- The Department of Justice (DOJ) on Tuesday announced that the Criminal Code Committee (CCC) has completed Book 2 of the new Criminal Code on Crimes and Penalties after three years of drafting work. The CCC was established on April 20, 2011 to study, assess and consolidate a simple, updated and modern criminal law to provide clarity in law enforcement and to improve the administration of justice. This was geared towards increased access to justice especially for the marginalized sectors. “We responded to the call of the President (Benigno S. Aquino III) to undertake
a codification project and for the first time in our history, we have a draft criminal code developed by justice stakeholders that is reflective of our societal norms,” Justice Secretary Leila M. De Lima said on Tuesday. “We shall now endorse the final product of both houses of Congress for their consideration to realize its passage as the new Criminal Code of the Philippines on or before 2016,” De Lima added. Gloria Arroyo camp allowed to file motion to dismiss plunder case MANILA, Aug 20 (Mabuhay) – Former president and incumbent Pampanga Rep. Gloria Macapagal-Arroyo on Wednesday was finally allowed to file a demurrer to evidence, which is equivalent to asking the court for an acquittal. “Sa aming opinion, maaaring makita ng court na di sapat ang ebidensya ng prosecution. Yan ang opinion namin kaya nag file kami ng demurrer. Salamat na pinayagan kami,” Mrs. Arroyo’s legal counsel, Atyy. Jose Flaminiano, said in an interview following the hearing. A demurrer to evidence formally asks the court to decide if the presented evidence of the prosecution is enough to hold a case. Mrs. Arroyo is facing plunder charges over the alleged misuse of P366-M in Philippine Charity Sweepstakes Office intelligence funds during her incumbency. At present, she is under hospital arrest at the Veterans Memorial Medical Center in Quezon City. In the same interview, Flaminiano said the court’s decision to allow them to file a demurrer to evidence will speed up the resolution of the case. “Mapapabilis, pero depende pa rin sa
justices. Ang demurrer kasi is equivalent sa motion for acquittal. Pag na grant yung demurrer, wala nang kaso,” he said. The Sandiganbayan First Division gave the defense team 10 days to submit the demurrer to evidence. The prosecution panel was likewise given 10 days to respond, after which the motion is considered submitted for resolution. Flaminiano said their legal team is of the opinion that the evidence against Mrs. Arroyo in the PCSO plunder case is weak. Plunder is a non-bailable offense if evidence against the accused is strong. Solon wants broadcast media to provide adequate public service time MANILA, Aug 20 (Mabuhay) – A lawmaker wants to require broadcast media to provide adequate public service time to enable the government reach the population and educate the people on important public issues. Rep. Evelina Escudero (1st District, Sorsogon) raised the proposal through House Bill 4641, noting that the capability of broadcast media in disseminating information through live and recorded coverage cannot be overstated. “Broadcast media is the best tool to relay information and motivate people to participate in nation building. It is the most effective vehicle to carry out the government’s ultimate goal to promote the objectives of sound government,” Escudero said. Escudero noted that its influence in shaping public perceptions and behavior, changing social attitudes and bringing about social integration is highly recognized. Escudero said her proposal also adheres to Section 24, Article II of the Constitution, which provides that “The State recognizes the vital role of communication and information in nation-building.” The lady lawmaker stressed that health, road and traffic discipline, good values, public safety, welfare rights and benefits and disaster preparedness are matters of public interest and concern because of their significant effects on safety and on the social, economic and moral well-being of the people. Escudero said that plans and programs of the government on these matters must
involve the active participation and cooperation of the people for their effective implementation. “Thus, the government should relay and communicate the public policy on these matters through the use of the most effective and accessible means, the broadcast media,” Escudero said. The measure also seeks to guarantee and confirm the social responsibility of broadcast media in serving the interest and welfare of the people. Under the measure, all broadcast media are required to provide public service time of at least two minutes per hour to enable the government promote the efficiency of public service and the principles of good governance. Broadcast media shall elect the subject matter to be featured in a given time. As described in this proposal, broadcast media refer to radio or television stations engaged in the business of distributing audio and video content to a dispersed audience via any audio or mass communication media. The bill mandates the Philippine Information Agency (PIA) to cause the production of the public service commercials designed to promote and inform the public on the latest issues, announcements, warnings, plans and programs of the government to be aired by the broadcast media. Failure of any broadcast media to provide the required public service time as stipulated in this proposal shall be a ground for suspension, revocation or non-renewal of license to operate radio or television station. Binay seeks probe into hospitals turning down patients MANILA, Aug 19 (Mabuhay) – Senator Nancy Binay has filed a resolution seeking probe into hospitals refusing to accept and to discharge patients who have no money to pay for deposit or hospital bills. The lady lawmaker also urged the Department of Health (DOH) to strictly monitor and implement its policies on the hospitals which turns down persons in need of immediate medical attention due to money problem. “Lives are put on the line when hospitals refuse to admit patients who are critically ill,” Binay said in a press statement. In her Senate Resolution No. 837, Binay wanted the proper Senate committee to look into a hospital which refused to admit a child suffering from congenital heart diseases, diabetes and kidney problems because her mother could pay for the admission. The refusal of the Butuan Doctors Hospital to admit 10-year-old Jannary “Yanna” Chan reportedly led to her death as her mother, Tutz Salarda-Chan along with two nurses from the San Francisco Doctors Hospital from Agusan del Sur, tried to find a hospital that would treat her critically ill child. ”There are many cases of patients being turned down by hospitals due to lack of money for deposit or refused to discharge for failure to pay in full the hospital bills. Negative Effect on your credit: When negative information in your report is accurate, only time can make it go away. A credit reporting company can report most accurate negative information for seven years and bankruptcy information for 10 years. Information about an unpaid judgment against you can be reported for seven years or until the statute of limitations runs out, whichever is longer. The seven-year reporting period starts from the date the event took place. There is no time limit on reporting information about criminal convictions; information reported in response to your application for a job that pays more than $75,000 a year; and information reported because you’ve applied for more than $150,000 worth of credit or life insurance. The Credit Repair Organization Act (CROA) makes it illegal for credit repair companies to lie about what they can do for you, and to charge you before they’ve performed their services. Once you get a copy of the report from the bureaus, you will be provided a report number, with this report number you can call the bureau and actually talk to a live person. This is the only way to call the bureaus and ask for further assistance. Step 2: Tell the creditor or other information provider, in writing, that you dispute an item. If the provider reports the item to a consumer reporting company, it must include a notice of your dispute. And if the information is found to be inaccurate, the provider may not report it again.

MANILA, Aug 20 (Mabuhay) – Lawyer Renato Bondal on Wednesday said the 11-storey Makati City Parking building was overpriced by 300 percent or about P2 billion. During the hearing of the Senate blue ribbon committee, Bondal said that based on the copy they obtained of a city ordinance issued in 2008, it showed that the city government allocated P2.7 billion for the construction of the project when it only declared P1.5 billion as the total cost of the project. “Base sa city ordinance na ito, lumalabas na mas malaki pa pala sa idineklara nilang P1.5 billion ang proyektong ito,� Bondal said. “Lumalabas na 300 porsyento ang bukol o patong nga mga Binay dito,� he added. The parking building has a total floor area of 31,928 square meters (sqm). It has five parking floors, five office floors and a basement. Bondal also that with the P2.7 billion allocated for the project, the construction cost amounts to P84,000 per sqm. Trillanes said he will recommend that Efren Canlas, president of Hilmarc’s Construction Corp., and other officials of the firm be charged over the alleged overpricing of the building. “That’s what we intend to do. We are going to grill Mr. Canlas about his contracts with Makati, his tax records, corporate records. We are very sure we will find something. In fact right now I am going to encourage Atty. [Renato] Bondal to include Mr. Efren Canlas and senior officials of Hilmarc’s to include them in the plunder case,� Trillanes said. During a Senate Blue Ribbon Committee hearing on Wednesday, Commission on Audit (COA) chairperson Grace PulidoTan said the bidding out of a project in several phases, just like what happened in Makati City Hall Building 2 project, is a red flag. Drilon: SC’s DAP ruling had ‘chilling effect’ on gov’t spending
MANILA, Aug 19 (Mabuhay) – Senate President Franklin Drilon on Tuesday urged economic managers to accelerate government spending, noting the “chilling effect” of the Supreme Court’s decision declaring parts of the Disbursement Acceleration Program (DAP) unconstitutional. During Tuesday’s hearing on the proposed 2015 national budget, Drilon noted that the government’s expenditures “have (gone) down tremendously” from 10 percent during the first quarter of 2013 to 2 percent during the same period this year. “…You can’t discount the fact that the bureaucracy is now concerned about spending given the decision of the Supreme Court on the DAP,” he said. “Takot na takot ngayon ang byurukrasya at baka masampahan sila ng kaso because of the decision on the DAP. DOJ hopes accused in Maguindanao massacre case will be convicted before Aquino’s term ends MANILA, Aug 20 (Mabuhay) – The Department of Justice (DOJ) panel of prosecutors is hoping that the accused in the infamous Maguindanao massacre case will be convicted before the term of President Benigno S. Aquino III ends on June 30, 2016. The massacre claimed the lives of 58 civilians, including 15 women and 32 media practitioners, in Ampatuan town, Maguindanao on Nov. 23, 2009. According to Justice Undersecretary Francisco Baraan III, their objective to obtain justice for all the victims of the massacre is still not faltering despite the allegations of bribery on the part of some of the prosecutors in the case. Baraan stressed that they have no other “agenda or motive” in their decision to finish the presenta-
tion of evidence against the 28 accused, including former Datu Unsay Mayor Andal Ampatuan Jr., but to secure justice for the victims. He said that the prosecution panel believes that through the “resting of the case” against some of the accused, the dispensation of justice will be expedited because the Supreme Court (SC) has allowed the rendering of “partial judgment” in the case. Baraan explained that it is not required to have a “rebuttal of evidence” from the prosecution before the termination of the presentation of evidence. Although Baraan admitted that the public prosecutors are hurting in the allegations of bribery, their target to win the case for the victims of the Maguindanao massacre is not wavering. (MNS)

WASHINGTON, August 19, 2014 (AFP) – Under a photo of Barack Obama carried by demonstrators in a town rocked by racially-charged protests, the appeal to America’s first black president is loud and clear: “Please come now.” The poster is among those waved by demonstrators in Ferguson, Missouri, where an unarmed black teenager was shot and killed by a white policeman nine days ago, touching off days of unrest. It summarizes, in part, the huge hopes stirred in the African-American community by Obama’s historic election win. But it also touches on a question that has loomed large since Obama took power in 2009: should he get more directly involved when a local incident raises the issue of racism. The United States is a country where segregation was abolished only half a century ago in some southern states, but now has a black president walking a fine line on still highly-charged issues. Obama spoke out Monday on the latest unrest. In a carefully worded speech, he urged law enforcement forces to show restraint and the demonstrators to avoid violence, which he said weakens any quest for justice more than it strengthens it. ‘Gulf of mistrust’ But when he was asked whether he planned a personal intervention in a drama that has gripped the nation for more than a week, Obama appeared to rule out anything so dramatic as a visit to Ferguson. Nevertheless, clearly uncomfortable, he did address broader issues. “As Americans we’ve got to the use this moment to seek out our shared humanity that’s been laid bare by this moment,” he said. “I’ve said this before, in too many communities a gulf of mistrust exists between local residents and law enforcement,” he added. “In too many communities, too many young men of color are left behind and seen only as objects of fear.”
But he also warned that fighting racial discriminations is a long term project that America has been working on for 200 years, as if to play down the idea that he alone can be some kind of savior. Since the end of his first term, Obama, elected thanks to strong support from minorities, has warned against expecting too much. “I never bought into the notion that by electing me, somehow we were entering into a post-racial period,” he told Rolling Stone magazine in April 2012. Time for a strong message Sherrilyn Ifill, president of the NAACP Legal Defense Fund, the legal arm of America’s largest civil rights group, said it was right for the president to keep a certain distance from day-to-day events. “We have to be very careful about getting addicted to asking the president to speak into every moment,” she said. Ifill added that the White House in recent days has supported a federal civil rights probe of the Ferguson killing and a separate autopsy separate from the one being done by local authorities. During the campaign leading up to his first presidential victory, Obama did address relations between African-Americans and whites. In a speech in March 2008 amid controversy over divisive remarks made his former pastor Jeremiah Wright. Obama said racism is a problem that the United States cannot afford to ignore. But, after he took power, things got off to a messy start. In July 2009, Obama was forced to apologize after he labeled as “stupid” the arrest of a black friend and speculated over racial motivations, without having all the facts in hand. A turning point came in the case of Trayvon Martin, a 17-year-old black male shot dead in February 2012 in Florida by a member of a civilian anti-crime patrol while walking in residential neighborhood. After a trial in which the defendant was acquitted, having pleaded self defense, Obama spoke in very personal terms.

Foley, 40, had been missing since he was seized in Syria in November 2012. “We’re very proud of him. He was a courageous, fearless journalist, a very compassionate American. But I admire his courage and political will in his quest to curb illegal gambling (jueteng) during his stint as interior secretary over the strong objections of provincial governors close to Noynoy and some cabinet secretaries. I hope too that former Congressman and Defense Secretary Gilbert Teodoro will have a change of heart and will try to run again as president. Teodoro lost to Noynoy in the 2010 presidential election. Teodoro’ stint in Congress and in the Defense departments is devoid of corruption or wrongdoings. Too bad we lost Robledo. He would have been a good president for our country. UK police find 15 immigrants in truck in latest incident LONDON, August 19, 2014 (AFP) – Fifteen distressed immigrants were found in a truck in Britain on Tuesday, as a man was arrested on suspicion for manslaughter for the death of a stowaway in a similar incident three days earlier. The 15 foreign nationals in the truck, who told police they were from Kashmir and Eritrea, were discovered after other road users heard shouts and banging coming from inside. The truck was stopped at a service station. On Saturday, staff at a port heard screaming and banging coming from inside a shipping container, and found 34 Afghan Sikhs alive inside suffering from severe dehydration, hypothermia and lack of air. One man was found dead, having passed away during the sea crossing from Belgium, and on Tuesday police in Northern Ireland said they had arrested a man on suspicion of manslaughter. The cases have raised questions about Britain’s border security and the desperate measures taken by immigrants to reach Britain’s shores illegally. Police arrested the German truck driver after 12 men and three women were found in the back of his vehicle as it travelled near Taunton, south west England on Tuesday. The people found in the truck were treated by paramedics for possible dehydration but were all in a healthy condition, according to police. “A total of 15 people were found in quite a state of distress, including men, women and a 15-year-old boy. They have stated they are from Eritrea and Kashmir,” an Avon and Somerset Constabulary spokesman said. “They were quite distressed, it had got
very hot inside the vehicle,” he added. “A man, who is from Germany, has been arrested on suspicion of facilitating the unlawful entry of people into the UK. “He was quite shocked to find people in his vehicle and he is assisting us with our inquiries,” explained the spokesman. Man arrested over death Police in Northern Ireland on Tuesday said they had arrested a 34-year-old man on suspicion of manslaughter over the death of the Afghan Sikh immigrant whose body was found in a shipping container in south east England on Saturday. Wildfire near Yosemite sparks 13,000 evacuation orders
LOS ANGELES, August 19, 2014 (AFP) – Californian authorities said Tuesday they have issued more than 13,000 evacuation orders near Yosemite National Park due to a wildfire encroaching on the US tourist attraction. Some 600 firefighters were battling the blaze that so far has burned some 1,200 acres (500 hectares), according to the Madera County Sheriff’s Office. With no containment in effect, the road allowing access to Yosemite from the south has been closed. However, the famous landmark remains open to the public. As of Tuesday morning, some 1,000 people had been evacuated, with another 4,000 told they were now on standby,
according to the sheriff’s office. Shelters have been set up by the Red Cross for those who have to leave their homes. At least eight structures have been damaged while at least 500 others risk being engulfed by the flames that were sparked early Monday in the drought-hit, tinder-dry area. The cause of the fire is under investigation. In July, another inferno threatened a grove of famous giant sequoia trees in Yosemite, which welcomes several million visitors annually. Last year, a gigantic blaze – the third largest in Californian history – tore through a swath of the park, burning more than 257,000 acres.

The National Weather Service issued a warning for flash floods, saying there was the threat of further “very heavy rainfall” and thunderstorms. Ebola test on Sacramento patient negative SACRAMENTO – The California Department of Public Health (CDPH) announced today that the federal Centers for Disease Control and Prevention (CDC) has tested the sample from the patient under investigation who is hospitalized in Sacramento and reports the test results are negative for Ebola. CDPH has been working in cooperation with the Sacramento County Public Health and the Kaiser Permanente South Sacramento Medical Center to ensure appropriate CDC protocols were followed in the investigation, testing, diagnosis and treatment of the patient.
There are currently no confirmed cases of Ebola in California. (3) The party against whom enforcement is sought, if unrepresented by legal counsel, was fully informed of the terms and basic effect of the agreement as well as the rights and obligations he or she was giving up by signing the agreement, and was proficient in the language in which the explanation of the party’s rights was conducted and in which the agreement was written. The explanation of the rights
and obligations relinquished shall be memorialized in writing and delivered to the party prior to signing the agreement. The unrepresented party shall, on or before the signing of the premarital agreement, execute a document declaring that he or she received the information required by this paragraph and indicating who provided that information. (4) The agreement and the writings executed pursuant to paragraphs (1) and (3) were not executed under duress, fraud, or undue influence, and the parties did not lack capacity to enter into the agreement (5) Any other factors the court deems relevant. In addition, the parties are required to provide each other with full disclosure of all material financial information. A premarital agreement may be unenforceable if found to be unconscionable when it was executed and the requisite disclosures were lacking and not waived Additionally, a spousal support provision in a premarital agreement executed under the UPAA, whether before or after January 1, 2002, is not enforceable if found to be unconscionable at the time of enforcement. Yellen: US jobs market ‘yet to fully recover’ WASHINGTON, August 22, 2014 (AFP) – Federal Reserve Chair Janet Yellen on Friday rebuffed pressure from inflation hawks to move faster toward a rate hike, saying the US jobs market still shows slack despite recent gains. But the European Central Bank’s Mario Draghi, also addressing the Fed’s central banker symposium in Jackson Hole, Wyoming, said the ECB was ready to respond to demands for more stimulus as the eurozone economy stalls. In her much-awaited speech on the labor market, Yellen said US monetary policy needed to be pragmatic, not defined by models but focused on what a range of data says. She acknowledged the rising calls for preemptive action to head off inflation, including from a growing minority within the Fed. And she admitted that interpreting the data on the US labor market since the Great Recession of 2008-2009 has become more complex, difficult to determine which patterns are cyclical and which represent deep structural and societal changes. “The assessment of labor market slack is rarely simple and has been especially challenging recently,� she told the symposium. Still, she stressed that even if the unemployment rate has fallen more quickly than expected to 6.2 percent, there remains “considerable uncertainty about the level of employment.� Taken together, she said, the data suggests that the jobless rate decline “somewhat overstates� labor market improvements. “Five years after the end of the recession, the labor market has yet to fully recover,� she said.

Saleen muscles in on the electric market
The Saleen FourSixteen inside, the cabin has a very sporty feel too. The addition of racing seats, harnesses and a two-tone leather finish that extends to the dashboard all hint at the car’s capability.
(Relaxnews) – One of America’s foremost performance car makers has turned its expertise to the Tesla Model S to create the Saleen FourSixteen. At first glance, the changes to the stock electric executive sedan may appear cosmetic. But the tweaks to the outer shell all serve the same purpose: to help the car cut through the wind even
more smoothly, while keeping the engine and brakes sufficiently cooled and the four wheels sufficiently planted. Inside, the cabin has a very sporty feel too. The addition of racing seats, harnesses and a two-tone leather finish that extends to the dashboard all hint at the car’s capability. However, even here there is a little nod to practicality. The Saleen offers more in-dash storage space than a stock Tesla, as well as a cup holder and a drawer for
charging smartphones. But it’s under the hood where the biggest changes have been made. The car gets a three-phase, four-pole AC induction motor that’s connected to a redeveloped drivetrain with a higher final gear ratio to increase acceleration. It also gets a clever locking differential and a stability control system to push the right amount of power to the right wheel so that the Tesla can corner as quickly and as confidently as it travels in a straight line. And to make sure that the extra performance doesn’t compromise everyday ride quality, the suspension system is adjustable. “Tesla has created an entirely new class of American automobile,” explained Steve Saleen about the company’s decision to spice up the Model S. “There are many similarities to this and how Ford created the ‘pony car’ class in 1964 with the Mustang, which is how these vehicles stand out from the rest of the pack.” All of which means that customizing electric cars is set to become an automotive trend and one that Saleen is looking to spearhead. In terms of the car’s vital statistics, Saleen isn’t yet prepared to go public with performance figures. All the company will say is that it will be faster off the line than the standard or performance versions of the Tesla Model S and that, thanks to the aerodynamic tweaks, it will have a longer range before it needs recharging. The FourSixteen will cost $152,000 if delivered as a complete car. However, existing Tesla Model S owners can have their cars upgraded to the Saleen specification for less.
