MANILA, August 9, 2013 (AFP) – A huge oil spill shut down parts of the Philippine capital’s vital fishing industry Friday, jeopardizing the livelihoods of tens of thousands of people living along Manila Bay’s diesel-coated coast. Dead fish floated on the water and some residents fell ill from the fumes, as authorities said an estimated 500,000 liters of oil cast a slick across 20-kilometres of the coastline. “Many of our young and elderly residents are getting sick,” Marcos Solis, the captain of a fishing village near the worst of the oil spill, told AFP. “The price of fish and shellfish has also collapsed. Even those who fish far out to sea are affected because the fish smell the oil and swim away.” Authorities said the slick was caused by either a leak at an oil terminal on the bay or a ship that had unloaded diesel there. Coastguard marine environmental protection chief Commodore Joel Garcia told reporters the slick stretched seaward about 15 kilometers from the shore, covering an area of 300 square kilometers (120

TAIPEI, August 8, 2013 (AFP) – Taiwan lifted its sanctions against the Philippines Thursday after Manila apologized for the fatal shooting of a Taiwanese fisherman, an incident which had severely strained relations. “The government of the Republic of China (Taiwan’s official title) announces that the sanction against the Philippines is removed immediately after the Filipino side has displayed apology and goodwill in written statements and action,” the foreign ministry said in a statement. The move came after Amadeo R. Perez, chairman of the Manila Economic and Cultural Office which handles relations in the absence of diplomatic ties, flew to Taiwan and offered an “official apology” on behalf of Filipino President Benigno Aquino. Tensions had risen sharply after the 65-year-old

fisherman was shot dead by Filipino coastguards on May 9 in waters near an island in the Philippines’ extreme north, which Taiwan also claims as part of its economic zone. Perez travelled to the small southern port town of Hsiaoliuchiu to meet the family of the dead man, Hung Shih-cheng. In televised comments, Perez said he wished to convey “the Philippine people’s deep regret and apology to the family of Mr Hung Shih-cheng over this unfortunate loss of life of their beloved one”. “May I respectfully present our official letter of apology to the family of Mr Hung on behalf of our president and our people,” he told Hung’s widow, before giving her the letter and shaking her hands. SUBIC BAY, August 6, 2013 (AFP) – The Philippines promised intensified sea patrols Tuesday as it welcomed the arrival of a second warship from the United States to bolster its defenses during a maritime dispute with China. President Benigno Aquino led the navy in welcoming the BRP Ramon Alcaraz, a Hamilton-class cutter that had been decommissioned by the US coast guard and acquired by Manila. The ship berthed at Subic, a former American naval base on the west coast of the main island of Luzon facing the South China Sea where the Philippines has festering territorial disputes with China. “Now that BRP Alcaraz has arrived, we will surely intensify our patrols in the Philippines’ exclusive economic zone,” Aquino said in a speech as the US envoy to Manila and other officials cheered. “It will also boost our capability to counter any threat,” he said. On the spiritual side, San Pedro Calungsod was adopted as the Patron Saint of Historic Filipinotown during a liturgy service by Reverend Father John Brannigan, followed by a symbolic release of 500 balloons and a joyous performance by the Jesus is Lord Choir. The Knights of Columbus and the El Shaddai Choir served during the holy mass. The entertainment line-up featured the GMA Variety Show with Kapuso actess Glaiza de Castro with other GMA artists, a hit performance by Filipino rock band INTRoVOYS, Ner de Leon, Lianna Gutierrez, Claire Rodriguez, Atty. Romy Mosqueda, the SIPA crew, Folklorico, a children’s fashion show by Filipino designer Lou Razon, and a presentation by the 2013 Miss Philippines USA candidates. Various competitions were held to showcase the budding beauty and talent in the community, starting with the 2013 Search for Youth Ambassadors of Historic Filipinotown, which awarded four ambassadors based on their involvement, mission and goals for the community, namely: Camille Yuson, Erica de los Santos, Alex Leap and Aislinn Sebastian. The awards were given by Cecilia Cortez Ramos and Leo Pandac. The event was concluded with the Battle of the Bands which was hosted by the

California wildfire injures 5, causes 1,800 to flee homes LOS ANGELES, August 8, 2013 (AFP) – A thousand Californian firefighters are battling a blaze east of Los Angeles that has injured five people and forced 1,800 to flee their homes, authorities said Thursday. Those hurt in the fire – estimated to cover 10,000 acres (4000 hectares) – include four firefighters and a civilian, the Riverside County Fire Department said. The civilian victim was wounded Wednesday and airlifted to a burn center, Fire Chief John Hawkins told reporters. Fifteen buildings were destroyed in the city of Banning, 90 miles (150 kilometers)

east of Los Angeles, officials said. Thirteen helicopters and six planes are in use to fight the fire, which is only 10 percent contained and has sparked the evacuation of 1,800 people in several towns near Banning. Authorities have not determined what sparked the flames. Smoke has reached the international airport of Palm Springs, but the runways remain open, director Tom Nolan told reporters. The effort to douse the flames is being complicated by high temperatures, very low humidity and wind gusts, weather forecasters said.

TUCP wants P83-P85 wage hike MANILA, Aug 8 (Mabuhay) – Militant groups held a rally at the Occupational Safety and Health Center in QC where the Regional Tripartite Wage Board held its third and final public consultation on petitions to raise the minimum daily wage. The RTWB for the National Capital Region has 30 days to decide on the issue. The two factions of the Trade Union Congress of the Philippines (TUCP) filed separate petitions. The group of Raymond Democrito C. Mendoza asked for an P85 daily minimum wage hike, while that of former Senator Ernesto F. Herrera petitioned for an P83 increase. The current minimum wage in NCR is P456 per day. Workers belonging to the militant Kilusang Mayo Uno, on the other hand, are pushing for a P125 legislated wage increase and the abolition of wage boards. KMU Chairperson Elmer Labog alleged that employers are using the wage board to continue exploiting workers. KMU cited Ibon foundation’s May 2013 study showing that the legislation of P125 across the board wage hike nationwide will only result in a 15 percent reduction in the profits of companies in the country.

Atty. Alberto Quimpo, corporate secretary of the Employers’ Confederation of the Philippines (ECOP), warned that increasing the minimum wage would result in mass layoffs and closure of companies. The ECOP filed a petition urging the wage boards to dismiss TUCP’s petition for wage increase. Alex Avila, chairman of the Regional Wage Board and Regional Director of DOLENCR, said several factors will have to be taken into consideration in approving a wage hike. These include the inflation and unemployment rates (as presented by NEDA during the hearing), oil price adjustments, rising electricity rates, etc. He said the wage board will have to do a balancing act in weighing the consequences of whatever decision they will make, not just on the labor and employer sectors, but on the country as a whole. No salary increase for gov’t workers in 2014 MANILA, Aug 7 (Mabuhay) – Budget Secretary Butch Abad has ruled out a salary increase for government employees next year. This was his response to a query by ACT teachers party-list rep. Antonio Tinio on whether or not government workers will get another salary increase. “We just finished 4 phases of [Salary Standardization Law] SSL3. And right now, as you will note, a provision for increases is not provided in 2014. We need time to assess and get into the effect and study impact and determine if another round is needed because it will entail a huge amount of money and personnel services already constitute huge chunk of budget,� he said. Tinio noted a National Economic and Development Authority study showing the benefits of the 3rd phase of the Salary Standardization Law which was concluded this year. Abad, however, said that study refers to the effects of the last SSL, and not a new SSL. (MNS)

CA orders gov’t to pay Piatco over $371-M MANILA, Aug 8 (Mabuhay) – The Court of Appeals (CA) has ordered government to pay the Philippine International Air Terminals Co., Inc. (Piatco), builder of the Ninoy Aquino International Airport (NAIA) Terminal 3, over $371 million for the expropriation of the terminal. In a 31-page decision by its Third Division dated Aug. 7, penned by Associate Justice Apolinario Bruselas, Jr., the appellate court modified the 2011 ruling of the Pasay City Regional Trial Court (RTC) Branch 117 that awarded just compensation to Piatco in the amount of $175.79 million, still less the over P3 billion or $59.44 million already paid to Piatco in compliance with a Supreme Court (SC) ruling in 2004 that it had to be paid first for building the terminal before its actual takeover could proceed. The RTC placed the net just compensation due Piatco at $ 116.35 million, minus any award of interest for government’s delay in paying the builder. Before the trial court, government argued that just compensation should be at $149.45 million. Less the amount already paid to Piatco, the actual payout should only cost over $90 million, based on this computation. Piatco, for its part, urged the trial court to award it $846.43 million, inclusive of attendant costs. Both government and Piatco appealed the lower court’s ruling before the CA. In its ruling, the appellate court ordered government to pay Piatco $371,426,688.24, representing replacement cost plus 6-percent annual interest, already less the over P3 billion actually received by the builder. “To arrive at just compensation, we (CA) simply put in the figure determined as replacement cost, which is $300,206,693 and factor in law and equity... that interest should be imposed on the amount due Piatco,� the decision read. The replacement cost corresponded to the “construction cost valuation (CCV)� for the property as of Dec. 2002 when the construction of the terminal ceased. The appellate court said that the RTC “erred� in adopting government’s position that deductions should be made from the construction cost because of depreciation. “Simple economic logic dictates that the replacement cost can never be lower than the construction cost at the time the structures were built,� the decision read. The ruling stressed that the replacement cost method used in arriving at just compensation due Piatco covered improvements based on market prices at the time of takeover in 2004, and should not factor in depreciation. The appellate court further ruled that it “cannot agree with the RTC� in also citing deterioration of the property and costs for non-compliance with contract specifications in making deductions from the payment due Piatco. Contrary to government’s claims, the appellate court said there was no proof of the terminal’s structural defects. “There is no clear evidence of any massive structural defect. What may have been considered as a manifestation of a structural defect was the much publicized collapse of a portion of the ceiling which coincidentally occurred just before the equally publicized occular inspection of the NAIA Terminal 3 premises. “The ceiling collapse, however, pertains more to a ‘finishing’ issue than a structural one,� the decision read. ‘Finishing,’ in construction lingo, deals with the “aesthetics, convenience and functionality of a built structure� but “does not relate to the stability and integrity of the structure itself,� the appellate court stressed. “Thus, a building might look ugly, worn out or deteriorated and dilapidated, but it does not necessarily mean that it is unsound. Structural defect in construction lingo relates to the very integrity and stability of the completed building itself...� the decision read. The appellate court pointed out that the mere fact that government operated the facility for the benefit of the general public “simply means that the defect is more aesthetic than structural.� “To argue [that the defect is structural] would be to indulge the thought that the Republic has chosen to gamble with general safety. The court (CA), certainly, cannot and refuses to indulge in so callous a thought,� the decision read.

PHL bans Dutchman in ‘crying cop’ case MANILA, August 8, 2013 (AFP) – A Dutch activist blamed for making a Philippine policeman cry was deported and permanently banned from the country, the immigration bureau said Thursday. The bureau said Thomas van Beersum was deported on Wednesday after the authorities had picked him out from a photograph that went viral showing him allegedly haranguing a uniformed police officer at an anti-government protest in Manila last month. Van Beersum is an “undesirable alien� who violated the terms of his tourist visa by joining a protest, immigration bureau spokeswoman Antonette Mangrobang told AFP.

“The activities he engaged in do not fall under those of a regular tourist, which are health, business or pleasure�, she added. The activist was photographed yelling at a weeping Filipino riot policeman at an anti-government protest during President Benigno Aquino’s annual policy address to parliament on July 22. Photographs of the incident, showing policeman Joselito Sevilla crying as he held back van Beersum and other activists, spread around the world on the Internet, and provoked heated debates on social media sites. The policeman later said he was crying from exhaustion and hunger after a long stint securing the area for

Aquino’s speech. Van Beersum was detained at Manila airport on Tuesday as he prepared to leave the country. The Dutchman, who said he is 21, alleged in a posting on his Facebook account late Wednesday that his 30-hour detention was a government ploy to distract attention from its shortcomings. “This harassment is obviously done to distract the people from the actual problems that the country faces, such as the almost total domination of its economy by foreign capitalists and the complicity of comprador puppets such as Aquino,� he added.

In a statement, Rep. Roy Seneres Sr., the party-list’s first nominee said the younger Napoles only wants to spare them from the controversy linked to her mother. SeĂąeres said, however, that Napoles will remain as president of the Metro Manila chapter. “She would be very busy with OFW issues. We know she could contribute a lot to our mission and advocacy,â€? Seneres claimed he does not even know Jo Christine’s mother, having come to know Janet only in news reports when the scandal broke. Napoles was supposed to replace Johnny Revilla as the party-list’s second nominee. Revilla was accused of failing to renounce his American citizenship. In choosing Napoles, the party-list had said she was able to deliver votes last May 13. ‘Fire & Powder’: A contemporary Bollywood dance fusion The world premiere of “Fire & Powder” a contemporary Bollywood dance fusion adaptaLIGHTHOUSE tion of Shakespeare’s “Romeo and Juliet “ and “West Side Story,” was recently presented by the Blue13 Dance Company at the historical Ford Amphitheatre last Saturday, August 3rd. Its a “tale of star-crossed lovers” depicted through various modern Indian dance interpretations such as “hip-hop, Bhangra, break dance and tap,” whose artistic director and lead choreographer was Achinta S. The theatre fusion ensemble portrayed the “rival houses of hip-hop Capulets” against the “Bollywood Montagues.” Bollywood soundtrack was felt throughout the entire presentation “including live drumming by Dhol Nation, and modern rock, while original music was written by composers from around the globe” such as: DJ Persyst, Plum Feat, Evan Roman, Tej Gill, Benjamin Kelly and Adam Conrad. ‘The fiercely energetic show featured 20 dancers.” The House of Montague dancers were portrayed by: “Arun Matthai as Romeo; Heather McManama as Mercurio; Rieka Toya and Gaby Alcazar as The Sister Montague; Dre Jackson as Lady Montague; and Achinta S. Eid’l Fitr is celebrated by the Muslim World for three (3) days after the end of the month of fasting. “As the teachings of The Prophet fill you with joy on this celebration, may you derive strength from your faith and open your hearts in compassion and thanksgiving; may Allah continue to bless and guide you on your journey as Filipinos and as faithful members of the Islam nation,” the President said. DIFFERENT OPTIONS AVAILABLE Short Sale: Also known as short pay-off, this is when lenders accept a discounted payoff on an existing mortgage to be sold based on the present market value. This allows the homeowners to sell the property to avoid foreclosure on their credit. Contrary to popular belief, lenders do not want to own a property and they simply want to recapture a respectable amount on their original investment. There are no upfront cost from the borrower, and the homeowner can even stay on the property during the short sale process at no cost. Short sale is an option if the homeowner has no means to continue paying the mortgage obligation due to insufficient income. Short Refinance: If your property market Value is less than the existing loan, short refinance is an option, you can lower your loan amount and mortgage payment. Other benefits are you will have an affordable mortgage payment and one mortgage payment that includes your property tax, hazard insurance, mortgage insurance, principal, and interest. Besides, you are locked to a 30-year fixed and lower interest rate loan. This option requires a two year employment, sufficient income and a credit that have no existing open collections, tax liens, and judgment. What is your exposure if your spouse is a shop-a-holic and runs though his/her credit card like there is no tomorrow? What if your spouse has a gambling problem and continues to get in debt to finance his/her gambling habits or what if your spouse has child support arrears from a previous relationship? To add insult to injury, what if you are the primary bread winner in the family working two jobs at the hospital while your spouse philanders around for BY KENNETH REYES other prospects. & DARRICK TAN Generally, the community estate is liable for a debt incurred by either spouse before or during marriage and prior to separation. The liability accrues regardless of which spouse has management and control of the property or whether one or both spouses are parties to the debt or to a judgment for the debt. Fam.C. § 910(a) and (b). The community estate are the property and earnings accumulated during the marriage. In other words, your community property can be liable to creditors of your spouse for debts accumulated even prior to marriage. The community estate liability is not limited to debts incurred for the benefit of the community. Under Family Code § 910, the community may be liable even to debts incurred by one spouse exclusively for his or her personal benefit. However, where community property is used to satisfy child support arrears arising from a previous marriage at a time where the spouse has separate property to satisfy it, the community has a right of reimbursement from the debtor spouse’s separate property up to the amount of community property used to satisfy the support obligation. What then is exempt from your spouse’s premarital debt? A non debtor spouse’s “earnings” during marriage are not liable for debts incurred by the other spouse before marriage under Family Code § 911(a). This does not include income received from passive investments through. The non debtor spouse’s earnings cannot be garnished to satisfy the debtor spouse’s prematrital debt as long as it is deposited in a separate account and not comingled with other community property. In addition, community liability for a debt “incurred during marriage does not include “the period during which the spouses are living separate and apart” before a dissolution or legal separation judgment. Family.Code. § 910 (a) and (b). Debts incurred by either spouse after separation are the debtor spouse’s separate obligation, neither chargeable against nor reimbursable from the community estate. As a result, the community estate is not liable for debts accumulated by your spouse after your date of separation. So if your spouse continues abusing his/her credit card after the date of separation, the community assets such as savings during the marriage or real property are no longer liable for those debts accumulated after separation. Those post separation debts are the debtor spouse’s separate debt. A spouse’s separate property is not liable for the other spouse’s debts, no matter when they were incurred. Family.Code. § 913(b)(1). Therefore, any savings or real estate that you accumulated prior to marriage will not be liable to your spouse’s debt whether your

spouse incurred the debt prior, during, or after marriage. A spouse’s spending and financial irresponsibility is a common cause of marital break ups. Sometimes, the non debtor spouse have to make the difficult decision of filing for divorce and dissolving the marriage as a means of self preservation and to preserve whatever is left of the community estate from total destruction from the debtor spouse. Making this move is a personal decision that only the non-debtor spouse can make. However, other factors should also be considered such as consequences to minor children. MANILA, Aug 9 (Mabuhay) – The Supreme Court (SC) asked the Department of Agrarian Reform (DAR) to respond to the allegations of farmer-beneficiaries of Hacienda Luisita in Tarlac that the land to be distributed to them has allegedly been slashed by almost 1,000 hectares. In a notice of resolution, the high tribunal, sitting in full court, gave the DAR 10 days to file a comment on a motion filed by the Alyansa ng Manggagawa sa Asyenda Luisita (Ambala) in June against the DAR. “The court resolved to...require the adverse party [DAR] to comment within 10 days from notice hereof, on the urgent omnibus motion [filed by Ambala],” said the SC. In November 2011, the SC ordered that the 4,335-hectare hacienda be distributed to some 6,000 farmer tenants, with Hacienda Luisita Inc. being paid a “just compensation” of P40,000 per hectare based on the sugar estate’s value in 1989. “However, the valuation made by the Land Bank of the Philippines, which has already been submitted to the DAR...shows that only 3,396 hectares, more or less, are to be distributed to the farm workers. Missing is 938 hectares,” said Ambala in its motion filed Thursday last week. The farmers also claimed that the valuation placed on the landholdings had gone up from the SC-sanctioned P40,000 to P70,000 per hectare, which would translate to a higher just compensation for HLI. The farmers asked the SC not only to expedite the distribution more than a year and a half after the SC ruling, but also to order the DAR to cover not only 3,396 hectares but the entire 4,335 hectares of the sugar plantation.

Senate bill seeks to give student fare discounts on weekends, holidays

MANILA, Aug 9 (Mabuhay) – Students across the country may soon have to spend less allowance money for transportation after a bill seeking to give them fare discounts even on weekends and holidays was filed in the Senate. Senate Bill 203, filed by Senator Juan Edgardo Angara, proposes the granting of 20-percent fare discounts to students on all transport utilities, including rail transits, all year round. In a statement, Angara said that students should be granted transportation discounts on weekends because they still often work on academic tasks on Saturdays and Sundays. “Students usually conduct their academic researches and group study activities during weekends. On the same note, it is only during semestral breaks and holidays that they are able to go home to their provinces to spend time with their families as well as to perform family-related duties,” the senator said. At present, students receive a 20-percent fare discount on school days by virtue of a memorandum circular issued in 2005 by the Land Transportation Franchising and Regulatory Board (LTFRB). The bill is expected to affect the income of public utility vehicle drivers and operators in the country. Angara said he expects the bill, once passed into law, to encourage students, especially the underprivileged and indigent, to attend school. “We must not only provide our young generation with a better quality of education. We must make sure that they stay in the race and do not drop out of school,” he said. A similar bill was earlier filed by Quezon City Rep. Alfred Vargas at the House of Representatives.

Aquino steps up protection of children’s rights in armed conflict

MANILA, Aug 8 (Mabuhay) – President Benigno S. Aquino III has revamped the Inter-Agency Committee on Children in Armed Conflict (IAC-CIAC) under an executive order aimed at further strengthening the government’s program for the protection of children against armed hostilities, abuse and exploitation. Executive Secretary Paquito N. Ochoa Jr. said on Thursday that President Aquino signed on August 2 Executive Order No. 138 amending Executive Order No. 56 (S. 2001), and places the IAC-CIAC under the direct supervision of the Council for the Welfare of Children (CWC), instead of the Office of the Presidential Adviser on the Peace Process (OPAPP). Under EO No. 138, the CWC will be the lead agency in the implementation of the CIAC Program Framework, which addresses the alarming involvement of children in armed conflict, either as combatants, couriers, spies, medics, cooks or their recruitment for sexual purposes, among others. The council will also be in charge of coordinating and monitoring of the program framework at all levels. The Department of Social Welfare and Development had earlier sought the establishment of the Monitoring, Reporting and Response System for Grave Child Rights’ Violations (MRRS-GCRV) in situations of armed conflict to be headed by the CWC in order step up government response to the problem of children being recruited, killed, maimed and abused in areas of armed hostilities. “Given the commonalities between the existing CIAC Program Framework implemented by the OPAPP and the proposed MRRS to be implemented by the CWC, and in line with the policy of streamlining government functions to avoid duplication of efforts, EO No. 56 is hereby amended to incorporate the proposed MRRS and reorganize the IAC-CIAC, thus strengthening the CIAC Program Framework,” Ochoa explained. The MRRS-GCRV will now serve as the monitoring arm of the inter-agency committee. The OPAPP remains a member of the inter-agency committee, along with the Commission on Human Rights (CHR); the Departments of Education (DepEd), Foreign Affairs (DFA), the Interior and Local Government (DILG), Health (DOH), National Defense-Armed Forces of the Philippines (DND-AFP), Justice (DOJ), and Social Welfare and Development (DSWD); the Philippine National Police (PNP); the Presidential Human Rights Committee (PHRC); and the Presidential Management Staff (PMS). In line with the enhancement of the CIAC Program Framework and the new set-up, Ochoa said, the CWC and member-agencies are mandated to craft a memorandum of agreement to define and delineate their functions and duties within 60 days after the presidential directive takes effect. EO No. 138 also mandates the IAC-CIAC to observe all international instruments on upholding the rights and welfare of children and other related human rights treaties in all initiatives in the formulation of guidelines and programs for the handling of children involved in armed conflict, among others. It should also conduct training, advocacy and information campaigns and capacity-building of local government units (LGUs). The Philippines is a state party to the United Nations Convention on the Rights of the Child (UNCRC) and the Optional Protocol on the Involvement of Children in Armed Conflict.

Dream 9 brings attention to needed reforms BY SEN. LELAND YEE California State Senator

Last month, we learned about nine young undocumented students who crossed the United StatesMexico border to demonstrate and bring attention to our nation’s immigration policy and demand a need for reform. The U.S. Senate recently passed landmark legislation that would bring significant changes to the immigration system, the first major reform to immigration since an amnesty bill was signed in 1986 that legalized more than 3 million immigrants. However, there is still much to discuss on this issue, including policies that protect undocumented children in our country, and keep families together. When I first heard about the detention of the Dream 9, as these nine young students are now called after the Dream Act, which provides undocumented immigrants a path to legalization, I was disappointed to hear about their treatment, placing them in solitary confinement by the Department of Homeland Security. Their unfair and psychologically harmful imprisonment was wrong. These young people deserve the dignity they are entitled to. There is ample evidence that putting children in solitary confinement has destructive consequences for their mental health. Responding to an act of protest by engaging in punitive measures that can do serious damage is inappropriate and unacceptable. Lizbeth Mateo-Jimenez, one of the students held in solitary confinement, is a bright young woman who has proven to be a productive member of the community. Through no fault of her own, she has been punished for the actions of her parents, who wanted nothing more than to provide a better life to their child. For two weeks, she was placed in 24-hour locked down, secluded, and stripped of her dignity.

One of the students was also placed on suicide watch. The fear and anxiety she suffered while in solitary confinement led her to that low of a point. Our country can do better than locking up children alone in a box for wanting a better life. On Tuesday, federal officials found that each student had credible fear of persecution in their birth country and therefore not be immediately removed without a hearing before an immigration judge. Pending those hearings, the Dream 9 has been released back into the presence and warmth of their families. This is a major victory for them and all Dreamers in the country. For many, this story brings hope to the many undocumented immigrants in this country. There are currently 1.6 million undocumented youth in the United States. According to the Pew Hispanic Center, about 39% of undocumented immigrants are protected by the Dream Act. I look forward to future discussions on this issue. The debate also continues on the issue of solitary confinement. As a child psychologist, I find the use of this extreme punishment on children shockingly antiquated and barbaric. Six states – Connecticut, Arizona, Maine, Oklahoma, West Virginia and Alaska – have already banned the practice of putting juveniles in solitary for punitive reasons. Separation from other people for extended periods of time can easily result in disorientation and hallucinations, depression, anxiety, psychosis, and self-harm. Why would our state have a policy that inflicts or worsens mental illness? In Sacramento, I have introduced Senate Joint Resolution 13, which calls upon Congress to prioritize family reunification in immigration reform. I also introduced Senate Bill 61, which address the placement of children in solitary confinement and sets strict standards to regulate and restrict its use.

Are employees required to sign a release to get their final paycheck? Q: I was terminated from work and my employer told me to sign a “release.” I was told that I would not get my final paycheck if I do not sign this document. Is this legal? A: If you were discharged from work, the employer must immediately pay all compensation due to you at the time of termination. Wages include any earned and unused vacation pay. The employer should pay you “at the place of discharge.” An employer shall not require the employee to sign a release of the employee’s right to any wages due, unless those wages have been paid. Some employers hold their employee’s final paycheck “hostage” until the employee signs a release or some type of termination form. This conduct is prohibited by law. The employer also cannot require the discharged employee, as a condition of being paid, to execute a false statement of their hours worked. A release signed by the employee under these circumstances may not be enforced. It may be a misdemeanor for an employer to violate this provision. Even if there is a dispute regarding the amount due to the employee, the employer must pay, without requiring a release,

If an employer willfully fails to pay all wages due to an employee after the termination, the employee’s wages continue as a penalty until paid, for up to 30 calendar days. This is called “waiting time penalties.” Hence, if the employee is regularly paid $120 per day, the employer may be held liable to pay up to $3,600 in penalty for not paying the terminated employee on time. Penalties may be avoided if the employer can show that a goodfaith dispute existed concerning whether any wages were due. An employee who quit or resigned from work without giving notice must be paid all wages due

within 72 hours of the resignation. If more than 72 hours’ notice of the resignation was given, then all compensation due must be paid on the last day of the employee’s work. A terminated employee may have some claims against the employer. The claims may include additional wages, discrimination, or harassment. An employer who recognizes these potential claims may offer the employee additional money in exchange for signing a release. In this instance, the employee is well advised to consult with a knowledgeable employment attorney before signing the release or any document. [C. COMMUNITY Obama links immigration reform to housing prices WASHINGTON, August 6, 2013 (AFP) – U.S. President Barack Obama will laud economic benefits of immigration reform Tuesday, most notably in increasing housing prices, still recovering after the 2008 economic crisis, the White House said. The Democratic leader is set to spend the day in Arizona, in the US southwest, for a day of housing-related activities, five years after the “subprime” mortgage crisis sparked the worst economic downturn since the Great Depression. Arizona, along with California and Nevada, was among the worst affected by the crash in home values – which dropped more than 60 percent in some places after years of boom. While prices are back on the rise, values have yet to recover to pre-2008 highs. The state is also on the U.S.-Mexico border, and immigration is a hot topic there. In a statement ahead of the trip, the White House argued that immigration reform –

championed by Obama, but stalled in Congress – would substantially increase home values. “Between 2000 and 2010, immigrants accounted for almost 40 percent of new homeowners nationwide,” the statement said, adding that eight in ten new homeowners in California were immigrants. Obama will unveil a battery of reforms and proposals to help boost the housing sector during his Arizona visit, including aid for troubled borrowers, better access to credit, and an investment program in low-priced homes. The president also wants the government to disengage from its role as a guarantor for home loans via semi-public groups Freddie Mac and Fannie Mae, so taxpayers wouldn’t be responsible for future bailouts, the White House statement said. Some of the proposals – framed as part of Obama’s initiative to help the middle class, launched in July – need congressional approval. But the Republican-dominated House of Representatives is opposed to any plan that is similar to a stimulus package. The House has also balked at approving a bipartisan Senate immigration bill that would beef up border security while providing a pathway to citizenship for 11 million illegal immigrants. Should the bill ever become law, it would be the most far-reaching immigration reform passed in nearly 30 years. Supporters of the bill had hoped to rally Republicans behind it after the increasingly powerful Hispanic vote swung against them in the 2012 elections. But many House Republicans, particularly those from conservative districts with few Hispanic constituents, have rejected the Senate bill as “amnesty” for people they view as law-breakers.

The 29-year-old billionaire spoke publicly on the issue for the first time late Monday at the debut of the autobiographical documentary “Documented” by journalist Jose Antonio Vargas in San Francisco. “This is something that we believe is really important for the future of our country – and for us to do what’s right,” the San Francisco Chronicle quoted him telling the audience. Zuckerberg appeared on stage with former Harvard University roommate Joe Green, who teamed with him to launch advocacy group Fwd.us early this year to lobby for immigration and education reform along with support for scientific research. Zuckerberg and Green sponsored the film debut event with immigrant rights group Define American, which was founded by Vargas. Five years after the burst of the subprime housing bubble wreaked havoc on the world economy, Obama made his pitch for reform on a visit to Arizona, one of the worst-hit areas. Obama hailed a recovery in the housing market – including in Arizona’s sprawling capital Phoenix – with home sales again rising and foreclosures slowing down. “Millions of families have been able to come up for air. They’re no longer underwater on their mortgages,” Obama said. But even though the worst US economic crisis since the Great Depression has eased, Obama said the United States had to do more to ensure its citizens can buy homes. “We’ve got to turn the page on this kind of bubble-and-bust mentality that helped to create this mess in the first place,” he said. “We’ve got to build a housing system that is durable and fair and rewards responsibility for generations to come.” Specifically, Obama called for the United States to “wind down” Fannie Mae and Freddie Mac, the mortgage finance giants that the government had supported for years and then finally bailed out in 2008 during the crisis. “For too long, these companies were allowed to make huge profits buying mortgages, knowing that if their bets went bad, taxpayers would be left holding the bag,” Obama said. “It was ‘heads we win, tails, you lose.’ And it was wrong,” he said. But, while embracing the role of the private sector, Obama called for a continued guarantee of a fixed rate mortgage over 30 years. “That’s something families should be able to rely on when they’re making the most important purchase of their lives,” he said. The rival Republican Party, which controls the House of Representatives, also supports ending Fannie Mae and Freddie Mac but has called for a greater market role in determining mortgage rates.

19-year-old faces child sex trafficking charges for ‘pimping’ minors SANTA ANA, California – A 19-yearold South Los Angeles man was scheduled to appear in federal court Wednesday to face charges that accuse him of acting as a pimp for underage prostitutes whose services were advertised online. Curtis Maurice Canady, 19, also known as “Cash,” was charged last week in a criminal complaint filed in United States District Court in Santa Ana with two counts of child sex trafficking. Because the victims were between the ages of 14 and 18, Canady would face a mandatory minimum sentence of 10 years in federal prison if he is convicted of either count. The statutory maximum penalty for the offenses is life in federal prison. After his arrest on July 25 as part of an FBI-led initiative called Operation “Cross Country,” Canady was charged by the

Orange County District Attorney’s Office with two counts of human trafficking with the intent to pander, two counts of pandering a minor by procuring, and one count of attempted pimping. At a court appearance this morning in the Orange County Superior Court, the District Attorney’s Office agreed to Canady’s release from custody so he could be taken into federal custody. Canady is scheduled to appear in United States District Court in Santa Ana tomorrow at 2:00 p.m. “As we focus our efforts on sex traffickers who prey upon young, vulnerable victims, we are developing new ways to identify the problem and deal with offenders,” United States Attorney André Birotte Jr. said. “This case demonstrates the value of collaborative law enforcement to most effectively bring justice to the victims of

this most troubling offense.” Officers with the Anaheim Police Department identified Canady as a trafficking suspect after interviewing victims who were working as prostitutes. Canady was subsequently arrested by members of the Orange County Child Exploitation Task Force during Operation Cross Country, which was conducted to identify sex trafficking rings and underage victims (see: http://tinyurl.com/ lenhjll). According to the federal complaint, Canady drove female prostitutes to Anaheim, including two girls who are 15 and 16. On July 25, task force investigators located one of the victims in a motel room in Los Angeles, and she not only admitted to working as a prostitute for Canady, she also said she accompanied Canady and another minor to Las Vegas, where they worked as prostitutes. During the investigation, investigators also identified one of the victims as the subject of an online advertisement for prostitution services in the Palmdale area.

“The U.S. Attorney and I will coordinate efforts to take these modern-day slave owners and human traffickers off the streets and prosecute them for the greatest possible punishment under the law for sexually exploiting children for their greedy purposes,” said Orange County District Attorney Tony Rackauckas. FBI Assistant Director in Charge Bill Lewis stated: “The targeting of minors for prostitution is on the rise in the United States. Law enforcement and the community must work together to identify victims in our own backyards, and to end the cycle of oppression endured by our nation’s children, as well as adult victims, who may be forced into prostitution against their will.” A criminal complaint contains allegations that a defendant has committed a crime. Every defendant is presumed to be innocent until proven guilty in court. The case against Canady is the result of an investigation by the Anaheim Police Department and the FBI.

Juliet Arnobit - Delos Reyes, or “Jonjie” as we dearly called her, was one of our younger or “junior sis” from the Batch ‘75 group. She portrayed the true spirit of our sorority in her quest for excellence. As a former Vice President of Business Development and International Marketing for the GMA TV Network back home, Jonjie was instrumental in spearheading the launching of GMA TV Network’s marketing reach in North America and Guam in mid 2000. Though Jonjie was seven years younger than me, our bond of sisterhood allowed not only me but all of us, her sorority sisters in extending our helping hand during her marketing outreach here in the United States. She exemplified the Sigma Delta leadership throughout her professional career, from her executive marketing position at

Jonjie has also shared her professional experience to those who yearned to be like her, as a teacher of Brand Communications at the University of Asia and the Pacific. LOS ANGELES, August 7, 2013 (AFP) – The man charged with slamming his car into tourists, killing one, on California’s famous Venice Beach Boardwalk pleaded not guilty to murder Tuesday. Nathan Campbell, 38, is being held on $1 million bail after the horrific incident that killed an Italian woman on her honeymoon and injured 11 others. In addition to the murder charge, he faces 16 counts of assault with a deadly weapon – his car – and 17 counts of hitand-run, according to the Los Angeles prosecutor’s office. A hearing was set for September 4 to determine if there is enough evidence to go to trial. If he is found guilty, he could get a life sentence. Witnesses of the crash, which occurred at around 6:00 pm local time (0100 GMT) on Saturday, said the driver of the highpowered Dodge Avenger appeared to deliberately aim at pedestrians. The driver of the car allegedly fled the scene immediately after the crash. The suspect later turned himself in for questioning at Santa Monica police station where he was formally arrested. Italian woman Alice Gruppioni, 32, died following the crash, coroner’s investigator Kristy McCracken said. An autopsy revealed she had died from trauma to the head and neck and her death was ruled a homicide, the Los Angeles medical examiner’s office said. Witnesses to the crash described a chaotic scene, with some estimating the car was going as fast as 60 miles (100 kilometers) an hour when it plowed through the crowd, though others thought it was slower. Venice Beach boardwalk is one of the most popular tourist attractions in Los Angeles, and is packed daily with visitors browsing shops and stalls. It is also home to “Muscle Beach”, an outdoor gym set beside the Pacific Ocean popular with bodybuilders.

Man who sells credit services ‘obtained lines of credit illegally’ LOS ANGELES – A Denver man who billed himself as “The Credit Line Millionaire” has pleaded not guilty to federal fraud charges that accuse him of conspiring to obtain lines of credit worth hundreds of thousands of dollars through a host of misrepresentations and falsified documents. Christopher Robert Wise, 34, was arraigned late yesterday in United States District Court after being arrested by Secret Service agents Wednesday night. Wise, who was taken into custody at Los Angeles International Airport after arriving on a flight from Puerto Vallarta, Mexico, was arrested pursuant to a four-count indictment that alleges he conspired to fraudulently obtain lines of credit from Wells Fargo Bank, Union Bank and City National Bank. tions was approved, which gave Wise a line of credit worth $175,000. At Wise’s arraignment yesterday, a trial date was scheduled for October 1. A United States magistrate judge set Wise’s bond at $150,000, but he remains in custody at this time. Rail company seeks bankruptcy after Canada disaster MONTREAL, August 7, 2013 (AFP) – The owners of a train which derailed in Canada last month leaving dozens dead has filed for bankruptcy, the company said in a statement Wednesday. Montreal, Maine & Atlantic said it was seeking bankruptcy as a direct result of the July 6 accident in the Quebec town of LacMegantic which killed 47 people. Montreal, Maine & Atlantic Railway, Ltd. has filed for Chapter 11 protection in US Bankrutpcy Court for the District of Maine, a statement said. Its sister company, Montreal, Maine & Atlantic Canada Co., meanwhile, filed a petition with the Superior Court of Quebec in Montreal. “It has become apparent that the obligations of both companies now exceed the value of their assets, including prospective insurance recoveries, as a direct result of the tragic derailment at Lac Megantic,” said Edward Burkhardt, chairman of the board of both companies. The train was carrying crude oil from the Bakken shale fields of North Dakota in 72 tanker cars near the Canada-US border to an Irving Oil refinery in New Brunswick. New government bailout for Australian auto industry SYDNEY, August 5, 2013 (AFP) – The Australian government Monday pledged a fresh Aus$200 million (US$177 million) bailout package for the car manufacturing industry as it looks to shore up struggling sectors to help the economy transition away from a mining boom. MB sales jump 22.5% in July for 7th record month of 2013 folio, with July’s top sellers comprised of the C-, E- and MClass model lines. BMW China venture to recall more than 140,000 cars: officials SHANGHAI, August 5, 2013 (AFP) – A Chinese joint venture of German car maker BMW will recall more than 140,000 cars in the world’s largest auto market over power steering defects, China’s quality watchdog said Monday. BMW Brilliance Automotive will next month start recalling 143,215 5-series cars made in the three years from August 2009, the General Administration of Quality Supervision, Inspection and Quarantine of China said in a statement. BMW Brilliance, a 50-50 joint venture with Brilliance China Automotive Holdings, will replace defective plugs on the vehicles that could cause safety hazards, the quality inspector said. The planned recall comes after BMW in late July failed to get Chinese government approval for a 9.2 billion yuan ($1.5 billion) plant expansion scheme in the northern city of Shenyang. In a statement posted on July 26, China’s environmental protection ministry said it had rejected a BMW Brilliance proposal to expand

Honda to build new auto plant in Brazil SAO PAULO, August 8, 2013 (AFP) – Japanese automaker Honda plans to build a new assembly plant in the Brazilian state of Sao Paulo with an annual capacity of 120,000 units, the company said. The $430 million facility, to be located in the city of Itirapina, 200 kilometers (125 miles) northwest of Sao Paulo, will become operational in 2015 and will double Honda’s annual output capacity in Brazil to 240,000 units. The Japanese auto giant is currently producing 120,000 units a year at its existing plant in the city of Sumare, also in Sao Paulo state. The Itirapina plant, which will employ roughly 2,000 people, is to churn out Fit-class compact vehicles which are in high demand on the world market, the statement late Wednesday said. “As the world’s fourth largest automobile market, Brazil is a very important market for Honda’s operations in South America,” said Masahiro Takedagawa, president of Honda’s Brazilian unit.

SHANGHAI, August 9, 2013 (AFP) – Growth in China’s vehicle sales slowed to an annual 9.9 percent in July, an industry group said Friday, as the world’s largest car market entered its low season. Sales totalled 1.52 million last month, the China Association of Automobile Manufacturers (CAAM) said in a statement, a slowdown in growth from June’s 11.2 percent improvement. Sales for the first seven months totalled 12.30 million units, the group said, up 12.0 percent from a year earlier but lower than the 12.3 percent growth registered in the first half. Automakers usually carry out equipment maintenance and send workers on holiday to avoid China’s hottest weather in late July and early August, CAAM said in explanation of the slowdown. Monthly passenger vehicles sales grew 10.5 percent year-on-year to 1.24 million units, the statement said, adding Chinese-brand sales increased 5.8 percent to 435,500 units to give them a 35.2 percent market share. It was their lowest share of the market since the global financial crisis in 2008, the group said, adding their situation was “grim”. Among foreign brands, German carmakers had the largest share with 21.4 percent, followed by Japanese companies on 17.6 percent and US firms with 13.6 percent. China became the world’s largest auto market in 2009. Consulting firm McKinsey forecasts the country’s passenger car market to grow an average of eight percent annually through to 2020, when sales will reach 22 million.

Ryder boss Watson hints at Tiger-Phil ‘Dream’ duo

ROCHESTER, August 7, 2013 (AFP) – U.S. 2014 Ryder Cup captain Tom Watson hinted Wednesday at a “Dream Team” pairing of world number one Tiger Woods and second-ranked Phil Mickelson next year at Gleneagles. But don’t expect the iconic 63-year-old winner of eight major titles – and nearly a ninth in the 2009 British Open at Turnberry – to necessarily pair the U.S. duo together. “You hope you can come up with an intimidation team,” Watson said Wednesday on the eve of the 95th PGA Championship. “I would think that these guys, if they got on a roll, just think what type of intimidating team they could be. That’s kind of the Dream Team.” But it didn’t work out that way at the 2004 Ryder Cup at Oakland Hills, when US captain Hal Sutton put Woods and Mickelson together for the first day and watched a nightmare unfold, including Woods glaring at Mickelson after the left-hander left him in the trees off the tee in a

crucial moment. Colin Montgomerie and Padraig Harrington beat Woods and Mickelson 2 and 1 in fourballs and Darren Clarke and Lee Westwood beat Woods and Mickelson 1 up in foursomes. “Nothing is set in stone as far as the players who are going to be on the team,” Watson said. “I know from past experience what teams seem to have worked the best and what teams didn’t work. There’s a history. I’ll use that history.” Watson could be tweaking the European side after being denied pin placements for the Johnne Walker Championship played at Gleneagles when he went for a visit. “We asked for the pin sheets and I looked at them with a smile and said, ‘You’re not going to give them to us?’ They said, ‘No, we’re not,’” Watson said. “They will give us some pin sheets. That’s not a problem. That’s no big deal. Kind of friendly repartee back and forth. “I’ve been assured the golf course will not be set up with any particular bias. It’s going to be set up by the European Tour. NEW YORK CITY, August 6, 2013 (AFP) – The return of Chicago star Derrick Rose will highlight the opening night of the NBA 2013-2014 season, with the Bulls taking on the champion Miami Heat on October 29. It’s one of three games on the slate for the league’s opening night, according to the full regular-season schedule unveiled on Tuesday. Rose missed the entire 2012-13 campaign while recovering from knee surgery and was on the sideline when the Heat eliminated the Bulls in the second round of the playoffs en route to their second straight title. The Indiana Pacers will host the Orlando Magic on the opening night undercard, and the third game will be a Los Angeles derby between the Lakers and Clippers.
