PHL blasts China over new fishing law MANILA, January 10, 2014 (AFP) – The Philippines denounced Friday a new Chinese law that Manila says compels foreign vessels to seek a permit from Chinese regional authorities for activities in large areas of the South China Sea. “We have requested China to immediately clarify the new fisheries law issued by the Hainan Provincial People’s Congress,” the Filipino foreign department said in a statement. “We are gravely concerned by this new regulation that would require foreign fishing vessels to obtain approval from Chinese regional authorities before fishing or surveying in a large portion of the South China Sea.” Press reports said the law was passed last year and took

effect on January 1. China claims almost all the South China Sea but the Philippines, Vietnam, Malaysia, Brunei and Taiwan have overlapping claims. Tensions between the Philippines and China have risen in recent years as Beijing becomes more aggressive in asserting its claims. Earlier this year Manila took Beijing to a United Nations tribunal over the contested Scarborough Shoal, which has been controlled by Chinese government vessels since last year. “This new law reinforces China’s expansive claim under the 9-dash line,” the Philippine foreign department alleged Friday, referring to China’s delineation of the

extent of its maritime territorial claim. “It is a gross violation of international law,” the statement added. “This development escalates tensions, unnecessarily complicates the situation in the South China Sea, and threatens the peace and stability of the region.” The statement said the Philippines was not the only country to be affected by the new Hainan regulations. “These regulations seriously violate the freedom of navigation and the right to fish of all states in the high seas, as provided for under UNCLOS (the UN Convention on the Law of the Sea),” it said. “Under customary international law, no state can subject the high seas to its sovereignty.”

Barefoot hordes in spectacular Nazareno procession in Manila BY JASON GUTIERREZ

Philippine National Police (PNP) Special Weapons and Tactics personnel look at the crowd next to their weapons as they maintain security during the start of a grand procession of the Jesus of the Black Nazarene in Manila January 9, 2014. The Jesus of the Black Nazarene, a life-size wooden statue of Jesus Christ carved in Mexico and brought to the Philippines in the 17th century, is believed to have healing powers in the predominantly Roman Catholic country. (MNS photo)

MANILA, January 9, 2014 (AFP) – Millions of barefoot devotees packed the Philippine capital’s streets Thursday for one of the world’s biggest Catholic parades, honoring an ancient statue of Jesus Christ they believe has miraculous powers. Chanting “Viva, Viva Senor Nazareno! (Long Live Mister Nazarene)”, frenzied pilgrims climbed over one another in the suffocating heat to touch the Black Nazarene during the ebony-hued wooden statue’s slow procession. “This has been a family tradition for years, and the Nazarene has given us many

blessings over the years,” housewife Josephine Manalastas told AFP after she and her 80-year-old mother were pulled out by medics from beneath the surging crowd. They were taken to an ambulance for treatment after a section of the crowd stampeded over a steel barrier protecting the statue’s carriage, shortly before the parade began at Manila’s largest park in the morning. Medics said the two were uninjured. But by mid-afternoon police said 879 people had been treated for various injuries as the life-sized, 406-year-old icon was borne towards its home in a central Manila church. See BAREFOOT, page 7

New system to ease nightmarish MM traffic MANILA, Jan 9 (Mabuhay) – President Benigno S. Aquino III led Wednesday the launching of the Metropolitan Manila Development Authority (MMDA) Traffic Signalization System and Command and Control Center that will ease traffic flow and enhance safety and security. The launch of the project is just in its initial phase which is worth P295 million, the President said. The government targets to complete Phase 3 of the project in 2016. “Kasabay po ng pagpapabuti natin sa mga mekanismong direktang gumagabay sa mga motorista, tinututukan din natin ang mas malaking sistemang kokontrol sa lahat ng mga ito,” the President said in a speech during the project launch. “Ang makabagong Command and Control Center pong ito ang magsisilbing utak sa pagmonitor at pagkilos ng MMDA sa masusing pangangasiwa ng sitwasyong pangtrapiko, at magiging pang-kalamidad at pampublikong seguridad.” See NEW SYSTEM, page 3

U.S. deported around 369,000 immigrants in 2013 By Anthony Advincula New America Media/Philippine Daily Inquirer

NEW YORK, January 9, 2014 – The U.S. government deported about 369,000 immigrants, including a number of Filipinos, during fiscal year 2013, according to new statistics from the Immigration and Customs Enforcement (ICE) released last month, showing a 10 percent drop from the previous year – the first since President Barack Obama took office in 2008.

Nearly 60 percent (216,810) of the total deported immigrants, the year-end report showed, had been previously convicted of a crime. Of this number, ICE apprehended and deported 110,115 individuals with a crime conviction from within the country and another 106,695 at the border while attempting to unlawfully enter or re-enter the United States. ICE officials described these figures as “meeting one or more immigration

enforcement priorities” that the Obama administration announced two years ago, stating that his administration would no longer devote federal resources to deporting immigrants with “low priority cases,” including those without a criminal record and not a threat to national security. “The 2013 numbers make clear that we are enforcing our nation’s laws in a smart and effective way, meeting our enforceSee U.S. DEPORTED, page 7

The new system can man 400 intersections in Metro Manila. Among the priorities in the project include the upgrade of traffic signal facilities in 85 priority intersections, as well as the installation of 25 high-definition CCTV cameras in strategic locations in the metro. With the use of CCTV cameras, the MMDA can control the flow of traffic at different locations through pre-planning and use of traffic lights. The control center uses, Hermes, a new traffic signal system that has the ability to track traffic and monitor various control system and future

sub-systems in real-time. “Naniniwala pa rin po tayo: Sa mga komplikadong problemang tulad ng traffic sa Metro Manila, ang pinakamainam na solusyon ay dapat nakaayon ang pondo, kakayahan, at panahon na mayroon tayo,” the President said. “Sa pagtugon sa traffic, ang kailangan natin ay isang epektibong sistema kung saan mas magiging proactive po tayo, kaysa reactive lamang.” The project is a partnership of MMDA, Spain-based technology firm Indra and the Meralco Industrial Engineering Services Corp. (MIESCOR). (MNS)

Iglesia backing Erap-GMA-Ramos alliance? MANILA, Jan 9 (Mabuhay) – The lawyer of former First Gentleman Jose Miguel Arroyo denied Thursday that the Iglesia ni Cristo is supporting a possible alliance between former Presidents Fidel Ramos, Joseph Estrada and Gloria Macapagal Arroyo. In a statement released to media, Topacio said: “ Lately, there have been reports in media attributing to the undersigned statements to the effect that the Iglesia ni Cristo (INC) is supporting the proposed so-called ‘Triple X Alliance’ of former Presidents Fidel V. Ramos, Joseph E. Estrada and Gloria Macapagal- Arroyo.”

“Such statements are INACCURATE. While the undersigned is a proud and active member of the INC, he has never pretended to speak for the Church, and his statements regarding any subject reflect only his personal or professional positions.” Talk of an alliance started after Ramos and Estrada paid a visit to former President Arroyo at the Veterans Memorial Medical Center. Arroyo, who is facing plunder charges, was placed under hospital arrest due to complications from a botched cervical spine surgery in 2011. Estrada earlier said he visited Mrs. Arroyo because he was concerned about her

health. Nothing political was discussed in the meetings, he said. Apart from the former presidents, other Arroyo visitors include Arroyo critics such

as Jesus is Lord Movement founder and leader Bro. Eddie Villanueva and retired Lingayen Dagupan Archbishop Oscar Cruz. (MNS)

Solon won’t back down on impeach moves vs SC MANILA, Jan 9 (Mabuhay) – There is no backing down on the impeachment complaint against several Supreme Court justices, according to Oriental Mindoro Rep. Rey Umali. Umali, vice chairman of the House of Representatives justice committee, said at least 169 congressmen have signed the resolution affirming the stand of solons that it is the House of Representatives Electoral Tribunal (HRET) that is the sole judge of all contests relating to elections. This is contrast to the recent move of the Supreme Court to act as arbiter in the electoral case of Rep. Regina Reyes vs Lord Allan Velasco. Umali said he is bent on pursuing an impeachment complaint against five justices who voted “in favor” of awarding the seat to Velasco. He said the primary charge that will be enunciated in the complaint will be Betrayal of Public Trust. “The judiciary must be reformed and we will pursue this in the 16th Congress,” Umali said. He, however, admitted that while he already has 169 congressmen backing him on the independence of HRET, he hopes to

get the same number of support when the impeachment complaint has been formally filed at the lower house. “Mag-uusap kami and I hope that they will continue to support me,” he said. Umali said another option is to forward the complaint straight to the Senate but he has to have 97 solons signing the complaint. “The Supreme Court cannot do this. They should rule this on the basis of law and jurisprudence,” he said. He added: “Hindi porke’t may makikinabang na kapwa nila myembro ay magbabago isip nila.” Last year, the the Philippines chief justice, Renato Corona, was impeached by the House of Representatives and later convicted by the Senate for failing to declare his assets properly, a violation of the constitution and betrayal of public trust. President Benigno Aquino III said Corona’s ouster was a “crucial step in ridding the country of pervasive corruption.: Corona was accused of failing to declare up to $12 million in bank accounts and blocking Aquino’s efforts to prosecute former president Gloria Macapagal-Arroyo for corruption.

Philippines has 343 AFVs in arsenal MANILA, Jan. 9 (Mabuhay) – The Philippine Army (PA), which has around 10 infantry divisions, is equipped with 343 AFVs (armored fighting vehicles). Capt. Anthony Bacus, Army spokesperson, said that these AFVs are distributed to the various infantry units to provide them with mobility and additional firepower. “Around 85 percent of these AFVs are on green status (fully mission capable) while another 10 percent are on yellow status (undergoing repair) and five percent

are on red (beyond repair), he added. Around 150 of the vehicles are the United Kingdom-built GKN “Simba with the remaining AFVs consisting of US designed V-150 and V-200 APCs, M-113 “Bradley, Turkish made ACV-300s and British Scorpion CVRTs. He said these AFVs give the PA its armor capability and are organized into a 14-vehicle mechanized infantry companion for deployment with regular units. (MNS)

Robin opposes lifetime tax break for Pacquiao MANILA, Jan 9 (Mabuhay) – Actor Robin Padilla criticized as “unjust a proposed bill seeking to grant Filipino boxing superstar Manny Pacquiao a lifetime exemption from paying taxes. The 44-year-old actor warned that the bill would be unfair, especially to those struggling to make ends meet. “Pag nagkaroon ng tax exemption, magrereklamo ako. Magrereklamo ka, ang daming magrereklamo. Unang-una na riyan ang mga taong hirap na hirap sa buhay, ‘tol, he said. Padilla is referring to the proposed Bill 3521, otherwise known as the Pacquiao Act of 2013, by Valenzuela City Rep. Magtanggol Gunigundo. The actor said he believes the Bureau of Internal Revenue (BIR) would not pursue the P2.2-billion tax evasion case against Pacquiao without basis or evidence, as he reacted to those defending the innocence of the Filipino boxer. “Hindi naman hahabulin ang ating

‘Pambansang Kamao,’ ang ating bayani, kung walang katwiran ang BIR. Ngayon ang akin, karapatan din ni Manny na ipagtanggol ang sarili niya. Isa lang ang hindi dapat mangyari dito, ‘yung magkaroon si Manny ng tax exemption, he said. The BIR ranked Padilla 60th in its latest list of top individual celebrity taxpayers for 2012, while Pacquiao placed 36th. Other than his political views, the action star also opened up about “10,000 Hours, his latest film that won 14 awards in the recently-concluded Metro Manila Film Festival, including Best Actor for Padilla. “Inabot kami ng mahigit dalawang taon. Maingat na maingat kami dahil halaw iyan sa storya ni Sen. Lacson. Hindi mo pwedeng babuyin yung pelikula. Mga galing ‘Bourne Legacy’ ang gumawa ng ‘10,000’. Magagaling ‘yung grupo ni Direk Joyce Bernal, he said. The Internal Revenue Services of the United States is reportedly after Pacquiao for “unpaid taxes. (MNS)

PHL military to expand counter-terrorism unit MANILA, Jan 8 (Mabuhay) – The Armed Forces of the Philippines is to triple the size of a special forces military unit that operates against armed groups responsible for deadly bombings and kidnappings of Westerners, officials said Tuesday. The Light Reaction Battalion is to be built up to regiment size, Philippine Army chief Lieutenant-General Noel Coballes said, an increase from about 500 soldiers to as many as 1,500. “We have seen how effective they are, so we are strengthening the unit in terms of anti-terrorism. From a battalion we’ll increase it to a regiment, he said. The unit is fighting the Abu Sayyaf, a bandit group behind the country’s deadliest attacks as well as kidnappings of Western targets. Defence Secretary Voltaire Gazmin said the battalion had taken substantial casualties during a three-week battle against gunmen in the southern port of Zamboanga in September last year. The gunmen are followers of former rebel leader Nur Misuari, who went into

hiding as hundreds of his men infiltrated Zamboanga to oppose a proposed peace treaty between the Philippine government and the Moro Islamic Liberation Front. The fighting left more than 240 people dead and displaced about 116,000 people as entire districts of the city of nearly a million people went up in flames. “As you have seen, we lost a number of our men in the Zamboanga incident, which led to a shortage that needed to be addressed, Gazmin said. Neither official gave a timetable, but military information chief Lt. Col. Ramon Zagala said the unit would be bulked up within the year. B“Based on what happened in Zamboanga, our military leadership saw a need to increase the strength of the Light Reaction Battalion to be able to address contingencies anywhere in the country, Zagala told AFP. The United States has trained and equipped the battalion since 2002, to help its Asian ally fight armed groups in Mindanao. (MNS)

Nancy: Don’t blame ‘Yolanda’ survivors for measles MANILA, Jan 9 (Mabuhay) – Sen. Nancy Binay on Thursday said the Department of Health should not blame parents or survivors of super typhoon “Yolanda” for the measles outbreak in Metro Manila and other parts of the country. In a statement, Binay said the DOH should assess the apparent failure of the government’s anti-measles campaign over the past years.

“Instead of blaming parents and survivors of super typhoon ‘Yolanda’ for the measles outbreak, the DOH should act now to stem any epidemic,” Binay said in a statement. The senator noted that if the DOH had the capability to conduct a door-to-door campaign for the first round of the measles immunization shots, “then they have the capability to do it one more time.” “A government agency has the resources it needs to

ensure its objectives are met. In this case targeting a ‘zero’ measles environment,” she said. Free vaccinations are supposed to be given to children between 6 and 48 months old and are given in two doses of MMR (measles, mumps and rubella) jab. Binay said the DOH can ask the help of local government units (LGUs) for the implementation and ensure success of its immunization programs.(MNS)

‘Build calamity-proof structures’, Norway FM urges PHL MANILA, Jan. 9 (Mabuhay) – Norway’s top diplomat on Thursday said the aid provided by foreign donors to typhoonravaged Visayas region must be used to fortify and build better structures that could withstand natural calamities. “It is important that aid is used as opportunity to build back better because we know this is an area very prone to natural disasters,” Norwegian Foreign Minister Borge Brende said amid reports of alleged

overpriced and sub-standard bunkhouses built for displaced victims of super typhoon Yolanda in the Visayas. Yolanda, internationally called Haiyan, was one of the strongest typhoons to hit land with fury and force Filipinos have never seen before. Tsunami-like storm surges swept away and damaged more than a million houses and left more than 6,000 people dead. Bodies continue to be found. More than 27,000 were injured and

Rehab of agri livelihood in ‘Yolanda’ affected areas to cost P6.9 B – DA MANILA, Jan 8 (Mabuhay) – Rehabilitation of livelihood in the agricultural areas affected by Typhoon ‘Yolanda’ is estimated to cost around P 6.9 billion, Agriculture Undersecretary Dante De Lima said in an interview with reporters Tuesday. Of the P 6.9 billion requirement, the national government has already committed to release P 1.4 billion, according to De Lima. Some of the interventions being implemented by the Department of Agriculture (DA) are clearing operations, provision of farm tractors and tools, distribution of fertilizer, fuel subsidy for farm machinery and provision of fishing boats, among others. The rehabilitation is currently focused

on strategic production zones consisting of 27 provinces in six regions which were worst hit by the typhoon. These zones include irrigation systems, agrarian reform communities, traditional food producing regions/provinces and households. The DA is also pushing for the cultivation of white corn as an alternative staple. “We are aiming to produce 100,000 metric tons of white corn by the start of the harvest season in September,” he said. “Production will focus particularly on the top 10 corn eating provinces in Visayas and Mindanao.” As of January 7, latest DA figure shows that the typhoon’s damage to agriculture stood at P31.13 billion. (MNS)

1,700 others remain missing. The United Nations said the typhoon has affected at least 14 million people and that it will take several years before the devastated areas could fully recover. Brende, who made a trip to Leyte Wednesday to inspect Norway’s assistance projects in the region devastated by the monster storm, said the government must ensure that houses, emergency centers and livelihoods should also prepare for calamities. “What we will try is to see that it is used to build these local communities in a way that can better withstand future natural disasters,” he said. Two months since the storm struck, Brende observed that the situation in the Visayas, particularly in Tacloban, Leyte and in Basey, Samar – two of the worst-hit areas – are still in a “very, very difficult situation.” Brende, former Secretary General of the Norwegian Red Cross, said he finds it

DepEd receives 1,000 sacks of rice donation for back-to-school feeding MANILA, Jan. 9 (Mabuhay) – The Department of Education (DepEd) received 1,000 sacks of rice donated by the Philippine Disaster Recovery Foundation (PDRF) in support of DepEd’s schoolbased feeding program in areas devastated by super typhoon Yolanda. Both parties signed a memorandum of agreement clarifying details of said donation. The rice will be distributed across the affected areas for the implementation of a month-long emergency feeding program for school children. Region 8 will receive the largest bulk with 400 sacks; Region 6, 300; Northern Cebu, 200, while Northern

“unfortunate” that only 40 percent of the United Nations’ $ 791-million appeal for the Philippines have been delivered. While in Leyte, Brende announced that Norway is providing additional $ 8 million to Central Philippines in response to the U.N.’s call for more aid. The fresh assistance brings Norway’s contribution to $ 43 million, making it the third largest donor to the Philippines’ rehabilitation efforts next to the United States and the United Kingdom. As the Philippine government grapples with the daunting task of reconstruction and helping affected communities in Visayas, Brende said donors should step up its aid to the country. “I am appealing to my colleagues in Europe and other colleagues that they would follow on this additional pledge so we can reach a much higher number than the 40 percent,” the Norwegian Minister said, adding that investments should also be infused in the region . (MNS)

Palawan will receive 100 sacks. The distribution has been set according to the needs as determined by DepEd regional offices. Education Secretary Armin Luistro said that the 1,000 sacks of rice are very helpful because not only will it fulfill the first few components of the school-based feeding program, it will also boost the attendance of school children. “In most schools, the attendance during the first week of class resumption was at 30 percent, by the succeeding weeks, though, we started to see an increase. When you give children something extra, like school kits and feeding programs, we motivate them to go back to school. We go over 80 percent.”

Afraid of your debt problems, think of U.S. DEPORTED Jesus resurrecting daughter of Jarius ment priorities by focusing on convicted From page 1

Are you worried that your debt problems are insurBANKRUPTCY mountable? Actually, debt problems are small potatoes in the big picture of life, death and life after death. We are temporarily here on earth en-route to eternal life in heaven with Jesus, God the Father and God the Holy Spirit. Jesus became man, suffered and died on the cross so that we can have eternal life in heaven after we die here on earth. So, when you look at your debt problems from the perspective of eternity with God in heaven, your debt problems are really nothing to worry about. What you really have to worry about is ending BY ATTY. up in hell instead of heaven when you die. LAWRENCE YANG But if you are indeed worried about your debt problems now, you can rely on Jesus who is the Almighty Creator of the universe and Who has power over death. Ask Jesus to help you out of your debt problems. He will certainly guide you towards the right path to get rid of your debt problems. Perhaps a bankruptcy 7 or 13 will relieve you of your debt problems. How many people did Jesus resurrect from the dead? The answer is 4. Jesus resurrected his friend Lazarus who had been dead and buried in a tomb for 4 days. Jesus also resurrected the dead son of the widow of Nain. Jesus also resurrected the 12-year-old daughter of Jarius who had just died. And of course, Jesus resurrected himself 3 days after His death on the cross! In Mathew, Mark and Luke appears the account of the resurrection of the 12-year-old daughter of Jarius. Having recently performed the exorcism of the legion of demons that left the possessed man and went into a herd of pigs, Jesus’ renown was quickly spreading. As He is thronged by a multitude of curious and desperate people, a distraught father bows to Him, desperately asking Him to heal his dying daughter. Jesus responds by going immediately to the home of the father, Jarius, a ruler of the same synagogue that the centurion had built for the Jews and whose servant Jesus had healed. “I am not worthy that you should come under my roof (to heal my servant), say but the word and he will be healed” said the centurion to Jesus. On the way, Jesus heals a woman with a serious blood illness. Because of the miracles that Jesus had performed, Jarius was convinced of His power. Although he expresses unhesitating faith in the ability of Jesus to heal, his faith is not equal to the centurion’s, who believed that distance was no hindrance to the infinite power of Jesus. Jarius believes that Jesus has to be physically present in his home and touch his daughter. As Jesus walks to the house of Jarius, a friend informs Jarius of the sad news, “Your daughter is dead.” Such a statement would have been devastating, but being in the presence of Jesus gave the grief-stricken father hope. Jesus is willing, even eager, to help the sick and dying. Though He refuses to flaunt His power, He is quick to glorify His Father, the one true God. As soon as Jesus hears the sad news of his daughter’s death, Jesus says “Do not be afraid; only believe, and she will be made well.” With a word of hope, He comforts Jarius. So, do not be afraid of your debt problems, only believe and you will be made well and placed on solid financial foundation. Jesus resurrects the daughter of Jarius in the presence of five appropriate witnesses; the father, mother, and only three of His disciples, Peter, James, and John. To establish the miracle’s veracity, He uses two unconverted people and three who were being converted. There are a total of ten witnesses to the miracle plus the daughter of Jarius who was dead and resurrected. Rely on the infinite power of Jesus who has power over life and death! National Day Laborer Organizing Network, also looked at the deportation numbers with skepticism. “It’s easy for the [Obama] administration to say that those deported fit their priorities when the White House has practically made sneezing a criminal act for immigrants,” Alvarado said. “These numbers may represent political calculus for the beltway but, for immigrant families, they represent our parents, siblings and loved ones.” To date, the total number of deportations has reached to more than 1.9 million since Pres. Obama was first elected in 2008, the highest record by far for any U.S president. Top 10 countries were: 241,493 Mexicans deported in 2013; Guatemala (47,769); Honduras (37,049); El Salvador (21,602); and the Dominican Republic (2,462); Ecuador (1,616); Brazil (1,500); Colombia (1,429); Nicaragua (1,383); and Jamaica (1,119). While the Philippines was not part of the list – and the year-end ICE report did not mention its ranking – the population of undocumented Filipinos (270,000) in the United States remains the second highest, slightly lower than Chinese (280,000), among the Asian groups. Asian immigrants make up 11 percent of the 11 million undocumented immigrants in the United States, living and working in the shadows. According to the U.S. Department of Homeland Security, about 4 million people born in the Philippines now live in the United States.

Church organizers said one person suffered a stroke. Large numbers of police were mustered to help maintain order along the six-kilometer (four-mile) route, but the procession was crawling so slowly that just over a third of the distance had been covered as dusk fell. As of midday organizers said this year’s crowd outnumbered the estimated nine million who attended last year, although the number could not be independently verified. Devotees climbed on each other’s shoulders to kiss the statue or wipe it with white towels and handkerchiefs. Others fought over a pair of thick lengths of rope that the pilgrims used to pull the carriage. In scenes reminiscent of a rock concert mosh pit, one determined woman surfed the crowd to reach the icon, only to fall back and sink into the sea of humanity afterwards. criminals while also continuing to secure our nation’s borders,” John Sandweg, ICE acting director, said in a news release. But the new removal figures provoked Filipino-American groups and other advocates for immigrant rights, saying that the numbers are misleading and that they don’t add up on Obama’s promise to stop unnecessary deportations, while Congress remains deadlocked on a comprehensive immigration reform that will legalize 11 million undocumented immigrants. While it is true that the Obama administration deported criminals, advocates say, the report also revealed that it ousted 151,834 individuals without a criminal conviction. Most of these immigrants only had immigration violations such as overstaying their visas, which is considered to be a civil offense, and those who are ignoring deportation orders. “The government would claim that they have achieved its enforcement goal, and that they only look for criminals. That’s all rhetoric,” said Emelyn Tapaoan, a Fil-Am adjunct professor who teaches race and ethnic studies at City University of New York’s (CUNY) Manhattan College. “If you’re undocumented, even with no criminal record, you have no immunity to deportation. That’s the truth.” Pablo Alvarado, executive director of

Q: I work in a service industry where I PROTECTING am required to drive the company vehicle to the EMPLOYEE & customer’s home or place of business to install or CONSUMER RIGHTS service the company’s product. I am not paid for the time I spend traveling from home to the customer’s location. Is this legal? A: Ordinarily, the law does not require that employees be paid for commute time from their home to their worksite. However, California law requires that employees be paid for all time during which an employee is subject to the control of the employer. If, during the commute time, the employee is really “subject to the control of BY C. JOE SAYAS, JR. the employer” then the employee must be paid for this commute time. Consider the following case: Lojack Corporation manufactures vehicle-tracking systems. Its technicians install and repair alarm and tracking systems at the clients’ locations. The technicians sued LoJack, for failure to pay them for all hours worked under the federal Fair Labor Standards Act (FLSA) and California state law. These hours included hours spent commuting while being under the control of LoJack, and hours spent performing tasks outside their shift for LoJack’s benefit. They also sought to recover payment for meal and rest breaks that were not provided. During the technician’ commute time on company vehicles, they could not stop for personal errands, take passengers, or use their cell phones (except to answer calls from company dispatchers). They were required to drive the vehicle directly from home to work site and back. Lojack’s computerized scheduling system dictated the technicians’ first assignment of the day and the order in which the tasks were to be completed. The technicians were also expected to repair and maintain the company’s vehicles on their own time and money, with no compensation. Since the technicians were required to drive the Lojack vehicle to and from the job site, and while driving, were also forbidden from attending to any personal business along the way, the technicians argued that they were under Lojack’s control. Thus, they were entitled to additional wages. Rather than continue to litigate the case, LoJack opted to settle the technicians’ claims for $8.1 million. Employees such as couriers, medical, appliance, and cable technicians, and other service representatives may travel from their homes to employer-assigned locations, using company-owned vehicles. If their commute times are subject to employer control, they may be entitled to additional wages. [C. 2014 Senior Tours, Alhambra Style Newshen colleague Lydia Solis, her sister LIGHTHOUSE Lulu Alcayde and I once experienced joining the senior outing tour sponsored by Alhambra’s Joslyn Recreation Center. They usually sponsor a couple of different tours every month. We were lucky to have joined one of LA’s “hidden treasures,” the Hsi Lai Temple tour in Hacienda Heights. It was a whole day’s worth of not only pleasurable and exciting but a spiritual experience as well. We boarded a passenger-packed luxury coach on an early weekend morning in front of the Recreation Center and we reached the Temple within half BY MYRNA AQUITANIA an hour where the view on top was exhilarating. Joslyn Recreation Center has recently published their 2014 tours and I truly recommend taking advantage of these inexpensive (minimal fees range from $12 to $20 per person, meals not included) outings because they’re really worth the minimal fee that went along with it. Following is the schedule this year: Farmer’s Market and The Grove on Friday, January 10th and the Pechanga Resort and Casino on Thursday, January 23rd. Registration for this tour was already done in December but you can check for availability of space by calling the Center at: 626/570-5056.

Lulu Alcayde at the Hsi Lai Temple in Hacienda Heights.

The historical nature of the Queen Mary tour brings you back in time to “revel in the past glories of transatlantic luxury travel,” while the creative and artistic experience at the Getty Villa will enable you to get immersed in the creative art pieces of ancient Rome and Greece, plus the breathtaking view of Malibu, where you can bring a sack lunch to eat or buy your lunch at the on-site cafe, all within a “coach ride” from Alhambra. In March, there’s a tour of Palm Springs, 8:30 am to 5:30 pm, March 13th, fee is $12.00 and Universal City, 10:00

Crackdown on illegal workers in Malaysia stars Jan. 21 MANILA, Jan 10 (Mabuhay) – The Malaysian government will commence with its crackdown on undocumented migrant workers after the three-month grace period set by their Home Ministry expires on January 21, a report from News Strait Times said. The nationwide crackdown, dubbed “Op Pemutihan,” will not only target un-

documented migrant workers but also those with incomplete papers, the report quoted Home Minister Datuk Seri Dr Ahmad Zahid Hamidi as saying. Arrest and repatriation await illegal workers once the crackdown begins, Zahid warned, noting that the Malaysian government has given these workers “ample time” to legalize their status.

Reinstating a deceased petitioner’s family based petition It is very common for beneficiaries of family based petition to wait many years before their petition’s priority date becomes current. The beneficiary has a couple of options depending on whether they are inside the US or outside the US. Alternatively, if the beneficiary is outside the US, beneficiary may seek to reinstate the petition based on humanitarian grounds. The DHS (Dept. of Homeland Security) may exercise discretion “for humanitarian reasons” to reinstate the petition and to allow the Affidavit of Support requirements to be satisfied by the qualifying I-864 of a spouse, parent, mother-in-law, father-in-law, sister-in-law, brother-in-law, grandparent, or grandchild or legal guardian of the beneficiary, as long as the petition was “approved” prior to the Petitioner’s death. that spurred a wave of foreclosures the past five years. The good news for borrowers is that the new rules will cap loan origination fees – they will be no more than 3 percent of the amount for mortgages of $100,000 and above. Currently, loan origination fees are not capped. However, to stay competitive, most lenders keep their fees low enough to attract customers yet high enough to make their business profitable. The rules establish a standard for what the government considers a “qualified mortgage.” Risky mortgages – negative-amortization, interest-only or balloon-payment loans – fall outside the qualified-mortgage standard. Lenders will be required to thoroughly verify consumers’ income, assets and obligations – or otherwise risk a lawsuit from borrowers who default on their mortgages. One example they cite is a provision in the rule that requires borrowers’ debt to make up 43 percent or less of their gross income. But some experts assert that lenders will be unwilling to make loans that don’t meet the qualified-mortgage standard. Because Fannie Mae and Freddie Mac won’t buy those mortgages, the lenders would be forced to keep them on their books. More expensive mortgages? Another criticism cited by some experts is that borrowers seeking conventional mortgages meeting the criteria of Fannie Mae and Freddie Mac may face higher fees. Fannie Mae and Freddie Mac announced this week that guarantee fees they charge to lenders for servicing their loans will rise an average of 14 basis points on 30-year fixed-rate loans, on top of the 10 basis point increases in both December 2011 and August 2012. Since borrowers are limited by qualified-mortgage rules to a debt-to-income ratio of 43 percent or less, higher mortgage rates and higher fees that increase the size of their housing payment make it more difficult for some borrowers to qualify for a loan. If you have slightly spotty credit, your income isn’t clearly defined, your assets are hard to verify or the value of your

home is difficult to appraise, you’ll have a hard time getting credit and you may not qualify at all. Seems like Overregulation is not doing anyone a favor. The problem right now in the housing market is that overregulation and capped compensation mean that many lenders will drop out of the business. Ultimately, he says, less competition among lenders will lead to higher fees and higher mortgage rates, which will hurt the housing market and particularly affect low- to moderate-income borrowers who have a harder time affording a loan. The biggest problem that everyday people are rising guarantee fees, the difficulty of selfemployed people to get a loan and the concern about loan buybacks, buybacks are major concerns of lenders in case the loan packaged is not sellable in the secondary market ( fannie or Freddie). Lenders are all just passing the buck, they only service your loan, names like BOA, CITI, Chase are all borrowing money to lend to you and they keep the servicing fees. Therefore, the true lender remains to be the two major names, Fannie Mae and Freddie Mac. Ability-to-Repay/qualified-mortgage rule: Borrowers without a lot of debt won’t be affected by this new rule, but those who have a debt-to-income ratio above 43 percent will find it harder to qualify for a loan unless they can reduce their debt or boost their income. Self-employed borrowers will need to provide more documentation of their income, and all borrowers will be required to provide extensive paperwork to prove their income and assets. The full scope of these changes, and to begin planning for implementation. Mortgagees may review Mortgagee Letter 2013-43 at www.hud.gov/lenders under “What’s New.” Should have refinanced in 2013? Oops, too late now! But I still think buying a home now at a fair market value should be considered. Call Ken Go of 1st Innovative Finance to get Pre-Approved for a new home loan. As well, TPS would provide Filipinos with the ability to obtain advance parole so that they could travel to see their loved ones overseas. The ability to obtain TPS, a work permit, and advance parole would be available to Philippine citizens who are either in the U.S. unlawfully or lawfully. TPS would also be available to those who are currently in removal proceedings, as well as those who have already been ordered deported or removed from the U.S. by an immigration judge. Filipino citizens who would not be eligible for TPS are those who have been convicted of a felony or 2 or more misdemeanors. Individuals who have been convicted of a crime involving moral turpitude or a drug-related offense also would not qualify for TPS. For individuals who are inadmissible to the U.S. for other reasons, such as because they committed fraud or misrepresentation, they would be required to apply for a waiver in order to be granted TPS. To be granted a waiver, they must demonstrate that granting of the waiver serves humanitarian purposes, family unity, or is in the public interest. An individual granted TPS would receive protected status and a work permit valid for up to 18 months. Individuals would be able to extend TPS status and benefits for up to 18 months at a time for as long as the DHS renews the TPS designation of the Philippines. Considering that it will require many years for the Philippines to recover from the unprecedented devastation caused by Typhoon Haiyan, as well as the experience of other countries

that have previously been granted TPS, ongoing renewal of TPS designation for the Philippines seems more than likely. In anticipation of TPS becoming a reality, Filipinos should start preparing the documents that will be necessary for the application. Individuals should move forward with ensuring that they have a valid government issued identification, such as a driver’s license or Philippine passport. Vital documents, like birth certificates issued by the National Statistics Office, marriage certificates, death certificates, and divorce judgments, should be obtained. Individuals should also start saving documents now that show their continuous residence in the U.S., such as employment records, rent receipts, utility bills, school records, and medical records. The DHS would specify a strict filing period of typically 6 months wherein individuals can submit TPS applications. Although there are provisions for filing late applications, it is very limited and restricted. Accordingly, individuals must be proactive in ensuring that they timely submit well-prepared applications, as the opportunities that would be provided under TPS are life altering. OPINION

Republicans say US war on January is National Thank You Month Danke, grazie, poverty hasn’t measured up merci, gracias, AROUND WASHINGTON, January 8, 2014 (AFP) – US conservatives seized on Wednesday’s 50th anniversary of the launch of president Lyndon Johnson’s “war on poverty” to dispute the effectiveness of existing policies, and urge a welfare state overhaul. “Five decades and trillions of dollars after president Johnson waged his war on poverty, the results of this big-government approach are in,” Republican Senator Marco Rubio, a potential White House aspirant in 2016, said in a speech in the US Capitol’s appropriately named Lyndon Johnson room. “We have four million Americans who have been out of work for six months or more,” he went on. “We have a staggering 49 million Americans living below the poverty line.” Johnson’s historic initiative achieved some noble victories in battles to help low-income Americans, some Republicans said, but the war is far from won, and perhaps slipping into stalemate. “I don’t argue with the intentions, I just believe they over-estimated the ability of government to have the effects that they anticipated,” Senator John McCain, who unsuccessfully challenged now-President Barack Obama for the White House in 2008, told AFP. “So the grade, probably, is mixed.” Reforms proposed by conservatives include slashing aid like food stamps, which are distributed to needy families, repackaging costly entitlement programs, and expanding training for the unskilled and unemployed. Anti-poverty programs help mitigate the impact of poverty, but throwing financial aid at the problem does not tackle its cause, Rubio said. “We have the single greatest engine of upward mobility in human history at our disposal: the American free enterprise system.” House Speaker John Boehner stressed that the Republican Party is doing its part, by pushing employment-generating legislation. “The one solution that we all know that works is a job,” Boehner said. The anniversary of Johnson’s 1964 speech comes as Obama and Democratic allies seek to extend benefits for the long-term unemployed, a move many Republicans oppose for budgetary and ideological reasons. Democrats are also trying to increase the hourly minimum wage from $7.25 to over $10, but again they face Republican opposition. The White House has framed these two measures in the wider context of the fight against inequality, which Obama intends to make one of the political themes of 2014. On Wednesday he praised the social safety net in place for half a century, beginning with the public pension system known as Social Security and public health care for seniors, called Medicare. The remaining poverty should only harden American resolve to strengthen existing programs, Obama said. “If we hadn’t declared ‘unconditional war on poverty in America,’ millions more Americans would be living in poverty today,” he added. But Republican Senator Rob Portman said Obama’s policies have failed to generate enough job growth to tip the scales. “If LBJ looked today, 50 years later, he’d be surprised that we still have such high rates of poverty, and it’s actually gone up in the last four years, not down,” Portman said.

And what a more perfect time to say thank you than at the beginning of the year to celebrate the beginning month of the year with a declaration of January a “Thank You Month”. Most of the 196 countries have the expression for “thank you” that sometimes gets lost as people age and are affected by the hustle and bustle of life. They forget about being polite and acknowledge people for the kind tasks they do on a daily basis. Being thankful researchers have found out give recipients of the gesture “a kind of dopamine rush - an experience linked with pleasurable experience” that will make them want to feel the experience again. January as a national thank you month is considered by some as an “impressive observance that encourages people to be thankful and show gratitude to others who have been most helpful”. That feeling of gratitude is an overwhelming feeling expressed in thankfulness. January is a good start to say “thank you” or show gratitude because it is not only a good start

Manila now a top real estate investment market in Asia – survey MANILA, Jan 10 (Mabuhay) – Manila has emerged as one of the top real estate investment markets in Asia for 2014, according to a new survey by the Urban Land Institute and PwC. In ULI and PwC’s “Emerging Trends in Real Estate Asia Pacific” report, Manila ranked fourth out of 23 Asian cities in terms of city investment prospects. Tokyo, Japan regained its status as the region’s most popular investment destination, followed by Shanghai and Jakarta. Manila outranked Sydney (5th), Guangzhou (6th), Singapore (7th), Beijing (8th), Osaka (9th) and Shenzen (10th). The report attributed for the Philippine capital’s rapid rise in the survey to its fast-growing economy, as well as its increasing popularity as a destination for multinational companies for outsourced services. Also cited were the perceived improvements in transparency and governance issues that have long plagued the country. “A big mover is Manila, which is up to 4 from 12 last year... We’ve been hearing for a couple of years now the success and impact of the BPO sector, as well as the positive demographics and GDP growth,” John Fitzgerald, ULI Asia Pacific chief executive, said during a presentation on Thursday evening. Fitzgerald said the survey showed investors are increasingly willing to look at emerging markets such as Manila and Ja-

karta, as alternatives to traditional markets. The city of Manila, which ranked 8th in city development prospects in the survey, was also cited for its young demographic, strong capital inflows from overseas workers, and a workforce with a cultural affinity with the West. “Despite the impact of super typhoon Yolanda and the expected withdrawal of the US Federal Reserve’s economic stimulus, there are other factors going for us, such as the recordsetting remittances from OFWs, increased number of investments and the lower cost of borrowing,” Alexander Cabrera, chairman and senior partner at Isla Lipana & Co., PwC member firm in the Philippines, said. But the report noted that Manila can be a difficult place to invest in due to “laws that prevent foreigners from majority ownership of land and partly because there is already plenty of domestic liquidity.” Manila also received a “buy” rating for its residential, office and retail sectors, showing the investors’ confidence in the local market. “Manila is a favorite for the office sector, as it was for residential, and for many of the same reasons: an influx of foreign companies has arrived on the market, supporting already buoyant sentiment in a strong economy. Manila also offers the highest prime office yields in Asia, averaging

about 10%,” the report said. The Emerging Trends report indicated a generally positive outlook for the real estate markets in the Asia Pacific region, particularly Japan’s return as the favorite market for investment and development. Japan’s resurgence was attributed to the government’s massive economic stimulus plan, which led to many investors snapping up properties in anticipation of higher prices. Emerging Trends provides an outlook on Asia Pacific real estate investment and development trends based on opinions of international real estate professionals. HEALTH & BEAUTY

Even without weight loss, Mediterranean diets stave off diabetes (Relaxnews) – A new study finds that even if you don’t lose weight or boost exercise, following a Mediterranean diet can help prevent the onset of type 2 diabetes. In the Spanish study, people at risk for heart disease who followed a diet of fruits, vegetables, whole grains, fish, and fats from nuts or olive oil were about 30 percent less likely to develop diabetes over a four-year period than those who ate a low-fat diet.

The research was a subanalysis of last year’s influential PREDIMED study, involving 7,447 subjects at high risk for cardiovascular disease. Researchers from Universidad de Navarra found that subjects who ate a Mediterranean diet had a 30 percent greater reduction in the risk of heart attack, stroke, or death from cardiovascular disease than those who ate a low-fat diet. The new paper, published this week in the Annals of Internal Medicine, looked

at the development of diabetes among 3,541 subjects who didn’t have diabetes at the beginning of the study. Even just adding olive oil to your diet resulted in a health boost, the study suggests. Participants who added fats from extra-virgin olive oil were 40 percent less likely to develop diabetes during the study compared with those who followed a low-fat diet. Recent evidence from Harvard Medi-

cal School and Brigham and Women’s Hospital in Boston also found that middle-aged women who follow a Mediterranean diet may live healthier, longer lives. Scientists evaluated the diets and medical records of 10,670 women and found that after 15 years those women who followed a Mediterranean diet were 40 percent more likely to survive to age 70 or over without heart disease, diabetes, or other chronic disease.

COMMUNITY Filipino films make waves in Palm Springs International Film Festival BY FE P. KOONS

Palm Springs, CA – Three very moving Filipino films attracted audiences in the Palm Springs International Film Festival last weekend Jan. 3-5 at the Regal Cinema. Iloilo which garnered the Cannes D’Oro award for first time filmmakers at the Cannes packed the theater. Anthony Chen, director of the film revealed how glad he is in showing the film. Chen confessed that the film is really about how families in Singapore and in

Asia tried to survive the hard economic times. He revealed that the real maid from Iloilo who took care of him was present in the screening of the film in Singapore. Angeli Panganiban who played the nanny Terry acted very well in her cool, calm manner. She also showed a natural way of bonding with the little boy she is taking care and still maintaining a relationship with the biological Singaporean who has nasty attitude against her. Iloilo showcases the experience of an overseas worker who

Transit . Hannah Espia makes it known that the story centers on laws affecting some of the 40,000 Filipinos currently living and working in Israel. The four year old son of Moises (Ping Medina) gets deported to Manila after he was found by the Israeli police. Irma Adlawan who played as Janet the grandmother of the young boy is an outstanding actress in the film. Transit focuses on the lives of displaced people those seeking asylum or foreign workers who chose to live in a foreign land for better wages. Espia who graduated from the UP Film Center revealed that her parents own a travel agency. “I was in a flight from Tel Aviv to Manila. I saw this baby who kept crying. The mother said that they are being deported to Manila. So I decided to write about this issue. Paul Soriano added that when the film was shown in Israel, the ambassador said that the movie showed the universal theme of love. Espia said that this law in Israel needs to be re-looked at because of it is not a fair law. The film distribution of Transit is handled by Electric Entertainment headed by Fil-Am producer Dean Devlin. The Palm Springs International Film Festival ends on January 13.

Consulate attends Commemoration of the 117th Martydom of Dr. Jose Rizal Los Angeles, 03 January 2013 – The City of Carson in cooperation with Dr. Jose S. Rizal Monument Movement (JPRMM) commemorated the 117th Martyrdom of Dr. Jose S. Rizal with a wreath laying ceremony on 29 December 2013 at the International Sculpture Garden, City of Carson, California. The Philippine Consulate General in Los Angeles, led by Consul Marlowe Miranda, and the City Council of Carson, led by Mayor Jim Dear and Mayor Pro Tem Elito Santarina, laid their respective wreaths at the foot of the Rizal Monument. The event was participated in by leaders of the various Filipino-American associations in Southern California. The program included invocation by Ms. Naomi Ar-

mada, Founder and Executive Director of the Philippine Heritage Institute International (PHII) and welcome remarks by JPRMM Chairman Mr. Chito Mandap. Officials of the City of Carson, Mayor Jim Dear and Mayor Pro Tem Santarina, delivered brief messages recognizing the event the mainstreaming of Filipino culture in America. Mr. Santarina also read the complete text of City Resolution 13-121 which was recently passed by the Carson City Council, declaring 30 December of every year as Rizal Day in that city. The Rizal Monument, with the statue standing at 8 feet on top of a 7-foot granite pedestal, was unveiled in Sept. 2012 and is the first monument to be installed in the International Sculpture Garden of Carson.

deals with loving a child not her own and inculcating in him the important values of love and family. Metro Manila is more of an exciting film which focuses on the intertwining lives of two armored car security guys. Lead actor Jake Macapagal (Oscar Ramirez) pointed out that the film exposes the poverty in the countryside. “There is really no method acting to speak of. I just go out in the streets and I will live like Oscar who comes to Metro Manila an experience the reality of trying to find food for his family, Macapagal said. Screenwriter Frank Flowers disclosed that he is from Cayman Islands and that there is a big Filipino community in the island. “I know how it is to see poverty outside of these borders. The story is a universal theme of survival. Sean, our film director came to Manila. He was attracted to two armored car men. He had the idea to write about them, Flowers explained. Metro Manila is the official entry of U.K. to the Oscars foreign language. It also won the audience award at the 2013 Sundance Film Festival. With growing national attention to hospital pricing practices, new data released by the nation’s largest nurses organization today showed that hospital charges continue to skyrocket with some U.S. hospitals charging more than ten times their cost – nearly $1,200 for every $100 of their total costs. NNU and IHSP list the 100 most expensive hospitals, top 10 for each state, and the 50 most expensive hospital systems. For specifics, call 510-273-2246. Key findings include: 14 U.S. hospitals charge more than $1,000 for every $100 of their total costs (a charge to cost ratio of 1,000 percent) topped by Meadowlands Hospital Medical Center in Secaucus, NJ which has a charge to cost ratio of 1,192 percent. The 100 most expensive U.S. hospitals have a charge to cost ratio of 765 percent and higher – more than double the national average of 331 percent. California, with a statewide average of 451 percent charge to cost average – meaning all its hospitals average a charge of $451 for every $100 of costs – ranks third overall among U.S. states in high charges Despite enactment of the Affordable Care Act, hospital charges recorded their single big-

gest jump, a 22 percentile point increase from fiscal year 2010-2011 to fiscal year 2011-2012 in the past 16 years for which the IHSP has analyzed the data. Six of the nine most expensive hospitals are part of two big chains, Community Health Systems, Inc. and Health Management Associates which are currently pursuing a controversial merger that critics charge would further drive up prices. For-profit hospitals continue to dominate the list of those with the highest charges. Forprofit corporations average charges of 503 percent of their costs, or $503 for every $100 of total costs. By contrast, government-run hospitals, including federal, state, county, city, or district operated hospitals, with public budgets and boards that meet in public, exercise far more restraint than for-profit or non-profit corporate chains. Average charge ratios for governmentrun hospitals are just 235 percent of their costs. Public oversight or regulation seems to help constrain excessive pricing. Maryland, probably the most regulated state in the U.S., has the lowest average charges of all the states among its 10 most expensive hospitals.

US private-sector job growth robust in December: ADP WASHINGTON, January 8, 2014 (AFP) – US private-sector job growth surged in December, topping November for the strongest pace of the year with a net new 238,000 jobs added, payrolls firm ADP said Wednesday. The number came in well above the consensus estimate of 203,000, and suggested possibly strong job growth numbers to come in Friday’s December labor report. ADP sharply revised its November number higher, to 229,000 net new jobs from the prior estimate of 215,000. The job gains in December were broad-based across industries, ADP reported. Construction added 48,000 jobs, its best month since 2006. Manufacturing gains remained strong but growth slowed a bit to 19,000. “The job market ended 2013 on a high note. Job growth meaningfully accelerated and is now over 200,000 per month,” said Mark Zandi, chief

economist of Moody’s Analytics, which helps compile the data. “It appears that businesses are growing more confident and increasing their hiring.” The upbeat ADP report came ahead of the Labor Department’s December jobs and unemployment data on Friday. Analysts on average expect job growth in both the private and public sectors of 197,000 in December, down from 203,000 in November, and the unemployment rate to hold unchanged at 7.0 percent. “While we’ve been thrown off, often, before by an overly exuberant (or under) ADP, the fact that the other surveys are suggesting that hiring is generally picking up points to upside risk to this Friday’s US payroll report,” Jennifer Lee, an economist at BMO Capital Markets, said in a research note. “So far, we’ve been above-consensus with our 204,000, but that’s probably changing as we speak.”

If you invest in a regional center, you will need only $500,000U.S. However, this is still an amount which is clearly a great deal of money. With the E-2, there is no exact amount. However, you can get an E-2 with an average of around $50,000 to $100,000U.S. investment. Obviously, this amount is much less than required for the EB-5 and opens up many more possibilities. Question: Can anybody apply for the EB-5? Answer: The answer is yes. However, this assumes they have the requisite investment and that they are not inadmissible on any other grounds. Question: Can anybody apply for the E-2? Answer: No. You must be a citizen of the Treaty Country with the United States. There are many countries that have treaties with the United States. However, many do not. If you come from a country that does not have a treaty with the United States, then the EB-5 is your option for investment. Either way, you should make certain

tedly had not built up the winter fat stores of her wild cousins – was brought inside to warm up. And in Kentucky, an escaped inmate begged to be let back into prison so he could warm up after spending the night shivering in an abandoned house. All of Canada and all the US states bar tropical Hawaii recorded temperatures below freezing on Tuesday, even usually sunny and warm Florida and California. But the most dangerous cold—cold that can cause frostbite in a minute and death in a matter of hours—hit the Midwest, dragged down as the ‘polar vortex’ brought frigid air from the Arctic. Schools, businesses and government offices were closed. Water mains and household pipes froze. Airplanes were grounded, trains were halted and roads and sidewalks became ice rinks. The town of Embarrass, Minnesota, recorded the lowest temperature in the United States Tuesday at a frigid -37 Celsius (-35 Fahrenheit). Then there was the wind chill: a calculation that represents how much colder it feels when the blinding gusts hit you in the face. That dipped as low as -52 Celsius in Montana and was in the -40 to -50 Celsius range in parts of Illinois, Indiana, Iowa, Maryland, Michigan, Minnesota, Nebraska, North Dakota, Ohio, Pennsylvania, South Dakota, Virginia, West Virginia and Wisconsin. That’s cold enough to toss a cup of boiling water into the air and watch it turn into snow before it hits the ground. The Mars Rover has been sending back daily temperature readings from its tour of the Red Planet ranging from -25 to -31 degrees Celsius (-13 and -24 degrees Fahrenheit). “To be fair, though, Mars is still way colder,” the Smithsonian Institute wrote in a blog post. “The Curiosity rover is driving around in a crater at, roughly, the equivalent latitude of Venezuela.” But then again, Mars is 78 million miles further away from the Sun. For a more Earthly comparison, the Amundsen-Scott South Pole Station recorded a temperature of -23 Celsius (-9 Fahrenheit) and a wind chill factor of -35 Celsius (-31 Fahrenheit) on Tuesday.

Tiger cracks $1.3-B in career money, tops Golf Digest list NEW YORK, January 7, 2014 (AFP) – World number one Tiger Woods has cracked $1.3 billion in career earnings by leading the Golf Digest 50 with $83 million in income last year, the magazine reported on its website Tuesday. Woods, a 14-time major champion, topped the list for the 11th time in its 11year history with $83,091,508, including an estimated $71 million off the course and more than $12 million in prize money. The story says Woods’ winnings of more than $155 million reflect less than 12 percent of his career earnings, with $1.16 billion coming from endorsements since his pro debut in 1996, a figure that continues to increase even in the wake of an infamous sex scandal and ensuing divorce. A Woods deal with Electronic Arts involving a golf video game ended at the conclusion of 2013 and, while he has not approached pre-scandal endrosement totals above $100 million a year, he has bounced back from a 2011 low of $62 million in endorsement income.

Second on the Golf Digest list for 2013 income was Phil Mickelson at $52,009,156, with an estimated $45 million in endorsements and other non-prize money income. The US left-hander won last year’s British Open and hopes to complete a career Grand Slam by winning this year’s US Open, an event where he is a record six-time runner-up. Arnold Palmer, the 84-year-old golf icon whose popularity helped spawn the television riches of today’s players, was third at $40 million, largely from licensing deals in Asia. Jack Nicklaus, who turns 74 on January 21, ranked fourth at just over $26 million. The record 18-time major champion joins Palmer and Gary Player for the annual honorary tee shots that mark the start of the Masters each year. Sweden’s Henrik Stenson, who won the US PGA Tour playoff crown and the European Tour’s Race to Dubai, was fifth at $21,444,670, with all but an estimated

$2.85 million in off-course income from his prize money. Despite a year with only one title, Northern Ireland’s Rory McIlroy was sixth on $20,608,789, with $18 million in endorsement deals including a new one with Nike for equipment that helped sting a season of struggles in which his only win came at the Australian Open. South African legend Player, 78, was seventh at just over $16 million, followed by Australian Adam Scott, who won his

first major title last year at the Masters, in eighth on $15,648,068 with $7.6 million in estimated endorsement income. South Africa’s Ernie Els and retired Australian star Greg Norman completed the top 10. Japan’s Ryo Ishikawa was the top Asian player on the list at 26th with $7,983,146 including $6.5 million off the course, while Paula Creamer was the only woman on the list at 48th with $5,281,550 including $4.5 million off the course.

Rodman sings birthday tribute to N. Korea’s Kim before game BEIJING, January 8, 2014 (AFP) – Former US basketball star Dennis Rodman sang “Happy birthday to you!” to North Korean leader Kim Jong-Un in Pyongyang Wednesday, before joining a game with fellow players to mark the event. In a video circulating online, the eccentric former NBA player can be seen walking onto an indoor basketball court in the North Korean capital to sing the birthday tribute to the young leader in front of an audience of thousands. Kim, who is believed to have turned 31 this week, watched the match with his wife Ri Sol-Ju, and other officials. Kim welcomed the team’s visit to North Korea “and said that the game served as a good occasion in promoting the understanding between the peoples of the two countries”, the official Korean Central News Agency said. Rodman, wearing a basketball jersey and dark sunglasses, gestured to the crowd in the packed stadium as he sang, while a team of blue-clad retired NBA team-mates and North Korean players clapped along. The heavily tattooed former star arrived in Pyongyang on Monday for his fourth trip to the North in 12 months, together with an assembled team of other former NBA players including Doug Christie, Craig Hodges and Charles Smith, for the exhibition game. Rodman has been widely criticized for failing to raise human rights issues or the plight of jailed American Kenneth Bae during his visits to the North and to the leader whom he calls his friend for life. “Under the right circumstances basketball can serve as a bridge to bring communities together, but these are not those circumstances,” Otis Birdsong, a four-time NBA All-Star and chairman of the National Basketball Retired Players Association, said Tuesday. The US government, which has no diplomatic ties with North Korea, has also sought to distance itself from Rodman’s approach. Rodman has rebutted the criticism, saying he simply came to celebrate his friend’s birthday, according to China’s state news agency Xinhua. “He also said he did feel the love and

enthusiasm the DPRK (North Korean) people have for their leader,” Xinhua reported from Pyongyang. Kim just last month oversaw the execution of his powerful uncle and political mentor Jang Song-Thaek on charges of treason and corruption.

Sprinter Vans achieved an annual sales total of 21,816, gaining 4.2%. Adding 9,264 units from smart, MBUSA’s year-end total hit a record 343,614, increasing 12.6% from the 305,072 vehicles sold the previous year. “It’s been an incredible year for Mercedes-Benz in every way,” said Steve Cannon, president and CEO of MBUSA. “We saw record sales, flexed our muscles across the entire product line from top to bottom and brought the customer experience to an all-time high. With the help of our dealer partners and the entire organiza-

tion behind us, we expect this beautifully choreographed series of product debuts to lead us to another phenomenal year in 2014.” Impressive increases were made in both the Mercedes-Benz passenger car and light truck categories, climbing 16.0% and 10.4%, respectively, from 2012. Annual retail volumes for the Mercedes-Benz brand were led by the C-, E- and M-Class model lines. The sporty C-Class took the top spot for the year at 88,251 units, rising 8.0% from 2012, followed by the E-Class with annual sales of 69,803, up 7.1%. The brand’s top-selling SUV, the M-Class, rounded out the top three at 41,326, up 8.5% over the previous year. Strong gains also were seen at the high end. The flagship S-Class, which reset the luxury benchmark with an all-new

generation for model year 2014, posted an annual increase of 12.8% to 13,303 units. Total sales for the SL-Class roadster rose 43.0% at 7,007. A best-ever December for the Mercedes-Benz brand yielded sales of 33,007, increasing 17.3% from the 28,145 vehicles sold in December 2012. The E-Class model line was the top volume performer for the month, jumping 25% to 8,727. Sprinter Vans, which launched a redesigned 2014 lineup in September, saw continued growth at 2,828 for the month, up 26.8%. Adding volumes of 855 at smart, MBUSA December sales reached a landmark 36,690 units, increasing 17.0% from the 31,372 vehicles sold during the same month last year. Sales of Mercedes-Benz BlueTEC diesel models totaled 1,575 in December and finished the year at 14,943. The company’s high-performance AMG models delivered

strong December sales of 1,109, bringing the year-end total to 6,906, a 3.7% increase from 2012. Separately, Mercedes-Benz Certified Pre-Owned (MBCPO) recorded sales of 9,726 vehicles in December, an increase of 40.0% compared to the 6,949 units sold in December 2012. For the year, MBCPO sold 99,075 vehicles, climbing 23.3% from the 80,380 vehicles sold in 2012. About Mercedes-Benz USA Mercedes-Benz USA (MBUSA), headquartered in Montvale, New Jersey, is responsible for the distribution, marketing and customer service for all MercedesBenz products in the United States. Autonomous cars to become the norm by 2050 (Relaxnews) – According to a new forecast from IHS Automotive, the world’s roads will be driven almost exclusively by entirely self-driving vehicles – including both privately owned cars and professional fleets – by the year 2050. The American research firm expects to see 54 million self-driving cars on the roads by 2035. IHS predicts that annual sales of autonomous vehicles will reach 230,000 by 2025 and increase exponentially over the following years, hitting 12 million a decade later. Of these 12 million vehicles, 5 million are expected to be entirely self-driving models, while the remaining 7 million will still require some level of human control. The North American market is slated to lead the autonomous vehicle market in 2035, accounting

for 29% of worldwide sales, followed by China (24%) and Western Europe (20%). According to Egil Juliussen, one of the analysts behind the report, one of the most notable effects of the spread of autonomous cars will be an improvement in road safety, as “accident rates will plunge to near zero for self-driving cars.” Juliussen also predicts a decrease in traffic congestion and pollution per car, as autonomous cars “can be programmed to be more efficient in their driving patterns.” The price markup for self-driving technology, IHS estimates, will initially stand at around $7,000 to $10,000 per vehicle, before dropping to around $1,000 on entry-level models by 2030.

Ford recently developed an entirely autonomous park assist feature that allows drivers to park the car simply by pressing a button, whether from within the car or outside of it (using a remote control). The American manufacturer is not the only brand actively developing its autonomous car technologies. Volvo will soon launch a pilot project in which 100 autonomous cars will be tested on public roads around the city of Gothenburg, Sweden. Nissan equipped a version of its all-electric car, the Leaf, with automatic driving technologies enabling it to legally travel along Japanese roads without a driver. Google, meanwhile, has been testing its driverless cars in California and Nevada for some time now.

At CES, Canadian-based QNX unveiled a partnership with Qualcomm to support the chipmaker’s new automotive platform, which connects to smartphones and offers apps for maps, speech recognition, geolocation, and vehicle analytics. At the same time, Google unveiled a partnership with General Motors, Audi, Honda and Hyundai in a new partnership to bring the Android mobile system to vehicles in a new Open Automotive Alliance. The moves come with Microsoft in a longstanding partnership with Ford, and Apple widely expected to expand its system for connecting the iPhone with automotive electronics systems.

LAS VEGAS, January 10, 2014 (AFP) – As the car becomes a connected Internet device, the titans of the tech sector are battling for control of the wheel. The war is shaping up a lot like the computer sector, with Google, Apple and Microsoft and others fighting to be in control of the vehicle’s “operating system” to deliver apps, navigation and other services. Some of those battles were played out this week at the Consumer Electronics Show in Las Vegas, which included a record nine auto manufacturers and scores of equipment makers, including software and related tech companies. “People want consumer apps in their cars, they want to connect to their smartphones, they want to connect to the cloud,” says Grant Courville, director of product management at QNX, which makes the on-board systems used on tens of millions

Infiniti reports increased sales in December NASHVILLE, Tenn. – Infiniti today reported U.S. sales of 13,232 units, an increase of 4.8 percent versus 12,627 units a year earlier. This was the best December in the luxury automaker’s history. The all-new Infiniti Q50 luxury sports sedan saw deliveries of 4,568 units in December. Overall sales of Infiniti sports sedans, which include the Infiniti G37, rose more than 13.4 percent for the month. The Infiniti QX60 7-passenger luxury crossover also had its best December ever with sales of 3,744 units, an increase of 38.3 percent. At the North American International Auto Show in Detroit on January 14, Infiniti will debut the Q50 Eau Rouge Concept, a high-performance sports sedan featuring aerodynamic design inspiration from the technical collaboration between Infiniti and four-time Formula One World Champions Infiniti Red Bull Racing. Infiniti continues to shine in the past few weeks. Just recently, the 2014 Infiniti Q50 luxury sports sedan has received an overall five-star safety rating by the National Highway Traffic Safety Administration’s (NHTSA) New Car Assessment Program (NCAP). Both the Infiniti Q50 3.7 and Q50 Hybrid models, including rear- and all-wheel drive versions, were recognized for their safety performance during government testing. “We’re pleased with NHTSA’s recognition of Infiniti’s efforts to develop some of the safest cars on the road, said Infiniti Americas Vice President Michael Bartsch. “The Q50 offers elegant design, inspired performance and ‘Five-Star’ safety. In particular, the Q50 is also the platform for us to introduce a number of world’s first

safety technologies including Active Lane Control (ALC) and Predictive Forward Collision Warning (PFCW). The National Highway Traffic Safety Administration’s New Car Assessment Program (NCAP) and its Five-Star Safety Ratings Program provide buyers with information about the overall safety of new vehicles beyond what is mandated by the federal government. Five-star is the highest possible rating for any new vehicle. NHTSA is the only organization that rates rollover resistance. 2014 Infiniti Q50 Safety Features All 2014 Infiniti Q50 models come standard with a host of active and passive safety features. Strategically constructed from ultra high strength steel, the Q50 uses zone body construction, creating a reinforced passenger compartment and front and rear crumple zones that act effectively as a safety cage to help protect both the driver and his or her passengers. In addition to using special materials, the Q50 comes standard with Infiniti’s Advanced Air Bag System (AABS), front seat-mounted side impact supplemental air bags and standard roof-mounted curtain side impact supplemental air bags for front and rear-seat outboard occupant head protection. The combination of each of these helps to give additional peace of mind to the driver and passengers. For additional information on any Infiniti vehicle, or for a full description of all of Infiniti’s advanced safety features found in the new Q50, call toll free 1-855-447-3713 or better yet visit the Infiniti of Van Nuys located at 5455 Van Nuys Blvd, Sherman Oaks, CA 91401.

Google partners with automakers for on-board Android SAN FRANCISCO, January 7, 2014 (AFP) – Google joined Monday with automakers General Motors, Audi, Honda and Hyundai in a new partnership to bring the Android mobile system to vehicles. The companies, with semiconductor firm Nvidia, announced the formation of the Open Automotive Alliance (OAA), an industry group “committed to bringing the Android platform to cars starting in 2014, according to a statement. “The OAA is dedicated to a common platform that will drive innovation, and make technology in the car safer and more intuitive for everyone, the statement added. “This open development model and common platform will allow automakers to more easily bring cutting-edge technology to their drivers, and create new opportunities for developers to deliver powerful

experiences for drivers and passengers in a safe and scalable way. The announcement comes with automakers looking at new technologies for the connected car, to bring navigation, entertainment and other applications to vehicles. Some automakers are looking at developing their own platforms, while others are considering platforms like Apple’s iOS or BlackBerry-owned QNX. But Monday’s announcement looks to put Google and Android in the driver’s seat. “Millions of people are already familiar with Android and use it every day, said Google vice president Sundar Pichai. “The expansion of the Android platform into automotive will allow our industry partners to more easily integrate mobile technology into cars and offer drivers a familiar, seamless experience so they can focus on the road.

Rolls-Royce says 2013 sales accelerate to record peak LONDON, January 9, 2014 (AFP) – German-owned luxury carmaker RollsRoyce said Thursday that sales accelerated in 2013 to strike a new record for the fourth year in succession, aided by emerging markets. The British brand, which is owned by Germany’s BMW, said in a statement that car sales rose by 1.5 percent to 3,630 vehicles last year, up from 3,575 in 2012. “I stated at the beginning of last year that I wished to see further sustainable growth, I am therefore delighted with this fourth successive record year, a result that reaffirms our leadership of the super-luxury segment, said Torsten MullerOtvos, chief executive of Rolls-Royce Motor Cars. “This is an extraordinary British manufacturing success story borne out of a commitment to delivering only the very finest super-luxury goods. I am particularly satisfied to report that this result is based on a balanced global sales picture, with continued success in emerging markets paving the way for future sustainable growth. Sales growth was particularly strong in the Middle East and China.

KIA Motors America announces second best full-year sales in company history U.S. sales surpass half a million vehicles for second straight year; Optima achieves all-time single nameplate sales record with 155,893 units sold IRVINE, Calif., January 3, 2014 – Kia Motors America (KMA) today reported the company’s second-best annual sales in 2013 of 535,179 vehicles following the delivery of seven all-new or significantly redesigned vehicles over the course of the year. For the second straight year the U.S.-built* Optima was KMA’s bestseller and December’s total of 33,631

units helped the midsize sedan set an alltime single nameplate annual sales record for the brand at 155,893 vehicles. Since debuting in 2009, sales of the funky Soul urban passenger vehicle have increased each year and that trend continued with Kia’s iconic people mover surpassing the 118,000 unit mark following the arrival of the all-new, second generation vehicle in the fourth quarter. With 2014 marking Kia’s 20th anniversary in the U.S. market, the company’s aggressive new vehicle launch cadence

will continue with the scheduled Spring arrival of the all-new 2015 K9001 rearwheel-drive flagship sedan, which was unveiled at the Los Angeles Auto Show. A long-awaited all-new minivan and the company’s first-ever electric vehicle also are scheduled to launch in 2014. Just recently, Kia Motors America’s (KMA) popular urban passenger vehicle, the all-new 2014 Soul, earned the National Highway Traffic Safety Administration’s (NHTSA) 5-Star overall safety rating. With its extensive list of standard safety features and use of high-tensile steel, Soul earned five stars in the frontal and side impact tests and four stars in the roll-over test. Starting at $14,7001, the Soul offers families fun and funky design with loads of available features at a great value. “Soul’s 5-star safety rating speaks to Kia’s commitment to our customers. Our vehicles combine top-level safety with iconic design, world-class quality and, of course, the outstanding value for which our brand is well known,” said Michael Sprague, executive vice president, marketing & communications, KMA. “We took a great deal of care with the design and engineering of the second-generation Soul, and NHTSA’s testing has validated that effort.” An impressive 66 percent of the allnew Soul’s chassis utilizes either Ultra High Strength Steel (35 percent) or High Strength Steel (31 percent). The 2014 model offers consumers invaluable

protection in the form of standard safety features and technology, including six standard airbags (dual advanced front and front seat-mounted side air bags, full-length side curtain air bags) and a four-channel, four-sensor Antilock Brake System (ABS) with Electronic Brake Force Distribution (EBD), which takes into account vehicle load and weight distribution and applies the appropriate stopping force to improve control and stability. Additional standard safety equipment for Soul includes Hill-start Assist Control (HAC), Tire Pressure Monitoring System (TPMS), Electronic Stability Control (ESC) and a Traction Control System (TCS). In conjunction with the ABS, the TCS uses brake and engine torque intervention to enhance traction during launch and acceleration on slippery road surfaces. If the ABS system detects wheel slip, it signals the engine control unit to adjust torque output accordingly. TCS also senses when one or more wheels spin faster than the vehicle’s speed, and if necessary, applies the brakes accordingly. Working together, the two systems limit wheel spin and help the driver maintain control. Kia of course offers a 10-year or 100,000 mile warranty, assuring you of a reliable vehicle for many, many years. For a long lasting vehicle, call the Car Pros Kia at 310-816-9800 or the Number 1 Kia Dealership in the whole of California. Kia Pros is located at 21243 S. Avalon Blvd., Carson, CA 90745.
